61. Sacrificial Animals
٦١۔ كِتَابُ الضَّحَايَا
[Machine] The Sheikh is Ibrahim Al-Uqayli and his uncle is Thawr Ibn Qudamah.
الشَّيْخُ هُوَ إِبْرَاهِيمُ الْعُقَيْلِيُّ وَعَمُّهُ ثَوْرُ بْنُ قُدَامَةَ
[Machine] Not to eat cheese except what the people of the Book have made.
أَنْ لَا تَأْكُلُوا مِنَ الْجُبْنِ إِلَّا مَا صَنَعَ أَهْلُ الْكِتَابِ
[Machine] Abdullah, son of Mas'ood, said, "Eat cheese, for it is what the Muslims and the People of the Book have made."
قَالَ عَبْدُ اللهِ هُوَ ابْنُ مَسْعُودٍ ؓ كُلُوا الْجُبْنَ مَا صَنَعَ الْمُسْلِمُونَ وَأَهْلُ الْكِتَابِ
[Machine] All that the Muslims and the People of the Book have done and narrated to us like this is from Abdullah ibn Abbas and Anas ibn Malik. And this is because the carcass of an animal is slaughtered, and the leak that is used to cure the cheese is taken from it. So if it is from the sacrifices of the Magians and the people of idols, it is not permissible. And likewise, when the animal dies, and the leak is taken from it, it is not permissible.
كُلْ مَا صَنَعَ الْمُسْلِمُونَ وَأَهْلُ الْكِتَابِ وَرُوِّينَا مِثْلَ هَذَا عَنْ عَبْدِ اللهِ بْنِ عَبَّاسٍ وَأَنَسِ بْنِ مَالِكٍ وَهَذَا لِأَنَّ السِّخَالَ تُذْبَحُ فَتُؤْخَذُ مِنْهَا الْإِنْفَحَةُ الَّتِي بِهَا يَصْلُحُ الْجُبْنُ فَإِذَا كَانَتْ مِنْ ذَبَائِحِ الْمَجُوسِ وَأَهْلِ الْأَوْثَانِ لَمْ يَحِلَّ وَهَكَذَا إِذَا مَاتَتِ السَّخْلَةُ فَأُخِذَتْ مِنْهَا الْإِنْفَحَةُ لَمْ تَحِلَّ
[Machine] So do not eat it, as some of the companions did not inquire about it to prioritize purity. This is narrated from Ibn Abbas and Ibn Umar, and others, while some of them inquired about it as a precaution. It is narrated from Abu Mas'ud al-Ansari that he said, "Delaying a meal from this palace is more beloved to me than eating cheese that I do not inquire about." And Al-Hasan al-Basri said, "The companions of Muhammad ﷺ would inquire about cheese but would not inquire about ghee."
فَلَا تَأْكُلْهُ وَقَدْ كَانَ بَعْضُ الصَّحَابَةِ ؓ لَا يَسْأَلُ عَنْهُ تَغْلِيبًا لِلطَّهَارَةِ رُوِّينَا ذَلِكَ عَنِ ابْنِ عَبَّاسٍ وَابْنِ عُمَرَ ؓ وَغَيْرِهِمَا وَبَعْضُهُمْ يَسْأَلُ عَنْهُ احْتِيَاطًا وَرُوِّينَا عَنْ أَبِي مَسْعُودٍ الْأَنْصَارِيِّ أَنَّهُ قَالَ لَأَنْ أَخِرَّ مِنْ هَذَا الْقَصْرِ أَحَبُّ إِلِيَّ مِنْ أَنْ آكُلَ جُبْنًا لَا أَسْأَلُ عَنْهُ وَعَنِ الْحَسَنِ الْبَصْرِيِّ قَالَ كَانَ أَصْحَابُ مُحَمَّدٍ ﷺ يَسْأَلُونَ عَنِ الْجُبْنِ وَلَا يَسْأَلُونَ عَنِ السَّمْنِ
[Machine] We used to eat cheese during the time of the Messenger of Allah ﷺ , and after that, we did not inquire about it. Anas used to only eat what the Muslims and the people of the book made. Aban ibn Abi Ayyash left it.
كُنَّا نَأْكُلُ الْجُبْنَ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ وَبَعْدَ ذَلِكَ لَا نَسْأَلُ عَنْهُ وَكَانَ أَنَسٌ لَا يَأْكُلُ إِلَّا مَا صَنَعُ الْمُسْلِمُونَ وَأَهْلُ الْكِتَابِ أَبَانُ بْنُ أَبِي عَيَّاشٍ مَتْرُوكٌ
[Machine] I said, "O Abu Abdur-Rahman, I mean, to Ibn Umar or someone else. I passed by a dead chicken and I stepped on it. Then, an egg came out of its belly. Should I eat it?" He said, "No." I said, "O Abu Abdur-Rahman, I passed by a dead chicken and I stepped on it. Then, an egg came out of its belly. I hatched it and it produced a chick. Should I eat it?" He asked, "Where are you from?" I replied, "I am from the people of Iraq."
قُلْتُ يَا أَبَا عَبْدِ الرَّحْمَنِ يَعْنِي لِابْنِ عُمَرَ أَوْ قَالَ غَيْرِي مَرَرْتُ عَلَى دَجَاجَةٍ مَيْتَةٍ فَوَطِئْتُ عَلَيْهَا فَخَرَجَتْ مِنِ اسْتِهَا بَيْضَةٌ آكُلُهَا؟ قَالَ لَا قَالَ يَا أَبَا عَبْدِ الرَّحْمَنِ مَرَرْتُ عَلَى دَجَاجَةٍ مَيْتَةٍ فَوَطِئْتُ عَلَيْهَا فَخَرَجَتْ مِنِ اسْتِهَا بَيْضَةٌ فَفَرَّخْتُهَا فَأَخْرَجَتْ فَرْخًا آكُلُهُ؟ قَالَ مِمَّنْ أَنْتَ؟ قَالَ قُلْتُ مِنْ أَهْلِ الْعِرَاقِ
