61.73 [Machine] What has been narrated about the hedgehog and ground insects

٦١۔٧٣ بَابُ مَا رُوِيَ فِي الْقُنْفُذِ وَحَشَرَاتِ الْأَرْضِ

Numaylah said: I was with Ibn Umar. He was asked about eating hedgehog. He recited: "Say: I find not in the message received by me by inspiration any (meat) forbidden." An old man who was with him said: I heard AbuHurayrah say: It was mentioned to the Messenger of Allah ﷺ. Noxious of the noxious. Ibn Umar said: If the Messenger of Allah ﷺ had said it, it is as he said that we did not know. (Using translation from Abū Dāʾūd 3799)   

البيهقي:١٩٤٣١أَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ مُحَمَّدُ بْنُ بَكْرٍ ثنا أَبُو دَاوُدَ ثنا أَبُو ثَوْرٍ إِبْرَاهِيمُ بْنُ خَالِدٍ الْكَبِّيُّ ثنا سَعِيدُ بْنُ مَنْصُورٍ ثنا عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدٍ عَنْ عِيسَى بْنِ تُمَيْلَةَ عَنْ أَبِيهِ قَالَ كُنْتُ عِنْدَ ابْنِ عُمَرَ ؓ فَسُئِلَ عَنْ أَكْلِ

الْقُنْفُذِ فَتَلَا {قُلْ لَا أَجِدُ فِي مَا أُوحِيَ إِلِيَّ مُحَرَّمًا} [الأنعام 145] الْآيَةَ قَالَ شَيْخٌ عِنْدَهُ سَمِعْتُ أَبَا هُرَيْرَةَ ؓ يَقُولُ ذُكِرَ عِنْدَ رَسُولِ اللهِ ﷺ فَقَالَ خَبِيثَةٌ مِنَ الْخَبَائِثِ فَقَالَ ابْنُ عُمَرَ ؓ إِنْ كَانَ قَالَ رَسُولُ اللهِ ﷺ هَذَا فَهُوَ كَمَا قَالَ هَذَا حَدِيثٌ لَمْ يُرْوَ إِلَّا بِهَذَا الْإِسْنَادِ وَهُوَ إِسْنَادٌ فِيهِ ضَعْفٌ

[Machine] Um Hufaid brought a lizard and a porcupine to the Messenger of Allah ﷺ , and she placed them in front of him. He wiped them off and said, "These are not permissible to eat." We have also been informed about this narration from Shu'bah, who reported it from Ja'far ibn Abi Bashir, but it was mentioned without mentioning the porcupine. And likewise.  

البيهقي:١٩٤٣٢أَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ بِشْرَانَ بِبَغْدَادَ أنبأ أَبُو جَعْفَرٍ مُحَمَّدُ بْنُ عَمْرٍو ثنا أَحْمَدُ بْنُ زُهَيْرٍ ثنا هَوْذَةُ بْنُ خَلِيفَةَ ثنا عَوْفٌ ثنا جَعْفَرُ بْنُ أَبِي وَحْشِيَّةَ عَنْ سَعِيدِ بْنِ جُبَيْرٍ قَالَ

جَاءَتْ أُمُّ حُفَيْدٍ بِضَبٍّ وَقُنْفُذٍ إِلَى رَسُولِ اللهِ ﷺ فَوَضَعَتْهُ بَيْنَ يَدَيْهِ فَنَحَّاهُ وَلَمْ يَأْكُلْ هَذَا مُرْسَلٌ وَقَدْ رُوِّينَاهُ مِنْ حَدِيثِ شُعْبَةَ عَنْ جَعْفَرٍ أَبِي بِشْرٍ مَوْصُولًا دُونَ ذِكْرِ الْقُنْفُذِ وَكَذَلِكَ  

رَوَاهُ أَبُو عَوَانَةَ عَنْ أَبِي بِشْرٍ مَوْصُولًا دُونَ ذِكْرِ الْقُنْفُذِ ثُمَّ هَذَا إِنْ صَحَّ لَمْ يَدُلَّ عَلَى التَّحْرِيمِ وَكَأَنَّهُ عَافَهُ كَمَا عَافَ الضَّبَّ

[Machine] I accompanied the Messenger of Allah ﷺ and I did not hear any prohibition regarding the crawling creature of the earth. And if it is proven to be permissible, it does not indicate its prohibition. And whatever he did not hear and someone else heard, the ruling belongs to the one who heard it and not to him. We have been narrated from the Prophet ﷺ what indicates the prohibition of scorpions and snakes. Likewise, the same applies to what has a similar meaning, which the Arabs consider repulsive and do not eat except out of necessity. And Allah knows best.  

البيهقي:١٩٤٣٣أَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ مُحَمَّدُ بْنُ بَكْرٍ ثنا أَبُو دَاوُدَ ثنا مُوسَى بْنُ إِسْمَاعِيلَ ثنا غَالِبُ بْنُ حُجْرَةَ حَدَّثَنِي مِلْقَامُ بْنُ تَلْبٍ عَنْ أَبِيهِ قَالَ

صَحِبْتُ رَسُولَ اللهِ ﷺ فَلَمْ أَسْمَعْ لِحَشَرَةِ الْأَرْضِ تَحْرِيمًا وَهَذَا إِنْ صَحَّ لَمْ يَدُلَّ عَلَى الْإِبَاحَةِ وَمَا لَمْ يَسْمَعْهُ وَسَمِعَهُ غَيْرُهُ فَالْحُكْمُ لِلسَّامِعِ دُونَهُ وَقَدْ رُوِّينَا عَنِ النَّبِيِّ ﷺ مَا دَلَّ عَلَى تَحْرِيمِ الْعَقْرَبِ وَالْحَيَّةِ فَكَذَلِكَ مَا فِي مَعْنَاهُمَا مِمَّا يَسْتَخْبِثُهُ الْعَرَبُ وَلَا تَأْكُلُهُ فِي غَيْرِ الضَّرُورَةِ وَاللهُ أَعْلَمُ
