61. Sacrificial Animals
٦١۔ كِتَابُ الضَّحَايَا
[Machine] The Messenger of Allah ﷺ forbade eating carcasses and their milk. Shakir opposed him, as did Laith bin Abu Sulaim.
نَهَى رَسُولُ اللهِ ﷺ عَنْ أَكْلِ الْجَلَّالَةِ وَأَلْبَانِهَا خَالَفَهُ شَرِيكٌ عَنْ لَيْثِ بْنِ أَبِي سُلَيْمٍ
[Machine] The Messenger of Allah ﷺ on the day of the conquest of Mecca regarding the spoils of war and plunder, and it was also narrated from another source about Ibn Umar.
رَسُولُ اللهِ ﷺ يَوْمَ فَتْحِ مَكَّةَ عَنْ لُحُومِ الْجَلَّالَةِ وَعَنِ النُّهْبَةِ وَرُوِي مِنْ وَجْهٍ آخَرَ عَنِ ابْنِ عُمَرَ ؓ
The Messenger of Allah ﷺ forbade riding the camel which feeds on filth and drinking its milk. (Using translation from Abū Dāʾūd 3787)
نَهَى رَسُولُ اللهِ ﷺ عَنِ الْجَلَّالَةِ فِي الْإِبِلِ أَنْ يُرْكَبَ عَلَيْهَا أَوْ يُشْرَبَ مِنْ أَلْبَانِهَا
عَبْدُ الْوَارِثِ فَذَكَرَهُ
[Machine] The Prophet ﷺ prohibited (people) from consuming the meat of hunted game animals, milk that has been mixed with jallalah milk, and drinking from water containers that have been used by a dog. Sa'id bin Abi 'Arubah, Hammad bin Salamah, and 'Umar bin 'Amir all narrated this from Qatadah, except that Hammad bin Salamah said that the prohibition also included riding on an animal that has recently been given jallalah milk, but he did not mention the milk (itself). Abu 'Abdullah al-Hafiz narrated to us, from Abu al-'Abbas Muhammad bin Ya'qub, from Muhammad bin Ishaq al-Saghani, from 'Affan, from Hammad bin Salamah, from Qatadah, who mentioned it in its content and said that the prohibition also included riding on an animal that has recently been given jallalah milk. It has also been reported that 'Ikrimah narrated from Abu Hurairah (may Allah be pleased with him) (a similar prohibition).
النَّبِيَّ ﷺ نَهَى عَنِ الْمُجَثَّمَةِ وَعَنْ لَبَنِ الْجَلَّالَةِ وَأَنْ يُشْرَبَ مِنْ فِي السِّقَاءِ تَابَعَهُ سَعِيدُ بْنُ أَبِي عَرُوبَةَ وَحَمَّادُ بْنُ سَلَمَةَ وَعُمَرُ بْنُ عَامِرٍ عَنْ قَتَادَةَ إِلَّا أَنَّ حَمَّادَ بْنَ سَلَمَةَ قَالَ وَعَنْ رُكُوبِ الْجَلَّالَةِ لَمْ يَذْكُرِ اللَّبَنَ أَخْبَرَنَاهُ أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ إِسْحَاقَ الصَّغَانِيُّ ثنا عَفَّانُ ثنا حَمَّادُ بْنُ سَلَمَةَ ثنا قَتَادَةُ فَذَكَرَهُ بِمَعْنَاهُ وَقَالَ عَنْ رُكُوبِ الْجَلَّالَةِ وَقَدْ قِيلَ عَنْ عِكْرِمَةَ عَنْ أَبِي هُرَيْرَةَ ؓ
[Machine] The Messenger of Allah ﷺ prohibited drinking from the bucket, the ladle, and the jug.
أَنَّ رَسُولَ اللهِ ﷺ نَهَى أَنْ يُشْرَبَ مِنْ فِي السِّقَاءِ وَالْمُجَثَّمَةِ وَالْجَلَّالَةِ
[Machine] The Messenger of Allah ﷺ forbade eating the meat of male camels and their milk. Ata ibn Abi Rabah also forbade eating the meat of male camels and sheep.
رَسُولَ اللهِ ﷺ نَهَى عَنْ أَكْلِ لُحُومِ الْجَلَّالَةِ وَأَلْبَانِهَا وَكَانَ عَطَاءُ بْنُ أَبِي رَبَاحٍ يَنْهَى عَنِ الْجَلَّالَةِ مِنَ الْإِبِلِ وَالْغَنَمِ أَنْ تُؤْكَلَ
from his father, form his grandfather - the on the Day of Kahaibar, the Messenger of Allah forbade the flesh of domesticated donkeys and of al-Jallalah (animals that eat dung), and (he forbade) riding them and eating their mat." (Using translation from Nasāʾī 4447)
أَنَّ رَسُولَ اللهِ ﷺ نَهَى يَوْمَ خَيْبَرَ عَنْ لُحُومِ الْحُمُرِ الْأَهْلِيَّةِ وَعَنِ الْجَلَّالَةِ عَنْ رُكُوبِهَا وَأَكْلِ لُحُومِهَا
[Machine] The Messenger of Allah ﷺ prohibited eating the meat and drinking the milk of beasts of prey. He also forbade riding them until they are tamed for forty nights. This is not a strong opinion, as Al-Shafi'i referred to it and claimed that it was intended to change their nature from disliked to other than disliked, which is the natural disposition of animals, so that the souls of the prey are not found in their veins and tendons.
نَهَى رَسُولُ اللهِ ﷺ عَنِ الْجَلَّالَةِ أَنْ يُؤْكَلَ لَحْمُهَا وَيُشْرَبَ لَبَنُهَا وَلَا يُحْمَلَ عَلَيْهَا أَظُنُّهُ قَالَ إِلَّا الْأَدَمُ وَلَا يَرْكَبَهَا النَّاسُ حَتَّى تُعْلَفَ أَرْبَعِينَ لَيْلَةً لَيْسَ هَذَا بِالْقَوِيِّ وَقَدْ أَشَارَ إِلَيْهِ الشَّافِعِيُّ وَزَعَمَ أَنَّهُ أَرَادَ تَغَيُّرَهَا مِنَ الطِّبَاعِ الْمَكْرُوهَةِ إِلَى الطِّبَاعِ غَيْرِ الْمَكْرُوهَةِ الَّتِي هِيَ فِطْرَةُ الدَّوَابِّ حَتَّى لَا تُوجَدَ أَرْوَاحُ الْعَذِرَةِ فِي عِرْقِهَا وَجِرَرِهَا
