61. Sacrificial Animals
٦١۔ كِتَابُ الضَّحَايَا
[Machine] The Messenger of Allah ﷺ said: "The rights of the unborn child are the rights of his mother, and likewise."
قَالَ رَسُولُ اللهِ ﷺ ذَكَاةُ الْجَنِينِ ذَكَاةُ أُمِّهِ وَكَذَلِكَ
[Machine] We asked the Messenger of Allah ﷺ about the fetus, so he said, "Eat it if you wish."
سَأَلْنَا رَسُولَ اللهِ ﷺ عَنِ الْجَنِينِ فَقَالَ كُلُوهُ إِنْ شِئْتُمْ
[Machine] We said, "O Messenger of Allah, one of us slaughters a camel and slaughters a cow or a sheep, and there is a fetus in its womb. Should we throw it away or eat it?" He said, "Eat it if you wish, as its zakat is the zakat of its mother."
قُلْنَا يَا رَسُولَ اللهِ أَحَدُنَا يَنْحَرُ النَّاقَةَ وَيَذْبَحُ الْبَقَرَةَ وَالشَّاةَ وَفِي بَطْنِهَا الْجَنِينُ أَيُلْقِيهِ أَمْ يَأْكُلُهُ؟ فَقَالَ كُلُوهُ إِنْ شِئْتُمْ فَإِنَّ ذَكَاتَهُ ذَكَاةُ أُمِّهِ
[Machine] The Messenger of Allah ﷺ was asked about a pig and a cow that carry a fetus in their womb. He replied, "When you slaughter the animal, its offspring is considered as the mother's offering." This was narrated by Abu 'Ubaidah Al-Haddad, from Yunus, from Abu Al-Waddak, in a concise manner.
عَنْ رَسُولِ اللهِ ﷺ سُئِلَ عَنِ الْجَزُورِ وَالْبَقَرَةِ يُوجَدُ فِي بَطْنِهَا الْجَنِينُ قَالَ إِذَا سَمَّيْتُمْ عَلَى الذَّبِيحَةِ فَذَكَاتُهُ ذَكَاةُ أُمِّهِ وَرُوِيَ ذَلِكَ عَنْ أَبِي عُبَيْدَةَ الْحَدَّادِ عَنْ يُونُسَ عَنْ أَبِي الْوَدَّاكِ مُخْتَصَرًا
[Machine] "Allah ﷺ said: The zakat (obligatory charity) of the fetus is the zakat of its mother. It is also narrated from Ali, Abdullah ibn Masud, Abdullah ibn Umar, Abdullah ibn Abbas, Abu Ayyub, Abu Hurairah, Abu Darda, Abu Umamah, and Al-Bara ibn Azib, all raised in importance. And in the hadith of Az-Zuhri from Ibn Ka'b ibn Malik that he said: The companions of the Messenger of Allah ﷺ used to say about the fetus: when it reaches six months, its zakat is the zakat of its mother."
اللهِ ﷺ قَالَ ذَكَاةُ الْجَنِينِ ذَكَاةُ أُمِّهِ وَفِي الْبَابِ عَنْ عَلِيٍّ وَعَبْدِ اللهِ بْنِ مَسْعُودٍ وَعَبْدِ اللهِ بْنِ عُمَرَ وَعَبْدِ اللهِ بْنِ عَبَّاسٍ وَأَبِي أَيُّوبَ وَأَبِي هُرَيْرَةَ وَأَبِي الدَّرْدَاءِ وَأَبِي أُمَامَةَ وَالْبَرَاءِ بْنِ عَازِبٍ ؓ مَرْفُوعًا وَفِي حَدِيثِ الزُّهْرِيِّ عَنِ ابْنِ كَعْبِ بْنِ مَالِكٍ أَنَّهُ قَالَ كَانَ أَصْحَابُ رَسُولِ اللهِ ﷺ يَقُولُونَ فِي الْجَنِينِ إِذَا أَشْعَرَ فَذَكَاتُهُ ذَكَاةُ أُمِّهِ
[Machine] Ibn Umar used to say, "When the camel is slaughtered, the owner has the right to take all the contents of its abdomen as part of his share if its creation is complete and its hair has grown. When it comes out of its abdomen alive, it is slaughtered until the blood comes out of its cavity." This is the wording of the hadith of Ibn Bukayr, and in the narration of Ibn Wahb, it includes both its contents and the remainder. This is the correct position.
اللهِ بْنَ عُمَرَ ؓ كَانَ يَقُولُ إِذَا نُحِرَتِ النَّاقَةُ فَذَكَاةُ مَا فِي بَطْنِهَا فِي ذَكَاتِهَا إِذَا كَانَ قَدْ تَمَّ خَلْقُهُ وَنَبَتَ شَعْرُهُ وَإِذَا خَرَجَ مِنْ بَطْنِهَا حَيًّا ذُبِحَ حَتَّى يَخْرُجَ الدَّمُ مِنْ جَوْفِهِ لَفْظُ حَدِيثِ ابْنِ بُكَيْرٍ وَفِي رِوَايَةِ ابْنِ وَهْبٍ بِذَكَاتِهَا وَالْبَاقِي سَوَاءٌ هَذَا هُوَ الصَّحِيحُ مَوْقُوفٌ
[Machine] "Allah ﷺ said regarding the fetus: Its zakat is the zakat of its mother, whether it feels or does not feel."
اللهِ ﷺ قَالَ فِي الْجَنِينِ ذَكَاتُهُ ذَكَاةُ أُمِّهِ أَشْعَرَ أَوْ لَمْ يُشْعِرْ
[Machine] The livestock animals are lawful for you, and their produce is a provision for their owners.
بَهِيمَةُ الْأَنْعَامِ أُحِلَّتْ لَكُمْ وَذَكَاتُهُ ذَكَاةُ أُمِّهِ
عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ
[Machine] We found a cow and found a fetus in its stomach, so we cooked it and brought it to Abu Dhabi. He took a bite of it and said, "This is what Ibn Abbas told us, that it is from the animals of the cattle." Tawus also narrated it from Ibn Abbas, and we also narrated it from Ikrimah, who narrated it from Ibn Abbas that he said about the animals of the cattle, "It is the fetus, its zakah is the zakah of its mother."
بَقَرَةً فَوَجَدْنَا فِي بَطْنِهَا جَنِينًا فَشَوَيْنَاهُ وَقَدِمْنَا إِلَى أَبِي ظَبْيَانَ فَتَنَاوَلَ لُقْمَةً مِنْهُ فَقَالَ هَذَا الَّذِي حَدَّثَنَا بِهِ ابْنُ عَبَّاسٍ ؓ أَنَّهُ مِنْ بَهِيمَةِ الْأَنْعَامِ وَرَوَاهُ أَيْضًا طَاوُسٌ عَنِ ابْنِ عَبَّاسٍ ؓ وَرُوِّينَا عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ ؓ أَنَّهُ قَالَ فِي بَهِيمَةِ الْأَنْعَامِ هُوَ الْجَنِينُ ذَكَاتُهُ ذَكَاةُ أُمِّهِ
الْجَنِينُ ذَكَاتُهُ ذَكَاةُ أُمِّهِ
ذَكَاتُهُ ذَكَاةُ أُمِّهِ
[Machine] It is said that it is only one of its pillars, its charity is the charity of its mother.
يُقَالُ إِنَّمَا هُوَ رُكْنٌ مِنْ أَرْكَانِهَا ذَكَاتُهُ ذَكَاةُ أُمِّهِ
كُلْهُ أَشْعَرَ أَوْ لَمْ يُشْعِرْ إِنْ لَمْ تَقْذَرْهُ يَعْنِي الْجَنِينَ قَالَ يَعْقُوبُ وَقَدْ رُوِيَ عَنْ حَمَّادٍ عَنْ إِبْرَاهِيمَ قَالَ لَا يَكُونُ ذَكَاةُ نَفْسٍ ذَكَاةَ نَفْسَيْنِ قَالَ يَعْقُوبُ حَدَّثَنَا بَعْضُ أَصْحَابِنَا عَنْ عُثْمَانَ بْنِ عُثْمَانَ أَنْبَأَ الْبَتِّيُّ قَالَ كَانَ حَمَّادٌ إِذَا قَالَ بِرَأْيهِ أَصَابَ وَإِذَا قَالَ قَالَ إِبْرَاهِيمُ أَخْطَأَ وَرُوِّينَا عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ وَالْقَاسِمِ بْنِ مُحَمَّدٍ وَالْحَسَنِ الْبَصْرِيِّ وَعَامِرٍ الشَّعْبِيِّ وَعَطَاءٍ وَطَاوُسٍ وَمُجَاهِدٍ وَنَافِعٍ وَعَبْدِ الرَّحْمَنِ بْنِ أَبِي لَيْلَى وَعِكْرِمَةَ وَعَمْرِو بْنِ دِينَارٍ نَحْوَ قَوْلِنَا
