61.106 [Machine] What happened to someone passing by a wall, or his walking?

٦١۔١٠٦ بَابُ مَا جَاءَ فِيمَنْ مَرَّ بِحَائِطِ إِنْسَانٍ أَوْ مَاشِيَتِهِ

[Machine] Al-Shafi'i, may Allah have mercy on him, said, "Whoever passes by a person's farm, livestock, or any other of his possessions, should not take anything from him except with his permission. This is because there is no book or established Sunnah that permits it. Therefore, it is forbidden to take someone's property without their permission, and Allah knows best. It has been said that if one passes by a wall, they may eat from it but should not take a handful. A hadith has been narrated concerning this, if it were authenticated by us, we would not oppose it. However, the established Sunnah and hadith states that it is not permissible to eat someone's property without their permission. The Sheikh said, as for the one who says this statement, it is 'Umar ibn al-Khattab."  

البيهقي:١٩٦٤٨أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو ثنا أَبُو الْعَبَّاسِ الْأَصَمُّ أنبأ الرَّبِيعُ قَالَ

قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ مَنْ مَرَّ لِرَجُلٍ بِزَرْعٍ أَوْ مَاشِيَةٍ أَوْ غَيْرِ ذَلِكَ مِنْ مَالِهِ لَمْ يَكُنْ لَهُ أَخْذُ شَيْءٍ مِنْهُ إِلَّا بِإِذْنِهِ؛ لِأَنَّ هَذَا مِمَّا لَمْ يَأْتِ فِيهِ كِتَابٌ وَلَا سُنَّةٌ ثَابِتَةٌ بِإِبَاحَتِهِ فَهُوَ مَمْنُوعٌ لِمَالِكِهِ إِلَّا بِإِذْنِهِ وَاللهُ أَعْلَمُ قَالَ وَقَدْ قِيلَ مَنْ مَرَّ بِحَائِطٍ فَلْيَأْكُلْ وَلَا يَتَّخِذْ خُبْنَةً وَرُوِيَ فِيهِ حَدِيثٌ لَوْ كَانَ يَثْبُتُ مِثْلُهُ عِنْدَنَا لَمْ نُخَالِفْهُ وَالْكِتَابُ وَالْحَدِيثُ الثَّابِتُ أَنَّهُ لَا يَجُوزُ أَكْلُ مَالِ أَحَدٍ إِلَّا بِإِذْنِهِ قَالَ الشَّيْخُ أَمَّا قَائِلُ هَذَا الْقَوْلِ فَعُمَرُ بْنُ الْخَطَّابِ ؓ

[Machine] Whoever passes by a wall, let them eat in their stomach and not take a dingleberry.  

البيهقي:١٩٦٤٩أَخْبَرَنَا أَبُو بَكْرٍ مُحَمَّدُ بْنُ إِبْرَاهِيمَ الْأَرْدَسْتَانِيُّ أنبأ أَبُو نَصْرٍ أَحْمَدُ بْنُ عَمْرٍو الْعِرَاقِيُّ ثنا سُفْيَانُ بْنُ مُحَمَّدٍ الْجَوْهَرِيُّ ثنا عَلِيُّ بْنُ الْحَسَنِ ثنا عَبْدُ اللهِ بْنُ الْوَلِيدِ ثنا سُفْيَانُ ثنا مَنْصُورٌ عَنْ مُجَاهِدٍ عَنْ أَبِي عِيَاضٍ أَنَّ عُمَرَ بْنَ الْخَطَّابِ ؓ قَالَ

مَنْ مَرَّ مِنْكُمْ بِحَائِطٍ فَلْيَأْكُلْ فِي بَطْنِهِ وَلَا يَتَّخِذْ خُبْنَةً

[Machine] Umar said, "If you are three, then appoint one of you in charge. And if you pass by a camel herder, call out 'O camel herder!' If he answers you, then ask him to give you water. And if he does not answer you, then force the camel to lie down, and drink its milk." This is reported by Umar with a good chain of narrators, and it is considered necessary according to us. And Allah knows best.  

البيهقي:١٩٦٥٠وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ وَأَبُو الْحُسَيْنِ بْنُ بِشْرَانَ قَالَا أنبأ إِسْمَاعِيلُ بْنُ مُحَمَّدٍ الصَّفَّارُ ثنا سَعْدَانُ بْنُ نَصْرٍ ثنا أَبُو مُعَاوِيَةَ عَنِ الْأَعْمَشِ عَنْ زَيْدِ بْنِ وَهْبٍ قَالَ

قَالَ عُمَرُ ؓ إِذَا كُنْتُمْ ثَلَاثَةً فَأَمِّرُوا عَلَيْكُمْ وَاحِدًا مِنْكُمْ فَإِذَا مَرَرْتُمْ بِرَاعِي الْإِبِلِ فَنَادُوا يَا رَاعِيَ الْإِبِلِ فَإِنْ أَجَابَكُمْ فَاسْتَسْقُوهُ وَإِنْ لَمْ يُجِبْكُمْ فَأْتُوهَا فُحُلُّوهَا وَاشْرَبُوا ثُمَّ صُرُّوهَا هَذَا عَنْ عُمَرَ ؓ صَحِيحٌ بِإِسْنَادَيْهِ جَمِيعًا وَهُوَ عِنْدَنَا مَحْمُولٌ عَلَى حَالِ الضَّرُورَةِ وَاللهُ أَعْلَمُ

[Machine] The Prophet ﷺ said, "Whoever enters a garden, let them eat from it and not take anything out of it." Umar ibn Ahmad narrated to us, who was informed by Abu Amr As-Sulami, who narrated to us Abu Ja'far Muhammad ibn Musa Al-Hulwani, who narrated to us Muhammad ibn Mansur Al-Jawwaz Al-Makki, who narrated to us Yahya ibn Sulaim, and he mentioned it to us. And Abu Muhammad As-Sukkari narrated to us, who was informed by Abu Bakr Ash-Shafi'i, who narrated to us Ja'far ibn Muhammad ibn Al-Azhar, who narrated to us Al-Mufadhdhil ibn Ghassan, who said, "It was mentioned to Abu Zakariya Yahya ibn Ma'in a hadith from Yahya ibn Sulaim At-Taifi about a man passing by a garden and eating from it." He said, "This is incorrect." And Abu Isa At-Tirmidhi said, "I asked Muhammad ibn Ismail about this hadith, and he said, 'Yahya ibn Sulaim narrates hadiths from Ud Allah that are doubtful.'" The sheikh said, "And it has been narrated from other reliable sources."  

البيهقي:١٩٦٥١وَأَمَّا الْحَدِيثُ الَّذِي رُوِيَ فَفِيمَا رَوَاهُ يَحْيَى بْنُ سُلَيْمٍ عَنْ عُبَيْدِ اللهِ بْنِ عُمَرَ ؓ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ

أَنَّ النَّبِيَّ ﷺ قَالَ مَنْ دَخَلَ حَائِطًا فَلْيَأْكُلْ وَلَا يَتَّخِذْ خُبْنَةً أَخْبَرَنَاهُ عُمَرُ بْنُ أَحْمَدَ أنبأ أَبُو عَمْرٍو السُّلَمِيُّ ثنا أَبُو جَعْفَرٍ مُحَمَّدُ بْنُ مُوسَى الْحُلْوَانِيُّ ثنا مُحَمَّدُ بْنُ مَنْصُورٍ الْجَوَّازُ الْمَكِّيُّ ثنا يَحْيَى بْنُ سُلَيْمٍ فَذَكَرَهُ 19652 وَقَدْ أَخْبَرَنَا أَبُو مُحَمَّدٍ السُّكَّرِيُّ أَنْبَأَ أَبُو بَكْرٍ الشَّافِعِيُّ ثنا جَعْفَرُ بْنُ مُحَمَّدِ بْنِ الْأَزْهَرِ ثنا الْمُفَضَّلُ بْنُ غَسَّانَ قَالَ وَذُكِرَ لِأَبِي زَكَرِيَّا يَحْيَى بْنِ مَعِينٍ حَدِيثُ يَحْيَى بْنِ سُلَيْمٍ الطَّائِفِيِّ عَنْ عُبَيْدِ اللهِ فِي الرَّجُلِ يَمُرُّ بِالْحَائِطِ فَيَأْكُلُ مِنْهُ قَالَ هَذَا غَلَطٌ وَقَالَ أَبُو عِيسَى التِّرْمِذِيُّ سَأَلْتُ مُحَمَّدَ بْنَ إِسْمَاعِيلَ عَنْ هَذَا الْحَدِيثِ فَقَالَ يَحْيَى بْنُ سُلَيْمٍ يَرْوِي أَحَادِيثَ عَنْ عُبَيْدِ اللهِ يَهِمُ فِيهَا قَالَ الشَّيْخُ وَقَدْ رُوِيَ مِنْ أَوْجُهٍ أُخَرَ لَيْسَتْ بِقَوِيَّةٍ

[Machine] I heard a man from Muzaynah asking the Messenger of Allah ﷺ about the stray animal. He mentioned the hadith and then asked him about the fruits that a person obtains. The Messenger of Allah ﷺ replied, "He should not take from the pockets, meaning the tops of the palm trees, what he carries, and he should bear its cost and its equivalent along with it, and a blow with a stick is not permitted, and what is in its leaf bundles, he should take it, when it reaches the price of the mijann (a unit of measurement), and if he eats from it and does not take, then he should consider it as a gift, and there is nothing upon him. And this is if it is correct, and this can be understood that there is nothing upon him in it, in terms of cutting, as long as he does not take it out of the haram (sanctuary)."  

البيهقي:١٩٦٥٣فَمِنْهَا مَا أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا أَحْمَدُ بْنُ عَبْدِ الْحَمِيدِ الْحَارِثِيُّ ثنا أَبُو أُسَامَةَ عَنِ الْوَلِيدِ بْنِ كَثِيرٍ حَدَّثَنِي عَمْرُو بْنُ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ قَالَ

سَمِعْتُ رَجُلًا مِنْ مُزَيْنَةَ سَأَلَ رَسُولَ اللهِ ﷺ وَأَنَا أَسْمَعُ عَنِ الضَّالَّةِ فَذَكَرَ الْحَدِيثَ قَالَ ثُمَّ سَأَلَهُ عَنِ الثِّمَارِ يُصِيبُهُ الرَّجُلُ قَالَ مَا أَخَذَ فِي أَكْمَامِهِ يَعْنِي رُءُوسَ النَّخْلِ فَاحْتَمَلَهُ فَثَمَنُهُ وَمِثْلُهُ مَعَهُ وَضَرْبٌ نَكَالٌ وَمَا كَانَ فِي أَجْرَانِهِ فَأَخَذَ فَفِيهِ الْقَطْعُ إِذَا بَلَغَ ذَلِكَ ثَمَنَ الْمِجَنِّ وَإِنْ أَكَلَ بِفِيهِ وَلَمْ يَأْخُذْ فَيَتَّخِذْ خُبْنَةً فَلَيْسَ عَلَيْهِ شَيْءٌ وَهَذَا إِنْ صَحَّ فَمَحْمُولٌ عَلَى أَنْ لَيْسَ عَلَيْهِ فِيهِ قَطْعٌ حِينَ لَمْ يُخْرِجْهُ مِنَ الْحِرْزِ

[Machine] If one of you comes upon an animal, and it has its owner with it, then let him ask permission from the owner. If he gives him permission, then let him take its milk and drink it. And if it does not have an owner, then let him call out three times. If it responds to him, then let him ask permission from it. And if it does not respond, then let him take its milk and drink it. And do not carry it. Al-Sheikh said: The narrations from Al-Hasan regarding Samurah, some of the huffaz do not consider them reliable. And it is claimed that it is from a book other than the Hadith of Al-Aqiqah, which mentions hearing. And if it is authentic, then it is applied in case of necessity.

إِذَا أَتَى أَحَدُكُمْ عَلَى مَاشِيَةٍ فَإِنْ كَانَ فِيهَا صَاحِبُهَا فَلْيَسْتَأْذِنْهُ فَإِنْ أَذِنَ لَهُ فَلْيَحْتَلِبْ وَلْيَشْرَبْ وَإِنْ لَمْ يَكُنْ فِيهَا فَلْيُصَوِّتْ ثَلَاثًا فَإِنْ أَجَابَهُ فَلْيَسْتَأْذِنْهُ وَإِلَّا فَلْيَحْتَلِبْ وَلْيَشْرَبْ وَلَا يَحْمِلْ قَالَ الشَّيْخُ أَحَادِيثُ الْحَسَنِ عَنْ سَمُرَةَ لَا يُثْبِتُهَا بَعْضُ الْحُفَّاظِ وَيَزْعُمُ أَنَّهَا مِنْ كِتَابٍ غَيْرَ حَدِيثِ الْعَقِيقَةِ الَّذِي قَدْ ذُكِرَ فِيهِ السَّمَاعُ وَإِنْ صَحَّ فَهُوَ مَحْمُولٌ عَلَى حَالِ الضَّرُورَةِ

[Machine] The Prophet, ﷺ , said: "If one of you comes to a shepherd, let him call out 'O camel herder!' three times. If the shepherd answers, then let him milk and drink [from the camels], but do not carry [any of the camels]. And if one of you comes to a wall, let him call out 'O owner of the wall!' three times. If the owner answers, then let him eat, but do not carry [anything from the wall]. This narration was narrated by Sa'id bin Iyas Al-Jurayri, who is reliable, except that he became confused towards the end of his life. Also, the hearing of Yazid bin Harun from him was narrated after his confusion. Hammad bin Salamah also narrated this from Al-Jurayri, but he is not considered strong. And it was narrated from Abu Sa'id Al-Khudri that the Prophet, ﷺ , said something different from this."  

البيهقي:١٩٦٥٥وَمِنْهَا أَخْبَرَنَا أَبُو الْحَسَنِ عَلِيُّ بْنُ أَحْمَدَ بْنِ عَبْدَانَ أنبأ أَحْمَدُ بْنُ عُبَيْدٍ الصَّفَّارُ ثنا الْحَارِثُ بْنُ أَبِي أُسَامَةَ ثنا يَزِيدُ بْنُ هَارُونَ أنبأ الْجُرَيْرِيُّ عَنْ أَبِي نَضْرَةَ عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ ؓ

عَنِ النَّبِيِّ ﷺ قَالَ إِذَا أَتَى أَحَدُكُمْ عَلَى رَاعٍ فَلْيُنَادِ يَا رَاعِيَ الْإِبِلِ ثَلَاثًا فَإِنْ أَجَابَهُ وَإِلَّا فَلْيَحْلِبْ وَلْيَشْرَبْ وَلَا يَحْمِلَنَّ وَإِذَا أَتَى أَحَدُكُمْ عَلَى حَائِطٍ فَلْيُنَادِ ثَلَاثًا يَا صَاحِبَ الْحَائِطِ فَإِنْ أَجَابَهُ وَإِلَّا فَلْيَأْكُلْ وَلَا يَحْمِلَنَّ تَفَرَّدَ بِهِ سَعِيدُ بْنُ إِيَاسٍ الْجُرَيْرِيُّ وَهُوَ مِنَ الثِّقَاتِ إِلَّا أَنَّهُ اخْتَلَطَ فِي آخِرِ عُمْرِهِ وَسَمَاعُ يَزِيدَ بْنِ هَارُونَ عَنْهُ بَعْدَ اخْتِلَاطِهِ وَرَوَاهُ أَيْضًا حَمَّادُ بْنُ سَلَمَةَ عَنِ الْجُرَيْرِيِّ وَلَيْسَ بِالْقَوِيِّ وَقَدْ رُوِيَ عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ ؓ عَنِ النَّبِيِّ ﷺ بِخِلَافِ ذَلِكَ

[Machine] Sa'id al-Khudri said, "It is not permissible for anyone to milk a she-camel without the permission of its owner. If the owner puts his seal on it, then it was asked, 'Should it be lifted?' He said, 'Yes.' The sheikh said, 'And this corresponds to the proven hadith from Nafi' from Ibn 'Umar from the Prophet Muhammad ﷺ regarding the prohibition of that. And it has already been mentioned in the previous chapter, number 19657. Abu 'Abd al-Rahman al-Sulami informed us that Abu al-Hasan al-Karizi informed us that 'Ali ibn 'Abd al-'Aziz said, 'Abu 'Ubaid said, 'And this hadith is only directed at the hadith of 'Umar ibn al-Khattab, and then the hadith of 'Amr ibn Shu'aib regarding permission, that he permitted it for the hungry and needy person who has nothing to buy with except it, and this is explained in another hadith that was narrated to us by al-Ansari Muhammad ibn 'Abdullah from ibn Jurayj from 'Ata' who said, 'The Messenger of Allah ﷺ permitted the hungry and needy person who has nothing to eat to eat from the wall without taking a large amount.' Abu 'Ubaid said, 'And from what clarifies this is the hadith of 'Umar regarding the Ansar who passed by a live Arab village. They asked them for food, but they refused. They asked them for information, but they refused. They were captured and so they were injured. They came to 'Umar and informed him of this, so he understood the situation of the Bedouins. And Ibn al-Sabil is more deserving of the water than the camels that are milked. Abu 'Ubaid said, 'Hajjaj informed us from Shu'bah from Muhammad ibn 'Ubaid al-Makki from Muhammad ibn Sulaiman al-Makhzumi who said, 'I heard al-Qasim ibn Muhawwal al-Bahzi say, 'I heard my father say, 'I asked, 'O Messenger of Allah, we find the camels and we are in need and they are lactating.' He said, 'Call out, 'O owner of the camels,' three times. If he answers, then you may milk. If not, then leave it and let the milk settle. Then milk it and leave a portion of the milk for the owner.'"  

البيهقي:١٩٦٥٦أَخْبَرَنَاهُ أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ أنبأ أَبُو الْحَسَنِ الْكَارِزِيُّ أنبأ عَلِيُّ بْنُ عَبْدِ الْعَزِيزِ عَنْ أَبِي عُبَيْدٍ ثنا شَرِيكٌ عَنْ عَبْدِ اللهِ بْنِ عَاصِمٍ قَالَ سَمِعْتُ أَبَا

سَعِيدٍ الْخُدْرِيَّ ؓ يَقُولُ لَا يَحِلُّ لِأَحَدٍ أَنْ يَحُلَّ صِرَارَ نَاقَةٍ إِلَّا بِإِذْنِ أَهْلِهَا فَإِنَّ خَاتَمَ أَهْلِهَا عَلَيْهَا فَقِيلَ لِشَرِيكٍ أَرَفَعَهُ؟ قَالَ نَعَمْ قَالَ الشَّيْخُ وَهَذَا يوَافِقُ الْحَدِيثَ الثَّابِتَ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ ؓ عَنِ النَّبِيِّ ﷺ فِي النَّهْيِ عَنْ ذَلِكَ وَقَدْ مَضَى فِي الْبَابِ قَبْلَهُ 19657 أَخْبَرَنَا أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ أَنْبَأَ أَبُو الْحَسَنِ الْكَارِزِيُّ أَنْبَأَ عَلِيُّ بْنُ عَبْدِ الْعَزِيزِ قَالَ قَالَ أَبُو عُبَيْدٍ وَإِنَّمَا يُوَجَّهُ هَذَا الْحَدِيثُ يَعْنِي حَدِيثَ عُمَرَ بْنِ الْخَطَّابِ ؓ ثُمَّ حَدِيثَ عَمْرِو بْنِ شُعَيْبٍ فِي الرُّخْصَةِ أَنَّهُ رَخَّصَ فِيهِ لِلْجَائِعِ الْمُضْطَرِّ الَّذِي لَا شَيْءَ مَعَهُ يَشْتَرِي بِهِ وَهُوَ مُفَسَّرٌ فِي حَدِيثٍ آخَرَ حَدَّثَنَاهُ الْأَنْصَارِيُّ مُحَمَّدُ بْنُ عَبْدِ اللهِ عَنِ ابْنِ جُرَيْجٍ عَنْ عَطَاءٍ قَالَ رَخَّصَ رَسُولُ اللهِ ﷺ لِلْجَائِعِ الْمُضْطَرِّ إِذَا مَرَّ بِالْحَائِطِ أَنْ يَأْكُلَ مِنْهُ وَلَا يَتَّخِذَ خُبْنَةً قَالَ أَبُو عُبَيْدٍ وَمِمَّا يبَيِّنُ ذَلِكَ حَدِيثُ عُمَرَ ؓ فِي الْأَنْصَارِ الَّذِينَ مَرُّوا بِحَيٍّ مِنَ الْعَرَبِ فَسَأَلُوهُمُ الْقِرَى فَأَبَوْا فَسَأَلُوهُمُ الشِّرَى فَأَبَوْا فَضَبَطُوهُمْ فَأَصَابُوا مِنْهُمْ فَأَتَوْا عُمَرَ ؓ فَذَكَرُوا ذَلِكَ لَهُ فَهَمَّ بِالْأَعْرَابِ وَقَالَ ابْنُ السَّبِيلِ أَحَقُّ بِالْمَاءِ مِنَ التَّانِئِ عَلَيْهِ قَالَ أَبُو عُبَيْدٍ حَدَّثَنَاهُ حَجَّاجٌ عَنْ شُعْبَةَ عَنْ مُحَمَّدِ بْنِ عُبَيْدِ اللهِ الثَّقَفِيِّ عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبِي لَيْلَى عَنْ عُمَرَ قَالَ أَبُو عُبَيْدٍ فَهَذَا مُفَسَّرٌ إِنَّمَا هُوَ لِمَنْ لَمْ يَقْدِرْ عَلَى قِرًى وَلَا شِرًى وَكَذَلِكَ قَالَ فِي الْحَدِيثِ الْأَوَّلِ لِيُصَوِّتْ يَا رَاعِيَ الْإِبِلِ ثَلَاثًا؛ لِيَكُونَ طَلَبُ الْقِرَى قَبْلُ قَالَ الشَّيْخُ وَفِي مِثْلِ هَذَا مَا أَخْبَرَنَا عَلِيُّ بْنُ أَحْمَدَ بْنِ عَبْدَانَ أَنْبَأَ أَحْمَدُ بْنُ عُبَيْدٍ ثنا تَمْتَامٌ ثنا مُحَمَّدُ بْنُ عَبَّادٍ الْمَكِّيُّ ثنا مُحَمَّدُ بْنُ سُلَيْمَانَ الْمَخْزُومِيُّ قَالَ سَمِعْتُ الْقَاسِمَ بْنَ مُخَوَّلٍ الْبَهْزِيَّ يَقُولُ سَمِعْتُ أَبِي يَقُولُ قُلْتُ يَا رَسُولَ اللهِ الْإِبِلُ نَلْقَاهَا وَنَحْنُ مُحْتَاجُونَ وَهِيَ مُصَرَّاةٌ قَالَ تُنَادِي يَا صَاحِبَ الْإِبِلِ ثَلَاثًا فَإِنْ أَجَابَكَ وَإِلَّا فَاحْلُبْ ثُمَّ دَعْ لِلَّبَنِ دَوَاعِيَهُ زَادَ فِيهِ غَيْرُهُ وَاحْلُبْ ثُمَّ صُرَّ وَبَقِّ لِلَّبَنِ دَوَاعِيَهُ

[Machine] We were with the Prophet ﷺ , and suddenly a camel having its legs bound by some branches of a tree passed by. Some people went to take its milk. The Prophet ﷺ called them and said, "Imagine if people came to your provisions and took what is in them, would you not consider it a betrayal?" They replied, "Yes." He said, "This is the household of a Muslim. The feelings within them are the same as what is within your provisions." They asked the Prophet ﷺ , "What if a man takes some of his brother's wealth?" He replied, "He may eat and drink from it but should not take it away." This narration has an unknown chain of narrators, and Al-Hajjaj ibn Artat has no authority to rely on it. It has also been narrated with a different chain of narrators, indicating that it is for someone in dire need.  

البيهقي:١٩٦٥٨أَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ بِشْرَانَ الْعَدْلُ بِبَغْدَادَ أنبأ أَبُو جَعْفَرٍ مُحَمَّدُ بْنُ عَمْرٍو الرَّزَّازُ ثنا عَبْدُ الرَّحْمَنِ بْنُ مُحَمَّدِ بْنِ مَنْصُورٍ ثنا مُعَاذُ بْنُ هِشَامٍ حَدَّثَنِي أَبِي عَنِ الْحَجَّاجِ بْنِ أَرْطَاةَ عَنْ سَلِيطِ بْنِ عَبْدِ اللهِ التَّمِيمِيِّ عَنْ ذُهَيْلِ بْنِ عَوْفِ بْنِ شَمَّاخٍ عَنْ أَبِي هُرَيْرَةَ ؓ قَالَ

كُنَّا مَعَ النَّبِيِّ ﷺ فَإِذَا إِبِلٌ مُصَرَّرَةٌ بِعِضَاهِ الشَّجَرِ فَانْطَلَقَ نَاسٌ لِيَحْتَلِبُوا فَدَعَاهُمُ النَّبِيُّ ﷺ فَقَالَ أَرَأَيْتُمْ لَوْ أَنَّ نَاسًا عَمَدُوا إِلَى مَزَاوِدِكُمْ فِيهَا أَزْوِدَتُكُمْ فَأَخَذُوا مَا فِيهَا لَكَانُوا غَدَرُوكُمْ؟ قَالُوا نَعَمْ قَالَ هَذِهِ لِأَهْلِ بَيْتٍ مِنَ الْمُسْلِمِينَ إِنَّ مَا فِي ضُرُوعِهَا مِثْلُ مَا فِي أَزْوِدَتِكُمْ قَالُوا يَا رَسُولَ اللهِ فَمَا يَحِلُّ لِلرَّجُلِ مِنْ مَالِ أَخِيهِ؟ قَالَ أَنْ يَأْكُلَ وَلَا يَحْمِلَ وَيَشْرَبَ وَلَا يَحْمِلَ هَذَا إِسْنَادٌ مَجْهُولٌ لَا تَقُومُ بِمِثْلِهِ الْحُجَّةُ وَالْحَجَّاجُ بْنُ أَرْطَاةَ غَيْرُ مُحْتَجٍّ بِهِ وَقَدْ رُوِيَ مِنْ وَجْهٍ آخَرَ عَنِ الْحَجَّاجِ مَا دَلَّ أَنَّهُ فِي الْمُضْطَرِّ

[Machine] While we were with the Prophet ﷺ , we saw some camels that were emaciated, their backs swollen because of hunger. He mentioned a saying and then we said, "What do you think if we seek food and drink?" He replied, "Eat and drink, but do not carry and collect (more than you can consume)." This hadith was narrated by Shurayk from Al-Hajjaj, but there is disagreement in its chain of narration.

بَيْنَا نَحْنُ مَعَ النَّبِيِّ ﷺ إِذْ رَأَيْنَا إِبِلًا مَصْرُورَةً بِعِضَاهِ الشَّجَرِ قَالَ وَذَكَرَ الْحَدِيثَ قَالَ فَقُلْنَا أَفَرَأَيْتَ إِنِ احْتَجْنَا إِلَى الطَّعَامِ وَالشَّرَابِ؟ فَقَالَ كُلْ وَلَا تَحْمِلْ وَاشْرَبْ وَلَا تَحْمِلْ وَرَوَاهُ شَرِيكٌ الْقَاضِي عَنِ الْحَجَّاجِ فَخَالَفَ فِي إِسْنَادِهِ مَنْ مَضَى

[Machine] The Prophet ﷺ was asked about what is permissible for a man from his brother's wealth. He said, "He should eat until he is full when he is hungry, and drink until he is satisfied."

سُئِلَ النَّبِيُّ ﷺ عَمَّا يَحِلُّ لِلرَّجُلِ مِنْ مَالِ أَخِيهِ قَالَ يَأْكُلُ حَتَّى يَشْبَعَ إِذَا كَانَ جَائِعًا وَيَشْرَبُ حَتَّى يَرْوَى
