[Machine] "Allah ﷺ said regarding the fetus: Its zakat is the zakat of its mother, whether it feels or does not feel."

البيهقي:١٩٤٩٤ – وَقَدْ أَخْبَرَنَا أَبُو الْحَسَنِ مُحَمَّدُ بْنُ الْحُسَيْنِ بْنِ دَاوُدَ الْعَلَوِيُّ رَحِمَهُ اللهُ أنبأ مُحَمَّدُ بْنُ حَمْدَوَيْهِ بْنِ سَهْلٍ الْمَرْوَزِيُّ الْمُطَّوِّعِيُّ ثنا أَبُو شِهَابٍ مَعْمَرُ بْنُ مُحَمَّدِ بْنِ مَعْمَرٍ الْعَوْفِيُّ ثنا عِصَامُ بْنُ يُوسُفَ ثنا الْمُبَارَكُ بْنُ مُجَاهِدٍ عَنْ عُبَيْدِ اللهِ بْنِ عُمَرَ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ ؓ أَنَّ رَسُولَ

اللهِ ﷺ قَالَ فِي الْجَنِينِ ذَكَاتُهُ ذَكَاةُ أُمِّهِ أَشْعَرَ أَوْ لَمْ يُشْعِرْ

رَوَاهُ أَبُو الْحَسَنِ عَلِيُّ بْنُ عُمَرَ الدَّارَقُطْنِيُّ فِي كِتَابِهِ عَنْ مُحَمَّدِ بْنِ حَمْدَوَيْهِ الْمَرْوَزِيِّ هَذَا وَعَلِيِّ بْنِ الْفَضْلِ بْنِ طَاهِرٍ 19495 أَخْبَرَنَا بِذَلِكَ أَبُو بَكْرِ بْنُ الْحَارِثِ الْأَصْبَهَانِيُّ أنبأ عَلِيُّ بْنُ عُمَرَ الْحَافِظُ فَذَكَرَهُ وَرُوِيَ مِنْ أَوْجُهٍ عَنِ ابْنِ عُمَرَ ؓ مَرْفُوعًا وَرَفْعُهُ عَنْهُ ضَعِيفٌ وَالصَّحِيحُ مَوْقُوفٌ وَفِي حَدِيثِ الْحَارِثِ عَنْ عَلِيٍّ ؓ أَنَّهُ قَالَ فِي ذَكَاةِ الْجَنِينِ ذَكَاةُ أُمِّهِ
