61. Sacrificial Animals (5/14)
٦١۔ كِتَابُ الضَّحَايَا ص ٥
[Machine] In the name of Allah, the Most Gracious, the Most Merciful.
Allah, may He be praised, said: "So pray to your Lord and sacrifice." [Surah Al-Kawthar, verse 2].
بِسْمِ اللهِ الرَّحْمَنِ الرَّحِيمِ.
قَالَ اللهُ جَلَّ ثَنَاؤُهُ: {فَصَلِّ لِرَبِّكَ وَانْحَرْ} [الكوثر: 2].
[Machine] The Messenger of Allah ﷺ said on the day of Eid al-Adha: "Whoever sacrifices among you, let him not partake of anything from his sacrifice until three days have passed." When the following year came, they said, "O Messenger of Allah, should we do the same this year as we did in the previous year?" He replied, "No, eat, feed others, and save some, as the previous year was a year of hardship or a word resembling it. I intended for you to distribute among the people."
قَالَ رَسُولُ اللهِ ﷺ يَوْمَ الْأَضْحَى مَنْ ضَحَّى مِنْكُمْ فَلَا يُصْبِحَنَّ مِنْ أُضْحِيَّتِهِ فِي بَيْتِهِ بَعْدَ ثَالِثَةٍ شَيْءٌ فَلَمَّا كَانَ الْعَامُ الْمُقْبِلُ قَالُوا يَا رَسُولَ اللهِ نَفْعَلُ فِي هَذَا الْعَامِ كَمَا فَعَلْنَا فِي الْعَامِ الْمَاضِي؟ فَقَالَ لَا كُلُوا وَأَطْعِمُوا وَادَّخِرُوا فَإِنَّ ذَلِكَ الْعَامَ كَانَ فِيهِ شِدَّةٌ أَوْ كَلِمَةً تُشْبِهُهَا فَأَرَدْتُ أَنْ تَقْسِمُوا فِي النَّاسِ
[Machine] The Messenger of Allah ﷺ said: "We used to prohibit you from eating its meat for more than three days, so that it would be enough for you. Then Allah brought abundance, so eat, save, and do business. Behold, these days are days of eating, drinking, and remembering Allah. And when he said 'and do business,' he meant to maintain kinship by giving gifts, for charity sought for its reward, not for trade."
قَالَ رَسُولُ اللهِ ﷺ إِنَّا كُنَّا نَهَيْنَاكُمْ عَنْ لُحُومِهَا أَنْ تَأْكُلُوهَا فَوْقَ ثَلَاثٍ لِكَيْ يَسَعَكُمْ جَاءَ اللهُ بِالسَّعَةِ فَكُلُوا وَادَّخِرُوا وَاتَّجِرُوا أَلَا وَإِنَّ هَذِهِ الْأَيَّامَ أَيَّامُ أَكْلٍ وَشُرْبٍ وَذِكْرِ اللهِ ﷻ قَوْلُهُ وَاتَّجِرُوا صِلَةُ ائْتَجِرُوا عَلَى وَزْنِ افْتَعِلُوا يُرِيدُ الصَّدَقَةَ الَّتِي يُبْتَغَى أَجْرُهَا وَلَيْسَ مِنْ بَابِ التِّجَارَةِ
We used to salt some of the meat of sacrifice and present it to the Prophet ﷺ at Medina. Once he said, "Do not eat (of that meat) for more than three days." That was not a final order, but (that year) he wanted us to feed of it to others, Allah knows better. (Using translation from Bukhārī 5570)
الضَّحِيَّةُ كُنَّا نُمَلِّحُ مِنْهُ وَنَقْدَمُ بِهِ إِلَى النَّبِيِّ ﷺ بِالْمَدِينَةِ فَقَالَ لَا تَأْكُلُوا مِنْهُ إِلَّا ثَلَاثَةَ أَيَّامٍ وَلَيْسَتْ بِعَزِيمَةٍ وَلَكِنْ أَرَادَ أَنْ تَطْعَمُوا مِنْهُ وَاللهُ أَعْلَمُ
Some people of desert came at the time of sacrifice in the time of Apostle of Allah ﷺ. The Messenger of Allah ﷺ said: Store up for three days and give the rest as sadaqah (alms). After than the people said to the Messenger of Allah ﷺ: Messenger of Allah, the people used to benefit from their sacrifices, take and dissolve fat from them, and make water-bags (from their skins). The Messenger of Allah ﷺ said: What is that ? or whatever he said: They said: Messenger of Allah ﷺ, you have prohibited to preserve the meat of sacrifice after three days. The Messenger of Allah ﷺ said: I prohibited you due to a body of people who came to you. Now eat, give it as sadaqah (alms), and store up. (Using translation from Abū Dāʾūd 2812)
رَسُولُ اللهِ ﷺ عَنْ أَكْلِ لُحُومِ الْأَضَاحِيِّ بَعْدَ ثَلَاثٍ قَالَ عَبْدُ اللهِ بْنُ أَبِي بَكْرٍ فَذَكَرْتُ ذَلِكَ لِعَمْرَةَ فَقَالَتْ صَدَقَ سَمِعْتُ عَائِشَةَ ؓ تَقُولُ دَفَّ نَاسٌ مِنْ أَهْلِ الْبَادِيَةِ حَضْرَةَ الْأَضْحَى فِي زَمَانِ النَّبِيِّ ﷺ فَقَالَ رَسُولُ اللهِ ﷺ ادَّخِرُوا لِثَلَاثٍ وَتَصَدَّقُوا بِمَا بَقِيَ قَالَتْ فَلَمَّا كَانَ بَعْدَ ذَلِكَ قِيلَ يَا رَسُولَ اللهِ لَقَدْ كَانَ النَّاسُ يَنْتَفِعُونَ مِنْ ضَحَايَاهُمْ يَجْمُلُونَ مِنْهَا الْوَدَكَ وَيَتَّخِذُونَ مِنْهَا الْأَسْقِيَةَ فَقَالَ رَسُولُ اللهِ ﷺ وَمَا ذَاكَ ؟ أَوْ كَمَا قَالَ قَالُوا يَا رَسُولَ اللهِ نَهَيْتَ عَنْ أَكْلِ لُحُومِ الضَّحَايَا بَعْدَ ثَلَاثٍ فَقَالَ رَسُولُ اللهِ ﷺ إِنَّمَا نَهَيْتُكُمْ مِنْ أَجْلِ الدَّافَّةِ الَّتِي دَفَّتْ حَضْرَةَ الْأَضْحَى فَكُلُوا وَتَصَدَّقُوا وَادَّخِرُوا
[Machine] The Messenger of Allah ﷺ forbade and Abu al-Hasan 'Ali ibn Muhammad al-Muqri reported that al-Hasan ibn Muhammad ibn Ishaq narrated to us, Yusuf ibn Ya'qub narrated to us, Muhammad ibn Kathir narrated to us, Sufyan narrated to us, 'Abd al-Rahman ibn 'Abis ibn Rabiah narrated from his father 'Abis ibn Rabiah that he said, "It was said to 'Aishah, 'Did the Messenger of Allah ﷺ forbid the eating of sacrificial meat after three days?' She said, 'He only forbade it once in a year when the people were hungry from it and he intended to feed the rich and poor. We used to keep the humps for fifteen days and then eat it.' I then asked, 'Why did you do that?' She laughed and said, 'The household of Muhammad ﷺ did not get full with the bread made of barley continuously for three days until he met Allah ﷻ.'
رَسُولُ اللهِ ﷺ نَهَى ح وأنبأ أَبُو الْحَسَنِ عَلِيُّ بْنُ مُحَمَّدٍ الْمُقْرِي أنبأ الْحَسَنُ بْنُ مُحَمَّدِ بْنِ إِسْحَاقَ ثنا يُوسُفُ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ كَثِيرٍ ثنا سُفْيَانُ ثنا عَبْدُ الرَّحْمَنِ بْنُ عَابِسِ بْنِ رَبِيعَةَ عَنْ أَبِيهِ عَابِسِ بْنِ رَبِيعَةَ أَنَّهُ قَالَ قِيلَ لِعَائِشَةَ ؓ أَنَهَى رَسُولُ اللهِ ﷺ أَنْ يُؤْكَلَ لُحُومُ الْأَضَاحِيِّ فَوْقَ ثَلَاثَةِ أَيَّامٍ؟ قَالَتْ مَا نَهَى عَنْهُ إِلَّا مَرَّةً فِي عَامٍ جَاعَ النَّاسُ مِنْهُ فَأَرَادَ أَنْ يُطْعِمَ الْغَنِيُّ الْفَقِيرَ وَلَقَدْ كُنَّا نُخْرِجُ الْكُرَاعَ بَعْدَ خَمْسَ عَشْرَةَ فَنَأْكُلُهُ فَقُلْتُ وَلِمَ تَفْعَلُونَ ذَلِكَ؟ قَالَ فَضَحِكَتْ وَقَالَتْ مَا شَبِعَ آلُ مُحَمَّدٍ ﷺ مِنْ خُبْزِ بُرٍّ مَأْدُومٍ ثَلَاثَةَ أَيَّامٍ حَتَّى لَحِقَ بِاللهِ ﷻ
61.36 [Machine] Feeding the poor and needy, and the content and distressed, and what is mentioned in their interpretation. Allah, may He be blessed and exalted, said: "So eat of them and feed the poor" [Surah Al-Hajj: 28], and He said: "And feed the contented and the distressed" [Surah Al-Hajj: 36]. Imam ash-Shafi'i, may Allah have mercy on him, said: The contented is the one who asks, and the distressed is the visitor who is passing by without staying. And he said in another place: The contented is the poor, and the distressed is the visitor, and it is said to be the one who exposes the gift from it.
٦١۔٣٦ بَابُ إِطْعَامِ الْبَائِسِ الْفَقِيرِ وَإِطْعَامِ الْقَانِعِ وَالْمُعْتَرِّ , وَمَا جَاءَ فِي تَفْسِيرِهِمْ قَالَ اللهُ تَبَارَكَ وَتَعَالَى: {فَكُلُوا مِنْهَا وَأَطْعِمُوا الْبَائِسَ الْفَقِيرَ} [الحج: 28]، وَقَالَ: {وَأَطْعِمُوا الْقَانِعَ وَالْمُعْتَرَّ} [الحج: 36]. قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: الْقَانِعُ هُوَ السَّائِلُ وَالْمُعْتَرُّ هُوَ الزَّائِرُ وَالْمَارُّ بِلَا وَقْتٍ. وَقَالَ فِي مَوْضِعٍ آخَرَ: الْقَانِعُ: الْفَقِيرُ، وَالْمُعْتَرُّ: الزَّائِرُ , وَقِيلَ الَّذِي يَتَعَرَّضُ الْعَطِيَّةَ مِنْهَا.
[Machine] About Ata's statement regarding Allah's command "And feed the poor and the needy" [Quran 22:28], he said...
عَنْ عَطَاءٍ فِي قَوْلِ اللهِ ﷻ {وَأَطْعِمُوا الْبَائِسَ الْفَقِيرَ} [الحج 28] قَالَ الَّذِي يَسْأَلُكَ
[Machine] "The satisfied seeker and the persistent one who seeks you, they want you without asking you."
الْقَانِعُ السَّائِلُ وَالْمُعْتَرُّ الَّذِي يَعْتَرِيكَ يُرِيدُكَ وَلَا يَسْأَلُكَ
[Machine] About Ibrahim and Mujahid, the contented person sitting in his house and the person causing you distress.
عَنْ إِبْرَاهِيمَ وَمُجَاهِدٍ الْقَانِعُ الْجَالِسُ فِي بَيْتِهِ وَالْمُعْتَرُّ الَّذِي يَعْتَرِيكَ
[Machine] In his statement, "The one who is content and the one who asks," [Al-Hajj 36], the content one is the one who accepts what is given to him without asking, and the one who asks is the one who seeks and does not hesitate to ask. He said: "It was narrated to us by Sa'eed, from Hushaim, from Mughira, from Ibrahim. One of them is the wayfarer and the other is the questioner."
فِي قَوْلِهِ {الْقَانِعَ وَالْمُعْتَرَّ} [الحج 36] قَالَ الْقَانِعُ الَّذِي يَقْنَعُ لِلرَّجُلِ يَسْأَلُهُ وَالْمُعْتَرُّ الَّذِي يَتَعَرَّضُ وَلَا يَسْأَلُ 19228 قَالَ وَحَدَّثَنَاهُ سَعِيدٌ ثنا هُشَيْمٌ أنبأ مُغِيرَةُ عَنْ إِبْرَاهِيمَ قَالَ أَحَدُهُمَا الْمَارُّ وَالْآخَرُ السَّائِلُ
[Machine] The content of the passage is: "The satisfied person is asking."
الْقَانِعُ السَّائِلُ
[Machine] About Mujahid's saying, "So eat from it and feed the needy and poor." (Surah Al-Hajj, 28) The needy person who asks with his hand, when he asks, the poor person who is satisfied but still hopes to receive some of your sacrifice from your neighbors, the beggar who covers himself and does not ask you directly, he exposes himself to you. It was narrated that Ibn Abbas said about this.
عَنْ مُجَاهِدٍ فِي قَوْلِهِ {فَكُلُوا مِنْهَا وَأَطْعِمُوا الْبَائِسَ الْفَقِيرَ} [الحج 28] قَالَ الْبَائِسُ الَّذِي يَسْأَلُ بِيَدِهِ إِذَا سَأَلَ قَالَ وَالْقَانِعُ الطَّامِعُ الَّذِي يَطْمَعُ فِي ذَبِيحَتِكَ مِنْ جِيرَانِكَ قَالَ وَالْمُعْتَرُّ الَّذِي يَعْتَرِيكَ بِنَفْسِهِ وَلَا يَسْأَلُكَ يَتَعَرَّضُ لَكَ وَرُوِيَ فِي ذَلِكَ عَنِ ابْنِ عَبَّاسٍ
[Machine] "To Ibn Abbas, have you seen the contented and the disaffected? What are the contented and the disaffected? He said, as for the contented one, it is the one who is content with what you have sent to him in his home, and the disaffected one is the one who disapproves of you."
لِابْنِ عَبَّاسٍ ؓ أَرَأَيْتَ الْقَانِعَ وَالْمُعْتَرَّ؟ مَا الْقَانِعُ وَالْمُعْتَرُّ؟ قَالَ أَمَّا الْقَانِعُ فَالْقَانِعُ بِمَا أَرْسَلْتَ إِلَيْهِ فِي بَيْتِهِ وَالْمُعْتَرُّ الَّذِي يَعْتَرِيكَ
61.37 [Machine] He does not sell anything from his sacrificial animal, nor does he give a share of it as a fee.
٦١۔٣٧ بَابُ لَا يَبِيعُ مِنْ أُضْحِيَّتِهِ شَيْئًا , وَلَا يُعْطِي أَجْرَ الْجَازِرِ مِنْهَا
[Machine] The Messenger of Allah ﷺ commanded me to stand by a camel's hump and divide its skin and meat. He ordered me not to give anything from it to the butcher and said, "We will give him something from ourselves." In another narration by Abu Khaythama, he commanded me to give charity with its meat, skin, and bones, and not to give the butcher any payment from it. He said, "We will give him payment from ourselves."
أَمَرَنِي رَسُولُ اللهِ ﷺ أَنْ أَقُومَ عَلَى بَدَنَةٍ وَأَنْ أَقْسِمَ جُلُودَهَا وَجِلَالَهَا وَأَمَرَنِي أَنْ لَا أُعْطِيَ الْجَازِرَ مِنْهَا شَيْئًا وَقَالَ نَحْنُ نُعْطِيهِ مِنْ عِنْدِنَا وَفِي رِوَايَةِ أَبِي خَيْثَمَةَ وَأَنْ أَتَصَدَّقَ بِلَحْمِهَا وَجُلُودِهَا وَأَجِلَّتِهَا وَأَنْ لَا أُعْطِيَ أَجْرَ الْجَازِرِ مِنْهَا قَالَ نَحْنُ نُعْطِيهِ مِنْ عِنْدِنَا
[Machine] The Messenger of Allah ﷺ said, "Whoever sells the skin of his sacrificial animal, there is no sacrifice for him."
قَالَ رَسُولُ اللهِ ﷺ مَنْ بَاعَ جِلْدَ أُضْحِيَّتِهِ فَلَا أُضْحِيَّةَ لَهُ
61.38 [Machine] Participation in Hajj and Udhiyah.
٦١۔٣٨ بَابُ الِاشْتِرَاكِ فِي الْهَدْيِ وَالْأُضْحِيَّةِ
[Machine] We sacrificed with the Messenger of Allah ﷺ in Al-Hudaybiyah: one camel for seven people, and one cow for seven people. This is the wording of the hadith of Qutaybah.
نَحَرْنَا مَعَ رَسُولِ اللهِ ﷺ بِالْحُدَيْبِيَةِ الْبَدَنَةَ عَنْ سَبْعَةٍ وَالْبَقَرَةَ عَنْ سَبْعَةٍ لَفْظُ حَدِيثِ قُتَيْبَةَ
We set out in the state of Ihram for Hajj along, with Messenger of Allah ﷺ. He commanded us that seven persons should join in a camel and a cow for offering sacrifice. (Using translation from Muslim 1318b)
خَرَجْنَا مَعَ رَسُولِ اللهِ ﷺ مُهِلِّينَ بِالْحَجِّ فَأَمَرَنَا رَسُولُ اللهِ ﷺ أَنْ نَشْتَرِكَ فِي الْإِبِلِ وَالْبَقَرِ كُلُّ سَبْعَةٍ مِنَّا فِي بَدَنَةٍ
[Machine] He heard Jabir ibn Abdullah say, "We were with the Prophet ﷺ during the Hajj and Umrah, and we jointly purchased seven goats. A man said to him, 'Can a cow be jointly purchased?' He replied, 'It is only for goats.' Then Jabir came to Al-Hudaybiyah and said, 'We jointly purchased every seven in a camel.' So that day we slaughtered seventy camels."
أَنَّهُ سَمِعَ جَابِرَ بْنَ عَبْدِ اللهِ ؓ يَقُولُ كُنَّا مَعَ النَّبِيِّ ﷺ فِي الْحَجِّ وَالْعُمْرَةِ فَاشْتَرَكْنَا فِي الْجَزُورِ سَبْعَةٌ فَقَالَ لَهُ رَجُلٌ الْبَقَرَةُ يُشْتَرَكُ فِيهَا؟ قَالَ مَا هِيَ إِلَّا مِنَ الْبُدْنِ وَحَضَرَ جَابِرٌ الْحُدَيْبِيَةَ فَقَالَ اشْتَرَكْنَا كُلُّ سَبْعَةٍ فِي بَدَنَةٍ فَنَحَرْنَا يَوْمَئِذٍ سَبْعِينَ بَدَنَةً
[Machine] "The cow (referring to a hadith) mentioned (something) about seven (things), and Al-Badana (another hadith collection) mentioned (something) about seven as well. It is narrated by Ata' from Jabir that Al-Badana mentioned (something) about seven. And there is consensus among these imams that Abu Al-Zubayr narrated from Jabir that Ata' also mentioned (something) about Jabir, stating that Al-Badana mentioned (something) about seven which is more valid than the narrations of Thawri from Abu Al-Zubayr from Jabir, in which there is mention of ten. We also have narrations from Ali, Hudhayfah, Abu Masud Al-Ansari, and Aisha stating that they said the cow (referring to a hadith) mentioned (something) about seven."
ﷺ قَالَ الْبَقَرَةُ عَنْ سَبْعَةٍ وَالْبَدَنَةُ عَنْ سَبْعَةٍ رِوَايَةُ عَطَاءٍ عَنْ جَابِرٍ عَلَى أَنَّ الْبَدَنَةَ عَنْ سَبْعَةٍ وَإِجْمَاعُ هَؤُلَاءِ الْأَئِمَّةِ عَنْ أَبِي الزُّبَيْرِ عَنْ جَابِرٍ ثُمَّ رِوَايَةُ عَطَاءٍ عَنْ جَابِرٍ عَلَى أَنَّ الْبَدَنَةَ عَنْ سَبْعَةٍ أَوْلَى مِنْ رِوَايَةِ الثَّوْرِيِّ عَنْ أَبِي الزُّبَيْرِ عَنْ جَابِرٍ ؓ فِي الْبَدَنَةِ عَنْ عَشَرَةٍ وَرُوِّينَا عَنْ عَلِيٍّ وَحُذَيْفَةَ وَأَبِي مَسْعُودٍ الْأَنْصَارِيِّ وَعَائِشَةَ ؓ أَنَّهُمْ قَالُوا الْبَقَرَةُ عَنْ سَبْعَةٍ
61.39 [Machine] Sacrifice during Travel
٦١۔٣٩ بَابُ الْأُضْحِيَّةِ فِي السَّفَرِ
[Machine] That the Messenger of Allah ﷺ sacrificed his offering during travel, then he said, "O Thawban, fix its meat." And I continued fixing it until we reached Madinah.
أَنَّ رَسُولَ اللهِ ﷺ ذَبَحَ أُضْحِيَّتَهُ فِي السَّفَرِ ثُمَّ قَالَ يَا ثَوْبَانُ أَصْلِحْ لَحْمَهَا فَلَمْ أَزَلْ أُصْلِحُهُ حَتَّى قَدِمْنَا الْمَدِينَةَ
61.40 [Machine] Who said: "Eid Al-Adha is valid on the day of sacrifice and all the days of Mina are for the sacrifices because they are days of rituals"?
٦١۔٤٠ بَابُ مَنْ قَالَ: الْأَضْحَى جَائِزٌ يَوْمَ النَّحْرِ وَأَيَّامَ مِنًى كُلَّهَا لِأَنَّهَا أَيَّامُ النُّسُكِ
[Machine] On the authority of the Prophet ﷺ , he said: "Every place in Arafat is a standing place, so elevate yourselves from Arafat. And every place in Muzdalifah is a standing place, so elevate yourselves from Muhassir. And every stone rim (jamarat) in Mina is a place of sacrifice. And every day of Tashreeq is a day of slaughter." He said: "And Abu Bakr narrated to us, Ahmad ibn Yusuf narrated to us, Abu Al-Yaman narrated to us, Sa'id ibn Abdul-Aziz mentioned it like this. This is the authentic narration and it is Mursal."
عَنِ النَّبِيِّ ﷺ قَالَ كُلُّ عَرَفَاتٍ مَوْقِفٌ وَارْفَعُوا عَنْ عَرَفَاتٍ وَكُلُّ مُزْدَلِفَةَ مَوْقِفٌ وَارْفَعُوا عَنْ مُحَسِّرٍ وَكُلُّ فِجَاجِ مِنًى مَنْحَرٌ وَكُلُّ أَيَّامِ التَّشْرِيقِ ذَبْحٌ 19240 قَالَ وَحَدَّثَنَا أَبُو بَكْرٍ ثنا أَحْمَدُ بْنُ يُوسُفَ ثنا أَبُو الْيَمَانِ ثنا سَعِيدُ بْنُ عَبْدِ الْعَزِيزِ فَذَكَرَهُ بِمِثْلِهِ هَذَا هُوَ الصَّحِيحُ وَهُوَ مُرْسَلٌ
[Machine] The Messenger of Allah ﷺ said, "Arafat is a standing place and remove any harm from the roadways. And every mash'ar (place of staying) is a standing place, so remove any distress from it. And every valley in Mina is a place of sacrifice. And during the days of tashreeq (11th, 12th, and 13th of Dhul Hijjah), there is slaughtering." This narration was reported by Suwaid bin Abdul Aziz, and he is considered weak by some of the scholars of transmission, on the authority of Sa'id.
قَالَ رَسُولُ اللهِ ﷺ عَرَفَاتٌ مَوْقِفٌ وَارْفَعُوا عَنْ عُرَنَةَ وَكُلُّ مُزْدَلِفَةَ مَوْقِفٌ وَارْفَعُوا عَنْ مُحَسِّرٍ وَكُلُّ فِجَاجِ مِنًى مَنْحَرٌ وَفِي كُلِّ أَيَّامِ التَّشْرِيقِ ذَبْحٌ وَرَوَاهُ سُوَيْدُ بْنُ عَبْدِ الْعَزِيزِ وَهُوَ ضَعِيفٌ عِنْدَ بَعْضِ أَهْلِ النَّقْلِ عَنْ سَعِيدٍ
[Machine] The Messenger of Allah ﷺ said, "The days of Tashreeq are all days of slaughter."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ أَيَّامُ التَّشْرِيقِ كُلُّهَا ذَبْحٌ
[Machine] The Prophet ﷺ said, "Every day of Tashreeq requires a sacrifice."
أَنَّ النَّبِيَّ ﷺ قَالَ كُلُّ أَيَّامِ التَّشْرِيقِ ذَبْحٌ
[Machine] He informed him about a man from the companions of the Prophet ﷺ who was named Nafi', but I forgot that the Prophet ﷺ said to a man from the Ghifar tribe, "Stand up and give the call to prayer, for only a believer enters paradise, and these are days of eating and drinking, days of Mina." Sulaiman bin Musa added, "and of sacrifice." Ibn Juraij said, "The days of sacrifice."
أَخْبَرَهُ عَنْ رَجُلٍ مِنْ أَصْحَابِ النَّبِيِّ ﷺ قَدْ سَمَّاهُ نَافِعٌ فَنَسِيتُهُ أَنَّ النَّبِيَّ ﷺ قَالَ لِرَجُلٍ مِنْ غِفَارٍ قُمْ فَأَذِّنْ أَنَّهُ لَا يَدْخُلُ الْجَنَّةَ إِلَّا مُؤْمِنٌ وَأَنَّهَا أَيَّامُ أَكْلٍ وَشُرْبٍ أَيَّامُ مِنًى زَادَ سُلَيْمَانُ بْنُ مُوسَى وَذَبْحٍ يَقُولُ أَيَّامُ ذَبْحٍ ابْنُ جُرَيْجٍ يَقُولُهُ
[Machine] The Prophet, blessings and ﷺ , informed us that all the days of Tashreeq involve sacrificing. Abu Sa'd al-Malayeeni informed us that Abu Ahmad ibn 'Adi al-Hafiz informed us that 'Abdullah ibn Muhammad ibn Muslim narrated to us that Duha'im narrated to us that Muhammad ibn Shu'ayb narrated to us that Mu'awiya ibn Yahya mentioned it and said that it was narrated from Abu Sa'id 19246, and Abu Sa'd informed us that Abu Ahmad narrated to us that Ja'far ibn Ahmad ibn 'Asim narrated to us that Duha'im narrated to us that Muhammad ibn Shu'ayb narrated to us from As-Saddafi, and he mentioned it and said that it was narrated from Abu Huraira. Abu Ahmad said: "And this is the same." Abu Ahmad also said: "And this is the same." Al-Zuhri narrated from Sa'id, from Abu Huraira, and he said: "And this is the same." Al-Zuhri narrated from Ibn Al-Musayyib, from Abu Sa'id, all of them are not preserved, except the narration of As-Saddafi. The Shaykh, may Allah have mercy on him, said: "And As-Saddafi is weak and cannot be relied upon."
النَّبِيِّ ﷺ أَيَّامُ التَّشْرِيقِ كُلُّهَا ذَبْحٌ أَخْبَرَنَاهُ أَبُو سَعْدٍ الْمَالِينِيُّ أنبأ أَبُو أَحْمَدَ بْنُ عَدِيٍّ الْحَافِظُ أنبأ عَبْدُ اللهِ بْنُ مُحَمَّدِ بْنِ مُسْلِمٍ ثنا دُحَيْمٌ ثنا مُحَمَّدُ بْنُ شُعَيْبٍ ثنا مُعَاوِيَةُ بْنُ يَحْيَى فَذَكَرَهُ وَقَالَ عَنْ أَبِي سَعِيدٍ 19246 وَأَخْبَرَنَا أَبُو سَعْدٍ أنبأ أَبُو أَحْمَدَ ثنا جَعْفَرُ بْنُ أَحْمَدَ بْنِ عَاصِمٍ ثنا دُحَيْمٌ ثنا مُحَمَّدُ بْنُ شُعَيْبٍ عَنِ الصَّدَفِيِّ فَذَكَرَهُ وَقَالَ عَنْ أَبِي هُرَيْرَةَ ؓ قَالَ أَبُو أَحْمَدَ وَهَذَا سَوَاءٌ قَالَ عَنِ الزُّهْرِيِّ عَنْ سَعِيدٍ عَنْ أَبِي هُرَيْرَةَ ؓ وَسَوَاءٌ قَالَ عَنِ الزُّهْرِيِّ عَنِ ابْنِ الْمُسَيِّبِ عَنْ أَبِي سَعِيدٍ جَمِيعًا غَيْرُ مَحْفُوظَيْنِ لَا يَرْوِيهُمَا غَيْرُ الصَّدَفِيِّ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَالصَّدَفِيُّ ضَعِيفٌ لَا يُحْتَجُّ بِهِ
[Machine] Eid al-Adha is three days after the Day of Sacrifice.
الْأَضْحَى ثَلَاثَةُ أَيَّامٍ بَعْدَ يَوْمِ النَّحْرِ
[Machine] That Hasan and Ataa said: It is slaughtered until the last days of the Tashriq.
أَنَّ الْحَسَنَ وَعَطَاءً قَالَا يُضَحَّى إِلَى آخِرِ أَيَّامِ التَّشْرِيقِ
[Machine] The Festival of Sacrifice is three days after the Day of the Sacrifice.
الْأَضْحَى ثَلَاثَةُ أَيَّامٍ بَعْدَ يَوْمِ النَّحْرِ
[Machine] Ata' said, "A sacrifice should be made during all the days of Mina, and on the last day of farewell."
قَالَ عَطَاءٌ يُذْبَحُ فِي أَيَّامِ مِنًى كُلِّهَا وَفِي يَوْمِ النَّفْرِ الْآخِرِ
[Machine] Al-Adha is the day of sacrifice and three days following it.
الْأَضْحَى يَوْمُ النَّحْرِ وَثَلَاثَةُ أَيَّامٍ بَعْدَهُ
[Machine] "Makholun Sadaqa"
مَكْحُولٌ صَدَقَ
61.41 [Machine] Who said the sacrifice is on the day of the slaughter and two days after it?
٦١۔٤١ بَابُ مَنْ قَالَ الْأَضْحَى يَوْمَ النَّحْرِ وَيَوْمَيْنِ بَعْدَهُ
[Machine] Whoever wishes, let him slaughter today and then tomorrow, if Allah wills.
عُمَرَ ؓ مَنْ شَاءَ فَلْيُضَحِّ الْيَوْمَ ثُمَّ غَدًا إِنْ شَاءَ اللهُ
[Machine] Ali ibn Abi Talib used to say that Eid al-Adha is two days after the day of Eid al-Adha.
عَلِيَّ بْنَ أَبِي طَالِبٍ ؓ كَانَ يَقُولُ الْأَضْحَى يَوْمَانِ بَعْدَ يَوْمِ الْأَضْحَى
الذَّبْحُ بَعْدَ النَّحْرِ يَوْمَانِ
61.42 [Machine] Who said sacrifices until the end of the month for those who wanted to inquire about it
٦١۔٤٢ بَابُ مَنْ قَالَ الضَّحَايَا إِلَى آخِرِ الشَّهْرِ لِمَنْ أَرَادَ أَنْ يَسْتَأْنِيَ ذَلِكَ
[Machine] That the Messenger of Allah ﷺ said: "The Udhiyah (sacrifice) is to be performed until the end of the month for those who wish to consult about it." This is the wording of the hadith of Asbahani, and in the narration of Abu Hamid it is mentioned that the Prophet of Allah ﷺ said: "The Udhiyah is to be performed until the beginning of the month of Muharram for those who wish to consult about it."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ الضَّحَايَا إِلَى آخِرِ الشَّهْرِ لِمَنْ أَرَادَ أَنْ يَسْتَأْنِيَ ذَلِكَ لَفْظُ حَدِيثِ الْأَصْبَهَانِيِّ وَفِي رِوَايَةِ أَبِي حَامِدٍ أَنَّ نَبِيَّ اللهِ ﷺ قَالَ الضَّحَايَا إِلَى هِلَالِ الْمُحَرَّمِ لِمَنْ أَرَادَ أَنْ يَسْتَأْنِي ذَلِكَ
[Machine] Abu Ishaq al-Marwazi, may Allah have mercy on him, stated in the commentary that it is narrated in some of the Eid al-Adha reports that the beginning of the month of Muharram is the day of Arafah. If this is correct, then the matter extends to the first day of Muharram. However, if it is not correct, then the correct report is that the days of Mina are the days of sacrifice. And based on this, Imam Ash-Shafi'i, may Allah have mercy on him, said, "The sheikh, may Allah have mercy on him, has deliberated on both views. This is due to the differences in narrations regarding this matter, focusing on Sulaiman bin Musa. The hadith of Sulaiman bin Musa is the stronger of the two, and Allah knows best."
أَبُو إِسْحَاقَ الْمَرْوَزِيُّ رَحِمَهُ اللهُ فِي الشَّرْحِ رُوِيَ فِي بَعْضِ الْأَخْبَارِ الْأُضْحِيَّةُ إِلَى رَأْسِ الْمُحَرَّمِ فَإِنْ صَحَّ ذَلِكَ فَالْأَمْرُ يَتَّسِعُ فِيهِ إِلَى غُرَّةِ الْمُحَرَّمِ وَإِنْ لَمْ يَصِحَّ فَالَّخَبَرُ الصَّحِيحُ أَيَّامُ مِنًى أَيَّامُ نَحْرٍ وَعَلَى هَذَا بَنَى الشَّافِعِيُّ رَحِمَهُ اللهُ قَالَ الشَّيْخُ رَحِمَهُ اللهُ فِي كِلَيْهِمَا نَظَرٌ هَذَا لِإِرْسَالِهِ وَمَا مَضَى لِاخْتِلَافِ الرُّوَاةِ فِيهِ عَلَى سُلَيْمَانَ بْنِ مُوسَى وَحَدِيثُ سُلَيْمَانَ بْنِ مُوسَى أَوْلَاهُمَا أَنْ يُقَالَ بِهِ وَاللهُ أَعْلَمُ

٦١۔٤٤ بَابُ الْعَقِيقَةُ سُنَّةٌ
[Machine] Abu Abdullah Al-Hafiz informed us that Abu Abdullah As-Saffar reported to us, who narrated from Ismail ibn Ishaq, who narrated from Sulaiman ibn Harb, who narrated from Hammad ibn Zaid, who narrated from Ayyub, who narrated from Muhammad, who narrated from a man named Salman, who reported: "With the newborn baby, there should be the sacrifice of an animal, so pour out its blood and remove any harm from it."
أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ أَبُو عَبْدِ اللهِ الصَّفَّارُ ثنا إِسْمَاعِيلُ بْنُ إِسْحَاقَ ثنا سُلَيْمَانُ بْنُ حَرْبٍ ثنا حَمَّادُ بْنُ زَيْدٍ عَنْ أَيُّوبَ عَنْ مُحَمَّدٍ عَنْ رَجُلٍ يُقَالُ لَهُ سَلْمَانُ رَفَعَهُ قَالَ مَعَ الْغُلَامِ عَقِيقَةٌ فَأَهْرِيقُوا عَنْهُ الدَّمَ وَأَمِيطُوا عَنْهُ الْأَذَى
[Machine] Abu Abdullah Al-Hafiz informed us that Abu Abdullah Al-Saffar narrated to us from Ismail bin Ishaq, who narrated from Hajjaj bin Minhal, who narrated from Hammad bin Salamah, who narrated from Ayub and Qatadah and Habib, who narrated from Muhammad bin Sirin, who narrated from Salman bin Amer Al-Dabbi, that the Messenger of Allah ﷺ said: "For a newborn boy, perform the Aqiqah, then shed blood from him and remove any harm from him." The scholar, may Allah have mercy on him, said: "It has been narrated from Al-Thawri, from Ayub, in a similar manner."
أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ أَبُو عَبْدِ اللهِ الصَّفَّارُ ثنا إِسْمَاعِيلُ بْنُ إِسْحَاقَ ثنا حَجَّاجُ بْنُ مِنْهَالٍ ثنا حَمَّادُ بْنُ سَلَمَةَ ثنا أَيُّوبُ وَقَتَادَةُ وَحَبِيبٌ عَنْ مُحَمَّدٍ ح وَأَخْبَرَنَا عَلِيُّ بْنُ أَحْمَدَ بْنِ عَبْدَانَ أنبأ أَحْمَدُ بْنُ عُبَيْدٍ الصَّفَّارُ ثنا خَلَفُ بْنُ عَمْرٍو الْعُكْبَرِيُّ ثنا عَبْدُ الْأَعْلَى بْنُ حَمَّادٍ ثنا حَمَّادٌ عَنْ يُونُسَ وَأَيُّوبَ وَهِشَامٍ وَحَبِيبٍ وَقَتَادَةَ فِي آخَرِينَ عَنْ مُحَمَّدِ بْنِ سِيرِينَ عَنْ سَلْمَانَ بْنِ عَامِرٍ الضَّبِّيِّ ؓ أَنَّ رَسُولَ اللهِ ﷺ قَالَ فِي الْغُلَامِ عَقِيقَةٌ فَأَهْرِيقُوا عَنْهُ دَمًا وَأَمِيطُوا عَنْهُ الْأَذَى قَالَ الْفَقِيهُ رَحِمَهُ اللهُ وَقَدْ رُوِيَ عَنِ الثَّوْرِيِّ عَنْ أَيُّوبَ كَذَلِكَ مُجَوَّدًا
[Machine] The Messenger of Allah ﷺ said about a newborn baby boy, "Slaughter an animal for him as a sacrifice, remove impurities from him, and testify to his faith." Al-Bukhari also narrated this through the narration of Jarir ibn Hazim from Ayyub, and similarly, Mujawwad narrated it. Al-Bukhari also narrated it through the narration of Yazid ibn Ibrahim from Ibn Sirin from Salman, with the same wording.
قَالَ رَسُولُ اللهِ ﷺ عَنِ الْغُلَامِ عَقِيقَةٌ فَأَهْرِيقُوا عَنْهُ دَمًا وَأَمِيطُوا عَنْهُ الْأَذَى وَاسْتَشْهَدَ الْبُخَارِيُّ أَيْضًا بِرِوَايَةِ جَرِيرِ بْنِ حَازِمٍ عَنْ أَيُّوبَ كَذَلِكَ مُجَوَّدًا قَالَ الْبُخَارِيُّ وَرَوَاهُ يَزِيدُ بْنُ إِبْرَاهِيمَ عَنِ ابْنِ سِيرِينَ عَنْ سَلْمَانَ قَوْلَهُ
[Machine] Salman said that the aqiqah is to be done with the child, so pour (the blood) out and remove harm from him. Muhammad said that he was eager to know what harm was removed from him, but he couldn't find anyone to inform him. The jurist, may Allah have mercy on him, said that Hisham narrated from Al-Hasan Al-Basri that he used to say that removing harm is shaving the head. Abu Ali Al-Rudhbary informed us that Muhammad bin Bakr told us, who was informed by Abu Dawood, who was informed by Yahya bin Khalaf, who was informed by Abdul-A'la, who was informed by Hisham, from Al-Hasan, and he mentioned it. Al-Bukhari said, and others beside him, that Asim and Hisham narrated from Hafsah bint Sirin, from Arraba' from Salman, from the Prophet ﷺ .
قَالَ سَلْمَانُ الْعَقِيقَةُ مَعَ الْوَلَدِ فَأَهْرِيقُوا عَنْهُ الدَّمَ وَأَمِيطُوا عَنْهُ الْأَذَى قَالَ مُحَمَّدٌ حَرَصْتُ عَلَى أَنْ أَعْلَمَ مَا أَمِيطُوا عَنْهُ الْأَذَى فَلَمْ أَجِدْ مَنْ يُخْبِرُنِي 19262 قَالَ الْفَقِيهُ رَحِمَهُ اللهُ قَدْ رَوَى هِشَامٌ عَنِ الْحَسَنِ الْبَصْرِيِّ أَنَّهُ كَانَ يَقُولُ إِمَاطَةُ الْأَذَى حَلْقُ الرَّأْسِ أَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ مُحَمَّدُ بْنُ بَكْرٍ ثنا أَبُو دَاوُدَ ثنا يَحْيَى بْنُ خَلَفٍ ثنا عَبْدُ الْأَعْلَى ثنا هِشَامٌ عَنِ الْحَسَنِ فَذَكَرَهُ قَالَ الْبُخَارِيُّ وَقَالَ غَيْرُ وَاحِدٍ عَنْ عَاصِمٍ وَهِشَامٍ عَنْ حَفْصَةَ بِنْتِ سِيرِينَ عَنِ الرَّبَابِ عَنْ سَلْمَانَ ؓ عَنِ النَّبِيِّ ﷺ
The Messenger of Allah ﷺ as saying: Along with a boy there is an 'Aqiqah, so shed blood on his behalf, and remove injury from him. (Using translation from Abū Dāʾūd 2839)
قَالَ رَسُولُ اللهِ ﷺ مَعَ الْغُلَامِ عَقِيقَةٌ فَأَهْرِيقُوا عَنْهُ دَمًا وَأَمِيطُوا عَنْهُ الْأَذَى
[Machine] Every child is held as a hostage by his own `aqiqah (sacrifice) on his seventh day, and his head is shaved and he is named. Abu Abdullah al-Hafiz and Abu Zakariyya ibn Abi Ishaq al-Muzakki told us that Ahmad ibn Kamal al-Qadi Abu Bakr narrated to us that Abdul Malik ibn Muhammad al-Raqashi narrated to him from Quraysh ibn Anas from Habib ibn al-Shahid who said: Muhammad ibn Sireen told me, "Ask Hasan from whom he heard the hadith of `aqiqah." So I asked him and he said, "From Samurah ibn Jundub."
كُلُّ غُلَامٍ رَهِينَةٌ بِعَقِيقَتِهِ تُذْبَحُ عَنْهُ يَوْمَ سَابِعِهِ وَيُحْلَقُ رَأْسُهُ وَيُسَمَّى 19265 أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ وَأَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ الْمُزَكِّي قَالَا ثنا أَحْمَدُ بْنُ كَامِلٍ الْقَاضِي أَبُو بَكْرٍ ثنا عَبْدُ الْمَلِكِ بْنُ مُحَمَّدٍ الرَّقَاشِيُّ ثنا قُرَيْشُ بْنُ أَنَسٍ ثنا حَبِيبُ بْنُ الشَّهِيدِ قَالَ قَالَ لِي مُحَمَّدُ بْنُ سِيرِينَ سَلِ الْحَسَنَ مِمَّنْ سَمِعَ حَدِيثَ الْعَقِيقَةِ؟ فَسَأَلْتُهُ فَقَالَ مِنْ سَمُرَةَ بْنِ جُنْدُبٍ ؓ
[Machine] "That he ﷺ ordered to circumcise Hasan and Husayn, and shaved their heads. Fatimah (may Allah be pleased with her) gave silver as charity."
ﷺ أَنَّهُ عَقَّ عَنِ الْحَسَنِ وَالْحُسَيْنِ وَحَلَقَ شُعُورَهُمَا وَتَصَدَّقَتْ فَاطِمَةُ ؓ بِزِنَتِهِ فِضَّةً
[Machine] The Messenger of Allah ﷺ slaughtered a ram for Hassan and a ram for Husayn.
رَسُولَ اللهِ ﷺ عَقَّ عَنِ الْحَسَنِ كَبْشًا وَعَنِ الْحُسَيْنِ كَبْشًا
The Messenger of Allah ﷺ sacrificed a ram for both al-Hasan and al-Husayn each (Allah be pleased with them). (Using translation from Abū Dāʾūd 2841)
أَنَّ النَّبِيَّ ﷺ عَقَّ عَنِ الْحَسَنِ وَالْحُسَيْنِ كَبْشَيْنِ
[Machine] He said, "Fatimah, the daughter of the Messenger of Allah ﷺ , weighed the hair of Hasan and Hussain, and she gave that weight in silver as charity."
أَنَّهُ قَالَ وَزَنَتْ فَاطِمَةُ بِنْتُ رَسُولِ اللهِ ﷺ شَعْرَ حَسَنٍ وَحُسَيْنٍ فَتَصَدَّقَتْ بِزِنَةِ ذَلِكَ فِضَّةً
أَنَسٍ وَلَيْسَ بِمَحْفُوظٍ
[Machine] did not find a or find II slaughter, and it was said by Yahya ibn Saeed, and by Amrah, from Aisha: "And it is not preserved."
ﷺ أَمَرَ بِرَأْسِ الْحَسَنِ وَالْحُسَيْنِ ابْنَيْ عَلِيِّ بْنِ أَبِي طَالِبٍ ؓ يَوْمَ سَابِعِهِمَا فَحُلِقَا ثُمَّ تَصَدَّقَ بِوَزْنِهِ فِضَّةً وَلَمْ يَجِدْ أَوْ يَجُدَّ ذَبْحًا وَقِيلَ عَنْ يَحْيَى بْنِ سَعِيدٍ عَنْ عَمْرَةَ عَنْ عَائِشَةَ ؓ وَلَيْسَ بِمَحْفُوظٍ
[Machine] The Messenger of Allah ﷺ ordered for Al-Hassan and Al-Hussein to be shaved on the seventh day of their birth and to be named. He also commanded that anything harmful be removed from their heads. Abu Ahmad said, "I do not know if Ibn Jurayj narrated it with this chain of narration except for Muhammad bin Amr al-Yafi'i and Abdul-Majeed bin Abdul-Aziz bin Abu Rawwad." The jurist (scholar) Rahimahullah said, "Abdullah bin Muhrar narrated from himself a rejected hadith regarding the sacrifice of the Prophet ﷺ ."
عَقَّ رَسُولُ اللهِ ﷺ عَنِ الْحَسَنِ وَالْحُسَيْنِ يَوْمَ السَّابِعِ وَسَمَّاهُمَا وَأَمَرَ أَنْ يُمَاطَ عَنْ رَأْسِهِمَا الْأَذَى قَالَ أَبُو أَحْمَدَ لَا أَعْلَمُ يَرْوِيهِ عَنِ ابْنِ جُرَيْجٍ بِهَذَا الْإِسْنَادِ غَيْرُ مُحَمَّدِ بْنِ عَمْرٍو الْيَافِعِيِّ وَعَبْدِ الْمَجِيدِ بْنِ عَبْدِ الْعَزِيزِ بْنِ أَبِي رَوَّادَ قَالَ الْفَقِيهُ رَحِمَهُ اللهُ وَرَوَى عَبْدُ اللهِ بْنُ مُحَرَّرٍ فِي عَقِيقَةِ النَّبِيِّ ﷺ عَنْ نَفْسِهِ حَدِيثًا مُنْكَرًا
[Machine] The Prophet ﷺ swore about himself after prophethood. Abdul Razzaq said that they left Abdullah ibn Muharrar [narrating] this hadith alone. The jurist, may Allah have mercy on him, said that this hadith was also narrated from Qatadah and from Anas from another source, but it is not correct.
أَنَّ النَّبِيَّ ﷺ عَقَّ عَنْ نَفْسِهِ بَعْدَ النُّبُوَّةِ قَالَ عَبْدُ الرَّزَّاقِ إِنَّمَا تَرَكُوا عَبْدَ اللهِ بْنَ مُحَرَّرٍ لِحَالِ هَذَا الْحَدِيثِ قَالَ الْفَقِيهُ رَحِمَهُ اللهُ وَقَدْ رُوِيَ مِنْ وَجْهٍ آخَرَ عَنْ قَتَادَةَ وَمِنْ وَجْهٍ آخَرَ عَنْ أَنَسٍ وَلَيْسَ بِشَيْءٍ
