61. Sacrificial Animals (9/14)
٦١۔ كِتَابُ الضَّحَايَا ص ٩
[Machine] In the name of Allah, the Most Gracious, the Most Merciful.
Allah, may He be praised, said: "So pray to your Lord and sacrifice." [Surah Al-Kawthar, verse 2].
بِسْمِ اللهِ الرَّحْمَنِ الرَّحِيمِ.
قَالَ اللهُ جَلَّ ثَنَاؤُهُ: {فَصَلِّ لِرَبِّكَ وَانْحَرْ} [الكوثر: 2].
[Machine] Jabir narrated that they used to eat the meat of horses during the time of the Messenger of Allah ﷺ.
عَنْ جَابِرٍ ؓ أَنَّهُمْ كَانُوا يَأْكُلُونَ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ لُحُومَ الْخَيْلِ
[Machine] "We ate horse meat during the time of the Prophet Muhammad ﷺ ."
أَكَلْنَا لَحْمَ فَرَسٍ عَلَى عَهْدِ النَّبِيِّ ﷺ
We slaughtered a horse (by Nahr) during the lifetime of Messenger of Allah ﷺ and ate it. (Using translation from Bukhārī 5512)
نَحَرْنَا فَرَسًا عَلَى عَهْدِ النَّبِيِّ ﷺ فَأَكَلْنَاهُ
[Machine] We sacrificed a horse during the time of the Messenger of Allah ﷺ and then we ate it.
نَحَرْنَا فَرَسًا عَلَى عَهْدِ رَسُولِ اللهِ ﷺ فَأَكَلْنَاهُ
[Machine] I ate a horse during the time of Ibn Zubayr and found it delicious.
أَكَلْتُ فَرَسًا فِي عَهْدِ ابْنِ الزُّبَيْرِ فَوَجَدْتُهُ حُلْوًا
لَا بَأْسَ بِلَحْمِ الْفَرَسِ
أَنَّهُ أَكَلَ لَحْمَ فَرَسٍ
61.75 [Machine] Statement on the Weakness of the Narration Regarding Prohibition of Eating Horse Meat
٦١۔٧٥ بَابُ بَيَانِ ضَعْفِ الْحَدِيثِ الَّذِي رُوِيَ فِي النَّهْيِ عَنْ لُحُومِ الْخَيْلِ
[Machine] The Messenger of Allah ﷺ forbade the meat of horses, mules, and donkeys, and every animal with canines among the wild beasts. Abu Abdur-Rahman As-Sulami and Abu Bakr bin Al-Harith reported that Ali bin Umar Al-Hafiz reported that Ibn Mubashshir narrated that Ahmed bin Sinan Al-Qattan narrated that Muhammad bin Umar Al-Waqidi narrated that Thawr bin Yazid mentioned it with a chain similar to it, except that he said the Prophet forbade it on the day of Khaybar. Muhammad bin Himeir reported it from Thawr from Salih bin Ya'hiya from his grandfather Al-Miqdam. Umar bin Harun Al-Balkhi reported it from Thawr from Yahya bin Al-Miqdam from his father from Khalid. This chain is problematic and contradictory to the narration of reliable narrators. Abu Bakr Muhammad bin Ibrahim Al-Farsi reported that Abu Ishaq Ibrahim bin Abdullah reported that Muhammad bin Sulaiman bin Faris narrated that Muhammad bin Ismail Al-Bukhari said that Salih bin Yahya bin Al-Miqdam bin Ma'di Karib Al-Kindi Ash-Shami reported from his father, narrating from Thawr and Sulaiman bin Suleim with a variation in the wording. Abu Abdur-Rahman As-Sulami and Abu Bakr bin Al-Harith reported that Ali bin Umar Al-Hafiz reported that Abu Sahl bin Ziyad said: I heard Musa bin Harun saying, "Salih bin Yahya and his father are only known through his grandfather." This (narrator) is weak, and Al-Waqidi claimed that Khalid bin Al-Walid accepted Islam after the conquest of Khaybar.
نَهَى رَسُولُ اللهِ ﷺ عَنْ لُحُومِ الْخَيْلِ وَالْبِغَالِ وَالْحَمِيرِ وَكُلِّ ذِي نَابٍ مِنَ السِّبَاعِ 19447 وَأَخْبَرَنَا أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ وَأَبُو بَكْرِ بْنُ الْحَارِثِ قَالَا أنبأ عَلِيُّ بْنُ عُمَرَ الْحَافِظُ ثنا ابْنُ مُبَشِّرٍ ثنا أَحْمَدُ بْنُ سِنَانٍ الْقَطَّانُ ثنا مُحَمَّدُ بْنُ عُمَرَ الْوَاقِدِيُّ ثنا ثَوْرُ بْنُ يَزِيدَ فَذَكَرَهُ بِإِسْنَادِهِ نَحْوَهُ إِلَّا أَنَّهُ قَالَ نَهَى يَوْمَ خَيْبَرَ وَرَوَاهُ مُحَمَّدُ بْنُ حِمْيَرٍ عَنْ ثَوْرٍ عَنْ صَالِحٍ أَنَّهُ سَمِعَ جَدَّهُ الْمِقْدَامَ وَرَوَاهُ عُمَرُ بْنُ هَارُونَ الْبَلْخِيُّ عَنْ ثَوْرٍ عَنْ يَحْيَى بْنِ الْمِقْدَامِ عَنْ أَبِيهِ عَنْ خَالِدٍ فَهَذَا إِسْنَادٌ مُضْطَرِبٌ وَمَعَ اضْطِرَابِهِ مُخَالِفٌ لِحَدِيثِ الثِّقَاتِ 19448 أَخْبَرَنَا أَبُو بَكْرٍ مُحَمَّدُ بْنُ إِبْرَاهِيمَ الْفَارِسِيُّ أَنْبَأَ أَبُو إِسْحَاقَ إِبْرَاهِيمُ بْنُ عَبْدِ اللهِ ثنا مُحَمَّدُ بْنُ سُلَيْمَانَ بْنِ فَارِسٍ ثنا مُحَمَّدُ بْنُ إِسْمَاعِيلَ الْبُخَارِيُّ قَالَ صَالِحُ بْنُ يَحْيَى بْنِ الْمِقْدَامِ بْنِ مَعْدِيكَرِبَ الْكِنْدِيُّ الشَّامِيُّ عَنْ أَبِيهِ رَوَى عَنْهُ ثَوْرٌ وَسُلَيْمَانُ بْنُ سُلَيْمٍ فِيهِ نَظَرٌ 19449 وَأَخْبَرَنَا أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ وَأَبُو بَكْرِ بْنُ الْحَارِثِ قَالَا أَنْبَأَ عَلِيُّ بْنُ عُمَرَ الْحَافِظُ ثنا أَبُو سَهْلِ بْنُ زِيَادٍ قَالَ سَمِعْتُ مُوسَى بْنَ هَارُونَ يَقُولُ لَا يُعْرَفُ صَالِحُ بْنُ يَحْيَى وَلَا أَبُوهُ إِلَّا بِجَدِّهِ وَهَذَا ضَعِيفٌ وَزَعَمَ الْوَاقِدِيُّ أَنَّ خَالِدَ بْنَ الْوَلِيدِ أَسْلَمَ بَعْدَ فَتْحِ خَيْبَرَ
61.76 [Machine] What is stated about consuming domesticated red meat?
٦١۔٧٦ بَابُ مَا جَاءَ فِي أَكْلِ لُحُومِ الْحُمُرِ الْأَهْلِيَّةِ
[Machine] That the Messenger of Allah ﷺ forbade the temporary marriage of women on the day of Khaybar and the consumption of the meat of domestic donkeys.
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنْ مُتْعَةِ النِّسَاءِ يَوْمَ خَيْبَرَ وَعَنْ لُحُومِ الْحُمُرِ الْأَهْلِيَّةِ
[Machine] The Messenger of Allah ﷺ forbade eating the meat of domestic donkeys.
رَسُولَ اللهِ ﷺ نَهَى عَنْ أَكْلِ لُحُومِ الْحُمُرِ الْأَهْلِيَّةِ
[Machine] "The Messenger of Allah ﷺ forbade the meat of domestic donkeys. 'Abdah added that on the day of Khaybar, the Prophet ﷺ said, 'Ibn Numayr informed me that Nafi' and Salim narrated.'"
رَسُولَ اللهِ ﷺ نَهَى عَنْ لُحُومِ الْحُمُرِ الْأَهْلِيَّةِ زَادَ عَبْدَةُ يَوْمَ خَيْبَرَ وَقَالَ ابْنُ نُمَيْرٍ حَدَّثَنِي نَافِعٌ وَسَالِمٌ
[Machine] The Messenger of Allah ﷺ forbade the consumption of the meat of domestic donkeys on the day of Khaybar, but allowed the consumption of horse meat.
أَنَّ رَسُولَ اللهِ ﷺ نَهَى يَوْمَ خَيْبَرَ عَنْ لُحُومِ الْحُمُرِ الْأَهْلِيَّةِ وَأَذِنَ فِي لُحُومِ الْخَيْلِ
[Machine] We were with the Messenger of Allah ﷺ , and we got some dates and cooked them. Then a caller ordered us to gather the pots. He said that Abu Muslim narrated to us, who told us that Sulaiman bin Harb narrated to us, who told us that Shu'bah reported from 'Adi bin Thabit, who narrated the same.
كُنَّا مَعَ رَسُولِ اللهِ ﷺ فَأَصَبْنَا حُمُرًا فَطَبَخْنَاهَا فَأَمَرَ مُنَادِيًا فَنَادَى أَوْ قَالَ فَأَمَرَ فَنُودِيَ أَنْ أَكْفِئُوا الْقُدُورَ 19455 قَالَ وَحَدَّثَنَا أَبُو مُسْلِمٍ ثنا سُلَيْمَانُ بْنُ حَرْبٍ ثنا شُعْبَةُ عَنْ عَدِيِّ بْنِ ثَابِتٍ عَنِ ابْنِ أَبِي أَوْفَى ؓ بِمِثْلِهِ
[Machine] "And Abdullah bin Abi Awfa narrated that they caught some red camels on the day of Khaybar, which they then cooked. So the caller of the Messenger of Allah ﷺ announced to distribute it."
وَعَبْدِ اللهِ بْنِ أَبِي أَوْفَى ؓ أَنَّهُمْ أَصَابُوا يَوْمَ خَيْبَرَ حُمُرًا فَطَبَخُوهَا فَنَادَى مُنَادِي رَسُولِ اللهِ ﷺ أَنْ أَكْفِئُوهَا
[Machine] The Prophet Muhammad ﷺ ordered us to offer the meat of domesticated red camels as a sacrifice, with the intention and cooking it well, but did not command us to eat it afterwards.
أَمَرَنَا رَسُولُ اللهِ ﷺ أَنْ نُكْفِئَ لَحْمَ الْحُمُرِ الْأَهْلِيَّةِ نَيَّةً وَنَضِيجَةً ثُمَّ لَمْ يَأْمُرْنَا بِأَكْلِهِ بَعْدَهُ
[Machine] When we arrived at Khaybar, the Messenger of Allah ﷺ saw fires being lit and asked, "Why are these fires being lit?" They replied, "To cook the meat of the domesticated camels." He said, "Break the pots and pour out what is in them." Then a man from the people asked, "O Messenger of Allah, should we pour out what is in them and wash them?" He replied, "That is the wording of the hadith of Ibn Hanbal."
لَمَّا قَدِمْنَا خَيْبَرَ رَأَى رَسُولُ اللهِ ﷺ نِيرَانًا تُوقَدُ فَقَالَ عَلَامَ تُوقَدُ هَذِهِ النِّيرَانُ؟ قَالُوا عَلَى لُحُومِ الْحُمُرِ الْأَهْلِيَّةِ قَالَ اكْسِرُوا الْقُدُورَ وَأَهْرِيقُوا مَا فِيهَا قَالَ فَقَالَ رَجُلٌ مِنَ الْقَوْمِ يَا رَسُولَ اللهِ أَنُهْرِيقُ مَا فِيهَا وَنَغْسِلُهَا؟ قَالَ أَوْ ذَاكَ لَفْظُ حَدِيثِ ابْنِ حَنْبَلٍ
[Machine] Allah ﷺ prohibited the meat of domestic donkeys at the time of Khaybar. The judge Ibn 'Amr used to say that the Messenger of Allah ﷺ prohibited it, but Ibn 'Abbas disagreed. He recited the verse, "Say, 'I do not find within that which was revealed to me [anything] forbidden to one who would eat it unless it be a dead animal or blood spilled out or the flesh of swine'" [Surah Al-An'am, 6:145]. The people of Jahiliyah used to leave certain things out of cleanliness, so Allah revealed His book and clarified what is lawful and what is prohibited. Whatever is permitted is lawful, and whatever is prohibited is forbidden, and whatever is not mentioned is pardoned. Then Allah recited this verse, "Say, 'I do not find within that which was revealed to me [anything] forbidden to one who would eat it unless it be a dead animal or blood spilled out or the flesh of swine'" [Surah Al-An'am, 6:145]. Imam Bukhari reported the beginning of this in his Sahih, narrated by Ali bin Al-Madinini from Sufyan. If Ibn Abbas knew that the Prophet ﷺ had prohibited it categorically, he would not have allowed it for anyone else except himself, but he did not know.
اللهِ ﷺ نَهَى عَنْ لُحُومِ الْحُمُرِ الْأَهْلِيَّةِ زَمَنَ خَيْبَرَ قَالَ قَدْ كَانَ يَقُولُ ذَلِكَ الْحَكَمُ بْنُ عَمْرٍو عَنْ رَسُولِ اللهِ ﷺ وَلَكِنْ أَبَى ذَلِكَ الْبَحْرُ يَعْنِي ابْنَ عَبَّاسٍ وَقَرَأَ {قُلْ لَا أَجِدُ فِي مَا أُوحِيَ إِلِيَّ مُحَرَّمًا} [الأنعام 145] الْآيَةَ وَقَدْ كَانَ أَهْلُ الْجَاهِلِيَّةِ يَتْرُكُونَ أَشْيَاءَ تَقَذُّرًا فَأَنْزَلَ اللهُ تَعَالَى كِتَابَهُ وَبَيَّنَ حَلَالَهُ وَحَرَامَهُ فَمَا أَحَلَّ فَهُوَ حَلَالٌ وَمَا حَرَّمَ فَهُوَ حَرَامٌ وَمَا سَكَتَ عَنْهُ فَهُوَ عَفْوٌ ثُمَّ تَلَا هَذِهِ الْآيَةَ {قُلْ لَا أَجِدُ فِي مَا أُوحِيَ إِلِيَّ مُحَرَّمًا عَلَى طَاعِمٍ يَطْعَمُهُ إِلَّا أَنْ يَكُونَ مَيْتَةً أَوْ دَمًا مَسْفُوحًا أَوْ لَحْمَ خِنْزِيرٍ} [الأنعام 145] فَقَدْ أَخْرَجَ الْبُخَارِيُّ أَوَّلَهُ فِي الصَّحِيحِ عَنْ عَلِيِّ بْنِ الْمَدِينِيِّ عَنْ سُفْيَانَ وَلَوْ عَلِمَ ابْنُ عَبَّاسٍ ؓ أَنَّ النَّبِيَّ ﷺ حَرَّمَهُ تَحْرِيمًا لَمْ يَصِرْ إِلَى غَيْرِهِ إِلَّا أَنَّهُ لَمْ يَعْلَمْهُ
[Machine] I do not know why the Messenger of Allah, ﷺ , prohibited it. Perhaps it was because it was burdensome for the people, so he disliked their burdens being taken away or prohibited them from eating the flesh of domesticated donkeys on the day of Khaybar.
لَا أَدْرِي أَنَهَى عَنْهُ رَسُولُ اللهِ ﷺ مِنْ أَجْلِ أَنَّهُ كَانَ حَمُولَةَ النَّاسِ فَكَرِهَ أَنْ تَذْهَبَ حَمُولَتُهُمْ أَوْ حَرَّمَهُ فِي يَوْمِ خَيْبَرَ لَحْمَ الْحُمُرِ الْأَهْلِيَّةِ
[Machine] It was the day of Khaybar and we fell into the traps. We destroyed them, but when the pots were filled with them, a caller called the Messenger of Allah ﷺ , saying, "Pour out the pots and do not eat anything from the meat of the camels." He said, "Some people said that the Messenger of Allah ﷺ forbade it because it was not milked properly, and others said that it was forbidden by the word of Hadith Abu Kamil, and in the narration of Ibn Abi Bukair others said that it was forbidden by the word of Hadith Abu Kamil."
كَانَ يَوْمُ خَيْبَرَ وَقَعْنَا فِي الْحُمُرِ الْأَهْلِيَّةِ فَانْتَحَرْنَاهَا فَلَمَّا غَلَتْ بِهَا الْقُدُورُ نَادَى مُنَادِي رَسُولِ اللهِ ﷺ أَكْفِئُوا الْقُدُورَ وَلَا تَأْكُلُوا مِنْ لُحُومِ الْحُمُرِ شَيْئًا قَالَ فَقَالَ نَاسٌ إِنَّمَا نَهَى عَنْهَا رَسُولُ اللهِ ﷺ لِأَنَّهَا لَمْ تُخْمَسْ وَقَالَ الْآخَرُونَ نَهَى عَنْهَا الْبَتَّةَ لَفْظُ حَدِيثِ أَبِي كَامِلٍ وَفِي رِوَايَةِ ابْنِ أَبِي بُكَيْرٍ وَقَالَ نَاسٌ حَرَّمَهَا الْبَتَّةَ
[Machine] Abu Tha'labah Al-Khushani, companion of the Messenger of Allah ﷺ , reported that the Messenger of Allah ﷺ prohibited the meat of donkeys and the meat of every predatory animal with canine teeth [Bukhari 19464]. And Abu Al-Hasan informed us, Ahmad reported to us, Ibn Milhan reported to us, Yahya mentioned it with its chain of narration similar to that, except that he said it was narrated from Abu Idris Al-Khawlani, and he said, "The prohibition applies to meat in both places."
عَنْ أَبِي ثَعْلَبَةَ الْخُشَنِيِّ ؓ صَاحِبِ رَسُولِ اللهِ ﷺ قَالَ حَرَّمَ رَسُولُ اللهِ ﷺ لَحْمَ الْحُمُرِ وَلَحْمَ كُلِّ ذِي نَابٍ مِنَ السِّبَاعِ 19464 وَأَخْبَرَنَا أَبُو الْحَسَنِ أنبأ أَحْمَدُ ثنا ابْنُ مِلْحَانَ ثنا يَحْيَى فَذَكَرَهُ بِإِسْنَادِهِ نَحْوَهُ إِلَّا أَنَّهُ قَالَ عَنْ أَبِي إِدْرِيسَ الْخَوْلَانِيِّ وَقَالَ لُحُومَ فِي الْمَوْضِعَيْنِ
Someone came to Messenger of Allah ﷺ and said, "The donkeys have been (slaughtered and) eaten. Another man came and said, "The donkeys have been destroyed." On that the Prophet ﷺ ordered a caller to announce to the people: Allah and His Apostle forbid you to eat the meat of donkeys, for it is impure.' Thus the pots were turned upside down while the (donkeys') meat was boiling in them. (Using translation from Bukhārī 5528)
أَنَّ النَّبِيَّ ﷺ جَاءَهُ جَاءٍ فَقَالَ أَكَلْتُ الْحُمُرَ ثُمَّ جَاءَهُ جَاءٍ فَقَالَ أَكَلْتُ الْحُمُرَ ثُمَّ جَاءَهُ جَاءٍ فَقَالَ أُفْنِيَتِ الْحُمُرُ فَنَادَى مُنَادٍ فِي النَّاسِ إِنَّ اللهَ ﷻ وَرَسُولَهُ يَنْهَيَانِكُمْ عَنْ لُحُومِ الْحُمُرِ الْأَهْلِيَّةِ فَإِنَّهَا نَجَسٌ قَالَ فَأُكْفِئَتِ الْقُدُورُ وَإِنَّهَا لَتَفُورُ بِاللَّحْمِ
[Machine] When the Messenger of Allah, ﷺ , conquered Khaybar, we obtained some camels from outside the village and cooked them. Then a caller from the Messenger of Allah, ﷺ , called out, "Verily, Allah and His Messenger forbid you from it, as it is impure from the actions of Satan." So we overturned the pots with what was in them, and indeed they were boiling with what was in them.
لَمَّا فَتَحَ رَسُولُ اللهِ ﷺ خَيْبَرَ أَصَبْنَا حُمُرًا خَارِجًا مِنَ الْقَرْيَةَ فَطَبَخْنَاهَا فَنَادَى مُنَادِي رَسُولِ اللهِ ﷺ أَلَا إِنَّ اللهَ وَرَسُولَهُ يَنْهَيَانِكُمْ عَنْهَا فَإِنَّهَا رِجْسٌ مِنْ عَمَلِ الشَّيْطَانِ فَأُكْفِئَتِ الْقُدُورُ بِمَا فِيهَا وَإِنَّهَا لَتَفُورُ بِمَا فِيهَا
[Machine] The Messenger of Allah ﷺ prohibited on the day of Khaybar every animal with fangs, the rabid (dog), and the donkey.
أَنَّ رَسُولَ اللهِ ﷺ حَرَّمَ يَوْمَ خَيْبَرَ كُلَّ ذِي نَابٍ مِنَ السِّبَاعِ وَالْمُجَثَّمَةَ وَالْحِمَارَ الْإِنْسِيَّ
[Machine] "He heard Al-Miqdad, a companion of the Prophet ﷺ, saying that the Messenger of Allah ﷺ has forbidden certain things on the day of Khaybar, including the domestic donkey. And he said, 'A man will soon recline on his couch and narrate a Hadith from me, saying between us and you is the Book of Allah. Whatever we find in it to be permissible, we declare it permissible. And whatever we find in it to be forbidden, we declare it forbidden. Know that whatever the Messenger of Allah ﷺ has forbidden, Allah ﷻ has also forbidden.' Ibn Jabir said, 'This is Al-Hasan ibn Jabir.'"
أَنَّهُ سَمِعَ الْمِقْدَامَ صَاحِبَ النَّبِيِّ ﷺ يَقُولُ حَرَّمَ رَسُولُ اللهِ ﷺ أَشْيَاءَ يَوْمَ خَيْبَرَ مِنْهَا الْحِمَارُ الْأَهْلِيُّ وَقَالَ يُوشِكُ الرَّجُلُ مُتَّكِئًا عَلَى أَرِيكَتِهِ يُحَدِّثُ بِحَدِيثِي فَيَقُولُ بَيْنَنَا وَبَيْنَكُمْ كِتَابُ اللهِ فَمَا وَجَدْنَا فِيهِ مِنْ حَلَالٍ أَحْلَلْنَاهُ وَمِنْ حَرَامٍ حَرَّمْنَاهُ أَلَا وَإِنَّ مَا حَرَّمَ رَسُولُ اللهِ ﷺ مَا حَرَّمَ اللهُ ﷻ ابْنُ جَابِرٍ هَذَا هُوَ الْحَسَنُ بْنُ جَابِرٍ
[Machine] Narrated by the Prophet ﷺ : "I have been given the book and whatever is similar to it, and soon there will be satiety on his comfortable nest where he will say: 'This book is between you and me. Whatever it deems permissible, I declare it permissible, and whatever it deems forbidden, I declare it forbidden.' Know that it is not so. By Allah! No carnivorous animal's meat is permissible, nor is the domesticated donkey's meat, nor is the meat of the animal slaughtered by non-Muslims, except if one cannot find anything else (to eat). And if a man adds people (as his relatives) but they do not accept him, then he can have relations like his (former) relatives."
عَنِ النَّبِيِّ ﷺ قَالَ أُوتِيتُ الْكِتَابَ وَمَا يَعْدِلُهُ يَعْنِي وَمِثْلَهُ يُوشِكُ شَبْعَانُ عَلَى أَرِيكَتِهِ يَقُولُ بَيْنَنَا وَبَيْنَكُمْ هَذَا الْكِتَابُ فَمَا كَانَ فِيهِ مِنْ حَلَالٍ أَحْلَلْنَاهُ وَمَا كَانَ مِنْ حَرَامٍ حَرَّمْنَاهُ أَلَا وَإِنَّهُ لَيْسَ كَذَلِكَ أَلَا لَا يَحِلُّ ذُو نَابٍ مِنَ السِّبَاعِ وَلَا الْحِمَارُ الْأَهْلِيُّ وَلَا اللُّقَطَةُ مِنْ مَالِ مُعَاهَدٍ إِلَّا أَنْ يَسْتَغْنِيَ عَنْهَا وَأَيُّمَا رَجُلٍ أَضَافَ قَوْمًا فَلَمْ يَقْرُوهُ فَإِنَّ لَهُ أَنْ يُعْقِبَهُمْ بِمِثْلِ قِرَاهُ
[Machine] And he ﷺ was sitting under a tree, pledging allegiance to the Prophet ﷺ , when he complained, so it was mentioned to him to immerse himself in the milk of the udder and its essence, but he disliked that.
وَكَانَ بَايَعَ النَّبِيَّ ﷺ تَحْتَ الشَّجَرَةِ أَنَّهُ اشْتَكَى فَنُعِتَ لَهُ أَنْ يَسْتَنْقِعَ فِي أَلْبَانِ الْأُتُنِ وَمَرَقِهَا فَكَرِهَ ذَلِكَ
[Machine] A year passed without me having anything to feed my family except for some camel meat. The Prophet ﷺ had prohibited the consumption of domesticated camel meat. So, I went to the Prophet ﷺ and said, "O Messenger of Allah, a year has passed and I have nothing to feed my family except for the fat of camel meat, and you have prohibited the consumption of domesticated camel meat." He replied, "Feed your family from the fat of your camel meat, for I had prohibited it due to the scarcity in our village. This hadith has a disputed chain of narration."
أَصَابَتْنَا سَنَةٌ فَلَمْ يَكُنْ فِي مَالِي شَيْءٌ أُطْعِمُ أَهْلِي إِلَّا شَيْءٌ مِنْ حُمُرٍ وَقَدْ كَانَ النَّبِيُّ ﷺ حَرَّمَ لُحُومَ الْحُمُرِ الْأَهْلِيَّةِ فَأَتَيْتُ النَّبِيَّ ﷺ فَقُلْتُ يَا رَسُولَ اللهِ أَصَابَتْنَا سَنَةٌ وَلَمْ يَكُنْ فِي مَالِي مَا أُطْعِمُ أَهْلِي إِلَّا سِمَانَ حُمُرٍ وَإِنَّكَ حَرَّمْتَ لُحُومَ الْحُمُرِ الْأَهْلِيَّةِ فَقَالَ أَطْعِمْ أَهْلَكَ مِنْ سَمِينِ حُمُرِكَ فَإِنَّمَا حَرَّمْتُهَا مِنْ أَجْلِ جَوَّالِي الْقَرْيَةِ فَهَذَا حَدِيثٌ مُخْتَلَفٌ فِي إِسْنَادِهِ
61.77 [Machine] What is mentioned about the food of Al-Jallalah and its milk, which is the camel that most of its fodder is alfalfa, and the spirits of the alfalfa are found in its veins and tendons. Al-Shafi'i, may Allah have mercy on him, said: And in the meaning of the camel, it includes cows, sheep, and others that are eaten.
٦١۔٧٧ بَابُ مَا جَاءَ فِي أَكْلِ الْجَلَّالَةِ وَأَلْبَانِهَا وَهِيَ الْإِبِلُ الَّتِي يَكُونُ أَكْثَرُ عَلَفِهَا الْعَذِرَةَ، وَأَرْوَاحُ الْعَذِرَةِ تُوجَدُ فِي عِرْقِهَا وَجِرَرِهَا. قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: وَفِي مَعْنَى الْإِبِلِ الْبَقَرُ وَالْغَنَمُ وَغَيْرُهُمَا مِمَّا يُؤْكَلُ.
[Machine] The Messenger of Allah ﷺ forbade eating carcasses and their milk. Shakir opposed him, as did Laith bin Abu Sulaim.
نَهَى رَسُولُ اللهِ ﷺ عَنْ أَكْلِ الْجَلَّالَةِ وَأَلْبَانِهَا خَالَفَهُ شَرِيكٌ عَنْ لَيْثِ بْنِ أَبِي سُلَيْمٍ
[Machine] The Messenger of Allah ﷺ on the day of the conquest of Mecca regarding the spoils of war and plunder, and it was also narrated from another source about Ibn Umar.
رَسُولُ اللهِ ﷺ يَوْمَ فَتْحِ مَكَّةَ عَنْ لُحُومِ الْجَلَّالَةِ وَعَنِ النُّهْبَةِ وَرُوِي مِنْ وَجْهٍ آخَرَ عَنِ ابْنِ عُمَرَ ؓ
The Messenger of Allah ﷺ forbade riding the camel which feeds on filth and drinking its milk. (Using translation from Abū Dāʾūd 3787)
نَهَى رَسُولُ اللهِ ﷺ عَنِ الْجَلَّالَةِ فِي الْإِبِلِ أَنْ يُرْكَبَ عَلَيْهَا أَوْ يُشْرَبَ مِنْ أَلْبَانِهَا
عَبْدُ الْوَارِثِ فَذَكَرَهُ
[Machine] The Prophet ﷺ prohibited (people) from consuming the meat of hunted game animals, milk that has been mixed with jallalah milk, and drinking from water containers that have been used by a dog. Sa'id bin Abi 'Arubah, Hammad bin Salamah, and 'Umar bin 'Amir all narrated this from Qatadah, except that Hammad bin Salamah said that the prohibition also included riding on an animal that has recently been given jallalah milk, but he did not mention the milk (itself). Abu 'Abdullah al-Hafiz narrated to us, from Abu al-'Abbas Muhammad bin Ya'qub, from Muhammad bin Ishaq al-Saghani, from 'Affan, from Hammad bin Salamah, from Qatadah, who mentioned it in its content and said that the prohibition also included riding on an animal that has recently been given jallalah milk. It has also been reported that 'Ikrimah narrated from Abu Hurairah (may Allah be pleased with him) (a similar prohibition).
النَّبِيَّ ﷺ نَهَى عَنِ الْمُجَثَّمَةِ وَعَنْ لَبَنِ الْجَلَّالَةِ وَأَنْ يُشْرَبَ مِنْ فِي السِّقَاءِ تَابَعَهُ سَعِيدُ بْنُ أَبِي عَرُوبَةَ وَحَمَّادُ بْنُ سَلَمَةَ وَعُمَرُ بْنُ عَامِرٍ عَنْ قَتَادَةَ إِلَّا أَنَّ حَمَّادَ بْنَ سَلَمَةَ قَالَ وَعَنْ رُكُوبِ الْجَلَّالَةِ لَمْ يَذْكُرِ اللَّبَنَ أَخْبَرَنَاهُ أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ إِسْحَاقَ الصَّغَانِيُّ ثنا عَفَّانُ ثنا حَمَّادُ بْنُ سَلَمَةَ ثنا قَتَادَةُ فَذَكَرَهُ بِمَعْنَاهُ وَقَالَ عَنْ رُكُوبِ الْجَلَّالَةِ وَقَدْ قِيلَ عَنْ عِكْرِمَةَ عَنْ أَبِي هُرَيْرَةَ ؓ
[Machine] The Messenger of Allah ﷺ prohibited drinking from the bucket, the ladle, and the jug.
أَنَّ رَسُولَ اللهِ ﷺ نَهَى أَنْ يُشْرَبَ مِنْ فِي السِّقَاءِ وَالْمُجَثَّمَةِ وَالْجَلَّالَةِ
[Machine] The Messenger of Allah ﷺ forbade eating the meat of male camels and their milk. Ata ibn Abi Rabah also forbade eating the meat of male camels and sheep.
رَسُولَ اللهِ ﷺ نَهَى عَنْ أَكْلِ لُحُومِ الْجَلَّالَةِ وَأَلْبَانِهَا وَكَانَ عَطَاءُ بْنُ أَبِي رَبَاحٍ يَنْهَى عَنِ الْجَلَّالَةِ مِنَ الْإِبِلِ وَالْغَنَمِ أَنْ تُؤْكَلَ
from his father, form his grandfather - the on the Day of Kahaibar, the Messenger of Allah forbade the flesh of domesticated donkeys and of al-Jallalah (animals that eat dung), and (he forbade) riding them and eating their mat." (Using translation from Nasāʾī 4447)
أَنَّ رَسُولَ اللهِ ﷺ نَهَى يَوْمَ خَيْبَرَ عَنْ لُحُومِ الْحُمُرِ الْأَهْلِيَّةِ وَعَنِ الْجَلَّالَةِ عَنْ رُكُوبِهَا وَأَكْلِ لُحُومِهَا
[Machine] The Messenger of Allah ﷺ prohibited eating the meat and drinking the milk of beasts of prey. He also forbade riding them until they are tamed for forty nights. This is not a strong opinion, as Al-Shafi'i referred to it and claimed that it was intended to change their nature from disliked to other than disliked, which is the natural disposition of animals, so that the souls of the prey are not found in their veins and tendons.
نَهَى رَسُولُ اللهِ ﷺ عَنِ الْجَلَّالَةِ أَنْ يُؤْكَلَ لَحْمُهَا وَيُشْرَبَ لَبَنُهَا وَلَا يُحْمَلَ عَلَيْهَا أَظُنُّهُ قَالَ إِلَّا الْأَدَمُ وَلَا يَرْكَبَهَا النَّاسُ حَتَّى تُعْلَفَ أَرْبَعِينَ لَيْلَةً لَيْسَ هَذَا بِالْقَوِيِّ وَقَدْ أَشَارَ إِلَيْهِ الشَّافِعِيُّ وَزَعَمَ أَنَّهُ أَرَادَ تَغَيُّرَهَا مِنَ الطِّبَاعِ الْمَكْرُوهَةِ إِلَى الطِّبَاعِ غَيْرِ الْمَكْرُوهَةِ الَّتِي هِيَ فِطْرَةُ الدَّوَابِّ حَتَّى لَا تُوجَدَ أَرْوَاحُ الْعَذِرَةِ فِي عِرْقِهَا وَجِرَرِهَا
61.78 [Machine] What is in the chicken that eats nettles?
٦١۔٧٨ بَابُ مَا جَاءَ فِي الدَّجَاجِ الَّذِي يَأْكُلُ النَّتِنَ
[Machine] I saw Abu Musa eating chicken, so he invited me over. I said, "I saw him eating mutton." He told me to come closer and eat, for he saw the Prophet ﷺ eating it.
رَأَيْتُ أَبَا مُوسَى ؓ يَأْكُلُ الدَّجَاجَ فَدَعَانِي فَقُلْتُ إِنِّي رَأَيْتُهُ يَأْكُلُ نَتِنًا قَالَ ادْنُهْ فَكُلْ فَإِنِّي رَأَيْتُ النَّبِيَّ ﷺ يَأْكُلُهُ
61.79 [Machine] What is mentioned in al-Masboorah?
٦١۔٧٩ بَابُ مَا جَاءَ فِي الْمَصْبُورَةِ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: وَالْمَصْبُورَةُ الشَّاةُ تُرْبَطُ ثُمَّ تُرْمَى بِالنَّبْلِ. وَقَالَ أَبُو عُبَيْدٍ: هُوَ الطَّائِرُ أَوْ غَيْرُهُ مِنْ ذَوَاتِ الرُّوحِ يُصْبَرُ حَيًّا ثُمَّ يُرْمَى حَتَّى يَقْتُلَ , وَأَصْلُ الصَّبْرِ الْحَبْسُ.
[Machine] Anas narrated that the Messenger of Allah ﷺ forbade restraining animals.
أَنَسٌ ؓ نَهَى رَسُولُ اللهِ ﷺ أَنْ تُصْبَرَ الْبَهَائِمُ
[Machine] Whoever did this, indeed the Messenger of Allah ﷺ cursed whoever did this.
اللهُ مَنْ فَعَلَ هَذَا إِنَّ رَسُولَ اللهِ ﷺ لَعَنَ مَنْ فَعَلَ هَذَا
[Machine] A boy from his sons tied a chicken, and he threw it. Then he approached the chicken and the boy and said to Yahya, "Scold your boy for not enduring the killing of this bird. I heard the Messenger of Allah ﷺ forbid causing suffering to animals. And if you want to slaughter it, then slaughter it."
وَغُلَامٌ مِنْ بَنِيهِ رَابِطٌ دَجَاجَةً وَهُوَ يَرْمِيهَا فَمَشَى إِلَى الدَّجَاجَةِ فَحَلَّهَا ثُمَّ أَقْبَلَ بِهَا وَبِالْغُلَامِ فَقَالَ لِيَحْيَى ازْجُرُوا غُلَامَكُمْ هَذَا عَنْ أَنْ يَصْبِرَ هَذَا الطَّيْرَ عَلَى الْقَتْلِ فَإِنِّي سَمِعْتُ رَسُولَ اللهِ ﷺ نَهَى أَنْ تُصْبَرَ بَهِيمَةٌ وَإِنْ أَرَدْتُمْ أَنْ تَذْبَحُوهَا فَاذْبَحُوهَا
[Machine] Ibn Abdullah narrated that the Prophet ﷺ forbade killing animals so patiently.
بْنَ عَبْدِ اللهِ ؓ يَقُولُ نَهَى النَّبِيُّ ﷺ أَنْ يُقْتَلَ شَيْءٌ مِنَ الدَّوَابِّ صَبْرًا
"The Prophet ﷺ prohibited the Mujath-thamah, the milk of the Jallalah, and drinking from the sprout of the water-skin." (Using translation from Tirmidhī 1825)
نَهَى رَسُولُ اللهِ ﷺ عَنْ لَبَنِ الْجَلَّالَةِ وَعَنْ أَكْلِ الْمُجَثَّمَةِ وَعَنِ الشُّرْبِ مِنْ فِي السِّقَاءِ
[Machine] The Messenger of Allah ﷺ forbade theft, looting, and consuming any animal with canine teeth from among wild animals. Abu Ubaid said that "mujaththamah" refers to the trapped animals, which can also include birds, rabbits, and similar animals that are trapped on the ground or elsewhere if necessary.
نَهَى رَسُولُ اللهِ ﷺ عَنِ الْخَطْفَةِ وَالنُّهْبَةِ وَالْمُجَثَّمَةِ وَعَنْ أَكْلِ كُلِّ ذِي نَابٍ مِنَ السِّبَاعِ قَالَ أَبُو عُبَيْدٍ الْمُجَثَّمَةُ هِيَ الْمَصْبُورَةُ أَيْضًا وَلَكِنَّهَا لَا تَكُونُ إِلَّا فِي الطَّيْرِ وَالْأَرَانِبِ وَأَشْبَاهِ ذَلِكَ مِمَّا يُجَثَّمُ بِالْأَرْضِ وَغَيْرِهَا إِذَا لَزِمَهُ
61.80 [Machine] The translation of the heading "ذَكَاةِ مَا فِي بَطْنِ الذَّبِيحَةِ" into English is "Zakah of what is in the belly of the slaughtered animal".
٦١۔٨٠ بَابُ ذَكَاةِ مَا فِي بَطْنِ الذَّبِيحَةِ
[Machine] The Messenger of Allah ﷺ said: "The rights of the unborn child are the rights of his mother, and likewise."
قَالَ رَسُولُ اللهِ ﷺ ذَكَاةُ الْجَنِينِ ذَكَاةُ أُمِّهِ وَكَذَلِكَ
[Machine] We asked the Messenger of Allah ﷺ about the fetus, so he said, "Eat it if you wish."
سَأَلْنَا رَسُولَ اللهِ ﷺ عَنِ الْجَنِينِ فَقَالَ كُلُوهُ إِنْ شِئْتُمْ
[Machine] We said, "O Messenger of Allah, one of us slaughters a camel and slaughters a cow or a sheep, and there is a fetus in its womb. Should we throw it away or eat it?" He said, "Eat it if you wish, as its zakat is the zakat of its mother."
قُلْنَا يَا رَسُولَ اللهِ أَحَدُنَا يَنْحَرُ النَّاقَةَ وَيَذْبَحُ الْبَقَرَةَ وَالشَّاةَ وَفِي بَطْنِهَا الْجَنِينُ أَيُلْقِيهِ أَمْ يَأْكُلُهُ؟ فَقَالَ كُلُوهُ إِنْ شِئْتُمْ فَإِنَّ ذَكَاتَهُ ذَكَاةُ أُمِّهِ
[Machine] The Messenger of Allah ﷺ was asked about a pig and a cow that carry a fetus in their womb. He replied, "When you slaughter the animal, its offspring is considered as the mother's offering." This was narrated by Abu 'Ubaidah Al-Haddad, from Yunus, from Abu Al-Waddak, in a concise manner.
عَنْ رَسُولِ اللهِ ﷺ سُئِلَ عَنِ الْجَزُورِ وَالْبَقَرَةِ يُوجَدُ فِي بَطْنِهَا الْجَنِينُ قَالَ إِذَا سَمَّيْتُمْ عَلَى الذَّبِيحَةِ فَذَكَاتُهُ ذَكَاةُ أُمِّهِ وَرُوِيَ ذَلِكَ عَنْ أَبِي عُبَيْدَةَ الْحَدَّادِ عَنْ يُونُسَ عَنْ أَبِي الْوَدَّاكِ مُخْتَصَرًا
[Machine] "Allah ﷺ said: The zakat (obligatory charity) of the fetus is the zakat of its mother. It is also narrated from Ali, Abdullah ibn Masud, Abdullah ibn Umar, Abdullah ibn Abbas, Abu Ayyub, Abu Hurairah, Abu Darda, Abu Umamah, and Al-Bara ibn Azib, all raised in importance. And in the hadith of Az-Zuhri from Ibn Ka'b ibn Malik that he said: The companions of the Messenger of Allah ﷺ used to say about the fetus: when it reaches six months, its zakat is the zakat of its mother."
اللهِ ﷺ قَالَ ذَكَاةُ الْجَنِينِ ذَكَاةُ أُمِّهِ وَفِي الْبَابِ عَنْ عَلِيٍّ وَعَبْدِ اللهِ بْنِ مَسْعُودٍ وَعَبْدِ اللهِ بْنِ عُمَرَ وَعَبْدِ اللهِ بْنِ عَبَّاسٍ وَأَبِي أَيُّوبَ وَأَبِي هُرَيْرَةَ وَأَبِي الدَّرْدَاءِ وَأَبِي أُمَامَةَ وَالْبَرَاءِ بْنِ عَازِبٍ ؓ مَرْفُوعًا وَفِي حَدِيثِ الزُّهْرِيِّ عَنِ ابْنِ كَعْبِ بْنِ مَالِكٍ أَنَّهُ قَالَ كَانَ أَصْحَابُ رَسُولِ اللهِ ﷺ يَقُولُونَ فِي الْجَنِينِ إِذَا أَشْعَرَ فَذَكَاتُهُ ذَكَاةُ أُمِّهِ
[Machine] Ibn Umar used to say, "When the camel is slaughtered, the owner has the right to take all the contents of its abdomen as part of his share if its creation is complete and its hair has grown. When it comes out of its abdomen alive, it is slaughtered until the blood comes out of its cavity." This is the wording of the hadith of Ibn Bukayr, and in the narration of Ibn Wahb, it includes both its contents and the remainder. This is the correct position.
اللهِ بْنَ عُمَرَ ؓ كَانَ يَقُولُ إِذَا نُحِرَتِ النَّاقَةُ فَذَكَاةُ مَا فِي بَطْنِهَا فِي ذَكَاتِهَا إِذَا كَانَ قَدْ تَمَّ خَلْقُهُ وَنَبَتَ شَعْرُهُ وَإِذَا خَرَجَ مِنْ بَطْنِهَا حَيًّا ذُبِحَ حَتَّى يَخْرُجَ الدَّمُ مِنْ جَوْفِهِ لَفْظُ حَدِيثِ ابْنِ بُكَيْرٍ وَفِي رِوَايَةِ ابْنِ وَهْبٍ بِذَكَاتِهَا وَالْبَاقِي سَوَاءٌ هَذَا هُوَ الصَّحِيحُ مَوْقُوفٌ
[Machine] "Allah ﷺ said regarding the fetus: Its zakat is the zakat of its mother, whether it feels or does not feel."
اللهِ ﷺ قَالَ فِي الْجَنِينِ ذَكَاتُهُ ذَكَاةُ أُمِّهِ أَشْعَرَ أَوْ لَمْ يُشْعِرْ
