[Machine] A man asked the Messenger of Allah ﷺ about Luqata (lost and found items), so he said, "Announce it for a year, then recognize its description and features, then spend it. [Machine] On the authority of a man from the companions of the Prophet ﷺ who said: The Messenger of Allah ﷺ said: "The first thing for which a servant will be held accountable on the Day of Resurrection is his prayer. If it is complete, then it will be recorded as complete for him. But if it is deficient, Allah, may He be exalted, will say: 'Look and see whether My servant has any voluntary prayers?' So his obligatory prayers will be made up for by his voluntary prayers. Then the zakat will be dealt with in the same way. Then the rest of his deeds will be dealt with accordingly."

Yahya related to me from Malik from Abd arRahman ibn Harmala that a man asked Said ibn al-Musayyab about what a man who was junub and had done tayammum should do when he came across water. Said said, "When he comes across water he must do ghusl for what comes after." Malik said about some one who had a wet dream while he was on a journey and there was only enough water for wudu and he was not thirsty and so he did not need to use it for that, "Let him wash his genitals, and whatever the semen has fallen on, with the water and then he does tayammum with good earth as Allah has ordered him." Malik was asked whether a man who was junub and wished to do tayammum but could only find salty earth could do tayammum with that earth, and whether it was disapproved of to pray on salty earth. He said, "There is no harm in praying on salty earth or in using it to do tayammum, because Allah the Blessed and Exalted has said, '...and do tayammum with good earth.' [Machine] Narrated Abu Huraira:

The Prophet ﷺ said, "Whoever says, 'Bismillah hir-Rahman nir-Rahim' (In the name of Allah, the Most Gracious, the Most Merciful), nothing will harm him with that name, whether in the heavens or on the earth, and He is the All-Hearing, the All-Knowing." He said it in the evening and did not get startled by any sudden affliction until the morning. And if he said it in the morning, he did not get startled by any sudden affliction until the evening." Abdullah bin Muslama disagreed with him, so he narrated it from Abu Maudud through a man who heard it from Aban bin Uthman. Abu Maudud also reported that from a man who said, "I heard Aban bin Uthman saying that I heard Uthman bin Affan saying that I heard the Messenger of Allah ﷺ saying something similar to that. Abu Abdur-Rahman told us, and it has been reported from Aban bin Uthman in words other than this." (Source: Jami` at-Tirmidhi 3388)

[Machine] About a man from the Banu Udhra of whom he freed a slave he owned upon his death and who had no other wealth. So the Messenger of Allah ﷺ freed one-third of it and ordered him to seek out the remaining two-thirds. This was mentioned to Imam al-Shafi'i, may Allah have mercy on him, and he said: "Whoever presents it is a messenger. Even if he is an intermediary, it is from a man who is not named, is not known, and his hadith is not proven." Al-Shafi'i, may Allah have mercy on him, said, "We opposed some of them with another hadith regarding istisqa' and one of his companions cut him off and said, 'No one should mention a hadith like this unless he knows the hadith due to its weakness.' " 21383. Abu Abdullah al-Hafiz informed us of all this speech and what I mentioned in this chapter from his speech. Abu al-Abbas al-Asamm reported, narrating from al-Rabi', who narrated from al-Shafi'i, and he mentioned it, but I do not know which hadith was presented to him.

[Machine] A delegation from the Banu Asad came to the Messenger of Allah ﷺ , and they spoke, saying, "Mudar has fought against you, while we are not fewer than them in number, nor are we less brave than them. We have connected with you through kinship." The Messenger of Allah ﷺ then said to Abu Bakr and Umar, "Respond to them in this manner." They said, "No." He said, "Indeed, the understanding of these people is limited, and surely Satan speaks through their tongues." Ata said in his narration, "So Allah revealed the verse, 'They regard it as a favor to you that they have embraced Islam' (Quran 49:17)."

If he performed it properly, it will be recorded as complete for him. Then, the Zakat (charity) is also taken into account in the same way. Then, the rest of the deeds will be judged accordingly.

I asked Ibn ʿUmar, "Can a person who has performed the Tawaf around the Kaʿba for ʿUmra but has not performed the (Saʿi) Tawaf of Safa and Marwa, have a sexual relation with his wife?" Ibn ʿUmar replied "When the Prophet ﷺ reached Mecca he performed the Tawaf around the Kaʿba (circumambulated it seven times) and offered a two-rakʿat prayer (at the place) behind the station (of Abraham) and then performed the Tawaf (Saʿi) of Safa and Marwa, and verily in Messenger of Allah ﷺ you have a good example." Then we put the same question to Jabir bin ʿAbdullah and he too replied, "He should not go near his wife (for sexual relation) till he has finished the Tawaf of Safa and Marwa."

"If it is the first or second divorce, the Messenger of Allah would tell him to take her back and keep her until she has menstruated again and purified herself, then divorce her before having intercourse with her. But if it was three simultaneous divorces, then you have disobeyed Allah with regard to the way in which divorce should be conducted and your wife has become irrevocably divorced."

Yahya related to me from Malik from Yahya ibn Muhammad ibn Talhafrom Uthman ibn Abd ar-Rahman that his father related to him that he had heard that Umar ibn al-Khattab used to wash what was beneath his waist wrapper with water. Yahya said that Malik was asked what a man should do if, when he did wudu, he forgot and washed his face before he had rinsed his mouth, or washed his forearms before he had washed his face. He said, "If someone washes his face before rinsing his mouth, he should rinse his mouth and not wash his face again. If someone washes his forearms before his face, however, he should wash his forearms again so that he has washed them after his face. This is if he is still near the place (of wudu)." Yahya said that Malik was asked about what a man should do if he had forgotten to rinse his mouth and nose until he had prayed, and he said, "He does not have to repeat the prayer, but should rinse his mouth and nose if he wishes to do any more prayers after that."

He said, 'When a man does not feel safe from his companion.' I said, 'So what do you command me to do if I reach that time?' He said, 'Restrain your tongue and hands, and stay in your home.' I said, 'O Messenger of Allah, what if a man enters my home?' He said, 'Then enter your own house.' I said, 'What if he enters my house?' He said, 'Then go to your mosque and do the same.' Then he said, "And this is how the willingness to give charity should be done (without any obligation). They contradicted the Sunnah in giving charity without obligation and they contradicted the hadith of Abdullah ibn Mas'ood which is in line with the Sunnah and it is established with them. [Machine] They asked the jurists what would expiate their sins and fulfill my debt, and they should begin with the debt to Allah. So he mentioned the Hadith, in which he said, "So they went to Ibn Abbas and he said to feed sixty poor people." They returned to Ibn Umar and informed him, and he said, "He spoke the truth, so do as he said."

[Machine] I heard the Messenger of Allah ﷺ saying: "Allah has prescribed five prayers upon His slaves. Whoever fulfills them and does not neglect them, Allah will have a covenant with him to forgive him and enter him into Paradise. But whoever does not fulfill them and disrespects them, then he does not have a covenant with Allah. If Allah wills, He may punish him and if He wills, He may forgive him." And Malik narrated from Yahya bin Sa'id in this chain of narration that there was a man from the Banu Kinanah named Al-Mukhddiji.
