34. Inheritance
٣٤۔ كِتَابُ الْفَرَائِضِ
[Machine] That a man dies and leaves his wife and parents, so his wife will receive a quarter and his mother will receive a third of what is left, which is a quarter of the total wealth. And if a woman dies and leaves her husband and parents, then her husband will receive half and her mother will receive a third of what is left, which is a sixth of the total wealth.
أَنْ يُتَوَفَّى رَجُلٌ وَيَتْرُكَ امْرَأَتَهُ وَأَبَوَيْهِ فَيَكُونَ لِامْرَأَتِهِ الرُّبُعُ وَلِأُمِّهِ الثُّلُثُ مِمَّا بَقِيَ وَهُوَ الرُّبُعُ مِنْ رَأْسِ الْمَالِ وَإِنْ تُتَوَفَّى امْرَأَةٌ وَتَتْرُكْ زَوْجَهَا وَأَبَوَيْهَا فَيَكُونَ لِزَوْجِهَا النِّصْفُ وَلِأُمِّهَا الثُّلُثُ مِمَّا بَقِيَ وَهُوَ السُّدُسُ مِنْ رأْسِ الْمَالِ
[Machine] He used to deprive his mother with two brothers, so they said to him, "O Abu Sa'id, indeed Allah says, 'And if he has brothers [or sisters], for his mother is a sixth [share]' (Quran 4:11) and you are depriving her with two brothers?" He said, "Indeed, the Arabs designate the two brothers as siblings." So they said to him, "O Abu Sa'id, are you deluding us? They are only eight pairs of sheep, two by two, and from goats two by two, and from camels two by two, and from cows two by two." He said, "No, indeed Allah says, 'And (God) made from them a pair, the male and the female' (Quran 75:39), so they are two pairs. Each one of them is a pair, the male says 'pair' and the female says 'pair'."
أَنَّهُ كَانَ يَحْجُبُ الْأُمَّ بِالْأَخَوَيْنِ فَقَالُوا لَهُ يَا أَبَا سَعِيدٍ فَإِنَّ اللهَ يَقُولُ {فَإِنْ كَانَ لَهُ إِخْوَةٌ فَلِأُمِّهِ السُّدُسُ} [النساء 11] وَأَنْتَ تَحْجُبُهَا بِأَخَوَيْنِ؟ فَقَالَ إِنَّ الْعَرَبَ تُسَمِّي الْأَخَوَيْنِ إِخْوَةً فَقَالُوا لَهُ يَا أَبَا سَعِيدٍ أَوَهِمْتَ؛ إِنَّمَا هِيَ ثَمَانِيَةُ أَزْوَاجٍ مِنَ الضَّأْنِ اثْنَيْنِ اثْنَيْنِ وَمِنَ الْمَعْزِ اثْنَيْنِ اثْنَيْنِ وَمِنَ الْإِبِلِ اثْنَيْنِ اثْنَيْنِ وَمِنَ الْبَقَرِ اثْنَيْنِ اثْنَيْنِ فَقَالَ لَا إِنَّ اللهَ يَقُولُ {فَجَعَلَ مِنْهُ الزَّوْجَيْنِ الذَّكَرَ وَالْأُنْثَى} [القيامة 39] فَهُمَا زَوْجَانِ كُلُّ وَاحِدٍ مِنْهُمَا زَوْجٌ يَقُولُ الذَّكَرُ زَوْجٌ وَالْأُنْثَى زَوْجٌ
عَنِ الثُّلُثِ لَهَا سُدُسُهَا
[Machine] "Indeed, if Allah had brothers, then the brothers in the language of your people are not brothers. Uthman said, 'I am unable to respond to what was said before me and what has passed in the lands, and people have inherited it.' It is narrated from Ibn Abbas regarding two fathers and brothers that he said, 'Indeed, brothers prohibited the mother from one third so that they could have two thirds', contrary to the statement of Zaid bin Thabit and others."
اللهُ {فَإِنْ كَانَ لَهُ إِخْوَةٌ} [النساء 11] فَالْأَخَوَانِ بِلِسَانِ قَوْمِكَ لَيْسَا بِإِخْوَةٍ فَقَالَ عُثْمَانُ لَا أَسْتَطِيعُ أَنْ أَرُدَّ مَا كَانَ قَبْلِي وَمَضَى فِي الْأَمْصَارِ وَتَوَارَثَ بِهِ النَّاسُ وَرُوِيَ عَنِ ابْنِ عَبَّاسٍ فِي أَبَوَيْنِ وَإِخْوَةٍ أَنَّهُ قَالَ إِنَّمَا حَجَبَ الْإِخْوَةُ الْأُمَّ مِنَ الثُّلُثِ؛ لِيَكُونَ السُّدُسُ لَهُمْ وَهُوَ بِخِلَافِ قَوْلِ زَيْدِ بْنِ ثَابِتٍ وَغَيْرِهِ
[Machine] The Prophet, may ﷺ , gave them one-sixth. I met some of the children of the man who was given one-sixth for his brothers, and they said that it was a testament for them.
أَنَّ النَّبِيَّ ﷺ أَعْطَاهُمُ السُّدُسَ فَلَقِيتُ بَعْضَ وَلَدِ ذَلِكَ الرَّجُلِ الَّذِي أُعْطِيَ إِخْوَتُهُ السُّدُسَ فَقَالَ بَلَغَنَا أَنَّهَا كَانَتْ وَصِيَّةً لَهُمْ
[Machine] "About Mansour and what he added to it, and what remained is for his father."
عَنْ مَنْصُورٍ وَزَادَ فِيهِ وَمَا بَقِيَ فَلِلْأَبِ
[Machine] When Umar walked on a path, we followed him and found it easy. We learned that he came across a woman and two parents, and he gave the woman a quarter, the mother a third of what was left, and the father two-thirds.
كَانَ عُمَرُ ؓ إِذَا سَلَكَ طَرِيقًا فَاتَّبَعْنَاهُ وَجَدْنَاهُ سَهْلًا وَأَنَّهُ أُتِيَ فِي امْرَأَةٍ وَأَبَوَيْنِ فَأَعْطَى الْمَرْأَةَ الرُّبُعَ وَأَعْطَى الْأُمَّ ثُلُثَ مَا بَقِيَ وَأَعْطَى الْأَبَ سَهْمَيْنِ
[Machine] That he divided it into four shares: one share for the woman, a third of what remains for the mother, and the father gets what remains.
أَنَّهُ جَعَلَهَا مِنْ أَرْبَعَةِ أَسْهُمٍ لِلْمَرْأَةِ الرُّبُعُ سَهْمٌ وَلِلْأُمِّ ثُلُثُ مَا بَقِيَ سَهْمٌ وَلِلْأَبِ مَا بَقِيَ
[Machine] The literal translation of the passage is: "Son of Abu Talib and son of Abbas, contrary to that."
بْنِ أَبِي طَالِبٍ وَابْنِ عَبَّاسٍ ؓ بِخِلَافِ ذَلِكَ
[Machine] "For the husband, he gets half. For the mother, she gets a third. And for the father, he gets a sixth. This ruling is attributed to al-Hasan ibn 'Umarah and has been narrated from another source with a disconnected chain."
لِلزَّوْجِ النِّصْفُ وَلِلْأُمِّ الثُّلُثُ وَلِلْأَبِ السُّدُسُ الْحَسَنُ بْنُ عُمَارَةَ مَتْرُوكٌ وَرُوِيَ مِنْ وَجْهٍ آخَرَ مُنْقَطِعٍ
[Machine] About Umar and Abdullah concerning a woman and two parents of the mother, one-third of what remains (i.e. the inheritance) he said. And Ali ibn Abi Talib said, "She has one-third of all the wealth."
عَنْ عُمَرَ وَعَبْدِ اللهِ فِي امْرَأَةٍ وَأَبَوَيْنِ لِلْأُمِّ ثُلُثُ مَا بَقِيَ قَالَ وَقَالَ عَلِيُّ بْنُ أَبِي طَالِبٍ ؓ لَهَا الثُّلُثُ مِنْ جَمِيعِ الْمَالِ
[Machine] Zaid gets half (of the inheritance), the mother gets a third of what remains, and the father gets the rest of the money. Ibn Abbas said to the mother, "The third is complete," the wording of the hadith of Yazid bin Harun and in another narration, Ruwah said, "And the mother gets a third of what remains, which is the sixth." So Ibn Abbas sent to him (Yazid), "Do you find this in the book of Allah?" He said, "No, but I dislike favoring the mother over the father." Ibn Abbas said, "I used to give the mother a third of all the money." And Abu Abdullah and Abu Saeed narrated to us, they both said, Abu al-Abbas narrated to us, Yahya informed us, from Yazid bin Harun, from Shurayk bin Abdullah, from Abdur Rahman al-Asbahani, from Ikrimah, he said, "So I came to Ibn Abbas and informed him." He said, "Then go back to him and say, 'Is it your father's book, or your opinion?'" I said, "By your opinion?" He said, "Then I went to him and he said, 'By my opinion.'" So I returned to Ibn Abbas and informed him. Ibn Abbas said, "And I say, by my opinion, the mother gets the third, complete." And Abu Abdullah narrated to us, Abu al-Abbas narrated to us, Yahya informed us, from Yazid, from Sufyan al-Thawri, from a man, from Fudayl, from Ibrahim, who said, "Ibn Abbas differed from the people in this matter."
زَيْدٌ لِلزَّوْجِ النِّصْفُ وَلِلْأُمِّ ثُلُثُ مَا بَقِيَ وَلِلْأَبِ بَقِيَّةُ الْمَالِ فَقَالَ ابْنُ عَبَّاسٍ لِلْأُمِّ الثُّلُثُ كَامِلًا لَفْظُ حَدِيثِ يَزِيدَ بْنِ هَارُونَ وَفِي رِوَايَةِ رَوْحٍ وَلِلْأُمِّ ثُلُثُ مَا بَقِيَ وَهُوَ السُّدُسُ فَأَرْسَلَ إِلَيْهِ ابْنُ عَبَّاسٍ أَفِي كِتَابِ اللهِ تَجِدُ هَذَا؟ قَالَ لَا وَلَكِنْ أَكْرَهُ أَنْ أُفَضِّلَ أُمًّا عَلَى أَبٍ قَالَ وَكَانَ ابْنُ عَبَّاسٍ يُعْطِي الْأُمَّ الثُّلُثَ مِنْ جَمِيعِ الْمَالِ 12306 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ وَأَبُو سَعِيدٍ قَالَا ثنا أَبُو الْعَبَّاسِ ثنا يَحْيَى أنا يَزِيدُ بْنُ هَارُونَ أنا شَرِيكُ بْنُ عَبْدِ اللهِ عَنْ عَبْدِ الرَّحْمَنِ الْأَصْبَهَانِيِّ عَنْ عِكْرِمَةَ بِمِثْلِهِ قَالَ فَأَتَيْتُ ابْنَ عَبَّاسٍ فَأَخْبَرْتُهُ قَالَ فَقَالَ ارْجِعْ إِلَيْهِ فَقُلْ لَهُ أَبِكِتَابِ اللهِ قُلْتَ أَمْ بِرَأْيِكَ؟ قَالَ فَأَتَيْتُهُ فَقَالَ بِرَأْيِي فَرَجَعْتُ إِلَى ابْنِ عَبَّاسٍ فَأَخْبَرْتُهُ فَقَالَ ابْنُ عَبَّاسٍ وَأَنَا أَقُولُ بِرَأْيِي لِلْأُمِّ الثُّلُثُ كَامِلًا 12307 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ ثنا أَبُو الْعَبَّاسِ ثنا يَحْيَى أنا يَزِيدُ أنا سُفْيَانُ الثَّوْرِيُّ عَنْ رَجُلٍ عَنْ فُضَيْلٍ عَنْ إِبْرَاهِيمَ قَالَ خَالَفَ ابْنُ عَبَّاسٍ فِيهَا النَّاسَ
[Machine] Ibn Abbas disagreed with all the people of prayer regarding marriage and parents.
خَالَفَ ابْنُ عَبَّاسٍ جَمِيعَ أَهْلِ الصَّلَاةِ فِي زَوْجٍ وَأَبَوَيْنِ
[Machine] Zaid divided it into four shares for the woman: one share for her, one-third for the mother, and the remainder for the father.
قَسَمَهَا زَيْدٌ مِنْ أَرْبَعَةِ أَسْهُمٍ لِلْمَرْأَةِ سَهْمٌ وَلِلْأُمِّ ثُلُثُ مَا بَقِيَ وَلِلْأَبِ بَقِيَّةُ الْمَالِ
Abu Musa was asked regarding (the inheritance of) a daughter, a son's daughter, and a sister. He said, "The daughter will take one-half and the sister will take one-half. If you go to Ibn Masʿud, he will tell you the same." Ibn Masʿud was asked and was told of Abu Musa's verdict. Ibn Masʿud then said, "If I give the same verdict, I would stray and would not be of the rightly-guided. The verdict I will give in this case, will be the same as the Prophet ﷺ did, i.e. one-half is for daughter, and one-sixth for the son's daughter, i.e. both shares make two-thirds of the total property; and the rest is for the sister." Afterwards we cams to Abu Musa and informed him of Ibn Masʿud's verdict, whereupon he said, "So, do not ask me for verdicts, as long as this learned man is among you." لَقَدْ ضَلَلْتُ إِذًا وَمَا أَنَا مِنَ الْمُهْتَدِينَ أَقْضِي فِيهَا بِمَا قَضَى رَسُولُ اللهِ ﷺ لِلِابْنَةِ النِّصْفُ وَلِابْنَةِ الِابْنِ السُّدُسُ تَكْمِلَةً لِلْثُلُثَيْنِ وَمَا بَقِيَ فَلِلْأُخْتِ قَالَ فَأَتَيْنَا أَبَا مُوسَى الْأَشْعَرِيَّ فَأَخْبَرْنَاهُ بِقَوْلِ ابْنِ مَسْعُودٍ فَقَالَ لَا تَسْأَلُونِي عَنْ شَيْءٍ مَا دَامَ هَذَا الْحَبْرُ فِيكُمْ
