34. Inheritance

٣٤۔ كِتَابُ الْفَرَائِضِ

34.23 [Machine] The obligation of inheritance for parents with one or two daughters God, may He be glorified and exalted, said { They request from you a [legal] ruling. Say, " Allah gives you a ruling concerning one having neither descendants nor ascendants [as heirs]." If a man dies, leaving no child but [only] a sister, she will have half of what he left. And he inherits from her if she [dies and] has no child. But if there are two sisters [or more], they will have two-thirds of what he left.} [Surah An-Nisa: 176]

٣٤۔٢٣ بَابُ فَرْضِ الْأُخْتِ وَالْأُخْتَيْنِ فَصَاعِدًا لِأَبٍ وَأُمٍّ أَوْ لِأَبٍ قَالَ اللهُ تَبَارَكَ وَتَعَالَى {يَسْتَفْتُونَكَ قُلِ اللهُ يُفْتِيكُمْ فِي الْكَلَالَةِ إنِ امْرُؤٌ هَلَكَ لَيْسَ لَهُ -[380]- وَلَدٌ وَلَهُ أُخْتٌ فَلَهَا نِصْفُ مَا تَرَكَ وَهُوَ يَرِثُهَا إِنْ لَمْ يَكُنْ لَهَا وَلَدٌ فَإِنْ كَانَتَا اثْنَتَيْنِ فَلَهُمَا الثُّلُثَانِ مِمَّا تَرَكَ} [النساء: 176]

[Machine] I complained, and I have seven sisters. The Messenger of Allah ﷺ entered upon me and splashed water on my face. I woke up and said, "O Messenger of Allah, should I give two-thirds to my sisters?" He said, "That is good." I said, "What about half?" He said, "That is good." Then the Messenger of Allah ﷺ left and returned, and he said, "O Jabir, I only see you as either dead or close to death from this pain, while Allah has revealed concerning your sisters, so make it clear." So, he gave them two-thirds. Jabir used to say, "These verses were revealed about me, 'They ask you for legal instruction. Say, "Allah instructs you concerning one having neither descendants nor ascendants."' [Quran 4:176] until the end of the narration of Wahb bin Jarir and the summarized narration of At-Tayalisi and it is narrated by Kathir bin Hisham from Hisham similar to the narration of Wahb except that he said, 'O Jabir, I do not see you as dead from this pain of yours.'"  

البيهقي:١٢٣٢٥أَخْبَرَنَا أَبُو بَكْرِ بْنُ فُورَكٍ أنا عَبْدُ اللهِ بْنُ جَعْفَرٍ ثنا يُونُسُ بْنُ حَبِيبٍ ثنا أَبُو دَاوُدَ ثنا هِشَامٌ الدَّسْتُوَائِيُّ ح وَأنا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو ثنا أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ نَصْرٍ ثنا إِسْحَاقُ بْنُ إِبْرَاهِيمَ أنا وَهْبُ بْنُ جَرِيرٍ عَنْ هِشَامِ بْنِ أَبِي عَبْدِ اللهِ صَاحِبِ الدَّسْتُوَائِيِّ عَنْ أَبِي الزُّبَيْرِ عَنْ جَابِرِ بْنِ عَبْدِ اللهِ قَالَ

اشْتَكَيْتُ وَعِنْدِي سَبْعُ أَخَوَاتٍ لِي فَدَخَلَ عَلَيَّ رَسُولُ اللهِ ﷺ فَنَضَحَ فِي وَجْهِي فَأَفَقْتُ فَقُلْتُ يَا رَسُولَ اللهِ أُوصِي لِأَخَوَاتِي بِالثُّلُثَيْنِ؟ فَقَالَ أَحْسِنْ فَقُلْتُ بِالشَّطْرِ؟ قَالَ أَحْسِنْ ثُمَّ خَرَجَ رَسُولُ اللهِ ﷺ ثُمَّ رَجَعَ فَقَالَ يَا جَابِرُ مَا أُرَاكَ إِلَّا مَيِّتًا أَوْ قَالَ مَا أُرَاكَ مَيِّتًا مِنْ هَذَا الْوَجَعِ وَقَدْ أَنْزَلَ اللهُ فِي أَخَوَاتِكَ فَبَيَّنَ فَجَعَلَ لَهُنَّ الثُّلُثَيْنِ فَكَانَ جَابِرٌ يَقُولُ نَزَلَتْ هَؤُلَاءِ الْآيَاتُ فِيَّ {يَسْتَفْتُونَكَ قُلِ اللهُ يُفْتِيكُمْ فِي الْكَلَالَةِ} [النساء 176] إِلَى آخِرِهَا لَفْظُ حَدِيثِ وَهْبِ بْنِ جَرِيرٍ وَحَدِيثُ الطَّيَالِسِيِّ مُخْتَصَرٌ وَرَوَاهُ كَثِيرُ بْنُ هِشَامٍ عَنْ هِشَامٍ نَحْوَ رِوَايَةِ وَهْبٍ إِلَّا أَنَّهُ قَالَ فَقَالَ يَا جَابِرُ لَا أُرَاكَ مَيِّتًا مِنْ وَجَعِكَ هَذَا
