34. Inheritance (1/7)
٣٤۔ كِتَابُ الْفَرَائِضِ ص ١
The Prophet ﷺ said: Knowledge has three categories; anything else is extra; a precise verse, or an established sunnah (practice), or a firm obligatory duty. (Using translation from Abū Dāʾūd 2885)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ الْعِلْمُ ثَلَاثَةٌ وَمَا سِوَى ذَلِكَ فَهُوَ فَضْلٌ آيَةٌ مُحْكَمَةٌ أَوْ سُنَّةٌ قَائِمَةٌ أَوْ فَرِيضَةٌ عَادِلَةٌ
[Machine] The Messenger of Allah ﷺ said: "Learn the Quran and teach it to people, and learn knowledge and teach it to people, and learn the religious obligations and teach them to people. Verily, knowledge will vanish and trials and tribulations will appear, until two people differ in a religious obligation and find no one to resolve their dispute. It has been narrated by Awf, from Sulaiman, from Abu al-Ahwas, from Abdullah, that Abu al-Hasan al-Muqri' informed us that al-Hasan ibn Muhammad ibn Ishaq narrated to us, that Yusuf ibn Ya'qub narrated to us, that Muhammad ibn Abi Bakr narrated to us, that al-Muthanna ibn Bakr al-Attar narrated to us, that Awf narrated to us from Sulaiman, from Abu al-Ahwas, from Abdullah. He mentioned this hadith as a marfu' report, except that he said: 'Verily, I am a man who will be taken away (i.e., die), and indeed knowledge will be taken away, until two men differ concerning a religious obligation and find no one to inform them about it.'"
قَالَ رَسُولُ اللهِ ﷺ تَعَلَّمُوا الْقُرْآنَ وَعَلِّمُوهُ النَّاسَ وَتَعَلَّمُوا الْعِلْمَ وَعَلِّمُوهُ النَّاسَ وَتَعَلَّمُوا الْفَرَائِضَ وَعَلِّمُوهُ النَّاسَ؛ فَإِنَّ الْعِلْمَ سَيَنْقَضِي وَتَظْهَرُ الْفِتَنُ حَتَّى يَخْتَلِفَ الِاثَنَانِ فِي الْفَرِيضَةِ فَلَا يَجِدَانِ مَنْ يَفْصِلُ بَيْنَهُمَا وَقَدْ قِيلَ عَنْ عَوْفٍ عَنْ سُلَيْمَانَ عَنْ أَبِي الْأَحْوَصِ عَنْ عَبْدِ اللهِ 12174 أَخْبَرَنَاهُ أَبُو الْحَسَنِ الْمُقْرِئُ أنبأ الْحَسَنُ بْنُ مُحَمَّدِ بْنِ إِسْحَاقَ ثنا يُوسُفُ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ أَبِي بَكْرٍ ثنا الْمُثَنَّى بْنُ بَكْرٍ الْعَطَّارُ ثنا عَوْفٌ عَنْ سُلَيْمَانَ عَنْ أَبِي الْأَحْوَصِ عَنْ عَبْدِ اللهِ فَذَكَرَهُ مَرْفُوعًا إِلَّا أَنَّهُ قَالَ فَإِنِّي امْرُؤٌ مَقْبُوضٌ وَإِنَّ الْعِلْمَ سَيُقْبَضُ حَتَّى يَخْتَلِفَ الرَّجُلَانِ فِي الْفَرِيضَةِ فَلَا يَجِدَانِ مَنْ يُخْبُرُهُمَا بِهَا
[Machine] "The Prophet ﷺ said: Learn the obligatory acts and teach them to others, for they are half of knowledge and they are forgotten. They are the first things to be taken away from my nation. Hafs ibn Umar excelled in memorizing them, although he was not the strongest (person)."
أَنَّ النَّبِيَّ ﷺ قَالَ تَعَلَّمُوا الْفَرَائِضَ وَعَلِّمُوهُ النَّاسَ؛ فَإِنَّهُ نِصْفُ الْعِلْمِ وَهُوَ يُنْسَى وَهُوَ أَوَّلُ شَيْءٍ يُنْتَزَعُ مِنَ أُمَّتِي تَفَرَّدَ بِهِ حَفْصُ بْنُ عُمَرَ وَلَيْسَ بِالْقَوِيِّ
[Machine] Umar said, "Learn the obligatory duties, the melody, and the practices as you learn the Quran."
قَالَ عُمَرُ تَعَلَّمُوا الْفَرَائِضَ وَاللَّحْنَ وَالسُّنَّةَ كَمَا تَعَلَّمُونَ الْقُرْآنَ
[Machine] Umar said, "Learn the obligations, as they are part of your religion."
قَالَ عُمَرُ ؓ تَعَلَّمُوا الْفَرَائِضَ؛ فَإِنَّهَا مِنْ دِينِكُمْ
[Machine] Omar wrote: "If you indulge in pastimes, indulge in archery, and if you speak, speak about religious obligations."
كَتَبَ عُمَرُ إِذَا لَهَوْتُمْ فَالْهُوا بِالرَّمْيِ وَإِذَا تَحَدَّثْتُمْ فَتَحَدَّثُوا بِالْفَرَائِضِ
[Machine] Whoever learns the Quran, let him learn the obligations and not be like a Bedouin man who met him and said, "O Abdullah, are you a Bedouin or a Muhajir?" If he says Muhajir, he says, "A person from my family died, so how do we distribute his inheritance?" If he knows, then he is better off, Allah will give it to him. And if he says, "I don't know," he says, "What is your superiority over us when you read the Quran and do not know the obligations?"
مَنْ تَعَلَّمَ الْقُرْآنَ فَلْيَتَعَلَّمِ الْفَرَائِضَ وَلَا يَكُنْ كَرَجُلٍ لَقِيَهُ أَعْرَابِيٌّ فَقَالَ لَهُ يَا عَبْدَ اللهِ أَعْرَابِيٌّ أَمْ مُهَاجِرٌ؟ فَإِنْ قَالَ مُهَاجِرٌ قَالَ إِنْسَانٌ مِنَ أَهْلِي مَاتَ فَكَيْفَ نُقَسِّمُ مِيرَاثَهُ فَإِنْ عَلِمَ كَانَ خَيْرًا أَعْطَاهُ اللهُ إِيَّاهُ وَإِنْ قَالَ لَا أَدْرِي قَالَ فَمَا فَضْلُكُمْ عَلَيْنَا إِنَّكُمْ تَقْرَءُونَ الْقُرْآنَ وَلَا تَعْلَمُونَ الْفَرَائِضَ؟
[Machine] Abdullah said, "Whoever learns the Quran should also learn the obligatory acts of worship. For if he meets a Bedouin and the Bedouin asks him, 'Do you recite the Quran?' and he answers, 'Yes,' then the Bedouin asks him, 'Do you fulfill its obligations?' and he answers, 'Yes,' then the Bedouin says, 'What is your superiority over me?'"
قَالَ عَبْدُ اللهِ مَنْ تَعَلَّمَ الْقُرْآنَ فَلْيَتَعَلَّمِ الْفَرَائِضَ؛ فَإِنْ لَقِيَهُ أَعْرَابِيٌّ قَالَ يَا مُهَاجِرُ أَتَقْرَأُ الْقُرْآنَ؟ قَالَ نَعَمْ قَالَ وَأَنَا أَقْرَأُ الْقُرْآنَ فَإِنْ قَالَ تُفْرِضُ؟ قَالَ نَعَمْ كَانَ ذَلِكَ وَإِنْ قَالَ لَا قَالَ فَمَا فَضْلُكَ عَلَيَّ؟
[Machine] Whoever reads the Quran should learn the obligatory acts and should not be like a bedouin man who says, "O emigrant, do you read the Quran?". If he says, "Yes", he should ask, "If someone from my family dies, should I fulfill their obligation?". If he tells him, it is knowledge that he has been taught and an increase that Allah has given him. Otherwise, he should say, "Why do you consider yourselves better than us, O emigrants?"
مَنْ قَرَأَ الْقُرْآنَ فَلْيَتَعَلَّمِ الْفَرَائِضَ وَلَا يَكُنْ كَرَجُلٍ لَقِيَهُ أَعْرَابِيٌّ فَيَقُولُ يَا مُهَاجِرُ أَتَقْرَأُ الْقُرْآنَ؟ فَإِنْ قَالَ نَعَمْ قَالَ فَإِنَّ إِنْسَانًا مِنْ أَهْلِي مَاتَ فَتَقُصُّ فَرِيضَتَهُ؟ فَإِنْ حَدَّثَهُ فَهُوَ عِلْمٌ عُلِّمَهُ وَزِيَادَةٌ زَادَهُ اللهُ وَإِلَّا قَالَ فَبِمَا تَفْضُلُونَنَا يَا مَعْشَرَ الْمُهَاجِرِينَ؟
[Machine] Ibn Mas'ud said: "Learn the obligations, pilgrimage, and divorce, for it is part of your religion."
قَالَ ابْنُ مَسْعُودٍ تَعَلَّمُوا الْفَرَائِضَ وَالْحَجَّ وَالطَّلَاقَ؛ فَإِنَّهُ مِنْ دِينِكُمْ
[Machine] Ibn Abbas used to place the cable on my leg to teach me the Quran and the obligations.
كَانَ ابْنُ عَبَّاسٍ يَضَعُ الْكَبْلَ فِي رِجْلِيَّ يُعَلِّمُنِي الْقُرْآنَ وَالْفَرَائِضَ
[Machine] From Tawus and Qatadah: "Al-faridah (obligatory duty) is one-third of knowledge."
عَنْ طَاوُسٍ وَقَتَادَةَ الْفَرِيضَةُ ثُلُثُ الْعِلْمِ
[Machine] To learn it so that you can teach your neighbors and pass it on from one another.
أَنْ تَعْلَمَهَا فَأَمِتْ جِيرَانَكَ وَوَرِّثَ بَعْضَهُمْ مِنْ بَعْضٍ
34.2 [Machine] Preference of the saying of Zaid ibn Thabit over the saying of others from the companions collectively in the knowledge of inheritance laws.
٣٤۔٢ بَابُ تَرْجِيحِ قَوْلِ زَيْدِ بْنِ ثَابِتٍ عَلَى قَوْلِ غَيْرِهِ مِنَ الصَّحَابَةِ مْ أَجْمَعِينَ فِي عِلْمِ الْفَرَائِضِ
[Machine] The Messenger of Allah ﷺ said, "The most merciful of my Ummah (nation) is Abu Bakr, and the strongest of them in the religion of Allah is Umar, and the most modest of them is Uthman, and the most knowledgeable of them in halal (lawful) and haram (forbidden) matters is Muadh, and every nation has a trustworthy person, and the trustworthy person of this nation is Abu Ubaidah ibn al-Jarrah. And likewise..."
قَالَ رَسُولُ اللهِ ﷺ أَرْحَمُ أُمَّتِي أَبُو بَكْرٍ وَأَشَدُّهُمْ فِي دِينِ اللهِ عُمَرُ وَأَصْدَقُهُمْ حَيَاءً عُثْمَانُ وَأَفْرَضُهُمْ زَيْدٌ وَأَقْرَؤُهُمْ أُبَيٌّ وَأَعْلَمُهُمْ بِالْحَلَالِ وَالْحَرَامِ مُعَاذٌ وَإِنَّ لِكُلِّ أُمَّةٍ أَمِينًا وَأَمِينُ هَذِهِ الْأُمَّةِ أَبُو عُبَيْدَةَ بْنُ الْجَرَّاحِ وَكَذَلِكَ
The Messenger of Allah said: The most merciful of my Ummah towards my Ummah is Abu Bakr; the one who adheres most sternly to the religion of Allah is 'Umar; the most sincere of them in shyness and modesty is 'Uthman; the best judge is 'Ali bin Abu Talib; the best in reciting the Book of Allah is Ubayy bin Ka'b; the most knowledgeable of what is lawful and unlawful is Mu'adh bin Jabal; and the most knowledgeable of the rules of inheritance (Fara'id) is Zaid bin Thabit. And every nation has a trustworthy guardian, and the trustworthy guardian of this Ummah is Abu 'Ubaidah bin Jarrah." (Using translation from Ibn Mājah 154)
قَالَ رَسُولُ اللهِ ﷺ أَرْأَفُ أُمَّتِي أَبُو بَكْرٍ وَأَشَدُّهُمْ فِي دِينِ اللهِ عُمَرُ وَأَصْدَقُهُمْ حَيَاءً عُثْمَانُ وَأَفْرَضُهُمْ زَيْدٌ وَأَقْرَؤُهُمْ أُبَيٌّ وَأَعْلَمُهُمْ بِالْحَلَالِ وَالْحَرَامِ مُعَاذٌ وَإِنَّ لِكُلِّ أُمَّةٍ أَمِينًا وَأَمِينُ هَذِهِ الْأُمَّةِ أَبُو عُبَيْدَةَ بْنُ الْجَرَّاحِ
[Machine] The Messenger of Allah, ﷺ , said: "The most merciful among my Ummah (nation) towards my Ummah is Abu Bakr, and the most severe among them in the matter of Allah is Umar." Then he mentioned (other names) in accordance with this meaning. This hadith was narrated by Bishr ibn Al-Mufaddal, Ismail ibn Ulayyah, Mohammed ibn Abi Adiy, narrated by Khaled Al-Hadda, narrated by Abu Qilabah, narrated by the Prophet, ﷺ , through the chain of narrators. Except his saying about Abu Ubaydah, as they attributed it to Anas ibn Malik, from the Prophet, ﷺ . All of these narrators are trustworthy and reliable. And Allah knows best.
قَالَ رَسُولُ اللهِ ﷺ أَرْحَمُ أُمَّتِي بِأُمَّتِي أَبُو بَكْرٍ وَأَشَدُّهُمْ فِي أَمْرِ اللهِ عُمَرُ ثُمَّ ذَكَرَ مَا بَعْدَهُ بِمَعْنَاهُ وَرَوَاهُ بِشْرُ بْنُ الْمُفَضَّلِ وَإِسْمَاعِيلُ ابْنُ عُلَيَّةَ وَمُحَمَّدُ بْنُ أَبِي عَدِيٍّ عَنْ خَالِدٍ الْحَذَّاءِ عَنْ أَبِي قِلَابَةَ عَنِ النَّبِيِّ ﷺ مُرْسَلًا إِلَّا قَوْلَهُ فِي أَبِي عُبَيْدَةَ فَإِنَّهُمْ وَصَلُوهُ فِي آخِرِهِ فَجَعَلُوهُ عَنْ أَنَسِ بْنِ مَالِكٍ عَنِ النَّبِيِّ ﷺ وَكُلُّ هَؤُلَاءِ الرُّوَاةِ ثِقَاتٌ أَثْبَاتٌ وَاللهُ أَعْلَمُ
[Machine] About money, let it come to me, for indeed Allah, the Most High, has made me a treasurer and distributor.
عَنِ الْمَالِ فَلْيَأْتِنِي؛ فَإِنَّ اللهَ تَعَالَى جَعَلَنِي لَهُ خَازِنًا وَقَاسِمًا
أَنَّهَا سَتَذْهَبُ مِنَ النَّاسِ
[Machine] "A shooting star says, if Uthman bin Affan and Zaid bin Thabit were to die at some point in time, the knowledge of inheritance would be lost until the Day of Judgment. A time will come upon people, and none will be able to perfect it except for them."
شِهَابٍ يَقُولُ لَوْ هَلَكَ عُثْمَانُ بْنُ عَفَّانَ وَزَيْدُ بْنُ ثَابِتٍ ؓ فِي بَعْضِ الزَّمَانِ لَهَلَكَ عِلْمُ الْفَرَائِضِ إِلَى يَوْمِ الْقِيَامَةِ جَاءَ عَلَى النَّاسِ زَمَانٌ وَمَا يُحْسِنُهُ غَيْرُهُمَا
[Machine] I heard Anas saying that the collection of the Quran during the time of the Prophet Muhammad ﷺ was done by four individuals: Ubay ibn Ka'b, Muadh ibn Jabal, Zaid ibn Thabit, and Abu Zaid. I asked Anas, "Who is Abu Zaid?" He replied, "One of my relatives."
سَمِعْتُ أَنَسًا يَقُولُ جَمَعَ الْقُرْآنَ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ أَرْبَعَةٌ أُبِيُّ بْنُ كَعْبٍ وَمُعَاذُ بْنُ جَبَلٍ وَزَيْدُ بْنُ ثَابِتٍ وَأَبُو زَيْدٍ قَالَ قُلْتُ لِأَنَسٍ مَنْ أَبُو زَيْدٍ؟ قَالَ أَحَدُ عُمُومَتِي
[Machine] Abu Bakr Al-Siddiq said to me, "Indeed, you are a young, intelligent man whom we do not suspect. You used to write for the Messenger of Allah ﷺ, so follow the Qur'an and compile it. This story has already been recorded in length in the book of prayer, and it includes the virtuousness of Zaid ibn Thabit."
قَالَ لِي أَبُو بَكْرٍ الصِّدِّيقُ ؓ إِنَّكَ رَجُلٌ شَابٌّ عَاقِلٌ لَا نَتَّهِمُكَ وَكُنْتَ تَكْتُبُ لِرَسُولِ اللهِ ﷺ فَتَتَبَّعِ الْقُرْآنَ فَاجْمَعْهُ قَدْ مَضَتْ هَذِهِ الْقِصَّةُ بِطُولِهَا فِي كِتَابِ الصَّلَاةِ وَفِيهَا فَضِيلَةٌ سَنِيَّةٌ لِزَيْدِ بْنِ ثَابِتٍ ؓ
[Machine] The Messenger of Allah ﷺ said to me, "There are books that I do not like anyone to read. Will you be able to learn them and improve your character?" I said, "No." He said, "Then learn them." So I learned them in seventeen days, the wording of the hadith from Ibn al-Fadl.
قَالَ لِي رَسُولُ اللهِ ﷺ تَأْتِينِي كُتُبٌ لَا أُحِبُّ أَنْ يَقْرَأَهَا أَحَدٌ فَتُحْسِنُ السُّرْيَانِيَّةَ؟ قُلْتُ لَا قَالَ فَتَعَلَّمْهَا فَتَعَلَّمْتُهَا فِي سَبْعَةَ عَشَرَ يَوْمًا لَفْظُ حَدِيثِ ابْنِ الْفَضْلِ
[Machine] When the Prophet ﷺ arrived in Medina, I was brought to him and I recited to him. He said to me, "Learn the Scripture of the Jews, for I do not trust them regarding our scripture." So, within fifteen days, I learned it and used to write for the Prophet ﷺ and recite their books to him.
لَمَّا قَدِمَ النَّبِيُّ ﷺ الْمَدِينَةَ أُتِيَ بِي إِلَيْهِ فَقَرَأْتُ عَلَيْهِ فَقَالَ لِي تَعَلَّمْ كِتَابَ الْيَهُودِ؛ فَإِنِّي لَا آمَنُهُمْ عَلَى كِتَابِنَا قَالَ فَمَا مَرَّ بِي خَمْسَةَ عَشَرَ حَتَّى تَعَلَّمْتُهُ فَكُنْتُ أَكْتُبُ لِلنَّبِيِّ ﷺ وَأَقْرَأُ كُتُبَهُمْ إِلَيْهِ
[Machine] He said to his cousin, the messenger of Allah ﷺ , "We treat our elders, scholars, and companions in this manner."
لَهُ تَنَحَّ يَا ابْنَ عَمِّ رَسُولِ اللهِ ﷺ فَقَالَ إِنَّا هَكَذَا نَفْعَلُ بِكُبَرَائِنَا وَعُلَمَائِنَا وَبِمَعْنَاهُ
[Machine] This is how knowledge fades away. Today, much knowledge has been buried.
هَكَذَا ذَهَابُ الْعِلْمِ لَقَدْ دُفِنَ الْيَوْمَ عِلْمٌ كَثِيرٌ
[Machine] About the companions of the Messenger of Allah ﷺ , they informed me that Zaid ibn Thabit was one of the steadfast in knowledge.
عَنْ أَصْحَابِ رَسُولِ اللهِ ﷺ فَأَخْبَرُونِي أَنَّ زَيْدَ بْنَ ثَابِتٍ كَانَ مِنَ الرَّاسِخِينَ فِي الْعِلْمِ
[Machine] Zaid bin Thabit learned about two qualities in the Quran and the obligations.
عَلِمَ زَيْدُ بْنُ ثَابِتٍ بِخَصْلَتَيْنِ بِالْقُرْآنِ وَبِالْفَرَائِضِ
34.3 [Machine] Who does not inherit from relatives
٣٤۔٣ بَابُ مَنْ لَا يَرِثُ مِنْ ذَوِي الْأَرْحَامِ
[Machine] I heard Jabir ibn Abdullah say, "The Messenger of Allah ﷺ entered upon me while I was sick. He performed ablution and poured some of his ablution water on me. So I said, 'O Messenger of Allah, I only have female relatives, so how will inheritance be for them?' Then the verse of compulsory inheritances (Al-Faraid) was revealed."
سَمِعْتُ جَابِرَ بْنَ عَبْدِ اللهِ يَقُولُ دَخَلَ عَلَيَّ رَسُولُ اللهِ ﷺ وَأَنَا مَرِيضٌ فَتَوَضَّأَ وَنَضَحَ عَلَيَّ مِنْ وَضُوئِهِ قَالَ فَقُلْتُ يَا رَسُولَ اللهِ إِنَّمَا يَرِثُنِي كَلَالَةٌ فَكَيْفَ الْمِيرَاثُ؟ فَنَزَلَتْ آيَةُ الْفَرَائِضِ
Allah's Apostle ﷺ and Abi Bakr (Allah be pleased with him) visited me on foot in Banu Salama, and found me unconscious. He (the Holy Prophet) called for water and performed ablution and sprinkled out of it (the water) over me. I felt relieved. I said: Messenger of Allah, what should I do with my property? And this verse was revealed:" Allah enjoins you concerning your children: for the male is equal of the portion of two females." (Using translation from Muslim 1616b)
عَادَنِي رَسُولُ اللهِ ﷺ وَأَبُو بَكْرٍ ؓ فِي بَنِي سَلِمَةَ فَوَجَدَنِي لَا أَعْقِلُ فَدَعَا بِمَاءٍ فَتَوَضَّأَ فَرَشَّ عَلَيَّ مِنْهُ فَأَفَقْتُ فَقُلْتُ كَيْفَ أَصْنَعُ فِي مَالِي يَا رَسُولَ اللهِ؟ فَنَزَلَتْ فِيَّ {يُوصِيكُمُ اللهُ فِي أَوْلَادِكُمْ لِلذَّكَرِ مِثْلُ حَظِّ الْأُنْثَيَيْنِ} [النساء 11] أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ ابْنِ جُرَيْجٍ
سَمِعَ أَبَا أُمَامَةَ يَقُولُ شَهِدْتُ رَسُولَ اللهِ ﷺ فِي حِجَّةِ الْوَدَاعِ فَسَمِعْتُهُ يَقُولُ إِنَّ اللهَ قَدْ أَعْطَى كُلَّ ذِي حَقٍّ حَقَّهُ فَلَا وَصِيَّةَ لِوَارِثٍ
[Machine] A man from the people of Al-A'la came to the Messenger of Allah ﷺ and said, "O Messenger of Allah, indeed, a man has died and left behind an aunt and a maternal uncle. He departed and left them as heirs. The Messenger of Allah ﷺ followed him on a donkey and said, 'O Lord, a man left behind an aunt and a maternal uncle, then he passed away and left them as heirs.' Then he continued saying the same thing as he walked. Then he said, 'O Lord, a man left behind an aunt and a maternal uncle, then he passed away and left them as heirs.' Then he said, 'O Lord, a man left behind an aunt and a maternal uncle, and I do not see anything descending upon me, which is not theirs."
أَتَى رَجُلٌ مِنْ أهْلِ الْعَالِيَةِ رَسُولَ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنَّ رَجُلًا هَلَكَ وَتَرَكَ عَمَّةً وَخَالَةً انْطَلِقَ تَقْسِمْ مِيرَاثَهُ فَتَبِعَهُ رَسُولُ اللهِ ﷺ عَلَى حِمَارٍ وَقَالَ يَا رَبِّ رَجُلٌ تَرَكَ عَمَّةً وَخَالَةً ثُمَّ سَارَ هُنَيَّةً ثُمَّ قَالَ يَا رَبِّ رَجُلٌ تَرَكَ عَمَّةً وَخَالَةً ثُمَّ سَارَ هُنَيَّةً ثُمَّ قَالَ يَا رَبِّ رَجُلٌ تَرَكَ عَمَّةً وَخَالَةً ثُمَّ قَالَ لَا أَرَى يَنْزِلُ عَلَيَّ شَيْءٌ لَا شَيْءَ لَهُمَا
[Machine] That the Messenger of Allah ﷺ rode to Quba and sought guidance regarding the inheritance of his aunt and maternal aunt. It was revealed to him that they have no inheritance. Abu Bakr Muhammad ibn Muhammad informed us, Abu al-Husayn al-Fasawi narrated to us, Abu Ali al-Lu'layyi narrated to us, Abu Dawud mentioned it, and Abu Nuaym Durar ibn Surad narrated it from Abdul Aziz, connected to the mention of Abu Sa'eed al-Khudri. In it, the narration is 12204. And it is narrated from Shareek ibn Abi Namir that Harith ibn Abd informed him that the Messenger of Allah ﷺ was asked about the inheritance of the aunt and maternal aunt, and he remained silent, so Jibril ﷺ descended upon him and said, "Jibril informed me that they have no inheritance."
أَنَّ رَسُولَ اللهِ ﷺ رَكِبَ إِلَى قُبَاءَ يَسْتَخِيرُ فِي مِيرَاثِ الْعَمَّةِ وَالْخَالَةِ فَأُنْزِلَ عَلَيْهِ لَا مِيرَاثَ لَهُمَا أَخْبَرَنَاهُ أَبُو بَكْرٍ مُحَمَّدُ بْنُ مُحَمَّدٍ أنا أَبُو الْحُسَيْنِ الْفَسَوِيُّ ثنا أَبُو عَلِيٍّ اللُّؤْلُؤِيُّ ثنا أَبُو دَاوُدَ فَذَكَرَهُ وَرَوَاهُ أَبُو نُعَيْمٍ ضِرَارُ بْنُ صُرَدٍ عَنْ عَبْدِ الْعَزِيزِ مَوْصُولًا بِذِكْرِ أَبِي سَعِيدٍ الْخُدْرِيِّ ؓ فِيهِ 12204 وَرُوِيَ عَنْ شَرِيكِ بْنِ أَبِي نَمِرٍ أَنَّ الْحَارِثَ بْنَ عَبْدٍ أَخْبَرَهُ أَنَّ رَسُولَ اللهِ ﷺ سُئِلَ عَنْ مِيرَاثِ الْعَمَّةِ وَالْخَالَةِ فَسَكَتَ فَنَزَلَ عَلَيْهِ جِبْرِيلُ عَلَيْهِ السَّلَامُ فَقَالَ حَدَّثَنِي جِبْرَائِيلُ أَنْ لَا مِيرَاثَ لَهُمَا
وَلَا الْجَدُّ أَبُو الْأُمِّ وَلَا ابْنَةُ الْأَخِ لِلْأَبِ وَالْأُمِّ وَلَا الْعَمَّةُ أُخْتُ الْأَبِ لِلْأُمِّ وَالْأَبِ وَلَا الْخَالَةُ وَلَا مَنْ هُوَ أَبْعَدُ نَسَبًا مِنَ الْمُتَوَفَّى مِمَّنْ هُوَ فِي هَذَا الْكِتَابِ لَا يَرِثُ أَحَدٌ مِنْهُمْ بِرَحِمِهِ ذَلِكَ شَيْئًا
[Machine] The aunt's matter is being asked about and deliberated upon. He came to him with it, seeking advice, so he rejected it. He called for a paper or a cup with water in it, and erased that writing on it, then he said, "If Allah is pleased with you, I shall accept you."
شَأْنِ الْعَمَّةِ يَسْأَلُ عَنْهَا وَيَسْتَخِيرُ فِيهَا فَأَتَاهُ بِهِ يَرْفَأُ فَدَعَا بِتَوْرٍ أَوْ قَدَحٍ فِيهِ مَاءٌ فَمَحَا ذَلِكَ الْكِتَابَ فِيهِ ثُمَّ قَالَ لَوْ رَضِيَكَ اللهُ لَأَقَرَّكَ لَوْ رَضِيَكَ اللهُ لَأَقَرَّكَ
[Machine] Regarding the Caliphate of Umar, the narration of the Madinah inhabitants is more reliable, and Allah knows best.
عَنْ عُمَرَ بِخِلَافِهِ وَرِوَايَةُ الْمَدَنِيِّينَ أَوْلَى بِالصِّحَّةِ وَاللهُ أَعْلَمُ
34.4 [Machine] Who Said About Inheriting Relatives
٣٤۔٤ بَابُ مَنْ قَالَ بِتَوْرِيثِ ذَوِي الْأَرْحَامِ
‘Umar wrote to AbuʼUbaidah bin al-Jarrah [saying]: Teach your children swimming and teach your fighters archery. After that they used to practise archery frequently, then a stray arrow came and killed a boy, and no one knew where it came from; he was under the care of his maternal uncle. Abu ʿUbaidah wrote to ʿUmar about that [asking]: To whom should I pay his diyah? ‘Umar wrote back telling him that the Messenger of Allah ﷺ used to say: “Allah and His Messenger are the mawla (guardian) of the one who has no mawla, and the maternal uncle is the heir of the one who has no heir.” (Using translation from Aḥmad 323)
يَخْتَلِفُونَ بَيْنَ الْأَغْرَاضِ فَجَاءَ سَهْمٌ غَرْبٌ فَأَصَابَ غُلَامًا فَقَتَلَهُ فِي حِجْرِ خَالٍ لَهُ لَا يُعْلَمُ لَهُ أَصْلٌ قَالَ فَكَتَبَ أَبُو عُبَيْدَةَ إِلَى عُمَرَ بْنِ الْخَطَّابِ ؓ يَسْأَلُهُ إِلَى مَنْ يَدْفَعُ عَقْلَهُ قَالَ فَكَتَبَ إِلَيْهِ عُمَرُ أَنَّ رَسُولَ اللهِ ﷺ كَانَ يَقُولُ اللهُ وَرَسُولُهُ مَوْلَى مَنْ لَا مَوْلَى لَهُ وَالْخَالُ وَارِثُ مَنْ لَا وَارِثَ لَهُ
The Prophet ﷺ said: If anyone leaves a debt or a helpless family I shall be responsible-and sometimes the narrator said: Allah and His Apostle will be responsible-but if anyone leaves property, it goes to his heirs. I am the heirs of him who has none, paying blood-wit for him and inheriting from him; and a maternal uncle is the heir of him who has none, paying blood-wit for him and inheriting from him. عَنِ الْمِقْدَامِ صَاحِبِ رَسُولِ اللهِ ﷺ عَنِ النَّبِيِّ ﷺ قَالَ مَنْ تَرَكَ كَلًّا فَإِلَيْنَا وَرُبَّمَا قَالَ إِلَى اللهِ وَرَسُولِهِ وَمَنْ تَرَكَ مَالًا فَلِوَرَثَتِهِ وَأَنَا وَارِثُ مَنْ لَا وَارِثَ لَهُ أَعْقِلُ عَنْهُ وَأَرِثُهُ وَالْخَالُ وَارِثُ مَنْ لَا وَارِثَ لَهُ يَعْقِلُ عَنْهُ وَيَرِثُهُ
[Machine] The Messenger of Allah ﷺ said, "I am closer to every believer than his own self. So whoever abandons a debt or property, it belongs to me. And whoever leaves behind wealth, it belongs to his inheritors. And I am the guardian of those who have no guardian, so I inherit their wealth and release their burdens." Abu Dawood said, "He is the guardian of those who have no guardian, inheriting their wealth and releasing their burdens."
قَالَ رَسُولُ اللهِ ﷺ أَنَا أَوْلَى بِكُلِّ مُؤْمِنٍ مِنْ نَفْسِهِ فَمَنْ تَرَكَ دَيْنًا أَوْ ضَيْعَةً فَإِلِيَّ وَمَنْ تَرَكَ مَالًا فَلِوَرَثَتِهِ وَأَنَا مَوْلَى مَنْ لَا مَوْلَى لَهُ أَرِثُ مَالَهُ وَأَفُكُّ عَانَهُ وَالْخَالُ مَوْلَى مَنْ لَا مَوْلَى لَهُ يَرِثُ مَالَهُ وَيَفُكُّ عَانَهُ قَالَ أَبُو دَاوُدَ
I heard the Messenger of Allah ﷺ say: I am the heirs of Him who has none, freeing him from his liabilities, and inheriting what he possesses. A maternal uncle is the heir of Him who has none, freeing him from his liabilities, and inheriting his property. (Using translation from Abū Dāʾūd 2901)
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ أَنَا وَارِثُ مَنْ لَا وَارِثَ لَهُ أَفُكُّ عُنِيَّهُ وَأَرِثُ مَالَهُ وَالْخَالُ وَارِثُ مَنْ لَا وَارِثَ لَهُ يَفُكُّ عُنِيَّهُ وَيَرِثُ مَالَهُ
[Machine] The Sheikh was narrated from another perspective, weaker than that.
الشَّيْخُ وَرُوِيَ مِنْ وَجْهٍ آخَرَ أَضْعَفَ مِنْ ذَلِكَ
[Machine] From the Prophet ﷺ, he said: "The paternal uncle is an inheritor."
عَنِ النَّبِيِّ ﷺ قَالَ الْخَالُ وَارِثٌ
[Machine] Narrated by the Prophet ﷺ , "The maternal uncle is an inheritor who has a different status than a partner, as you can see. Walid bin Abi Sulaym does not have a legitimate claim to it, and Allah knows best."
عَنِ النَّبِيِّ ﷺ قَالَ الْخَالُ وَارِثٌ هَذَا مُخْتَلَفٌ فِيهِ عَلَى شَرِيكٍ كَمَا تَرَى وَلَيْثُ بْنُ أَبِي سُلَيْمٍ غَيْرُ مُحْتَجٍّ بِهِ وَاللهُ أَعْلَمُ
[Machine] God and His Messenger said: "The one who has no guardian, the paternal uncle is his heir." This is the preserved saying of Aisha, held as authoritative. And likewise...
قَالَتُ اللهُ وَرَسُولُهُ مَوْلَى مَنْ لَا مَوْلَى لَهُ وَالْخَالُ وَارِثُ مَنْ لَا وَارِثَ لَهُ هَذَا هُوَ الْمَحْفُوظُ مِنْ قَوْلِ عَائِشَةَ مَوْقُوفًا عَلَيْهَا وَكَذَلِكَ
[Machine] Thabit ibn Dadah was a nobleman among the Banu Unayf or the Banu Al-Ajlan tribe. When he died, the Prophet ﷺ was asked if he had any heir. However, they could not find anyone to inherit from him. So the Prophet ﷺ passed on his inheritance to his nephew, Abu Lubaba ibn Abdullah. This narration is from Hadith Ar-Rudastani and the Hadith of Abu Abdullah, in which the names of the heir and the inheritor are not mentioned and it is disconnected (chain of narration) 12217. It is also narrated from Muhammad ibn Ishaq, from Ya'qub ibn Utbah, from Muhammad ibn Yahya ibn Habban, from his uncle Wasif ibn Habban, from the Prophet ﷺ, that he asked Asim ibn Adi Al-Ansari about Thabit ibn Dadah, and he was informed that he was killed. Do you know if he has any lineage among you? He said, "No, he was just a visitor among us." Then the Messenger of Allah ﷺ decreed his inheritance to his nephew, and Abu Abdul Rahman As-Sulami informed us, that I am Abu Al-Hasan Al-Karizi, narrating from Ali ibn Abdul Aziz, from Abu Ubaid, from Abbad ibn Abbad, from Muhammad ibn Ishaq, from Ya'qub ibn Utbah, from Muhammad ibn Yahya ibn Habban, from his uncle Wasif ibn Habban, who raised the narration. This narration is also disconnected. Al-Shafi'i responded to this in Al-Qadim, saying, "Thabit ibn Dadah was killed on the day of Uhud before the establishment of inheritance laws." The Sheikh said, "He was killed on the day of Uhud," according to the narration of Az-Zuhri from Saeed ibn Al-Musayyib.
أَنَّ ثَابِتَ بْنَ الدَّحْدَاحِ كَانَ رَجُلًا أَتِيًّا فِي بَنِي أُنَيْفٍ أَوْ فِي بَنِي الْعَجْلَانِ مَاتَ فَسَأَلَ النَّبِيُّ ﷺ هَلْ لَهُ وَارِثٌ؟ فَلَمْ يَجِدُوا لَهُ وَارِثًا فَدَفَعَ النَّبِيُّ ﷺ مِيرَاثَهُ إِلَى ابْنِ أُخْتِهِ وَهُوَ أَبُو لُبَابَةَ بْنُ عَبْدِ الْمُنْذِرِ لَفْظُ حَدِيثِ الْأَرْدَسْتَانِيِّ وَحَدِيثُ أَبِي عَبْدِ اللهِ مُخْتَصَرًا لَمْ يُسَمِّ الْوَارِثَ وَالْمُوَرَّثَ وَهُوَ مُنْقَطِعٌ 12217 وَرُوِيَ عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ عَنْ يَعْقُوبَ بْنِ عُتْبَةَ عَنْ مُحَمَّدِ بْنِ يَحْيَى بْنِ حَبَّانَ عَنْ عَمِّهِ وَاسِعِ بْنِ حَبَّانَ عَنِ النَّبِيِّ ﷺ أَنَّهُ سَأَلَ عَاصِمَ بْنَ عَدِيٍّ الْأَنْصَارِيَّ عَنْ ثَابِتِ بْنِ الدَّحْدَاحِ وَتُوُفِّيَ هَلْ تَعْلَمُونَ لَهُ نَسَبًا فِيكُمْ؟ فَقَالَ لَا وَإِنَّمَا هُوَ أَتِيٌّ فِينَا قَالَ فَقَضَى رَسُولُ اللهِ ﷺ بِمِيرَاثِهِ لِابْنِ أُخْتِهِ أَخْبَرَنَاهُ أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ أنا أَبُو الْحَسَنِ الْكَارِزِيُّ ثنا عَلِيُّ بْنُ عَبْدِ الْعَزِيزِ عَنْ أَبِي عُبَيْدٍ ثنا عَبَّادُ بْنُ عَبَّادٍ عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ عَنْ يَعْقُوبَ بْنِ عُتْبَةَ عَنْ مُحَمَّدِ بْنِ يَحْيَى بْنِ حَبَّانَ عَنْ عَمِّهِ وَاسِعِ بْنِ حَبَّانَ رَفَعَهُ وَهَذَا أَيْضًا مُنْقَطِعٌ وَقَدْ أَجَابَ عَنْهُ الشَّافِعِيُّ فِي الْقَدِيمِ فَقَالَ ثَابِتُ بْنُ الدَّحْدَاحَةِ قُتِلَ يَوْمَ أُحُدٍ قَبْلَ أَنْ تَنْزِلَ الْفَرَائِضُ قَالَ الشَّيْخُ قَتْلُهُ فِي يَوْمِ أُحُدٍ فِي رِوَايَةِ الزُّهْرِيِّ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ
[Machine] Then Ibn Dhadhah did not stay there long until the polytheists of Quraysh came on the day of Uhud, so he went out with the Messenger of Allah ﷺ and fought them and was martyred. Al-Shafi'i said: The Ayah of inheritance was revealed concerning what our companions have confirmed regarding the daughters of Mahmud ibn Muslimah, and it was revealed on the day of Khaybar. It was said that it was revealed after Uhud regarding the daughters of Sa'd ibn al-Rabi'. And all of this was after the command of Thabit ibn Dhadhahah. The Shaykh [Al-Shafi'i] mentioned in what we mentioned from the hadith of Jabir bin Abdullah and his saying to the Prophet ﷺ : "Indeed, my uncles will inherit me, so how will the inheritance be?" So the Ayah of inheritance descended as evidence that it was revealed after Uhud. For indeed, before Uhud, his father was alive, and indeed he was martyred on the day of Uhud, leaving behind Jabir and his daughters. When Jabir became ill, he had sisters, but he did not have a father or children. So he said, "Indeed, my uncles will inherit me." So the Ayah of inheritance was revealed. It has also been said that the Ayah of inheritance was revealed in the one that is at the end of Surah An-Nisa, and the one that is at the beginning of it was revealed concerning the daughters of Sa'd ibn al-Rabi', as Al-Shafi'i said, may Allah have mercy on him.
فَلَمْ يَلْبَثِ ابْنُ الدَّحْدَاحِ إِلَّا يَسِيرًا حَتَّى جَاءَ كُفَّارُ قُرَيْشٍ يَوْمَ أُحُدٍ فَخَرَجَ مَعَ رَسُولِ اللهِ ﷺ فَقَاتَلَهُ فَقُتِلَ شَهِيدًا قَالَ الشَّافِعِيُّ وَإِنَّمَا نَزَلَتْ آيَةُ الْفَرَائِضِ فِيمَا يُثْبِتُ أَصْحَابُنَا فِي بَنَاتِ مَحْمُودِ بْنِ مَسْلَمَةَ وَقُتِلَ يَوْمَ خَيْبَرَ وَقِيلَ نَزَلَتْ بَعْدَ أُحُدٍ فِي بَنَاتِ سَعْدِ بْنِ الرَّبِيعِ وَهَذَا كُلُّهُ بَعْدَ أَمْرِ ثَابِتِ بْنِ الدَّحْدَاحَةِ قَالَ الشَّيْخُ فِيمَا ذَكَرْنَا مِنْ حَدِيثِ جَابِرِ بْنِ عَبْدِ اللهِ وَقَوْلِهِ لِلنَّبِيِّ ﷺ إِنَّمَا يَرِثُنِي كَلَالَةٌ فَكَيْفَ الْمِيرَاثُ؟ فَنَزَلَتْ آيَةُ الْفَرَائِضِ دَلَالَةٌ عَلَى أَنَّهَا نَزَلَتْ بَعْدَ أُحُدٍ فَإِنَّ قَبْلَ أُحُدٍ كَانَ أَبُوهُ حَيًّا وَإِنَّمَا قُتِلَ يَوْمَ أُحُدٍ شَهِيدًا وَخَلَّفَ جَابِرًا وَبَنَاتٍ لَهُ فَحِينَ مَرِضَ جَابِرٌ كَانَ لَهُ أَخَوَاتٌ وَلَمْ يَكُنْ لَهُ أَبٌ وَلَا وَلَدٌ فَقَالَ إِنَّمَا يَرِثُنِي كَلَالَةٌ فَنَزَلَتْ آيَةُ الْفَرَائِضِ وَقَدْ قِيلَ إِنَّمَا نَزَلَتْ فِيهِ آيَةُ الْفَرَائِضِ الَّتِي فِي آخِرِ سُورَةِ النِّسَاءِ وَنَزَلَتِ الَّتِي فِي أَوَّلِهَا فِي ابْنَتَيْ سَعْدِ بْنِ الرَّبِيعِ كَمَا قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ
"The wife of Sa'd bin Ar-Rabi came with her two daughters from Sa'd to he Messenger of Allah ﷺand said; O Messenger of Allah ﷺ! these two are daughters of Sa'd bin Ar-Rabi who fought along with you on the day of Uhud and was martyred. Their uncle took their wealth, without leaving any wealth for them, and they will not be married unless they have wealth.' He said: 'Allah will decide on that matter.' The ayah about inheritance was revealed, so the Messenger of Allah ﷺ sent (word) to their Uncle saying: Give the two daughters of Sa'd two thirds, and give their mother one eighth, and whatever remains, then it is for you.' (Using translation from Tirmidhī 2092)
يَا رَسُولَ اللهِ هَاتَانِ ابْنَتَا سَعْدِ بْنِ الرَّبِيعِ قُتِلَ أَبُوهُمَا مَعَكَ شَهِيدًا يَوْمَ أُحُدٍ وَإِنَّ عَمَّهُمَا أَخَذَ مَالَهُمَا اسْتِفَاءً وَلَمْ يَتْرُكْ لَهُمَا مَالًا وَلَا تُنْكَحَانِ إِلَّا وَلَهُمَا مَالٌ فَقَالَ رَسُولُ اللهِ ﷺ يَقْضِي اللهُ فِي ذَلِكَ فَأَنْزَلَ اللهُ الْمِيرَاثَ فَأَرْسَلَ إِلَى عَمِّهِمَا فَدَعَاهُ فَقَالَ أَعْطِ ابْنَتَيْ سَعْدٍ الثُّلُثَيْنِ وَأَعْطِ أُمَّهُمَا الثُّمُنَ وَلَكَ مَا بَقِيَ
[Machine] "Do you know how he spent his life there?" They said, "No." He said, "By Allah, I know the people who lived with him there. He treated his aunt as he would treat his sister, and his paternal aunt as he would treat his aunt. So he gave two-thirds to his aunt and one-third to his paternal aunt." It was narrated by Al-Hassan, Jabir ibn Zaid, Bakr ibn Abdullah al-Muzani, and others, that Umar distributed two-thirds to his aunt and one-third to his paternal aunt. All of this is transmitted and narrated by the people of Medina from Umar, and it is more likely to be correct. Allah knows best.
هَلْ تَدْرُونَ كَيْفَ قَضَى عُمَرُ ؓ فِيهَا؟ قَالُوا لَا فَقَالَ وَاللهِ إِنِّي لَأَعْلَمُ النَّاسِ بِقَضَاءِ عُمَرَ فِيهَا جَعَلَ الْعَمَّةَ بِمَنْزِلَةِ الْأَخِ وَالْخَالَةَ بِمَنْزِلَةِ الْأُخْتِ فَأَعْطَى الْعَمَّةَ الثُّلُثَيْنِ وَالْخَالَةَ الثُّلُثَ وَرَوَاهُ الْحَسَنُ وَجَابِرُ بْنُ زَيْدٍ وَبَكْرُ بْنُ عَبْدِ اللهِ الْمُزَنِيُّ وَغَيْرُهُمْ أَنَّ عُمَرَ ؓ جَعَلَ لِلْعَمَّةِ الثُّلُثَيْنِ وَلِلْخَالَةِ الثُّلُثَ وَجَمِيعُ ذَلِكَ مَرَاسِيلُ وَرِوَايَةُ الْمَدَنِيِّينَ عَنْ عُمَرَ أَوْلَى أَنْ تَكُونَ صَحِيحَةً وَاللهُ أَعْلَمُ
[Machine] The aunt is like the mother, and the paternal aunt is like the father, and the niece is like the sister, and every relative is like the womb that follows, if there is no inheriting relative. We have narrated from Abu Ishaq al-Sabi'i from al-Sha'abi from Masruq who said: Abdullah said: Assign them the positions of their fathers, he says: inherit every person in the position of their father.
الْخَالَةُ بِمَنْزِلَةِ الْأُمِّ وَالْعَمَّةُ بِمَنْزِلَةِ الْأَبِ وَابْنَةُ الْأَخِ بِمَنْزِلَةِ الْأَخِ وَكُلُّ ذِي رَحِمٍ بِمَنْزِلَةِ الرَّحِمِ الَّتِي تَلِيهِ إِذَا لَمْ يَكُنْ وَارِثٌ ذُو قَرَابَةٍ وَرُوِّينَا عَنْ أَبِي إِسْحَاقَ السَّبِيعِيِّ عَنِ الشَّعْبِيِّ عَنْ مَسْرُوقٍ قَالَ قَالَ عَبْدُ اللهِ أَنْزِلُوهُمْ مَنَازِلَ آبَائِهِمْ يَقُولُ وَرِّثْ كُلَّ إِنْسَانٍ بِمَنْزِلَةِ أَبِيهِ
[Machine] About his companions, Ali and Abdullah, if they couldn't find an arrow, they would give each other's relatives the entire wealth. And the aunt, the daughter of the aunt, the daughter of the sister, for the mother or father, and the mother or father, the aunt, the daughter of the aunt, the daughter of the granddaughter, and the grandfather from the mother's side, whether near or far in relation, they have the right to the wealth if there is no one else. But if there is the daughter of the sister and the daughter of the aunt, then it is half and half. And if it is the aunt and the uncle, then it is one-third and two-thirds. And the daughter of the uncle and the daughter of the aunt, it is one-third and two-thirds.
عَنْ أَصْحَابِهِ كَانَ عَلِيٌّ وَعَبْدُ اللهِ إِذَا لَمْ يَجِدُوا ذَا سَهْمٍ أَعْطَوَا الْقَرَابَةَ أَعْطَوْا بِنْتَ الْبِنْتِ الْمَالَ كُلَّهُ وَالْخَالَ الْمَالَ كُلَّهُ وَكَذَلِكَ ابْنَةُ الْأَخِ وَابْنَةَ الْأُخْتِ لِلْأُمِّ أَوْ لِلْأَبِ وَالْأُمِّ أَوْ لِلْأَبِ وَالْعَمَّةَ وَابْنَةَ الْعَمِّ وَابْنَةَ بِنْتِ الِابْنِ وَالْجَدَّ مِنْ قِبَلِ الْأُمِّ وَمَا قَرُبَ أَوْ بَعُدَ إِذَا كَانَ رَحِمًا فَلَهُ الْمَالُ إِذَا لَمْ يُوجَدْ غَيْرُهُ فَإِنْ وُجِدَ ابْنَةُ بِنْتٍ وَابْنَةُ أُخْتٍ فَالنِّصْفُ وَالنِّصْفُ وِإِنْ كَانَتْ عَمَّةٌ وَخَالَةٌ فَالثُّلُثُ وَالثُّلُثَانِ وَابْنَةُ الْخَالِ وَابْنَةُ الْخَالَةِ الثُّلُثُ وَالثُّلُثَانِ
34.5 [Machine] A Muslim does not inherit a disbeliever, and a disbeliever does not inherit a Muslim
٣٤۔٥ بَابُ لَا يَرِثُ الْمُسْلِمُ الْكَافِرَ، وَلَا الْكَافِرُ الْمُسْلِمَ
[Machine] The Messenger of Allah ﷺ said, "A Muslim does not inherit from a disbeliever, nor does a disbeliever inherit from a Muslim."
