34. Inheritance
٣٤۔ كِتَابُ الْفَرَائِضِ
[Machine] I fell ill, so the Prophet ﷺ visited me to see how I was doing. I asked him, "O Messenger of Allah, what should I do with my wealth? How should I distribute it?" He did not answer me until the verse of inheritance was revealed, "They request from you a [legal] verdict. Say, 'Allah gives you a ruling concerning one having neither descendants nor ascendants as heirs.'" [Quran 4:176]
مَرِضْتُ فَأَتَانِي النَّبِيُّ ﷺ يَعُودُنِي فَقُلْتُ يَا رَسُولَ اللهِ كَيْفَ أَقْضِي فِي مَالِي؟ كَيْفَ أَصْنَعُ فِي مَالِي؟ فَلَمْ يُحَدِّثْنِي بِشَيْءٍ حَتَّى نَزَلَتْ آيَةُ الْمِيرَاثِ {يَسْتَفْتُونَكَ قُلِ اللهُ يُفْتِيكُمْ فِي الْكَلَالَةِ} [النساء 176]
[Machine] He heard Jabir saying, "I fell ill and the Prophet ﷺ came to visit me with Abu Bakr, walking, while I was unconscious and unable to speak to him. He performed ablution and poured water on me, and I regained consciousness. I said, 'O Messenger of Allah, what should I do with my wealth when I have sisters?' He said, 'The verse of inheritance was revealed: "They ask you, [O Muhammad], about the division of inheritances. Say, ' Allah instructs you about one's relatives.'" (Quran 4:176).' In another narration from Shu'bah narrated from Ibn Al-Munkadir from Jabir in this hadith, he said, 'Only a paternal uncle could inherit me, so he was named as a paternal uncle.' It was mentioned by the scholar and Jabir bin Abdullah, in whom the verse of inheritance was revealed, did not have any children or parents, as his father was killed on the day of Uhud and this verse was revealed after that."
أَنَّهُ سَمِعَ جَابِرًا يَقُولُ مَرِضْتُ فَأَتَانِي النَّبِيُّ ﷺ يَعُودُنِي هُوَ وَأَبُو بَكْرٍ مَاشِيَيْنِ وَقَدْ أُغْمِيَ عَلَيَّ فَلَمْ أُكَلِّمْهُ فَتَوَضَّأَ وَصَبَّهُ عَلَيَّ فَأَفَقْتُ فَقُلْتُ يَا رَسُولَ اللهِ كَيْفَ أَصْنَعُ فِي مَالِي وَلِي أَخَوَاتٌ؟ قَالَ فَنَزَلَتْ آيَةُ الْمِيرَاثِ {يَسْتَفْتُونَكَ قُلِ اللهُ يُفْتِيكُمْ فِي الْكَلَالَةِ} [النساء 176] مَنْ كَانَ لَيْسَ لَهُ وَلَدٌ وَلَهُ أَخَوَاتٌ وَفِي رِوَايَةِ شُعْبَةَ عَنِ ابْنِ الْمُنْكَدِرِ عَنْ جَابِرٍ فِي هَذَا الْحَدِيثِ قَالَ إِنَّمَا يَرِثُنِي كَلَالَةٌ فَسَمَّى مَنْ يَرِثُهُ كَلَالَةً وَقَدْ مَضَى ذِكْرُهُ قَالَ الشَّيْخُ وَجَابِرُ بْنُ عَبْدِ اللهِ الَّذِي نَزَلَتْ فِيهِ آيَةُ الْكَلَالَةِ لَمْ يَكُنْ لَهُ وَلَدٌ وَلَا وَالِدٌ؛ لِأَنَّ أَبَاهُ قُتِلَ يَوْمَ أُحُدٍ وَهَذِهِ الْآيَةُ نَزَلَتْ بَعْدَهُ
[Machine] The last verse to be revealed is "{They ask you for a legal judgement. Say: Allah delivers His judgement to you concerning estranged children.}" [Quran 4:176]
آخِرُ آيَةٍ نَزَلَتْ {يَسْتَفْتُونَكَ قُلِ اللهُ يُفْتِيكُمْ فِي الْكَلَالَةِ} [النساء 176]
[Machine] In it, there is what made the Messenger of Allah ﷺ most upset, or what I have not revealed to the Messenger of Allah ﷺ more than the verse of Al-Kallalah, until he struck my chest and said, "The verse of Al-Sayf, which was revealed in the last verse of Surat Al-Nisa {They ask you (O Muhammad) about Al-Kallalah. Say, 'Allah instructs you concerning them.'] until the end of the verse, and I will judge in it with a judgment known to those who read it and those who do not read it, and it is what remains of the Father." This is my estimation.
فِيهِ مَا أَغْلَظَ لِي رَسُولُ اللهِ ﷺ أَوْ مَا نَازَلْتُ رَسُولَ اللهِ ﷺ فِي شَيْءٍ أَكْثَرَ مِنْ آيَةِ الْكَلَالَةِ حَتَّى ضَرَبَ صَدْرِي وَقَالَ يَكْفِيكَ مِنْهَا آيَةُ الصَّيْفِ الَّتِي أُنْزِلَتْ فِي آخِرِ سُورَةِ النِّسَاءِ {يَسْتَفْتُونَكَ قُلِ اللهُ يُفْتِيكُمْ فِي الْكَلَالَةِ} [النساء 176] إِلَى آخِرِ الْآيَةِ وَسَأَقْضِي فِيهَا بِقَضَاءٍ يَعْلَمُهُ مَنْ يَقْرَأُ وَمَنْ لَا يَقْرَأُ وَهُوَ مَا خَلَا الْأَبَ كَذَا أَحْسَبُ
A man came to the Prophet ﷺ and said: Messenger of Allah, they ask thee for a legal decision about a kalalah. What is meant by kalalah? He replied: The verse revealed in summer is sufficient for you. I asked AbuIshaq: Does it mean a person who dies and leaves neither children nor father? He said: This is so. The people think it is so. (Using translation from Abū Dāʾūd 2889)
جَاءَ رَجُلٌ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللهِ يَسْتَفْتُونَكَ فِي الْكَلَالَةِ فَمَا الْكَلَالَةُ؟ قَالَ تُجْزِيكَ آيَةُ الصَّيْفِ قُلْتُ لِأَبِي إِسْحَاقَ هُوَ مَنْ مَاتَ وَلَمْ يَدَعْ وَلَدًا وَلَا وَالِدًا؟ قَالَ كَذَلِكَ ظَنُّوا أَنَّهُ كَذَلِكَ
[Machine] A man came to the Prophet ﷺ and said, "O Messenger of Allah, they ask you for a ruling. Say, Allah gives you a ruling concerning the kalalah." He said, "Whoever dies and leaves neither a child nor a parent, his inheritance will be given to his kalalah." Abu Dawud said, "And Ammar narrated from Abu Ishaq from Al-Bara' about the kalalah, and he said, 'The verse of the summer is sufficient for you.' The sheikh said, 'This is the well-known narration, and the narration of Abu Ishaq from Abu Salamah is disconnected, and it is not recognized.'"
جَاءَ رَجُلٌ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللهِ {يَسْتَفْتُونَكَ قُلِ اللهُ يُفْتِيكُمْ فِي الْكَلَالَةِ} [النساء 176] قَالَ مَنْ لَمْ يَتْرُكْ وَلَدًا وَلَا وَالِدًا فَوَرَثَتُهُ كَلَالَةٌ قَالَ أَبُو دَاوُدَ وَرَوَى عَمَّارٌ عَنْ أَبِي إِسْحَاقَ عَنِ الْبَرَاءِ فِي الْكَلَالَةِ قَالَ تَكْفِيكَ آيَةُ الصَّيْفِ قَالَ الشَّيْخُ هَذَا هُوَ الْمَشْهُورُ وَحَدِيثُ أَبِي إِسْحَاقَ عَنْ أَبِي سَلَمَةَ مُنْقَطِعٌ وَلَيْسَ بِمَعْرُوفٍ
[Machine] "To contradict Abu Bakr Al-Kalalah except for the child and the parent."
أَنْ أُخَالِفَ أَبَا بَكْرٍ الْكَلَالَةُ مَا عَدَا الْوَلَدَ وَالْوَالِدَ
[Machine] A time came upon me that I don't know what "kallala" means, and "kallala" is someone who has neither a father nor a child.
أَتَى عَلَيَّ زَمَانٌ مَا أَدْرِي مَا الْكَلَالَةُ وَإِذِ الْكَلَالَةُ مَنْ لَا أَبَ لَهُ وَلَا وَلَدَ
عَنْ أَبِي إِسْحَاقَ
[Machine] I said, "Verily, Allah says, 'If a person dies and he has no child.'" He became angry and scolded me.
قُلْتُ فَإِنَّ اللهَ ﷻ يَقُولُ {إِنِ امْرُؤٌ هَلَكَ لَيْسَ لَهُ وَلَدٌ} [النساء 176] قَالَ فَغَضِبَ وَانْتَهَرَنِي
[Machine] "Allah, if a person dies and he has no child, but he has a sister" [Women 176] so He becomes angry and reproaches me and says, 'Who has no child and no parent?"
اللهُ {إِنِ امْرُؤٌ هَلَكَ لَيْسَ لَهُ وَلَدٌ وَلَهُ أُخْتٌ} [النساء 176] فَغَضِبَ وَانْتَهَرَنِي وَقَالَ مَنْ لَا وَلَدَ لَهُ وَلَا وَالِدَ
[Machine] The kalaala (inheritance of one with no offspring) is mentioned in this narration, which we have heard from Umar and Ibn Abbas in their interpretation of kalaala. It is more similar to the evidence from the Quran and Sunnah than this narration, and it is more likely to be correct, due to the uniqueness of this narration and the contradiction of other narrations from them. And Allah knows best.
الْكَلَالَةُ مَنْ لَا وَلَدَ لَهُ كَذَا فِي هَذِهِ الرِّوَايَةِ وَالَّذِي رُوِّينَا عَنْ عُمَرَ وَابْنِ عَبَّاسٍ فِي تَفْسِيرِ الْكَلَالَةِ أَشْبَهُ بِدَلَائِلِ الْكِتَابِ وَالسُّنَّةِ مِنْ هَذِهِ الرِّوَايَةِ وَأَوْلَى أَنْ يَكُونَ صَحِيحًا؛ لِانْفِرَادِ هَذِهِ الرِّوَايَةِ وَتَظَاهُرِ الرِّوَايَاتِ عَنْهُمَا بِخِلَافِهَا وَاللهُ أَعْلَمُ
[Machine] "That the Messenger of Allah ﷺ makes them clear to me is more beloved to me than the red camels, leadership, wealth, and interest. So I said to Murrah, 'Who would doubt regarding the parentage except the child and the father?' He said, 'They doubt regarding the father.'
لَأَنْ يَكُونَ رَسُولُ اللهِ ﷺ بَيَّنَهُنَّ أَحَبُّ إِلِيَّ مِنْ حُمْرِ النَّعَمِ الْخِلَافَةُ وَالْكَلَالَةُ وَالرِّبَا فَقُلْتُ لِمُرَّةَ وَمَنْ يَشُكُّ فِي الْكَلَالَةِ مَا هُوَ دُونَ الْوَلَدِ وَالْوَالِدِ؟ قَالَ إِنَّهُمْ يَشُكُّونَ فِي الْوَالِدِ
[Machine] The passage is from the Quran, specifically verse 176 of Surah An-Nisa (The Women):
"And for you is half of what your wives leave if they have no child. But if they have a child, for you is one fourth of what they leave, after any bequest they[DQ1] have made or debt. And for the wives is one fourth if you leave no child. But if you leave a child, then for them is an eighth of what you leave, after any bequest you[DQ2] have made or debt. And if a man or woman leaves neither ascendants nor descendants[DQ3] , but has a brother or a sister[DQ4] , then for each one of them is a sixth. But if they are more than two, they share one third, after any bequest which was made or debt[DQ5] , as long as there is no detriment[DQ6] . [This is] an ordinance from Allah , and Allah is Knowing and Forbearing."

وَمِيرَاثُ الْإِخْوَةِ لِلْأُمِّ أَنَّهُمْ لَا يَرِثُونَ مَعَ الْوَلَدِ وَلَا مَعَ وَلَدِ الِابْنِ ذَكَرًا كَانَ أَوْ أُنْثَى شَيْئًا وَلَا مَعَ الْأَبِ وَلَا مَعَ الْجَدِّ أَبِي الْأَبِ شَيْئًا قَالَ وَمِيرَاثُ الْإِخْوَةِ لِلْأَبِ وَالْأُمِّ أَنَّهُمْ لَا يَرِثُونَ مَعَ الْوَلَدِ الذَّكَرِ وَلَا مَعَ وَلَدِ الِابْنِ الذَّكَرِ وَلَا مَعَ الْأَبِ شَيْئًا قَالَ وَمِيرَاثُ الْإِخْوَةِ لِلْأَبِ إِذَا لَمْ يَكُنْ مَعَهُمْ أَحَدٌ مِنْ بَنِي الْأُمِّ وَالْأَبِ كَمِيرَاثِ الْإِخْوَةِ لِلْأَبِ وَالْأُمِّ سَوَاءٌ فَإِذَا اجْتَمَعَ الْإِخْوَةُ مِنَ الْأَبِ وَالْأُمِّ وَالْإِخْوَةُ مِنَ الْأَبِ فَكَانَ فِي بَنِي الْأُمِّ وَالْأَبِ ذَكَرٌ فَلَا مِيرَاثَ مَعَهُ لِأَحَدٍ مِنَ الْإِخْوَةِ لِلْأَبِ
