34. Inheritance (2/7)
٣٤۔ كِتَابُ الْفَرَائِضِ ص ٢
[Machine] The Messenger of Allah ﷺ said, "A disbeliever does not inherit from a Muslim, nor does a Muslim inherit from a disbeliever."
قَالَ رَسُولُ اللهِ ﷺ لَا يَرِثُ الْكَافِرُ الْمُسْلِمَ وَلَا الْمُسْلِمُ الْكَافِرَ
[Machine] I asked, "O Messenger of Allah, where will you stay tomorrow?" And this was during the farewell pilgrimage of the Prophet ﷺ . He replied, "Did Aqil ibn Abi Talib leave anything for us?" Then he said, "A Muslim does not inherit from a disbeliever, nor does a disbeliever inherit from a Muslim." Then he said, "We will stay tomorrow at Khayf ibn Kinanah, where Quraysh divided the camels for disbelief."
قُلْتُ يَا رَسُولَ اللهِ أَيْنَ تَنْزِلُ غَدًا؟ وَذَلِكَ فِي حِجَّةِ النَّبِيِّ ﷺ فَقَالَ وَهَلْ تَرَكَ لَنَا عَقِيلُ بْنُ أَبِي طَالِبٍ شَيْئًا؟ ثُمَّ قَالَ لَا يَرِثُ الْمُسْلِمُ الْكَافِرَ وَلَا الْكَافِرُ الْمُسْلِمَ ثُمَّ قَالَ نَحْنُ نَازِلُونَ غَدًا بِخَيْفِ بَنِي كِنَانَةَ حَيْثُ قَاسَمَتْ قُرَيْشٌ عَلَى الْكُفْرِ
“O Messenger of Allah, will you stay in your house in Makkah?” He said: “Has ‘Aqeel left us any houses?” 'Aqeel had inherited Abu Talib along with Talib. Neither Ja'far nor 'Ali inherited anything because they had been Muslims, and 'Aqeel and Talib had been disbelievers. So on account of that, Omar would say the believer does not inherit from the disbeliever. And Usamah said: the Messenger of Allah ﷺ said "The Muslim does not inherit from the disbeliever nor the disbeliever from the Muslim." (Using translation from Ibn Mājah 2730)
أَنَّهُ قَالَ يَا رَسُولَ اللهِ أَتَنْزِلُ فِي دَارِكَ بِمَكَّةَ؟ قَالَ وَهَلَ تَرَكَ لَنَا عَقِيلٌ مِنْ رِبَاعٍ أَوْ دُورٍ؟ وَكَانَ عَقِيلٌ وَرِثَ أَبَا طَالِبٍ هُوَ وَطَالِبٌ وَلَمْ يَرِثْهُ جَعْفَرٌ وَلَا عَلِيٌّ؛ لِأَنَّهُمَا كَانَا مُسْلِمَيْنِ وَكَانَ عَقِيلٌ وَطَالِبٌ كَافِرَيْنِ فَكَانَ عُمَرُ بْنُ الْخَطَّابِ ؓ مِنْ أَجْلِ ذَلِكَ يَقُولُ لَا يَرِثُ الْمُؤْمِنُ الْكَافِرَ
[Machine] The Messenger of Allah ﷺ said, "A Muslim should not inherit a Christian, except if he is his slave or his servant."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا يَرِثُ الْمُسْلِمُ النَّصْرَانِيَّ إِلَّا أَنْ يَكُونَ عَبْدَهُ أَوْ أَمَتَهُ
[Machine] The Jew and the Christian do not inherit the Muslim, and they are not inherited by them, except if they are the slave or the slave woman of a man. Ali said, and it is preserved.
لَا يَرِثُ الْيَهُودِيُّ وَلَا النَّصْرَانِيُّ الْمُسْلِمَ وَلَا يَرِثُهُمْ إِلَّا أَنْ يَكُونَ عَبْدَ الرَّجُلِ أَوْ أَمَتَهُ هَذَا مَوْقُوفٌ قَالَ عَلِيٌّ وَهُوَ الْمَحْفُوظُ
[Machine] The Prophet ﷺ said, "The people of two different religions do not inherit from each other, and likewise."
أَنَّ النَّبِيَّ ﷺ قَالَ لَا يَتَوَارَثُ أَهْلُ مِلَّتَيْنِ شَتَّى وَكَذَلِكَ
The Prophet ﷺ as saying: A Muslim may not inherit from an infidel nor an infidel from a Muslim. (Using translation from Abū Dāʾūd 2909)
عَنِ النَّبِيِّ ﷺ قَالَ لَا يَرِثُ الْمُسْلِمُ الْكَافِرَ وَلَا الْكَافِرُ الْمُسْلِمَ وَلَا يَتَوَارَثُونَ أَهْلُ مِلَّتَيْنِ
[Machine] The passage translates to "Her relatives of the same religion inherit it."
يَرِثُهَا أَهْلُ دِينِهَا
[Machine] We do not inherit from the people of religions, and they do not inherit from us.
لَا نَرِثُ أَهْلَ الْمِلَلِ وَلَا يَرِثُونَا
[Machine] "And he said, her relatives of the same faith will inherit her."
وَقَالَ يَرِثُهَا أَهْلُ دِينِهَا
[Machine] I saw an old man walking with a cane, and they said, "This is the heir of Safiyah bint Huyayyah." We used to talk about how when she died, he converted to Islam for her inheritance, but he was not left any inheritance.
رَأَيْتُ شَيْخًا يَمْشِي عَلَى عَصًا فَقَالُوا هَذَا وَارِثُ صَفِيَّةَ بِنْتِ حُيَيٍّ فَكُنَّا نَتَحَدَّثُ أَنَّهَا لَمَّا مَاتَتْ أَسْلَمَ مِنْ أَجْلِ مِيرَاثِهَا فَلَمْ يُوَرَّثْ
34.6 [Machine] The slave does not inherit
٣٤۔٦ بَابُ لَا يَرِثُ الْمَمْلُوكُ
[Machine] The messenger of Allah ﷺ said, "Whoever sells a slave that he possesses, his ownership belongs to the buyer unless the buyer stipulates otherwise." Al-Shafi'i said, "When it became clear in the Prophet's ﷺ Sunnah that a slave does not possess wealth and that whatever the slave possesses is owned by their master, and the master is not their biological father or an inheritor, a gift could be given to the slave as if they were a father. We would only give the master who has no inheritance right, and we did not give a slave any inheritance as described, nor anyone in whom freedom, Islam, and innocence from murder are not combined." Sheikh said, and Zaid bin Thabit said the same.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ بَاعَ عَبْدًا لَهُ مَالٌ فَمَالُهُ لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَهُ الْمُبْتَاعُ قَالَ الشَّافِعِيُّ فَلَمَّا كَانَ بَيِّنًا فِي سُنَّةِ النَّبِيِّ ﷺ أَنَّ الْعَبْدَ لَا يَمْلِكُ مَالًا وَأَنَّ مَا يَمْلِكُ الْعَبْدُ فَإِنَّمَا يَمْلِكُهُ سَيِّدُهُ وَلَمْ يَكُنِ السَّيِّدُ بِأَبِي الْمَيِّتِ وَلَا وَارِثٍ سُمِّيَتْ لَهُ فَرِيضَةٌ فَكُنَّا لَوْ أَعْطَيْنَا الْعَبْدَ بِأَنَّهُ أَبٌ إِنَّمَا أَعْطَيْنَا السَّيِّدَ الَّذِي لَا فَرِيضَةَ لَهُ فَوَرَّثْنَا غَيْرَ مَنْ وَرَّثَ اللهُ فَلَمْ نُوَرِّثْ عَبْدًا لِمَا وَصَفْتُ وَلَا أَحَدًا لَمْ يَجْتَمِعْ فِيهِ الْحُرِّيَّةُ وَالْإِسْلَامُ وَالْبَرَاءَةُ مِنَ الْقَتْلِ قَالَ الشَّيْخُ وَبِهِ قَالَ زَيْدُ بْنُ ثَابِتٍ
34.7 [Machine] The killer does not inherit
٣٤۔٧ بَابُ لَا يَرِثُ الْقَاتِلُ
[Machine] That the Messenger of Allah ﷺ said: "A killer does not inherit from the blood money of the one he killed."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا يَرِثُ قَاتِلٌ مِنْ دِيَةِ مَنْ قَتَلَ
[Machine] "He said in his text that the intentional or unintentional killer does not inherit anything from the blood money."
أَنَّهُ قَالَ فِي مَتْنِهِ لَا يَرِثُ قَاتِلُ عَمْدٍ وَلَا خَطَأٍ شَيْئًا مِنَ الدِّيَةِ أَخْبَرَنَاهُ مُحَمَّدُ بْنُ مُحَمَّدٍ أَنَا الْفَسَوِيُّ ثنا اللُّؤْلُؤِيُّ ثنا أَبُو دَاوُدَ فَذَكَرَهُ
[Machine] That a man with leprosy named 'Adi had two wives, and they fought and one of them was killed. When the Messenger of Allah ﷺ arrived, 'Adi informed him about it. The Messenger of Allah ﷺ said to him, "Exercise self-restraint and do not inherit her."
أَنَّ عَدِيًّا الْجُذَامِيَّ كَانَتْ لَهُ امْرَأَتَانِ اقْتَتَلَتَا فَرَمَى إِحْدَاهُمَا فَمَاتَتْ مِنْهَا فَلَمَّا قَدِمَ رَسُولُ اللهِ ﷺ أَتَاهُ فَذَكَرَ ذَلِكَ لَهُ فَقَالَ لَهُ اعْقِلْهَا وَلَا تَرِثْهَا
[Machine] There was a man from the Banu Mudlij tribe named Qatadah. He had a mother and children, and he married an Arab woman. She said, "I will not be satisfied with you unless you take care of my children." He ordered her to take care of them, but his sons refused. Qatadah took one of his sons and killed him with a sword. Suraqah bin Malik bin Ju'shum went to Umar bin Al-Khattab and informed him of this. Umar said to him, "Prepare for me twenty hundred camels from the land of Banu Mudlij." When Umar arrived, he took thirty female camels, thirty males, and forty young ones. Then he said, "Where is the brother of the slain?" I heard the Messenger of Allah ﷺ saying, "The killer has no claim. These are good genealogical ties; some strengthen others. It has been narrated that it is connected from different aspects."
أَنَّ رَجُلًا مِنْ بَنِي مُدْلِجٍ يُدْعَى قَتَادَةَ كَانَتْ لَهُ أُمُّ وَلَدٍ وَكَانَ لَهُ مِنْهَا ابْنَانِ فَتَزَوَّجَ عَلَيْهَا امْرَأَةً مِنَ الْعَرَبِ فَقَالَتْ لَا أَرْضَى عَنْكَ حَتَّى تَرْعَى عَلَيَّ أُمُّ وَلَدِكَ فَأَمَرَهَا أَنْ تَرْعَى عَلَيْهَا فَأَبَى ابْنَاهَا ذَلِكَ فَتَنَاوَلَ قَتَادَةُ أَحَدَ ابْنَيْهِ بِالسَّيْفِ فَمَاتَ فَقَدِمَ سُرَاقَةُ بْنُ مَالِكِ بْنِ جُعْشُمٍ عَلَى عُمَرَ بْنِ الْخَطَّابِ ؓ فَذَكَرَ ذَلِكَ لَهُ فَقَالَ لَهُ أَعْدِدْ لِي بِقُدَيْدٍ وَهِيَ أَرْضُ بَنِي مُدْلِجٍ عِشْرِينَ وَمِائَةً مِنَ الْإِبِلِ فَلَمَّا قَدِمَ عُمَرُ ؓ أَخَذَ ثَلَاثِينَ جَذَعَةً وَثَلَاثِينَ حِقَّةً وَأَرْبَعِينَ خَلِفَةً ثُمَّ قَالَ أَيْنَ أَخُو الْمَقْتُولِ؟ سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ لَيْسَ لِلْقَاتِلِ شَيْءٌ هَذِهِ مَرَاسِيلُ جَيِّدَةٌ يَقْوَى بَعْضُهَا بِبَعْضٍ وَقَدْ رُوِيَ مَوْصُولًا مِنْ أَوْجُهٍ
[Machine] The Messenger of Allah ﷺ said, "A killer has no rights, unless he has an inheritor who is the closest person to him, and the killer does not inherit anything."
قَالَ رَسُولُ اللهِ ﷺ لَيْسَ لِقَاتِلٍ شَيْءٌ فَإِنْ لَمْ يَكُنْ لَهُ وَارِثٌ يَرِثُهُ أَقْرَبُ النَّاسِ إِلَيْهِ وَلَا يَرِثُ الْقَاتِلُ شَيْئًا
[Machine] The Messenger of Allah ﷺ said: "The murderer does not have any share of inheritance."
قَالَ رَسُولُ اللهِ ﷺ لَيْسَ لِلْقَاتِلِ مِنَ الْمِيرَاثِ شَيْءٌ
[Machine] The Prophet ﷺ said, "Whoever kills a person, then they shall not inherit from him, even if they have no other inheritors. And if they have children or parents, then the Messenger of Allah ﷺ has decreed that the killer shall not receive any inheritance."
قَالَ النَّبِيُّ ﷺ مَنْ قَتَلَ قَتِيلًا فَإِنَّهُ لَا يَرِثُهُ وَإِنَّ لَمْ يَكُنْ لَهُ وَارِثٌ غَيْرُهُ وَإِنْ كَانَ وَلَدَهُ أَوْ وَالِدَهُ فَإِنَّ رَسُولَ اللهِ ﷺ قَضَى لَيْسَ لِقَاتِلٍ مِيرَاثٌ
[Machine] That the Messenger of Allah ﷺ said: "The killer does not inherit. Ishaaq ibn Abdullah cannot be used as evidence except that his testimony strengthens it. And Allah knows best."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ الْقَاتِلُ لَا يَرِثُ إِسْحَاقُ بْنُ عَبْدِ اللهِ لَا يُحْتَجُّ بِهِ إِلَّا أَنَّ شَوَاهِدَهُ تُقَوِّيهِ وَاللهُ أَعْلَمُ
[Machine] "A murderer does not inherit a mistake or intentionally."
عُمَرُ لَا يَرِثُ الْقَاتِلُ خَطَأً وَلَا عَمْدًا
[Machine] Ali, Zaid, and Abdullah said, "The intentional killer does not inherit anything, nor does the unintentional killer."
عَنْ عَلِيٍّ وَزَيْدٍ وَعَبْدِ اللهِ قَالُوا لَا يَرِثُ الْقَاتِلُ عَمْدًا وَلَا خَطَأً شَيْئًا
[Machine] A man threw a stone that hit his mother, causing her death. He then wanted his share of her inheritance, but his brothers said he had no right to it. They went to Ali and he told him, "Your share of her inheritance is the stone that killed her, and you are obliged to pay the blood money. You will not be given anything from her inheritance."
أَنَّ رَجُلًا رَمَى بِحَجَرٍ فَأَصَابَ أُمَّهُ فَمَاتَتْ مِنْ ذَلِكَ فَأَرَادَ نَصِيبَهُ مِنْ مِيرَاثِهَا فَقَالَ لَهُ إِخْوَتُهُ لَا حَقَّ لَكَ فَارْتَفَعُوا إِلَى عَلِيٍّ ؓ فَقَالَ لَهُ عَلِيٌّ حَظُّكَ مِنْ مِيرَاثِهَا الْحَجَرُ وَأَغْرَمَهُ الدِّيَةَ وَلَمْ يُعْطِهِ مِنْ مِيرَاثِهَا شَيْئًا
[Machine] A man who deliberately kills a man or a woman, and is one of their heirs, has no inheritance from them. And whatever woman kills a man or a woman, deliberately or accidentally, she has no inheritance from them. And if the killing is deliberate, the relatives of the victim have the right to either forgive or demand retaliation. If they forgive, there is no inheritance for them from his intellect or his wealth. This was decided by Umar ibn al-Khattab and Ali and Shurayh and others from the judges of the Muslims.
رَجُلٍ قَتَلَ رَجُلًا أَوِ امْرَأَةً عَمْدًا أَوْ خَطَأً مِمَّنْ يَرِثُ فَلَا مِيرَاثَ لَهُ مِنْهُمَا وَأَيُّمَا امْرَأَةٍ قَتَلَتْ رَجُلًا أَوِ امْرَأَةً عَمْدًا أَوْ خَطَأً فَلَا مِيرَاثَ لَهَا مِنْهُمَا وَإِنْ كَانَ الْقَتْلُ عَمْدًا فَالْقَوَدُ إِلَّا أَنْ يَعْفُوا أَوْلِيَاءُ الْمَقْتُولِ فَإِنْ عَفَوْا فَلَا مِيرَاثَ لَهُ مِنْ عَقْلِهِ وَلَا مِنْ مَالِهِ قَضَى بِذَلِكَ عُمَرُ بْنُ الْخَطَّابِ وَعَلِيٌّ ؓ وَشُرَيْحٌ وَغَيْرُهُمْ مِنْ قُضَاةِ الْمُسْلِمِينَ
[Machine] Those who have insight and forbidding in what kills some of you, are the messengers of Allah among you. So come to them and they said, "Indeed, Allah commands you to slaughter a cow." They said, "Do you take us in ridicule?" He said, "I seek refuge in Allah from being among the ignorant." [Al-Baqarah 67] He said, "If they had not been so stubborn, a cow would have sufficed them, but they made it difficult for themselves. So it became difficult for them until they came to the cow that they were commanded to slaughter. And they found it belonging to a man who had no other cow. They said, "By Allah, we will not slaughter it until its owner comes back, if he ever comes." So they took it upon themselves, filling it with gold. And they slaughtered it. And when they struck him with a part of it, he stood up and they asked, "Who killed you?" He said, "This is the doing of my nephew." Then he turned back dead, without leaving a will behind him."
ذَوُو الرَّأْيِ وَالنَّهْيِ عَلَى مَا يَقْتُلُ بَعْضُكُمْ بَعْضًا وَهَذَا رَسُولُ اللهِ ﷺ فِيكُمْ فَأَتَوْهُ فَقَالَ {إِنَّ اللهَ يَأْمُرُكُمْ أَنْ تَذْبَحُوا بَقَرَةً قَالُوا أَتَتَّخِذُنَا هُزُوًا قَالَ أَعُوذُ بِاللهِ أَنْ أَكُونَ مِنَ الْجَاهِلِينَ} [البقرة 67] قَالَ فَلَوْ لَمْ يَعْتَرِضُوا الْبَقَرَ لَأَجْزَأَتْ عَنْهُمْ أَدْنَى بَقَرَةٍ وَلَكِنَّهُمْ شَدَّدُوا فَشُدِّدَ عَلَيْهِمْ حَتَّى انْتَهَوْا إِلَى الْبَقَرَةِ الَّتِي أُمِرُوا بِذَبْحِهَا فَوَجَدُوهَا عِنْدَ رَجُلٍ لَيْسَ لَهُ بَقَرَةٌ غَيْرَهَا فَقَالَ وَاللهِ لَا أَنْقُصُهَا مِنْ مِلْءِ جِلْدِهَا ذَهَبًا فَأَخَذُوهَا بِمِلْءِ جِلْدِهَا ذَهَبًا فَذَبَحُوهَا فَضَرَبُوهُ بِبَعْضِهَا فَقَامَ فَقَالُوا مَنْ قَتَلَكَ؟ قَالَ هَذَا لِابْنِ أَخِيهِ ثُمَّ مَالَ مَيِّتًا فَلَمْ يُعْطَ ابْنُ أَخِيهِ مِنْ مَالِهِ شَيْئًا وَلَمْ يُوَرَّثْ قَاتِلٌ بَعْدَهُ
34.8 [Machine] Who said: The killer does not inherit from the deceased's money, but inherits from the compensation? This has been narrated from Sa'id ibn Musayyib, 'Ata ibn Abi Rabah, and Muhammad ibn Jubayr ibn Mut'im. Ash-Shafi'i said: And this has also been narrated from some of our companions, from the Prophet ﷺ , in a hadith that the people of knowledge do not authenticate.
٣٤۔٨ بَابُ مَنْ قَالَ: يَرِثُ قَاتِلُ الْخَطَأِ مِنَ الْمَالِ، وَلَا يُوَرَّثُ مِنَ الدِّيَةِ رُوِيَ ذَلِكَ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، وَعَطَاءِ بْنِ أَبِي رَبَاحٍ، وَمُحَمَّدِ بْنِ جُبَيْرِ بْنِ مُطْعِمٍ، قَالَ الشَّافِعِيُّ: وَرُوِيَ ذَلِكَ عَنْ بَعْضِ أَصْحَابِنَا، عَنِ النَّبِيِّ ﷺ، بِحَدِيثٍ لَا يُثْبِتُهُ أَهْلُ الْعِلْمِ بِالْحَدِيثِ
[Machine] The Messenger of Allah ﷺ stood on the day of the conquest of Makkah and said, "The people of two religions do not inherit from each other. The woman inherits from her husband's blood money and wealth, and he inherits from her blood money and wealth, as long as one of them does not intentionally kill the other. If one of them intentionally kills the other, he does not inherit anything from his blood money and wealth. However, if he accidentally kills the other, he inherits his wealth but does not inherit his blood money." Ali narrated this, and Abu Bakr al-Naysaburi narrated from Muhammad ibn Yahya, who narrated from Ubaidullah ibn Musa, who narrated from Al-Hasan ibn Salih with the same chain of narration. Muhammad ibn Saeed al-Taifi, a trustworthy narrator, also reported this, according to the shaykh.
أَنَّ رَسُولَ اللهِ ﷺ قَامَ يَوْمَ فَتْحِ مَكَّةَ فَقَالَ لَا يَتَوَارَثُ أَهْلُ مِلَّتَيْنِ الْمَرْأَةُ تَرِثُ مِنْ دِيَةِ زَوْجِهَا وَمَالِهِ وَهُوَ يَرِثُ مِنْ دِيَتِهَا وَمَالِهَا مَا لَمْ يَقْتُلْ أَحَدُهُمَا صَاحِبَهُ عَمْدًا فَإِنْ قَتَلَ أَحَدُهُمَا صَاحِبَهُ عَمْدًا لَمْ يَرِثْ مِنْ دِيَتِهِ وَمَالِهِ شَيْئًا وَإِنْ قَتَلَ صَاحِبَهُ خَطَأً وَرِثَ مِنْ مَالِهِ وَلَمْ يَرِثْ مِنْ دِيَتِهِ قَالَ وَأنبأ عَلِيٌّ ثنا أَبُو بَكْرٍ النَّيْسَابُورِيُّ ثنا مُحَمَّدُ بْنُ يَحْيَى ثنا عُبَيْدُ اللهِ بْنُ مُوسَى ثنا الْحَسَنُ بْنُ صَالِحٍ بِإِسْنَادِهِ مِثْلَهُ قَالَ عَلِيٌّ مُحَمَّدُ بْنُ سَعِيدٍ الطَّائِفِيُّ ثِقَةٌ قَالَ الشَّيْخُ وَقَدْ
34.9 [Machine] Inheritance of Whose Death?
٣٤۔٩ بَابُ مِيرَاثِ مَنْ عُمِّيَ مَوْتُهُ
[Machine] Abu Bakr ordered me, when the people of Yamama were killed, to distribute the inheritance among the living and not to distribute it among some of them from others.
أَمَرَنِي أَبُو بَكْرٍ ؓ حَيْثُ قُتِلَ أَهْلُ الْيَمَامَةِ أَنْ يُوَرِّثَ الْأَحْيَاءَ مِنَ الْأَمْوَاتِ وَلَا يُوَرِّثَ بَعْضَهُمْ مِنْ بَعْضٍ
[Machine] That the living inherit from the dead, but the dead do not inherit from each other. The Sheikh said, as narrated from Sha'abi, from Umar that he inherited some of them from each other, from their offspring and in another narration, he said to Ali, "inherit these, so he inherited them from their offspring" and from Qatadah that Umar inherited the people of Ta'un Amwas, some of them from each other, so if one's hand and foot are on top of the other, he will inherit the higher from the lower and will not inherit the lower from the higher. These two narrations are disconnected. It has been said about Qatadah, from Rajaa' ibn Haywah, from Qabeesah ibn Dhu'ayb, from Umar, and he is also disconnected. So what we have narrated from Umar is the closest and Allah knows best.
أَنْ أُوَرِّثَ الْأَحْيَاءَ مِنَ الْأَمْوَاتِ وَلَا أُوَرِّثَ الْأَمْوَاتَ بَعْضَهُمْ مِنْ بَعْضٍ قَالَ الشَّيْخُ وَقَدْ رُوِيَ عَنِ الشَّعْبِيِّ عَنْ عُمَرَ أَنَّهُ وَرَّثَ بَعْضَهُمْ مِنْ بَعْضٍ مِنْ تِلَادِ أَمْوَالِهِمْ وَفِي رِوَايَةٍ أَنَّهُ قَالَ لِعَلِيٍّ ؓ وَرِّثْ هَؤُلَاءِ فَوَرَّثَهُمْ مِنْ تِلَادِ أَمْوَالِهِمْ وَعَنْ قَتَادَةَ أَنَّ عُمَرَ وَرَّثَ أَهْلَ طَاعُونِ عَمْوَاسٍ بَعْضَهُمْ مِنْ بَعْضٍ فَإِذَا كَانَتْ يَدُ أَحَدِهِمَا وَرِجْلُهُ عَلَى الْآخَرِ وَرَّثَ الْأَعْلَى مِنَ الْأَسْفَلِ وَلَمْ يُوَرِّثِ الْأَسْفَلَ مِنَ الْأَعْلَى وَهَاتَانِ الرِّوَايَتَانِ مُنْقَطِعَتَانِ وَقَدْ قِيلَ عَنْ قَتَادَةَ عَنْ رَجَاءِ بْنِ حَيْوَةَ عَنْ قَبِيصَةَ بْنِ ذُؤَيْبٍ عَنْ عُمَرَ وَهُوَ أَيْضًا مُنْقَطِعٌ فَمَا رُوِّينَا عَنْ عُمَرَ أَشْبَهُ وَاللهُ أَعْلَمُ
[Machine] He said about a people who died in a disaster such as a collapse, drowning, or other similar situations, but it was not known which of them died first. He said, "They do not inherit from each other."
أَنَّهُ قَالَ فِي قَوْمٍ مُتَوَارِثِينَ هَلَكُوا فِي هَدْمٍ أَوْ غَرَقٍ أَوْ غَيْرِ ذَلِكَ مِنَ الْمُتَأَلَّفِ فَلَمْ يُدْرَ أَيُّهُمْ مَاتَ قَبْلُ قَالَ لَا يَتَوَارَثُونَ
[Machine] "About the scholars from the people of Madinah, they used to say that every people who die in destruction, drowning, fire, or something similar, the death of some of them blinds the others before them. Therefore, they do not inherit from each other and are not entitled to be heirs. And because of this, the statement of Zaid bin Thabit was that and Umar bin Abdul Aziz ruled accordingly."
عَنِ الْفُقَهَاءِ مِنْ أَهْلِ الْمَدِينَةِ كَانُوا يَقُولُونَ كُلُّ قَوْمٍ مُتَوَارِثِينَ مَاتُوا فِي هَدْمٍ أَوْ غَرَقٍ أَوْ حَرِيقٍ أَوْ غَيْرِهِ فَعُمِّيَ مَوْتُ بَعْضِهِمْ قَبْلَ بَعْضٍ فَإِنَّهُمْ لَا يَتَوَارَثُونَ وَلَا يُحْجَبُونَ وَعَلَى ذَلِكَ كَانَ قَوْلُ زَيْدِ بْنِ ثَابِتٍ وَقَضَى بِذَلِكَ عُمَرُ بْنُ عَبْدِ الْعَزِيزِ
[Machine] That Um Kulthum, the daughter of Ali, and her son Zaid both passed away on the same day. The two widows met each other but could not tell which one of them had died first, so they did not inherit from each other. It is also mentioned that the people of Siffin did not inherit from each other, nor did the people of Harrah.
أَنَّ أُمَّ كُلْثُومٍ بِنْتَ عَلِيٍّ وَابْنَهَا زَيْدًا وَقَعَا فِي يَوْمٍ وَاحِدٍ وَالْتَقَتِ الصَّائِحَتَانِ فَلَمْ يُدْرَ أَيُّهُمَا هَلَكَ قَبْلُ فَلَمْ تَرِثْهُ وَلَمْ يَرِثْهَا وَأَنَّ أَهْلَ صِفِّينَ لَمْ يَتَوَارَثُوا وَأَنَّ أَهْلَ الْحَرَّةِ لَمْ يَتَوَارَثُوا
[Machine] That the people of al-Harra, when they were afflicted, judgment was passed upon them regarding Zaid bin Thabit, and among the people at that time were companions of the Prophet ﷺ and many of their sons.
أَنَّ أَهْلَ الْحَرَّةِ حِينَ أُصِيبُوا كَانَ الْقَضَاءُ فِيهِمْ عَلَى زَيْدِ بْنِ ثَابِتٍ وَفِي النَّاسِ يَوْمَئِذٍ مِنْ أَصْحَابِ النَّبِيِّ ﷺ وَمِنْ أَبْنَائِهِمْ نَاسٌ كَثِيرٌ
[Machine] "Ali inherited the dead of the camel and then he inherited their living heirs. 12256. I said, and I am Yazid bin Tarif Al-Bahili, on the authority of Yahya bin Saeed, that the dead of the camel and Al-Harrah were inherited by their living heirs."
أَنَّ عَلِيًّا ؓ وَرَّثَ قَتْلَى الْجَمَلِ فَوَرَّثَ وَرَثَتَهُمُ الْأَحْيَاءَ 12256 قَالَ وَأنا يَزِيدُ أنا نَصْرُ بْنُ طَرِيفٍ الْبَاهِلِيُّ عَنْ يَحْيَى بْنِ سَعِيدٍ أَنْ قَتْلَى الْجَمَلِ وَالْحَرَّةِ وُرِّثَ وَرَثَتُهُمُ الْأَحْيَاءُ
[Machine] That Ali inherited from a man and his son or two brothers who were both injured in the Battle of Siffin, it is not known which of them died before the other, so he inherited some of them from others, as he said, and we only take the first narration.
أَنَّ عَلِيًّا وَرَّثَ رَجُلًا وَابْنَهُ أَوْ أَخَوَيْنِ أُصِيبَا بِصِفِّينَ لَا يُدْرَى أَيُّهُمَا مَاتَ قَبْلَ الْآخَرِ فَوَرَّثَ بَعْضَهُمْ مِنْ بَعْضٍ كَذَا قَالَ وَنَحْنُ إِنَّمَا نَأْخُذُ بِالرِّوَايَةِ الْأُولَى
[Machine] That which has been inherited is not from those who were killed on the Day of the Camel, the Day of Siffin, and the Day of Harrah. Then there was the Day of Qudaid, and none of those who were killed on that day inherited anything from their companions except for those who were known to have been killed before their companions. Malik said: "This is a matter in which there is no difference of opinion among us and no doubt among any of the scholars in our city." Imam Ahmad, may Allah have mercy on him, said: "It is narrated from Iyas ibn Abd al-Muzanni that he said: 'Some of them inherit from others.' And the saying of the majority is more correct."
أَنَّهُ لَمْ يَتَوَارَثْ مَنْ قُتِلَ يَوْمَ الْجَمَلِ وَيَوْمَ صِفِّينَ وَيَوْمَ الْحَرَّةِ ثُمَّ كَانَ يَوْمُ قُدَيْدٍ فَلَمْ يَتَوَارَثْ أَحَدٌ مِمَّنْ قُتِلَ مِنْهُمْ مِنْ صَاحِبِهِ شَيْئًا إِلَّا مَنْ عُلِمَ أَنَّهُ قُتِلَ قَبْلَ صَاحِبِهِ قَالَ مَالِكٌ وَذَلِكَ الْأَمْرُ الَّذِي لَا اخْتِلَافَ فِيهِ عِنْدَنَا وَلَا شَكَّ عِنْدَ أَحَدٍ مِنْ أَهْلِ الْعِلْمِ بِبَلَدِنَا قَالَ الْإِمَامُ أَحْمَدُ رَحِمَهُ اللهُ وَرُوِيَ عَنْ إِيَاسِ بْنِ عَبْدٍ الْمُزَنِيِّ أَنَّهُ قَالَ يُوَرَّثُ بَعْضُهُمْ مِنْ بَعْضٍ وَقَوْلُ الْجَمَاعَةِ أَوْلَى
34.10 [Machine] He who does not inherit from these does not veil himself.
٣٤۔١٠ بَابُ لَا يَحْجُبُ مَنْ لَا يَرِثُ مِنْ هَؤُلَاءِ
[Machine] Families from different beliefs do not inherit each other, and those who do not inherit are not concealed.
لَا يَتَوَارَثْ أَهْلُ مِلَّتَيْنِ شَتَّى وَلَا يَحْجُبُ مَنْ لَا يَرِثُ
[Machine] Ali said, "A polytheist does not inherit nor is inherited." And Abdullah said, "He inherits but does not be inherited."
قَالَ عَلِيٌّ ؓ وَزَيْدٌ ؓ الْمُشْرِكُ لَا يَحْجُبُ وَلَا يَرِثُ وَقَالَ عَبْدُ اللهِ ؓ يَحْجُبُ وَلَا يَرِثُ
وَقَالَ عَبْدُ اللهِ يَحْجُبُونَ وَلَا يَرِثُونَ
34.11 [Machine] Exclusion of Brothers and Sisters by the Mother from the Father, Grandfather, Son, and Grandson of the Son.
٣٤۔١١ بَابُ حَجْبِ الْإِخْوَةِ وَالْأَخَوَاتِ مِنْ قِبَلِ الْأُمِّ بِالْأَبِ وَالْجَدِّ وَالْوَلَدِ وَوَلَدِ الِابْنِ
سَعْدٌ مِنْ أُمِّهِ
[Machine] "I will speak my opinion on it, and if it is correct, it is from Allah. And if it is incorrect, it is from me and from Satan. I do not see the Prophet leaving behind a successor and a parent. When Umar was appointed, he said, 'I feel ashamed in front of Allah to refuse something that Abu Bakr said.'"
إِنِّي سَأَقُولُ فِيهَا بِرَأْيِي فَإِنْ يَكُ صَوَابًا فَمِنَ اللهِ وَإِنْ يَكُ خَطَأً فَمِنِّي وَمِنَ الشَّيْطَانِ أُرَاهُ مَا خَلَا الْوَلَدَ وَالْوَالِدَ فَلَمَّا اسْتُخْلِفَ عُمَرُ ؓ قَالَ إِنِّي لَأَسْتَحْيِي مِنَ اللهِ أَنْ أَرُدَّ شَيْئًا قَالَهُ أَبُو بَكْرٍ
[Machine] That one of the companions of Muhammad ﷺ inherited brothers from a mother with a grandfather, has lied.
أَنَّ أَحَدًا مِنْ أَصْحَابِ مُحَمَّدٍ ﷺ وَرَّثَ إِخْوَةً مِنْ أُمٍّ مَعَ جَدٍّ فَقَدْ كَذَبَ
[Machine] No one inherited from the Prophet's companions any brothers from the mother, along with the grandfather, at all. 12266 He said, and I am the son of Al-Mubarak, I am Sufyan from Al-A'mash from Ibrahim, approximately.
مَا وَرَّثَ أَحَدٌ مِنْ أَصْحَابِ النَّبِيِّ ﷺ الْإِخْوَةَ مِنَ الْأُمِّ مَعَ الْجَدِّ شَيْئًا قَطُّ 12266 قَالَ وَأنا ابْنُ الْمُبَارَكِ أنا سُفْيَانُ عَنِ الْأَعْمَشِ عَنْ إِبْرَاهِيمَ نَحْوَهُ
34.12 [Machine] Exclusion of brothers and sisters from the father, son, and grandson.
٣٤۔١٢ بَابُ حَجْبِ الْإِخْوَةِ وَالْأَخَوَاتِ مَنْ كَانُوا بِالْأَبِ وَالِابْنِ وَابْنِ الِابْنِ
[Machine] I fell ill, so the Prophet ﷺ visited me to see how I was doing. I asked him, "O Messenger of Allah, what should I do with my wealth? How should I distribute it?" He did not answer me until the verse of inheritance was revealed, "They request from you a [legal] verdict. Say, 'Allah gives you a ruling concerning one having neither descendants nor ascendants as heirs.'" [Quran 4:176]
مَرِضْتُ فَأَتَانِي النَّبِيُّ ﷺ يَعُودُنِي فَقُلْتُ يَا رَسُولَ اللهِ كَيْفَ أَقْضِي فِي مَالِي؟ كَيْفَ أَصْنَعُ فِي مَالِي؟ فَلَمْ يُحَدِّثْنِي بِشَيْءٍ حَتَّى نَزَلَتْ آيَةُ الْمِيرَاثِ {يَسْتَفْتُونَكَ قُلِ اللهُ يُفْتِيكُمْ فِي الْكَلَالَةِ} [النساء 176]
[Machine] He heard Jabir saying, "I fell ill and the Prophet ﷺ came to visit me with Abu Bakr, walking, while I was unconscious and unable to speak to him. He performed ablution and poured water on me, and I regained consciousness. I said, 'O Messenger of Allah, what should I do with my wealth when I have sisters?' He said, 'The verse of inheritance was revealed: "They ask you, [O Muhammad], about the division of inheritances. Say, ' Allah instructs you about one's relatives.'" (Quran 4:176).' In another narration from Shu'bah narrated from Ibn Al-Munkadir from Jabir in this hadith, he said, 'Only a paternal uncle could inherit me, so he was named as a paternal uncle.' It was mentioned by the scholar and Jabir bin Abdullah, in whom the verse of inheritance was revealed, did not have any children or parents, as his father was killed on the day of Uhud and this verse was revealed after that."
أَنَّهُ سَمِعَ جَابِرًا يَقُولُ مَرِضْتُ فَأَتَانِي النَّبِيُّ ﷺ يَعُودُنِي هُوَ وَأَبُو بَكْرٍ مَاشِيَيْنِ وَقَدْ أُغْمِيَ عَلَيَّ فَلَمْ أُكَلِّمْهُ فَتَوَضَّأَ وَصَبَّهُ عَلَيَّ فَأَفَقْتُ فَقُلْتُ يَا رَسُولَ اللهِ كَيْفَ أَصْنَعُ فِي مَالِي وَلِي أَخَوَاتٌ؟ قَالَ فَنَزَلَتْ آيَةُ الْمِيرَاثِ {يَسْتَفْتُونَكَ قُلِ اللهُ يُفْتِيكُمْ فِي الْكَلَالَةِ} [النساء 176] مَنْ كَانَ لَيْسَ لَهُ وَلَدٌ وَلَهُ أَخَوَاتٌ وَفِي رِوَايَةِ شُعْبَةَ عَنِ ابْنِ الْمُنْكَدِرِ عَنْ جَابِرٍ فِي هَذَا الْحَدِيثِ قَالَ إِنَّمَا يَرِثُنِي كَلَالَةٌ فَسَمَّى مَنْ يَرِثُهُ كَلَالَةً وَقَدْ مَضَى ذِكْرُهُ قَالَ الشَّيْخُ وَجَابِرُ بْنُ عَبْدِ اللهِ الَّذِي نَزَلَتْ فِيهِ آيَةُ الْكَلَالَةِ لَمْ يَكُنْ لَهُ وَلَدٌ وَلَا وَالِدٌ؛ لِأَنَّ أَبَاهُ قُتِلَ يَوْمَ أُحُدٍ وَهَذِهِ الْآيَةُ نَزَلَتْ بَعْدَهُ
[Machine] The last verse to be revealed is "{They ask you for a legal judgement. Say: Allah delivers His judgement to you concerning estranged children.}" [Quran 4:176]
آخِرُ آيَةٍ نَزَلَتْ {يَسْتَفْتُونَكَ قُلِ اللهُ يُفْتِيكُمْ فِي الْكَلَالَةِ} [النساء 176]
[Machine] In it, there is what made the Messenger of Allah ﷺ most upset, or what I have not revealed to the Messenger of Allah ﷺ more than the verse of Al-Kallalah, until he struck my chest and said, "The verse of Al-Sayf, which was revealed in the last verse of Surat Al-Nisa {They ask you (O Muhammad) about Al-Kallalah. Say, 'Allah instructs you concerning them.'] until the end of the verse, and I will judge in it with a judgment known to those who read it and those who do not read it, and it is what remains of the Father." This is my estimation.
فِيهِ مَا أَغْلَظَ لِي رَسُولُ اللهِ ﷺ أَوْ مَا نَازَلْتُ رَسُولَ اللهِ ﷺ فِي شَيْءٍ أَكْثَرَ مِنْ آيَةِ الْكَلَالَةِ حَتَّى ضَرَبَ صَدْرِي وَقَالَ يَكْفِيكَ مِنْهَا آيَةُ الصَّيْفِ الَّتِي أُنْزِلَتْ فِي آخِرِ سُورَةِ النِّسَاءِ {يَسْتَفْتُونَكَ قُلِ اللهُ يُفْتِيكُمْ فِي الْكَلَالَةِ} [النساء 176] إِلَى آخِرِ الْآيَةِ وَسَأَقْضِي فِيهَا بِقَضَاءٍ يَعْلَمُهُ مَنْ يَقْرَأُ وَمَنْ لَا يَقْرَأُ وَهُوَ مَا خَلَا الْأَبَ كَذَا أَحْسَبُ
A man came to the Prophet ﷺ and said: Messenger of Allah, they ask thee for a legal decision about a kalalah. What is meant by kalalah? He replied: The verse revealed in summer is sufficient for you. I asked AbuIshaq: Does it mean a person who dies and leaves neither children nor father? He said: This is so. The people think it is so. (Using translation from Abū Dāʾūd 2889)
جَاءَ رَجُلٌ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللهِ يَسْتَفْتُونَكَ فِي الْكَلَالَةِ فَمَا الْكَلَالَةُ؟ قَالَ تُجْزِيكَ آيَةُ الصَّيْفِ قُلْتُ لِأَبِي إِسْحَاقَ هُوَ مَنْ مَاتَ وَلَمْ يَدَعْ وَلَدًا وَلَا وَالِدًا؟ قَالَ كَذَلِكَ ظَنُّوا أَنَّهُ كَذَلِكَ
[Machine] A man came to the Prophet ﷺ and said, "O Messenger of Allah, they ask you for a ruling. Say, Allah gives you a ruling concerning the kalalah." He said, "Whoever dies and leaves neither a child nor a parent, his inheritance will be given to his kalalah." Abu Dawud said, "And Ammar narrated from Abu Ishaq from Al-Bara' about the kalalah, and he said, 'The verse of the summer is sufficient for you.' The sheikh said, 'This is the well-known narration, and the narration of Abu Ishaq from Abu Salamah is disconnected, and it is not recognized.'"
جَاءَ رَجُلٌ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللهِ {يَسْتَفْتُونَكَ قُلِ اللهُ يُفْتِيكُمْ فِي الْكَلَالَةِ} [النساء 176] قَالَ مَنْ لَمْ يَتْرُكْ وَلَدًا وَلَا وَالِدًا فَوَرَثَتُهُ كَلَالَةٌ قَالَ أَبُو دَاوُدَ وَرَوَى عَمَّارٌ عَنْ أَبِي إِسْحَاقَ عَنِ الْبَرَاءِ فِي الْكَلَالَةِ قَالَ تَكْفِيكَ آيَةُ الصَّيْفِ قَالَ الشَّيْخُ هَذَا هُوَ الْمَشْهُورُ وَحَدِيثُ أَبِي إِسْحَاقَ عَنْ أَبِي سَلَمَةَ مُنْقَطِعٌ وَلَيْسَ بِمَعْرُوفٍ
[Machine] "To contradict Abu Bakr Al-Kalalah except for the child and the parent."
أَنْ أُخَالِفَ أَبَا بَكْرٍ الْكَلَالَةُ مَا عَدَا الْوَلَدَ وَالْوَالِدَ
[Machine] A time came upon me that I don't know what "kallala" means, and "kallala" is someone who has neither a father nor a child.
أَتَى عَلَيَّ زَمَانٌ مَا أَدْرِي مَا الْكَلَالَةُ وَإِذِ الْكَلَالَةُ مَنْ لَا أَبَ لَهُ وَلَا وَلَدَ
