34. Inheritance (3/7)
٣٤۔ كِتَابُ الْفَرَائِضِ ص ٣
عَنْ أَبِي إِسْحَاقَ
[Machine] I said, "Verily, Allah says, 'If a person dies and he has no child.'" He became angry and scolded me.
قُلْتُ فَإِنَّ اللهَ ﷻ يَقُولُ {إِنِ امْرُؤٌ هَلَكَ لَيْسَ لَهُ وَلَدٌ} [النساء 176] قَالَ فَغَضِبَ وَانْتَهَرَنِي
[Machine] "Allah, if a person dies and he has no child, but he has a sister" [Women 176] so He becomes angry and reproaches me and says, 'Who has no child and no parent?"
اللهُ {إِنِ امْرُؤٌ هَلَكَ لَيْسَ لَهُ وَلَدٌ وَلَهُ أُخْتٌ} [النساء 176] فَغَضِبَ وَانْتَهَرَنِي وَقَالَ مَنْ لَا وَلَدَ لَهُ وَلَا وَالِدَ
[Machine] The kalaala (inheritance of one with no offspring) is mentioned in this narration, which we have heard from Umar and Ibn Abbas in their interpretation of kalaala. It is more similar to the evidence from the Quran and Sunnah than this narration, and it is more likely to be correct, due to the uniqueness of this narration and the contradiction of other narrations from them. And Allah knows best.
الْكَلَالَةُ مَنْ لَا وَلَدَ لَهُ كَذَا فِي هَذِهِ الرِّوَايَةِ وَالَّذِي رُوِّينَا عَنْ عُمَرَ وَابْنِ عَبَّاسٍ فِي تَفْسِيرِ الْكَلَالَةِ أَشْبَهُ بِدَلَائِلِ الْكِتَابِ وَالسُّنَّةِ مِنْ هَذِهِ الرِّوَايَةِ وَأَوْلَى أَنْ يَكُونَ صَحِيحًا؛ لِانْفِرَادِ هَذِهِ الرِّوَايَةِ وَتَظَاهُرِ الرِّوَايَاتِ عَنْهُمَا بِخِلَافِهَا وَاللهُ أَعْلَمُ
[Machine] "That the Messenger of Allah ﷺ makes them clear to me is more beloved to me than the red camels, leadership, wealth, and interest. So I said to Murrah, 'Who would doubt regarding the parentage except the child and the father?' He said, 'They doubt regarding the father.'
لَأَنْ يَكُونَ رَسُولُ اللهِ ﷺ بَيَّنَهُنَّ أَحَبُّ إِلِيَّ مِنْ حُمْرِ النَّعَمِ الْخِلَافَةُ وَالْكَلَالَةُ وَالرِّبَا فَقُلْتُ لِمُرَّةَ وَمَنْ يَشُكُّ فِي الْكَلَالَةِ مَا هُوَ دُونَ الْوَلَدِ وَالْوَالِدِ؟ قَالَ إِنَّهُمْ يَشُكُّونَ فِي الْوَالِدِ
[Machine] The passage is from the Quran, specifically verse 176 of Surah An-Nisa (The Women):
"And for you is half of what your wives leave if they have no child. But if they have a child, for you is one fourth of what they leave, after any bequest they[DQ1] have made or debt. And for the wives is one fourth if you leave no child. But if you leave a child, then for them is an eighth of what you leave, after any bequest you[DQ2] have made or debt. And if a man or woman leaves neither ascendants nor descendants[DQ3] , but has a brother or a sister[DQ4] , then for each one of them is a sixth. But if they are more than two, they share one third, after any bequest which was made or debt[DQ5] , as long as there is no detriment[DQ6] . [This is] an ordinance from Allah , and Allah is Knowing and Forbearing."

وَمِيرَاثُ الْإِخْوَةِ لِلْأُمِّ أَنَّهُمْ لَا يَرِثُونَ مَعَ الْوَلَدِ وَلَا مَعَ وَلَدِ الِابْنِ ذَكَرًا كَانَ أَوْ أُنْثَى شَيْئًا وَلَا مَعَ الْأَبِ وَلَا مَعَ الْجَدِّ أَبِي الْأَبِ شَيْئًا قَالَ وَمِيرَاثُ الْإِخْوَةِ لِلْأَبِ وَالْأُمِّ أَنَّهُمْ لَا يَرِثُونَ مَعَ الْوَلَدِ الذَّكَرِ وَلَا مَعَ وَلَدِ الِابْنِ الذَّكَرِ وَلَا مَعَ الْأَبِ شَيْئًا قَالَ وَمِيرَاثُ الْإِخْوَةِ لِلْأَبِ إِذَا لَمْ يَكُنْ مَعَهُمْ أَحَدٌ مِنْ بَنِي الْأُمِّ وَالْأَبِ كَمِيرَاثِ الْإِخْوَةِ لِلْأَبِ وَالْأُمِّ سَوَاءٌ فَإِذَا اجْتَمَعَ الْإِخْوَةُ مِنَ الْأَبِ وَالْأُمِّ وَالْإِخْوَةُ مِنَ الْأَبِ فَكَانَ فِي بَنِي الْأُمِّ وَالْأَبِ ذَكَرٌ فَلَا مِيرَاثَ مَعَهُ لِأَحَدٍ مِنَ الْإِخْوَةِ لِلْأَبِ
34.13 [Machine] He does not inherit with his father his parents
٣٤۔١٣ بَابُ لَا يَرِثُ مَعَ الْأَبِ أَبَوَاهُ
[Machine] Abu Bakr used to say, "A grandfather is not a grandfather until there is no grandfather below him, just as a son of a son is not a son until there is no son below him."
كَانَ أَبُو بَكْرٍ ؓ يَقُولُ الْجَدُّ أَبٌ مَا لَمْ يَكُنْ دُونَهُ أَبٌ كَمَا أَنَّ ابْنَ الِابْنِ ابْنٌ مَا لَمْ يَكُنْ دُونَهُ ابْنٌ
[Machine] That Zaid ibn Thabit did not give any inheritance to his grandmother along with her son.
أَنَّ زَيْدَ بْنَ ثَابِتٍ لَمْ يَكُنْ يَجْعَلُ لِلْجَدَّةِ مَعَ ابْنِهَا مِيرَاثًا
[Machine] Ali and Zaid did not include their grandmother in the inheritance with her son.
أَنَّ عَلِيًّا ؓ وَزَيْدًا ؓ كَانَا لَا يَجْعَلَانِ لِلْجَدَّةِ مَعَ ابْنِهَا مِيرَاثًا
[Machine] Ali and Zaid were not inheriting the grandmother with her son.
أَنَّ عَلِيًّا وَزَيْدًا كَانَا لَا يُوَرِّثَانِ الْجَدَّةَ مَعَ ابْنِهَا
[Machine] That Uthman used to not inherit the grandmother if her son was alive.
أَنَّ عُثْمَانَ ؓ كَانَ لَا يُوَرِّثُ الْجَدَّةَ إِذَا كَانَ ابْنُهَا حَيًّا
[Machine] "He said: The first grandmother who was fed by the Messenger of Allah ﷺ was his paternal grandmother and her son, and the son was alive. Muhammad ibn Salim narrated it in this way. And it was narrated from Yunus, from Ibn Sirin, who said: I was informed, and from Ash'ath ibn Sawwar, from Ibn Sirin, from Abdullah, from Ash'ath ibn Abd al-Malik, from al-Hasan, and Ibn Sirin, from the Prophet ﷺ . The narration of Yunus and Ash'ath is disconnected, and Muhammad ibn Salim cannot be relied upon for evidence. The authentic narration in it is only from Umar, Abdullah, and Imran ibn Husain."
أَنَّهُ قَالَ أَوَّلُ جَدَّةٍ أَطْعَمَهَا رَسُولُ اللهِ ﷺ سُدُسًا مَعَ ابْنِهَا وَابْنُهَا حَيٌّ فَمُحَمَّدُ بْنُ سَالِمٍ يَتَفَرَّدُ بِهِ هَكَذَا وَرُوِيَ عَنْ يُونُسَ عَنِ ابْنِ سِيرِينَ قَالَ أُنْبِئْتُ وَعَنْ أَشْعَثَ بْنِ سَوَّارٍ عَنِ ابْنِ سِيرِينَ عَنْ عَبْدِ اللهِ وَعَنْ أَشْعَثَ بْنِ عَبْدِ الْمَلِكِ عَنِ الْحَسَنِ وَابْنِ سِيرِينَ عَنِ النَّبِيِّ ﷺ وَحَدِيثُ يُونُسَ وَأَشْعَثَ مُنْقَطِعٌ وَمُحَمَّدُ بْنُ سَالِمٍ غَيْرُ مُحْتَجٍّ بِهِ وَإِنَّمَا الرِّوَايَةُ الصَّحِيحَةُ فِيهِ عَنْ عُمَرَ وَعَبْدِ اللهِ وَعِمْرَانَ بْنِ حُصَيْنٍ
[Machine] That Umar ibn Al-Khattab inherited the grandfather of a man from Thaqeef along with his son.
أَنَّ عُمَرَ بْنَ الْخَطَّابِ ؓ وَرَّثَ جَدَّةَ رَجُلٍ مِنْ ثَقِيفٍ مَعَ ابْنِهَا
أَنْهُ وَرَّثَ جَدَّةً مَعَ ابْنِهَا
[Machine] He used to inherit the grandmother and her son while alive.
أَنَّهُ كَانَ يُوَرِّثُ الْجَدَّةَ وَابْنُهَا حَيٌّ
34.14 [Machine] Do not inherit with a grandmother
٣٤۔١٤ بَابُ لَا تَرِثُ مَعَ الْأُمِّ جَدَّةٌ
[Machine] That the Messenger of Allah ﷺ would give the grandmother one-sixth if she is not the mother.
أَنَّ رَسُولَ اللهِ ﷺ أَطْعَمَ الْجَدَّةَ السُّدُسَ إِذَا لَمْ تَكُنْ أُمٌّ
[Machine] That the grandmother does not inherit anything with the mother, and in addition to that, she is obliged to receive one-sixth as a duty. And that the father's mother does not inherit anything with the mother or with the father, and in addition to that, she is obliged to receive one-sixth as a duty.
أَنَّ أُمَّ الْأُمِّ لَا تَرِثُ مَعَ الْأُمِّ شَيْئًا وَهِيَ فِيمَا سِوَى ذَلِكَ يُفْرَضُ لَهَا السُّدُسُ فَرِيضَةً وَأَنَّ أُمَّ الْأَبِ لَا تَرِثُ مَعَ الْأُمِّ وَلَا مَعَ الْأَبِ شَيْئًا وَهِيَ فِيمَا سِوَى ذَلِكَ يُفْرَضُ لَهَا السُّدُسُ فَرِيضَةً
34.15 [Machine] The collection of inheritance laws.
٣٤۔١٥ جُمَّاعُ أَبْوَابِ الْمَوَارِيثِ
34.16 [Machine] The obligation of the husband and wife
٣٤۔١٦ بَابُ فَرْضِ الزَّوْجِ وَالزَّوْجَةِ
[Machine] In His saying, "Allah instructs you concerning your children: for the male, what is equal to the share of two females" [Quran 4:11], it is mentioned that inheritance was for the child and the will was for the parents. So, Allah abrogated from that which He preferred and made the share of the male child equal to two females, and He made for the parents one-sixth each, and He made for the husband half or one-fourth, and He made for the wife one-fourth or one-eighth.
فِي قَوْلِهِ ﷻ {يُوصِيكُمُ اللهُ فِي أَوْلَادِكُمْ لِلذَّكَرِ مِثْلُ حَظِّ الْأُنْثَيَيْنِ} [النساء 11] قَالَ كَانَ الْمِيرَاثُ لِلْوَلَدِ وَكَانَتِ الْوَصِيَّةُ لِلْوَالِدَيْنِ فَنَسَخَ اللهُ مِنْ ذَلِكَ مَا أَحَبَّ فَجَعَلَ لِلْوَلَدِ الذَّكَرِ مِثْلَ حَظِّ الْأُنْثَيَيْنِ وَجَعَلَ لِلْوَالِدَيْنِ السُّدُسَيْنِ وَجَعَلَ لِلزَّوْجِ النِّصْفَ أَوِ الرُّبُعَ وَجَعَلَ لِلْمَرْأَةِ الرُّبُعَ أَوِ الثُّمُنَ
[Machine] The man inherits from his wife if she does not leave behind a child or a child of the son half. If she leaves behind a male or female child or a child of the son, her husband inherits a quarter of it, and nothing is deducted from that. The woman inherits from her husband if he does not leave behind a child or a child of the quarter. If he leaves behind a child or a child of the son, his wife inherits an eighth of it.
يَرِثُ الرَّجُلُ مِنِ امْرَأَتِهِ إِذَا هِيَ لَمْ تَتْرُكْ وَلَدًا وَلَا وَلَدَ ابْنٍ النِّصْفَ فَإِنْ تَرَكَتْ وَلَدًا أَوْ وَلَدَ ابْنٍ ذَكَرًا أَوْ أُنْثَى وَرِثَهَا زَوْجُهَا الرُّبُعَ لَا يَنْقُصُ مِنْ ذَلِكَ شَيْءٌ وَتَرِثُ الْمَرْأَةُ مِنْ زَوْجِهَا إِذَا هُوَ لَمْ يَتْرُكْ وَلَدًا وَلَا وَلَدَ ابْنٍ الرُّبُعَ فَإِنْ تَرَكَ وَلَدًا أَوْ وَلَدَ ابْنٍ وَرِثَتْهُ امْرَأَتُهُ الثُّمُنَ
34.17 [Machine] The obligation of the mother
٣٤۔١٧ بَابُ فَرْضِ الْأُمِّ
[Machine] That a man dies and leaves his wife and parents, so his wife will receive a quarter and his mother will receive a third of what is left, which is a quarter of the total wealth. And if a woman dies and leaves her husband and parents, then her husband will receive half and her mother will receive a third of what is left, which is a sixth of the total wealth.
أَنْ يُتَوَفَّى رَجُلٌ وَيَتْرُكَ امْرَأَتَهُ وَأَبَوَيْهِ فَيَكُونَ لِامْرَأَتِهِ الرُّبُعُ وَلِأُمِّهِ الثُّلُثُ مِمَّا بَقِيَ وَهُوَ الرُّبُعُ مِنْ رَأْسِ الْمَالِ وَإِنْ تُتَوَفَّى امْرَأَةٌ وَتَتْرُكْ زَوْجَهَا وَأَبَوَيْهَا فَيَكُونَ لِزَوْجِهَا النِّصْفُ وَلِأُمِّهَا الثُّلُثُ مِمَّا بَقِيَ وَهُوَ السُّدُسُ مِنْ رأْسِ الْمَالِ
[Machine] He used to deprive his mother with two brothers, so they said to him, "O Abu Sa'id, indeed Allah says, 'And if he has brothers [or sisters], for his mother is a sixth [share]' (Quran 4:11) and you are depriving her with two brothers?" He said, "Indeed, the Arabs designate the two brothers as siblings." So they said to him, "O Abu Sa'id, are you deluding us? They are only eight pairs of sheep, two by two, and from goats two by two, and from camels two by two, and from cows two by two." He said, "No, indeed Allah says, 'And (God) made from them a pair, the male and the female' (Quran 75:39), so they are two pairs. Each one of them is a pair, the male says 'pair' and the female says 'pair'."
أَنَّهُ كَانَ يَحْجُبُ الْأُمَّ بِالْأَخَوَيْنِ فَقَالُوا لَهُ يَا أَبَا سَعِيدٍ فَإِنَّ اللهَ يَقُولُ {فَإِنْ كَانَ لَهُ إِخْوَةٌ فَلِأُمِّهِ السُّدُسُ} [النساء 11] وَأَنْتَ تَحْجُبُهَا بِأَخَوَيْنِ؟ فَقَالَ إِنَّ الْعَرَبَ تُسَمِّي الْأَخَوَيْنِ إِخْوَةً فَقَالُوا لَهُ يَا أَبَا سَعِيدٍ أَوَهِمْتَ؛ إِنَّمَا هِيَ ثَمَانِيَةُ أَزْوَاجٍ مِنَ الضَّأْنِ اثْنَيْنِ اثْنَيْنِ وَمِنَ الْمَعْزِ اثْنَيْنِ اثْنَيْنِ وَمِنَ الْإِبِلِ اثْنَيْنِ اثْنَيْنِ وَمِنَ الْبَقَرِ اثْنَيْنِ اثْنَيْنِ فَقَالَ لَا إِنَّ اللهَ يَقُولُ {فَجَعَلَ مِنْهُ الزَّوْجَيْنِ الذَّكَرَ وَالْأُنْثَى} [القيامة 39] فَهُمَا زَوْجَانِ كُلُّ وَاحِدٍ مِنْهُمَا زَوْجٌ يَقُولُ الذَّكَرُ زَوْجٌ وَالْأُنْثَى زَوْجٌ
عَنِ الثُّلُثِ لَهَا سُدُسُهَا
[Machine] "Indeed, if Allah had brothers, then the brothers in the language of your people are not brothers. Uthman said, 'I am unable to respond to what was said before me and what has passed in the lands, and people have inherited it.' It is narrated from Ibn Abbas regarding two fathers and brothers that he said, 'Indeed, brothers prohibited the mother from one third so that they could have two thirds', contrary to the statement of Zaid bin Thabit and others."
اللهُ {فَإِنْ كَانَ لَهُ إِخْوَةٌ} [النساء 11] فَالْأَخَوَانِ بِلِسَانِ قَوْمِكَ لَيْسَا بِإِخْوَةٍ فَقَالَ عُثْمَانُ لَا أَسْتَطِيعُ أَنْ أَرُدَّ مَا كَانَ قَبْلِي وَمَضَى فِي الْأَمْصَارِ وَتَوَارَثَ بِهِ النَّاسُ وَرُوِيَ عَنِ ابْنِ عَبَّاسٍ فِي أَبَوَيْنِ وَإِخْوَةٍ أَنَّهُ قَالَ إِنَّمَا حَجَبَ الْإِخْوَةُ الْأُمَّ مِنَ الثُّلُثِ؛ لِيَكُونَ السُّدُسُ لَهُمْ وَهُوَ بِخِلَافِ قَوْلِ زَيْدِ بْنِ ثَابِتٍ وَغَيْرِهِ
[Machine] The Prophet, may ﷺ , gave them one-sixth. I met some of the children of the man who was given one-sixth for his brothers, and they said that it was a testament for them.
أَنَّ النَّبِيَّ ﷺ أَعْطَاهُمُ السُّدُسَ فَلَقِيتُ بَعْضَ وَلَدِ ذَلِكَ الرَّجُلِ الَّذِي أُعْطِيَ إِخْوَتُهُ السُّدُسَ فَقَالَ بَلَغَنَا أَنَّهَا كَانَتْ وَصِيَّةً لَهُمْ
[Machine] "About Mansour and what he added to it, and what remained is for his father."
عَنْ مَنْصُورٍ وَزَادَ فِيهِ وَمَا بَقِيَ فَلِلْأَبِ
[Machine] When Umar walked on a path, we followed him and found it easy. We learned that he came across a woman and two parents, and he gave the woman a quarter, the mother a third of what was left, and the father two-thirds.
كَانَ عُمَرُ ؓ إِذَا سَلَكَ طَرِيقًا فَاتَّبَعْنَاهُ وَجَدْنَاهُ سَهْلًا وَأَنَّهُ أُتِيَ فِي امْرَأَةٍ وَأَبَوَيْنِ فَأَعْطَى الْمَرْأَةَ الرُّبُعَ وَأَعْطَى الْأُمَّ ثُلُثَ مَا بَقِيَ وَأَعْطَى الْأَبَ سَهْمَيْنِ
[Machine] That he divided it into four shares: one share for the woman, a third of what remains for the mother, and the father gets what remains.
أَنَّهُ جَعَلَهَا مِنْ أَرْبَعَةِ أَسْهُمٍ لِلْمَرْأَةِ الرُّبُعُ سَهْمٌ وَلِلْأُمِّ ثُلُثُ مَا بَقِيَ سَهْمٌ وَلِلْأَبِ مَا بَقِيَ
[Machine] The literal translation of the passage is: "Son of Abu Talib and son of Abbas, contrary to that."
بْنِ أَبِي طَالِبٍ وَابْنِ عَبَّاسٍ ؓ بِخِلَافِ ذَلِكَ
[Machine] "For the husband, he gets half. For the mother, she gets a third. And for the father, he gets a sixth. This ruling is attributed to al-Hasan ibn 'Umarah and has been narrated from another source with a disconnected chain."
لِلزَّوْجِ النِّصْفُ وَلِلْأُمِّ الثُّلُثُ وَلِلْأَبِ السُّدُسُ الْحَسَنُ بْنُ عُمَارَةَ مَتْرُوكٌ وَرُوِيَ مِنْ وَجْهٍ آخَرَ مُنْقَطِعٍ
[Machine] About Umar and Abdullah concerning a woman and two parents of the mother, one-third of what remains (i.e. the inheritance) he said. And Ali ibn Abi Talib said, "She has one-third of all the wealth."
عَنْ عُمَرَ وَعَبْدِ اللهِ فِي امْرَأَةٍ وَأَبَوَيْنِ لِلْأُمِّ ثُلُثُ مَا بَقِيَ قَالَ وَقَالَ عَلِيُّ بْنُ أَبِي طَالِبٍ ؓ لَهَا الثُّلُثُ مِنْ جَمِيعِ الْمَالِ
[Machine] Zaid gets half (of the inheritance), the mother gets a third of what remains, and the father gets the rest of the money. Ibn Abbas said to the mother, "The third is complete," the wording of the hadith of Yazid bin Harun and in another narration, Ruwah said, "And the mother gets a third of what remains, which is the sixth." So Ibn Abbas sent to him (Yazid), "Do you find this in the book of Allah?" He said, "No, but I dislike favoring the mother over the father." Ibn Abbas said, "I used to give the mother a third of all the money." And Abu Abdullah and Abu Saeed narrated to us, they both said, Abu al-Abbas narrated to us, Yahya informed us, from Yazid bin Harun, from Shurayk bin Abdullah, from Abdur Rahman al-Asbahani, from Ikrimah, he said, "So I came to Ibn Abbas and informed him." He said, "Then go back to him and say, 'Is it your father's book, or your opinion?'" I said, "By your opinion?" He said, "Then I went to him and he said, 'By my opinion.'" So I returned to Ibn Abbas and informed him. Ibn Abbas said, "And I say, by my opinion, the mother gets the third, complete." And Abu Abdullah narrated to us, Abu al-Abbas narrated to us, Yahya informed us, from Yazid, from Sufyan al-Thawri, from a man, from Fudayl, from Ibrahim, who said, "Ibn Abbas differed from the people in this matter."
زَيْدٌ لِلزَّوْجِ النِّصْفُ وَلِلْأُمِّ ثُلُثُ مَا بَقِيَ وَلِلْأَبِ بَقِيَّةُ الْمَالِ فَقَالَ ابْنُ عَبَّاسٍ لِلْأُمِّ الثُّلُثُ كَامِلًا لَفْظُ حَدِيثِ يَزِيدَ بْنِ هَارُونَ وَفِي رِوَايَةِ رَوْحٍ وَلِلْأُمِّ ثُلُثُ مَا بَقِيَ وَهُوَ السُّدُسُ فَأَرْسَلَ إِلَيْهِ ابْنُ عَبَّاسٍ أَفِي كِتَابِ اللهِ تَجِدُ هَذَا؟ قَالَ لَا وَلَكِنْ أَكْرَهُ أَنْ أُفَضِّلَ أُمًّا عَلَى أَبٍ قَالَ وَكَانَ ابْنُ عَبَّاسٍ يُعْطِي الْأُمَّ الثُّلُثَ مِنْ جَمِيعِ الْمَالِ 12306 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ وَأَبُو سَعِيدٍ قَالَا ثنا أَبُو الْعَبَّاسِ ثنا يَحْيَى أنا يَزِيدُ بْنُ هَارُونَ أنا شَرِيكُ بْنُ عَبْدِ اللهِ عَنْ عَبْدِ الرَّحْمَنِ الْأَصْبَهَانِيِّ عَنْ عِكْرِمَةَ بِمِثْلِهِ قَالَ فَأَتَيْتُ ابْنَ عَبَّاسٍ فَأَخْبَرْتُهُ قَالَ فَقَالَ ارْجِعْ إِلَيْهِ فَقُلْ لَهُ أَبِكِتَابِ اللهِ قُلْتَ أَمْ بِرَأْيِكَ؟ قَالَ فَأَتَيْتُهُ فَقَالَ بِرَأْيِي فَرَجَعْتُ إِلَى ابْنِ عَبَّاسٍ فَأَخْبَرْتُهُ فَقَالَ ابْنُ عَبَّاسٍ وَأَنَا أَقُولُ بِرَأْيِي لِلْأُمِّ الثُّلُثُ كَامِلًا 12307 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ ثنا أَبُو الْعَبَّاسِ ثنا يَحْيَى أنا يَزِيدُ أنا سُفْيَانُ الثَّوْرِيُّ عَنْ رَجُلٍ عَنْ فُضَيْلٍ عَنْ إِبْرَاهِيمَ قَالَ خَالَفَ ابْنُ عَبَّاسٍ فِيهَا النَّاسَ
[Machine] Ibn Abbas disagreed with all the people of prayer regarding marriage and parents.
خَالَفَ ابْنُ عَبَّاسٍ جَمِيعَ أَهْلِ الصَّلَاةِ فِي زَوْجٍ وَأَبَوَيْنِ
[Machine] Zaid divided it into four shares for the woman: one share for her, one-third for the mother, and the remainder for the father.
قَسَمَهَا زَيْدٌ مِنْ أَرْبَعَةِ أَسْهُمٍ لِلْمَرْأَةِ سَهْمٌ وَلِلْأُمِّ ثُلُثُ مَا بَقِيَ وَلِلْأَبِ بَقِيَّةُ الْمَالِ
Abu Musa was asked regarding (the inheritance of) a daughter, a son's daughter, and a sister. He said, "The daughter will take one-half and the sister will take one-half. If you go to Ibn Masʿud, he will tell you the same." Ibn Masʿud was asked and was told of Abu Musa's verdict. Ibn Masʿud then said, "If I give the same verdict, I would stray and would not be of the rightly-guided. The verdict I will give in this case, will be the same as the Prophet ﷺ did, i.e. one-half is for daughter, and one-sixth for the son's daughter, i.e. both shares make two-thirds of the total property; and the rest is for the sister." Afterwards we cams to Abu Musa and informed him of Ibn Masʿud's verdict, whereupon he said, "So, do not ask me for verdicts, as long as this learned man is among you." لَقَدْ ضَلَلْتُ إِذًا وَمَا أَنَا مِنَ الْمُهْتَدِينَ أَقْضِي فِيهَا بِمَا قَضَى رَسُولُ اللهِ ﷺ لِلِابْنَةِ النِّصْفُ وَلِابْنَةِ الِابْنِ السُّدُسُ تَكْمِلَةً لِلْثُلُثَيْنِ وَمَا بَقِيَ فَلِلْأُخْتِ قَالَ فَأَتَيْنَا أَبَا مُوسَى الْأَشْعَرِيَّ فَأَخْبَرْنَاهُ بِقَوْلِ ابْنِ مَسْعُودٍ فَقَالَ لَا تَسْأَلُونِي عَنْ شَيْءٍ مَا دَامَ هَذَا الْحَبْرُ فِيكُمْ
34.18 [Machine] The obligation of the two daughters, continuously.
٣٤۔١٨ بَابُ فَرْضِ الِابْنَتَيْنِ فَصَاعِدًا
[Machine] We went out with the Messenger of Allah ﷺ until we came to a woman from the Ansar, who was the grandmother of Kharijah bin Zaid bin Thabit. So she mentioned the story and said, "O Messenger of Allah, these are the daughters of Thabit bin Qais bin Shammas who were killed with you on the Day of Uhud. Their uncle has distributed all their wealth and inheritance, leaving nothing except what he has taken. So what do you think, O Messenger of Allah?" The Messenger of Allah ﷺ said, "Allah will decide in this matter." Then Surah An-Nisa' (Chapter 4), verse 11 was revealed, where Allah says: "Allah instructs you concerning your children". So the Messenger of Allah ﷺ said, "Call the woman and her companion." Then he said to their uncle, "Give them two-thirds (of the inheritance) and give their mother one-eighth. What remains is yours." The phrase "distributed all their wealth and inheritance" means that he had divided their wealth among themselves, taking their rights from the inheritance, and the original meaning of the word "return" is that he should return their rights to them and give them their rightful share of the inheritance. As for the statement "Thabit bin Qais", it is a mistake, it should be "Sa'd bin Ar-Rabi". This was narrated to me by Abu Ali Ar-Ruwdhbari, I am Muhammad bin Bakr, narrated to me Abu Dawud, narrated to me Ibn As-Sarh, narrated to me Ibn Wahb, who told me Dawud bin Qais and others from the people of knowledge, from Abdullah bin Muhammad bin Aqil, from Jabir, that the wife of Sa'd bin Ar-Rabi said, "O Messenger of Allah, Sa'd has died and he has left behind two daughters." He said, "Tell the story." Abu Dawud said, "This is the correct version."
خَرَجْنَا مَعَ رَسُولِ اللهِ ﷺ حَتَّى جِئْنَا امْرَأَةً مِنَ الْأَنْصَارِ فِي الْأَسْوَافِ وَهِيَ جَدَّةُ خَارِجَةَ بْنِ زَيْدِ بْنِ ثَابِتٍ فَذَكَرَ الْحَدِيثَ قَالَ فَجَاءَتِ الْمَرْأَةُ بِابْنَتَيْنِ لَهَا فَقَالَتْ يَا رَسُولَ اللهِ هَاتَانِ ابْنَتَا ثَابِتِ بْنِ قَيْسِ بْنِ شَمَّاسٍ قُتِلَ مَعَكَ يَوْمَ أُحُدٍ وَقَدِ اسْتَفَاءَ عَمُّهُمَا مَالَهُمَا وَمِيرَاثَهُمَا كُلَّهُ فَلَمْ يَدَعْ مَالًا إِلَّا أَخَذَ فَمَا تَرَى يَا رَسُولَ اللهِ؟ فَوَاللهِ لَا تُنْكَحَانِ أَبَدًا إِلَّا وَلَهُمَا مَالٌ فَقَالَ رَسُولُ اللهِ ﷺ يَقْضِي اللهُ ﷻ فِي ذَلِكَ فَنَزَلَتْ سُورَةُ النِّسَاءِ {يُوصِيكُمُ اللهُ فِي أَوْلَادِكُمْ} [النساء 11] الْآيَةَ فَقَالَ رَسُولُ اللهِ ﷺ ادْعُ لِيَ الْمَرْأَةَ وَصَاحِبَهَا فَقَالَ لِعَمِّهِمَا أَعْطِهِمَا الثُّلُثَيْنِ وَأَعْطِ أُمَّهُمَا الثُّمُنَ وَمَا بَقِيَ فَلَكَ قَوْلُهُ اسْتَفَاءَ مَالَهُمَا مَعْنَاهُ اسْتَرَدَّ وَاسْتَرْجَعَ حَقَّهُمَا مِنَ الْمِيرَاثِ وَأَصْلُهُ مِنَ الْفَيْءِ وَهُوَ الرُّجُوعُ قَوْلُهُ ثَابِتُ بْنُ قَيْسٍ خَطَأٌ إِنَّمَا هُوَ سَعْدُ بْنُ الرَّبِيعِ 12312 أَخْبَرَنَاهُ أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنا مُحَمَّدُ بْنُ بَكْرٍ ثنا أَبُو دَاوُدَ ثنا ابْنُ السَّرْحِ ثنا ابْنُ وَهْبٍ أَخْبَرَنِي دَاوُدُ بْنُ قَيْسٍ وَغَيْرُهُ مِنْ أَهْلِ الْعِلْمِ عَنْ عَبْدِ اللهِ بْنِ مُحَمَّدِ بْنِ عَقِيلٍ عَنْ جَابِرٍ أَنَّ امْرَأَةَ سَعْدِ بْنِ الرَّبِيعِ قَالَتْ يَا رَسُولَ اللهِ إِنَّ سَعْدًا هَلَكَ وَتَرَكَ ابْنَتَيْنِ قَالَ وَسَاقَ الْحَدِيثَ قَالَ أَبُو دَاوُدَ هَذَا هُوَ الصَّوَابُ
34.19 [Machine] Inheritance of the Son's Children.
٣٤۔١٩ بَابُ مِيرَاثِ أَوْلَادِ الِابْنِ
[Machine] "When a man or a woman dies and leaves behind one daughter, she is entitled to half of the inheritance. But if there are two or more daughters, they are entitled to two-thirds. However, if there is a son among them, then none of them are entitled to a fixed share, and the division starts by giving the son his fixed share. Whatever is left after that is distributed among them. The son will have a share equal to that of two daughters. The position of the grandchildren is similar to the position of their parents if they do not have any children themselves. They inherit and are protected just like their parents. If the son and the son of the son both exist, then the son's son does not inherit anything from the son's portion. Unless the son's daughters also have a son, in which case that grandson will have a share equal to that of the son's daughters. If there is no wealth left except for a single daughter, then the granddaughter and other granddaughters share equally in one-sixth after the two-thirds have been distributed. If the grandson of the son also exists, he does not have a share or a fixed portion. However, if there is any surplus remaining after the distribution of the fixed portion to the heirs, it will be given to the heirs according to their respective positions, with the male heirs being given a share equal to that of two females. And whoever has a more distant relationship to the deceased has no share. If there is no surplus, then there is no share for them."
أَنَّهُ إِذَا تُوُفِّيَ رَجُلٌ أَوِ امْرَأَةٌ فَتَرَكَ ابْنَةً وَاحِدَةً فَلَهَا النِّصْفُ فَإِنْ كَانَتَا اثْنَتَيْنِ فَمَا فَوْقَ ذَلِكَ مِنَ الْإِنَاثِ كَانَ لَهُنَّ الثُّلُثَانِ فَإِنْ كَانَ مَعَهُنَّ ذَكَرٌ فَإِنَّهُ لَا فَرِيضَةَ لِأَحَدٍ مِنْهُمْ وَيُبْدَأُ بِأَحَدٍ إِنْ شَرَكَهُمْ بِفَرِيضَةٍ فَيُعْطَى فَرِيضَتَهُ فَمَا بَقِيَ بَعْدَ ذَلِكَ فَهُوَ بَيْنَهُمْ {لِلذَّكَرِ مِثْلُ حَظِّ الْأُنْثَيَيْنِ} [النساء 11] قَالَ وَمَنْزِلَةُ وَلَدِ الْأَبْنَاءِ إِذَا لَمْ يَكُنْ دُونَهُمْ وَلَدٌ كَمَنْزِلَةِ الْوَلَدِ سَوَاءٌ ذَكَرُهُمْ كَذَكَرِهِمْ وَأُنْثَاهُمْ كَأُنْثَاهُمْ يَرِثُونَ كَمَا يَرِثُونَ وَيَحْجُبُونَ كَمَا يَحْجُبُونَ فَإِنِ اجْتَمَعَ الْوَلَدُ وَوَلَدُ الِابْنِ فَكَانَ فِي الْوَلَدِ ذَكَرٌ فَإِنَّهُ لَا مِيرَاثَ مَعَهُ لِأَحَدٍ مِنْ وَلَدِ الِابْنِ وَإِنْ لَمْ يَكُنِ الْوَلَدُ ذَكَرًا وَكَانَتَا اثْنَتَيْنِ فَأَكْثَرَ مِنَ الْبَنَاتِ فَإِنَّهُ لَا مِيرَاثَ لِبَنَاتِ الِابْنِ مَعَهُنَّ إِلَّا أَنْ يَكُونَ مَعَ بَنَاتِ الِابْنِ ذَكَرٌ هُوَ مِنَ الْمُتَوَفَّى بِمَنْزِلَتِهِنَّ أَوْ هُوَ أَطْرَفُ مِنْهُنَّ فَيَرُدُّ عَلَى مَنْ بِمَنْزِلَتِهِ وَمَنْ فَوْقَهُ مِنْ بَنَاتِ الْأَبْنَاءِ فَضْلًا إِنْ فَضَلَ فَيُقَسِّمُونَهُ {لِلذَّكَرِ مِثْلُ حَظِّ الْأُنْثَيَيْنِ} [النساء 11] فَإِنْ لَمْ يَفْضُلْ شَيْءٌ فَلَا شَيْءَ لَهُمْ وَإِنْ لَمْ يَكُنِ الْوَلَدُ إِلَّا ابْنَةً وَاحِدَةً فَتَرَكَ ابْنَةَ ابْنٍ فَأَكْثَرَ مِنْ ذَلِكَ مِنْ بَنَاتِ الِابْنِ بِمَنْزِلَةٍ وَاحِدَةٍ فَلَهُنَّ السُّدُسُ تَتِمَّةَ الثُّلُثَيْنِ فَإِنْ كَانَ مَعَ بَنَاتِ الِابْنِ ذَكَرٌ هُوَ بِمَنْزِلَتِهِنَّ فَلَا سُدُسَ لَهُنَّ وَلَا فَرِيضَةَ وَلَكِنْ إِنْ فَضَلَ فَضْلٌ بَعْدَ فَرِيضَةِ أَهْلِ الْفَرَائِضِ كَانَ ذَلِكَ الْفَضْلُ لِذَلِكَ الذَّكَرِ وَلِمَنْ بِمَنْزِلَتِهِ مِنَ الْإِنَاثِ {لِلذَّكَرِ مِثْلُ حَظِّ الْأُنْثَيَيْنِ} [النساء 11] وَلَيْسَ لِمَنْ هُوَ أَطْرَفُ مِنْهُنَّ شَيْءٌ فَإِنْ لَمْ يَفْضُلْ شَيْءٌ فَلَا شَيْءَ لَهُنَّ
[Machine] She (referring to a specific person) participated among the daughters of the son and the sons of the son and among the brothers and sisters of the father in what remained, meaning [for the male, an amount equivalent to the share of two females] [Quran - Surah An-Nisa, verse 11]. He (referring to another person) said, "And Abdullah did not divide between them," meaning he allocated what remained for the male without considering the females.
أَنَّهَا أَشْرَكَتْ بَيْنَ بَنَاتِ الِابْنِ وَبَنِي الِابْنِ وَبَيْنَ الْإِخْوَةِ والْأَخَوَاتِ لِلْأَبِ فِيمَا بَقِيَ يَعْنِي {لِلذَّكَرِ مِثْلُ حَظِّ الْأُنْثَيَيْنِ} [النساء 11] قَالَ وَكَانَ عَبْدُ اللهِ لَا يُشْرِكُ بَيْنَهُمْ يَعْنِي يَجْعَلُ مَا بَقِيَ لِلذَّكَرِ دُونَ الْإِنَاثِ
[Machine] Did anyone leave a greater impact on you than Abdullah? He replied, "No, but when I arrived in the city, I saw Zaid bin Thabit and the people of the city disputing among themselves about a man who left sisters from a father and mother, and brothers and sisters from a father, and he left daughters and granddaughters."
لَهُ عَلْقَمَةُ أَكَانَ أَحَدٌ أَثْبَتَ عِنْدَكَ مِنْ عَبْدِ اللهِ؟ قَالَ لَا وَلَكِنِّي قَدِمْتُ الْمَدِينَةَ فَرَأَيْتُ زَيْدَ بْنَ ثَابِتٍ وَأَهْلَ الْمَدِينَةِ يُشْرِكُونَ بَيْنَهُمْ فِي رَجُلٍ تَرَكَ أَخَوَاتٍ لِأَبٍ وَأُمٍّ وَإِخْوَةً وَأَخَوَاتٍ لِأَبٍ وَتَرَكَ بَنَاتٍ وَبَنَاتِ ابْنٍ وَبَنِي ابْنٍ
[Machine] Because it did not increase the share of daughters beyond two-thirds, a daughter and the daughter of a son and the daughter of a son, in the statement of Ali and Zaid for the daughter is half and what remains is for the son of the son and the daughters of the son {for the male, is the share equal to that of two females} [An-Nisa 11] and in the statement of Abdullah for the daughter, the share is half and the remaining is for the son of the son.
لِأَنَّهُ لَمْ يَكُنْ يَزِيدُ الْبَنَاتِ عَلَى الثُّلُثَيْنِ ابْنَةٌ وَابْنَةُ ابْنٍ وَابْنُ ابْنٍ فِي قَوْلِ عَلِيٍّ وَزَيْدٍ لِلِابْنَةِ النِّصْفُ وَمَا بَقِيَ فَلِابْنِ الِابْنِ وَلِبَنَاتِ الِابْنِ {لِلذَّكَرِ مِثْلُ حَظِّ الْأُنْثَيَيْنِ} [النساء 11] وَفِي قَوْلِ عَبْدِ اللهِ لِلِابْنَةِ النِّصْفُ وَلِبَنَاتِ الِابْنِ تَكْمِلَةُ الثُّلُثَيْنِ وَمَا بَقِيَ فَلِابْنِ الِابْنِ
34.20 [Machine] The obligation of the son's daughter with the stepdaughter does not include a male.
٣٤۔٢٠ بَابُ فَرْضِ ابْنَةِ الِابْنِ مَعَ ابْنَةِ الصُّلْبِ لَيْسَ مَعَهُمَا ذَكَرٌ
[Machine] "I have gone astray, and I am not among the guided ones. However, I will follow it as the Messenger of Allah ﷺ has ruled for the daughter, half for the son's daughter, two-thirds completion for two-thirds, and for the sister, what remains of the narration of Abu Abdullah, and in the narration of Janaah, according to what the Prophet ﷺ has ruled."
{قَدْ ضَلَلْتُ} إِذًا وَمَا أَنَا مِنَ الْمُهْتَدِينَ وَلَكِنْ أَقْضِي فِيهَا كَمَا قَضَى رَسُولُ اللهِ ﷺ لِلِابْنَةِ النِّصْفُ وَلِابْنَةِ الِابْنِ السُّدُسُ تَكْمِلَةَ الثُّلُثَيْنِ وَلِلْأُخْتِ مَا بَقِيَ لَفْظُ حَدِيثِ أَبِي عَبْدِ اللهِ وَفِي رِوَايَةِ جَنَاحٍ بِمَا قَضَى النَّبِيُّ ﷺ
34.21 [Machine] Who does not inherit the nephew with the grandfather anything
٣٤۔٢١ بَابُ مَنْ لَمْ يُوَرِّثِ ابْنَ الْأَخِ مَعَ الْجَدِّ شَيْئًا
[Machine] Ali and Abdullah ibn Mas'ud did not inherit the son of the brother along with the grandfather.
أَنَّ عَلِيًّا وَعَبْدَ اللهِ بْنَ مَسْعُودٍ كَانَا لَا يُوَرِّثَانِ ابْنَ الْأَخِ مَعَ الْجَدِّ
[Machine] No one among the people has inherited a brother from a mother or a son of a brother with any share.
مَا وَرَّثَ أَحَدٌ مِنَ النَّاسِ أَخًا لِأُمٍّ وَلَا ابْنَ أَخٍ مَعَ جَدٍّ شَيْئًا
[Machine] Ali used to give the brothers of his wife the same status as their biological fathers, and none of the companions of the Prophet ﷺ did this except for him.
أَنَّ عَلِيًّا ؓ كَانَ يُنْزِلُ بَنِي الْأَخِ مَعَ الْجَدِّ مَنَازِلَ آبَائِهِمْ وَلَمْ يَكُنْ أَحَدٌ مِنْ أَصْحَابِ النَّبِيِّ ﷺ يَفْعَلُهُ غَيْرَهُ
34.22 [Machine] The Obligation of Inheritance for Mothers
٣٤۔٢٢ بَابُ فَرْضِ الْإِخْوَةِ وَالْأَخَوَاتِ لِلْأُمِّ قَالَ اللهُ تَبَارَكَ وَتَعَالَى {وَإِنْ كَانَ رَجُلٌ يُورَثُ كَلَالَةً أَوِ امْرَأَةٌ وَلَهُ أَخٌ أَوْ أُخْتٌ فَلِكُلِّ وَاحِدٍ مِنْهُمَا السُّدُسُ فَإِنْ كَانُوا أَكْثَرَ مِنْ ذَلِكَ فَهُمْ شُرَكَاءُ فِي الثُّلُثِ} [النساء: 12]
[Machine] That Saad used to recite it, even if he was a man who inherited from a lineage or a woman, and he has a brother or sister from the mother.
أَنَّ سَعْدًا كَانَ يَقْرَؤُهَا وَإِنْ كَانَ رَجُلٌ يُورَثُ كَلَالَةً أَوِ امْرَأَةٌ وَلَهُ أَخٌ أَوْ أُخْتٌ مِنْ أُمٍّ
[Machine] In his sermon, he mentioned that indeed, these verses in the beginning of Surah An-Nisa explain the rights and duties that Allah has sent down concerning children and parents. And the second verse from Surah An-Nisa explains the rights and duties that Allah has sent down concerning spouses and siblings from the mother's side. And the verse that concludes Surah An-Nisa explains the rights and duties that Allah has sent down concerning siblings from the mother and father.
فِي خُطْبَتِهِ أَلَا إِنَّ هَذِهِ الْآيَةَ الَّتِي فِي أَوَّلِ سُورَةِ النِّسَاءِ فِي بَيَانِ الْفَرَائِضِ أَنْزَلَهَا اللهُ فِي الْوَلَدِ وَالْوَالِدِ وَالْآيَةَ الثَّانِيَةَ مِنْ سُورَةِ النِّسَاءِ أَنْزَلَهَا اللهُ فِي الزَّوْجِ وَالزَّوْجَةِ وَالْإِخْوَةِ مِنَ الْأُمِّ وَالْآيَةَ الَّتِي خَتَمَ بِهَا سُورَةَ النِّسَاءِ أَنْزَلَهَا اللهُ فِي الْإِخْوَةِ مِنَ الْأُمِّ وَالْأَبِ
[Machine] And the inheritance of brothers to the mother is that they do not inherit along with the child, nor with the son of the son, whether male or female, nor with the father, nor with the grandfather, the father's father, anything else. And they are obliged to give the sixth to one of them, whether male or female, in everything other than that. If they are two or more, males or females, they are obliged to share equally the third.
وَمِيرَاثُ الْإِخْوَةِ لِلْأُمِّ أَنَّهُمْ لَا يَرِثُونَ مَعَ الْوَلَدِ وَلَا مَعَ وَلَدِ الِابْنِ ذَكَرًا كَانَ أَوْ أُنْثَى شَيْئًا وَلَا مَعَ الْأَبِ وَلَا مَعَ الْجَدِّ أَبِي الْأَبِ شَيْئًا وَهُمْ فِي كُلِّ مَا سِوَى ذَلِكَ يُفْرَضُ لِلْوَاحِدِ مِنْهُمُ السُّدُسَ ذَكَرًا كَانَ أَوْ أُنْثَى فَإِنْ كَانُوا اثْنَيْنِ فَصَاعِدًا ذُكُورًا أَوْ إِنَاثًا فُرِضَ لَهُمُ الثُّلُثُ يَقْتَسِمُونَهُ بِالسَّوَاءِ
34.23 [Machine] The obligation of inheritance for parents with one or two daughters God, may He be glorified and exalted, said { They request from you a [legal] ruling. Say, " Allah gives you a ruling concerning one having neither descendants nor ascendants [as heirs]." If a man dies, leaving no child but [only] a sister, she will have half of what he left. And he inherits from her if she [dies and] has no child. But if there are two sisters [or more], they will have two-thirds of what he left.} [Surah An-Nisa: 176]
٣٤۔٢٣ بَابُ فَرْضِ الْأُخْتِ وَالْأُخْتَيْنِ فَصَاعِدًا لِأَبٍ وَأُمٍّ أَوْ لِأَبٍ قَالَ اللهُ تَبَارَكَ وَتَعَالَى {يَسْتَفْتُونَكَ قُلِ اللهُ يُفْتِيكُمْ فِي الْكَلَالَةِ إنِ امْرُؤٌ هَلَكَ لَيْسَ لَهُ -[380]- وَلَدٌ وَلَهُ أُخْتٌ فَلَهَا نِصْفُ مَا تَرَكَ وَهُوَ يَرِثُهَا إِنْ لَمْ يَكُنْ لَهَا وَلَدٌ فَإِنْ كَانَتَا اثْنَتَيْنِ فَلَهُمَا الثُّلُثَانِ مِمَّا تَرَكَ} [النساء: 176]
[Machine] I complained, and I have seven sisters. The Messenger of Allah ﷺ entered upon me and splashed water on my face. I woke up and said, "O Messenger of Allah, should I give two-thirds to my sisters?" He said, "That is good." I said, "What about half?" He said, "That is good." Then the Messenger of Allah ﷺ left and returned, and he said, "O Jabir, I only see you as either dead or close to death from this pain, while Allah has revealed concerning your sisters, so make it clear." So, he gave them two-thirds. Jabir used to say, "These verses were revealed about me, 'They ask you for legal instruction. Say, "Allah instructs you concerning one having neither descendants nor ascendants."' [Quran 4:176] until the end of the narration of Wahb bin Jarir and the summarized narration of At-Tayalisi and it is narrated by Kathir bin Hisham from Hisham similar to the narration of Wahb except that he said, 'O Jabir, I do not see you as dead from this pain of yours.'"
اشْتَكَيْتُ وَعِنْدِي سَبْعُ أَخَوَاتٍ لِي فَدَخَلَ عَلَيَّ رَسُولُ اللهِ ﷺ فَنَضَحَ فِي وَجْهِي فَأَفَقْتُ فَقُلْتُ يَا رَسُولَ اللهِ أُوصِي لِأَخَوَاتِي بِالثُّلُثَيْنِ؟ فَقَالَ أَحْسِنْ فَقُلْتُ بِالشَّطْرِ؟ قَالَ أَحْسِنْ ثُمَّ خَرَجَ رَسُولُ اللهِ ﷺ ثُمَّ رَجَعَ فَقَالَ يَا جَابِرُ مَا أُرَاكَ إِلَّا مَيِّتًا أَوْ قَالَ مَا أُرَاكَ مَيِّتًا مِنْ هَذَا الْوَجَعِ وَقَدْ أَنْزَلَ اللهُ فِي أَخَوَاتِكَ فَبَيَّنَ فَجَعَلَ لَهُنَّ الثُّلُثَيْنِ فَكَانَ جَابِرٌ يَقُولُ نَزَلَتْ هَؤُلَاءِ الْآيَاتُ فِيَّ {يَسْتَفْتُونَكَ قُلِ اللهُ يُفْتِيكُمْ فِي الْكَلَالَةِ} [النساء 176] إِلَى آخِرِهَا لَفْظُ حَدِيثِ وَهْبِ بْنِ جَرِيرٍ وَحَدِيثُ الطَّيَالِسِيِّ مُخْتَصَرٌ وَرَوَاهُ كَثِيرُ بْنُ هِشَامٍ عَنْ هِشَامٍ نَحْوَ رِوَايَةِ وَهْبٍ إِلَّا أَنَّهُ قَالَ فَقَالَ يَا جَابِرُ لَا أُرَاكَ مَيِّتًا مِنْ وَجَعِكَ هَذَا
34.24 [Machine] Inheritance of brothers and sisters to a father and mother or to a father
٣٤۔٢٤ بَابُ مِيرَاثِ الْإِخْوَةِ وَالْأَخَوَاتِ لِأَبٍ وَأُمٍّ أَوْ لِأَبٍ
[Machine] And the inheritance of brothers, if there is no one among the children of the mother and father, is like the inheritance of brothers from the same parents, both males and females. Except that they do not share with the children of the mother in this obligation, which the children of the father and mother share. So, if the brothers from the mother and father come together, there will be male heirs from the father and mother, and there will be no inheritance with them for any of the brothers from the father. And if the children of the mother and father are only one woman, and the children of the father are one woman or more than that of females, there is no male in them. Then, it is obligatory to give half to the sister from the father and mother, and it is obligatory to give one-sixth to the daughters of the father, to complete the two-thirds. If there is a male brother from the father, there is no obligation for them, and the distribution starts with the heirs, and they are given their obligations. If there is anything remaining after that, it is considered a favor between the children of the father, like the share of two females. If there is nothing remaining, they receive nothing. If the children of the mother and father are two women or more than that of females, then two-thirds are obligatory for them, and there is no inheritance with them for the daughters of the father except if there is a male with them from the father. If there is a male with them, the distribution starts with the obligations of those who have an obligation, and they are given their obligations. If there is anything remaining after that, it is considered a favor between the children of the father, like the share of two females. If there is nothing remaining, they receive nothing.
وَمِيرَاثُ الْإِخْوَةِ مِنَ الْأَبِ إِذَا لَمْ يَكُنْ مَعَهُمْ أَحَدٌ مِنْ بَنِي الْأُمِّ وَالْأَبِ كَمِيرَاثِ الْإِخْوَةِ لِلْأَبِ وَالْأُمِّ سَوَاءٌ ذَكَرُهُمْ كَذَكَرِهِمْ وَأُنْثَاهُمْ كَأُنْثَاهُمْ إِلَّا أَنَّهُمْ لَا يَشْتَرِكُونَ مَعَ بَنِي الْأُمِّ فِي هَذِهِ الْفَرِيضَةِ الَّتِي شَرَكَهُمْ بَنُو الْأَبِ وَالْأُمِّ فَإِذَا اجْتَمَعَ الْإِخْوَةُ مِنَ الْأُمِّ وَالْأَبِ وَالْإِخْوَةُ مِنَ الْأَبِ فَكَانَ فِي بَنِي الْأَبِ وَالْأُمِّ ذَكَرٌ فَلَا مِيرَاثَ مَعَهُ لِأَحَدٍ مِنَ الْإِخْوَةِ لِلْأَبِ وَإِنْ لَمْ يَكُنْ بَنُو الْأُمِّ وَالْأَبِ إِلَّا امْرَأَةً وَاحِدَةً وَكَانَ بَنُو الْأَبِ امْرَأَةً وَاحِدَةً أَوْ أَكْثَرَ مِنْ ذَلِكَ مِنَ الْإِنَاثِ لَا ذَكَرَ فِيهِنَّ فَإِنَّهُ يُفْرَضُ لِلْأُخْتِ مِنَ الْأَبِ وَالْأُمِّ النِّصْفُ وَيُفْرَضُ لِبَنَاتِ الْأَبِ السُّدُسُ تَتِمَّةَ الثُّلُثَيْنِ فَإِنْ كَانَ مَعَ بَنَاتِ الْأَبِ أَخٌ ذَكَرٌ فَلَا فَرِيضَةَ لَهُمْ وَيُبْدَأُ بِأَهْلِ الْفَرَائِضِ فَيُعْطَوْنَ فَرَائِضَهُمْ فَإِنْ فَضَلَ بَعْدَ ذَلِكَ فَضْلٌ كَانَ بَيْنَ بَنِي الْأَبِ {لِلذَّكَرِ مِثْلُ حَظِّ الْأُنْثَيَيْنِ} [النساء 11] فَإِنْ لَمْ يَفْضُلْ شَيْءٌ فَلَا شَيْءَ لَهُمْ فَإِنْ كَانَ بَنُو الْأُمِّ وَالْأَبِ امْرَأَتَيْنِ فَأَكْثَرَ مِنْ ذَلِكَ مِنَ الْإِنَاثِ فَيُفْرَضُ لَهُنَّ الثُّلُثَانِ وَلَا مِيرَاثَ مَعَهُنَّ لِبَنَاتِ الْأَبِ إِلَّا أَنْ يَكُونَ مَعَهُنَّ ذَكَرٌ مِنْ أَبٍ فَإِنْ كَانَ مَعَهُنَّ ذَكَرٌ بُدِئَ بِفَرَائِضِ مَنْ كَانَتْ لَهُ فَرِيضَةٌ فَأُعْطُوهَا فَإِنْ فَضَلَ بَعْدَ ذَلِكَ فَضْلٌ كَانَ بَيْنَ بَنِي الْأَبِ لِلذَّكَرِ مِثْلُ حَظِّ الْأُنْثَيَيْنِ فَإِنْ لَمْ يَفْضُلْ شَيْءٌ فَلَا شَيْءَ لَهُمْ
[Machine] And about Ibrahim and Ash-Sha'bi, a sister to a father and mother and a brother and sisters to a father, in the saying of Ali and Zaid for the sister from the father and mother is half, and what remains for the sisters and the brother from the father is "for the male, a portion equal to that of two females" [An-Nisa 11]. And in the saying of Abdullah for the sister from the father and mother, half, and for the sisters from the father, two-thirds, and what remains for the brother from the father is two sisters to a father and mother and a brother and sister to a father, in the saying of Ali and Zaid for the two sisters from the father and mother, two-thirds, and what remains between the sister and the brother is "for the male, a portion equal to that of two females" [An-Nisa 11]. And in the saying of Abdullah for the two sisters from the father and mother, two-thirds, and what remains for the male is less than the female; because he did not intend to give the sisters more than two-thirds.
وَعَنْ إِبْرَاهِيمَ وَالشَّعْبِيِّ أُخْتٌ لِأَبٍ وَأُمٍّ وَأَخٌ وَأَخَوَاتٌ لِأَبٍ فِي قَوْلِ عَلِيٍّ وَزَيْدٍ لِلْأُخْتِ مِنَ الْأَبِ وَالْأُمِّ النِّصْفُ وَمَا بَقِيَ لِلْأَخَوَاتِ وَالْأَخِ مِنَ الْأَبِ {لِلذَّكَرِ مِثْلُ حَظِّ الْأُنْثَيَيْنِ} [النساء 11] وَفِي قَوْلِ عَبْدِ اللهِ لِلْأُخْتِ مِنَ الْأَبِ وَالْأُمِّ النِّصْفُ وَلِلْأَخَوَاتِ مِنَ الْأَبِ السُّدُسُ تَكْمِلَةَ الثُّلُثَيْنِ وَمَا بَقِيَ لِلْأَخِ مِنَ الْأَبِ أُخْتَانِ لِأَبٍ وَأُمٍّ وَأَخٌ وَأُخْتٌ لِأَبٍ فِي قَوْلِ عَلِيٍّ وَزَيْدٍ لِلْأُخْتَيْنِ مِنَ الْأَبِ وَالْأُمِّ الثُّلُثَانِ وَمَا بَقِيَ بَيْنَ الْأُخْتِ وَالْأَخِ {لِلذَّكَرِ مِثْلُ حَظِّ الْأُنْثَيَيْنِ} [النساء 11] وَفِي قَوْلِ عَبْدِ اللهِ لِلْأُخْتَيْنِ لِلْأَبِ وَالْأُمِّ الثُّلُثَانِ وَمَا بَقِيَ لِلذَّكَرِ دُونَ الْأُنْثَى؛ لِأَنَّهُ لَمْ يَكُنْ يَرْمِي أَنْ يَزِيدَ الْأَخَوَاتِ عَلَى الثُّلُثَيْنِ
You recite: ʿafter the payment of legacies he may have bequeathed or debtsʿ [an-Nisaʿ 4:12]. The Messenger of Allah ﷺ ruled that debts must be paid before carrying out bequests, [And he ruled] that sons from the same father and mother inherit from one another, but sons from different mothers (but the same father) do not. A man inherits from his brother through his father and mother but not from his brother through his father only. (Using translation from Aḥmad 1222)
قَضَى رَسُولُ اللهِ ﷺ أَنَّ الدَّيْنَ قَبْلَ الْوَصِيَّةِ وَأَنْتُمْ تَقْرَءُونَهَا {مِنْ بَعْدِ وَصِيَّةٍ يُوصَى بِهَا أَوْ دَيْنٍ} [النساء 12] وإِنَّ أَعْيَانَ بَنِي الْأُمِّ يَتَوَارَثُونَ دُونَ بَنِي الْعَلَّاتِ يَرِثُ الرَّجُلُ أَخَاهُ لِأَبِيهِ وَأُمِّهِ دُونَ إِخْوَتِهِ لِأَبِيهِ
