[Machine] We went out with the Messenger of Allah ﷺ until we came to a woman from the Ansar, who was the grandmother of Kharijah bin Zaid bin Thabit. So she mentioned the story and said, "O Messenger of Allah, these are the daughters of Thabit bin Qais bin Shammas who were killed with you on the Day of Uhud. Their uncle has distributed all their wealth and inheritance, leaving nothing except what he has taken. So what do you think, O Messenger of Allah?" The Messenger of Allah ﷺ said, "Allah will decide in this matter." Then Surah An-Nisa' (Chapter 4), verse 11 was revealed, where Allah says: "Allah instructs you concerning your children". So the Messenger of Allah ﷺ said, "Call the woman and her companion." Then he said to their uncle, "Give them two-thirds (of the inheritance) and give their mother one-eighth. What remains is yours." The phrase "distributed all their wealth and inheritance" means that he had divided their wealth among themselves, taking their rights from the inheritance, and the original meaning of the word "return" is that he should return their rights to them and give them their rightful share of the inheritance. As for the statement "Thabit bin Qais", it is a mistake, it should be "Sa'd bin Ar-Rabi". This was narrated to me by Abu Ali Ar-Ruwdhbari, I am Muhammad bin Bakr, narrated to me Abu Dawud, narrated to me Ibn As-Sarh, narrated to me Ibn Wahb, who told me Dawud bin Qais and others from the people of knowledge, from Abdullah bin Muhammad bin Aqil, from Jabir, that the wife of Sa'd bin Ar-Rabi said, "O Messenger of Allah, Sa'd has died and he has left behind two daughters." He said, "Tell the story." Abu Dawud said, "This is the correct version."

خَرَجْنَا مَعَ رَسُولِ اللهِ ﷺ حَتَّى جِئْنَا امْرَأَةً مِنَ الْأَنْصَارِ فِي الْأَسْوَافِ وَهِيَ جَدَّةُ خَارِجَةَ بْنِ زَيْدِ بْنِ ثَابِتٍ فَذَكَرَ الْحَدِيثَ قَالَ فَجَاءَتِ الْمَرْأَةُ بِابْنَتَيْنِ لَهَا فَقَالَتْ يَا رَسُولَ اللهِ هَاتَانِ ابْنَتَا ثَابِتِ بْنِ قَيْسِ بْنِ شَمَّاسٍ قُتِلَ مَعَكَ يَوْمَ أُحُدٍ وَقَدِ اسْتَفَاءَ عَمُّهُمَا مَالَهُمَا وَمِيرَاثَهُمَا كُلَّهُ فَلَمْ يَدَعْ مَالًا إِلَّا أَخَذَ فَمَا تَرَى يَا رَسُولَ اللهِ؟ فَوَاللهِ لَا تُنْكَحَانِ أَبَدًا إِلَّا وَلَهُمَا مَالٌ فَقَالَ رَسُولُ اللهِ ﷺ يَقْضِي اللهُ ﷻ فِي ذَلِكَ فَنَزَلَتْ سُورَةُ النِّسَاءِ {يُوصِيكُمُ اللهُ فِي أَوْلَادِكُمْ} [النساء 11] الْآيَةَ فَقَالَ رَسُولُ اللهِ ﷺ ادْعُ لِيَ الْمَرْأَةَ وَصَاحِبَهَا فَقَالَ لِعَمِّهِمَا أَعْطِهِمَا الثُّلُثَيْنِ وَأَعْطِ أُمَّهُمَا الثُّمُنَ وَمَا بَقِيَ فَلَكَ قَوْلُهُ اسْتَفَاءَ مَالَهُمَا مَعْنَاهُ اسْتَرَدَّ وَاسْتَرْجَعَ حَقَّهُمَا مِنَ الْمِيرَاثِ وَأَصْلُهُ مِنَ الْفَيْءِ وَهُوَ الرُّجُوعُ قَوْلُهُ ثَابِتُ بْنُ قَيْسٍ خَطَأٌ إِنَّمَا هُوَ سَعْدُ بْنُ الرَّبِيعِ 12312 أَخْبَرَنَاهُ أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنا مُحَمَّدُ بْنُ بَكْرٍ ثنا أَبُو دَاوُدَ ثنا ابْنُ السَّرْحِ ثنا ابْنُ وَهْبٍ أَخْبَرَنِي دَاوُدُ بْنُ قَيْسٍ وَغَيْرُهُ مِنْ أَهْلِ الْعِلْمِ عَنْ عَبْدِ اللهِ بْنِ مُحَمَّدِ بْنِ عَقِيلٍ عَنْ جَابِرٍ أَنَّ امْرَأَةَ سَعْدِ بْنِ الرَّبِيعِ قَالَتْ يَا رَسُولَ اللهِ إِنَّ سَعْدًا هَلَكَ وَتَرَكَ ابْنَتَيْنِ قَالَ وَسَاقَ الْحَدِيثَ قَالَ أَبُو دَاوُدَ هَذَا هُوَ الصَّوَابُ

We went out with the Messenger of Allah ﷺ and came to a woman of the Ansar in al-Aswaf. The woman brought her two daughters, and said: Messenger of Allah, these are the daughters of Thabit ibn Qays who was killed as a martyr when he was with you at the battle of Uhud, their paternal uncle has taken all their property and inheritance, and he has not left anything for them. What do you think, Messenger of Allah? They cannot be married unless they have some property. The Messenger of Allah ﷺ said: Allah will decide regarding the matter. Then the verse of Surat an-Nisa was revealed: "Allah (thus) directs you as regards your children's (inheritance)." Messenger of Allah ﷺ said: Call to me the woman and her husband's brother. He then said to their paternal uncle: Give them two-thirds and their mother an eighth, and what remains is yours. Abu Dawud said: The narrator Bishr made a mistake. They were the daughters of Sa'd b. al-Rabi' for Thabit b. Qais was killed in the battle of Yamamah.
