34. Inheritance (4/7)
٣٤۔ كِتَابُ الْفَرَائِضِ ص ٤
[Machine] "I have gone astray, and I am not one of the guided ones. Rather, I will decide in it according to what the Messenger of Allah ﷺ has decided for his daughter, which is half, and for his granddaughter, which is two-thirds, and what is left for her sister will be returned to Abu Musa who will inform him. He said, ‘Do not ask us about anything as long as this ink is between you.’"
{قَدْ ضَلَلْتُ إِذًا وَمَا أَنَا مِنَ الْمُهْتَدِينَ} لَا بَلْ أَقْضِي فِيهَا بِمَا قَضَى رَسُولُ اللهِ ﷺ لِابْنَتِهَا النِّصْفُ وَلِابْنَةِ ابْنِهَا السُّدُسُ تَكْمِلَةَ الثُّلُثَيْنِ وَمَا بَقِيَ لِأُخْتِهَا فَرَجَعَ إِلَى أَبِي مُوسَى فَأَخْبَرَهُ فَقَالَ لَا تَسْأَلُونَا عَنْ شَيْءٍ مَا دَامَ هَذَا الْحَبْرُ بَيْنَ أَظْهُرِكُمْ
[Machine] Muadh bin Jabal judged in our favor regarding a woman who left her daughter and sister. Half of the inheritance was for the daughter and half for the sister. Sulayman later judged on our case, but he did not mention the covenant of the Messenger of Allah.
قَضَى فِينَا مُعَاذُ بْنُ جَبَلٍ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ فِي امْرَأَةٍ تَرَكَتِ ابْنَتَهَا وَأُخْتَهَا النِّصْفُ لِلِابْنَةِ وَالنِّصْفُ لِلْأُخْتِ قَالَ سُلَيْمَانُ بَعْدُ قَضَى فِينَا وَلَمْ يَذْكُرْ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ
[Machine] That the Messenger of Allah ﷺ was approached by a man who left behind his daughter and sister. So he gave half to the daughter and half to the sister, like that.
أَنَّ رَسُولَ اللهِ ﷺ جِيءَ فِي رَجُلٍ تَرَكَ ابْنَتَهُ وَأُخْتَهُ فَأَعْطَى الِابْنَةَ النِّصْفَ وَالْأُخْتَ النِّصْفَ كَذَا
[Machine] Abdullah bin Zubair, so you are my messenger to Abdullah bin Umar, so inform him with this conversation, and he was a judge in Kufa.
عَبْدُ اللهِ بْنُ الزُّبَيْرِ فَأَنْتَ رَسُولِي إِلَى عَبْدِ اللهِ بْنِ عُتْبَةَ فَتُحَدِّثُهُ بِهَذَا الْحَدِيثِ وَكَانَ قَاضِيًا عَلَى الْكُوفَةِ
[Machine] "For the daughter, it is half, and for the sister, there is nothing remaining, so it is for her tribe. A man said to him, 'Verily, Umar ibn Al-Khattab has ruled otherwise. He has given half to the daughter and half to the sister.' Ibn Abbas said, 'Are you more knowledgeable than Allah?' Ma'mar said, 'I did not know the reason for that until I met Ibn Tawus and mentioned to him the hadith of Az-Zuhri. He informed me that my father had told him that he heard Ibn Abbas saying that Allah the Blessed and Exalted said, "If a man dies, leaving neither child nor parent but has a sister, then she gets half of what he leaves."' Ibn Abbas said, 'You have said that half belongs to her even if he has a child.' The elder meant by the child here is the son, according to the evidence from the Prophet ﷺ, then those who came after him.'
لِلِابْنَةِ النِّصْفُ وَلَيْسَ لِلْأُخْتِ شَيْءٌ مَا بَقِيَ فَهُوَ لِعَصَبَتِهِ فَقَالَ لَهُ رَجُلٌ فَإِنَّ عُمَرَ بْنَ الْخَطَّابِ ؓ قَدْ قَضَى بِغَيْرِ ذَلِكَ جَعَلَ لِلِابْنَةِ النِّصْفَ وَلِلْأُخْتِ النِّصْفَ قَالَ ابْنُ عَبَّاسٍ أَنْتُمْ أَعْلَمُ أَمِ اللهُ؟ قَالَ مَعْمَرٌ فَلَمْ أَدْرِ مَا وَجْهُ ذَلِكَ حَتَّى لَقِيتُ ابْنَ طَاوُسٍ فَذَكَرْتُ لَهُ حَدِيثَ الزُّهْرِيِّ فَقَالَ أَخْبَرَنِي أَبِي أَنَّهُ سَمِعَ ابْنَ عَبَّاسٍ يَقُولُ قَالَ اللهُ تَبَارَكَ وَتَعَالَى {إِنِ امْرُؤٌ هَلَكَ لَيْسَ لَهُ وَلَدٌ وَلَهُ أُخْتٌ فَلَهَا نِصْفُ مَا تَرَكَ} [النساء 176] قَالَ ابْنُ عَبَّاسٍ فَقُلْتُمْ أَنْتُمْ لَهَا نِصْفٌ وَإِنْ كَانَ لَهُ وَلَدٌ قَالَ الشَّيْخُ الْمُرَادُ بِالْوَلَدِ هَا هُنَا الِابْنُ بِدَلِيلِ مَا مَضَى عَنِ النَّبِيِّ ﷺ ثُمَّ عَمَّنْ بَعْدَهُ
34.26 [Machine] The inheritance of the father
٣٤۔٢٦ بَابُ مِيرَاثِ الْأَبِ
[Machine] If the deceased leaves behind a male child or a male grandchild, then the father is entitled to one-sixth. If the deceased does not leave behind a male child or a male grandchild, then the father is next in line, and he starts with those who inherited with him from the obligatory heirs. They are given their obligatory shares. If there is any surplus from the estate after distributing the obligatory shares, and it exceeds one-sixth, then it belongs to the father. If the surplus does not exceed one-sixth, then one-sixth is obligatory for the father as well.
أَنَّهُ إِنْ تَرَكَ الْمُتَوَفَّى وَلَدًا ذَكَرًا أَوْ وَلَدَ ابْنٍ ذَكَرًا فَإِنَّهُ يُفْرَضُ لِلْأَبِ السُّدُسُ وَإِنْ لَمْ يَتْرُكِ الْمُتَوَفَّى وَلَدًا ذَكَرًا وَلَا وَلَدَ ابْنٍ ذَكَرًا فَإِنَّ الْأَبَ يُخَلَّفُ وَيُبْدَأُ بِمَنْ شَرَكَهُ مِنْ أَهْلِ الْفَرَائِضِ فَيُعْطَوْنَ فَرَائِضَهُمْ فَإِنْ فَضَلَ مِنَ الْمَالِ السُّدُسُ فَأَكْثَرُ مِنْهُ كَانَ لِلْأَبِ وَإِنْ لَمْ يَفْضُلْ عَنْهُمُ السُّدُسُ فَأَكْثَرُ مِنْهُ فُرِضَ لِلْأَبِ السُّدُسُ فَرِيضَةً
[Machine] His daughter will inherit half, and the sixth goes to the mother and the sixth goes to the father, then another sixth goes to the father. Then he told me about his father that the Prophet ﷺ said: "Connect the money to the shares, so whatever is left of the shares goes to the nearest male relative."
لِابْنَتِهِ النِّصْفُ لَا تُزَادُ وَالسُّدُسُ لِلْأُمِّ وَالسُّدُسُ لِلْأَبِ ثُمَّ السُّدُسُ الْآخَرُ لِلْأَبِ ثُمَّ أَخْبَرَنِي عَنْ أَبِيهِ أَنَّ النَّبِيَّ ﷺ قَالَ أَلْحِقُوا الْمَالَ بِالْفَرَائِضِ فَمَا تَرَكَتِ الْفَرَائِضُ فَلِأَدْنَى رَجُلٍ ذَكَرٍ
[Machine] The Messenger of Allah ﷺ said, "Give the obligatory rights to their rightful owners. Whatever is left belongs to the nearest relative."
قَالَ رَسُولُ اللهِ ﷺ أَلْحِقُوا الْفَرَائِضَ بِأَهْلِهَا فَمَا بَقِيَ فَهُوَ لِأَوْلَى رَجُلٍ ذَكَرٍ
34.27 [Machine] The obligation of the grandparents
٣٤۔٢٧ بَابُ فَرْضِ الْجَدَّةِ وَالْجَدَّتَيْنِ
A grandmother came to AbuBakr asking him for her share of inheritance. He said: There is nothing prescribed for you in Allah's Book, nor do I know anything for you in the Sunnah of the Prophet of Allah ﷺ Go home till I question the people. He then questioned the people, and al-Mughirah ibn Shu'bah said: I had been present with the Messenger of Allah ﷺ when he gave grandmother a sixth. AbuBakr said: Is there anyone with you? Muhammad ibn Maslamah stood and said the same as al-Mughirah ibn Shu'bah had said. So AbuBakr made it apply to her. Another grandmother came to Umar ibn al-Khattab asking him for her share of inheritance. He said: Nothing has been prescribed for you in Allah's Book. The decision made before you was made for a grandmother other than you. I am not going to add in the shares of inheritance; but it is that sixth. If there are two of you, it is shared between you, but whichever of you is the only one left gets it all. (Using translation from Abū Dāʾūd 2894)
جَاءَتِ الْجَدَّةُ إِلَى أَبِي بَكْرٍ الصِّدِّيقِ ؓ تَسْأَلُهُ مِيرَاثَهَا فَقَالَ لَهَا أَبُو بَكْرٍ ؓ مَا لَكِ فِي كِتَابِ اللهِ شَيْءٌ وَمَا عَلِمْتُ لَكِ فِي سُنَّةِ رَسُولِ اللهِ ﷺ شَيْئًا فَارْجِعِي حَتَّى أَسْأَلَ النَّاسَ فَقَالَ الْمُغِيرَةُ بْنُ شُعْبَةَ حَضَرْتُ رَسُولَ اللهِ ﷺ أَعْطَاهَا السُّدُسَ فَقَالَ أَبُو بَكْرٍ هَلْ مَعَكَ غَيْرُكَ؟ فَقَامَ مُحَمَّدُ بْنُ مَسْلَمَةَ الْأَنْصَارِيُّ فَقَالَ مِثْلَ مَا قَالَ الْمُغِيرَةُ فَأَنْفَذَهُ لَهَا أَبُو بَكْرٍ ؓ ثُمَّ جَاءَتِ الْجَدَّةُ الْأُخْرَى إِلَى عُمَرَ بْنِ الْخَطَّابِ ؓ تَسْأَلُهُ مِيرَاثَهَا فَقَالَ مَا لَكِ فِي كِتَابِ اللهِ شَيْءٌ وَمَا كَانَ الْقَضَاءُ الَّذِي قَضَى بِهِ إِلَّا لِغَيْرِكِ وَمَا أَنَا بِزَائِدٍ فِي الْفَرَائِضِ شَيْئًا وَلَكِنْ هُوَ ذَاكَ السُّدُسُ فَإِنِ اجْتَمَعْتُمَا فِيهِ فَهُوَ بَيْنَكُمَا وَأَيَّتُكُمَا خَلَتْ بِهِ فَهُوَ لَهَا
It was narrated from Ibn ‘Abbas that the Messenger of Allah ﷺ gave a grandmother one sixth of the inheritance. (Using translation from Ibn Mājah 2725)
أَنَّ رَسُولَ اللهِ ﷺ وَرَّثَ جَدَّةً سُدُسًا
[Machine] That the Messenger of Allah ﷺ would give one-sixth of the inheritance to the grandmother if she is not a mother.
أَنَّ رَسُولَ اللهِ ﷺ أَطْعَمَ السُّدُسَ الْجَدَّةَ إِذَا لَمْ تَكُنْ أُمٌّ
[Machine] The Prophet Muhammad ﷺ gave the grandmother one-sixth and it was narrated from Shu'bah from Yunus ibn 'Ubayd, 12341 Abu al-Hasan ibn 'Abdan informed us, I am Ahmad ibn 'Ubayd narrated by Muhammad ibn Bishr, the brother of Khattab, narrated by Ibn Humayd, narrated by Ibrahim ibn al-Mukhtar, narrated by Shu'bah, who mentioned it similarly.
أَنَّ رَسُولَ اللهِ ﷺ أَعْطَى الْجَدَّةَ السُّدُسَ وَرُوِيَ عَنْ شُعْبَةَ عَنْ يُونُسَ بْنِ عُبَيْدٍ 12341 أَخْبَرَنَا أَبُو الْحَسَنِ بْنُ عَبْدَانَ أنا أَحْمَدُ بْنُ عُبَيْدٍ ثنا مُحَمَّدُ بْنُ بِشْرٍ أَخُو خَطَّابٍ ثنا ابْنُ حُمَيْدٍ ثنا إِبْرَاهِيمُ بْنُ الْمُخْتَارِ ثنا شُعْبَةُ فَذَكَرَهُ بِمِثْلِهِ وَكَذَلِكَ
[Machine] He said, "The two grandmothers came to Abu Bakr Al-Siddiq, and he wanted to give the sixth to the one from the mother's side. A man from the Ansar said to him, 'Why don't you leave it to the one who, if they were to die while he is alive, he would inherit from her?' So Abu Bakr Al-Siddiq placed the sixth between them."
أَنَّهُ قَالَ أَتَتِ الْجَدَّتَانِ إِلَى أَبِي بَكْرٍ الصِّدِّيقِ ؓ فَأَرَادَ أَنَ يَجْعَلَ السُّدُسَ لِلَّتِي مِنْ قِبَلِ الْأُمِّ فَقَالَ لَهُ رَجُلٌ مِنَ الْأَنْصَارِ أَمَا إِنَّكَ تَتْرُكُ الَّتِي لَوْ مَاتَتَا وَهُوَ حَيٌّ كَانَ إِيَّاهَا يَرِثُ فَجَعَلَ أَبُو بَكْرٍ الصِّدِّيقُ السُّدُسَ بَيْنَهُمَا
[Machine] That my two grandmothers, Umm Al-Umm and Umm Al-Abe, came to Abu Bakr Al-Siddiq. So Abu Bakr gave the inheritance to Umm Al-Umm over Umm Al-Abe. Abdurrahman bin Sahl, the brother of Bani Haritha, said to him, "O Khalifa of the Messenger of Allah, you have given to one who, if she were to die, would not be inherited." So Abu Bakr placed Abu Bakr between them, meaning one-sixth, and this is narrated from the Prophet ﷺ in a mursal chain.
أَنَّ جَدَّتَيْنِ أَتَتَا أَبَا بَكْرٍ الصِّدِّيقَ ؓ أُمُّ الْأُمِّ وَأُمُّ الْأَبِ فَأَعْطَى الْمِيرَاثَ أُمَّ الْأُمِّ دُونَ أُمِّ الْأَبِ فَقَالَ لَهُ عَبْدُ الرَّحْمَنِ بْنُ سَهْلٍ أَخُو بَنِي حَارِثَةَ يَا خَلِيفَةَ رَسُولِ اللهِ قَدْ أَعْطَيْتَ الَّتِي لَوْ أَنَّهَا مَاتَتْ لَمْ يَرِثْهَا فَجَعَلَهُ أَبُو بَكْرٍ بَيْنَهُمَا يَعْنِي السُّدُسَ وَقَدْ رُوِيَ هَذَا عَنِ النَّبِيِّ ﷺ فِي إِسْنَادٍ مُرْسَلٍ
[Machine] Indeed, it is from the decree of the Messenger of Allah ﷺ that he has decreed for the two grandmothers from the inheritance a sixth (of total inheritance), whether from Is-haq or 'Ubadah, the one being sent.
إِنَّ مِنْ قَضَاءِ رَسُولِ اللهِ ﷺ أَنَّهُ قَضَى لِلْجَدَّتَيْنِ مِنَ الْمِيرَاثِ بَيْنَهُمَا السُّدُسُ سَوَاءٌ إِسْحَاقُ عَنْ عُبَادَةَ مُرْسَلٌ
34.28 [Machine] Who did not inherit more than two grandmothers
٣٤۔٢٨ بَابُ مَنْ لَمْ يُوَرِّثْ أَكْثَرَ مِنْ جَدَّتَيْنِ
[Machine] That Abu Bakr ibn Abdurrahman ibn Al-Harith ibn Hisham would only impose for the two grandmothers.
أَنَّ أَبَا بَكْرِ بْنَ عَبْدِ الرَّحْمَنِ بْنِ الْحَارِثِ بْنِ هِشَامٍ كَانَ لَا يَفْرِضُ إِلَّا لِلْجَدَّتَيْنِ
[Machine] We do not know it, he inherited in Islam except for two grandmothers, and this is also the saying of Rabee'ah and it was narrated from Sa'd ibn Abi Waqqas that he said to Ibn Mas'ood, "You are the ones who impose inheritance on three grandmothers, as if he rejects that, and in another narration, he inherited Eve from her children and its chain of narration is not that.
لَا نَعْلَمُهُ وَرَّثَ فِي الْإِسْلَامِ إِلَّا جَدَّتَيْنِ وَهَذَا قَوْلُ رَبِيعَةَ أَيْضًا وَرُوِيَ عَنْ سَعْدِ بْنِ أَبِي وَقَّاصٍ أَنَّهُ قَالَ لِابْنِ مَسْعُودٍ أَنْتُمُ الَّذِينَ تَفْرِضُونَ لِثَلَاثِ جَدَّاتٍ كَأَنَّهُ يُنْكِرُ ذَلِكَ وَفِي رِوَايَةٍ أُخْرَى وَرَّثَ حَوَّاءَ مِنْ بَنِيهَا وَإِسْنَادُهُ لَيْسَ بِذَاكَ
[Machine] About the companions of the Prophet ﷺ and a group of the followers, it is narrated that they inherited three hadiths along with the disconnected narrative that is narrated from the Prophet ﷺ that he inherited three hadiths. We do not know of any of the companions of the Prophet ﷺ who differed from that, except for what has been narrated from Saad ibn Abi Waqqas from what is not confirmed by the people of knowledge in its chain.
عَنْ أَصْحَابِ النَّبِيِّ ﷺ وَجَمَاعَةٍ مِنَ التَّابِعِينَ أَنَّهُمْ وَرَّثُوا ثَلَاثَ جَدَّاتٍ مَعَ الْحَدِيثِ الْمُنْقَطِعِ الَّذِي يُرْوَى عَنِ النَّبِيِّ ﷺ أَنَّهُ وَرَّثَ ثَلَاثَ جَدَّاتٍ وَلَا نَعْلَمُ عَنْ أَحَدٍ مِنْ أَصْحَابِ النَّبِيِّ ﷺ خِلَافَ ذَلِكَ إِلَّا مَا رُوِّينَا عَنْ سَعْدِ بْنِ أَبِي وَقَّاصٍ مِمَّا لَا يُثْبِتُ أَهْلُ الْمَعْرِفَةِ بِالْحَدِيثِ إِسْنَادَهُ
34.29 [Machine] Inheriting three adjacent or more grandmothers
٣٤۔٢٩ بَابُ تَوْرِيثِ ثَلَاثِ جَدَّاتٍ مُتَحَاذِيَاتٍ أَوْ أَكْثَرَ
[Machine] The Messenger of Allah ﷺ fed three-thirds to a guest. I asked Ibrahim, "What are they?" He said, "They are the two grandmothers from your father's side and your mother's grandmother." This is transmitted and has been narrated from Harajah ibn Musab, from Mansur, from Ibrahim, from Abdur Rahman ibn Yazid, from the Prophet ﷺ . He also mentioned it. 12349 Abu Bakr ibn al-Harith al-Faqih informed us: I am Ali ibn Umar al-Hafiz. Muhammad ibn Ismail al-Farisi narrated to us, Musa ibn Isa ibn al-Munther narrated to us, Ahmed ibn Khalid al-Wahbi narrated to us, Kharijah ibn Musab narrated to us, from Mansur, from Ibrahim, from Abdur Rahman ibn Yazid. He said, then he mentioned it.
أَطْعَمَ رَسُولُ اللهِ ﷺ ثَلَاثَ جَدَّاتٍ سُدُسًا قُلْتُ لِإِبْرَاهِيمَ مَا هُنَّ؟ قَالَ جَدَّتَاكَ مِنْ قِبَلِ أَبِيكَ وَجَدَّةُ أُمِّكَ هَذَا مُرْسَلٌ وَقَدْ رُوِيَ عَنْ خَارِجَةَ بْنِ مُصْعَبِ عِنْ مَنْصُورٍ عَنْ إِبْرَاهِيمَ عِنْ عَبْدِ الرَّحْمَنِ بْنِ يَزِيدَ عَنِ النَّبِيِّ ﷺ وَهُوَ أَيْضًا مُرْسَلٌ 12349 أَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ الْفَقِيهُ أنا عَلِيُّ بْنُ عُمَرَ الْحَافِظُ ثنا مُحَمَّدُ بْنُ إِسْمَاعِيلَ الْفَارِسِيُّ ثنا مُوسَى بْنُ عِيسَى بْنِ الْمُنْذِرِ ثنا أَحْمَدُ بْنُ خَالِدٍ الْوَهْبِيُّ ثنا خَارِجَةُ بْنُ مُصْعَبٍ عَنْ مَنْصُورٍ عَنْ إِبْرَاهِيمَ عَنْ عَبْدِ الرَّحْمَنِ بْنِ يَزِيدَ قَالَ فَذَكَرَهُ
[Machine] The Messenger of Allah ﷺ inherited three grandfathers.
أَنَّ رَسُولَ اللهِ ﷺ وَرَّثَ ثَلَاثَ جَدَّاتٍ
أَنَّ عُمَرَ ؓ أَطْعَمَهُنَّ السُّدُسَ
[Machine] Ibn Thabit and Ali used to inherit three grandmothers, two from the father's side and one from the mother's side.
بْنَ ثَابِتٍ وَعَلِيًّا ؓ كَانَا يُوَرِّثَانِ ثَلَاثَ جَدَّاتٍ ثِنْتَيْنِ مِنْ قِبَلِ الْأَبِ وَوَاحِدَةً مِنْ قِبَلِ الْأُمِّ
[Machine] Regarding Zaid, as for the explanation, it is the explanation of Abu Zanad on the meanings of Zaid. He said, "If the deceased person leaves behind three daughters, they are equal in terms of inheritance, and there is no mother or father beside them. The sixth share is divided among them equally, and they are: the mother, the grandmother, and the great-grandmother."
عَنْ زَيْدٍ وَأَمَّا التَّفْسِيرُ فَتَفْسِيرُ أَبِي الزِّنَادِ عَلَى مَعَانِي زَيْدٍ قَالَ فَإِنْ تَرَكَ الْمُتَوَفَّى ثَلَاثَ جَدَّاتٍ بِمَنْزِلَةٍ وَاحِدَةٍ لَيْسَ دُونَهُنَّ أُمٌّ وَلَا أَبٌ فَالسُّدُسُ بَيْنَهُنَّ ثَلَاثَتَهُنَّ وَهُنَّ أُمُّ أُمِّ الْأُمِّ وَأُمُّ أُمِّ الْأَبِ وَأُمُّ أَبِي الْأَبِ
[Machine] You inherit three great-grandmothers from the paternal side and one from the maternal side.
تَرِثُ ثَلَاثُ جَدَّاتٍ جَدَّتَيْنِ مِنْ قِبَلِ الْأَبِ وَوَاحِدَةٍ مِنْ قِبَلِ الْأُمِّ
[Machine] She inherits three great-grandmothers from her father's side and one from her mother's side.
تَرِثُ ثَلَاثُ جَدَّاتٍ جَدَّتَيْنِ مِنْ قِبَلِ الْأَبِ وَوَاحِدَةٍ مِنْ قِبَلِ الْأُمِّ
[Machine] The grandmothers (feminine) inherit the four (feminine) together.
تَرِثُ الْجَدَّاتُ الْأَرْبَعُ جَمْعٌ
[Machine] Four grandmothers came and quarreled over a stolen item. Then, the mother of my father threw it and inherited three grandmothers.
جِئْنَ أَرْبَعُ جَدَّاتٍ يَتَسَاوَقْنَ إِلَى مَسْرُوقٍ فَأَلْقَى أُمَّ أَبِي الْأُمِّ وَوَرَّثَ ثَلَاثَ جَدَّاتٍ
[Machine] "From Shabi, what you contribute is only what you do not inherit, so how can you inherit it?"
عَنِ الشَّعْبِيِّ إِنَّمَا الَّذِي تُدْلِي بِهِ لَا يَرِثُ فَكَيْفَ تَرِثُ هِيَ؟
34.30 [Machine] Inheritance from Grandmothers without Distance
٣٤۔٣٠ بَابُ تَوْرِيثِ الْقُرْبَى مِنَ الْجَدَّاتِ دُونَ الْبُعْدَى
[Machine] And Zaid and Zaina used to inherit from their grandparents.
وَزَيْدًا ؓ كَانَا يُوَرِّثَانِ الْقُرْبَى مِنَ الْجَدَّاتِ
[Machine] Ali and Zaid inherit from the closest ancestors, the closest.
عَلِيٌّ وَزَيْدٌ ؓ يُوَرِّثَانِ مِنَ الْجَدَّاتِ الْأَقْرَبَ فَالْأَقْرَبَ
[Machine] Ali and Zaid feed the grandmother, whether it's one-sixth, two-sixths, or three-sixths. They do not decrease or increase from it if their relationship to the deceased is the same. However, if one of them is closer, then the sixth belongs to her alone, separate from them. Abdullah used to distribute among the closer and farther in the sixth if they are in different places. The grandmothers are not excluded from the sixth, except for the mother.
عَلِيٌّ وَزَيْدٌ ؓ يُطْعِمَانِ الْجَدَّةَ أَوِ الثِّنْتَيْنِ أَوِ الثَّلَاثَ السُّدُسَ لَا يُنْقَصْنَ مِنْهُ وَلَا يُزَدْنَ عَلَيْهِ إِذَا كَانَتْ قَرَابَتُهُنَّ إِلَى الْمَيِّتِ سَوَاءً فَإِنْ كَانَتْ إِحْدَاهُنَّ أَقْرَبَ فَالسُّدُسُ لَهَا دُونَهُنَّ وَكَانَ عَبْدُ اللهِ يُشْرِكُ بَيْنَ أَقْرَبِهِنَّ وَأَبْعَدِهِنَّ فِي السُّدُسِ إِنْ كُنَّ بِمَكَانٍ شَتَّى وَلَا يَحْجُبُ الْجَدَّاتِ مِنَ السُّدُسِ إِلَّا الْأُمُّ
[Machine] "And Zaid and Yurithan al-Qurba from the sixth generation of the grandmothers, even if they are equal, then it is between them. And Abdullah used to say, the grandmothers should not be deprived except the mother, and he would inherit them, even if some of them are closer to each other, except if one of them is the mother of the other, then he would inherit the daughter. This was narrated by Abu Amr al-Shaibani from Abdullah ibn Masood with its meaning, and it was also narrated by Abu Ishaq from Al-Harith from Ali and Zaid with its meaning."
وَزَيْدٌ ؓ يُوَرِّثَانِ الْقُرْبَى مِنَ الْجَدَّاتِ السُّدُسَ وَإِنْ يَكُنَّ سَوَاءً فَهُوَ بَيْنَهُنَّ وَكَانَ عَبْدُ اللهِ يَقُولُ لَا يَحْجُبُ الْجَدَّاتِ إِلَّا الْأُمُّ وَيُوَرِّثْهُنَّ وَإِنْ كَانَ بَعْضُهُنَّ أَقْرَبَ مِنْ بَعْضٍ إِلَّا أَنَ تَكُونَ إِحْدَاهُنَّ أُمَّ الْأُخْرَى فَيُوَرِّثُ الِابْنَةَ وَرَوَاهُ أَبُو عَمْرٍو الشَّيْبَانِيُّ عَنْ عَبْدِ اللهِ بْنِ مَسْعُودٍ بِمَعْنَاهُ وَرُوِيَ عَنْ أَبِي إِسْحَاقَ عَنِ الْحَارِثِ عَنْ عَلِيٍّ وَزَيْدٍ ؓ بِمَعْنَاهُ
34.31 [Machine] Inheriting from female relatives if it is on the mother's side, and sharing inheritance if it is on the father's side, which is the correct belief of Zaid's doctrine.
٣٤۔٣١ بَابُ تَوْرِيثِ الْقُرْبَى مِنْهُنَّ إِذَا كَانَتْ مِنْ قِبَلِ الْأُمِّ، وَالْإِشْرَاكِ بَيْنَهُنَّ إِذَا كَانَتِ الْقُرْبَى مِنْ قِبَلِ الْأَبِ وَهُوَ الصَّحِيحُ مِنْ مَذْهَبِ زَيْدٍ
[Machine] If the two grandmothers meet, the sixth will be between them. If the one on the mother's side is closer to the other, then the sixth is for her. If the one on the father's side is closer, then he is between them.
إِذَا اجْتَمَعَتْ جَدَّتَانِ فَبَيْنَهُمَا السُّدُسُ وَإِذَا كَانَتِ الَّتِي مِنْ قِبَلِ الْأُمِّ أَقْرَبَ مِنَ الْأُخْرَى فَالسُّدُسُ لَهَا وَإِذَا كَانَتِ الَّتِي مِنْ قِبَلِ الْأَبِ أَقْرَبَ فَهُوَ بَيْنَهُمَا
[Machine] We have heard that if the one from the mother's side is more spacious, she would have two-thirds and the one from the father's side would have one-third. And if they were equal or if the one from the father's side is more spacious, then the two-thirds will be divided equally between them.
سَمِعْنَا أَنَّهَا إِنْ كَانَتِ الَّتِي مِنْ قِبَلِ الْأُمِّ هِيَ أَقْعَدَهُمَا كَانَ لَهَا السُّدُسُ دُونَ الَّتِي مِنْ قِبَلِ الْأَبِ وَإِنْ كَانَتَا مِنَ الْمُتَوَفَّى بِمَنْزِلَةٍ وَاحِدَةٍ أَوْ كَانَتِ الَّتِي مِنْ قِبَلِ الْأَبِ هِيَ أَقْعَدَهُمَا فَإِنَّ السُّدُسَ يُقْسَمُ بَيْنَهُمَا نِصْفَيْنِ
[Machine] He would say, "If the grandmother is on the mother's side, I sit closer to the grandmother on the father's side, as she is more entitled to a sixth. And if the grandmother is on the father's side, I sit and divide equally between her and the grandmother on the mother's side." Then it was asked, "How did the grandmother from the mother's side reach this position?" He said, "Because grandmothers are only given a sixth of what the mother is given."
أَنَّهُ كَانَ يَقُولُ إِذَا كَانَتِ الْجَدَّةُ مِنْ قِبَلِ الْأُمِّ أَقْعَدَ مِنَ الْجَدَّةِ مِنْ قِبَلِ الْأَبِ فَهِيَ أَحَقُّ بِالسُّدُسِ وَإِذَا كَانَتِ الْجَدَّةُ مِنْ قِبَلِ الْأَبِ أَقْعَدَ أُشْرِكَتْ بَيْنَهَا وَبَيْنَ جَدَّةِ الْأُمِّ قِيلَ وَكَيْفَ صَارَتِ الْجَدَّةُ مِنْ قِبَلِ الْأُمِّ بِهَذِهِ الْمَنْزِلَةِ؟ قَالَ لِأَنَّ الْجَدَّاتِ إِنَّمَا أُطْعِمْنَ السُّدُسَ مِنْ قِبَلِ سُدُسِ الْأُمِّ
[Machine] If the grandmother is from the mother's side, then she inherits from the grandmother from the mother's side, she takes one-sixth. But if the grandmother is from the father's side, then she inherits from the grandmother from the father's side, the sixth is assigned between them. Yaḥyā bin Yaḥyā and Waki' narrated from Fiṭr, from a sheikh from the people of Al-Madīnah, from Khārija bin Zaid, from Zaid bin Thābit, that he used to say that.
إِذَا كَانَتِ الْجَدَّةُ مِنْ قِبَلِ الْأُمِّ أَقْعَدَ مِنَ الْجَدَّةِ مِنْ قِبَلِ الْأَبِ كَانَ لَهَا السُّدُسُ وَإِذَا كَانَتِ الْجَدَّةُ مِنْ قِبَلِ الْأُمِّ هِيَ أَقْعَدَ مِنَ الْجَدَّةِ مِنَ الْأَبِ جُعِلَ السُّدُسُ بَيْنَهُمَا قَالَ وَأنا يَحْيَى بْنُ يَحْيَى أنا وَكِيعٌ عَنْ فِطْرٍ عَنْ شَيْخٍ مِنْ أَهْلِ الْمَدِينَةِ عَنْ خَارِجَةَ بْنِ زَيْدٍ عَنْ زَيْدِ بْنِ ثَابِتٍ أَنَّهُ كَانَ يَقُولُ ذَلِكَ
[Machine] If the grandmother is from the mother's side, then she is entitled to one-sixth.
إِذَا كَانَتِ الْجَدَّةُ مِنْ قِبَلِ الْأُمِّ أَقْعَدَ فَهِيَ أَحَقُّ بِالسُّدُسِ
34.32 [Machine] The Association
٣٤۔٣٢ بَابُ الْعَصَبَةِ
The Prophet ﷺ said, "I am closer to the believers than their selves in this world and in the Hereafter, and if you like, you can read Allah's Statement: "The Prophet ﷺ is closer to the believers than their own selves." (33.6) So, if a true believer dies and leaves behind some property, it will be for his inheritors (from the father's side), and if he leaves behind some debt to be paid or needy offspring, then they should come to me as I am the guardian of the deceased." قَالَ رَسُولُ اللهِ ﷺ مَا مِنْ مُؤْمِنٍ إِلَّا وَأَنَا أَوْلَى النَّاسِ بِهِ فِي الدُّنْيَا وَالْآخِرَةِ اقْرَءُوا إِنْ شِئْتُمْ {النَّبِيُّ أَوْلَى بِالْمُؤْمِنِينَ مِنْ أَنْفُسِهِمْ} [الأحزاب 6] وَأَيُّمَا امْرِئٍ تَرَكَ مَالًا فَلْيَرِثْهُ عَصَبَتُهُ مَنْ كَانُوا وَإِنْ تَرَكَ دَيْنًا أَوْ ضَيَاعًا فَلْيَأْتِنِي فَأَنَا مَوْلَاهُ
By Him in Whose Hand is the life of Muhammad, there is no believer on the earth with whom I am not the nearest among all the people. He who amongst you (dies) and leaves a debt, I am there to pay it, and he who amongst you (dies) leaving behind children I am there to look after them. And he who amongst You leaves behind property, that is for the inheritor whoever he is. (Using translation from Muslim 1619c)
عَنِ النَّبِيِّ ﷺ قَالَ وَالَّذِي نَفْسُ مُحَمَّدٍ بِيَدِهِ إِنْ عَلَى الْأَرْضِ مُؤْمِنٌ إِلَّا أَنَا أَوْلَى النَّاسِ بِهِ فَأَيُّكُمْ مَا تَرَكَ دَيْنًا أَوْ ضَيَاعًا فَلْأُدْعَ إِلَيْهِ؛ فَأَنَا مَوْلَاهُ وَأَيُّكُمْ مَا تَرَكَ مَالًا فَإِلَى الْعَصَبَةِ مَنْ كَانَ
قَالَ رَسُولُ اللهِ ﷺ أَنَا أَوْلَى بِالْمُؤْمِنِينَ مِنْ أَنْفُسِهِمْ مَنْ تَرَكَ مَالًا فَمَالُهُ لِمَوَالِي الْعَصَبَةِ وَمَنْ تَرَكَ كَلًّا أَوْ ضَيَاعًا فَأَنَا وَلِيُّهُ
34.33 [Machine] The organization of the group
٣٤۔٣٣ بَابُ تَرْتِيبِ الْعَصَبَةِ
[Machine] That the Prophet ﷺ said, "Combine wealth with the obligations, and whatever remains of the obligations should go to the nearest male heirs." And in another narration of Musa: "Combine the obligations with their rightful recipients, and whatever is left should go to the nearest male heirs."
أَنَّ النَّبِيَّ ﷺ قَالَ أَلْحِقُوا الْمَالَ بِالْفَرَائِضِ فَمَا أَبْقَتِ الْفَرَائِضُ فَلِأَوْلَى رَجُلٍ ذَكَرٍ وَفِي رِوَايَةِ مُوسَى أَلْحِقُوا الْفَرَائِضَ بِأَهْلِهَا فَمَا بَقِيَ فَهُوَ لِأَوْلَى رَجُلٍ ذَكَرٍ
[Machine] "And if someone's father passes away and he leaves no one except him, then he inherits all the wealth. And if someone's father passes away and he leaves a son, the father receives one-sixth and the rest goes to the son. And if someone's grandson passes away and he leaves no son, then the grandson's son inherits in the place of the son."
وَإِنْ تَرَكَ أَبَاهُ وَلَمْ يَتْرُكْ أَحَدًا غَيْرَهُ فَلَهُ الْمَالُ وَإِنْ تَرَكَ أَبَاهُ وَتَرَكَ ابْنَا فَلِلْأَبِ السُّدُسُ وَمَا بَقِيَ فَلِلِابْنِ وَإِنْ تَرَكَ ابْنَ ابْنٍ وَلَمْ يَتْرُكِ ابْنًا فَابْنُ الِابْنِ بِمَنْزِلَةِ الِابْنِ
[Machine] The brother of the mother and father is more entitled to inheritance than the brother of the father, and the brother of the father is more entitled to inheritance than the son of the brother of the father and the mother. The son of the brother of the father is more entitled to inheritance than the son of the son of the brother of the father and the mother. The uncle of the father is more entitled to inheritance than the brother of the father and the uncle of the father is more entitled to inheritance than the son of the uncle of the father and the mother. The son of the uncle of the father is more entitled to inheritance than the cousin of the father and the mother. If you are asked about any of this, attribute the deceased to their father and attribute those who dispute in the guardianship to their tribe. If you find anyone among them who is attributed to a father which is not attributed by others except to a higher father, then give the inheritance to the one who is attributed to the closest father without the others. And if you find all of them attributed to one father, then look at their position in relation to lineage. If it is only the son of a son, then give the inheritance to him excluding the others. But if the parties are a son of a mother and a father, and you find them equal, proportional in the number of fathers to one father, until they inherit from the deceased, and all of them are sons of a father or sons of a father and mother, then divide the inheritance equally among them. And if the parent of some of them is the brother of the parent of the deceased, then the inheritance is only for their father and mother. And if the parent of someone other than the deceased is only the brother of the parent, then the inheritance is only for their father. Because the inheritance is for the children of the father and mother, excluding the children of the father and the grandfather is more entitled than the son of the brother of the father and the mother, and more entitled than the cousin of the father and the mother.
الْأَخُ لِلْأُمِّ وَالْأَبِ أَوْلَى بِالْمِيرَاثِ مِنَ الْأَخِ لِلْأَبِ وَالْأَخُ لِلْأَبِ أَوْلَى بِالْمِيرَاثِ مِنِ ابْنِ الْأَخِ لِلْأَبِ وَالْأُمِّ وَابْنُ الْأَخِ لِلْأُمِّ وَالْأَبِ أَوْلَى مِنِ ابْنِ الْأَخِ لِلْأَبِ وَابْنُ الْأَخِ لِلْأَبِ أَوْلَى مِنِ ابْنِ ابْنِ الْأَخِ لِلْأَبِ وَالْأُمِّ وَابْنُ الْأَخِ لِلْأَبِ أَوْلَى مِنَ الْعَمِّ أَخِي الْأَبِ لِلْأُمِّ وَالْأَبِ وَالْعَمُّ أَخُو الْأَبِ لِلْأُمِّ وَالْأَبِ أَوْلَى مِنَ الْعَمِّ أَخِي الْأَبِ لِلْأَبِ وَالْعَمُّ أَخُو الْأَبِ لِلْأَبِ أَوْلَى مِنِ ابْنِ الْعَمِّ أَخِي الْأَبِ لِلْأَبِ وَالْأُمِّ وَابْنُ الْعَمِّ لِلْأَبِ أَوْلَى مِنْ عَمِّ الْأَبِ أَخِي أَبِي الْأَبِ لِلْأُمِّ وَالْأَبِ وَكُلُّ شَيْءٍ سُئِلَ عَنْهُ مِنْ مِيرَاثِ الْعَصَبَةِ فَإِنَّهُ عَلَى نَحْوِ هَذَا فَمَا سُئِلْتَ عَنْهُ مِنْ ذَلِكَ فَانْسِبِ الْمُتَوَفَّى وَانْسِبْ مَنْ تَنَازَعَ فِي الْوَلَايَةِ مِنْ عَصَبَتِهِ فَإِنْ وَجَدْتَ أَحَدًا مِنْهُمْ يَلْقَى الْمُتَوَفَّى إِلَى أَبٍ لَا يَلْقَاهُ مَنْ سِوَاهُ مِنْهُمْ إِلَّا إِلَى أَبٍ فَوْقَ ذَلِكَ فَاجْعَلِ الْمِيرَاثَ لِلَّذِي يَلْقَاهُ إِلَى الْأَبِ الْأَدْنَى دُونَ الْآخَرِينَ وَإِذَا وَجَدْتَهُمْ كُلَّهُمْ يَلْقَوْنَهُ إِلَى أَبٍ وَاحِدٍ يَجْمَعُهُمْ فَانْظُرْ أَقْعَدَهُمْ فِي النَّسَبِ فَإِنْ كَانَ ابْنُ ابْنٍ فَقَطْ فَاجْعَلِ الْمِيرَاثَ لَهُ دُونَ الْأَطْرَفِ فَإِنْ كَانَ الْأَطْرَافُ ابْنَ أُمٍّ وَأَبٍ فَإِنْ وَجَدْتَهُمْ مُسْتَوِينَ يَتَنَاسَبُونَ فِي عَدَدِ الْآبَاءِ إِلَى عَدَدٍ وَاحِدٍ حَتَّى يَلْقَوْا نَسَبَ الْمُتَوَفَّى وَكَانُوا كُلُّهُمْ بَنِي أَبٍ أَوْ بَنِي أَبٍ وَأُمٍّ فَاجْعَلِ الْمِيرَاثَ بَيْنَهُمْ بِالسَّوَاءِ وَإِنْ كَانَ وَالِدُ بَعْضِهِمْ أَخَا وَالِدِ ذَلِكَ الْمُتَوَفَّى لِأَبِيهِ وَأُمِّهِ وَكَانَ وَالِدُ مَنْ سِوَاهُ إِنَّمَا هُوَ أَخُو وَالِدِ ذَلِكَ الْمُتَوَفَّى لِأَبِيهِ فَقَطْ فَإِنَّ الْمِيرَاثَ لِبَنِي الْأَبِ وَالْأُمِّ دُونَ بَنِي الْأَبِ وَالْجَدُّ أَبُو الْأَبِ أَوْلَى مِنِ ابْنِ الْأَخِ لِلْأَبِ وَالْأُمِّ وَأَوْلَى مِنَ الْعَمِّ أَخِي الْأَبِ لِلْأُمِّ وَالْأَبِ
[Machine] A man wrote their story in a newspaper and then brought it to him, so he read it and said, "Yes, I understand. Ad-Dhahak bin Qays told me that Umar bin Al-Khattab decided concerning the people of Amwas, that if they are from the father's side, then the maternal uncles have the right to the wealth. But if one of them is closest to them in terms of a father, then he has the right to the wealth."
رَجُلٌ فَكَتَبَ قِصَّتَهُمْ فِي صَحِيفَةٍ ثُمَّ جَاءَ بِهَا إِلَيْهِ فَقَرَأَهَا فَقَالَ نَعَمْ قَدْ فَهِمْتُ حَدَّثَنِي الضَّحَّاكُ بْنُ قَيْسٍ أَنَّ عُمَرَ بْنَ الْخَطَّابِ ؓ قَضَى فِي أَهْلِ طَاعُونَ عَمْوَاسٍ أَنَّهُمْ إِذَا كَانُوا مِنْ قِبَلِ الْأَبِ سَوَاءً فَبَنُو الْأُمِّ أَحَقُّ بِالْمَالِ فَإِنْ كَانَ أَحَدُهُمْ أَقْرَبَهُمْ بِأَبٍ فَهُوَ أَحَقُّ بِالْمَالِ
The Prophet ﷺ ruled that debts must be paid before carrying out bequests, and you recite the words, “after payment of legacies he (or she) may have bequeathed or debts” [an-Nisaʿ 4:12]. Brothers from the same mother and father inherit from one another, but brothers from different mothers do not. (Using translation from Aḥmad 1091)
قَضَى رَسُولُ اللهِ ﷺ بِالدَّيْنِ قَبْلَ الْوَصِيَّةِ وَأَنْتُمْ تَقْرَءُونَ {مِنْ بَعْدِ وَصِيَّةٍ يُوصَى بِهَا أَوْ دَيْنٍ} [النساء 12] وَإِنَّ أَعْيَانَ بَنِي الْأُمِّ يَتَوَارَثُونَ دُونَ بَنِي الْعَلَّاتِ الْإِخْوَةُ وَالْأَخَوَاتُ لِلْأَبِ وَالْأُمِّ دُونَ الْإِخْوَةِ وَالْأَخَوَاتِ لِلْأَبِ
34.34 [Machine] The inheritance of the cousin's two sons, one being a husband and the other a brother to their mother.
٣٤۔٣٤ بَابُ مِيرَاثِ ابْنَيْ عَمٍّ أَحَدُهُمَا زَوْجٌ وَالْآخَرُ أَخٌ لِأُمٍّ
The Prophet ﷺ said, "Give the Fara'id (the shares of the inheritance that are prescribed in the Qur'an) to those who are entitled to receive it; and whatever is left should be given to the closest male relative of the deceased." (Using translation from Bukhārī 6746)
عَنْ رَسُولِ اللهِ ﷺ قَالَ أَلْحِقُوا الْفَرَائِضَ بِأَهْلِهَا فَمَا تَرَكَتِ الْفَرَائِضُ فَلِأَوْلَى رَجُلٍ ذَكَرٍ
[Machine] "A man named Shurayh came and said: A woman left behind her two cousins, one of them her husband and the other her brother from her mother. He gave the husband half [of the wealth] and gave the brother from the mother what remained. Ali received this information and sent for Shurayh. He asked him, 'What did you decide?' Shurayh replied, 'I gave the husband half [of the wealth] and the brother from the mother what remained.' Ali then asked, 'Did you base your decision on the Book of Allah or the Sunnah of the Messenger of Allah ﷺ ?' Shurayh replied, 'Rather, I based it on the Book of Allah.' Ali asked, 'Where?' Shurayh said, 'In the verse, "And those with relationships are entitled to inherit from one another in the decree of Allah" [Quran 33:6].' Ali then asked, 'Did it say to give the husband half and give the brother from the mother what remained?' Then Ali gave the husband half and the brother from the mother one-sixth, and divided what remained between them. Shu'bah also narrated this from Aws al-Ansari."
عِقَالٍ قَالَ أُتِيَ شُرَيْحٌ فِي امْرَأَةٍ تَرَكَتِ ابْنَيْ عَمِّهَا أَحَدُهُمَا زَوْجُهَا وَالْآخَرُ أَخُوهَا لِأُمِّهَا فَأَعْطَى الزَّوْجَ النِّصْفَ وَأَعْطَى الْأَخَ مِنَ الْأُمِّ مَا بَقِيَ فَبَلَغَ ذَلِكَ عَلِيًّا ؓ فَأَرْسَلَ إِلَيْهِ فَقَالَ ادْعُو إِلَىَّ الْعَبْدَ الْأَبْطَرَ فَدُعِيَ شُرَيْحٌ فَقَالَ مَا قَضَيْتَ؟ قَالَ أَعْطَيْتُ الزَّوْجَ النِّصْفَ وَالْأَخَ مِنَ الْأُمِّ مَا بَقِيَ فَقَالَ عَلِيٌّ ؓ أَبِكِتَابِ اللهِ أَمْ بِسُنَّةٍ مِنْ رَسُولِ اللهِ ﷺ؟ فَقَالَ بَلْ بِكِتَابِ اللهِ فَقَالَ أَيْنَ؟ قَالَ شُرَيْحٌ {وَأُولُو الْأَرْحَامِ بَعْضُهُمْ أَوْلَى بِبَعْضٍ فِي كِتَابِ اللهِ} [الأحزاب 6] فَقَالَ عَلِيٌّ ؓ هَلْ قَالَ لِلزَّوْجِ النِّصْفُ وَلِهَذَا مَا بَقِيَ ثُمَّ أَعْطَى عَلِيٌّ ؓ الزَّوْجَ النِّصْفَ وَالْأَخَ مِنَ الْأُمِّ السُّدُسَ ثُمَّ مَا بَقِيَ قَسَّمَهُ بَيْنَهُمَا وَرَوَاهُ أَيْضًا شُعْبَةُ عَنْ أَوْسٍ الْأَنْصَارِيِّ
[Machine] Ali came to the door of his maternal cousin, one of whom is a brother to his mother. It was said to him, "Indeed Abdullah used to give all of the money to the brother of the mother." He said, "May Allah have mercy on him, if he was a jurist. If it were me, I would give the brother from the mother one-sixth, then I would divide what remains between them."
أُتِيَ عَلِيٌّ ؓ بِابْنَيْ عَمٍّ أَحَدُهُمَا أَخٌ لِأُمٍّ فَقِيلَ لَهُ إِنَّ عَبْدَ اللهِ كَانَ يُعْطِي الْأَخَ لِلْأُمِّ الْمَالَ كُلَّهُ قَالَ يَرْحَمُهُ اللهُ إِنْ كَانَ لَفَقِيهًا وَلَوْ كُنْتُ أَنَا لَأَعْطَيْتُ الْأَخَ مِنَ الْأُمِّ السُّدُسَ ثُمَّ لَقَسَمْتُ مَا بَقِيَ بَيْنَهُمَا
[Machine] Her two cousins, one being her husband and the other being her brother from her mother's side, left her. According to Ali and Zaid, the husband gets half and the brother from the mother gets one-third, and they are partners in what remains. According to Abdullah, the husband gets half and the brother from the mother gets the rest. Yazid supports the statement of Ali and Zaid.
تَرَكَتِ ابْنَيْ عَمِّهَا أَحَدُهُمَا زَوْجُهَا وَالْآخَرُ أَخُوهَا لِأُمِّهَا فِي قَوْلِ عَلِيٍّ وَزَيْدٍ ؓ لِلزَّوْجِ النِّصْفُ وَلِلْأَخِ مِنَ الْأُمِّ السُّدُسُ وَهُمَا شَرِيكَانِ فِيمَا بَقِيَ وَفِي قَوْلِ عَبْدِ اللهِ لِلزَّوْجِ النِّصْفُ وَلِلْأَخِ مِنَ الْأُمِّ مَا بَقِيَ قَالَ يَزِيدُ بِقَوْلِ عَلِيٍّ وَزَيْدٍ ؓ يُؤْخَذُ
34.35 [Machine] The inheritance by loyalty
٣٤۔٣٥ بَابُ الْمِيرَاثِ بِالْوَلَاءِ
[Machine] The loyalty is for us, so I mentioned that to the Messenger of Allah ﷺ and he said to me, "That should not prevent you, for loyalty belongs to whoever emancipates."
الْوَلَاءَ لَنَا فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللهِ ﷺ فَقَالَ لَا يَمْنَعْكِ ذَلِكَ؛ فَإِنَّ الْوَلَاءَ لِمَنْ أَعْتَقَ
