[Machine] "About the scholars from the people of Madinah, they used to say that every people who die in destruction, drowning, fire, or something similar, the death of some of them blinds the others before them. Therefore, they do not inherit from each other and are not entitled to be heirs. And because of this, the statement of Zaid bin Thabit was that and Umar bin Abdul Aziz ruled accordingly."  

البيهقي:١٢٢٥٣وَأَخْبَرَنَا أَبُو الْحَسَنِ الرَّفَّاءُ أنا عُثْمَانُ بْنُ مُحَمَّدِ بْنِ بِشْرٍ ثنا إِسْمَاعِيلُ الْقَاضِي ثنا ابْنُ أَبِي أُوَيْسٍ وَعِيسَى بْنُ مِينَاءٍ قَالَا ثنا ابْنُ أَبِي الزِّنَادِ

عَنِ الْفُقَهَاءِ مِنْ أَهْلِ الْمَدِينَةِ كَانُوا يَقُولُونَ كُلُّ قَوْمٍ مُتَوَارِثِينَ مَاتُوا فِي هَدْمٍ أَوْ غَرَقٍ أَوْ حَرِيقٍ أَوْ غَيْرِهِ فَعُمِّيَ مَوْتُ بَعْضِهِمْ قَبْلَ بَعْضٍ فَإِنَّهُمْ لَا يَتَوَارَثُونَ وَلَا يُحْجَبُونَ وَعَلَى ذَلِكَ كَانَ قَوْلُ زَيْدِ بْنِ ثَابِتٍ وَقَضَى بِذَلِكَ عُمَرُ بْنُ عَبْدِ الْعَزِيزِ
