33. The Found (1/3)
٣٣۔ كِتَابُ اللُّقَطَةِ ص ١
A man came to Messenger of Allah ﷺ and asked about Al-Luqata (a fallen thing). The Prophet ﷺ said, "Recognize its container and its tying material and then make a public announcement about it for one year and if its owner shows up, give it to him; otherwise use it as you like." The man said, "What about a lost sheep?" The Prophet ﷺ said, "It is for you, your brother or the wolf." The man said "What about a lost camel?" The Prophet ﷺ said, "Why should you take it as it has got its water-container (its stomach) and its hooves and it can reach the places of water and can eat the trees till its owner finds it?" (Using translation from Bukhārī 2372)
أَنَّهُ قَالَ جَاءَ رَجُلٌ إِلَى رَسُولِ اللهِ ﷺ يَسْأَلُهُ عَنِ اللُّقَطَةِ فَقَالَ اعْرِفْ عِفَاصَهَا وَوِكَاءَهَا ثُمَّ عَرِّفْهَا سَنَةً فَإِنْ جَاءَ صَاحِبُهَا وَإِلَّا فَشَأْنَكَ بِهَا قَالَ فَضَالَّةُ الْغَنَمِ؟ قَالَ لَكَ أَوْ لِأَخِيكَ أَوْ لِلذِّئْبِ قَالَ فَضَالَّةُ الْإِبِلِ؟ قَالَ مَا لَكَ وَلَهَا مَعَهَا سِقَاؤُهَا وَحِذَاؤُهَا تَرِدُ الْمَاءَ وَتَأَكُلُ الشَّجَرَ حَتَّى يَلْقَاهَا رَبُّهَا
[Machine] The Messenger of Allah ﷺ was asked about the found item, so he said, "Inform about it for a year, and if its owner comes, then give it to him, otherwise spend it." This narration is narrated by Ath-Thawri.
سُئِلَ رَسُولُ اللهِ ﷺ عَنِ اللُّقَطَةِ فَقَالَ عَرِّفْهَا سَنَةً فَإِنْ جَاءَ صَاحِبُهَا وَإِلَّا فَاسْتَنْفِقْهَا أَخْرَجَاهُ مِنْ حَدِيثِ الثَّوْرِيِّ
[Machine] He heard Zaid bin Khalid Al-Juhani, the companion of the Messenger of Allah ﷺ , saying: The Messenger of Allah ﷺ was asked about picking up gold or silver. He said, 'Acquire knowledge about its markings and specifications, and then identify it for a year. If it is not recognized, then spend it and let it be a trust with you. If its seeker comes one day, return it to him.' This narration is mentioned in Sahih from the Hadith of Sulaiman bin Bilal.
أَنَّهُ سَمِعَ زَيْدَ بْنَ خَالِدٍ الْجُهَنِيَّ صَاحِبَ رَسُولِ اللهِ ﷺ يَقُولُ سُئِلَ رَسُولُ اللهِ ﷺ عَنِ اللُّقَطَةِ الذَّهَبِ أَوِ الْوَرِقِ فَقَالَ اعْرِفْ وِكَاءَهَا وَعِفَاصَهَا ثُمَّ عَرِّفْهَا سَنَةً فَإِنْ لَمْ تُعْرَفْ فَاسْتَنْفِقْهَا وَلْتَكُنْ وَدِيعَةً عِنْدَكَ فَإِنْ جَاءَ طَالِبُهَا يَوْمًا مِنَ الدَّهْرِ فَأَدِّهَا إِلَيْهِ أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ سُلَيْمَانَ بْنِ بِلَالٍ
[Machine] He said, "The Messenger of Allah, ﷺ , was asked about a stray sheep. He said, 'It belongs to you, your brother, or the wolf.' He was asked about a camel, and he became angry and his face turned red. He said, 'It has its water bag and its owner's shoes, and it grazes the trees.' He was asked about expenditure, and he said, 'You should define it in details. If its owner comes, you give it to him. Otherwise, you know its wool or its back, then you dispose of it to its owner. If its owner comes, you give it to him.'"
أَنَّهُ قَالَ سُئِلَ رَسُولُ اللهِ ﷺ عَنِ الشَّاةِ الضَّالَّةِ فَقَالَ لَكَ أَوْ لِأَخِيكَ أَوْ لِلذِّئْبِ وَسُئِلَ عَنِ الْبَعِيرِ فَغَضِبَ وَاحْمَرَّ وَجْهُهُ فَقَالَ مَعَهُ سِقَاؤُهُ وَحِذَاؤُهُ يَرِدُ الْمَاءَ وَيَرْعَى الشَّجَرَ وَسُئِلَ عَنِ النَّفَقَةِ فَقَالَ تُعَرِّفُهَا حَوْلًا فَإِنْ جَاءَ صَاحِبُهَا دَفَعْتَهَا إِلَيْهِ وَإِلَّا عَرَفْتَ وِكَاءَهَا أَوْ عِفَاصَهَا ثُمَّ أَفَضْتَهَا فِي مَالِكَ فَإِنْ جَاءَ صَاحِبُهَا دَفَعْتَهَا إِلَيْهِ
[Machine] The Messenger of Allah, ﷺ , was asked about the stray animal, so he said: Define it for a year, then if it still remains unknown, define its look and its marks, and then consume it all. But if its owner comes, return it to him.
سُئِلَ رَسُولُ اللهِ ﷺ عَنِ اللُّقَطَةِ فَقَالَ عَرِّفْهَا سَنَةً فَإِنْ لَمْ تُعْتَرَفْ فَاعْرِفْ عِفَاصَهَا وَوِكَاءَهَا ثُمَّ كُلْهَا فَإِنْ جَاءَ صَاحِبُهَا فَارْدُدْهَا إِلَيْهِ
[Machine] I found a purse containing a hundred dinars from the time of the Messenger of Allah ﷺ . I brought it to the Messenger of Allah ﷺ and he asked me to describe it in detail. I described it in detail but couldn't find anyone who recognized it. So, I went back to him and he asked me to describe it again. I described it again but still couldn't find anyone who recognized it. I went back to him again and he asked me to describe it yet again. I described it again and still couldn't find anyone who recognized it. He then said, "Keep its count, container, and strap. If its owner comes, give it to him; otherwise, enjoy it." Salama (the narrator) said, "I don't know if he said 'describe it in three different ways' or 'describe it in detail'. The wording of the tradition is from Adam ﷺ and not from Sulayman ﷺ ."
لِي إِنِّي وَجَدْتُ صُرَّةً عَلَى عَهْدِ رَسُولِ اللهِ ﷺ فِيهَا مِائَةُ دِينَارٍ فَأَتَيْتُ بِهَا رَسُولَ اللهِ ﷺ فَقَالَ لِي عَرِّفْهَا حَوْلًا فَعَرَّفْتُهَا حَوْلًا فَلَمْ أَجِدْ مَنْ يَعْرِفُهَا فَعُدْتُ إِلَيْهِ فَقَالَ عَرِّفْهَا حَوْلًا فَعَرَّفْتُهَا ثُمَّ عُدْتُ إِلَيْهِ فَقَالَ عَرِّفْهَا حَوْلًا آخَرَ فَعَرَّفْتُهَا ثُمَّ عُدْتُ إِلَيْهِ قَالَ فِي الرَّابِعَةِ احْفَظْ عِدَّتَهَا وَوِعَاءَهَا وَوِكَاءَهَا فَإِنْ جَاءَ صَاحِبُهَا وَإِلَّا فَاسْتَمْتِعْ بِهَا قَالَ سَلَمَةُ لَا أَدْرِي أَقَالَ ثَلَاثَةَ أَحْوَالٍ عَرِّفْهَا أَوْ قَالَ حَوْلًا لَفْظُ حَدِيثِ آدَمَ وَلَيْسَ فِي حَدِيثِ سُلَيْمَانَ قَوْلُ سَلَمَةَ
“Whoever finds lost property, let him ask one or two men of good character to witness it, then he should not alter it nor conceal it. If its owner comes along, then he has more right to it, otherwise it belongs to Allah (SWT), Who gives it to whomsoever He wills.” (Using translation from Ibn Mājah 2505)
عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ مَنِ الْتَقَطَ لُقَطَةً فَلْيُشْهِدْ ذَوَيْ عَدْلٍ أَوْ ذَا عَدْلٍ وَلَا يَكْتُمْ وَلَا يُغَيِّبْ فَإِنْ جَاءَ صَاحِبُهَا فَهُوَ أَحَقُّ بِهَا وَإِلَّا فَهُوَ مَالُ اللهِ يُؤْتِيهِ مَنْ يَشَاءُ
[Machine] About the Messenger of Allah, it was asked about lost property. He said, "If it is found on a public road or in a central town, announce it to the people for a year, and if its owner comes, give it back to him, and if he does not come, it is yours. And if it is found in a ruin, it belongs to the finder, and if it is found in a well, it is subject to the one-fifth Islamic tax."
عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ سُئِلَ عَنِ اللُّقَطَةِ فَقَالَ مَا كَانَ مِنْهَا فِي طَرِيقِ الْمِئْتَاءِ وَالْقَرْيَةِ الْجَامِعَةِ فَعَرِّفُوهَا سَنَةً فَإِنْ جَاءَ صَاحِبُهَا فَادْفَعْهَا إِلَيْهِ وَإِنْ لَمْ يَأْتِ فَهِيَ لَكَ وَمَا كَانَ فِي الْخَرَابِ فَفِيهَا وَفِي الرِّكَازِ الْخُمُسُ
[Machine] Year, if it is known, then it is for you, and if not, then it is for the midwife in the season. So he mentioned it to him, and 'Umar said to him, "It is for you, for the Messenger of Allah ﷺ ordered us to do that." He said, "There is no need for me in it." So 'Umar took it and put it in the Bayt al-Mal. And it was narrated from 'Aisha that a woman asked her about the leftover, and she said, "Enjoy it."
سَنَةً فَإِنْ عُرِفَتْ فَذَاكَ وَإِلَّا فَهِيَ لَكَ فَلَمْ تُعْرَفْ فَلَقِيَهُ بِهَا الْقَابِلَ فِي الْمَوْسِمِ فَذَكَرَهَا لَهُ فَقَالَ عُمَرُ هِيَ لَكَ؛ فَإِنَّ رَسُولَ اللهِ ﷺ أَمَرَنَا بِذَلِكَ قَالَ لَا حَاجَةَ لِي فِيهَا فَقَبَضَهَا عُمَرُ فَجَعَلَهَا فِي بَيْتِ الْمَالِ وَرُوِّينَا عَنْ عَائِشَةَ ؓ أَنَّ امْرَأَةً سَأَلَتْهَا عَنِ اللُّقَطَةِ فَقَالَتْ اسْتَمْتِعِي بِهَا
[Machine] He found a dinar during the time of the Messenger of Allah ﷺ and he mentioned it to the Prophet ﷺ who ordered him to announce it, but no one came forward to claim it. So he ordered him to keep it and then the owner came and he ordered him to pay a fine. Al-Shafi'i and Ali ibn Abi Talib may Allah have mercy on them, both said it is prohibited for him to receive charity because he is from the descendants of Banu Hashim.
أَنَّهُ وَجَدَ دِينَارًا عَلَى عَهْدِ رَسُولِ اللهِ ﷺ فَذَكَرَهُ لِلنَّبِيِّ ﷺ فَأَمَرَهُ أَنْ يُعَرِّفَهُ فَلَمْ يُعْتَرَفْ فَأَمَرَهُ أَنْ يَأَكُلَهُ ثُمَّ جَاءَ صَاحِبُهُ فَأَمَرَهُ أَنْ يَغْرَمَهُ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ وَعَلِيُّ بْنُ أَبِي طَالِبٍ ؓ مِمَّنْ تَحْرُمُ عَلَيْهِ الصَّدَقَةُ؛ لِأَنَّهُ مِنْ صَلِيبَةِ بَنِي هَاشِمٍ
[Machine] Narrated by the Prophet ﷺ and they narrated a hadith from 'Amir from his father from Abdullah that he bought a slave girl. Her owner went away and he donated her price and said, "O Allah, for her owner if he dislikes (this action), then (the responsibility is) on me and (you may) support me." Then he said, "And this is how the willingness to give charity should be done (without any obligation). They contradicted the Sunnah in giving charity without obligation and they contradicted the hadith of Abdullah ibn Mas'ood which is in line with the Sunnah and it is established with them. And they used this hadith as evidence while they contradicted it in its essence." The Sheikh said, "And it has been narrated from Ali ibn Abi Talib from his statement that doesn't contradict the statement of the Iraqis."
عَنِ النَّبِيِّ ﷺ وَرَوَوْا حَدِيثًا عَنْ عَامِرٍ عَنْ أَبِيهِ عَنْ عَبْدِ اللهِ أَنَّهُ اشْتَرَى جَارِيَةً فَذَهَبَ صَاحِبُهَا فَتَصَدَّقَ بِثَمَنِهَا وَقَالَ اللهُمَّ عَنْ صَاحِبِهَا فَإِنْ كَرِهَ فَلِي وَعَلَيَّ الْغُرْمُ ثُمَّ قَالَ وَهَكَذَا يُفْعَلُ بِاللُّقَطَةِ فَخَالَفُوا السُّنَّةَ فِي اللُّقَطَةِ الَّتِي لَا حُجَّةَ مَعَهَا وَخَالَفُوا حَدِيثَ عَبْدِ اللهِ بْنِ مَسْعُودٍ الَّذِي يُوَافِقُ السُّنَّةَ وَهُوَ عِنْدَهُمْ ثَابِتٌ وَاحْتَجُّوا بِهَذَا الْحَدِيثِ وَهُمْ يُخَالِفُونَهُ فِيمَا هُوَ فِيهِ بِعَيْنِهِ قَالَ الشَّيْخُ وَقَدْ رُوِيَ عَنْ عَلِيِّ بْنِ أَبِي طَالِبٍ ؓ مِنْ قَوْلِهِ مَا يُوَافِقُ قَوْلَ الْعِرَاقِيِّينَ
[Machine] A man from the Banu Ru'as found a purse and brought it to Ali. He said, "I found a purse with coins in it, and I recognized it, but I couldn't find anyone who knew it. I hope that no one comes looking for it." Ali said, "Give it in charity, and if its owner comes and is satisfied, he will have the reward, and if he is not satisfied, you will be liable for it, and you will still have the reward." It is narrated by Asim ibn Damrah, who is not strong. We have also narrated it with connected authentic chains from the Prophet Muhammad ﷺ and it is more proper to follow the established Sunnah of the Messenger of Allah. And with Allah is the help.
أَنَّ رَجُلًا مِنْ بَنِي رُؤَاسٍ وَجَدَ صُرَّةً فَأَتَى بِهَا عَلِيًّا ؓ فَقَالَ إِنِّي وَجَدْتُ صُرَّةً فِيهَا دَرَاهِمَ وَقَدْ عَرَّفْتُهَا وَلَمْ أَجِدْ مَنْ يَعْرِفُهَا وَجَعَلْتُ أَشْتَهِي أَنْ لَا يَجِيءَ مَنْ يَعْرِفُهَا قَالَ تَصَدَّقْ بِهَا فَإِنْ جَاءَ صَاحِبُهَا فَرَضِيَ كَانَ لَهُ الْأَجْرُ وَإِنْ لَمْ يَرْضَ غَرِمْتَهَا وَكَانَ لَكَ الْأَجْرُ عَاصِمُ بْنُ ضَمْرَةَ غَيْرُ قَوِيٍّ وَقَدْ رُوِّينَا عَنْ عَلِيٍّ ؓ مَرْفُوعًا جَوَازَ الْأَكْلِ وَرُوِّينَاهُ بِأَسَانِيدَ صِحَاحٍ مَوْصُولَةٍ عَنِ النَّبِيِّ ﷺ وَسُنَّةُ رَسُولِ اللهِ ﷺ الثَّابِتَةُ أَوْلَى بِالِاتِّبَاعِ وَبِاللهِ التَّوْفِيقُ
[Machine] "That you should eat it, even if you wish, you would not take it." Abu Sa'eed added in his narration, "Al-Shafi'i Ibn Umar said, 'Perhaps he did not hear the Hadith from the Prophet ﷺ regarding the piece, and if we did not hear it, it is appropriate to say that he should not eat it, as Ibn Umar said.'"
أَنْ تَأَكُلَهَا وَلَوْ شِئْتَ لَمْ تَأْخُذْهَا زَادَ أَبُو سَعِيدٍ فِي رِوَايَتِهِ قَالَ الشَّافِعِيُّ ابْنُ عُمَرَ لَعَلَّهُ أَنْ لَا يَكُونَ سَمِعَ الْحَدِيثَ عَنِ النَّبِيِّ ﷺ فِي اللُّقَطَةِ وَلَوْ لَمْ نَسْمَعْهُ انْبَغَى أَنْ نَقُولَ لَا يَأْكُلُهَا كَمَا قَالَ ابْنُ عُمَرَ
ادْفَعْهَا إِلَى الْأَمِيرِ
33.2 [Machine] What is permissible for him to take and what is not permissible for him to take?
٣٣۔٢ بَابُ مَا يَجُوزُ لَهُ أَخْذُهُ وَمَا لَا يَجُوزُ مِمَّا يَجِدُهُ

أَنَّهُ قَالَ أَتَى رَجُلٌ إِلَى رَسُولِ اللهِ ﷺ وَأَنَا مَعَهُ فَسَأَلَهُ عَنِ اللُّقَطَةِ فَقَالَ اعْرِفْ عِفَاصَهَا وَوِكَاءهَا ثُمَّ عَرِّفْهَا سَنَةً فَإِنْ جَاءَ صَاحِبُهَا وَإِلَّا فَشَأْنَكَ بِهَا قَالَ فَضَالَّةُ الْغَنَمِ؟ قَالَ لَكَ أَوْ لِأَخِيكَ أَوْ لِلذِّئْبِ قَالَ فَضَالَّةُ الْإِبِلِ؟ قَالَ مَعَهَا حِذَاؤُهَا وَسِقَاؤُهَا وَتَرِدُ الْمَاءَ وَتَأْكُلُ الشَّجَرَ حَتَّى يَلْقَاهَا رَبُّهَا
A man asked the Messenger of Allah (SWAS) about a find. He said: Make the matter known for a year, then note its string and its container and then use it for your purpose. Then if its owner comes, give it to him. He asked : Messenger of Allah, what about a stray sheep? He replied: Take it; that is for you, or for your brother, or for the wolf. He again asked: Messenger of Allah, What about stray camels? The Messenger of Allah (SWAS) became angry so much so that his cheeks became red or ( the narrator is doubtful) his face became red. He replied: What have you to do with them? They have with them their feet and their stomachs (for drink) till their master comes to him. (Using translation from Abū Dāʾūd 1704)
أَنَّ رَجُلًا سَأَلَ رَسُولَ اللهِ ﷺ عَنِ اللُّقَطَةِ فَقَالَ عَرِّفْهَا سَنَةً ثُمَّ اعْرِفْ وِكَاءَهَا وَعِفَاصَهَا ثُمَّ اسْتَنْفِقْ بِهَا فَإِنْ جَاءَ رَبُّهَا فَأَدِّهَا إِلَيْهِ فَقَالَ يَا رَسُولَ اللهِ فَضَالَّةُ الْغَنَمِ؟ قَالَ خُذْهَا؛ فَإِنَّمَا هِيَ لَكَ أَوْ لِأَخِيكَ أَوْ لِلذِّئْبِ قَالَ يَا رَسُولَ اللهِ فَضَالَّةُ الْإِبِلِ؟ قَالَ فَغَضِبَ رَسُولُ اللهِ ﷺ حَتَّى احْمَرَّتْ وَجْنَتَاهُ أَوِ احْمَرَّ وَجْهُهُ قَالَ مَا لَكَ وَلَهَا؟ مَعَهَا حِذَاؤُهَا وَسِقَاؤُهَا حَتَّى يَلْقَاهَا رَبُّهَا وَقَالَ يَحْيَى عَنْ أَيُّوبَ دَعْهَا حَتَّى يَلْقَاهَا رَبُّهَا
Recognise well the strap and the bag (containing) that and then make an announcement regarding that for one year, but if none recognises it, then spend that and it would be a trust with you; and if someone comes one day to make demand of that, then pay that to him. He (the inquirer) asked about the lost camel, whereupon he said: You have nothing to do with that. Leave that alone, for it has feet and also a leather bag, it drinks water, and eats (the leaves) of the trees. He asked him about sheep, whereupon he said: Take it, it is for you, or for your brother, or for the wolf. (Using translation from Muslim 1722e)
أَنَّهُ سَمِعَ زَيْدَ بْنَ خَالِدٍ الْجُهَنِيَّ صَاحِبَ رَسُولِ اللهِ ﷺ يَقُولُ سُئِلَ رَسُولُ اللهِ ﷺ عَنِ اللُّقَطَةِ الذَّهَبِ أَوِ الْوَرِقِ فَقَالَ اعْرِفْ وِكَاءهَا وَعِفَاصَهَا ثُمَّ عَرِّفْهَا سَنَةً فَإِنْ لَمْ تُعْتَرَفْ فَاسْتَنْفِقْهَا وَلْتَكُنْ وَدِيعَةً عِنْدَكَ فَإِنْ جَاءَ طَالِبُهَا يَوْمًا مِنَ الدَّهْرِ فَأَدِّهَا إِلَيْهِ وَسَأَلَهُ عَنْ ضَالَّةِ الْإِبِلِ فَقَالَ مَا لَكَ وَلَهَا؟ دَعْهَا؛ فَإِنَّ مَعَهَا حِذَاءَهَا وَسِقَاءَهَا تَرِدُ الْمَاءَ وَتَأْكُلُ الشَّجَرَ حَتَّى يَجِدَهَا رَبُّهَا وَسَأَلَهُ عَنِ الشَّاةِ فَقَالَ خُذْهَا؛ فَإِنَّمَا هِيَ لَكَ أَوْ لِأَخِيكَ أَوْ لِلذِّئْبِ
[Machine] I heard a man from Muzaynah ask the Messenger of Allah ﷺ , and I have heard about the stray camel. The Prophet replied, "If it has its water bag and shoes, the wolf will not eat it. It will drink water and eat from trees, so leave it in its place until its owner comes. The man asked, "What about a stray sheep?" The Prophet said, "It belongs to you, your brother, or the wolf, so gather them until their owner comes." The man asked, "What if he cannot be found?" The Prophet said, "If it was not found in the inhabited areas or on the dangerous roads, recognize it as a year's sustenance, but if the owner comes, return it to him. The man asked, "O Messenger of Allah, what about abandoned property in the city?" The Prophet replied, "It includes the fifth of the discovered property." This was narrated by 'Amr bin Al-Harith and Hisham bin Sa'd from 'Amr bin Shu'aib from his father from Ibn 'Umar, and its meaning is the same. The man asked, "What about stray sheep?" The Prophet said, "If there is edible food for you, your brother, or the wolf, then keep it for your brother. This is the narration found in the book of Zakah."
سَمِعْتُ رَجُلًا مِنْ مُزَيْنَةَ سَأَلَ رَسُولَ اللهِ ﷺ وَأَنَا أَسْمَعُ عَنِ الضَّالَّةِ مِنَ الْإِبِلِ فَقَالَ مَعَهَا سِقَاؤُهَا وَحِذَاؤُهَا لَا يَأْكُلُهَا الذِّئْبُ تَرِدُ الْمَاءَ وَتَأْكُلُ الشَّجَرَ فَدَعْهَا مَكَانَهَا حَتَّى يَأْتِيَ بَاغِيهَا قَالَ فَضَالَّةُ الْغَنَمِ قَالَ لَكَ أَوْ لِأَخِيكَ أَوْ لِلذِّئْبِ اجْمَعْهَا حَتَّى يَأْتِيَهَا بَاغِيهَا قَالَ اللُّقَطَةُ يَجِدُهَا؟ قَالَ مَا كَانَ فِي الْعَامِرَةِ وَالسَّبِيلِ الْغَامِرَةِ فَعَرِّفْهَا سَنَةً فَإِنْ جَاءَ بَاغِيهَا فَأَدِّهَا إِلَيْهِ وَإِلَّا فَهِيَ لَكَ قَالَ يَا رَسُولَ اللهِ فَمَا يُوجَدُ فِي الْقَرْيَةِ الْخَرَابِ الْعَادِيِّ؟ قَالَ فِيهِ وَفِي الرِّكَازِ الْخُمُسُ وَرَوَاهُ عَمْرُو بْنُ الْحَارِثِ وَهِشَامُ بْنُ سَعْدٍ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ عَبْدِ اللهِ بْنِ عُمَرَ وَبِمَعْنَاهُ قَالَ فِيهِ فَكَيْفَ تَرَى فِي ضَالَّةِ الْغَنَمِ؟ قَالَ طَعَامٌ مَأْكُولٌ لَكَ أَوْ لِأَخِيكَ أَوْ لِلذِّئْبِ احْبِسْ عَلَى أَخِيكَ ضَالَّتَهُ وَقَدْ مَضَى بِإِسْنَادِهِ فِي كِتَابِ الزَّكَاةِ
“I was with my father in Bawazij and the cows came back in the evening. He saw a cow did not recognize it. He said: 'What is this?' He said: 'A cow that joined the herd.' And he issued orders that it be driven away until it disappeared from view. Then he said: 'I heard the Messenger of Allah ﷺ say: “No one gives refuge to a stray animal but one who is also astray.” (Using translation from Ibn Mājah 2503)
كُنْتُ مَعَ أَبِي بِالْبَوَازِيجِ بِالسَّوَادِ فَرَاحَتِ الْبَقَرُ فَرَأَى بَقَرَةً أَنْكَرَهَا فَقَالَ مَا هَذِهِ الْبَقَرَةُ؟ قَالُوا بَقَرَةٌ لَحِقَتْ بِالْبَقَرِ فَأَمَرَ بِهَا فَطُرِدَتْ حَتَّى تَوَارَتْ ثُمَّ قَالَ سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ لَا يَأْوِي الضَّالَّةَ إِلَّا ضَالٌّ
[Machine] I said, "O Messenger of Allah, if a stray camel comes to me, should I leave it?" He said, "The stray animal of a Muslim is the fire, so likewise."
قُلْتُ يَا رَسُولَ اللهِ تَأْتِي عَلَيَّ ضَالَّةُ الْإِبِلِ فَأَتْرُكُهَا؟ فَقَالَ ضَالَّةُ الْمُسْلِمِ حَرْقُ النَّارِ وَكَذَلِكَ
[Machine] "The Prophet ﷺ said, 'The aim of the believer is to protect from the fire of Hell, and likewise...'"
أَنَّ النَّبِيَّ ﷺ قَالَ ضَالَّةُ الْمُؤْمِنِ حَرْقُ النَّارِ وَكَذَلِكَ
[Machine] "We came to the Messenger of Allah ﷺ while we were on lean camels. We said, 'O Messenger of Allah, we pass through rough terrains and occasionally find camels to ride.' He replied, 'The loss of a Muslim's property is equivalent to the burning of fire.' It is narrated from Yazid from his brother Mutarraf from Al-Jarood."
أَتَيْنَا رَسُولَ اللهِ ﷺ وَنَحْنُ عَلَى إِبِلٍ عِجَافٍ فَقُلْنَا يَا رَسُولَ اللهِ إِنَّا نَمُرُّ بِالْجُرُفِ فَنَجِدُ إِبِلًا فَنَرْكَبُهَا فَقَالَ ضَالَّةُ الْمُسْلِمِ حَرْقُ النَّارِ وَقِيلَ عَنْهُ عَنْ يَزِيدَ عَنْ أَخِيهِ مُطَرِّفٍ عَنِ الْجَارُودِ
[Machine] From Al-Jarood Al-Abdi, he raised it to the Prophet ﷺ who said, "The lost sheep of a Muslim is the burning of fire; so do not approach it." It has been said about him, from Mutarraf, from Abu Muslim, from Al-Jarood. And it has been said about Mutarraf ibn Abdullah ibn Al-Shakheer, from his father.
عَنِ الْجَارُودِ الْعَبْدِيِّ يَرْفَعُهُ إِلَى النَّبِيِّ ﷺ قَالَ ضَالَّةُ الْمُسْلِمِ حَرْقُ النَّارِ؛ فَلَا تَقْرَبُنَّهَا وَقَدْ قِيلَ عَنْهُ عَنْ مُطَرِّفٍ عَنْ أَبِي مُسْلِمٍ عَنِ الْجَارُودِ وَقَدْ قِيلَ عَنْ مُطَرِّفِ بْنِ عَبْدِ اللهِ بْنِ الشِّخِّيرِ عَنْ أَبِيهِ
[Machine] A man asked the Prophet ﷺ and said, "We are afflicted with hardships in our camels." The Prophet replied, "The losses of a Muslim or a believer are the burning of fire."
أَنَّ رَجُلًا سَأَلَ النَّبِيَّ ﷺ فَقَالَ إِنَّا نُصِيبُ هَوَامِيَ الْإِبِلِ فَقَالَ ضَالَّةُ الْمُسْلِمِ أَوِ الْمُؤْمِنِ حَرْقُ النَّارِ
[Machine] And he is a leaning support against the Kaaba, whoever takes a stray object, he is a stray.
وَهُوَ مُسْنِدٌ ظَهْرَهُ إِلَى الْكَعْبَةِ مَنْ أَخَذَ ضَالَّةً فَهُوَ ضَالٌّ
[Machine] The Bedouin said to the Prophet ﷺ , "I see that you have made the people excluding me. Did you make up a turn for me?" The Prophet ﷺ replied, "Woe to you, do not ask this question." The Bedouin asked, "And how intense is your questioning?" The Prophet ﷺ replied, "Seek forgiveness from Allah and draw closer to Him, and delay what you have done." The Bedouin asked, "Do you know where this verse was revealed?" The Prophet ﷺ replied, "Do not ask about things that if they were revealed to you, they would sadden you." He continued reciting the rest of the verse, "O you who have believed, do not ask about things which, if they are shown to you, will distress you." The Prophet ﷺ then explained that there was a group of people who used to mock him when they would say, "Whose son am I?" and "Where is my camel?" So Allah revealed this verse in response to their mocking.
الْأَعْرَابِيُّ أُرَاكَ قَدْ أَصْدَرْتَ النَّاسَ غَيْرِي أَفَتَرَى لِي نَوْبَةً؟ قَالَ وَيْلَكَ لَا تَسْأَلْ هَذِهِ الْمَسْأَلَةَ قَالَ وَمَا أَشَدَّ مَسْأَلَتَكَ قَالَ اسْتَغْفِرِ اللهَ وَأَقْرِبْ إِلَيْهِ وَأَجِلَّ مَا صَنَعْتَ قَالَ أَتَدْرِي فِيمَا نَزَلَتْ هَذِهِ الْآيَةُ {يَا أَيُّهَا الَّذِينَ آمَنُوا لَا تَسْأَلُوا عَنْ أَشْيَاءَ إَنْ تُبْدَ لَكُمْ تَسُؤْكُمْ} [المائدة 101] حَتَّى فَرَغَ مِنَ الْآيَةِ كُلِّهَا قَالَ كَانَ قَوْمٌ يَسْأَلُونَ رَسُولَ اللهِ ﷺ اسْتِهْزَاءً فَيَقُولُ الرَّجُلُ مَنْ أَبِي؟ وَيَقُولُ الرَّجُلُ تَضِلُّ نَاقَتُهُ أَيْنَ نَاقَتِي؟ فَأَنْزَلَ اللهُ ﷻ فِيهِ هَذِهِ الْآيَةَ
[Machine] Narrated by the Prophet ﷺ, he said, "The lost camel that is branded and has its bell removed belongs to its finder and its similar is with it."
عَنِ النَّبِيِّ ﷺ قَالَ ضَالَّةُ الْإِبِلِ الْمَكْتُومَةُ غَرَامَتُهَا وَمِثْلُهَا مَعَهَا
33.3 [Machine] The man finds a lost item, he wants to return it to its owner, does not want to eat it.
٣٣۔٣ بَابُ الرَّجُلِ يَجِدُ ضَالَّةً يُرِيدُ رَدَّهَا عَلَى صَاحِبِهَا لَا يُرِيدُ أَكْلَهَا
[Machine] "The Messenger of Allah ﷺ said: "Whoever shelters a stray is considered lost until he reveals its identity.""
عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ قَالَ مَنْ آوَى ضَالَّةً فَهُوَ ضَالٌّ مَا لَمْ يُعَرِّفْهَا
[Machine] He said: Go and send him from where you took him and with his meaning.
لَهُ اذْهَبْ فَأَرْسِلْهُ مِنْ حَيْثُ أَخَذْتَهُ وَبِمَعْنَاهُ
[Machine] He heard Ibn Shihab say that the stray camels in the time of Umar ibn al-Khattab were branded, and their offspring would not be touched until the time of Uthman ibn Affan. Uthman then ordered for their identification and registration, and they were sold. When their owner came, they were given their price.
أَنَّهُ سَمِعَ ابْنَ شِهَابٍ يَقُولُ كَانَتْ ضَوَالُّ الْإِبِلِ فِي زَمَانِ عُمَرَ بْنِ الْخَطَّابِ ؓ إِبِلًا مُؤَبَّلَةً تَنَاتَجُ لَا يَمَسُّهَا حَتَّى إِذَا كَانَ زَمَانُ عُثْمَانَ بْنِ عَفَّانَ ؓ أَمَرَ بِمَعْرِفَتِهَا وَتَعْرِيفِهَا ثُمَّ تُبَاعُ فَإِذَا جَاءَ صَاحِبُهَا أُعْطِيَ ثَمَنَهَا
33.4 [Machine] Selection in taking a shot if it is from a trustworthy person, and whoever chooses to abandon it
٣٣۔٤ بَابُ الِاخْتِيَارِ فِي أَخْذِ اللُّقَطَةِ إِذَا كَانَ مِنْ أَهْلِ الْأَمَانَةِ، وَمَنِ اخْتَارَ تَرْكَهَا
[Machine] You did well. You did well. Indeed, I found a pouch containing a hundred dinars during the time of the Messenger of Allah ﷺ. So, I went to the Prophet ﷺ and he said, "Describe it in detail." So, I described it in detail. Then, I went to him again and he said, "Describe it in detail." So, I described it in detail. Then, I went to him again and he said, "Describe it in detail." So, I described it in detail. Then, after some time, I brought it to him. He said, "Tell me its number, contents, and container. If anyone comes and informs you about its number and contents, then give it to him. Otherwise, you may keep it."
أَحْسَنْتَ أَحْسَنْتَ إِنِّي وَجَدْتُ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ صُرَّةً فِيهَا مِائَةُ دِينَارٍ فَأَتَيْتُ النَّبِيَّ ﷺ فَقَالَ عَرِّفْهَا حَوْلًا فَعَرَّفْتُهَا حَوْلًا ثُمَّ أَتَيْتُهُ فَقَالَ عَرِّفْهَا حَوْلًا فَعَرَّفْتُهَا حَوْلًا ثُمَّ أَتَيْتُهُ فَقَالَ عَرِّفْهَا حَوْلًا ثُمَّ أَتَيْتُ بِهَا بَعْدَ أَحْوَالٍ ثَلَاثَةٍ فَقَالَ اعْرِفْ عَدَدَهَا وَوِكَاءَهَا وَوِعَاءَهَا فَإِنْ جَاءَ أَحَدٌ يُخْبِرُكَ بِعَدَدِهَا وَوِكَائِهَا فَادْفَعْهَا إِلَيْهِ وَإِلَّا فَاسْتَمْتِعْ بِهَا
[Machine] "Do not lift it from the ground, for you do not have anything to do with it, meaning the picking up, and the statement of Abdullah ibn Umar in that has already passed in the first matter."
لَا تَرْفَعْهَا مِنَ الْأَرْضِ لَسْتَ مِنْهَا فِي شَيْءٍ يَعْنِي اللُّقَطَةَ وَقَوْلُ عَبْدِ اللهِ بْنِ عُمَرَ فِي ذَلِكَ قَدْ مَضَى فِي الْمَسْأَلَةِ الْأُولَى
33.5 [Machine] Definition and knowledge of a snapshot and testimony about it.
٣٣۔٥ بَابُ تَعْرِيفِ اللُّقَطَةِ وَمَعْرِفَتِهَا وَالْإِشْهَادِ عَلَيْهَا
[Machine] He said that a man came to the Messenger of Allah ﷺ and asked him about "Al-Luqatah" (lost property). The Messenger of Allah ﷺ said, "Know its description and its container, then describe it for a year. If its owner comes, give it to him, otherwise, it is yours." This is mentioned in the authentic narration of Malik and its meaning.
أَنَّهُ قَالَ جَاءَ رَجُلٌ إِلَى رَسُولِ اللهِ ﷺ فَسَأَلَهُ عَنِ اللُّقَطَةِ فَقَالَ اعْرِفْ عِفَاصَهَا وَوِكَاءَهَا ثُمَّ عَرِّفْهَا سَنَةً فَإِنْ جَاءَ صَاحِبُهَا وَإِلَّا فَشَأْنَكَ بِهَا أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ مَالِكٍ وَبِمَعْنَاهُ
[Machine] In the Hadith, he defined her as a year, then defined her wrinkles and blemishes, then spent on her. If her Lord comes, he hands her over to him. Abu Ali al-Rudhbari informed us that Muhammad ibn Bakr told us that Abu Dawud told us that Qutaybah ibn Saeed told us that Ismail ibn Jafar mentioned it, and it was narrated by Thawri from Rabee'ah.
فِي الْحَدِيثِ عَرِّفْهَا سَنَةً ثُمَّ اعْرِفْ وِكَاءَهَا وَعِفَاصَهَا ثُمَّ اسْتَنْفِقْ بِهَا فَإِنْ جَاءَ رَبُّهَا فَأَدِّهَا إِلَيْهِ أَخْبَرَنَاهُ أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ مُحَمَّدُ بْنُ بَكْرٍ ثنا أَبُو دَاوُدَ ثنا قُتَيْبَةُ بْنُ سَعِيدٍ ثنا إِسْمَاعِيلُ بْنُ جَعْفَرٍ فَذَكَرَهُ وَقَدْ مَضَى بِطُولِهِ وَرَوَاهُ الثَّوْرِيُّ عَنْ رَبِيعَةَ
[Machine] An Arab came to the Prophet ﷺ and asked him about a lost sheep. The Prophet ﷺ told him to first describe it, then describe its size, its udder, and its drinking trough. If its owner comes, then give it to him, otherwise, spend it or enjoy it. The man asked, "O Messenger of Allah, what about a lost camel?" The Prophet's face changed and he said, "What do you have to do with it? It has its saddle and water container. It goes back to drinking and eating from trees. Leave it until it meets its owner."
جَاءَ أَعْرَابِيٌّ إِلَى النَّبِيِّ ﷺ فَسَأَلَهُ عَنِ اللُّقَطَةِ فَقَالَ عَرِّفْهَا سَنَةً ثُمَّ اعْرِفْ عِفَاصَهَا وَوِكَاءَهَا وَوِعَاءَهَا فَإِنْ جَاءَ صَاحِبُهَا فَادْفَعْهَا إِلَيْهِ وَإِلَّا فَاسْتَنْفِقْهَا أَوِ اسْتَمْتِعْ بِهَا فَقَالَ يَا رَسُولَ اللهِ ضَالَّةُ الْغَنَمِ؟ فَقَالَ إِنَّمَا هِيَ لَكَ أَوْ لِأَخِيكَ أَوْ لِلذِّئْبِ فَسَأَلَهُ عَنْ ضَالَّةِ الْإِبِلِ فَتَغَيَّرَ وَجْهُهُ وَقَالَ مَا لَكَ وَلَهَا؟ مَعَهَا حِذَاؤُهَا وَسِقَاؤُهَا تَرِدُ الْمَاءَ تَأَكُلُ الشَّجَرَ دَعْهَا حَتَّى تَلْقَى رَبَّهَا
[Machine] "On the authority of the Prophet ﷺ who said: 'Whoever finds a lost item, let them announce it for a year. If its owner comes, they should return it to him. If not, then let them announce its description and features, and then they may consume it. If its owner comes afterward, they should return it to him.'"
عَنِ النَّبِيِّ ﷺ قَالَ مَنِ الْتَقَطَ لُقَطَةً فَلْيُعَرِّفْهَا سَنَةً فَإِنْ جَاءَ رَبُّهَا وَإِلَّا فَلْيَعْرِفْ عَدَدَهَا وَوِكَاءَهَا ثُمَّ لِيُأْكُلْهَا فَإِنْ جَاءَ صَاحِبُهَا فَلْيَرُدَّهَا عَلَيْهِ
[Machine] I found a purse containing a hundred dinars during the time of the Prophet Muhammad ﷺ . I went to the Prophet ﷺ and said, "Identify its owner." I described it, but no one recognized it. I returned to him and he said the same thing three times. Then he said, "Keep count of its contents, its container, and its strap, and if its owner comes forward, give it to him; otherwise, enjoy it." So, I enjoyed it. Salamah said, "I do not know whether I described it properly three times or there were three different descriptions."
إِنِّي وَجَدْتُ صُرَّةً عَلَى عَهْدِ رَسُولِ اللهِ ﷺ فِيهَا مِائَةُ دِينَارٍ فَأَتَيْتُ النَّبِيَّ ﷺ فَقَالَ عَرِّفْهَا حَوْلًا فَعَرَّفْتُهَا حَوْلًا فَلَمْ أَجِدْ أَحَدًا يَعْرِفُهَا فَعُدْتُ إِلَيْهِ فَقَالَ مِثْلَ ذَلِكَ ثَلَاثَ مَرَّاتٍ فَقَالَ احْفَظْ عِدَّتَهَا وَوِعَاءَهَا وَوِكَاءَهَا فَإِنْ جَاءَ صَاحِبُهَا وَإِلَّا فَاسْتَمْتِعْ بِهَا قَالَ فَاسْتَمْتَعْتُ بِهَا قَالَ سَلَمَةُ لَا أَدْرِي عَرَّفَهَا حَوْلًا إِلَى ثَلَاثَةِ أَحْوَالٍ أَوْ فِي الْحَوْلِ
The Prophet ﷺ said: He who finds something should call one or two trusty persons as witnesses and not conceal it or cover it up; then if he finds its owner he should return it to him, otherwise it is Allah's property which He gives to whom He will. (Using translation from Abū Dāʾūd 1709)
قَالَ رَسُولُ اللهِ ﷺ مَنْ وَجَدَ لُقَطَةً فَلْيُشْهِدْ ذَا عَدْلٍ أَوْ ذَوَيْ عَدْلٍ وَلَا يَكْتُمْ وَلَا يُغَيِّبْ فَإِذَا وَجَدَ صَاحِبَهَا فَلْيَرُدَّهَا عَلَيْهِ وَإِلَّا فَهِيَ مَالُ اللهِ يُؤْتِيهِ مَنْ يَشَاءُ
[Machine] His age is known at the doors of the mosque, and mention it to whoever comes from Sham after a year has passed, and then it becomes your concern.
لَهُ عُمَرُ ؓ عَرِّفْهَا عَلَى أَبْوَابِ الْمَسْجِدِ وَاذْكُرْهَا لِمَنْ يَقْدَمُ مِنَ الشَّامِ سَنَةً فَإِذَا أَمْضَتِ السَّنَةَ فَشَأْنَكَ بِهَا
33.6 [Machine] Statement of the duration of the definition The narration of Zaid bin Khalid Al-Juhani and Abdullah bin Amr bin al-Aas agreed upon the definition of the particle for one year. The narration has passed from them and also from Umar bin Khattab from the Prophet ﷺ and from Uqbah bin Suwaid from his father from the Prophet ﷺ. As for the hadith of Salamah bin Kuhail from Suwaid bin Ghafalah, from Ubay bin Ka'b, from the Prophet ﷺ, the narration of Al-A'mash, Zaid bin Abi Unaisah, and Hammad from Salamah bin Kuhail indicates that it has three different versions. And we have also narrated from Shu'bah from Salamah likewise. Shu'bah said: I met him (Salamah bin Kuhail) after that in Makkah and he said, "I don't know if it's three versions or one version.
٣٣۔٦ بَابُ بَيَانِ مُدَّةِ التَّعْرِيفِ اتَّفَقَتْ رِوَايَةُ زَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ وَعَبْدِ اللهِ بْنِ عَمْرِو بْنِ الْعَاصِ ، عَنِ النَّبِيِّ ﷺ، عَلَى تَعْرِيفِ اللُّقَطَةِ سَنَةً وَاحِدَةً، وَقَدْ مَضَتِ الرِّوَايَةُ عَنْهُمَا، وَكَذَلِكَ عَنْ عُمَرَ بْنِ الْخَطَّابِ عَنِ النَّبِيِّ ﷺ، وَعَنْ عُقْبَةَ بْنِ سُوَيْدٍ، عَنْ أَبِيهِ، عَنِ النَّبِيِّ ﷺ , وَأَمَّا حَدِيثُ سَلَمَةَ بْنِ كُهَيْلٍ عَنْ سُوَيْدِ بْنِ غَفَلَةَ، عَنْ أُبِيِّ بْنِ كَعْبٍ ، عَنِ النَّبِيِّ ﷺ , فَرِوَايَةُ الْأَعْمَشِ وَزَيْدِ بْنِ أَبِي أُنَيْسَةَ وَحَمَّادٍ عَنْ سَلَمَةَ بْنِ كُهَيْلٍ تَدُلُّ عَلَى أَنَّهُ يُعَرِّفُهَا ثَلَاثَةَ أَحْوَالٍ. وَرُوِّينَا عَنْ شُعْبَةَ عَنْ سَلَمَةَ كَذَلِكَ، قَالَ شُعْبَةُ: فَلَقِيتُهُ بَعْدَ ذَلِكَ بِمَكَّةَ، فَقَالَ: لَا أَدْرِي ثَلَاثَةَ أَحْوَالٍ أَوْ حَوْلًا وَاحِدًا
[Machine] Obayy bin Ka'b, I found a purse containing one hundred dinars during the time of the Messenger of Allah ﷺ . So, I went to the Messenger of Allah ﷺ and told him about it. He said, "Make an announcement about it for a year." I made the announcement but did not find anyone who claimed it. So, he said, "Keep its count, its container, and its contents, and if its owner comes, give it to him, otherwise, utilize it." Shu'bah said, "After that, I met Salamah and he said, 'I'm not sure if he meant three different things or one thing.' I liked this hadith, so I said to Abu Sa'diq, 'Come, let me tell you about it and hear it from him.' Abu Sa'diq narrated it from Buhz bin Asad, who narrated it from Shu'bah, who narrated it from Salamah." Shu'bah said, "I heard it from him ten years later, and he said, 'Make an announcement about it for one year.'" 12092 Abu Abdullah Al-Hafiz informed us, Abu Al-Fadl bin Ibrahim narrated to us, Ahmed bin Salamah narrated to us, Abdul Rahman bin Bishr narrated to us, Buhz narrated to us, Shu'bah mentioned it.
أُبِيُّ بْنُ كَعْبٍ وَجَدْتُ صُرَّةً فِيهَا مِائَةُ دِينَارٍ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ فَأَتَيْتُ رَسُولَ اللهِ ﷺ فَذَكَرْتُ ذَلِكَ لَهُ فَقَالَ عَرِّفْهَا حَوْلًا فَعَرَّفْتُهَا فَلَمْ أَجِدْ مَنْ يَعْرِفُهَا ثَلَاثَ مَرَّاتٍ فَقَالَ احْفَظْ عَدَدَهَا وَوِكَاءَهَا وَوِعَاءَهَا فَإِنْ جَاءَ صَاحِبُهَا وَإِلَّا فَاسْتَمْتِعْ بِهَا قَالَ شُعْبَةُ فَلَقِيتُ سَلَمَةَ بَعْدَ ذَلِكَ فَقَالَ لَا أَدْرِي ثَلَاثَةَ أَحْوَالٍ أَوْ حَوْلًا وَاحِدًا فَأَعْجَبَنِي هَذَا الْحَدِيثُ فَقُلْتُ لِأَبِي صَادِقٍ تَعَالَ فَاسْمَعْهُ مِنْهُ وَرَوَاهُ بَهْزُ بْنُ أَسَدٍ عَنْ شُعْبَةَ عَنْ سَلَمَةَ قَالَ شُعْبَةُ فَسَمِعْتُهُ بَعْدَ عَشْرِ سِنِينَ يَقُولُ عَرِّفْهَا عَامًا وَاحِدًا 12092 أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ أَبُو الْفَضْلِ بْنُ إِبْرَاهِيمَ ثنا أَحْمَدُ بْنُ سَلَمَةَ ثنا عَبْدُ الرَّحْمَنِ بْنُ بِشْرٍ ثنا بَهْزٌ ثنا شُعْبَةُ فَذَكَرَهُ
[Machine] This is a provision that Allah has provided for us. All praise is due to Allah. He bought meat and food with it, and prepared the food. Then he said to Fatimah, peace be upon her, "Send to your father and inform him, if he finds it permissible, we will eat it." So when they made the food, they called the Messenger of Allah, ﷺ . When he arrived, they mentioned that to him. The Messenger of Allah, ﷺ , said, "This is provision from Allah." So he ate from it, and they ate as well. Then, after that, a woman came asking for a specific amount of money, saying, "I ask Allah for this amount of money." The Messenger of Allah, ﷺ , said, "O Ali, give her the money."
هَذَا رِزْقٌ رَزَقَنَا اللهُ ﷻ لِلَّهِ الْحَمْدُ فَاشْتَرَى بِهِ لَحْمًا وَطَعَامًا فَهَيَّأَ طَعَامًا فَقَالَ لِفَاطِمَةَ عَلَيْهَا السَّلَامُ أَرْسِلِي إِلَى أَبِيكِ فَتُخْبِرِيهِ فَإِنْ رَآهُ حَلَالًا أَكَلْنَاهُ فَلَمَّا صَنَعُوا طَعَامًا دَعَوْا رَسُولَ اللهِ ﷺ فَلَمَّا أَتَى ذَكَرُوا ذَلِكَ لَهُ فَقَالَ رَسُولُ اللهِ ﷺ هُوَ رِزْقُ اللهِ فَأَكَلَ مِنْهُ وَأَكَلُوا فَلَمَّا كَانَ بَعْدَ ذَلِكَ أَتَتِ امْرَأَةٌ تَنْشُدُ الدِّينَارَ أَنْشُدُ اللهَ الدِّينَارَ فَقَالَ رَسُولُ اللهِ ﷺ يَا عَلِيُّ أَدِّ الدِّينَارَ
[Machine] Hunger said, so Ali went out and found a dinar in the market, so he came to Fatimah (as) and informed her. She said, "Go to so-and-so, the Jew, and take some flour for us." So the Jew came and bought flour with the dinar. The Jew said, "Are you the one who claims to be the Messenger of Allah?" Ali said, "Yes." The Jew said, "Take your dinar and take the flour." So Ali went until he brought it to Fatimah (as) and informed her. She said, "Go to so-and-so, the butcher, and take some meat for us with a dirham." So he went and pawned the dinar for a dirham of meat. Then he brought it, and she kneaded it, and set it up, and baked it. Then she sent it to her father, and he came to them. He said, "O Messenger of Allah, I mention it to you so that when you see it, it will be permissible for us to eat it, and you can eat from it as well." He said, "Eat in the name of Allah." So they ate. While they were eating, a boy said, "Allah and Islam redeem the dinar." The Prophet ﷺ ordered him to be called. He asked him, and he said, "I dropped it in the market." The Prophet ﷺ said, "O Ali, go to the butcher and tell him that the Messenger of Allah ﷺ orders you to send it to me with the dinar and your dirham on me." So he sent it, and the Messenger of Allah ﷺ handed it over to him. The prominent sheikh narrates from Ali (ra) in this chapter, indicating that he spent it before sharing it at that time. We have also narrated from Ata ibn Yasar (ra) from Ali (ra) in this story, that the Prophet ﷺ ordered him to share it, but he was not recognized, so the Prophet ﷺ ordered him to eat it. The apparent meaning of this narration is that he conditioned sharing it at that time and allowed eating it before the year had passed. The hadiths that mention the condition of sharing it for a year are stronger and more abundant, so they are more deserving. It is possible that he allowed him to spend it before a year had passed due to the necessity of it, and the story indicates that. It is also possible that he did not condition a year for a small amount, and Allah knows best.
قَالَتِ الْجُوعُ فَخَرَجَ عَلِيٌّ ؓ فَوَجَدَ دِينَارًا بِالسُّوقِ فَجَاءَ إِلَى فَاطِمَةَ عَلَيْهَا السَّلَامُ فَأَخْبَرَهَا فَقَالَتِ اذْهَبْ إِلَى فُلَانٍ الْيَهُودِيِّ فَخُذْ لَنَا دَقِيقًا فَجَاءَ الْيَهُودِيَّ فَاشْتَرَى بِهِ دَقِيقًا فَقَالَ الْيَهُودِيُّ أَنْتَ خَتَنُ هَذَا الَّذِي يَزْعُمُ أَنَّهُ رَسُولُ اللهِ ﷺ؟ قَالَ نَعَمْ قَالَ فَخُذْ دِينَارَكَ وَلَكَ الدَّقِيقُ فَخَرَجَ عَلِيٌّ ؓ حَتَّى جَاءَ بِه فَاطِمَةَ عَلَيْهَا السَّلَامُ فَأَخْبَرَهَا فَقَالَتِ اذْهَبْ إِلَى فُلَانٍ الْجَزَّارِ فَخُذْ لَنَا بِدِرْهَمٍ لَحْمًا فَذَهَبَ وَرَهَنَ الدِّينَارَ بِدِرْهَمٍ لَحْمًا فَجَاءَ بِهِ فَعَجَنَتْ وَنَصَبَتْ وَخَبَزَتْ فَأَرْسَلَتْ إِلَى أَبِيهَا فَجَاءَهُمْ فَقَالَ يَا رَسُولَ اللهِ أَذْكُرُ لَكَ فَإِنْ رَأَيْتَهُ لَنَا حَلَالًا أَكَلْنَاهُ وَأَكَلْتَ مِنْ شَأْنِهِ كَذَا وَكَذَا فَقَالَ كُلُوا بِاسْمِ اللهِ فَأَكَلُوا فَبَيْنَا هُمْ مَكَانَهُمْ إِذَا غُلَامٌ يَنْشُدُ اللهَ وَالْإِسْلَامَ الدِّينَارَ فَأَمَرَ رَسُولُ اللهِ ﷺ فَدُعِيَ لَهُ فَسَأَلَهُ فَقَالَ سَقَطَ مِنِّي فِي السُّوقِ فَقَالَ النَّبِيُّ ﷺ يَا عَلِيُّ اذْهَبْ إِلَى الْجَزَّارِ فَقُلْ لَهُ إِنَّ رَسُولَ اللهِ ﷺ يَقُولُ لَكَ أَرْسِلْ إِلِيَّ بِالدِّينَارِ وَدِرْهَمُكَ عَلَيَّ فَأَرْسَلَ بِهِ فَدَفَعَهُ رَسُولُ اللهِ ﷺ إِلَيْهِ قَالَ الشَّيْخُ ظَاهِرُ الْحَدِيثِ عَنْ عَلِيٍّ ؓ فِي هَذَا الْبَابِ يَدُلُّ عَلَى أَنَّهُ أَنْفَقَهُ قَبْلَ التَّعْرِيفِ فِي الْوَقْتِ وَقَدْ رُوِّينَا عَنْ عَطَاءِ بْنِ يَسَارٍ عَنْ عَلِيٍّ ؓ فِي هَذِهِ الْقِصَّةِ أَنَّ النَّبِيَّ ﷺ أَمَرَهُ أَنْ يُعَرِّفَهُ فَلَمْ يُعْتَرَفْ فَأَمَرَهُ أَنْ يَأْكُلَهُ وَظَاهِرُ تِلْكَ الرِّوَايَةِ أَنَّهُ شَرَطَ التَّعْرِيفَ فِي الْوَقْتِ وَأَبَاحَ أَكْلَهُ قَبْلَ مُضِيِّ السَّنَةِ وَالْأَحَادِيثُ الَّتِي وَرَدَتْ فِي اشْتِرَاطِ التَّعْرِيفِ سَنَةً فِي جَوَازِ الْأَكْلِ أَصَحُّ وَأَكْثَرُ فَهِيَ أَوْلَى وَيُحْتَمَلُ أَنْ يَكُونَ إِنَّمَا أَبَاحَ لَهُ إِنْفَاقَهُ قَبْلَ مُضِيِّ سَنَةٍ لِوُقُوعِ الِاضْطِرَارِ إِلَيْهِ وَالْقِصَّةُ تَدُلُّ عَلَيْهِ وَيُحْتَمَلُ أَنَّهُ لَمْ يَشْتَرِطْ مُضِيَّ سَنَةٍ فِي قَلِيلِ اللُّقَطَةِ وَاللهُ أَعْلَمُ
Bilal ibn Yahya al-Absi said: Ali found a dinar and purchased some flour with it. The seller of the flour recognised him and returned the dinar to him. Ali took it, deducted two qirat (carat) from it, and purchased meat with it. (Using translation from Abū Dāʾūd 1715)
أَنْهُ الْتَقَطَ دِينَارًا فَاشْتَرَى بِهِ دَقِيقًا فَعَرَفَهُ صَاحِبُ الدَّقِيقِ فَرَدَّ عَلَيْهِ الدِّينَارَ فَأَخَذَهُ عَلِيٌّ فَقَطَعَ مِنْهُ قِيرَاطَيْنِ فَاشْتَرَى بِهِ لَحْمًا فِي مَتْنِ هَذَا الْحَدِيثِ اخْتِلَافٌ وَفِي أَسَانِيدِهِ ضَعْفٌ وَاللهُ أَعْلَمُ
33.7 [Machine] What is mentioned in the brief narrations about Zaid bin Khalid Al-Juhani and Abdullah bin Amr from the Prophet ﷺ indicates equality between a small amount and a large amount in definition.
٣٣۔٧ بَابُ مَا جَاءَ فِي قَلِيلِ اللُّقَطَةِ ظَاهِرُ الْأَحَادِيثِ عَنْ زَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ وَعَبْدِ اللهِ بْنِ عَمْرٍو عَنِ النَّبِيِّ ﷺ يَدُلُّ عَلَى التَّسْوِيَةِ بَيْنَ قَلِيلِ اللُّقَطَةِ وَكَثِيرِهَا فِي التَّعْرِيفِ
[Machine] That the Messenger of Allah, ﷺ , passed by a date palm on the road and said, "If it were not for it being a form of charity, I would have eaten it."
أَنَّ رَسُولَ اللهِ ﷺ مَرَّ بِتَمْرَةٍ بِالطَّرِيقِ فَقَالَ لَوْلَا أَنْ تَكُونَ مِنَ الصَّدَقَةِ لَأَكَلْتُهَا
[Machine] The messenger of Allah ﷺ passed by a date palm on the road and said, "If it were not for the fact that I fear it may be charity, I would have eaten it." He said, "Then Ibn Umar passed by a date palm on the road and ate it."
مَرَّ رَسُولُ اللهِ ﷺ عَلَى تَمْرَةٍ فِي الطَّرِيقِ مَطْرُوحَةٍ فَقَالَ لَوْلَا أَنِّي أَخْشَى أَنْ تَكُونَ مِنَ الصَّدَقَةِ لَأَكَلْتُهَا 12097 قَالَ وَمَرَّ ابْنُ عُمَرَ بِتَمْرَةٍ مَطْرُوحَةٍ فِي الطَّرِيقِ فَأَكَلَهَا
[Machine] "The Messenger of Allah ﷺ gave us permission regarding the stick, whip, rope, and similar things, allowing a person to pick them up and benefit from them as a means of conveying the narration of Abu Dawood. And in the narration of Ar-Ramli, he said it was narrated from Abu Az-Zubair and Al-Baqi that they are equal. Abu Dawood said..."
رَخَّصَ لَنَا رَسُولُ اللهِ ﷺ فِي الْعَصَا وَالسَّوْطِ وَالْحَبْلِ وَأَشْبَاهِهِ يَلْتَقِطُ الرَّجُلُ يَنْتَفِعُ بِهِ لَفْظُ حَدِيثِ أَبِي دَاوُدَ وَفِي رِوَايَةِ الرَّمْلِيِّ قَالَ عَنْ أَبِي الزُّبَيْرِ وَالْبَاقِي سَوَاءٌ قَالَ أَبُو دَاوُدَ
[Machine] The Messenger of Allah ﷺ said, "Whoever finds a small amount of an item, such as a rope, a dirham, or something similar, should announce it for three days. If it is more than that, then he should announce it for six days." 'Umar ibn 'Abdullah ibn Ya'laa claimed to have a unique case, which was doubted by Yahya ibn Ma'een and Jarir ibn 'Abd al-Hamid. Among the reasons for doubt was his consumption of alcohol.
قَالَ رَسُولُ اللهِ ﷺ مَنِ الْتَقَطَ لُقَطَةً يَسِيرَةً حَبْلًا أَوْ دِرْهَمًا أَوْ شِبْهَ ذَلِكَ فَلْيُعَرِّفْهُ ثَلَاثَةَ أَيَّامٍ فَإِنْ كَانَ فَوْقَ ذَلِكَ فَلْيُعَرِّفْهُ سِتَّةَ أَيَّامٍ تَفَرَّدَ بِهِ عُمَرُ بْنُ عَبْدِ اللهِ بْنِ يَعْلَى وَقَدْ ضَعَّفَهُ يَحْيَى بْنُ مَعِينٍ وَرَمَاهُ جَرِيرُ بْنُ عَبْدِ الْحَمِيدِ وَغَيْرُهُ بِشُرْبِ الْخَمْرِ
[Machine] He picks up his brother's whip and reaches with his hands what I see as a hardship. He asked, "What about the rope?" She said, "And the rope." He asked, "And the shoe?" She said, "And the shoe." He asked, "And the container?" She said, "I do not permit what Allah has forbidden. The container is where expenses and belongings are kept." And 12101. And according to Sufyan, from Ar-Rabi' bin Subayh, from Al-Hasan, that he permitted the use of a whip, stick, and walking for enjoyment.
يَلْتَقِطُ سَوْطَ أَخِيهِ يَصِلُ بِهِ يَدَيْهِ مَا أَرَى بَأْسًا قَالَ وَالْحَبْلُ؟ قَالَتْ وَالْحَبْلُ قَالَ وَالْحِذَاءُ؟ قَالَتْ وَالْحِذَاءُ قَالَ وَالْوِعَاءُ؟ قَالَتْ لَا أُحِلُّ مَا حَرَّمَ اللهُ الْوِعَاءُ يَكُونُ فِيهِ النَّفَقَةُ وَيَكُونُ فِيهِ الْمَتَاعُ 12101 وَعَنْ سُفْيَانَ عَنِ الرَّبِيعِ بْنِ صُبَيْحٍ عَنِ الْحَسَنِ أَنَّهُ رَخَّصَ فِي السَّوْطِ وَالْعَصَا وَالسَّيْرِ يَجِدُهُ يَسْتَمْتِعُ بِهِ
33.8 [Machine] What has come in following the harvesters and taking what falls from them
٣٣۔٨ بَابُ مَا جَاءَ فِي اتِّبَاعِ الْحَصَّادِينَ وَأَخْذِ مَا يَسْقُطُ مِنْهُمْ
[Machine] To Abu Darda, don't ask anyone anything. I said, what if I need something? He said, follow the harvesters and see what falls from them, then pick it up, hit it, grind it, knead it, then eat it, and don't ask anyone anything.
لِي أَبُو الدَّرْدَاءِ ؓ لَا تَسْأَلِي أَحَدًا شَيْئًا قُلْتُ إِنِ احْتَجْتُ؟ قَالَ تَتَبَّعِي الْحَصَّادِينَ فَانْظُرِي مَا يَسْقُطُ مِنْهُمْ فَخِذَيْهِ فَاخْبِطِيهِ ثُمَّ اطْحَنِيهِ ثُمَّ اعْجِنِيهِ ثُمَّ كُلِيهِ وَلَا تَسْأَلِي أَحَدًا شَيْئًا
[Machine] I heard Al-Awza'i saying, "The hand of the reaper did not commit a mistake, nor did the hand of the plucker harvest unjustly. There is no way for the owner of the crop, but it is only for the passer-by and the wayfarers."
سَمِعْتُ الْأَوْزَاعِيَّ يَقُولُ مَا أَخَطَّتْ يَدُ الْحَاصِدِ أَوْ جَنَتْ يَدُ الْقَاطِفِ فَلَيْسَ لِصَاحِبِ الزَّرْعِ عَلَيْهِ سَبِيلٌ إِنَّمَا هُوَ لِلْمَارَّةِ وَأَبْنَاءِ السَّبِيلِ
