33. The Found
٣٣۔ كِتَابُ اللُّقَطَةِ
A man came to Messenger of Allah ﷺ and asked about Al-Luqata (a fallen thing). The Prophet ﷺ said, "Recognize its container and its tying material and then make a public announcement about it for one year and if its owner shows up, give it to him; otherwise use it as you like." The man said, "What about a lost sheep?" The Prophet ﷺ said, "It is for you, your brother or the wolf." The man said "What about a lost camel?" The Prophet ﷺ said, "Why should you take it as it has got its water-container (its stomach) and its hooves and it can reach the places of water and can eat the trees till its owner finds it?" أَنَّهُ قَالَ أَتَى رَجُلٌ إِلَى رَسُولِ اللهِ ﷺ وَأَنَا مَعَهُ فَسَأَلَهُ عَنِ اللُّقَطَةِ فَقَالَ اعْرِفْ عِفَاصَهَا وَوِكَاءهَا ثُمَّ عَرِّفْهَا سَنَةً فَإِنْ جَاءَ صَاحِبُهَا وَإِلَّا فَشَأْنَكَ بِهَا قَالَ فَضَالَّةُ الْغَنَمِ؟ قَالَ لَكَ أَوْ لِأَخِيكَ أَوْ لِلذِّئْبِ قَالَ فَضَالَّةُ الْإِبِلِ؟ قَالَ مَعَهَا حِذَاؤُهَا وَسِقَاؤُهَا وَتَرِدُ الْمَاءَ وَتَأْكُلُ الشَّجَرَ حَتَّى يَلْقَاهَا رَبُّهَا
A man asked the Messenger of Allah (SWAS) about a find. He said: Make the matter known for a year, then note its string and its container and then use it for your purpose. Then if its owner comes, give it to him. He asked : Messenger of Allah, what about a stray sheep? He replied: Take it; that is for you, or for your brother, or for the wolf. He again asked: Messenger of Allah, What about stray camels? The Messenger of Allah (SWAS) became angry so much so that his cheeks became red or ( the narrator is doubtful) his face became red. He replied: What have you to do with them? They have with them their feet and their stomachs (for drink) till their master comes to him. (Using translation from Abū Dāʾūd 1704)
أَنَّ رَجُلًا سَأَلَ رَسُولَ اللهِ ﷺ عَنِ اللُّقَطَةِ فَقَالَ عَرِّفْهَا سَنَةً ثُمَّ اعْرِفْ وِكَاءَهَا وَعِفَاصَهَا ثُمَّ اسْتَنْفِقْ بِهَا فَإِنْ جَاءَ رَبُّهَا فَأَدِّهَا إِلَيْهِ فَقَالَ يَا رَسُولَ اللهِ فَضَالَّةُ الْغَنَمِ؟ قَالَ خُذْهَا؛ فَإِنَّمَا هِيَ لَكَ أَوْ لِأَخِيكَ أَوْ لِلذِّئْبِ قَالَ يَا رَسُولَ اللهِ فَضَالَّةُ الْإِبِلِ؟ قَالَ فَغَضِبَ رَسُولُ اللهِ ﷺ حَتَّى احْمَرَّتْ وَجْنَتَاهُ أَوِ احْمَرَّ وَجْهُهُ قَالَ مَا لَكَ وَلَهَا؟ مَعَهَا حِذَاؤُهَا وَسِقَاؤُهَا حَتَّى يَلْقَاهَا رَبُّهَا وَقَالَ يَحْيَى عَنْ أَيُّوبَ دَعْهَا حَتَّى يَلْقَاهَا رَبُّهَا
Recognise well the strap and the bag (containing) that and then make an announcement regarding that for one year, but if none recognises it, then spend that and it would be a trust with you; and if someone comes one day to make demand of that, then pay that to him. He (the inquirer) asked about the lost camel, whereupon he said: You have nothing to do with that. Leave that alone, for it has feet and also a leather bag, it drinks water, and eats (the leaves) of the trees. He asked him about sheep, whereupon he said: Take it, it is for you, or for your brother, or for the wolf. (Using translation from Muslim 1722e)
أَنَّهُ سَمِعَ زَيْدَ بْنَ خَالِدٍ الْجُهَنِيَّ صَاحِبَ رَسُولِ اللهِ ﷺ يَقُولُ سُئِلَ رَسُولُ اللهِ ﷺ عَنِ اللُّقَطَةِ الذَّهَبِ أَوِ الْوَرِقِ فَقَالَ اعْرِفْ وِكَاءهَا وَعِفَاصَهَا ثُمَّ عَرِّفْهَا سَنَةً فَإِنْ لَمْ تُعْتَرَفْ فَاسْتَنْفِقْهَا وَلْتَكُنْ وَدِيعَةً عِنْدَكَ فَإِنْ جَاءَ طَالِبُهَا يَوْمًا مِنَ الدَّهْرِ فَأَدِّهَا إِلَيْهِ وَسَأَلَهُ عَنْ ضَالَّةِ الْإِبِلِ فَقَالَ مَا لَكَ وَلَهَا؟ دَعْهَا؛ فَإِنَّ مَعَهَا حِذَاءَهَا وَسِقَاءَهَا تَرِدُ الْمَاءَ وَتَأْكُلُ الشَّجَرَ حَتَّى يَجِدَهَا رَبُّهَا وَسَأَلَهُ عَنِ الشَّاةِ فَقَالَ خُذْهَا؛ فَإِنَّمَا هِيَ لَكَ أَوْ لِأَخِيكَ أَوْ لِلذِّئْبِ
[Machine] I heard a man from Muzaynah ask the Messenger of Allah ﷺ , and I have heard about the stray camel. The Prophet replied, "If it has its water bag and shoes, the wolf will not eat it. It will drink water and eat from trees, so leave it in its place until its owner comes. The man asked, "What about a stray sheep?" The Prophet said, "It belongs to you, your brother, or the wolf, so gather them until their owner comes." The man asked, "What if he cannot be found?" The Prophet said, "If it was not found in the inhabited areas or on the dangerous roads, recognize it as a year's sustenance, but if the owner comes, return it to him. The man asked, "O Messenger of Allah, what about abandoned property in the city?" The Prophet replied, "It includes the fifth of the discovered property." This was narrated by 'Amr bin Al-Harith and Hisham bin Sa'd from 'Amr bin Shu'aib from his father from Ibn 'Umar, and its meaning is the same. The man asked, "What about stray sheep?" The Prophet said, "If there is edible food for you, your brother, or the wolf, then keep it for your brother. This is the narration found in the book of Zakah."
سَمِعْتُ رَجُلًا مِنْ مُزَيْنَةَ سَأَلَ رَسُولَ اللهِ ﷺ وَأَنَا أَسْمَعُ عَنِ الضَّالَّةِ مِنَ الْإِبِلِ فَقَالَ مَعَهَا سِقَاؤُهَا وَحِذَاؤُهَا لَا يَأْكُلُهَا الذِّئْبُ تَرِدُ الْمَاءَ وَتَأْكُلُ الشَّجَرَ فَدَعْهَا مَكَانَهَا حَتَّى يَأْتِيَ بَاغِيهَا قَالَ فَضَالَّةُ الْغَنَمِ قَالَ لَكَ أَوْ لِأَخِيكَ أَوْ لِلذِّئْبِ اجْمَعْهَا حَتَّى يَأْتِيَهَا بَاغِيهَا قَالَ اللُّقَطَةُ يَجِدُهَا؟ قَالَ مَا كَانَ فِي الْعَامِرَةِ وَالسَّبِيلِ الْغَامِرَةِ فَعَرِّفْهَا سَنَةً فَإِنْ جَاءَ بَاغِيهَا فَأَدِّهَا إِلَيْهِ وَإِلَّا فَهِيَ لَكَ قَالَ يَا رَسُولَ اللهِ فَمَا يُوجَدُ فِي الْقَرْيَةِ الْخَرَابِ الْعَادِيِّ؟ قَالَ فِيهِ وَفِي الرِّكَازِ الْخُمُسُ وَرَوَاهُ عَمْرُو بْنُ الْحَارِثِ وَهِشَامُ بْنُ سَعْدٍ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ عَبْدِ اللهِ بْنِ عُمَرَ وَبِمَعْنَاهُ قَالَ فِيهِ فَكَيْفَ تَرَى فِي ضَالَّةِ الْغَنَمِ؟ قَالَ طَعَامٌ مَأْكُولٌ لَكَ أَوْ لِأَخِيكَ أَوْ لِلذِّئْبِ احْبِسْ عَلَى أَخِيكَ ضَالَّتَهُ وَقَدْ مَضَى بِإِسْنَادِهِ فِي كِتَابِ الزَّكَاةِ
“I was with my father in Bawazij and the cows came back in the evening. He saw a cow did not recognize it. He said: 'What is this?' He said: 'A cow that joined the herd.' And he issued orders that it be driven away until it disappeared from view. Then he said: 'I heard the Messenger of Allah ﷺ say: “No one gives refuge to a stray animal but one who is also astray.” (Using translation from Ibn Mājah 2503)
كُنْتُ مَعَ أَبِي بِالْبَوَازِيجِ بِالسَّوَادِ فَرَاحَتِ الْبَقَرُ فَرَأَى بَقَرَةً أَنْكَرَهَا فَقَالَ مَا هَذِهِ الْبَقَرَةُ؟ قَالُوا بَقَرَةٌ لَحِقَتْ بِالْبَقَرِ فَأَمَرَ بِهَا فَطُرِدَتْ حَتَّى تَوَارَتْ ثُمَّ قَالَ سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ لَا يَأْوِي الضَّالَّةَ إِلَّا ضَالٌّ
[Machine] I said, "O Messenger of Allah, if a stray camel comes to me, should I leave it?" He said, "The stray animal of a Muslim is the fire, so likewise."
قُلْتُ يَا رَسُولَ اللهِ تَأْتِي عَلَيَّ ضَالَّةُ الْإِبِلِ فَأَتْرُكُهَا؟ فَقَالَ ضَالَّةُ الْمُسْلِمِ حَرْقُ النَّارِ وَكَذَلِكَ
[Machine] "The Prophet ﷺ said, 'The aim of the believer is to protect from the fire of Hell, and likewise...'"
أَنَّ النَّبِيَّ ﷺ قَالَ ضَالَّةُ الْمُؤْمِنِ حَرْقُ النَّارِ وَكَذَلِكَ
[Machine] "We came to the Messenger of Allah ﷺ while we were on lean camels. We said, 'O Messenger of Allah, we pass through rough terrains and occasionally find camels to ride.' He replied, 'The loss of a Muslim's property is equivalent to the burning of fire.' It is narrated from Yazid from his brother Mutarraf from Al-Jarood."
أَتَيْنَا رَسُولَ اللهِ ﷺ وَنَحْنُ عَلَى إِبِلٍ عِجَافٍ فَقُلْنَا يَا رَسُولَ اللهِ إِنَّا نَمُرُّ بِالْجُرُفِ فَنَجِدُ إِبِلًا فَنَرْكَبُهَا فَقَالَ ضَالَّةُ الْمُسْلِمِ حَرْقُ النَّارِ وَقِيلَ عَنْهُ عَنْ يَزِيدَ عَنْ أَخِيهِ مُطَرِّفٍ عَنِ الْجَارُودِ
[Machine] From Al-Jarood Al-Abdi, he raised it to the Prophet ﷺ who said, "The lost sheep of a Muslim is the burning of fire; so do not approach it." It has been said about him, from Mutarraf, from Abu Muslim, from Al-Jarood. And it has been said about Mutarraf ibn Abdullah ibn Al-Shakheer, from his father.
عَنِ الْجَارُودِ الْعَبْدِيِّ يَرْفَعُهُ إِلَى النَّبِيِّ ﷺ قَالَ ضَالَّةُ الْمُسْلِمِ حَرْقُ النَّارِ؛ فَلَا تَقْرَبُنَّهَا وَقَدْ قِيلَ عَنْهُ عَنْ مُطَرِّفٍ عَنْ أَبِي مُسْلِمٍ عَنِ الْجَارُودِ وَقَدْ قِيلَ عَنْ مُطَرِّفِ بْنِ عَبْدِ اللهِ بْنِ الشِّخِّيرِ عَنْ أَبِيهِ
[Machine] A man asked the Prophet ﷺ and said, "We are afflicted with hardships in our camels." The Prophet replied, "The losses of a Muslim or a believer are the burning of fire."
أَنَّ رَجُلًا سَأَلَ النَّبِيَّ ﷺ فَقَالَ إِنَّا نُصِيبُ هَوَامِيَ الْإِبِلِ فَقَالَ ضَالَّةُ الْمُسْلِمِ أَوِ الْمُؤْمِنِ حَرْقُ النَّارِ
[Machine] And he is a leaning support against the Kaaba, whoever takes a stray object, he is a stray.
وَهُوَ مُسْنِدٌ ظَهْرَهُ إِلَى الْكَعْبَةِ مَنْ أَخَذَ ضَالَّةً فَهُوَ ضَالٌّ
[Machine] The Bedouin said to the Prophet ﷺ , "I see that you have made the people excluding me. Did you make up a turn for me?" The Prophet ﷺ replied, "Woe to you, do not ask this question." The Bedouin asked, "And how intense is your questioning?" The Prophet ﷺ replied, "Seek forgiveness from Allah and draw closer to Him, and delay what you have done." The Bedouin asked, "Do you know where this verse was revealed?" The Prophet ﷺ replied, "Do not ask about things that if they were revealed to you, they would sadden you." He continued reciting the rest of the verse, "O you who have believed, do not ask about things which, if they are shown to you, will distress you." The Prophet ﷺ then explained that there was a group of people who used to mock him when they would say, "Whose son am I?" and "Where is my camel?" So Allah revealed this verse in response to their mocking.
الْأَعْرَابِيُّ أُرَاكَ قَدْ أَصْدَرْتَ النَّاسَ غَيْرِي أَفَتَرَى لِي نَوْبَةً؟ قَالَ وَيْلَكَ لَا تَسْأَلْ هَذِهِ الْمَسْأَلَةَ قَالَ وَمَا أَشَدَّ مَسْأَلَتَكَ قَالَ اسْتَغْفِرِ اللهَ وَأَقْرِبْ إِلَيْهِ وَأَجِلَّ مَا صَنَعْتَ قَالَ أَتَدْرِي فِيمَا نَزَلَتْ هَذِهِ الْآيَةُ {يَا أَيُّهَا الَّذِينَ آمَنُوا لَا تَسْأَلُوا عَنْ أَشْيَاءَ إَنْ تُبْدَ لَكُمْ تَسُؤْكُمْ} [المائدة 101] حَتَّى فَرَغَ مِنَ الْآيَةِ كُلِّهَا قَالَ كَانَ قَوْمٌ يَسْأَلُونَ رَسُولَ اللهِ ﷺ اسْتِهْزَاءً فَيَقُولُ الرَّجُلُ مَنْ أَبِي؟ وَيَقُولُ الرَّجُلُ تَضِلُّ نَاقَتُهُ أَيْنَ نَاقَتِي؟ فَأَنْزَلَ اللهُ ﷻ فِيهِ هَذِهِ الْآيَةَ
[Machine] Narrated by the Prophet ﷺ, he said, "The lost camel that is branded and has its bell removed belongs to its finder and its similar is with it."
عَنِ النَّبِيِّ ﷺ قَالَ ضَالَّةُ الْإِبِلِ الْمَكْتُومَةُ غَرَامَتُهَا وَمِثْلُهَا مَعَهَا
