33. The Found
٣٣۔ كِتَابُ اللُّقَطَةِ
The Prophet ﷺ said: If anyone finds an animal whose owners were helpless to provide fodder to it and so they turned it out (of their house), and he took it and looked after it, it will belong to him. Abu Dawud said: This is the tradition of Hammad. It is more plain and perfect. (Using translation from Abū Dāʾūd 3524)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ وَجَدَ دَابَّةً قَدْ عَجَزَ عَنْهَا أَهْلُهَا أَنْ يَعْلِفُوهَا فَسَيَّبُوهَا فَأَخَذَهَا فَأَحْيَاهَا فَهِيَ لَهُ قَالَ فِي حَدِيثِ أَبَانَ قَالَ عُبَيْدُ اللهِ فَقُلْتُ عَمَّنْ قَالَ؟ عَنْ غَيْرِ وَاحِدٍ مِنَ أَصْحَابِ رَسُولِ اللهِ ﷺ قَالَ أَبُو دَاوُدَ هَذَا لَفْظُ حَدِيثِ حَمَّادٍ وَهُوَ أَبْيَنُ وَأَتَمُّ
The Prophet ﷺ said: If anyone leaves an animal at a place of perishing and another man brings it to life, it belongs to him who brings it to life. (Using translation from Abū Dāʾūd 3525)
عَنِ الشَّعْبِيِّ يَرْفَعُ الْحَدِيثَ إِلَى النَّبِيِّ ﷺ أَنَّهُ قَالَ مَنْ تَرَكَ دَابَّةً بِمَهْلَكٍ فَأَحْيَاهَا رَجُلٌ فَهِيَ لِمَنْ أَحْيَاهَا
[Machine] I heard Al-Sha'abi saying, "Whoever abandons his livestock and leaves it, it belongs to whoever revives it." I asked, "Whose statement is this, O Abu Amr?" He replied, "If you want, I will count for you so and so from the companions of the Messenger of Allah ﷺ. This is a disputed hadith regarding its authenticity, and it is disconnected from the Prophet ﷺ. And everyone has the right to his property until he gives it to someone else. And Allah knows best."
سَمِعْتُ الشَّعْبِيَّ يَقُولُ مَنْ قَامَتْ عَلَيْهِ دَابَّتُهُ فَتَرَكَهَا فَهِيَ لِمَنْ أَحْيَاهَا قُلْتُ عَمَّنْ هَذَا يَا أَبَا عَمْرٍو؟ فَقَالَ إِنْ شِئْتَ عَدَدْتُ لَكَ كَذَا وَكَذَا مِنَ أَصْحَابِ رَسُولِ اللهِ ﷺ هَذَا حَدِيثٌ مُخْتَلَفٌ فِي رَفْعِهِ وَهُوَ عَنِ النَّبِيِّ ﷺ مُنْقَطِعٌ وَكُلُّ أَحَدٍ أَحَقُّ بِمَالِهِ حَتَّى يَجْعَلَهُ لِغَيْرِهِ وَاللهُ أَعْلَمُ
[Machine] Al-Sha'bi said: This has been settled. If he irrigates it with a spring and water and security, then its companion has more right to it. And if he irrigates it with a canal and fright, then the one who took it has more right to it.
قَالَ الشَّعْبِيُّ هَذَا قَدْ قُضِيَ فِيهِ إِنْ كَانَ سَيَّبَهَا فِي كَلَأٍ وَمَاءٍ وَأَمْنٍ فَصَاحِبُهَا أَحَقُّ بِهَا وَإِنْ كَانَ سَيَّبَهَا فِي مَفَازَةٍ وَمَخَافَةٍ فَالَّذِي أَخَذَهَا أَحَقُّ بِهَا
