33. The Found
٣٣۔ كِتَابُ اللُّقَطَةِ
Some of the Companions of Prophet ﷺ went on a journey. They encamped with a clan of the Arabs and sought hospitality from them, but they refused to provide them with any hospitality. The chief of the clan was stung by a scorpion or bitten by a snake. They gave him all sorts of treatment, but nothing gave him relied. One of them said: Would that you had gone to those people who encamped with you ; some of them might have something which could give you relief to your companion. (So they went and) one of them said: Our chief has been stung by a scorpion or bitten by a snake. We administered all sorts of medicine but nothing gave him relief. Has any of you anything, i.e. charm, which gives healing to our companion. One of those people said: I shall apply charm; we sought hospitality from you, but you refused to entertain us. I am not going to apply charm until you give me some wages. So they offered them a number of sheep. He then came to and recited Faithat-al-Kitab and spat until he was cured as if he were set free from a bond. Thereafter they made payment of the wages as agreed by them. They said: Apportion (the wages). The man who applied the charm said: Do not do until we come to the Messenger of Allah ﷺ and consult him. So they came to the Messenger of Allah ﷺ next morning and mentioned it to him. The Messenger of Allah ﷺ said: From where did you learn that it was a charm ? You have done right. Give me a share along with you. (Using translation from Abū Dāʾūd 3418)
أَنَّ رَهْطًا مِنَ أَصْحَابِ النَّبِيِّ ﷺ انْطَلَقُوا فِي سَفْرَةٍ سَافَرُوهَا فَنَزَلُوا بِحَيٍّ مِنَ أَحْيَاءِ الْعَرَبِ فَاسْتَضَافُوهُمْ فَأَبَوْا أَنْ يُضَيِّفُوهُمْ قَالَ فَلُدِغَ سَيِّدُ ذَلِكَ الْحِيِّ فَسَعَوْا لَهُ بِكُلِّ شَيْءٍ لَا يَنْفَعُهُ شَيْءٌ قَالَ بَعْضُهُمْ لَوْ أَتَيْتُمْ هَؤُلَاءِ الَّذِينَ نَزَلُوا بِكُمْ؛ لَعَلَّ يَكُونُ عِنْدَ بَعْضِهِمْ مَا يَنْفَعُ صَاحِبَكُمْ فَقَالَ بَعْضُهُمْ أَيُّهَا الرَّهْطُ إِنَّ سَيِّدَنَا لَدِيغٌ فَسَعَيْنَا لَهُ بِكُلِّ شَيْءٍ فَهَلْ عِنْدَ أَحَدٍ مِنْكُمْ مَا يَنْفَعُ صَاحِبَنَا؟ فَقَالَ رَجُلٌ مِنَ الْقَوْمِ نَعَمْ إِنِّي لَأَرْقِي وَلَكِنِ اسْتَضَفْنَاكُمْ فَأَبَيْتُمْ أَنْ تُضَيِّفُونَا وَمَا أَنَا بِرَاقٍ حَتَّى تَجْعَلُوا لِي جُعْلًا فَجَعَلُوا لَهُ قَطِيعًا مِنَ الشَّاةِ قَالَ فَأَتَاهُ فَقَرَأَ عَلَيْهِ أُمَّ الْكِتَابِ وَيَتْفِلُ عَلَيْهِ حَتَّى بَرَأَ كَأَنَّهُ نَشِطَ مِنْ عِقَالٍ قَالَ فَأَوْفَاهُمُ الَّذِي صَالَحُوهُ عَلَيْهِ فَقَالَ اقْسِمُوا فَقَالَ الَّذِي رَقَى لَا تَفْعَلُوا؛ نَأْتِي النَّبِيَّ ﷺ فَنَسْتَأْمِرُهُ فَغَدَوْا عَلَى رَسُولِ اللهِ ﷺ فَذَكَرُوا لَهُ فَقَالَ رَسُولُ اللهِ ﷺ مِنْ أَيْنَ عَلِمْتَ أَنَّهَا رُقْيَةٌ؟ وَقَالَ أَحْسَنْتُمْ فَاقْتَسِمُوا وَاضْرِبُوا لِي مَعَكُمْ بِسَهْمٍ
[Machine] The Messenger of Allah ﷺ decided about the slave who was found in the Haram with ten dirhams, and this is weak. The preserved hadith is from Ibn Jurayj who narrated it from Ibn Abi Mulaykah and Amr ibn Dinar, they said: The Messenger of Allah ﷺ decided about the slave who was found outside of the Haram with ten dirhams, and this is disconnected.
قَضَى رَسُولُ اللهِ ﷺ فِي الْعَبْدِ الْآبِقِ يُوجَدُ فِي الْحَرَمِ بِعَشَرَةِ دَرَاهِمَ فَهَذَا ضَعِيفٌ وَالْمَحْفُوظُ حَدِيثُ ابْنِ جُرَيْجٍ عَنِ ابْنِ أَبِي مُلَيْكَةَ وَعَمْرِو بْنِ دِينَارٍ قَالَا جَعَلَ رَسُولُ اللهِ ﷺ فِي الْآبِقِ يُوجَدُ خَارِجًا مِنَ الْحَرَمِ عَشَرَةَ دَرَاهِمَ وَذَلِكَ مُنْقَطِعٌ
[Machine] About Ali regarding the dinar in Jual al-Abiq, whether it is taken near or far, and about Hajjaj from Amr ibn Shuaib that Saeed ibn al-Musayyib used to say that. And about Hajjaj that Ibn Masood used to say, when he comes out of Egypt, forty of the Hajjaj ibn Artat is not to be relied upon.
عَنْ عَلِيٍّ فِي جُعْلِ الْآبِقِ دِينَارٌ قَرِيبًا أُخِذَ أَوْ بَعِيدًا وَعَنِ الْحَجَّاجِ عَنْ عَمْرِو بْنِ شُعَيْبٍ أَنَّ سَعِيدَ بْنَ الْمُسَيِّبِ كَانَ يَقُولُ ذَلِكَ 12124 وَعَنِ الْحَجَّاجِ أَنَّ ابْنَ مَسْعُودٍ كَانَ يَقُولُ إِذَا خَرَجَ مِنَ الْمِصْرِ فَجُعْلُهُ أَرْبَعُونَ الْحَجَّاجُ بْنُ أَرْطَاةَ لَا يُحْتَجُّ بِهِ
[Machine] Forty dirhams for each person is the best that has been narrated in this matter, and it is possible that Abdullah knew the condition of their owner in which whoever turned them away from each person should pay forty dirhams, so he informed him of that and Allah knows best.
أَرْبَعُونَ دِرْهَمًا مِنْ كُلِّ رَأْسٍ وَهَذَا أَمْثَلُ مَا رُوِيَ فِي هَذَا الْبَابِ وَيُحْتَمَلُ أَنْ يَكُونَ عَبْدُ اللهِ عَرَفَ شَرْطَ مَالِكِهِمْ لِمَنْ رَدَّهُمْ عَنْ كُلِّ رَأْسٍ أَرْبَعِينَ دِرْهَمًا فَأَخْبَرَهُ بِذَلِكَ وَاللهُ أَعْلَمُ
[Machine] I brought in a black slave, but he escaped from me, so they accused me in front of Shuraih. He guaranteed me, then this was brought to Ali and he said, "Shuraih lied and the judgment was incorrect." The black slave swears to the red slave that he did not escape from him, and then he is not responsible for anything.
جِئْتُ بِعَبْدٍ آبِقٍ مِنَ السَّوَادِ فَانْفَلَتَ مِنِّي فَخَاصَمُونِي إِلَى شُرَيْحٍ فَضَمَّنَنِيهُ قَالَ فَرُفِعَ ذَلِكَ إِلَى عَلِيٍّ ؓ فَقَالَ كَذَبَ شُرَيْحٌ وَأَخْطَأَ الْقَضَاءَ يَحْلِفُ الْعَبْدُ الْأَسْوَدُ لِلْعَبْدِ الْأَحْمَرِ لَانْفَلَتَ مِنْهُ انْفِلَاتًا ثُمَّ لَا شَيْءَ عَلَيْهِ
[Machine] About Ali, in a man, he finds a fault, so he blames him, without guaranteeing him. But a slice guaranteed him. And we say by the words of Ali, if the fault is bigger than exceeding it, and Allah knows best.
عَنْ عَلِيٍّ ؓ فِي الرَّجُلِ يَجِدُ الْآبِقَ فَيَأْبَقُ مِنْهُ لَا يَضْمَنُهُ وَضَمَّنَهُ شُرَيْحٌ وَنَحْنُ نَقُولُ بِقَوْلِ عَلِيٍّ إِنْ كَانَ الْآبِقُ أَبِقَ مِنْ دُونِ تَعَدِّيهِ وَاللهُ أَعْلَمُ
