33. The Found (2/3)
٣٣۔ كِتَابُ اللُّقَطَةِ ص ٢
I heard the Messenger of Allah (May peace be upon him) as saying; if anyone hears a man crying out in the mosque about something he has lost, he should say: May Allah not restore it to you, for the mosque were not built for this. (Using translation from Abū Dāʾūd 473)
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ سَمِعَ رَجُلًا يَنْشُدُ فِي الْمَسْجِدِ ضَالَّةً فَلْيَقُلْ لَا أَدَّاهَا اللهُ إِلَيْكَ؛ فَإِنَّ الْمَسَاجِدَ لَمْ تُبْنَ لِهَذَا
[Machine] The Prophet ﷺ heard an Arab man or a person saying, "Whoever calls to the red camel." The Prophet ﷺ said, "No, you have not found (meaning the mosques were not built) except for what they were built for."
أَنَّ النَّبِيَّ ﷺ سَمِعَ أَعْرَابِيًّا أَوْ رَجُلًا يَقُولُ مَنْ دَعَا إِلَى الْجَمَلِ الْأَحْمَرِ فَقَالَ النَّبِيُّ ﷺ لَا وَجَدْتَ إِنَّمَا بُنِيَتْ هَذِهِ الْمَسَاجِدُ لِمَا بُنِيَتْ لَهُ
33.10 [Machine] What was said by the person admitting the catch?
٣٣۔١٠ بَابُ مَا جَاءَ فِيمَنْ يَعْتَرِفُ اللُّقَطَةَ
[Machine] From the Prophet ﷺ in the narration, he said regarding the lost item, he should describe it in detail, including its number, container, and power, and benefit from it. If its owner comes, and describes its number and power, then give it to him. Abu Dawood said it was only reported by Hammam who described its number. The Sheikh said, it has been ...
عَنِ النَّبِيِّ ﷺ فِي اللُّقَطَةِ قَالَ فِي التَّعْرِيفِ عَرِّفْهَا عَامَيْنِ أَوْ ثَلَاثَةً وَقَالَ اعْرِفْ عَدَدَهَا وَوِعَاءَهَا وَوِكَاءَهَا وَاسْتَنْفِعْ بِهَا فَإِنْ جَاءَ صَاحِبُهَا فَعَرَفَ عَدَدَهَا وَوِكَاءَهَا فَادْفَعْهَا إِلَيْهِ قَالَ أَبُو دَاوُدَ لَيْسَ يَقُولُ إِلَّا حَمَّادٌ فَعَرَفَ عَدَدَهَا قَالَ الشَّيْخُ قَدْ
[Machine] Narrated by the Prophet ﷺ about the Lqiata, he said, "Know its quantity, its measures, and its container. If someone comes and informs you about its number and measures, give it to him. Otherwise, enjoy it for yourself."
عَنِ النَّبِيِّ ﷺ فِي اللُّقَطَةِ فَقَالَ اعْرِفْ عَدَدَهَا وَوِكَاءَهَا وَوِعَاءَهَا فَإِنْ جَاءَ أَحَدٌ يُخْبِرُكَ بِعَدَدِهَا وَوِكَائِهَا فَادْفَعْهَا إِلَيْهِ وَإِلَّا فَاسْتَمْتِعْ بِها
[Machine] About the Prophet ﷺ in the hadith of Looqatah, he said: "If someone brings the lost item and recognizes its owner and the quantity, then give it back to him." Abu Dawood said: Hammad also narrated from Ubaidullah ibn Umar from Amr ibn Shuaib from his father from his grandfather from the Prophet ﷺ with a similar narration.
عَنِ النَّبِيِّ ﷺ فِي حَدِيثِ اللُّقَطَةِ قَالَ فَإِنْ جَاءَ بَاغِيهَا فَعَرَفَ عِفَاصَهَا وَعَدَدَهَا فَادْفَعْهَا إِلَيْهِ قَالَ أَبُو دَاوُدَ قَالَ حَمَّادٌ أَيْضًا عَنْ عُبَيْدِ اللهِ بْنِ عُمَرَ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ عَنِ النَّبِيِّ ﷺ مِثْلَهُ
[Machine] The Messenger of Allah ﷺ was asked about a stray camel. He mentioned a hadith and then he was asked about a found object. He said, "Identify its quantity, container, and description, and announce it publicly. If its owner comes and identifies its quantity and description, then return it to him. Otherwise, it belongs to you." Abu Dawud said, "This addition was added by Hammam ibn Salamah in the hadith of Salamah ibn Kuhail, Yahya ibn Sa'id, Rabiah, and Ubaidullah. If its owner comes and identifies its description and container, then return it to him. It is not considered a preserved item." The sheikh said, "We have narrated it from Ath-Thawri from Salamah ibn Kuhail."
أَنَّ رَسُولَ اللهِ ﷺ سُئِلَ عَنْ ضَالَّةِ الْإِبِلِ فَذَكَرَ الْحَدِيثَ قَالَ ثُمَّ سَأَلَهُ عَنِ اللُّقَطَةِ فَقَالَ اعْرِفْ عَدَدَهَا وَوِعَاءَهَا وَعِفَاصَهَا وَعَرِّفْهَا عَامًا فَإِنْ جَاءَ صَاحِبُهَا فَعَرَفَ عَدَدَهَا وَعِفَاصَهَا فَادْفَعْهَا إِلَيْهِ وَإِلَّا فَهِيَ لَكَ قَالَ أَبُو دَاوُدَ وَهَذِهِ الزِّيَادَةُ الَّتِي زَادَهَا حَمَّادُ بْنُ سَلَمَةَ فِي حَدِيثِ سَلَمَةَ بْنِ كُهَيْلٍ وَيَحْيَى بْنِ سَعِيدٍ وَرَبِيعَةَ وَعُبَيْدِ اللهِ إِنْ جَاءَ صَاحِبُهَا فَعَرَفَ عِفَاصَهَا وَوِكَاءَهَا فَادْفَعْهَا إِلَيْهِ لَيْسَتْ بِمَحْفُوظَةٍ قَالَ الشَّيْخُ قَدْ رُوِّينَاهُ عَنِ الثَّوْرِيِّ عَنْ سَلَمَةَ بْنِ كُهَيْلٍ
[Machine] An Arab man came to the Prophet ﷺ with a camel. He said, "Identify its age for me, then identify its womb and its suckling." If someone comes to inform you of it, then accept it, otherwise, spend it (in charity). And he mentioned the rest of the conversation.
جَاءَ أَعْرَابِيٌّ إِلَى النَّبِيِّ ﷺ بِلُقَطَةٍ فَقَالَ عَرِّفْهَا سَنَةً ثُمَّ اعْرِفْ عِفَاصَهَا وَوِكَاءَهَا فَإِنْ جَاءَ أَحَدٌ يُخْبِرُكَ بِهَا وَإِلَّا فَاسْتَنْفِقْهَا وَذَكَرَ بَاقِيَ الْحَدِيثِ
[Machine] Imam Shafi'i said: I give fatwa to the person who knows the value, quality, quantity, weight, and verifies that he did not abandon any falsehood that should be given to him, nor should he be forced to make a judgment except with clear evidence based on it, just as the rights are established. Then he went on to say that the Prophet ﷺ said: Know its value and quality, and Allah knows best how to fulfill its value and quality along with what is fulfilled from it, and he should know when he puts it in his property that it is the found item without his property. It is possible that he relied on the truthfulness of the confessor, and this is the most obvious. The saying of the Messenger of Allah ﷺ is that the burden of proof is on the claimant, so this is a claimant. Have you ever thought that if ten or more people described it accurately and they all got it right, should we give it to them, will they be partners in it? Even if they were a thousand or two thousand, and we know that they are all liars except one, without a doubt, and maybe that one could be a liar who does not deserve anyone with this attribute.
قَالَ الشَّافِعِيُّ أُفْتِي الْمُلْتَقِطَ إِذَا عَرَفَ الْعِفَاصَ وَالْوِكَاءَ وَالْعَدَدَ وَالْوَزْنَ وَوَقَعَ فِي نَفْسِهِ أَنَّهُ لَمْ يَدَعْ بَاطِلًا أَنْ يُعْطِيَهُ وَلَا أُجْبِرُهُ فِي الْحُكْمِ إِلَّا بِبَيِّنَةٍ تَقُومُ عَلَيْهَا كَمَا تَقُومُ عَلَى الْحُقُوقِ ثُمَّ سَاقَ الْكَلَامَ إِلَى أَنْ قَالَ وَإِنَّمَا قَوْلُهُ ﷺ اعْرِفْ عِفَاصَهَا وَوِكَاءَهَا وَاللهُ أَعْلَمُ أَنْ يُؤَدِّيَ عِفَاصَهَا وَوِكَاءَهَا مَعَ مَا يُؤَدِّي مِنْهَا وَلِيعْلَمَ إِذَا وَضَعَهَا فِي مَالِهِ أَنَّهَا اللُّقَطَةُ دُونَ مَالِهِ وَقَدْ يُحْتَمَلُ أَنْ يَكُونَ اسْتَدَلَّ عَلَى صِدْقِ الْمُعْتَرِفِ وَهَذَا الْأَظَهَرُ إِنَّمَا قَوْلُ رَسُولِ اللهِ ﷺ الْبَيِّنَةُ عَلَى الْمُدَّعِي فَهَذَا مُدَّعِي أَرَأَيْتَ لَوْ أَنَّ عَشَرَةً أَوْ أَكْثَرَ وَصَفُوهَا كُلُّهُمْ فَأَصَابُوا صِفَتَهَا أَلَنَا أَنْ نُعْطِيَهُمْ إِيَّاهَا يَكُونُونَ شُرَكَاءَ فِيهَا وَلَوْ كَانُوا أَلْفًا أَوْ أَلْفَيْنِ وَنَحْنُ نَعْلَمُ أَنَّ كُلَّهُمْ كَاذِبٌ إِلَّا وَاحِدًا بِغَيْرِ عَيْنِهِ وَلَعَلَّ الْوَاحِدَ أَنْ يَكُونَ كَاذِبًا لَيْسَ يَسْتَحِقُّ أَحَدٌ بِالصِّفَةِ شَيْئًا
33.11 [Machine] What was mentioned about one who revives?
٣٣۔١١ بَابُ مَا جَاءَ فِيمِنْ أَحْيَا حَسِيرًا
The Prophet ﷺ said: If anyone finds an animal whose owners were helpless to provide fodder to it and so they turned it out (of their house), and he took it and looked after it, it will belong to him. Abu Dawud said: This is the tradition of Hammad. It is more plain and perfect. (Using translation from Abū Dāʾūd 3524)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ وَجَدَ دَابَّةً قَدْ عَجَزَ عَنْهَا أَهْلُهَا أَنْ يَعْلِفُوهَا فَسَيَّبُوهَا فَأَخَذَهَا فَأَحْيَاهَا فَهِيَ لَهُ قَالَ فِي حَدِيثِ أَبَانَ قَالَ عُبَيْدُ اللهِ فَقُلْتُ عَمَّنْ قَالَ؟ عَنْ غَيْرِ وَاحِدٍ مِنَ أَصْحَابِ رَسُولِ اللهِ ﷺ قَالَ أَبُو دَاوُدَ هَذَا لَفْظُ حَدِيثِ حَمَّادٍ وَهُوَ أَبْيَنُ وَأَتَمُّ
The Prophet ﷺ said: If anyone leaves an animal at a place of perishing and another man brings it to life, it belongs to him who brings it to life. (Using translation from Abū Dāʾūd 3525)
عَنِ الشَّعْبِيِّ يَرْفَعُ الْحَدِيثَ إِلَى النَّبِيِّ ﷺ أَنَّهُ قَالَ مَنْ تَرَكَ دَابَّةً بِمَهْلَكٍ فَأَحْيَاهَا رَجُلٌ فَهِيَ لِمَنْ أَحْيَاهَا
[Machine] I heard Al-Sha'abi saying, "Whoever abandons his livestock and leaves it, it belongs to whoever revives it." I asked, "Whose statement is this, O Abu Amr?" He replied, "If you want, I will count for you so and so from the companions of the Messenger of Allah ﷺ. This is a disputed hadith regarding its authenticity, and it is disconnected from the Prophet ﷺ. And everyone has the right to his property until he gives it to someone else. And Allah knows best."
سَمِعْتُ الشَّعْبِيَّ يَقُولُ مَنْ قَامَتْ عَلَيْهِ دَابَّتُهُ فَتَرَكَهَا فَهِيَ لِمَنْ أَحْيَاهَا قُلْتُ عَمَّنْ هَذَا يَا أَبَا عَمْرٍو؟ فَقَالَ إِنْ شِئْتَ عَدَدْتُ لَكَ كَذَا وَكَذَا مِنَ أَصْحَابِ رَسُولِ اللهِ ﷺ هَذَا حَدِيثٌ مُخْتَلَفٌ فِي رَفْعِهِ وَهُوَ عَنِ النَّبِيِّ ﷺ مُنْقَطِعٌ وَكُلُّ أَحَدٍ أَحَقُّ بِمَالِهِ حَتَّى يَجْعَلَهُ لِغَيْرِهِ وَاللهُ أَعْلَمُ
[Machine] Al-Sha'bi said: This has been settled. If he irrigates it with a spring and water and security, then its companion has more right to it. And if he irrigates it with a canal and fright, then the one who took it has more right to it.
قَالَ الشَّعْبِيُّ هَذَا قَدْ قُضِيَ فِيهِ إِنْ كَانَ سَيَّبَهَا فِي كَلَأٍ وَمَاءٍ وَأَمْنٍ فَصَاحِبُهَا أَحَقُّ بِهَا وَإِنْ كَانَ سَيَّبَهَا فِي مَفَازَةٍ وَمَخَافَةٍ فَالَّذِي أَخَذَهَا أَحَقُّ بِهَا
33.12 [Machine] Do not capture the scene of Makkah except for a singer
٣٣۔١٢ بَابُ لَا تَحِلُّ لُقَطَةُ مَكَّةَ إِلَّا لِمُنْشِدٍ
[Machine] He informed him about the Prophet ﷺ in the story of Makkah, its thorns do not bounce, its trees do not break, and its fallen leaves are not collected except by a singer.
أَخْبَرَهُ عَنِ النَّبِيِّ ﷺ فِي قِصَّةِ مَكَّةَ لَا يُخْتَلَى شَوْكُهَا وَلَا يُعْضَدُ شَجَرُهَا وَلَا يَلْتَقِطُ سَاقِطَتَهَا إِلَّا مُنْشِدٌ
[Machine] The Messenger of Allah ﷺ said on the day of the conquest of Mecca, "Verily, this city is sacred. Allah has made it forbidden [to fight] and it was not permissible to kill anyone in it before me. However, it has been made permissible for me for only a short time. It is sacred as Allah has forbidden it until the Day of Resurrection. Its game is not to be scared away, its thorns are not to be cut, and its fallen things are not to be picked up except by the one who recognizes them. Its trees are not to be damaged except the Izdir tree, as it belongs to their homes." Then Al-Abbas said, "Except the Izdhar tree, as it belongs to their homes."
قَالَ رَسُولُ اللهِ ﷺ يَوْمَ فَتْحِ مَكَّةَ إِنَّ هَذَا الْبَلَدَ حَرَامٌ حَرَّمَهُ اللهُ لَمْ يَحِلَّ فِيهِ الْقَتْلُ لِأَحَدٍ قَبْلِي وَإِنَّهَا أُحِلَّتْ لِي سَاعَةً فَهُوَ حَرَامٌ حَرَّمَهُ اللهُ إِلَى يَوْمِ الْقِيَامَةِ لَا يُنَفَّرُ صَيْدُهُ وَلَا يُعْضَدُ شَوْكُهُ وَلَا يَلْتَقِطُ لُقَطَتَهُ إِلَّا مَنْ عَرَّفَهَا وَلَا يُخْتَلَى خَلَاهُ فَقَالَ الْعَبَّاسُ إِلَّا الْإِذْخِرَ؛ فَإِنَّهُ لِبُيُوتِهِمْ فَقَالَ إِلَّا الْإِذْخِرَ
Messenger of Allah ﷺ also said, "It (i.e., Makkah's) thorny bushes should not be uprooted and its game should not be chased, and picking up its fallen things is illegal except by him who makes public announcement about it, and its grass should not be cut." 'Abbas said, "O Messenger of Allah ! Except Idhkhir (a kind of grass)." The Prophet ﷺ said, "Except Idhkhir." (Using translation from Bukhārī 2433)
أَنَّ النَّبِيَّ ﷺ قَالَ لَا يُخْتَلَى خَلَاهَا وَلَا يُعْضَدُ عِضَاهُهَا وَلَا يُنَفَّرُ صَيْدُهَا وَلَا تَحِلُّ لُقَطَتُهَا إِلَّا لِمُنْشِدٍ فَقَالَ الْعَبَّاسُ ؓ إِلَّا الْإِذْخِرَ فَقَالَ إِلَّا الْإِذْخِرَ
[Machine] There is nothing for its creator except singing forever, and it is not permissible for it to be touched by him.
أَنَّهُ لَيْسَ لِوَاجِدِهَا مِنْهَا شَيْءٌ إِلَّا الْإِنْشَادَ أَبَدًا وَإِلَّا فَلَا يَحِلُّ لَهُ أَنْ يَمَسَّهَا
[Machine] The Messenger of Allah ﷺ forbade picking up things dropped by the pilgrims.
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنْ لُقَطَةِ الْحَاجِّ
33.13 [Machine] The answer to your query is "Al-Jualaati".
٣٣۔١٣ بَابُ الْجُعَالَةِ
Some of the Companions of Prophet ﷺ went on a journey. They encamped with a clan of the Arabs and sought hospitality from them, but they refused to provide them with any hospitality. The chief of the clan was stung by a scorpion or bitten by a snake. They gave him all sorts of treatment, but nothing gave him relied. One of them said: Would that you had gone to those people who encamped with you ; some of them might have something which could give you relief to your companion. (So they went and) one of them said: Our chief has been stung by a scorpion or bitten by a snake. We administered all sorts of medicine but nothing gave him relief. Has any of you anything, i.e. charm, which gives healing to our companion. One of those people said: I shall apply charm; we sought hospitality from you, but you refused to entertain us. I am not going to apply charm until you give me some wages. So they offered them a number of sheep. He then came to and recited Faithat-al-Kitab and spat until he was cured as if he were set free from a bond. Thereafter they made payment of the wages as agreed by them. They said: Apportion (the wages). The man who applied the charm said: Do not do until we come to the Messenger of Allah ﷺ and consult him. So they came to the Messenger of Allah ﷺ next morning and mentioned it to him. The Messenger of Allah ﷺ said: From where did you learn that it was a charm ? You have done right. Give me a share along with you. (Using translation from Abū Dāʾūd 3418)
أَنَّ رَهْطًا مِنَ أَصْحَابِ النَّبِيِّ ﷺ انْطَلَقُوا فِي سَفْرَةٍ سَافَرُوهَا فَنَزَلُوا بِحَيٍّ مِنَ أَحْيَاءِ الْعَرَبِ فَاسْتَضَافُوهُمْ فَأَبَوْا أَنْ يُضَيِّفُوهُمْ قَالَ فَلُدِغَ سَيِّدُ ذَلِكَ الْحِيِّ فَسَعَوْا لَهُ بِكُلِّ شَيْءٍ لَا يَنْفَعُهُ شَيْءٌ قَالَ بَعْضُهُمْ لَوْ أَتَيْتُمْ هَؤُلَاءِ الَّذِينَ نَزَلُوا بِكُمْ؛ لَعَلَّ يَكُونُ عِنْدَ بَعْضِهِمْ مَا يَنْفَعُ صَاحِبَكُمْ فَقَالَ بَعْضُهُمْ أَيُّهَا الرَّهْطُ إِنَّ سَيِّدَنَا لَدِيغٌ فَسَعَيْنَا لَهُ بِكُلِّ شَيْءٍ فَهَلْ عِنْدَ أَحَدٍ مِنْكُمْ مَا يَنْفَعُ صَاحِبَنَا؟ فَقَالَ رَجُلٌ مِنَ الْقَوْمِ نَعَمْ إِنِّي لَأَرْقِي وَلَكِنِ اسْتَضَفْنَاكُمْ فَأَبَيْتُمْ أَنْ تُضَيِّفُونَا وَمَا أَنَا بِرَاقٍ حَتَّى تَجْعَلُوا لِي جُعْلًا فَجَعَلُوا لَهُ قَطِيعًا مِنَ الشَّاةِ قَالَ فَأَتَاهُ فَقَرَأَ عَلَيْهِ أُمَّ الْكِتَابِ وَيَتْفِلُ عَلَيْهِ حَتَّى بَرَأَ كَأَنَّهُ نَشِطَ مِنْ عِقَالٍ قَالَ فَأَوْفَاهُمُ الَّذِي صَالَحُوهُ عَلَيْهِ فَقَالَ اقْسِمُوا فَقَالَ الَّذِي رَقَى لَا تَفْعَلُوا؛ نَأْتِي النَّبِيَّ ﷺ فَنَسْتَأْمِرُهُ فَغَدَوْا عَلَى رَسُولِ اللهِ ﷺ فَذَكَرُوا لَهُ فَقَالَ رَسُولُ اللهِ ﷺ مِنْ أَيْنَ عَلِمْتَ أَنَّهَا رُقْيَةٌ؟ وَقَالَ أَحْسَنْتُمْ فَاقْتَسِمُوا وَاضْرِبُوا لِي مَعَكُمْ بِسَهْمٍ
[Machine] The Messenger of Allah ﷺ decided about the slave who was found in the Haram with ten dirhams, and this is weak. The preserved hadith is from Ibn Jurayj who narrated it from Ibn Abi Mulaykah and Amr ibn Dinar, they said: The Messenger of Allah ﷺ decided about the slave who was found outside of the Haram with ten dirhams, and this is disconnected.
قَضَى رَسُولُ اللهِ ﷺ فِي الْعَبْدِ الْآبِقِ يُوجَدُ فِي الْحَرَمِ بِعَشَرَةِ دَرَاهِمَ فَهَذَا ضَعِيفٌ وَالْمَحْفُوظُ حَدِيثُ ابْنِ جُرَيْجٍ عَنِ ابْنِ أَبِي مُلَيْكَةَ وَعَمْرِو بْنِ دِينَارٍ قَالَا جَعَلَ رَسُولُ اللهِ ﷺ فِي الْآبِقِ يُوجَدُ خَارِجًا مِنَ الْحَرَمِ عَشَرَةَ دَرَاهِمَ وَذَلِكَ مُنْقَطِعٌ
[Machine] About Ali regarding the dinar in Jual al-Abiq, whether it is taken near or far, and about Hajjaj from Amr ibn Shuaib that Saeed ibn al-Musayyib used to say that. And about Hajjaj that Ibn Masood used to say, when he comes out of Egypt, forty of the Hajjaj ibn Artat is not to be relied upon.
عَنْ عَلِيٍّ فِي جُعْلِ الْآبِقِ دِينَارٌ قَرِيبًا أُخِذَ أَوْ بَعِيدًا وَعَنِ الْحَجَّاجِ عَنْ عَمْرِو بْنِ شُعَيْبٍ أَنَّ سَعِيدَ بْنَ الْمُسَيِّبِ كَانَ يَقُولُ ذَلِكَ 12124 وَعَنِ الْحَجَّاجِ أَنَّ ابْنَ مَسْعُودٍ كَانَ يَقُولُ إِذَا خَرَجَ مِنَ الْمِصْرِ فَجُعْلُهُ أَرْبَعُونَ الْحَجَّاجُ بْنُ أَرْطَاةَ لَا يُحْتَجُّ بِهِ
[Machine] Forty dirhams for each person is the best that has been narrated in this matter, and it is possible that Abdullah knew the condition of their owner in which whoever turned them away from each person should pay forty dirhams, so he informed him of that and Allah knows best.
أَرْبَعُونَ دِرْهَمًا مِنْ كُلِّ رَأْسٍ وَهَذَا أَمْثَلُ مَا رُوِيَ فِي هَذَا الْبَابِ وَيُحْتَمَلُ أَنْ يَكُونَ عَبْدُ اللهِ عَرَفَ شَرْطَ مَالِكِهِمْ لِمَنْ رَدَّهُمْ عَنْ كُلِّ رَأْسٍ أَرْبَعِينَ دِرْهَمًا فَأَخْبَرَهُ بِذَلِكَ وَاللهُ أَعْلَمُ
[Machine] I brought in a black slave, but he escaped from me, so they accused me in front of Shuraih. He guaranteed me, then this was brought to Ali and he said, "Shuraih lied and the judgment was incorrect." The black slave swears to the red slave that he did not escape from him, and then he is not responsible for anything.
جِئْتُ بِعَبْدٍ آبِقٍ مِنَ السَّوَادِ فَانْفَلَتَ مِنِّي فَخَاصَمُونِي إِلَى شُرَيْحٍ فَضَمَّنَنِيهُ قَالَ فَرُفِعَ ذَلِكَ إِلَى عَلِيٍّ ؓ فَقَالَ كَذَبَ شُرَيْحٌ وَأَخْطَأَ الْقَضَاءَ يَحْلِفُ الْعَبْدُ الْأَسْوَدُ لِلْعَبْدِ الْأَحْمَرِ لَانْفَلَتَ مِنْهُ انْفِلَاتًا ثُمَّ لَا شَيْءَ عَلَيْهِ
[Machine] About Ali, in a man, he finds a fault, so he blames him, without guaranteeing him. But a slice guaranteed him. And we say by the words of Ali, if the fault is bigger than exceeding it, and Allah knows best.
عَنْ عَلِيٍّ ؓ فِي الرَّجُلِ يَجِدُ الْآبِقَ فَيَأْبَقُ مِنْهُ لَا يَضْمَنُهُ وَضَمَّنَهُ شُرَيْحٌ وَنَحْنُ نَقُولُ بِقَوْلِ عَلِيٍّ إِنْ كَانَ الْآبِقُ أَبِقَ مِنْ دُونِ تَعَدِّيهِ وَاللهُ أَعْلَمُ
33.14 [Machine] Capturing the abandoned and it is not permissible to leave it lost.
٣٣۔١٤ بَابُ الْتِقَاطِ الْمَنْبُوذِ وَأَنَّهُ لَا يَجُوزُ تَرْكُهُ ضَائِعًا
A Muslim is a Muslim’s brother: he does not wrong him or abandon him. If anyone cares for his brother’s need, Allah will care for his need ; if anyone removes a Muslim’s anxiety, Allah will remove from him, on account of it, one of the anxieties of the Day of resurrection ; and if anyone conceals a Muslim’s fault, Allah will conceal his fault on the Day of resurrection. أَخْبَرَهُ أَنَّ رَسُولَ اللهِ ﷺ قَالَ الْمُسْلِمُ أَخُو الْمُسْلِمِ لَا يَظْلِمُهُ وَلَا يُسْلِمُهُ مَنْ كَانَ فِي حَاجَةِ أَخِيهِ كَانَ اللهُ فِي حَاجَتِهِ وَمَنْ فَرَّجَ عَنْ مُسْلِمٍ كُرْبَةً فَرَّجَ اللهُ عَنْهُ بِهَا كُرْبَةً مِنْ كُرَبِ يَوْمِ الْقِيَامَةِ وَمَنْ سَتَرَ عَلَى مُسْلِمٍ سَتَرَهُ اللهُ يَوْمَ الْقِيَامَةِ
[Machine] "Narrated by the Prophet ﷺ , he said: Whoever leaves behind wealth, it belongs to his inheritors, and whoever leaves behind debt, it is upon us."
عَنِ النَّبِيِّ ﷺ قَالَ مَنْ تَرَكَ مَالًا فَلِوَرَثَتِهِ وَمَنْ تَرَكَ كَلًّا فَإِلَيْنَا
[Machine] And the Messenger of Allah ﷺ said, "I am the closest of all people to the believers in the Book of Allah. So, whoever leaves behind a debt or inheritance, let them call upon me for help. I am their guardian. And whoever leaves behind wealth, they should prefer their family over it."
وَقَالَ رَسُولُ اللهِ ﷺ أَنَا أَوْلَى النَّاسِ بِالْمُؤْمِنِينَ فِي كِتَابِ اللهِ فَأَيُّكُمْ مَا تَرَكَ دَيْنًا أَوْ ضَيْعَةً فَادْعُونِي؛ فَإِنِّي وَلِيُّهُ وَأَيُّكُمْ مَا تَرَكَ مَالًا فَلْيُؤْثِرْ بِمَالِهِ عَصَبَتَهُ مَنْ كَانَ
[Machine] Then Umar read this verse: "Indeed, Allah has purchased from the believers their lives and their properties [in exchange] for that they will have Paradise." [Quran 9:111] He then said, "Allah has given both of these transactions to him (the believer). And by Allah, if it were not for Allah extending His provisions to you from His treasures beforehand, I would have taken the wealth of this man for his own benefit and for his family. But I have divided it among the poor emigrants."
ثُمَّ قَرَأَ عُمَرُ هَذِهِ الْآيَةَ {إِنَّ اللهَ اشْتَرَى مِنَ الْمُؤْمِنِينَ أَنْفُسَهُمْ وَأَمْوَالَهُمْ بِأَنَّ لَهُمُ الْجَنَّةَ} [التوبة 111] الْآيَةَ فَجَعَلَ لَهُ الصَّفْقَتَيْنِ جَمِيعًا وَاللهِ لَوْلَا أَنَّ اللهَ أَمَدَّكُمْ بِخَزَائِنَ مِنْ قِبَلِهِ لَأَخَذْتُ فَضْلَ مَالِ الرَّجُلِ عَنْ نَفْسِهِ وَعِيَالِهِ فَقَسَمْتُهُ بَيْنَ فُقَرَاءِ الْمُهَاجِرِينَ
[Machine] So he heard the sound of a newborn baby crying until he went to him, and there was his mother with him. He said to her, "What is the matter with you?" She said, "I came to this market for something I needed, and labor came upon me, and I gave birth to a boy." He said, "And is she next to the house of a people in the market?" He said, "Has anyone from the people of this house noticed you?" He said, "May God not bless the people of this house. If I had known that they noticed you and did not help you, I would have done something to them and done something else." Then he prayed for her with a drink of saouak and said, "Drink this, it cuts off hunger, protects the stomach, and strengthens the veins." Then we entered the mosque and he prayed with the people. As-Sa'q said, "Azhar informed me from Fil, who said, "If I had known that they noticed you and did not help you with anything, I would have burned them."
فَسَمِعَ صَوْتَ صَبِيٍّ مَوْلُودٍ يَبْكِي حَتَّى قَامَ عَلَيْهِ فَإِذَا عِنْدَهُ أُمُّهُ فَقَالَ لَهَا مَا شَأْنُكِ؟ قَالَتْ جِئْتُ إِلَى هَذَا السُّوقِ لِبَعْضِ الْحَاجَةِ فَعَرَضَ لِيَ الْمَخَاضُ فَوَلَدَتْ غُلَامًا قَالَ وَهِيَ إِلَى جَنْبِ دَارِ قَوْمٍ فِي السُّوقِ فَقَالَ هَلْ شَعَرَ بِكِ أَحَدٌ مِنَ أَهْلِ هَذِهِ الدَّارِ؟ وَقَالَ مَا ضَيَّعَ اللهُ أَهْلَ هَذِهِ الدَّارِ أَمَا أَنِّي لَوْ عَلِمْتُ أَنَّهُمْ شَعَرُوا بِكِ ثُمَّ لَمْ يَنْفَعُوكِ فَعَلْتُ بِهِمْ وَفَعَلْتُ ثُمَّ دَعَا لَهَا بِشَرْبَةِ سَوِيقٍ فَقَالَ اشْرَبِي هَذِهِ تَقْطَعُ الْحَشَا وَتَعْصِمُ الْأَمْعَاءَ وَتُدِرُّ الْعُرُوقَ ثُمَّ دَخَلْنَا الْمَسْجِدَ فَصَلَّى بِالنَّاسِ قَالَ الصَّعْقُ حَدَّثَنِي أَزْهَرُ عَنْ فِيلٍ قَالَ وَلَوْ عَلِمْتُ أَنَّهُمْ شَعَرُوا بِكِ ثُمَّ لَمْ يَنْفَعُوكِ بِشَيْءٍ لَحَرَّقْتُ عَلَيْهِمْ
[Machine] "Omar, go, for he is free and his loyalty is for you, and his expenses are upon us from the treasury. This is a summarized narration from Ash-Shafi'i and Abdullah bin Razzaq that he took someone who was expelled and brought him to Omar, so Omar said to him, he is free and his loyalty is for you, and his expenses are upon us from the treasury."
عُمَرُ اذْهَبْ فَهُوَ حُرٌّ وَلَكَ وَلَاؤُهُ وَعَلَيْنَا نَفَقَتُهُ لَفْظُ حَدِيثِ الشَّافِعِيِّ وَحَدِيثُ عَبْدِ الرَّزَّاقِ مُخْتَصَرًا أَنَّهُ الْتَقَطَ مَنْبُوذًا فَجَاءَ بِهِ إِلَى عُمَرَ فَقَالَ لَهُ عُمَرُ هُوَ حُرٌّ وَوَلَاؤُهُ لَكَ وَنَفَقَتُهُ عَلَيْنَا مِنْ بَيْتِ الْمَالِ
[Machine] Indeed, the Prophet ﷺ came to realize that he had gone out during the year of the Conquest, and he informed him that he had found him ostracized during the caliphate of Umar ibn al-Khattab. So he took him, and said, "This was mentioned by an informant." When Umar saw me, he said, "Perhaps you have done something wrong to cause you to take this soul?" I said, "I found it lost, so I took it." The informant said, "Indeed, he is a righteous man." Umar said, "In that case, take him, for he is free and his loyalty belongs to you, and his provision is on us."
أَنَّهُ أَدْرَكَ النَّبِيَّ ﷺ أَنَّهُ كَانَ خَرَجَ مَعَهُ عَامَ الْفَتْحِ فَأَخْبَرَهُ أَنَّهُ وَجَدَ مَنْبُوذًا فِي خِلَافَةِ عُمَرَ بْنِ الْخَطَّابِ ؓ فَأَخَذَهُ قَالَ فَذَكَرَ ذَلِكَ عَرِيفِيٌّ فَلَمَّا رَآنِي عُمَرُ قَالَ عَسَى الْغُوَيْرُ أَبْؤُسًا مَا حَمَلَكَ عَلَى أَخْذِكَ هَذِهِ النَّسَمَةَ؟ قَالَ قُلْتُ وَجَدْتُهَا ضَائِعَةً فَأَخَذْتُهَا فَقَالَ عَرِيفِيٌّ إِنَّهُ رَجُلٌ صَالِحٌ قَالَ كَذَلِكَ قَالَ نَعَمْ قَالَ فَاذْهَبْ بِهِ فَهُوَ حُرٌّ وَلَكَ وَلَاؤُهُ وَعَلَيْنَا نَفَقَتُهُ
33.15 [Machine] Who said: The illegitimate child is free, and he has no allegiance, in accordance with the saying of the Prophet ﷺ : "Verily, allegiance is only for those who have been emancipated.
٣٣۔١٥ بَابُ مَنْ قَالَ: اللَّقِيطُ حُرٌّ، لَا وَلَاءَ عَلَيْهِ لِقَوْلِ النَّبِيِّ ﷺ: " إِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ "
And they sold him for a reduced price - a few dirhams - and they were, concerning him, of those content with little. (Using translation from Qurʾān 12:20)
أَنَّهُ حُرٌّ وَقَرَأَ هَذِهِ الْآيَةَ {وَشَرَوْهُ بِثَمَنٍ بَخْسٍ دَرَاهِمَ مَعْدُودَةٍ وَكَانُوا فِيهِ مِنَ الزَّاهِدِينَ} [يوسف 20]
أَبَى اللهُ ذَلِكَ أَمَا تَقْرَأُ سُورَةَ يُوسُفَ؟
33.16 [Machine] The child follows his parents in disbelief, so when one of them becomes a Muslim, the child follows him in Islam. Allah, the Most High, says: "And those who believe and whose offspring follow them in faith" [At-Tur: 21]. And it is recited as: "And We made their offspring follow them in faith.
٣٣۔١٦ بَابُ الْوَلَدِ يَتْبَعُ أَبَوَيْهِ فِي الْكُفْرِ، فَإِذَا أَسْلَمَ أَحَدُهُمَا تَبِعَهُ الْوَلَدُ فِي الْإِسْلَامِ قَالَ اللهُ تَعَالَى {وَالَّذِينَ آمَنُوا وَاتَّبَعَتْهُمْ ذُرِّيَّتُهُمْ بِإِيمَانٍ} [الطور: 21]، وَقُرِئَ (وَأَتْبَعْنَاهُمْ ذُرِّيَّاتِهِمْ بِإِيمَانٍ أَلْحَقْنَا بِهِمْ ذُرِّيَّاتِهِمْ)
Every child is born on Islam, but his parents make him a Jew and a Christian, just as a beast is born whole. Do you find some among them (born) maimed? The people asked : Messenger of Allah! What do you think about the one who died while he was young? He replied : Allah knows best what he was going to do. (Using translation from Abū Dāʾūd 4714)
قَالَ رَسُولُ اللهِ ﷺ كُلُّ مَوْلُودٍ يُولَدُ عَلَى الْفِطْرَةِ فَأَبَوَاهُ يُهَوِّدَانِهِ وَيُنَصِّرَانِهِ كَمَا تَنَاتَجُ الْإِبِلُ مِنْ بَهِيمَةٍ جَمْعَاءَ هَلْ تُحِسُّ فِيهَا مِنْ جَدْعَاءَ؟ قَالُوا يَا رَسُولُ اللهِ أَفَرَأَيْتَ مَنْ يَمُوتُ وَهُوَ صَغِيرٌ؟ قَالَ اللهُ أَعْلَمُ بِمَا كَانُوا عَامِلِينَ
[Machine] The Messenger of Allah ﷺ said: "There is no newborn among the children of Adam except that he is born upon the fitrah (natural disposition), until his parents make him Jewish, Christian, or Magian, just as an animal gives birth to a perfect offspring. Do you find any among them imperfect? Then Abu Hurairah recited: 'The fitrah (natural disposition) of Allah upon which He has created [all] people. No change should there be in the creation of Allah. That is the correct religion, but most of the people do not know.'" [Quran 30:30]
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَا مِنْ مَوْلُودٍ فِي بَنِي آدَمَ إِلَّا يُولَدُ عَلَى الْفِطْرَةِ حَتَّى يَكُونَ أَبَوَاهُ يُهَوِّدَانِهِ أَوْ يُنَصِّرَانِهِ أَوْ يُمَجِّسَانِهِ كَمَا تُنْتَجُ الْبَهِيمَةُ بَهِيمَةً جَمْعَاءَ هَلْ تُحِسُّونَ فِيهَا مِنْ جَدْعَاءَ؟ ثُمَّ يَقُولُ أَبُو هُرَيْرَةَ وَاقْرَءُوا إِنْ شِئْتُمْ {فِطْرَةَ اللهِ الَّتِي فَطَرَ النَّاسَ عَلَيْهَا لَا تَبْدِيلَ لِخَلْقِ اللهِ ذَلِكَ الدِّينُ الْقَيِّمُ وَلَكِنَّ أَكْثَرَ النَّاسِ لَا يَعْلَمُونَ} [الروم 30]
Messenger of Allah ﷺ said, "No child is born but has the Islamic Faith, but its parents turn it into a Jew or a Christian. It is as you help the animals give birth. Do you find among their offspring a mutilated one before you mutilate them yourself?" The people said, "O Messenger of Allah ﷺ! What do you think about those (of them) who die young?" The Prophet ﷺ said, "Allah knows what they would have done (were they to live)." (Using translation from Bukhārī 6599)
قَالَ رَسُولُ اللهِ ﷺ مَنْ يُولَدُ يُولَدُ عَلَى هَذِهِ الْفِطْرَةِ فَأَبَوَاهُ يُهَوِّدَانِهِ وَيُنَصِّرَانِهِ كَمَا تُنْتَجُ الْبَهِيمَةُ فَهَلْ تَجِدُونَ فِيهَا مِنْ جَدْعَاءَ حَتَّى تَكُونُوا أَنْتُمْ تَجْدَعُونَهَا؟ قَالُوا يَا رَسُولُ اللهِ أَفَرَأَيْتَ مَنْ يَمُوتُ وَهُوَ صَغِيرٌ؟ قَالَ اللهُ أَعْلَمُ بِمَا كَانُوا عَامِلِينَ
[Machine] The Messenger of Allah ﷺ said, "There is no newborn except that they are born upon this religion until their tongue becomes apparent, and then their parents either make them into Jews, or Christians, or polytheists, or magicians." They asked, "O Messenger of Allah, what about those who came before that?" Meaning, those who have died. He said, "Allah knows best what they were doing."
قَالَ رَسُولُ اللهِ ﷺ لَيْسَ مِنْ مَوْلُودٍ يُولَدُ إِلَّا عَلَى هَذِهِ الْمِلَّةِ حَتَّى يُبِينَ عَنْهُ لِسَانُهُ فَأَبَوَاهُ يُهَوِّدَانِهِ أَوْ يُنَصِّرَانِهِ أَوْ يُشَرِّكَانِهِ أَوْ يُمَجِّسَانِهِ قَالَ فَقَالُوا يَا رَسُولَ اللهِ فَكَيْفَ بِمَنْ كَانَ قَبْلَ ذَلِكَ؟ يَعْنِي مَاتَ قَالَ اللهُ أَعْلَمُ بِمَا كَانُوا عَامِلِينَ
The mother of every person gives him birth according to his true nature. It is subsequently his parents who make him a Jew or a Christian or a Magian. Had his parents been Muslim he would have also remained a Muslim. Every person to whom his mother gives birth (has two aspects of his life) ; when his mother gives birth Satan strikes him but it was not the case with Mary and her son (Jesus Christ). أَنَّ رَسُولَ اللهِ ﷺ قَالَ كُلُّ إِنْسَانٍ تَلِدُهُ أُمُّهُ عَلَى الْفِطْرَةِ أَبَوَاهُ يُهَوِّدَانِهِ أَوْ يُنَصِّرَانِهِ أَوْ يُمَجِّسَانِهِ فَإِنْ كَانَا مُسْلِمَيْنِ فَمُسْلِمٌ كُلُّ إِنْسَانٍ تَلِدُهُ أُمُّهُ يَلْكُزُهُ الشَّيْطَانُ فِي حِضْنَيْهِ إِلَّا مَرْيَمَ وَابْنَهَا
[Machine] Narrated by the Prophet ﷺ , "Every newborn is born on the Fitrah (natural inclination towards goodness) until his parents convert him to Judaism or Christianity or change his nature. Al-Shafi'i, in the old narration of Abu 'Abd al-Rahman al-Baghdadi, stated that the Prophet ﷺ said, 'Every newborn is born on the Fitrah (the natural inclination upon which Allah has created mankind), and it is the parents who turn them into one of the two beliefs: faith or disbelief.' They have no choice in themselves, and the judgment is only for their parents. So, as their parents were on the day they were born, they are either believers, so they are judged by their faith, or disbelievers, so they are judged by their disbelief."
عَنِ النَّبِيِّ ﷺ قَالَ كُلُّ مَوْلُودٍ يُولَدُ عَلَى الْفِطْرَةِ حَتَّى يُعْرِبَ عَنْ نَفْسِهِ زَادَ فِيهِ غَيْرُهُ فَأَبَوَاهُ يُهَوِّدَانِهِ وَيُنَصِّرَانِهِ قَالَ الشَّافِعِيُّ فِي الْقَدِيمِ فِي رِوَايَةِ أَبِي عَبْدِ الرَّحْمَنِ الْبَغْدَادِيِّ عَنْهُ قَوْلُ النَّبِيِّ ﷺ كُلُّ مَوْلُودٍ يُولَدُ عَلَى الْفِطْرَةِ الَّتِي فَطَرَ اللهُ عَلَيْهَا الْخَلْقَ فَجَعَلَهُمْ رَسُولُ اللهِ ﷺ مَا لَمْ يُفْصِحُوا بِالْقَوْلِ فَيَخْتَارُوا أَحَدَ الْقَوْلَيْنِ؛ الْإِيمَانَ أَوِ الْكُفْرَ لَا حُكْمَ لَهُمْ فِي أَنْفُسِهِمْ إِنَّمَا الْحُكْمُ لَهُمْ بِآبَائِهِمْ فَمَا كَانَ آبَاؤُهُمْ يَوْمَ يُولَدُونَ فَهُوَ بِحَالِهِ إِمَّا مُؤْمِنٌ فَعَلَى إِيمَانِهِ أَوْ كَافِرٌ فَعَلَى كُفْرِهِ
In our opinion it means that covenant which Allah had taken in the loins of their fathers when He said : “Am I not your Lord? They said: Yes. (Using translation from Abū Dāʾūd 4716)
سَمِعْتُ حَمَّادَ بْنَ سَلَمَةَ يُفَسِّرُ حَدِيثَ كُلُّ مَوْلُودٍ يُولَدُ عَلَى الْفِطْرَةِ قَالَ هَذَا عِنْدَنَا حَيْثُ أَخَذَ اللهُ ﷻ عَلَيْهِمُ الْعَهْدَ فِي أَصْلَابِ آبَائِهِمْ حَيْثُ قَالَ {أَلَسْتُ بِرَبِّكُمْ قَالُوا بَلَى} [الأعراف 172]
[Machine] That the messenger of Allah ﷺ said: "Every child is born on the Fitrah (natural inclination towards Islam), then his parents make him Jewish, Christian or Magian." Al-Awza'i said: "They do not remove him from the knowledge of Allah, and they will ultimately return to the knowledge of Allah."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ كُلُّ مَوْلُودٍ يُولَدُ عَلَى الْفِطْرَةِ فَأَبَوَاهُ يُهَوِّدَانِهِ وَيُنَصِّرَانِهِ وَيُمَجِّسَانِهِ قَالَ الْأَوْزَاعِيُّ لَا يُخْرِجَانِهِ مِنْ عِلْمِ اللهِ وَإِلَى عِلْمِ اللهِ يَصِيرُونَ
33.17 [Machine] The conversion of some who became Muslim through the Islam of his parents or one of them from the children of the Sahaba.
٣٣۔١٧ بَابُ ذِكْرِ بَعْضِ مَنْ صَارَ مُسْلِمًا بِإِسْلَامِ أَبَوَيْهِ أَوْ أَحَدِهِمَا مِنَ أَوْلَادِ الصَّحَابَةِ مْ
[Machine] The Prophet ﷺ said, "By Allah, I have never seen my parents except that they practiced religion, and there has never been a day that passed us by without the Messenger of Allah ﷺ coming to us in the morning and evening."
النَّبِيِّ ﷺ قَالَتْ وَاللهِ مَا عَقَلْتُ أَبَوَيَّ قَطُّ إِلَّا يَدِينَانِ الدِّينَ وَمَا مَرَّ عَلَيْنَا يَوْمٌ قَطُّ إِلَّا يَأْتِينَا فِيهِ رَسُولُ اللهِ ﷺ بُكْرَةً وَعَشِيًّا
[Machine] "And I am the one who was circumcised, so I came to the city and stayed in Quba. I was born in Quba, then I was brought to the Messenger of Allah ﷺ and he placed me in his lap. Then he called for a date and chewed it, then he placed it in my mouth. The first thing that entered my stomach was the saliva of the Messenger of Allah ﷺ . Then he rubbed my palate and made supplication for me and blessed me. I was the first child to be born in Islam."
وَأَنَا مُتِمٌّ فَأَتَيْتُ الْمَدِينَةَ فَنَزَلْتُ بِقُبَاءَ فَوَلَدْتُهُ بِقُبَاءَ ثُمَّ أَتَيْتُ بِهِ رَسُولَ اللهِ ﷺ فَوَضَعَهُ فِي حِجْرِهِ ثُمَّ دَعَا بِتَمْرَةٍ فَمَضَغَهَا ثُمَّ تَفَلَ فِي فِيهِ فَكَانَ أَوَّلَ شَيْءٍ دَخَلَ جَوْفَهُ رِيقُ رَسُولِ اللهِ ﷺ ثُمَّ حَنَّكَهُ ثُمَّ دَعَا لَهُ وَبَرَّكَ عَلَيْهِ وَكَانَ أَوَّلَ مَوْلُودٍ وُلِدَ فِي الْإِسْلَامِ
[Machine] I was reading to Umm Sa'd bint Rabee'ah, who was an orphan living in the house of Abu Bakr. I read the verse {And those who break their oaths} [Quran 4:33]. She said, "Don't read it {And those who break their oaths} [Quran 4:33]. It was revealed about Abu Bakr and his son Abdur Rahman when they refused to accept Islam. Abu Bakr swore not to leave any inheritance for him, but when he embraced Islam, the Prophet Muhammad ﷺ ordered that he should be given his share. Abdul Aziz gained this share, and he did not embrace Islam until he was forced by the sword. Imam Ahmad (may Allah have mercy on him) said, and Al-Waqidi claimed that Abdul Rahman embraced Islam during the Hudaybiyyah Treaty, and Ali ibn Zaid claimed that he migrated from the young men of Quraysh to the Prophet Muhammad ﷺ before the conquest. Abu Ubaidah claimed that his name was Abdul Azza in the pre-Islamic period, so the Messenger of Allah ﷺ named him Abdul Rahman. Mus'ab ibn Abdullah al-Zubayri claimed that Umm Abdul Rahman and Aisha, the mother of Rumman ibn Amir, embraced Islam and their Islam was good.
كُنْتُ أَقْرَأُ عَلَى أُمِّ سَعْدٍ بِنْتِ الرَّبِيعِ وَكَانَتْ يَتِيمَةً فِي حِجْرِ أَبِي بَكْرٍ فَقَرَأْتُ {وَالَّذِينَ عَقَدَتْ أَيْمَانُكُمْ} [النساء 33] فَقَالَتْ لَا تَقْرَأْ {وَالَّذِينَ عَقَدَتْ أَيْمَانُكُمْ} [النساء 33]؛ إِنَّمَا نَزَلَتْ فِي أَبِي بَكْرٍ وَابْنِهِ عَبْدِ الرَّحْمَنِ حِينَ أَبَى الْإِسْلَامَ فَحَلَفَ أَبُو بَكْرٍ ؓ أَنْ لَا يُوَرِّثَهُ فَلَمَّا أَسْلَمَ أَمَرَهُ نَبِيُّ اللهِ ﷺ أَنْ يُؤْتِيَهُ نَصِيبَهُ زَادَ عَبْدُ الْعَزِيزِ وَمَا أَسْلَمَ حَتَّى حُمِلَ عَلَى الْإِسْلَامِ بِالسَّيْفِ قَالَ الْإِمَامُ أَحْمَدُ رَحِمَهُ اللهُ وَزَعَمَ الْوَاقِدِيُّ أَنَّ عَبْدَ الرَّحْمَنِ أَسْلَمَ فِي هُدْنَةِ الْحُدَيْبِيَةِ وَزَعَمَ عَلِيُّ بْنُ زَيْدٍ أَنَّهُ هَاجَرَ فِي فِتْيَةٍ مِنْ قُرَيْشٍ إِلَى النَّبِيِّ ﷺ قَبْلَ الْفَتْحِ وَزَعَمَ أَبُو عُبَيْدَةَ أَنَّ اسْمَ عَبْدِ الرَّحْمَنِ فِي الْجَاهِلِيَّةِ عَبْدُ الْعُزَّى فَسَمَّاهُ رَسُولُ اللهِ ﷺ عَبْدَ الرَّحْمَنِ وَزَعَمَ مُصْعَبُ بْنُ عَبْدِ اللهِ الزُّبَيْرِيُّ أَنَّ أُمَّ عَبْدِ الرَّحْمَنِ وَعَائِشَةَ أُمُّ رُومَانَ بِنْتَ عَامِرٍ أَسْلَمَتْ وَحَسُنَ إِسْلَامُهَا
[Machine] The Messenger of Allah (PBUH) once came up to me on the day of Uhud when I was fourteen years old and patted me on the shoulder. It has been said that Hafsah and Abdullah embraced Islam before their father, and Abdullah was young at the time. His Islam was completed through his father's Islam, and Allah knows best. As for Abbas bin Abdul-Muttalib, he went to Badr with the polytheists and was captured until he ransomed himself and embraced Islam.
عَرَضَنِي رَسُولُ اللهِ ﷺ يَوْمَ أُحُدٍ وَأَنَا ابْنُ أَرْبَعَ عَشْرَةَ سَنَةً فَاسْتَصْغَرَنِي وَقَدْ قِيلَ إِنَّ حَفْصَةَ وَعَبْدَ اللهِ أَسْلَمَا قَبْلَ أَبِيهِمَا وَعَبْدُ اللهِ كَانَ صَغِيرًا حِينَئِذٍ فَإِنَّمَا تَمَّ إِسْلَامُهُ بِإِسْلَامِ أَبِيهِ وَاللهُ أَعْلَمُ وَأَمَّا الْعَبَّاسُ بْنُ عَبْدِ الْمُطَّلِبِ ؓ فَإِنَّهُ خَرَجَ إِلَى بَدْرٍ مَعَ الْمُشْرِكِينَ وَأُسِرَ حَتَّى فَدَى نَفْسَهُ وَأَسْلَمَ
[Machine] "Some men from the Ansar sought permission from the Messenger of Allah ﷺ and said, 'Grant us permission, O Messenger of Allah, to leave and offer our loyalty to our cousin, Abbas.' The Messenger replied, 'No, by Allah, you will not leave even a single dirham.'"
أَنَّ رِجَالًا مِنَ الْأَنْصَارِ اسْتَأْذَنُوا رَسُولَ اللهِ ﷺ فَقَالُوا ائْذَنْ لَنَا يَا رَسُولَ اللهِ فَلنَتْرُكْ لِابْنِ أُخْتِنَا عَبَّاسٍ فِدَاءَهُ فَقَالَ لَا وَاللهِ لَا تَذَرُونَ دِرْهَمًا
عَنْ سُفْيَانَ
[Machine] I and my mother were among those whom Allah, the Most High, mentioned their mention.
كُنْتُ أَنَا وَأُمِّي مِمَّنْ عَذَرَ اللهُ تَعَالَى ذِكْرُهُ
[Machine] I heard the Messenger of Allah ﷺ saying, "Islam will increase and not decrease." And it was narrated by Abd al-Warith from Amr from Abdullah ibn Buraydah from Yahya from Abu al-Aswad that a man told him that Muadh said, "He mentioned it in this manner and raised it." Abu Ali al-Rudhbari informed us that Muhammad ibn Bakr told us, on the authority of Abu Dawud, on the authority of Musaddad, on the authority of Abd al-Warith, and Allah knows best, that the ruling of Islam will prevail and one of its prevailings is that a child is ruled by Islam by the Islam of one of his parents.
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ الْإِسْلَامُ يَزِيدُ وَلَا يَنْقُصُ 12154 وَرَوَاهُ عَبْدُ الْوَارِثِ عَنْ عَمْرٍو عَنْ عَبْدِ اللهِ بْنِ بُرَيْدَةَ عَنْ يَحْيَى عَنْ أَبِي الْأَسْوَدِ أَنَّ رَجُلًا حَدَّثَهُ أَنَّ مُعَاذًا قَالَ فَذَكَرَهُ كَذَلِكَ مَرْفُوعًا أَخْبَرَنَاهُ أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ مُحَمَّدُ بْنُ بَكْرٍ ثنا أَبُو دَاوُدَ ثنا مُسَدَّدٌ ثنا عَبْدُ الْوَارِثِ وَإِنَّمَا أَرَادَ وَاللهُ أَعْلَمُ أَنَّ حُكْمَ الْإِسْلَامِ يَغْلِبُ وَمِنْ تَغْلِيبِهِ أَنْ يُحْكَمَ لِلْوَلَدِ بِالْإِسْلَامِ بِإِسْلَامِ أَحَدِ أَبَوَيْهِ
[Machine] He came on the day of conquest with Abu Sufyan ibn Harb and the Messenger of Allah ﷺ and his companions were with him. They said, "This is Abu Sufyan and 'A'idh ibn 'Amr." The Messenger of Allah ﷺ said, "This is 'A'idh ibn 'Amr and Abu Sufyan, Islam is more honorable than that." Islam is elevated and not elevated. Imam Ahmad (may Allah have mercy on him) said, and Hasan, Shurayh, Ibrahim, and Qatadah said: If one of them becomes Muslim, the child is with the Muslim.
أَنَّهُ جَاءَ يَوْمَ الْفَتْحِ مَعَ أَبِي سُفْيَانَ بْنِ حَرْبٍ وَرَسُولُ اللهِ ﷺ حَوْلَهُ أَصْحَابُهُ فَقَالُوا هَذَا أَبُو سُفْيَانَ وَعَائِذُ بْنُ عَمْرٍو فَقَالَ رَسُولُ اللهِ ﷺ هَذَا عَائِذُ بْنُ عَمْرٍو وَأَبُو سُفْيَانَ الْإِسْلَامُ أَعَزُّ مِنْ ذَلِكَ الْإِسْلَامُ يَعْلُو وَلَا يُعْلَى قَالَ الْإِمَامُ أَحْمَدُ رَحِمَهُ اللهُ وَقَالَ الْحَسَنُ وَشُرَيْحٌ وَإِبْرَاهِيمُ وَقَتَادَةُ إِذَا أَسْلَمَ أَحَدُهُمَا فَالْوَلَدُ مَعَ الْمُسْلِمِ
33.18 [Machine] Who said: "The child and his parents are not considered Muslim until he reaches puberty and describes Islam.
٣٣۔١٨ بَابُ مَنْ قَالَ: لَا يُحْكَمُ بِإِسْلَامِ الصَّبِيِّ بِنَفْسِهِ وَأَبَوَاهُ كَافِرَانِ حَتَّى يَبْلُغَ فَيَصِفَ الْإِسْلَامَ
[Machine] The Prophet ﷺ said, "The pen is lifted from three: from the child until they reach the age of puberty, from the insane person until they regain sanity, and from the sleeper until they wake up." And it was narrated from Ali ibn Abi Talib (may Allah be pleased with him) from the Prophet ﷺ .
النَّبِيِّ ﷺ قَالَ رُفِعَ الْقَلَمُ عَنْ ثَلَاثَةٍ عَنِ الصَّبِيِّ حَتَّى يَحْتَلِمَ وَعَنِ الْمَعْتُوهِ حَتَّى يُفِيقَ وَعَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ وَرُوِّينَا عَنْ عَلِيِّ بْنِ أَبِي طَالِبٍ ؓ عَنِ النَّبِيِّ ﷺ
