[Machine] The messenger of Allah ﷺ passed by a date palm on the road and said, "If it were not for the fact that I fear it may be charity, I would have eaten it." He said, "Then Ibn Umar passed by a date palm on the road and ate it."  

البيهقي:١٢٠٩٧ – أَخْبَرَنَا أَبُو مُحَمَّدٍ جَنَاحُ بْنُ نُذَيْرِ بْنِ جَنَاحٍ ثنا أَبُو جَعْفَرِ بْنُ دُحَيْمٍ ثنا مُحَمَّدُ بْنُ الْحُسَيْنِ بْنِ أَبِي الْحُنَيْنِ الْقَزَّازُ ثنا قَبِيصَةُ بْنُ عُقْبَةَ عَنْ سُفْيَانَ عَنْ مَنْصُورٍ عَنْ طَلْحَةَ بْنِ مُصَرِّفٍ عَنْ أَنَسٍ ؓ قَالَ

مَرَّ رَسُولُ اللهِ ﷺ عَلَى تَمْرَةٍ فِي الطَّرِيقِ مَطْرُوحَةٍ فَقَالَ لَوْلَا أَنِّي أَخْشَى أَنْ تَكُونَ مِنَ الصَّدَقَةِ لَأَكَلْتُهَا 12097 قَالَ وَمَرَّ ابْنُ عُمَرَ بِتَمْرَةٍ مَطْرُوحَةٍ فِي الطَّرِيقِ فَأَكَلَهَا  

رَوَاهُ الْبُخَارِيُّ فِي الصَّحِيحِ عَنْ قَبِيصَةَ وَأَخْرَجَهُ مُسْلِمٌ مِنْ وَجْهٍ آخَرَ عَنِ الثَّوْرِيِّ دُونَ ابْنِ عُمَرَ وَقَدْ رُوِّينَاهُ مِنْ حَدِيثِ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ ﷺ إِلَّا أَنَّهُ قَالَ إِنِّي لَأَدْخُلُ بَيْتِي أَجِدُ التَّمْرَةَ مُلْقَاةً عَلَى فِرَاشِي وَفِي رِوَايَةٍ وَلَا أَدْرِي أَمِنْ تَمْرِ الصَّدَقَةِ أَوْ مِنْ تَمْرِ أَهْلِي فَأَدَعُهَا وَذَلِكَ لَا يَتَنَاوَلُ اللُّقَطَةَ
