68. Emancipation (1/2)
٦٨۔ كِتَابُ الْعِتْقِ ص ١
The Prophet ﷺ said, "Whoever frees a Muslim slave, Allah will save all the parts of his body from the (Hell) Fire as he has freed the body-parts of the slave." Saʿid bin Marjana said that he narrated that Hadith to ʿAli bin Al-Husain and he freed his slave for whom ʿAbdullah bin Jaʿfar had offered him ten thousand Dirhams or one-thousand Dinars. قَالَ رَسُولُ اللهِ ﷺ أَيُّمَا امْرِئٍ مُسْلِمٍ أَعْتَقَ امْرَأً مُسْلِمًا اسْتَنْقَذَهُ اللهُ بِكُلِّ عُضْوٍ مِنْهُ عُضْوًا مِنَ النَّارِ قَالَ سَعِيدُ ابْنُ مَرْجَانَةَ سَمِعْتُ الْحَدِيثَ فَانْطَلَقْتُ بِهِ إِلَى عَلِيِّ بْنِ الْحُسَيْنِ فَعَمِدَ إِلَى عَبْدٍ قَدْ أَعْطَاهُ بِهِ عَبْدُ اللهِ بْنُ جَعْفَرٍ عَشَرَةَ آلَافِ دِرْهَمٍ أَوْ أَلْفَ دِينَارٍ فَأَعْتَقَهُ
I heard Messenger of Allah ﷺ as saying: He who emancipates a believing slave. Allah will set free from Fire his every limb for every limb of his (slave's), even his private parts for his. (Using translation from Muslim 1509c)
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ أَعْتَقَ رَقَبَةً مُؤْمِنَةً أَعْتَقَ اللهُ بِكُلِّ عُضْوٍ مِنْهُ عُضْوًا مِنْهُ مِنَ النَّارِ حَتَّى يُعْتِقَ فَرْجَهُ بِفَرْجِهِ
[Machine] "On the authority of the Messenger of Allah ﷺ who said: Whoever frees a slave, Allah will free every limb of theirs from the Hellfire, corresponding to every limb of the slave's body."
عَنْ رَسُولِ اللهِ ﷺ قَالَ مَنْ أَعْتَقَ رَقَبَةً أَعْتَقَ اللهُ بِكُلِّ عُضْوٍ مِنْهَا عُضْوًا مِنْ أَعْضَائِهِ مِنَ النَّارِ حَتَّى فَرْجَهُ بِفَرْجِهِ
[Machine] Narrated to us a Hadith that you heard from the Messenger of Allah ﷺ : "Your father for Allah and be cautious." He said: "I heard the Messenger of Allah ﷺ saying, 'Whoever emancipates a Muslim slave, then his reward for freeing him will be a bone for every bone in the slave's body, and whoever emancipates two Muslim women, then their reward for freeing them will be two bones for every bone in their bodies, and whoever a Muslim woman emancipates another Muslim woman, then her reward for freeing her will be a bone for every bone in her body.'"
حَدِّثْنَا حَدِيثًا سَمِعْتَهُ مِنْ رَسُولِ اللهِ ﷺ لِلَّهِ أَبُوكَ وَاحْذَرْ قَالَ سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ أَيُّمَا رَجُلٍ مُسْلِمٍ أَعْتَقَ رَجُلًا مُسْلِمًا كَانَ فِكَاكَهُ مِنَ النَّارِ يُجْزَى بِكُلِّ عَظْمٍ مِنْ عِظَامِهِ عَظْمًا مِنْ عِظَامِهِ وَأَيُّمَا رَجُلٍ مُسْلِمٍ أَعْتَقَ امْرَأَتَيْنِ مُسْلِمَتَيْنِ كَانَتَا فِكَاكَهُ مِنَ النَّارِ يُجْزَى بِكُلِّ عَظْمَيْنِ مِنْ عِظَامِهِمَا عَظْمًا مِنْ عِظَامِهِ وَأَيُّمَا امْرَأَةٍ مَسْلَمَةٍ أَعْتَقَتِ امْرَأَةً مَسْلَمَةً كَانَتْ فِكَاكَهَا مِنَ النَّارِ تُجْزَى بِكُلِّ عَظْمٍ مِنْ عِظَامِهَا عَظْمًا مِنْ عِظَامِهَا
[Machine] Shurahbil bin al-Simt was the governor of Hims appointed by 'Amr bin 'Abasa al-Sulami, the companion of the Messenger of Allah ﷺ. "O Abu Najih, narrate to us a hadith that you heard from the Messenger of Allah ﷺ, which contains no addition or omission." Abu Najih said, "I heard the Messenger of Allah ﷺ saying, 'Whoever frees a believing slave, Allah will free for each of his organs a part from the Fire. And whoever shoots an arrow in the cause of Allah, and it reaches its target, it will be for him a reward equivalent to that of freeing a slave. And whoever goes out in the cause of Allah and returns with white hairs [due to old age or ailing], it will be a light for him on the Day of Resurrection."
شُرَحْبِيلُ بْنُ السِّمْطِ وَهُوَ أَمِيرٌ عَلَى حِمْصَ لِعَمْرِو بْنِ عَبَسَةَ السُّلَمِيِّ صَاحِبِ رَسُولِ اللهِ ﷺ يَا أَبَا نَجِيحٍ حَدِّثْنَا بِحَدِيثٍ سَمِعْتَهُ مِنْ رَسُولِ اللهِ ﷺ لَيْسَ فِيهِ تَزَيُّدٌ وَلَا نِسْيَانٌ قَالَ سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ أَعْتَقَ رَقَبَةً مُؤْمِنَةً أَعْتَقَ اللهُ بِكُلَّ عُضْوٍ مِنْهَا عُضْوًا مِنْهُ مِنَ النَّارِ وَمَنْ رَمَى بِسَهْمٍ فِي سَبِيلِ اللهِ فَبَلَغَ الْعَدُوَّ وَأَصَابَ كَانَ لَهُ كَعِدْلِ رَقَبَةٍ وَمَنْ شَابَ شَيْبَةً فِي سَبِيلِ اللهِ كَانَتْ لَهُ نُورًا يَوْمَ الْقِيَامَةِ
[Machine] We surrounded the palace of Ta'if with the Prophet ﷺ , and I heard the Messenger of Allah ﷺ say: "Whoever throws an arrow in the cause of Allah, it will be a freeing of a slave for him." On that day, I reached sixteen arrows, and I heard the Messenger of Allah ﷺ say: "Whoever throws an arrow in the cause of Allah, it will be a rank for him in Paradise. And whoever becomes gray-haired in Islam, it will be a light for him on the Day of Resurrection. And whatever Muslim man frees a Muslim slave, then Allah will make every bone of his from the bones of hellfire a bone from the bones of his freed slave. And whatever Muslim woman frees a Muslim woman, then Allah will make every bone of hers from the bones of hellfire a bone from the bones of her freed slave."
حَاصَرْنَا مَعَ النَّبِيِّ ﷺ قَصْرَ الطَّائِفِ فَسَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ بَلَغَ بِسَهْمٍ فِي سَبِيلِ اللهِ فَهُوَ لَهُ عَدْلُ مُحَرَّرٍ فَبَلَغْتُ يَوْمَئِذٍ سِتَّةَ عَشَرَ سَهْمًا فَسَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ رَمَى بِسَهْمٍ فِي سَبِيلِ اللهِ فَهُوَ لَهُ دَرَجَةٌ فِي الْجَنَّةِ وَمَنْ شَابَ شَيْبَةً فِي الْإِسْلَامِ كَانَتْ لَهُ نُورًا يَوْمَ الْقِيَامَةِ وَأَيُّمَا رَجُلٍ مُسْلِمٍ أَعْتَقَ رَجُلًا مُسْلِمًا فَإِنَّ اللهَ جَاعِلٌ وِقَاءَ كُلِّ عَظْمٍ مِنْ عِظَامِهِ عَظْمًا مِنْ عِظَامِ مُحَرَّرِهِ مِنَ النَّارِ وَأَيُّمَا امْرَأَةٍ مَسْلَمَةٍ أَعْتَقَتِ امْرَأَةً مَسْلَمَةً فَإِنَّ اللهَ ﷻ جَاعِلٌ وِقَاءَ كُلِّ عَظْمٍ مِنْ عِظَامِهَا عَظْمًا مِنْ عِظَامِ مُحَرَّرِهَا مِنَ النَّارِ
[Machine] He heard the Messenger of Allah ﷺ saying, "Whoever frees a slave, it will be his release from the Fire, limb by limb."
أَنَّهُ سَمِعَ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ أَعْتَقَ رَقَبَةً أَوْ عَبْدًا كَانَتْ فِكَاكَهُ مِنَ النَّارِ عُضْوًا بِعُضْوٍ
[Machine] An Arab man came to the Prophet Muhammad (PBUH) and said, "O Messenger of Allah, inform me of a deed that will admit me into Paradise." The Prophet responded, "If you shorten your speech, you have already fulfilled the requirement. Free a slave, and help in the payment of the slave's price. Are these two equal actions?" The man asked. The Prophet replied, "Freeing a slave is better for you to excel in, and helping in the payment of a slave's price is better for you to assist in. The granting of a loan and the waiving of a debt is upon the oppressor. And feed the hungry and visit the sick." The man asked, "What if I am not able to do that?" The Prophet said, "Then enjoin good and forbid evil." The man asked, "What if I cannot do that?" The Prophet said, "Refrain from speaking except for goodness related to the Hadith of Abu Dawud."
جَاءَ أَعْرَابِيٌّ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللهِ أَخْبِرْنِي بِعَمَلٍ يُدْخِلُنِي الْجَنَّةَ قَالَ لَئِنْ أَقْصَرْتَ فِي الْخُطْبَةِ لَقَدْ أَعْرَضْتَ الْمَسْأَلَةَ أَعْتِقِ النَّسَمَةَ وَفُكَّ الرَّقَبَةَ قَالَ يَا رَسُولَ اللهِ أَهُمَا سَوَاءٌ؟ قَالَ لَا عِتْقُ النَّسَمَةِ أَنْ تَنْفَرِدَ بِهَا وَفَكُّ الرَّقَبَةِ أَنْ تُعِينَ فِي ثَمَنِهَا وَالْمِنْحَةُ الْوَكُوفُ وَالْفَيْءُ عَلَى ذِي الرَّحِمِ الظَّالِمِ قَالَ فَمَنْ يُطِيقُ ذَلِكَ؟ قَالَ فَأَطْعِمِ الْجَائِعَ وَاسْقِ الظَّمْآنَ قَالَ فَإِنْ لَمْ أَسْتَطِعْ؟ قَالَ مُرْ بِالْمَعْرُوفِ وَانْهَ عَنِ الْمُنْكَرِ قَالَ فَمَنْ لَمْ يُطِقْ ذَلِكَ؟ قَالَ فَكُفَّ لِسَانَكَ إِلَّا مِنْ خَيْرٍ لَفْظُ حَدِيثِ أَبِي دَاوُدَ
68.2 [Machine] Which of the necks is the best.
٦٨۔٢ بَابٌ: أِيُّ الرِّقَابِ أَفْضَلُ.
I asked the Prophet, "What is the best deed?" He replied, "To believe in Allah and to fight for His Cause." I then asked, "What is the best kind of manumission (of slaves)?" He replied, "The manumission of the most expensive slave and the most beloved by his master." I said, "If I cannot afford to do that?" He said, "Help the weak or do good for a person who cannot work for himself." I said, "If I cannot do that?" He said, "Refrain from harming others for this will be regarded as a charitable deed for your own good." (Using translation from Bukhārī 2518)
سَأَلْتُ رَسُولَ اللهِ ﷺ أِيُّ الْعَمَلِ أَفْضَلُ؟ قَالَ إِيمَانٌ بِاللهِ وَجِهَادٌ فِي سَبِيلِ اللهِ قُلْتُ أِيُّ الرِّقَابِ أَفْضَلُ؟ قَالَ أَغْلَاهَا ثَمَنًا وَأَنْفَسُهَا عِندَ أَهْلِهَا قَالَ قُلْتُ فَإِنْ لَمْ أَفْعَلْ؟ قَالَ تُعِينُ صَانِعًا أَوْ تَصْنَعُ لِأَخْرَقَ قَالَ قُلْتُ فَإِنْ لَمْ أَفْعَلْ؟ قَالَ تَدَعُ النَّاسَ مِنَ الشَّرِّ فَإِنَّهَا صَدَقَةٌ تَصَدَّقُ بِهَا عَلَى نَفْسِكَ
68.3 [Machine] The Virtue of Emancipation in Health
٦٨۔٣ بَابٌ: فَضْلُ الْعِتْقِ فِي الصِّحَّةِ.
[Machine] I met Abu Darda and said to him, "I had a brother who died and he entrusted me with a portion of his wealth. Where should I put it? Should I give it to the poor, the fighters in jihad, or should I free slaves?" He replied, "If I were you, I would not give it all to the fighters in jihad, for the Messenger of Allah ﷺ said, 'The example of the one who emancipates a slave at the time of his death is like the one who gives a gift after having fully satisfied his hunger.'"
لَقِيتُ أَبَا الدَّرْدَاءِ فَقُلْتُ إِنَّ أَخًا لِي مَاتَ وَأَوْصَى إِلِيَّ بِطَائِفَةٍ مِنْ مَالِهِ فَفِي أِيِّ شَيْءٍ أَضَعُهُ؟ فِي الْفُقَرَاءِ وَالْمُجَاهِدِينَ وَفِي الرِّقَابِ؟ قَالَ أَمَا إِنِّي فَلَوْ كُنْتُ لَمْ أَعْدِلْ بِالْمُجَاهِدِينَ لِأَنَّ رَسُولَ اللهِ ﷺ قَالَ مَثَلُ الَّذِي يُعْتِقُ عِنْدَ الْمَوْتِ مَثَلُ الَّذِي يُهْدِي بَعْدَ مَا يَشْبَعُ
68.4 [Machine] Who freed one person from his slaves.
٦٨۔٤ بَابٌ: مَنْ أَعْتَقَ مِنْ مَمْلُوكِهِ شِقْصًا.
[Machine] That a man freed a servant from a slave, and it was mentioned to the Prophet ﷺ, so he said, "There is no partner with Allah." Ibn Kathir added to his narration and the Prophet ﷺ approved of his manumission. The Sheikh, may Allah have mercy on him, said, "It is possible that this applies to a situation where a person frees a servant who is shared between him and others, and it is also possible it refers to others."
أَنَّ رَجُلًا أَعْتَقَ شِقْصًا لَهُ مِنْ غُلَامٍ فَذُكِرَ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ لَيْسَ لِلَّهِ شَرِيكٌ زَادَ ابْنُ كَثِيرٍ فِي حَدِيثِهِ فَأَجَازَ النَّبِيُّ ﷺ عِتْقَهُ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَيُحْتَمَلُ أَنْ يَكُونَ هَذَا فِيمَنْ أَعْتَقَ شِقْصًا لَهُ مِنْ غُلَامٍ مُشْتَرَكٍ بَيْنَهُ وَبَيْنَ غَيْرِهِ وَيُحْتَمَلُ غَيْرُهُ
[Machine] A man from his people emancipated one-third of his child, so this matter was raised to the Prophet ﷺ and he said, "He is free, all of him. There is no partner for Allah, and this is most apparent in what we have placed as the door. Allah knows best."
أَنَّ رَجُلًا مِنْ قَوْمِهِ أَعْتَقَ ثُلُثَ غُلَامِهِ فَرُفِعَ ذَلِكَ إِلَى النَّبِيِّ ﷺ فَقَالَ هُوَ حُرٌّ كُلُّهُ لَيْسَ لِلَّهِ شَرِيكٌ وَهَذَا فِيمَا وَضَعْنَا الْبَابَ لَهُ أَظْهَرُ وَاللهُ أَعْلَمُ
[Machine] The age of that I set free completely does not include a thousand.
عُمَرُ ؓ أَعْتِقْهُ كُلَّهُ لَيْسَ فِيهِ أَلْفٌ
[Machine] So his grandfather freed half of him, and then the slave came to the Prophet ﷺ and informed him. The Prophet ﷺ said, "You must free one slave in exchange for your freedom, and one slave must be freed in exchange for your neck." The slave continued to serve his master until his master died. Umrah bin Hawshab and Ismail, the son of Umayyah bin Amr bin Sa'id bin Al-'As, took him as their own and 'Izra'il bin Saeed bin Al-'As did not have companionship with him.
فَأَعْتَقَ جَدُّهُ نِصْفَهُ فَجَاءَ الْعَبْدُ إِلَى النَّبِيِّ ﷺ فَأَخْبَرَهُ فَقَالَ النَّبِيُّ ﷺ تُعْتَقُ فِي عِتْقِكَ وَتُرَقُّ فِي رِقِّكَ قَالَ فَكَانَ يَخْدُمُ سَيِّدَهُ حَتَّى مَاتَ تَفَرَّدَ بِهِ عُمَرُ بْنُ حَوْشَبٍ وَإِسْمَاعِيلُ هُوَ ابْنُ أُمَيَّةَ بْنِ عَمْرِو بْنِ سَعِيدِ بْنِ الْعَاصِ وَعَمْرُو بْنُ سَعِيدٍ لَيْسَ لَهُ صُحْبَةٌ
[Machine] The Messenger of Allah ﷺ said, "A man can free his slave as much as he wishes. If he wishes, he can free him a third, or a fourth, or a fifth, and there is no harm between him and Allah. In another place, it is mentioned 'sakhtah'. Our teacher Abu Al-Walid said, "Our companions said, 'He is the one who can free a third or a fourth of him, and whoever dies or bequeaths half of this and half of that, neither one of them will invalidate the other, and he will free from each one according to the extent that he freed him.' The Sheikh, may Allah have mercy on him, said, "This is a good interpretation, except that Muhammad ibn Fada' is weak and is not considered reliable. Yahya ibn Ma'in, Sulaiman ibn Harb, and Abu Abdur-Rahman An-Nasa'i all spoke about him."
قَالَ رَسُولُ اللهِ ﷺ يُعْتِقُ الرَّجُلُ مِنْ عَبْدِهِ مَا شَاءَ إِنْ شَاءَ ثُلُثًا وَإِنْ شَاءَ رُبُعًا وَإِنْ شَاءَ خُمُسًا لَيْسَ بَيْنَهُ وَبَيْنَ اللهِ ضَغْطَةٌ وَقَالَ فِي مَوْضِعٍ آخَرَ سَقْطَةٌ قَالَ الْأُسْتَاذُ أَبُو الْوَلِيدِ قَالَ أَصْحَابُنَا هُوَ الَّذِي يُعْتِقُ مِنْ ذَا ثُلُثَهُ وَمِنْ ذَا رُبُعَهُ وَمَنْ مَاتَ أَوْ أَوْصَى بِنِصْفِ عِتْقِ هَذَا وَبِنِصْفِ عِتْقِ هَذَا لَا يُبْطِلُ أَحَدُهُمَا الْآخَرَ وَيُعْتَقُ مِنْ كُلِّ وَاحِدٍ قَدْرُ مَا أَعْتَقَهُ قَالَ الشَّيْخُ رَحِمَهُ اللهُ هَذَا تَأْوِيلٌ حَسَنٌ إِلَّا أَنَّ مُحَمَّدَ بْنَ فَضَاءٍ هَذَا ضَعِيفٌ لَا يُحْتَجُّ بِهِ تَكَلَّمَ فِيهِ يَحْيَى بْنُ مَعِينٍ وَسُلَيْمَانُ بْنُ حَرْبٍ وَأَبُو عَبْدِ الرَّحْمَنِ النَّسَائِيُّ رَحِمَهُمُ اللهُ
[Machine] If a man has a slave and he frees half of him, only what is freed is severed.
إِذَا كَانَ لِرَجُلٍ عَبْدٌ فَأَعْتَقَ نِصْفَهُ لَمْ يُعْتَقْ مِنْهُ إِلَّا مَا عَتَقَ هَذَا مُنْقَطِعٌ
68.5 [Machine] Whoever frees a slave that he owns while in debt.
٦٨۔٥ بَابٌ: مَنْ أَعْتَقَ شِرْكًا لَهُ فِي عَبْدٍ وَهُوَ مُوسِرٌ.
[Machine] The Messenger of Allah ﷺ said, "Whoever frees a partner in slave ownership and has enough wealth to cover the price of the slave, then he should assess the value of the slave fairly and give his partners their shares. Then, he should free the slave. If not, then he has only partially freed the slave." He said, "Yes."
قَالَ رَسُولُ اللهِ ﷺ مَنْ أَعْتَقَ شِرْكًا لَهُ فِي عَبْدٍ وَكَانَ لَهُ مَالٌ يَبْلُغُ ثَمَنَ الْعَبْدِ قُوِّمَ عَلَيْهِ قِيمَةَ عَدْلٍ وَأَعْطَى شُرَكَاءَهُ حِصَصَهُمْ وَعَتَقَ عَلَيْهِ الْعَبْدُ وَإِلَّا فَقَدْ عَتَقَ مِنْهُ مَا عَتَقَ ؟ قَالَ نَعَمْ
[Machine] I heard the Messenger of Allah ﷺ say: "If any slave is owned jointly by partners and one of them frees him, then he should give the share of his partners to him (the slave). For he will be established in the property of the one who frees him at the value of justice, then he should free him if he has enough wealth for that."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ أَيُّمَا مَمْلُوكٍ كَانَ بَيْنَ شُرَكَاءَ فَأَعْتَقَ أَحَدُهُمْ نَصِيبَهُ فَإِنَّهُ يُقَامُ فِي مَالِ الَّذِي أَعْتَقَ قِيمَةَ عَدْلٍ فَيَعْتِقُ إِنْ بَلَغَ ذَلِكَ مَالَهُ
[Machine] He said, the Messenger of Allah ﷺ said, "Whoever sets free a partner he has in a slave and establishes a condition of compensation for it, then the compensation should be paid to his partners, and he sets free in the property of the one he has set free."
أَنَّهُ قَالَ قَالَ رَسُولُ اللهِ ﷺ مَنْ أَعْتَقَ شِرْكًا لَهُ فِي عَبْدٍ أُقِيمَ عَلَى الَّذِي أَعْتَقَهُ فَيَدْفَعُ ثَمَنَهُ إِلَى شُرَكَائِهِ وَأَعْتَقَ فِي مَالِ الَّذِي أَعْتَقَهُ
[Machine] The Messenger of Allah ﷺ said, "Whoever frees a partner he has in a slave and establishes justice by giving his partners their shares, the slave is freed on his behalf."
رَسُولَ اللهِ ﷺ قَالَ مَنْ أَعْتَقَ شِرْكًا لَهُ فِي عَبْدٍ أُقِيمَ عَلَيْهِ قِيمَةَ الْعَدْلِ فَأَعْطَى شُرَكَاءَهُ حِصَصَهُمْ وَعَتَقَ عَلَيْهِ الْعَبْدُ
النَّبِيِّ ﷺ
[Machine] The Prophet ﷺ said, "Whoever frees a slave that he owns, and the slave has the value that reaches his redemption, it is mandatory to include it in the portion of his owner." Al-Bukhari narrated it, as did Ibn Abi Dhi'b, and Muslim reported it from another chain of narrators, also narrated by Ibn Abi Dhi'b.
عَنِ النَّبِيِّ ﷺ قَالَ مَنْ أَعْتَقَ شِرْكًا مَمْلُوكًا وَعِنْدَ الَّذِي أَعْتَقَهُ مَا يَبْلُغُ ثَمَنَهُ ضَمِنَ نَصِيبَ صَاحِبِهِ قَالَ الْبُخَارِيُّ وَرَوَاهُ ابْنُ أَبِي ذِئْبٍ وَأَخْرَجَهُ مُسْلِمٌ مِنْ وَجْهٍ آخَرَ عَنِ ابْنِ أَبِي ذِئْبٍ
[Machine] The Messenger of Allah, ﷺ , said: "Whichever servant is between two people and frees one of them, his share will be established with the highest value or the value of a fair and just measurement that is not lessened or decreased. Then, a fine will be imposed on him for this portion."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ أَيُّمَا عَبْدٍ كَانَ بَيْنَ اثْنَيْنِ وَأَعْتَقَ أَحَدُهُمَا نَصِيبَهُ فَإِنْ كَانَ مُوسِرًا فَإِنَّهُ يُقَوَّمُ عَلَيْهِ بِأَغْلَى الْقِيمَةِ أَوْ قِيمَةِ عَدْلٍ لَيْسَتْ بِوَكْسٍ وَلَا شَطَطٍ ثُمَّ يَغْرَمُ لِهَذَا حِصَّتَهُ كَذَا
He who emancipates a slave (shared) by him and another one, his full price may be justly assessed from his wealth, neither less nor more, and he (the slave) would be emancipated if he (the partner) would be solvent enough (to forgo the amount of his share). (Using translation from Muslim 1501g)
أَنَّ النَّبِيَّ ﷺ قَالَ مَنْ أَعْتَقَ عَبْدًا بَيْنَهُ وَبَيْنَ آخَرَ قُوِّمَ عَلَيْهِ فِي مَالِهِ قِيمَةَ عَدْلٍ لَا وَكْسَ وَلَا شَطَطَ وَعَتَقَ عَلَيْهِ فِي مَالِهِ إِنْ كَانَ مُوسِرًا
[Machine] The Prophet ﷺ said: "Whoever frees a slave which he owns, then what remains from his wealth is freed as well, if he has enough wealth to cover the slave's value."
أَنَّ النَّبِيَّ ﷺ قَالَ مَنْ أَعْتَقَ شِرْكًا لَهُ فِي عَبْدٍ عَتَقَ مَا بَقِيَ فِي مَالِهِ إِذَا كَانَ لَهُ مَالٌ مَا يَبْلُغُ ثَمَنَ الْعَبْدِ
[Machine] The Prophet ﷺ said, "When a man frees a slave who rightfully belongs to him, then the slave becomes free." This is the narration of Al-Tayalisi. In another narration by Yazid, it is mentioned that the Prophet ﷺ said, "If a man has a slave between two men, then one of them frees his share, he guarantees his freedom."
أَنَّ النَّبِيَّ ﷺ قَالَ إِذَا أَعْتَقَ الرَّجُلُ شِقْصًا لَهُ مِنْ مَمْلُوكٍ فَهُوَ حُرٌّ لَفْظُ حَدِيثِ الطَّيَالِسِيِّ وَفِي رِوَايَةِ يَزِيدَ عَنِ النَّبِيِّ ﷺ فِي الْمَمْلُوكِ بَيْنَ الرَّجُلَيْنِ فَيُعْتِقُ أَحَدُهُمَا نَصِيبَهُ قَالَ يَضْمَنُ
[Machine] The Messenger of Allah ﷺ said: "Whoever frees a share for himself from a slave, let him free from his wealth if he has any. If it is not mentioned in his chain of narrators, some of them reported it from Hisham from Nadir ibn Anas, and some of them mentioned it."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ أَعْتَقَ نَصِيبًا لَهُ فِي مَمْلُوكٍ عَتَقَ مِنْ مَالِهِ إِنْ كَانَ لَهُ مَالٌ لَمْ يَذْكُرْ فِي إِسْنَادِهِ بَعْضَ الرُّوَاةِ عَنْ هِشَامٍ عَنِ النَّضْرِ بْنِ أَنَسٍ وَذَكَرَهُ بَعْضُهُمْ
[Machine] That the Messenger of Allah ﷺ said: "Whoever frees a slave owned by another, then his freedom is upon him from his wealth, if he has any wealth that does not have a partner with Allah."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ أَعْتَقَ سَهْمًا فِي مَمْلُوكٍ فَعِتْقُهُ عَلَيْهِ فِي مَالِهِ إِنْ كَانَ لَهُ مَالٌ لَيْسَ لِلَّهِ شَرِيكٌ
A man emancipated his share in a slave. The Prophet ﷺ allowed his (full) emancipation, and required him to pay the rest of his price. (Using translation from Abū Dāʾūd 3934)
أَنَّ رَجُلًا أَعْتَقَ شِقْصًا مِنْ غُلَامٍ فَأَجَازَ النَّبِيُّ ﷺ عِتْقَهُ وَغَرَّمَهُ بَقِيَّةَ ثَمَنِهِ
[Machine] The Prophet ﷺ said: Abu Ahmad narrated, Salih bin Abdullah Al-Hashimi narrated, Mahmoud bin Khalid narrated, Al-Walid bin Muslim narrated, Abu Muayad narrated, Sulaiman narrated from Nafi, from Ibn Umar, and from Ata, from Jabir bin Abdullah, that the Messenger of Allah ﷺ said: "Whoever frees a slave and has something to give, let him fulfill his promise. He is free and guarantees the share of his partners with a fair value for any harm caused by their participation. The slave has no obligation." Abu Ahmad said: His statement "The slave has no obligation" is not narrated by anyone except Abu Muayad, who is Hafs bin Ghailan, from Sulaiman bin Musa.
أَنَّ النَّبِيَّ ﷺ قَالَ أَبُو أَحْمَدَ وَثَنَا صَالِحُ بْنُ عَبْدِ اللهِ الْهَاشِمِيُّ ثنا مَحْمُودُ بْنُ خَالِدٍ ثنا الْوَلِيدُ بْنُ مُسْلِمٍ قَالَ وَحَدَّثَ أَبُو مُعَيْدٍ قَالَ وَحَدَّثَ سُلَيْمَانُ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ وَعَنْ عَطَاءٍ عَنْ جَابِرِ بْنِ عَبْدِ اللهِ أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ أَعْتَقَ عَبْدًا وَلَهُ فِيهِ شَيْءٌ وَلَهُ وَفَاءٌ فَهُوَ حُرٌّ وَيَضْمَنُ نَصِيبَ شُرَكَائِهِ بِقِيمَةِ عَدْلٍ بِمَا أَسَاءَ مُشَارَكَتَهُمْ وَلَيْسَ عَلَى الْعَبْدِ شَيْءٌ قَالَ أَبُو أَحْمَدَ قَوْلُهُ لَيْسَ عَلَى الْعَبْدِ شَيْءٌ لَا يَرْوِيهِ غَيْرُ أَبِي مُعَيْدٍ وَهُوَ حَفْصُ بْنُ غَيْلَانَ عَنْ سُلَيْمَانَ بْنِ مُوسَى
[Machine] said that a servant was placed between two men, and one of them freed his share. Then the Prophet ﷺ kept him imprisoned until he sold him to someone else.
أَنَّ عَبْدًا كَانَ بَيْنَ رَجُلَيْنِ فَأَعْتَقَ أَحَدُهُمَا نَصِيبَهُ فَحَبَسَهُ النَّبِيُّ ﷺ حَتَّى بَاعَ فِيهِ غَنِيمَةً لَهُ هَذَا مُنْقَطِعٌ وَقَدْ
[Machine] There was a slave between two men, and one of them freed his share. He then rode with his partner to Umar and wrote that the highest value should be established.
كَانَ عَبْدٌ بَيْنَ رَجُلَيْنِ فَأَعْتَقَ أَحَدُهُمَا نَصِيبَهُ فَرَكِبَ شَرِيكُهُ إِلَى عُمَرَ ؓ فَكَتَبَ أَنْ يُقَوَّمَ أَغْلَى الْقِيمَةِ
[Machine] About Ibrahim and Al-Sha'abi in the matter of the slave, it is when there is a disagreement between the two men, one of them will emancipate his share. They said that he guarantees its price for his owner with the value of justice on the day he emancipates it.
عَنْ إِبْرَاهِيمَ وَالشَّعْبِيِّ فِي الْعَبْدِ يَكُونُ بَيْنَ الرَّجُلَيْنِ فَيُعْتِقُ أَحَدُهُمَا نَصِيبَهُ قَالَا يَضْمَنُ ثَمَنَهُ لِصَاحِبِهِ بِقِيمَةِ عَدْلٍ يَوْمَ أَعْتَقَهُ
68.6 [Machine] Who said: "He will be free the day he speaks about emancipation"?
٦٨۔٦ بَابٌ: مَنْ قَالَ: يَكُونُ حُرًّا يَوْمَ تَكَلَّمَ بِالْعِتْقِ.
[Machine] Narrated by the Prophet ﷺ : "Whoever emancipates a portion from his slave or a partner from a slave, and he had wealth that is equal to the remaining value of the slave, then he has indeed emancipated. Nafi' said, otherwise he has emancipated a portion from him. Ayyub (the narrator) said, 'I do not know if Nafi' said this or if it is in the Hadith.' And Abu Al-Hasan Ali bin Muhammad Al-Muqri informed us that Al-Hasan bin Muhammad bin Ishaq narrated to us that Youssef bin Ya'qoub narrated to us that Abu Al-Rabi' narrated to us that Hammad bin Zaid narrated to us that Ayoub mentioned it with its Sanad (chain of narration) and meaning. He said, 'It means that the slave is emancipated.'"
عَنِ النَّبِيِّ ﷺ قَالَ مَنْ أَعْتَقَ نَصِيبًا لَهُ فِي مَمْلُوكٍ أَوْ شِرْكًا مِنْ عَبْدٍ وَكَانَ لَهُ مِنَ الْمَالِ مَا يَبْلُغُ قِيمَةَ بَقِيَّةِ الْعَبْدِ فَقَدْ عَتَقَ قَالَ نَافِعٌ وَإِلَّا فَقَدْ عَتَقَ مِنْهُ مَا عَتَقَ قَالَ أَيُّوبُ لَا أَدْرِي أَشَيْءٌ قَالَهُ نَافِعٌ؟ أَوْ هُوَ فِي الْحَدِيثِ؟ 21341 وَأَخْبَرَنَا أَبُو الْحَسَنِ عَلِيُّ بْنُ مُحَمَّدٍ الْمُقْرِئُ أنبأ الْحَسَنُ بْنُ مُحَمَّدِ بْنِ إِسْحَاقَ ثنا يُوسُفُ بْنُ يَعْقُوبَ ثنا أَبُو الرَّبِيعِ ثنا حَمَّادُ بْنُ زَيْدٍ ثنا أَيُّوبُ فَذَكَرَهُ بِإِسْنَادِهِ وَمَعْنَاهُ وَقَالَ فَهُوَ عَتِيقٌ
[Machine] The Messenger of Allah ﷺ said, "Whoever frees a slave for his sake, then he has freed all of him."
قَالَ رَسُولُ اللهِ ﷺ مَنْ أَعْتَقَ شِرْكًا لَهُ فِي مَمْلُوكٍ فَقَدْ عَتَقَ كُلَّهُ
[Machine] The Messenger of Allah ﷺ said, "Whoever frees a slave that he owns and the slave owner has his share of the price, then he has freed them both completely according to what is stated in the authentic narration."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ أَعْتَقَ شِقْصًا لَهُ فِي مَمْلُوكٍ وَكَانَ لِلَّذِي يُعْتِقُ مِنْهُمَا نَصِيبُهُ مَبْلَغَ ثَمَنِهِ فَقَدْ عَتَقَ كُلَّهُ أَخْرَجَاهُ فِي الصَّحِيحِ
68.7 [Machine] Who said: "He frees with words and defends the value.
٦٨۔٧ بَابٌ: مَنْ قَالَ: يُعْتِقُ بِالْقَوْلِ وَيَدْفَعُ الْقِيمَةَ.
[Machine] I heard the Messenger of Allah ﷺ saying, "Whoever frees a share of a slave is obligated to free the rest, and the emancipator should be helpful." Yahya said, "I don't know if he meant something he used to say before or if it was something related to this statement. If he doesn't have it, then what he did is permissible."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ أَعْتَقَ نَصِيبًا فِي مَمْلُوكٍ كُلِّفَ مَا بَقِيَ فَأَعْتَقَهُ وَكَانَ نَافِعٌ يَقُولُ قَالَ يَحْيَى لَا أَدْرِي شَيْئًا كَانَ مِنْ قِبَلِهِ يَقُولُهُ أَمْ هُوَ شَيْءٌ فِي الْحَدِيثِ؟ فَإِنْ لَمْ يَكُنْ عِنْدَهُ فَقَدْ جَازَ مَا صَنَعَ
[Machine] "That the Messenger of Allah ﷺ said: 'Whichever man has a share in a slave and then emancipates his share, it is upon him to complete the emancipation according to the value of justice."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ أَيُّمَا رَجُلٍ كَانَ لَهُ نَصِيبٌ فِي عَبْدٍ فَأَعْتَقَ نَصِيبَهُ فَعَلَيْهِ أَنْ يُكْمِلَ عِتْقَهُ بِقِيمَةِ عَدْلٍ
The Prophet ﷺ said, "Whoever manumits his share o a jointly possessed slave, it is imperative on him to manumit the slave completely if he has sufficient money to pay the rest of its price which is to be estimated justly. He should pay his partners their shares and release him (the freed one). (Using translation from Bukhārī 2503)
أَنَّ النَّبِيَّ ﷺ قَالَ مَنْ أَعْتَقَ شِرْكًا فِي مَمْلُوكٍ فَقَدْ وَجَبَ عَلَيْهِ أَنْ يُعْتِقَ مَا بَقِيَ إِنْ كَانَ لَهُ مِنَ الْمَالِ قَدْرُ ثَمَنِهِ يُقَامُ قِيمَةَ عَدْلٍ فَيُعْطَى شُرَكَاؤُهُ حِصَصَهُمْ وَيُخَلَّى سَبِيلُ الْمُعْتَقِ
[Machine] The Messenger of Allah ﷺ said, "Whoever frees a slave as an act of worship to other than Allah, it is incumbent upon him to free the remaining slaves. In other narrations that we have mentioned, there is evidence to support this statement, as well as evidence to support the first statement. It is as if they did not consider this, and they only considered the act of freeing slaves in general without the obligation of guaranteeing it if one is able to do so. And Allah knows best."
قَالَ رَسُولُ اللهِ ﷺ مَنْ أَعْتَقَ مِنْ عَبْدٍ شِرْكًا فَعَلَيْهِ أَنْ يُعْتِقَ مَا بَقِيَ وَفِي سَائِرِ الرِّوَايَاتِ الَّتِي قَدَّمْنَا ذِكْرَهَا مَا دَلَّ عَلَى هَذَا الْقَوْلِ وَفِيهَا مَا دَلَّ عَلَى الْقَوْلِ الْأَوَّلِ وَكَأَنَّهُمْ لَمْ يُرَاعُوا هَذَا وَإِنَّمَا رَاعَوْا حُصُولَ الْعِتْقِ فِي الْجُمْلَةِ دُونَ وُجُوبِ الضَّمَانِ إِذَا كَانَ مُوسِرًا وَاللهُ أَعْلَمُ
[Machine] On the authority of the Prophet, ﷺ , he said, "Whoever frees a slave that belongs to him, it is guaranteed that his own freedom will be established and then the slave shall be freed."
عَنِ النَّبِيِّ ﷺ قَالَ مَنْ أَعْتَقَ شِرْكًا فِي مَمْلُوكٍ لَهُ فَقَدْ ضَمِنَ عِتْقَهُ يُقَوَّمُ الْعَبْدُ ثُمَّ يُعْتَقُ
[Machine] There was a young boy between me and Al-Aswad who had witnessed the Battle of Al-Qadisiyah and was injured in it. So they wanted to set him free, and I was young at that time. Al-Aswad mentioned this to Umar, so Umar said, "Set yourselves free, and Abdur Rahman will have his share until he desires something similar to what you desire, or he will take his portion. It is possible that he wants his share of the value." We have narrated this from Umar. This meaning has also been narrated in a similar hadith.
كَانَ بَيْنِي وَبَيْنَ الْأَسْوَدِ وَأُمِّنَّا غُلَامٌ قَدْ شَهِدَ الْقَادِسِيَّةَ وَأَبْلَى فِيهَا فَأَرَادُوا عِتْقَهُ وَكُنْتُ صَغِيرًا فَذَكَرَ الْأَسْوَدُ ذَلِكَ لِعُمَرَ ؓ فَقَالَ عُمَرُ أَعْتِقُوا أَنْتُمْ وَيَكُونُ عَبْدُ الرَّحْمَنِ عَلَى نَصِيبِهِ حَتَّى يَرْغَبَ فِي مِثْلِ مَا رَغِبْتُمْ فِيهِ أَوْ يَأْخُذَ نَصِيبَهُ وَيُحْتَمَلُ أَنْ يُرِيدَ بِهِ نَصِيبَهُ مِنَ الْقِيمَةِ وَقَدْ رُوِّينَا عَنْ عُمَرَ ؓ مَا دَلَّ عَلَى هَذَا وَرُوِيَ فِي مِثْلِ هَذَا الْمَعْنَى حَدِيثٌ مُرْسَلٌ
[Machine] The sons of Sa'id ibn al-Aas had a slave boy, so they all emancipated him except for one man. He went to the Messenger of Allah ﷺ to intercede for him with the man, so the man granted his share to the Prophet ﷺ and he emancipated him. The slave used to say, "I am the slave of the Messenger of Allah ﷺ ", and this man was called Rāfi` ibn al-Bahiyy. This indicates that he was not emancipated explicitly, and it is possible that they were in financial difficulty. The hadith is disconnected, and we narrated it from Isma'il ibn Umayyah from 'Amr ibn Sa'id ibn al-Aas from his father from his grandfather. Another story that contradicts this narrative has been mentioned earlier, and the ruling has been mentioned in the previous part. And Allah knows best.
أَنَّ بَنِي سَعِيدِ بْنِ الْعَاصِ كَانَ لَهُمْ غُلَامٌ فَأَعْتَقَهُ كُلُّهُمْ إِلَّا رَجُلًا وَاحِدًا فَذَهَبَ إِلَى رَسُولِ اللهِ ﷺ يَسْتَشْفِعُ بِهِ عَلَى الرَّجُلِ فَوَهَبَ الرَّجُلُ نَصِيبَهُ لِلنَّبِيِّ ﷺ فَأَعْتَقَهُ فَكَانَ الْعَبْدُ يَقُولُ أَنَا مَوْلَى رَسُولِ اللهِ ﷺ وَالرَّجُلُ يُقَالُ لَهُ رَافِعٌ أَبُو الْبَهِيِّ هَذَا يَدُلُّ إِنْ صَحَّ عَلَى أَنَّهُ لَمْ يُعْتَقْ بِاللَّفْظِ وَيُحْتَمَلُ أَنَّهُمْ كَانُوا مُعْسِرِينَ وَالْحَدِيثُ مُنْقَطِعٌ وَرُوِّينَا عَنْ إِسْمَاعِيلَ بْنِ أُمَيَّةَ عَنْ عَمْرِو بْنِ سَعِيدِ بْنِ الْعَاصِ عَنْ أَبِيهِ عَنْ جَدِّهِ فِي هَذَا قِصَّةٌ أُخْرَى تُخَالِفُ هَذِهِ الصُّورَةَ وَالْحُكْمَ قَدْ مَضَى فِي الْجُزْءِ قَبْلَهُ وَاللهُ أَعْلَمُ
68.8 [Machine] Whoever emancipates a slave who is in debt.
٦٨۔٨ بَابٌ: مَنْ أَعْتَقَ شِرْكًا لَهُ فِي عَبْدٍ وَهُوَ مُعْسِرٌ.
[Machine] The Messenger of Allah, ﷺ , said, "Whoever sets free a slave that he owns and he has enough wealth to pay the slave's price, he should give the slave's partners their shares and set the slave free. If not, then he has set free what he could from him." He said, "Yes."
قَالَ رَسُولُ اللهِ ﷺ مَنْ أَعْتَقَ شِرْكًا لَهُ فِي عَبْدٍ وَكَانَ لَهُ مَالٌ يَبْلُغُ ثَمَنَ الْعَبْدِ قُوِّمَ عَلَيْهِ قِيمَةَ الْعَدْلِ فَأُعْطِيَ شُرَكَاؤُهُ حِصَصَهُمْ وَعَتَقَ عَلَيْهِ الْعَبْدُ وَإِلَّا فَقَدْ عَتَقَ مِنْهُ مَا عَتَقَ ؟ قَالَ نَعَمْ
[Machine] The Messenger of Allah, ﷺ , said, "Whoever frees a portion of a slave or a share in a partnership, then he will have from that slave or partnership an amount of wealth equal to the value of justice. He will be considered a free person." He said, "I do not know if this is a hadith from the Prophet, ﷺ , or something that Nafi' said. If it is not something that Nafi' said, then he has freed what he has freed." They have reported it in Sahih like this, and it contains an apparent indication that he was unsure about it. Malik ibn Anas, may Allah have mercy on him, confirmed it as a hadith from the Prophet, ﷺ , so the ruling is in accordance with his view. As for the preference of Malik's memorization, it is with the majority of the people of hadith, as Ash-Shafi'i, may Allah have mercy on him, said. 21355 Abu 'Abdullah Al-Hafiz informed us, Abu Bakr ibn Ishaq informed us, Isma'il ibn Ishaq informed us, 'Ali ibn Al-Madinri said, "Abdur-Rahman ibn Mahdi would not give precedence to anyone over Malik." 21356 Abu 'Abdullah Al-Hafiz informed us, I heard Abu Al-Hasan Al-'Anazi say, I heard 'Uthman ibn Sa'id Ad-Darimi say, "I asked Yahya ibn Ma'in, 'Is Malik more beloved to you than Nafi' or 'Ubaidullah ibn 'Umar?' He said, 'Malik.' I said, 'And what about Ayub As-Sakhtiani?' He said, 'Malik.'" 21357 Abu 'Abdullah Al-Hafiz informed us, Abu Muhammad ibn 'Ukht ibn Abu 'Awana informed us, my maternal uncle informed me, Al-Maimuni said, "I heard Yahya ibn Ma'in and Ahmad ibn Hanbal, both of them, say, 'Malik was one of the most trustworthy people in his hadith.'" Ahmad ibn Hanbal said, "O Abu Al-Hasan, it does not matter if you do not ask about a man who narrates from Malik, especially if he is from Madinah." 21358 Abu 'Abdullah Al-Hafiz informed us, I heard Abu Bakr Muhammad ibn Ahmad Al-Hairi say, I heard Al-Husayn ibn Muhammad Al-Qabani say, I heard 'Ubaidullah ibn 'Umar Al-Qawariri say, 'I heard Hammad ibn Zaid say, 'I heard Ayyub As-Sakhtiani say, "Malik had a special chain with Nafi' during his lifetime.'" 21359 Abu Al-Husayn Ibn Al-Fadl Al-Qattan informed us in Baghdad, 'Abdullah ibn Ja'far told us, Ya'qub ibn Sufyan informed me, Muhammad ibn Abi Ruqayn informed me, Ibn Wahb informed me, Malik said, "Yahya ibn Sa'id asked me to compile one hundred hadiths from the hadiths of Ibn Shihab and select them for him, so I wrote those hadiths for him until I filled the book and explained them to him." Malik said, "And a man said, 'I used to learn from him until the day he died. He would come to me and ask me questions.' As for the concurrence of the ones who agreed with Malik on this addition..."
قَالَ رَسُولُ اللهِ ﷺ مَنْ أَعْتَقَ نَصِيبًا مِنْ عَبْدٍ أَوْ شِرْكًا كَانَ لَهُ فِي عَبْدٍ فَكَانَ لَهُ مِنَ الْمَالِ مَا يَبْلُغُ ثَمَنَهُ بِقِيمَةِ الْعَدْلِ فَهُوَ عَتِيقٌ قَالَ فَلَا أَدْرِي أَهُوَ فِي الْحَدِيثِ عَنِ النَّبِيِّ ﷺ؟ أَوْ شَيْءٌ قَالَهُ نَافِعٌ وَإِلَّا فَقَدْ عَتَقَ مِنْهُ مَا عَتَقَ ؟ أَخْرَجَاهُ فِي الصَّحِيحِ هَكَذَا وَفِيهِ دَلَالَةٌ ظَاهِرَةٌ عَلَى أَنَّهُ كَانَ يَشُكُّ فِيهِ وَمَالِكُ بْنُ أَنَسٍ رَحِمَهُ اللهُ أَثْبَتَهُ عَنِ الْحَدِيثِ عَنِ النَّبِيِّ ﷺ فَالْحُكْمُ لَهُ دُونَهُ وَأَمَّا فَضْلُ حِفْظِ مَالِكٍ فَهُوَ عِنْدَ جَمَاعَةِ أَهْلِ الْحَدِيثِ كَمَا قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ 21355 أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أَنْبَأَ أَبُو بَكْرِ بْنُ إِسْحَاقَ أَنْبَأَ إِسْمَاعِيلُ بْنُ إِسْحَاقَ ثنا عَلِيُّ بْنُ الْمَدِينِيِّ قَالَ كَانَ عَبْدُ الرَّحْمَنِ بْنُ مَهْدِيٍّ لَا يُقَدِّمُ عَلَى مَالِكٍ أَحَدًا 21356 أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ قَالَ سَمِعْتُ أَبَا الْحَسَنِ الْعَنَزِيَّ يَقُولُ سَمِعْتُ عُثْمَانَ بْنَ سَعِيدٍ الدَّارِمِيَّ يَقُولُ قُلْتُ لِيَحْيَى بْنِ مَعِينٍ مَالِكٌ أَحَبُّ إِلَيْكَ فِي نَافِعٍ أَوْ عُبَيْدُ اللهِ بْنُ عُمَرَ؟ قَالَ مَالِكٌ قُلْتُ فَأَيُّوبُ السَّخْتِيَانِيُّ؟ قَالَ مَالِكٌ 21357 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أَنْبَأَ أَبُو مُحَمَّدٍ ابْنُ أُخْتِ أَبِي عَوَانَةَ حَدَّثَنِي خَالِي ثنا الْمَيْمُونِيُّ قَالَ سَمِعْتُ يَحْيَى بْنَ مَعِينٍ وَأَحْمَدَ بْنَ حَنْبَلٍ جَمِيعًا يَقُولَانِ كَانَ مَالِكٌ مِنْ أَثْبَتِ النَّاسِ فِي حَدِيثِهِ قَالَ أَحْمَدُ بْنُ حَنْبَلٍ يَا أَبَا الْحَسَنِ لَا تُبَالِ أَنْ لَا تَسْأَلَ عَنْ رَجُلٍ حَدَّثَ عَنْهُ مَالِكٌ وَلَا سِيَّمَا مَدَنِيٌّ 21358 أَخْبَرَنَا أَبُو عَبْدِ اللهِ قَالَ سَمِعْتُ أَبَا بَكْرٍ مُحَمَّدَ بْنَ أَحْمَدَ الْحِيرِيَّ يَقُولُ سَمِعْتُ الْحُسَيْنَ بْنَ مُحَمَّدٍ الْقَبَّانِيَّ يَقُولُ سَمِعْتُ عُبَيْدَ اللهِ بْنَ عُمَرَ الْقَوَارِيرِيَّ يَقُولُ سَمِعْتُ حَمَّادَ بْنَ زَيْدٍ يَقُولُ سَمِعْتُ أَيُّوبَ السَّخْتِيَانِيَّ يَقُولُ لَقَدْ كَانَتْ لِمَالِكٍ حَلْقَةٌ فِي حَيَاةِ نَافِعٍ 21359 أَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ الْفَضْلِ الْقَطَّانُ بِبَغْدَادَ أَنْبَأَ عَبْدُ اللهِ بْنُ جَعْفَرٍ ثنا يَعْقُوبُ بْنُ سُفْيَانَ حَدَّثَنِي مُحَمَّدُ بْنُ أَبِي رُكَيْنٍ أَنْبَأَ ابْنُ وَهْبٍ حَدَّثَنِي مَالِكٌ قَالَ قَالَ لِي يَحْيَى بْنُ سَعِيدٍ اكْتُبْ لِي مِائَةَ حَدِيثٍ مِنْ حَدِيثِ ابْنِ شِهَابٍ انْتَقِهَا لِي وَأَعْطَانِي رَقًّا قَدِيمًا قَدِ اصْفَرَّ قَالَ فَكَتَبْتُ لَهُ تِلْكَ الْأَحَادِيثَ حَتَّى مَلَأْتُهُ وَبَيَّنْتُهُ لَهُ قَالَ مَالِكٌ وَقَالَ رَجُلٌ كُنْتُ أَتَعَلَّمُ مِنْهُ مَا مَاتَ حَتَّى كَانَ يَجِيئُنِي فَيَسْتَفْتِينِي وَأَمَّا مُوَافَقَةُ مَنْ وَافَقَ مَالِكًا عَلَى هَذِهِ الزِّيَادَةِ
If anyone emancipates his share in a slave, he should emancipate him completely if he has enough money to pay the full price ; but if he has none, he will be emancipated to the extent of his share. (Using translation from Abū Dāʾūd 3943)
قَالَ رَسُولُ اللهِ ﷺ مَنْ أَعْتَقَ شِرْكًا لَهُ فِي مَمْلُوكٍ فَعَلَيْهِ عِتْقُهُ كُلُّهُ إِنْ كَانَ لَهُ مَالٌ يَبْلُغُ ثَمَنَهُ وَإِنْ لَمْ يَكُنْ لَهُ مَالٌ أَعْتَقَ مِنْهُ مَا أَعْتَقَ
[Machine] The Messenger of Allah ﷺ said, "Whoever frees a slave that he owns, then his freedom is upon him in its entirety. If he has wealth that is sufficient for its price, then he should free him completely. But if he does not have wealth, then he should free him according to the value of justice, meaning he should free him as much as he can." This is a statement of Ibn Numayr, and in the narrations of Abu Bakr and Uthman, it is upon him to free him completely if he has wealth that is sufficient for its price. But if he does not have wealth, then he should establish a fair value for him, meaning he should free him as much as he can.
قَالَ رَسُولُ اللهِ ﷺ مَنْ أَعْتَقَ شِرْكًا لَهُ فِي مَمْلُوكٍ فَعَلَيْهِ عِتْقُهُ كُلُّهُ إِنْ كَانَ لَهُ مَالٌ يَبْلُغُ ثَمَنَهُ فَإِنْ لَمْ يَكُنْ لَهُ مَالٌ أَعْتَقَ مِنْهُ مَا عَتَقَ هَذَا حَدِيثُ ابْنِ نُمَيْرٍ وَفِي حَدِيثِ أَبِي بَكْرٍ وَعُثْمَانَ فَعَلَيْهِ عِتْقُهُ كُلُّهُ إِنْ كَانَ لَهُ مَالٌ يَبْلُغُ ثَمَنَهُ وَإِنْ لَمْ يَكُنْ لَهُ مَالٌ يُقَوَّمُ عَلَيْهِ قِيمَةَ عَدْلٍ يَعْنِي عَلَى الْمُعْتَقِ عَتَقَ مِنْهُ مَا عَتَقَ
The Prophet ﷺ said, "If one manumits his share of a common slave (Abd), and he has money sufficient to free the remaining portion of the price of the slave (justly estimated), then he should free the slave completely by paying the rest of his price; otherwise the slave is freed partly. قَالَ رَسُولُ اللهِ ﷺ مَنْ أَعْتَقَ نَصِيبًا فِي عَبْدٍ فَكَانَ لَهُ مِنَ الْمَالِ قَدْرُ مَا يَبْلُغُ قِيمَتَهُ قُوِّمَ عَلَيْهِ قِيمَةَ عَدْلٍ وَإِلَّا فَقَدْ عَتَقَ مِنْهُ مَا عَتَقَ
[Machine] The Messenger of Allah ﷺ said: "Whoever frees a partner in his slave, and establishes upon him a just value, then his partners are given their share, even if the slave was difficult to buy out. Otherwise, he is to free from him what he freed and distribute what remains. As for the statement of Imran bin Husain regarding the invalidity of istisqa'a..."
رَسُولَ اللهِ ﷺ قَالَ مَنْ أَعْتَقَ شِرْكًا لَهُ فِي عَبْدٍ أُقِيمَ عَلَيْهِ قِيمَةَ عَدْلٍ فَأُعْطِيَ شُرَكَاؤُهُ وَقَدْ عَتَقَ عَلَيْهِ الْعَبْدُ إِنْ كَانَ مُوسِرًا وَإِلَّا عَتَقَ مِنْهُ مَا عَتَقَ وَرَّقَ مَا بَقِيَ وَأَمَّا حَدِيثُ عِمْرَانَ بْنِ حُصَيْنٍ بِإِبْطَالِ الِاسْتِسْعَاءِ
'Imran b. Husain reported that a person who had no other property emancipated six slaves of his at the time of his death. Messenger of Allah ﷺ called for them and divided them into three sections, cast lots amongst them, and set two free and kept four in slavery; and he (the Holy Prophet) spoke severely of him. أَنَّ رَجُلًا أَعْتَقَ سِتَّةَ مَمْلُوكِينَ عِنْدَ مَوْتِهِ لَمْ يَكُنْ لَهُ مَالٌ غَيْرُهُمْ فَدَعَاهُمْ رَسُولُ اللهِ ﷺ فَجَزَّأَهُمْ أَثْلَاثًا ثُمَّ أَقْرَعَ بَيْنَهُمْ فَأَعْتَقَ اثْنَيْنِ وَأَرَقَّ أَرْبَعَةً وَقَالَ لَهُ قَوْلًا شَدِيدًا
