68. Emancipation
٦٨۔ كِتَابُ الْعِتْقِ
[Machine] That a man freed a servant from a slave, and it was mentioned to the Prophet ﷺ, so he said, "There is no partner with Allah." Ibn Kathir added to his narration and the Prophet ﷺ approved of his manumission. The Sheikh, may Allah have mercy on him, said, "It is possible that this applies to a situation where a person frees a servant who is shared between him and others, and it is also possible it refers to others."
أَنَّ رَجُلًا أَعْتَقَ شِقْصًا لَهُ مِنْ غُلَامٍ فَذُكِرَ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ لَيْسَ لِلَّهِ شَرِيكٌ زَادَ ابْنُ كَثِيرٍ فِي حَدِيثِهِ فَأَجَازَ النَّبِيُّ ﷺ عِتْقَهُ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَيُحْتَمَلُ أَنْ يَكُونَ هَذَا فِيمَنْ أَعْتَقَ شِقْصًا لَهُ مِنْ غُلَامٍ مُشْتَرَكٍ بَيْنَهُ وَبَيْنَ غَيْرِهِ وَيُحْتَمَلُ غَيْرُهُ
[Machine] A man from his people emancipated one-third of his child, so this matter was raised to the Prophet ﷺ and he said, "He is free, all of him. There is no partner for Allah, and this is most apparent in what we have placed as the door. Allah knows best."
أَنَّ رَجُلًا مِنْ قَوْمِهِ أَعْتَقَ ثُلُثَ غُلَامِهِ فَرُفِعَ ذَلِكَ إِلَى النَّبِيِّ ﷺ فَقَالَ هُوَ حُرٌّ كُلُّهُ لَيْسَ لِلَّهِ شَرِيكٌ وَهَذَا فِيمَا وَضَعْنَا الْبَابَ لَهُ أَظْهَرُ وَاللهُ أَعْلَمُ
[Machine] The age of that I set free completely does not include a thousand.
عُمَرُ ؓ أَعْتِقْهُ كُلَّهُ لَيْسَ فِيهِ أَلْفٌ
[Machine] So his grandfather freed half of him, and then the slave came to the Prophet ﷺ and informed him. The Prophet ﷺ said, "You must free one slave in exchange for your freedom, and one slave must be freed in exchange for your neck." The slave continued to serve his master until his master died. Umrah bin Hawshab and Ismail, the son of Umayyah bin Amr bin Sa'id bin Al-'As, took him as their own and 'Izra'il bin Saeed bin Al-'As did not have companionship with him.
فَأَعْتَقَ جَدُّهُ نِصْفَهُ فَجَاءَ الْعَبْدُ إِلَى النَّبِيِّ ﷺ فَأَخْبَرَهُ فَقَالَ النَّبِيُّ ﷺ تُعْتَقُ فِي عِتْقِكَ وَتُرَقُّ فِي رِقِّكَ قَالَ فَكَانَ يَخْدُمُ سَيِّدَهُ حَتَّى مَاتَ تَفَرَّدَ بِهِ عُمَرُ بْنُ حَوْشَبٍ وَإِسْمَاعِيلُ هُوَ ابْنُ أُمَيَّةَ بْنِ عَمْرِو بْنِ سَعِيدِ بْنِ الْعَاصِ وَعَمْرُو بْنُ سَعِيدٍ لَيْسَ لَهُ صُحْبَةٌ
[Machine] The Messenger of Allah ﷺ said, "A man can free his slave as much as he wishes. If he wishes, he can free him a third, or a fourth, or a fifth, and there is no harm between him and Allah. In another place, it is mentioned 'sakhtah'. Our teacher Abu Al-Walid said, "Our companions said, 'He is the one who can free a third or a fourth of him, and whoever dies or bequeaths half of this and half of that, neither one of them will invalidate the other, and he will free from each one according to the extent that he freed him.' The Sheikh, may Allah have mercy on him, said, "This is a good interpretation, except that Muhammad ibn Fada' is weak and is not considered reliable. Yahya ibn Ma'in, Sulaiman ibn Harb, and Abu Abdur-Rahman An-Nasa'i all spoke about him."
قَالَ رَسُولُ اللهِ ﷺ يُعْتِقُ الرَّجُلُ مِنْ عَبْدِهِ مَا شَاءَ إِنْ شَاءَ ثُلُثًا وَإِنْ شَاءَ رُبُعًا وَإِنْ شَاءَ خُمُسًا لَيْسَ بَيْنَهُ وَبَيْنَ اللهِ ضَغْطَةٌ وَقَالَ فِي مَوْضِعٍ آخَرَ سَقْطَةٌ قَالَ الْأُسْتَاذُ أَبُو الْوَلِيدِ قَالَ أَصْحَابُنَا هُوَ الَّذِي يُعْتِقُ مِنْ ذَا ثُلُثَهُ وَمِنْ ذَا رُبُعَهُ وَمَنْ مَاتَ أَوْ أَوْصَى بِنِصْفِ عِتْقِ هَذَا وَبِنِصْفِ عِتْقِ هَذَا لَا يُبْطِلُ أَحَدُهُمَا الْآخَرَ وَيُعْتَقُ مِنْ كُلِّ وَاحِدٍ قَدْرُ مَا أَعْتَقَهُ قَالَ الشَّيْخُ رَحِمَهُ اللهُ هَذَا تَأْوِيلٌ حَسَنٌ إِلَّا أَنَّ مُحَمَّدَ بْنَ فَضَاءٍ هَذَا ضَعِيفٌ لَا يُحْتَجُّ بِهِ تَكَلَّمَ فِيهِ يَحْيَى بْنُ مَعِينٍ وَسُلَيْمَانُ بْنُ حَرْبٍ وَأَبُو عَبْدِ الرَّحْمَنِ النَّسَائِيُّ رَحِمَهُمُ اللهُ
[Machine] If a man has a slave and he frees half of him, only what is freed is severed.
إِذَا كَانَ لِرَجُلٍ عَبْدٌ فَأَعْتَقَ نِصْفَهُ لَمْ يُعْتَقْ مِنْهُ إِلَّا مَا عَتَقَ هَذَا مُنْقَطِعٌ
