68. Emancipation
٦٨۔ كِتَابُ الْعِتْقِ
[Machine] Its rulings are the rulings of the slaves, until they are all freed.
أَحْكَامُهُ أَحْكَامُ الْعَبِيدِ حَتَّى يُعْتَقَ كُلُّهُ
[Machine] "He is divided between them, half for the one who was freed and half for the one who was not freed. Ibn Al-Mubarak reported from Ma'mar from Jabir from Ash-Sha'bi about a slave who was between two men, one of them wrote and freed him, then the people who had written the bill of emancipation died before it was executed. He said, 'His property is divided into two halves, one half for the one who freed him and the other half for the people who had written the bill.'"
هُوَ بَيْنَهُمَا نِصْفَيْنِ نِصْفٌ لِلَّذِي أَعْتَقَ وَنِصْفٌ لِلَّذِي لَمْ يُعْتِقْ وَعَنِ ابْنِ الْمُبَارَكِ عَنْ مَعْمَرٍ عَنْ جَابِرٍ عَنِ الشَّعْبِيِّ فِي عَبْدٍ بَيْنَ رَجُلَيْنِ كَاتَبَ وَاحِدٌ وَأَعْتَقَ وَاحِدٌ ثُمَّ مَاتَ الْمُكَاتِبُ قَبْلَ أَنْ يُؤَدِّيَ قَالَ مَالُهُ نِصْفَيْنِ لِلْمُعْتِقِ نِصْفٌ وَلِلْمُكَاتِبِ نِصْفٌ جَعَلَهُ بَيْنَهُمَا
