[Machine] The Messenger of Allah ﷺ said, "Whoever frees a partner in slave ownership and has enough wealth to cover the price of the slave, then he should assess the value of the slave fairly and give his partners their shares. Then, he should free the slave. If not, then he has only partially freed the slave." He said, "Yes."

If anyone emancipates his share ina slave and has enough money to pay the full price for him, a fair price for the slave should be fixed, his partners given their shares, and the slave be thus emancipated, otherwise he is emancipated only to the extent of the first man's share.  

مسلم:١٥٠١a – حَدَّثَنَا يَحْيَى بْنُ يَحْيَى قَالَ قُلْتُ لِمَالِكٍ حَدَّثَكَ نَافِعٌ عَنِ ابْنِ عُمَرَ قَالَ

He who gives up his share in a slave, and has enough money to pay the full price of the slave, then full emancipation devolves upon him; but if he has not the money, then he emancipated what he emancipated.

abudawud:3940 – al-Qaʿnabī > Mālik > Nāfiʿ > ʿAbdullāh b. ʿUmar

If anyone emancipates his share in slave, a fair price for the slave should be fixed, give his partners their shares, and the slave be thus emancipated. Otherwise he is emancipated to the extent of the share which he emancipated.  

أبو داود:٣٩٤٠ – حَدَّثَنَا الْقَعْنَبِيُّ عَنْ مَالِكٍ عَنْ نَافِعٍ عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ مَنْ أَعْتَقَ شِرْكًا لَهُ فِي مَمْلُوكٍ أُقِيمَ عَلَيْهِ قِيمَةَ الْعَدْلِ فَأَعْطَى شُرَكَاءَهُ حِصَصَهُمْ وَأُعْتِقَ عَلَيْهِ الْعَبْدُ وَإِلاَّ فَقَدْ عَتَقَ مِنْهُ مَا عَتَقَ  

ibnmajah:2528b – Yaḥyá b. Ḥakīm > ʿUthmān b. ʿUmar > Mālik b. Anas > Nāfiʿ > Ibn ʿUmar

“Whoever frees his share of a slave, the price of the slave should be fairly evaluated, and he (the partner who initiated this process) should free him (in full, by giving the rest of his price to the other co-owners), if he has enough wealth to do so. Otherwise, he will have freed whatever he freed.”  

ابن ماجة:٢٥٢٨b – حَدَّثَنَا يَحْيَى بْنُ حَكِيمٍ حَدَّثَنَا عُثْمَانُ بْنُ عُمَرَ حَدَّثَنَا مَالِكُ بْنُ أَنَسٍ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ قَالَ

قَالَ رَسُولُ اللَّهِ ﷺ مَنْ أَعْتَقَ شِرْكًا لَهُ فِي عَبْدٍ أُقِيمَ عَلَيْهِ بِقِيمَةِ عَدْلٍ فَأَعْطَى شُرَكَاءَهُ حِصَصَهُمْ إِنْ كَانَ لَهُ مِنَ الْمَالِ مَا يَبْلُغُ ثَمَنَهُ وَعَتَقَ عَلَيْهِ الْعَبْدُ وَإِلاَّ فَقَدْ عَتَقَ مِنْهُ مَا عَتَقَ  

malik:38-1 – Mālik > Nāfiʿ > ʿAbdullāh b. ʿUmar

Malik related to me from Nafi from Abdullah ibn Umar that the Messenger of Allah ﷺsaid, "If a man frees his share of a slave and has enough money to cover the full price of the slave justly evaluated for him, he must buy out his partners so that the slave is completely freed. If he doesn't have the money, he partially frees him.  

مالك:٣٨-١ – حَدَّثَنِي مَالِكٌ عَنْ نَافِعٍ عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ

أنَّ رَسُولَ اللَّهِ ﷺ قالَ: «مَن أعْتَقَ شِرْكًا لَهُ فِي عَبْدٍ. فَكانَ لَهُ مالٌ يَبْلُغُ ثَمَنَ العَبْدِ، قُوِّمَ عَلَيْهِ قِيمَةَ العَدْلِ. فَأعْطى شُرَكاءَهُ حِصَصَهُمْ. وعَتَقَ عَلَيْهِ العَبْدُ. وإلّا فَقَدْ عَتَقَ مِنهُ ما عَتَقَ»  

ahmad:397 – Isḥāq b. ʿĪsá > Mālik > Nāfiʿʿan Ibn ʿUmar

“If a person frees his share of a slave, and has enough Money to pay the full price of the slave, a fair price should be worked out for the slave, and his partners should be given their shares, then he may free the slave, otherwise he has freed only what he has freed.”  

أحمد:٣٩٧ – حَدَّثَنَا إِسْحَاقُ بْنُ عِيسَى أَخْبَرَنَا مَالِكٌ عَنْ نَافِعٍعَنِ ابْنِ عُمَرَ

"مَنْ أَعْتَقَ شِرْكًا لَهُ في عَبْدٍ وَكان له مَالٌ يَبْلغُ ثَمَنَ العَبْدِ قُوِّمَ العَبْدُ عَلَيه قِيمَة عَدْلٍ، فأَعْطَى شُرَكَاءَه حِصَصَهم، وَعَتَقَ عَليه العبدُ، وإِلَّا فَقَد عتَقَ مِنْهُ ما عَتَقَ".
