٢٤۔ كِتَابُ الْغَصْبِ ص ١
[Machine] The Messenger of Allah ﷺ said during his Farewell Pilgrimage, "Do you not know which month is the most sacred?" They said, "Our month, this month." He said, "Do you not know which land is the most sacred?" They said, "Our land, this land." He said, "Do you not know which day is the most sacred?" They said, "Our day, this day." He said, "Verily, Allah has made your lives, your wealth, and your honor sacred for one another, just as the sanctity of this day and this land. Have I not conveyed?" They said, "Yes, you have."
قَالَ رَسُولُ اللهِ ﷺ فِي حِجَّةِ الْوَدَاعِ أَلَا أِيُّ شَهْرٍ تَعْلَمُونَهُ أَعْظَمَ حُرْمَةً؟ قَالُوا شَهْرُنَا هَذَا قَالَ أِيُّ بَلَدٍ تَعْلَمُونَهُ أَعْظَمَ حُرْمَةً؟ قَالُوا بَلَدُنَا هَذَا قَالَ تَعْلَمُونَ أِيَّ يَوْمٍ أَعْظَمَ؟ قَالُوا يَوْمُنَا هَذَا قَالَ فَإِنَّ اللهَ حَرَّمَ عَلَيْكُمْ دِمَاءَكُمْ وَأَمْوَالَكُمْ وَأَعْرَاضَكُمْ إِلَّا بِحَقِّهَا كَحُرْمَةِ يَوْمِي هَذَا فِي بَلَدِكُمْ هَذَا أَلَا هَلْ بَلَّغْتُ؟ ثَلَاثًا كُلُّ ذَلِكَ يُجِيبُونَهُ أَلَا نَعَمْ 11494 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ أَبُو سَعِيدٍ أَحْمَدُ بْنُ يَعْقُوبَ الثَّقَفِيُّ ثنا أَبُو بَكْرٍ عُمَرُ بْنُ حَفْصٍ السَّدُوسِيُّ ثنا عَاصِمُ بْنُ عَلِيٍّ فَذَكَرَهُ بِإِسْنَادِهِ نَحْوَهُ إِلَّا أَنَّهُ قَالَ أَلَا أِيُّ بَلَدٍ أَلَا أِيُّ يَوْمٍ وَقَالَ أَلَا شَهْرُنَا هَذَا أَلَا بَلَدُنَا هَذَا أَلَا يَوْمُنَا هَذَا وَزَادَ فِيهِ مِنْ شَهْرِكُمْ هَذَا وَزَادَ فِي آخِرِهِ وَقَالَ وَيْحَكُمْ أَوْ وَيْلَكُمْ لَا تَرْجِعُوا بَعْدِي كُفَّارًا يَضْرِبُ بَعْضُكُمْ رِقَابَ بَعْضٍ
[Machine] When that day came, the Messenger of Allah ﷺ mounted his camel and stopped, then he said, "Do you know which day this is?" We remained silent until we saw that he would name it something other than its actual name. He then said, "Is it not the day of sacrifice?" We replied, "Yes." Then he asked, "Do you know which month this is?" Again, we remained silent until we realized he would name it something other than its actual name. He then said, "Is it not the month of Dhul-Hijjah?" We replied, "Yes, O Messenger of Allah." Then he asked, "Do you know which land this is?" Again, we remained silent until we realized he would name it something other than its actual name. He then said, "Is it not the city?" We replied, "Yes." He said, "Verily, your wealth, honor, and blood are sanctified among you just like the sanctity of this day of yours in this month of yours in this land of yours. Behold! Let him who is present convey the message to him who is absent, for perhaps the informed is more comprehending than the listener. Then he urged his camel towards the spoils and began to distribute them among the two men who had brought the sheep and the three men who had brought the camels.
لَمَّا كَانَ ذَلِكَ الْيَوْمُ رَكِبَ رَسُولُ اللهِ ﷺ نَاقَتَهُ ثُمَّ وَقَفَ فَقَالَ أَتَدْرُونَ أِيُّ يَوْمٍ هَذَا؟ فَسَكَتْنَا حَتَّى رَأَيْنَا أَنَّهُ سَيُسَمِّيهِ سِوَى اسْمِهِ فَقَالَ أَلَيْسَ يَوْمَ النَّحْرِ؟ قُلْنَا بَلَى ثُمَّ قَالَ أَتَدْرُونَ أِيُّ شَهْرٍ هَذَا؟ فَسَكَتْنَا حَتَّى رَأَيْنَا أَنَّهُ سَيُسَمِّيهِ سِوَى اسْمِهِ قَالَ أَلَيْسَ ذَا الْحِجَّةِ؟ قَالُوا بَلَى يَا رَسُولَ اللهِ قَالَ أَتَدْرُونَ أِيُّ بَلَدٍ هَذَا؟ فَسَكَتْنَا حَتَّى رَأَيْنَا أَنَّهُ سَيُسَمِّيهِ سِوَى اسْمِهِ قَالَ أَلَيْسَ الْبَلْدَةَ؟ فَقُلْنَا بَلَى قَالَ فَإِنَّ أَمْوَالَكُمْ وَأَعْرَاضَكُمْ وَدِمَاءَكُمْ حَرَامٌ بَيْنَكُمْ مِثْلُ يَوْمِكُمْ فِي مِثْلِ شَهْرِكُمْ فِي مِثْلِ بَلَدِكُمْ أَلَا لِيُبَلِّغِ الشَّاهِدُ الْغَائِبَ مَرَّتَيْنِ فَرُبَّ مُبَلَّغٍ هُوَ أَوْعَى مِنْ سَامِعٍ ثُمَّ مَالَ عَلَى نَاقَتِهِ إِلَى غُنَيْمَاتٍ فَجَعَلَ يَقْسِمُهَا بَيْنَ الرَّجُلَيْنِ الشَّاةُ وَالثَّلَاثَةِ الشَّاةُ
Don't nurse grudge and don't bid him out for raising the price and don't nurse aversion or enmity and don't enter into a transaction when the others have entered into that transaction and be as fellow-brothers and servants of Allah. A Muslim is the brother of a Muslim. He neither oppresses him nor humiliates him nor looks down upon him. The piety is here, (and while saying so) he pointed towards his chest thrice. It is a serious evil for a Muslim that he should look down upon his brother Muslim. All things of a Muslim are inviolable for his brother in faith: his blood, his wealth and his honour. أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا تَحَاسَدُوا وَلَا تَبَاغَضُوا وَلَا تَنَاجَشُوا وَلَا تَدَابَرُوا وَلَا يَبِعْ بَعْضُكُمْ عَلَى بَيْعِ بَعْضٍ وَكُونُوا عِبَادَ اللهِ إِخْوَانًا الْمُسْلِمُ أَخُو الْمُسْلِمِ لَا يَظْلِمُهُ وَلَا يَخْذُلُهُ وَلَا يَحْقِرُهُ التَّقْوَى هَا هُنَا يُشِيرُ إِلَى صَدْرِهِ ثَلَاثَ مَرَّاتٍ بِحَسْبِ امْرِئٍ مِنَ الشَّرِّ أَنْ يَحْقِرَ أَخَاهُ الْمُسْلِمَ كُلُّ الْمُسْلِمِ عَلَى الْمُسْلِمِ حَرَامٌ دَمُهُ وَمَالُهُ وَعِرْضُهُ
‘Abd Allah bin Umar reported the Apostle of Allaah ﷺ as saying “One should not milk the cattle of anyone without his permission. Does anyone of you like that any one approaches his corn cell and its storage is broken and then the corn scatters away? Likewise, the teats of their Cattle store their food. Therefore none of you should milk the cattle of anyone without his permission.” (Using translation from Abū Dāʾūd 2623)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا يَحْلُبَنَّ أَحَدُكُمْ مَاشِيَةَ غَيْرِهِ إِلَّا بِإِذْنِهِ أَيُحِبُّ أَحَدُكُمْ أَنْ تُؤْتَى مَشْرُبَتُهُ فَتُكْسَرَ خِزَانَتُهُ فَيُنْتَقَلَ طَعَامُهُ فَإِنَّمَا يَخْزُنُ لَهُمْ ضُرُوعُ مَوَاشِيهِمْ أَطْعِمَتَهُمْ فَلَا يَحْلُبَنَّ أَحَدٌ مَاشِيَةَ أَحَدٍ إِلَّا بِإِذْنِهِ
[Machine] The Messenger of Allah ﷺ prohibited plundering and mutilation.
نَهَى رَسُولُ اللهِ ﷺ عَنِ النُّهْبَى وَالْمُثْلَةِ
[Machine] He heard the Prophet ﷺ say, "No one should take his brother's belongings jokingly or seriously, and if someone takes his brother's staff, he should return it to him."
أَنَّهُ سَمِعَ النَّبِيَّ ﷺ يَقُولُ لَا يَأْخُذْ أَحَدُكُمْ مَتَاعَ أَخِيهِ لَاعِبًا أَوْ جَادًّا وَإِذَا أَخَذَ أَحَدُكُمْ عَصَا أَخِيهِ فَلْيَرُدَّهَا إِلَيْهِ
[Machine] The Messenger of Allah ﷺ said, "Injustice is darkness on the Day of Judgment."
قَالَ رَسُولُ اللهِ ﷺ الظُّلْمُ ظُلُمَاتٌ يَوْمَ الْقِيَامَةِ
Be on your guard against committing oppression, for oppression is a darkness on the Day of Resurrection, and be on your guard against stinginess for stinginess destroyed those who were before you, as it incited them to shed blood and make lawful what was unlawful for them. أَنَّ رَسُولَ اللهِ ﷺ قَالَ اتَّقُوا الظُّلْمَ؛ فَإِنَّ الظُّلْمَ ظُلُمَاتٌ يَوْمَ الْقِيَامَةِ وَاتَّقُوا الشُّحَّ؛ فَإِنَّ الشُّحَّ أَهْلَكَ مَنْ كَانَ قَبْلَكُمْ حَمَلَهُمْ عَلَى أَنْ سَفَكُوا دِمَاءَهُمْ وَاسْتَحَلُّوا مَحَارِمَهُمْ
[Machine] The Prophet ﷺ sent Mu'adh ibn Jabal to Yemen and said to him at the end of his instructions, "Beware of the supplication of the oppressed, for there is no barrier between it and Allah." This hadith is reported by Bukhari and Muslim in Sahih from the narration of Waki' and others.
أَنَّ النَّبِيَّ ﷺ بَعَثَ مُعَاذَ بْنَ جَبَلٍ ؓ إِلَى الْيَمَنِ الْحَدِيثَ وَقَالَ فِي آخِرِهِ وَاتَّقِ دَعْوَةَ الْمَظْلُومِ؛ فَإِنَّهُ لَيْسَ بَيْنَهَا وَبَيْنَ اللهِ حِجَابٌ وَأَخْرَجَهُ الْبُخَارِيُّ وَمُسْلِمٌ فِي الصَّحِيحِ مِنْ حَدِيثِ وَكِيعٍ وَغَيْرِهِ
"O My servants, I have forbidden oppression for Myself and have made it forbidden amongst you, so do not oppress one another. O My servants, all of you are astray except for those I have guided, so seek guidance of Me and I shall guide you, O My servants, all of you are hungry except for those I have fed, so seek food of Me and I shall feed you. O My servants, all of you are naked except for those I have clothed, so seek clothing of Me and I shall clothe you."
"O My servants, you sin by night and by day, and I forgive all sins, so seek forgiveness of Me and I shall forgive you. O My servants, you will not attain harming Me so as to harm Me, and will not attain benefitting Me so as to benefit Me. O My servants, were the first of you and the last of you, the human of you and the jinn of you to be as pious as the most pious heart of any one man of you, that would not increase My dominion in anything. O My servants, were the first of you and the last of you, the human of you and the jinn of you to be as wicked as the most wicked heart of any one man of you, that would not decrease My dominion in anything. O My servants, were the first of you and the last of you, the human of you and the jinn of you to rise up in one place and make a request of Me, and were I to give everyone what he requested, that would not decrease what I have, any more that a needle decreases the sea if put into it. O My servants, it is but your deeds that I record for you and then recompense you for. So let him who finds good, praise Allah, and let him who finds other than that blame no one but himself." (Using translation from Muslim 2577a)
عَنْ رَسُولِ اللهِ ﷺ عَنِ اللهِ ﷻ أَنَّهُ قَالَ إِنِّي حَرَّمْتُ الظُّلْمَ عَلَى نَفْسِي وَجَعَلْتُهُ بَيْنَكُمْ مُحَرَّمًا فَلَا تَظَالَمُوا يَا عِبَادِي إِنَّكُمُ الَّذِينَ تُخْطِئُونَ بِاللَّيْلِ وَالنَّهَارِ وَأَنَا الَّذِي أَغْفِرُ الذُّنُوبَ وَلَا أُبَالِي فَاسْتَغْفِرُونِي أَغْفِرْ لَكُمْ يَا عِبَادِي كُلُّكُمْ جَائِعٌ إِلَّا مَنْ أَطْعَمْتُ فَاسْتَطْعِمُونِي أُطْعِمْكُمْ يَا عِبَادِي كُلُّكُمْ عَارٍ إِلَّا مَنْ كَسَوْتُهُ فَاسْتَكْسُونِي أَكْسُكُمْ يَا عِبَادِي لَوْ أَنَّ أَوَّلَكُمْ وَآخِرَكُمْ وَإِنْسَكُمْ وَجِنَّكُمْ كَانُوا عَلَى أَتْقَى قَلْبِ رَجُلٍ مِنْكُمْ لَمْ يَزِدْ ذَلِكَ فِي مُلْكِي شَيْئًا يَا عِبَادِي لَوْ أَنَّ أَوَّلَكُمْ وَآخِرَكُمْ وَإِنْسَكُمْ وَجِنَّكُمْ كَانُوا عَلَى أَفْجَرِ قَلْبِ رَجُلٍ مِنْكُمْ لَمْ يَنْقُصْ ذَلِكَ مِنْ مُلْكِي شَيْئًا يَا عِبَادِي لَوْ أَنَّ أَوَّلَكُمْ وَآخِرَكُمْ وَإِنْسَكُمْ وَجِنَّكُمُ اجْتَمَعُوا فِي صَعِيدٍ وَاحِدٍ فَسَأَلُونِي ثُمَّ أَعْطَيْتُ كُلَّ إِنْسَانٍ مِنْهُمْ مَا سَأَلَ لَمْ يَنْقُصْ ذَلِكَ مِنْ مُلْكِي شَيْئًا إِلَّا كَمَا يَنْقُصُ الْبَحْرُ يُغْمَسُ فِيهِ الْمِخْيَطُ غَمْسَةً وَاحِدَةً يَا عِبَادِي إِنَّمَا هِيَ أَعْمَالُكُمْ أَحْفَظُهَا عَلَيْكُمْ فَمَنْ وَجَدَ خَيْرًا فَلْيَحْمَدِ اللهَ وَمَنْ وَجَدَ غَيْرَ ذَلِكَ فَلَا يَلُومَنَّ إِلَّا نَفْسَهُ
Do you know who is poor? They (the Companions of the Holy Prophet) said: A poor man amongst us is one who has neither dirham with him nor wealth. He (the Holy Prophet) said: The poor of my Umma would be he who would come on the Day of Resurrection with prayers and fasts and Zakat but (he would find himself bankrupt on that day as he would have exhausted his funds of virtues) since he hurled abuses upon others, brought calumny against others and unlawfully consumed the wealth of others and shed the blood of others and beat others, and his virtues would be credited to the account of one (who suffered at his hand). And if his good deeds fall short to clear the account, then his sins would be entered in (his account) and he would be thrown in the Hell-Fire. (Using translation from Muslim 2581)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ أَتَدْرُونَ مَنِ الْمُفْلِسُ؟ قَالُوا الْمُفْلِسُ فِينَا مَنْ لَا دِرْهَمَ لَهُ وَلَا مَتَاعَ فَقَالَ إِنَّ الْمُفْلِسَ مِنْ أُمَّتِي يَأْتِي يَوْمَ الْقِيَامَةِ بِصَلَاةٍ وَصِيَامٍ وَزَكَاةٍ وَيَأْتِي قَدْ شَتَمَ هَذَا وَقَذْفَ هَذَا وَأَكَلَ مَالَ هَذَا وَسَفَكَ دَمَ هَذَا وَضَرَبَ هَذَا فَيُعْطَى هَذَا مِنْ حَسَنَاتِهِ وَهَذَا مِنْ حَسَنَاتِهِ فَإِنْ فَنِيَتْ حَسَنَاتُهُ قَبْلَ أَنْ يُقْضَى عَنْهُ مَا عَلَيْهِ أُخِذَ مِنْ خَطَايَاهُمْ فَطُرِحَتْ عَلَيْهِ ثُمَّ طُرِحَ فِي النَّارِ لَفْظُ حَدِيثِهِمَا سَوَاءٌ إِلَّا أَنَّ فِي رِوَايَةِ ابْنِ عَبْدَانَ فَيُقْضَى هَذَا مِنْ حَسَنَاتِهِ
“Rights will certainly be restored to those entitled to them on the Day of Resurrection, (to the point that) even the hornless sheep will lay claim upon the horned one.” (Using translation from Muslim 2582)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَتُؤَدَّنَّ الْحُقُوقُ إِلَى أَهْلِهَا يَوْمَ الْقِيَامَةِ حَتَّى يُقَادَ لِلشَّاةِ الْجَلْحَاءِ مِنَ الشَّاةِ الْقَرْنَاءِ
[Machine] Al-Zubair: O Messenger of Allah, will what is between us with the specific sins be repeated? He (the Prophet): Yes, it will be repeated upon you until the right of every rightful person is restored. Al-Zubair: By Allah, the matter is indeed severe.
الزُّبَيْرُ يَا رَسُولَ اللهِ أَيُكَرَّرُ عَلَيْنَا مَا يَكُونُ بَيْنَنَا مَعَ خَوَاصِّ الذُّنُوبِ؟ قَالَ نَعَمْ لَتُكَرَّرَنَّ عَلَيْكُمْ حَتَّى يُرَدَّ إِلَى كُلِّ ذِي حَقٍّ حَقُّهُ قَالَ الزُّبَيْرُ وَاللهِ إِنَّ الْأَمْرَ لَشَدِيدٌ
[Machine] The Messenger of Allah ﷺ said: "Verily, Allah gives respite to the wrongdoer until, when He seizes him, He will not let him escape." Then he recited, "{Such is the seizing of your Lord when He seizes the cities while they are committing wrong. Indeed, His seizing is painful and severe}" [Hud 102].
قَالَ رَسُولُ اللهِ ﷺ إِنَّ اللهَ لَيُمْلِي الظَّالِمَ حَتَّى إِذَا أَخَذَهُ لَمْ يُفْلِتْهُ ثُمَّ قَرَأَ {وَكَذَلِكَ أَخْذُ رَبِّكَ إِذَا أَخَذَ الْقُرَى وَهِيَ ظَالِمَةٌ إِنَّ أَخْذَهُ أَلِيمٌ شَدِيدٌ} [هود 102]
24.2 [Machine] Victory for the oppressed and standing up against the oppressor when possible
٢٤۔٢ بَابُ نَصْرِ الْمَظْلُومِ وَالْأَخْذِ عَلَى يَدِ الظَّالِمِ عِنْدَ الْإِمْكَانِ
[Machine] About seven things, meaning the Prophet ﷺ said: We have been commanded to visit the sick, follow funeral processions, greet with peace, answer the one who calls for help, say "Alhamdulillah" when someone sneezes, support the oppressed, fulfill promises, and refrain from drinking in silver vessels. For whoever drinks from them in this world, they will not drink from them in the Hereafter. And we have been prohibited from wearing gold rings, riding on saddles, wearing silk, linen, Deebaj, and Istabrak garments. This was narrated in the Sahih from the hadith of Ash-Shaybani and others.
عَنْ سَبْعٍ يَعْنِي النَّبِيَّ ﷺ قَالَ أَمَرَنَا بِعِيَادَةِ الْمَرِيضِ وَاتِّبَاعِ الْجَنَازَةِ وَإِفْشَاءِ السَّلَامِ وَإِجَابَةِ الدَّاعِي وَتَشْمِيتِ الْعَاطِسِ وَنَصْرِ الْمَظْلُومِ وَإِبْرَارِ الْمُقْسِمِ وَنَهَانَا عَنِ الشُّرْبِ فِي آنِيَةِ الْفِضَّةِ؛ فَإِنَّهُ مَنْ يَشْرَبُ فِيهَا فِي الدُّنْيَا لَا يَشْرَبُ فِيهَا فِي الْآخِرَةِ وَعَنِ التَّخَتُّمِ بِالذَّهَبِ وَعَنْ رُكُوبِ الْمَيَاثِرِ وَلِبَاسِ الْقَسِّيِّ وَالْحَرِيرِ وَالدِّيبَاجِ وَالْإِسْتَبْرَقِ أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ الشَّيْبَانِيِّ وَغَيْرِهِ
"Help your brother whether he is an oppressor or oppressed." It was said: "O Messenger of Allah! I help him when he is oppressed. But how can I help him when he oppresses?" He said: "Prevent him from oppression, that is your help for him." (Using translation from Tirmidhī 2255)
قَالَ رَسُولُ اللهِ ﷺ انْصُرْ أَخَاكَ ظَالِمًا أَوْ مَظْلُومًا قِيلَ يَا رَسُولَ اللهِ نَصَرْتُهُ مَظْلُومًا فَكَيْفَ أَنْصُرُهُ ظَالِمًا؟ قَالَ تَمْنَعُهُ مِنَ الظُّلْمِ فَذَلِكَ نَصْرُكَ إِيَّاهُ
Messenger of Allah ﷺ said, "Help your brother, whether he is an oppressor or he is an oppressed one. People asked, "O Messenger of Allah ﷺ! It is all right to help him if he is oppressed, but how should we help him if he is an oppressor?" The Prophet ﷺ said, "By preventing him from oppressing others." (Using translation from Bukhārī 2444)
قَالَ رَسُولُ اللهِ ﷺ انْصُرْ أَخَاكَ ظَالِمًا أَوْ مَظْلُومًا فَقَالَ يَا رَسُولَ اللهِ هَذَا نَنْصُرُهُ مَظْلُومًا فَكَيْفَ نَنْصُرُهُ ظَالِمًا؟ قَالَ تَأْخُذُ فَوْقَ يَدَيْهِ
[Machine] The Prophet ﷺ said: "Indeed, a believer is like a building, supporting and strengthening each other, just like the bricks of a building are held together."
عَنِ النَّبِيِّ ﷺ قَالَ إِنَّ الْمُؤْمِنَ لِلْمُؤْمِنِ كَالْبُنْيَانِ يَشُدُّ بَعْضُهُ بَعْضًا وَشَبَّكَ بَيْنَ أَصَابِعِهِ
A Muslim is a Muslim’s brother: he does not wrong him or abandon him. If anyone cares for his brother’s need, Allah will care for his need ; if anyone removes a Muslim’s anxiety, Allah will remove from him, on account of it, one of the anxieties of the Day of resurrection ; and if anyone conceals a Muslim’s fault, Allah will conceal his fault on the Day of resurrection. أَخْبَرَهُ أَنَّ رَسُولَ اللهِ ﷺ قَالَ الْمُسْلِمُ أَخُو الْمُسْلِمِ لَا يَظْلِمُهُ وَلَا يُسْلِمُهُ مَنْ كَانَ فِي حَاجَةِ أَخِيهِ كَانَ اللهُ ﷻ فِي حَاجَتِهِ وَمَنْ فَرَّجَ عَنْ مُسْلِمٍ كُرْبَةً فَرَّجَ اللهُ عَنْهُ بِهَا كُرْبَةً مِنْ كُرَبِ يَوْمِ الْقِيَامَةِ وَمَنْ سَتَرَ مُسْلِمًا سَتَرَهُ اللهُ ﷻ يَوْمَ الْقِيَامَةَ
"I heard the Messenger of Allah [SAW] say: 'Whoever among you sees an evil, let him change it with his hand; if he cannot, then with his tongue; if he cannot, then with his heart- and that is the weakest of Faith.'" (Using translation from Nasāʾī 5008)
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ رَأَى مِنْكُمْ مُنْكَرًا فَلْيُغَيِّرْهُ بِيَدِهِ فَإِنْ لَمْ يَسْتَطِعْ فَبِلِسَانِهِ فَإِنْ لَمْ يَسْتَطِعْ فَبِقَلْبِهِ وَذَلِكَ أَضْعَفُ الْإِيمَانِ
[Machine] When Ja'far bin Abi Talib returned from the land of Abyssinia, he met the Prophet ﷺ . The Prophet ﷺ said to him, "Tell me about the most amazing thing you saw in Abyssinia." Ja'far replied, "I saw a woman with a bundle of food on her head. A man on a horse passed by her and knocked it off. The woman picked it up and put it back in her bundle, saying, 'Woe to you! The day the King places his throne and gives the oppressed their right against the oppressor.' The Prophet ﷺ laughed until his molars could be seen and said, 'How can a nation be considered holy if it does not give its weak their rights against the strong, especially when the weak are not even rebellious?'" Then Abu Al-Husayn bin Bishran informed us, narrating from Abu Amr bin As-Sammak, who narrated from Abdullah bin Abi Saad, who narrated from Sa'id bin Sulaiman, who narrated from Mansur bin Abi Al-Aswad, who narrated from Ata' bin As-Sa'ib, who narrated from Muharib bin Dithar, who narrated from Ibn Buraydah, who narrated from his father, who mentioned the hadith with its meaning.
لَمَّا قَدِمَ جَعْفَرُ بْنُ أَبِي طَالِبٍ مِنْ أَرْضِ الْحَبَشَةِ لَقِيَهُ النَّبِيُّ ﷺ فَقَالَ أَخْبِرْنِي بِأَعْجَبِ شَيْءٍ رَأَيْتَهُ بِأَرْضِ الْحَبَشَةِ قَالَ مَرَّتِ امْرَأَةٌ عَلَى رَأْسِهَا مِكْتَلٌ فِيهِ طَعَامٌ فَمَرَّ بِهَا رَجُلٌ عَلَى فَرَسٍ فَأَصَابَهَا فَرَمَى بِهِ فَجَعَلْتُ أَنْظُرُ إِلَيْهَا وَهِيَ تُعِيدُهُ فِي مِكْتَلِهَا وَهِيَ تَقُولُ وَيْلٌ لَكَ يَوْمَ يَضَعُ الْمَلِكُ كُرْسِيَّهُ فَيَأْخُذُ لِلْمَظْلُومِ مِنَ الظَّالِمِ فَضَحِكَ النَّبِيُّ ﷺ حَتَّى بَدَتْ نَوَاجِذُهُ فَقَالَ كَيْفَ تُقَدَّسُ أُمَّةٌ لَا تَأْخُذُ لِضَعِيفِهَا مِنْ شَدِيدِهَا حَقَّهُ وَهُوَ غَيْرُ مُتَعْتَعٍ؟ 11515 وَأَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ بِشْرَانَ أنبأ أَبُو عَمْرِو بْنُ السَّمَّاكِ ثنا عَبْدُ اللهِ بْنُ أَبِي سَعْدٍ ثنا سَعِيدُ بْنُ سُلَيْمَانَ عَنْ مَنْصُورِ بْنِ أَبِي الْأَسْوَدِ ثنا عَطَاءُ بْنُ السَّائِبِ عَنْ مُحَارِبِ بْنِ دِثَارٍ عَنِ ابْنِ بُرَيْدَةَ عَنْ أَبِيهِ فَذَكَرَ الْحَدِيثَ بِمَعْنَاهُ
[Machine] The Messenger of Allah ﷺ said: "When you see my nation, do not say to the oppressor that he is a oppressor, for then you would have betrayed Muhammad bin Muslim. This is Abu al-Zubair and he did not hear it from Abdullah bin Amr bin al-As 11517." Abu Abdullah al-Hafiz informed us, in the narration of Abu al-Abbas Muhammad bin Ya'qub, who said: I heard al-Abbas bin Muhammad saying: I heard Yahya bin Ma'in saying: Abu al-Zubair did not hear it from Abdullah bin Amr bin al-As 11518. And regarding its authenticity, Abu Sa'd al-Malini informed us, who was informed by Abu Ahmad bin Adi, who was informed by Muhammad bin Bakkar, who was informed by Muhammad bin Ubaydullah al-Munadi, who was informed by Shababa, who was informed by Abu Shihab, who was informed by al-Hasan bin Amr, who heard it from Abu al-Zubair, who heard it from Amr bin Shuayb, who heard it from Abdullah bin Amr, who heard it from the Prophet ﷺ in a similar manner.
قَالَ رَسُولُ اللهِ ﷺ إِذَا رَأَيْتُمْ أُمَّتِي لَا تَقُولُ لِلظَّالِمِ أَنْتَ ظَالِمٌ فَقَدْ تُوُدِّعَ مِنْهُمْ مُحَمَّدُ بْنُ مُسْلِمٍ هَذَا هُوَ أَبُو الزُّبَيْرِ وَلَمْ يَسْمَعْ مِنْ عَبْدِ اللهِ بْنِ عَمْرِو بْنِ الْعَاصِ 11517 أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ قَالَ سَمِعْتُ الْعَبَّاسَ بْنَ مُحَمَّدٍ يَقُولُ سَمِعْتُ يَحْيَى بْنَ مَعِينٍ يَقُولُ أَبُو الزُّبَيْرِ لَمْ يَسْمَعْ مِنْ عَبْدِ اللهِ بْنِ عَمْرِو بْنِ الْعَاصِ 11518 وبِصِحَّةِ ذَلِكَ أَخْبَرَنَا أَبُو سَعْدٍ الْمَالِينِيُّ أنبأ أَبُو أَحْمَدَ بْنُ عَدِيٍّ ثنا مُحَمَّدُ بْنُ بَكَّارٍ ثنا مُحَمَّدُ بْنُ عُبَيْدِ اللهِ الْمُنَادِي ثنا شَبَابَةُ ثنا أَبُو شِهَابٍ ثنا الْحَسَنُ بْنُ عَمْرٍو عَنْ أَبِي الزُّبَيْرِ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ عَبْدِ اللهِ بْنِ عَمْرٍو عَنِ النَّبِيِّ ﷺ نَحْوَهُ
24.3 [Machine] Recovering the Stolen when it is still available
٢٤۔٣ بَابُ رَدِّ الْمَغْصُوبِ إِذَا كَانَ بَاقِيًا
“The hand that takes is responsible for what it has taken until it returns it.” (Using translation from Ibn Mājah 2400)
قَالَ النَّبِيُّ ﷺ عَلَى الْيَدِ مَا أَخَذَتْ حَتَّى تُؤَدِّيَهُ
24.4 [Machine] Return its value if it is of valuable nature, or return its equivalent if it is of similar kind, when it is destroyed by the looter or damaged in their hands
٢٤۔٤ بَابُ رَدِّ قِيمَتِهِ إِنْ كَانَ مِنْ ذَوَاتِ الْقِيَمِ، أَوْ رَدِّ مِثْلِهِ إِنْ كَانَ مِنْ ذَوَاتِ الْأَمْثَالِ، إِذَا أَتْلَفَهُ الْغَاصِبُ أَوْ تَلِفَ فِي يَدَيْهِ
“If a person frees his share of a slave, and has enough Money to pay the full price of the slave, a fair price should be worked out for the slave, and his partners should be given their shares, then he may free the slave, otherwise he has freed only what he has freed.” (Using translation from Aḥmad 397)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ أَعْتَقَ شِرْكًا لَهُ فِي عَبْدٍ فَكَانَ لَهُ مَا يَبْلُغُ ثَمَنَ الْعَبْدِ قُوِّمَ عَلَيْهِ قِيمَةُ الْعَدْلِ فَأَعْطَى شُرَكَاءَهُ حِصَصَهُمْ وَعَتَقَ عَلَيْهِ الْعَبْدُ وَإِلَّا فَقَدْ عَتَقَ مِنْهُ مَا عَتَقَ اتَّفَقَا عَلَى إِخْرَاجِهِ فِي الصَّحِيحِ مِنْ حَدِيثِ مَالِكٍ
While the Prophet ﷺ was with one of his wives, one of the mothers of the believers (i.e. one of his wives) sent a wooden bowl containing food with a servant. The wife (in whose house he was sitting) stroke the bowl with her hand and broke it. The Prophet ﷺ collected the shattered pieces and put the food back in it and said, "Eat." He kept the servant and the bowl till he had eaten the food. Then the Prophet gave another unbroken. bowl to the servant and kept the broken one. (Using translation from Bukhārī 2481)
أَنَّ رَسُولَ اللهِ ﷺ كَانَ عِنْدَ بَعْضِ نِسَائِهِ فَأَرْسَلَتْ إِحْدَى أُمَّهَاتِ الْمُؤْمِنِينَ مَعَ خَادِمٍ بِقَصْعَةٍ فِيهَا طَعَامٌ فَضَرَبَتْ بِيَدِه فَكَسَرَتِ الْقَصْعَةَ فَضَمَّهَا وَجَعَلَ فِيهَا الطَّعَامَ وَقَالَ كُلُوا وَحَبَسَ الرَّسُولَ وَالْقَصْعَةَ حَتَّى فَرَغُوا فَدَفَعَ الْقَصْعَةَ الصَّحِيحَةَ إِلَى الرَّسُولِ وَحَبَسَ الْمَكْسُورَةَ
[Machine] The Prophet ﷺ was with some of his wives when one of the mothers of the believers sent a plate of food. The servant of the house accidentally hit the hand of the person holding the plate, causing it to fall and break open. The Messenger of Allah ﷺ gathered the broken pieces together and placed the food that was in the plate between them. He then said, "Your mother got angry and kept the servant until she brought a plate from the person she was with." He gave the correct plate to the one whose plate had been broken and kept the broken plate at the house of the one who had caused it to break.
كَانَ النَّبِيُّ ﷺ عِنْدَ بَعْضِ نِسَائِهِ فَأَرْسَلَتْ إِحْدَى أُمَّهَاتِ الْمُؤْمِنِينَ بِصَحْفَةٍ فِيهَا طَعَامٌ فَضَرَبَتِ الَّتِي فِي بَيْتِهَا يَدَ الْخَادِمِ فَسَقَطَتِ الصَّحْفَةُ فَانْفَلَقَتْ فَجَمَعَ رَسُولُ اللهِ ﷺ بَيْنَ الْفِلْقَتَيْنِ ثُمَّ جَعَلَ يَجْعَلُ فِيهِمَا الطَّعَامَ الَّذِي كَانَ فِي الصَّحْفَةِ وَيَقُولُ غَارَتْ أُمُّكُمْ وَحَبَسَ الْخَادِمَ حَتَّى أَتَى بِصَحْفَةٍ مِنْ عِنْدِ الَّتِي هُوَ فِي بَيْتِهَا فَدَفَعَ الصَّحْفَةَ الصَّحِيحَةَ إِلَى الَّتِي كُسِرَتْ صَحْفَتُهَا وَأَمْسَكَ الْمَكْسُورَةَ فِي بَيْتِ الَّتِي كَسَرَتْ
[Machine] I saw a food maker like Safiyyah, who sent a vessel with food in it to the Messenger of Allah ﷺ . I hit it with my hand and broke it, so I said, "O Messenger of Allah, what is the expiation for this?" He said, "A vessel is replaced by another vessel and food is replaced by another food." I wish that Al-Amiri and Jasrah bint Dajajah were present, so they can witness this statement, and the interpretation of the news is what has passed. With Allah's help, we narrated this from Ash-Sha'bi, who said regarding a man, "Wheat is consumed for him, and he has food similar to his food, and a measure similar to his measure."
رَأَيْتُ صَانِعَةَ طَعَامٍ مِثْلَ صَفِيَّةَ ؓ بَعَثَتْ إِلَى رَسُولِ اللهِ ﷺ بِإِنَاءٍ فِيهِ طَعَامٌ فَضَرَبْتُهُ بِيَدِي فَكَسَرْتُهُ فَقُلْتُ يَا رَسُولَ اللهِ مَا كَفَّارَةُ هَذَا؟ قَالَ إِنَاءٌ مَكَانُ إِنَاءٍ وَطَعَامٌ مَكَانُ طَعَامٍ فُلَيْتٌ الْعَامِرِيُّ وَجَسْرَةُ بِنْتُ دَجَاجَةَ فِيهِمَا نَظَرٌ ثُمَّ تَأْوِيلُ الْخَبَرِ مَا مَضَى وَبِاللهِ التَّوْفِيقُ وَرُوِّينَا عَنِ الشَّعْبِيِّ أَنَّهُ قَالَ فِي الرَّجُلِ تُسْتَهْلَكُ لَهُ الْحِنْطَةُ إِنَّ عَلَى صَاحِبِهِ لَهُ طَعَامًا مِثْلَ طَعَامِهِ وَكَيْلًا مِثْلَ كَيْلِهِ
24.5 [Machine] No one owns anything through inheritance except what they wish for and the owner.
٢٤۔٥ بَابُ لَا يَمْلِكُ أَحَدٌ بِالْجِنَايَةِ شَيْئًا جَنَى عَلَيْهِ إِلَّا أَنْ يَشَاءَ هُوَ وَالْمَالِكُ
[Machine] The Messenger of Allah ﷺ addressed the people during the Farewell Hajj and mentioned in his speech, "It is not lawful for a man to take the wealth of his brother except what he willingly gives him out of good will. Do not wrong one another and do not return to disbelief after me, striking each other's necks."
أَنَّ رَسُولَ اللهِ ﷺ خَطَبَ النَّاسَ فِي حِجَّةِ الْوَدَاعِ فَذَكَرَ الْحَدِيثَ وَفِيهِ لَا يَحِلُّ لِامْرِئٍ مِنْ مَالِ أَخِيهِ إِلَّا مَا أَعْطَاهُ مِنْ طِيبِ نَفْسٍ وَلَا تَظْلِمُوا وَلَا تَرْجِعُوا بَعْدِي كُفَّارًا يَضْرِبُ بَعْضُكُمْ رِقَابَ بَعْضٍ
[Machine] I attended the sermon of the Prophet ﷺ in Mina, and in his speech he said, "It is not permissible for anyone to take anything from his brother's wealth except what his brother willingly gives. When someone heard that, he asked, 'O Messenger of Allah, what if I come across my cousin's sheep and I take a sheep from him and then slaughter it? Would I be at fault?' The Prophet ﷺ replied, 'If you come across a female sheep carrying a knife and a pulley of a caravan, do not touch it.' It was said that it is a land between Mecca and the neighbor's land, a land without any inhabitants."
شَهِدْتُ خُطْبَةَ النَّبِيِّ ﷺ بِمِنًى فَكَانَ فِيمَا خَطَبَ بِهِ قَالَ وَلَا يَحِلُّ لِأَحَدٍ مِنْ مَالِ أَخِيهِ إِلَّا مَا طَابَتْ بِهِ نَفْسُهُ فَلَمَّا سَمِعَهُ قَالَ ذَلِكَ قَالَ يَا رَسُولَ اللهِ أَرَأَيْتَ لَوْ لَقِيتُ غَنَمَ ابْنِ عَمِّي فَأَخَذْتُ مِنْهُ شَاةً فَاجْتَزَرْتُهَا فَعَلَيَّ فِي ذَلِكَ شَيْءٌ؟ قَالَ إِنْ لَقِيتَهَا نَعْجَةً تَحْمِلُ شَفْرَةً وَزِنَادًا بِخَبْتِ الْجَمِيشِ فَلَا تَمَسَّهَا قِيلَ هِيَ أَرْضٌ بَيْنَ مَكَّةَ وَالْجَارِ أَرْضٌ لَيْسَ بِهَا أَنِيسٌ
[Machine] Narrated Ibn 'Umar: The Prophet ﷺ mentioned the sermon during the middle days of Tashriq in his Hajj and said, "O people! Whoever has entrusted something precious to him, he should return it to the one who entrusted him. O people! Verily, no one has the right to take anything from his brother's wealth except what is pleasing to himself."
عَنِ ابْنِ عُمَرَ فَذَكَرَ الْحَدِيثَ فِي خُطْبَةِ النَّبِيِّ ﷺ وَسَطَ أَيَّامِ التَّشْرِيقِ فِي حَجَّتِهِ وَقَالَ فِيهَا أَيُّهَا النَّاسُ مَنْ كَانَتْ عِنْدَهُ وَدِيعَةٌ فَلْيَرُدَّهَا إِلَى مَنِ ائْتَمَنَهُ عَلَيْهَا أَيُّهَا النَّاسُ إِنَّهُ لَا يَحِلُّ لِامْرِئٍ مِنْ مَالِ أَخِيهِ شَيْءٌ إِلَّا مَا طَابَتْ بِهِ نَفْسُهُ
Abu Bakr had a slave who used to give him some of his earnings. Abu Bakr used to eat from it. One day he brought something and Abu Bakr ate from it. The slave said to him, "Do you know what this is?" Abu Bakr then enquired, "What is it?" The slave said, "Once, in the pre-Islamic period of ignorance I foretold somebody's future though I did not know this knowledge of foretelling but I, cheated him, and when he met me, he gave me something for that service, and that is what you have eaten from." Then Abu Bakr put his hand in his mouth and vomited whatever was present in his stomach. (Using translation from Bukhārī 3842)
كَانَ لِأَبِي بَكْرٍ ؓ غُلَامٌ يُخْرِجُ لَهُ الْخَرَاجَ وَكَانَ أَبُو بَكْرٍ ؓ يَأْكُلُ مِنْ خَرَاجِهِ فَجَاءَ يَوْمًا بِشَيْءٍ فَأَكَلَ مِنْهُ أَبُو بَكْرٍ ؓ فَقَالَ لَهُ الْغُلَامُ أَتَدْرِي مَا هَذَا؟ فَقَالَ أَبُو بَكْرٍ ؓ وَمَا هُوَ؟ قَالَ كُنْتُ تَكَهَّنْتُ لِإِنْسَانٍ فِي الْجَاهِلِيَّةِ وَمَا أُحْسِنُ الْكِهَانَةَ إِلَّا أَنِّي خَدَعْتُهُ فَلَقِيَنِي فَأَعْطَانِي بِذَلِكَ فَهَذَا الَّذِي أَكَلْتَ مِنْهُ فَأَدْخَلَ أَبُو بَكْرٍ ؓ يَدَهُ فَقَاءَ كُلَّ شَيْءٍ فِي بَطْنِهِ لَفْظُ حَدِيثِهِمَا سَوَاءٌ وَإِنَّمَا الِاخْتِلَافُ فِي الْإِسْنَادِ
[Machine] A Muslim woman from the Quraysh made food for the Messenger of Allah and invited him and his companions. He said, "Then my father took me with him and we sat among the gatherings of the children of their fathers. They did not eat until they saw the Messenger of Allah eating. When the Messenger of Allah took a morsel, he threw it away and said, 'I find the taste of a slaughtered sheep without the permission of its owner in it.' She said, 'O Messenger of Allah, my brother and I are among the dearest people to him, and if there was something better than it, he would not have given me anything else. So, he refused to eat from it and ordered the food to be given to the prisoners.' The old man added, 'and this (means) because he feared corruption, and her companion was absent, so he thought it was beneficial to feed the prisoners.' And Allah knows best. Then he guaranteed (the punishment for) her companion."
صَنَعَتِ امْرَأَةٌ مِنَ الْمُسْلِمِينَ مِنْ قُرَيْشٍ لِرَسُولِ اللهِ ﷺ طَعَامًا فَدَعَتْهُ وَأَصْحَابَهُ قَالَ فَذَهَبَ بِي أَبِي مَعَهُ قَالَ فَجَلَسْنَا بَيْنَ يَدَيْ آبَائِنَا مَجَالِسَ الْأَبْنَاءِ مِنْ آبَائِهِمْ قَالَ فَلَمْ يَأْكُلُوا حَتَّى رَأَوْا رَسُولَ اللهِ ﷺ أَكَلَ فَلَمَّا أَخَذَ رَسُولُ اللهِ ﷺ لُقْمَةً رَمَى بِهَا ثُمَّ قَالَ إِنِّي لَأَجِدُ طَعْمَ لَحْمِ شَاةٍ ذُبِحَتْ بِغَيْرِ إِذْنِ صَاحِبِهَا فَقَالَتْ يَا رَسُولَ اللهِ أَخِي وَأَنَا مِنْ أَعَزِّ النَّاسِ عَلَيْهِ وَلَوْ كَانَ خَيْرًا مِنْهَا لَمْ يُغَيِّرْ عَلَيَّ وَعَلَيَّ أَنْ أُرْضِيَهُ بِأَفْضَلَ مِنْهَا فَأَبَى أَنْ يَأْكُلَ مِنْهَا وَأَمَرَ بِالطَّعَامِ لِلْأُسَارَى قَالَ الشَّيْخُ وَهَذَا؛ لِأَنَّهُ كَانَ يَخْشَى عَلَيْهِ الْفَسَادَ وَصَاحِبُهَا كَانَ غَائِبًا فَرَأَى مِنَ الْمَصْلَحَةِ أَنْ يُطْعِمَهَا الْأُسَارَى وَاللهُ أَعْلَمُ ثُمَّ يَضْمَنُ لِصَاحِبِهَا
[Machine] About the jurists from the people of Al-Madina, they used to consider in every Livestock, whether the value of the Livestock is intact or injured, and anything that the Livestock is inflicted with is treated accordingly. Isa ibn Minaa said, as for the wounds of a slave, they consider the wounds of a slave to be valued according to the value of the slave on the day he was injured, just as the wounds of a free person are valued according to his blood money.
عَنِ الْفُقَهَاءِ مِنْ أَهْلِ الْمَدِينَةِ أَنَّهُمْ كَانُوا يَجْعَلُونَ فِي كُلِّ بَهِيمَةٍ أُصِيبَتْ مَا بَيْنَ قِيمَةِ الْبَهِيمَةِ صَحِيحَةِ الْعَيْنِ وَمُصَابَةِ الْعَيْنِ وَكُلُّ مَا أُصِيبَ مِنَ الْبَهِيمَةِ فَعَلَى قَدْرِ ذَلِكَ قَالَ عِيسَى بْنُ مِينَاءٍ فَأَمَّا جِرَاحُ الْعَبْدِ فَإِنَّهُمْ يَجْعَلُونَ جِرَاحَ الْعَبْدِ تَجْرِي جِرَاحُهُ كُلُّهَا فِي قِيمَتِهِ يَوْمَ يُصَابُ كَمَا تَجْرِي جِرَاحُ الْحُرِّ فِي دِيَتِهِ
[Machine] "He (Umar) wrote to him (Shuraih) about it, and it was also narrated by Jabir Al-Ju'fi, who is weak, from Al-Shabi from Shuraih that Umar wrote to him about it. And Mujalid narrated it from Al-Shabi, he said Umar wrote to Shuraih and it was disconnected."
أَنَّهُ كَتَبَ بِهِ إِلَى شُرَيْحٍ وَهُوَ أَيْضًا مُنْقَطِعٌ وَرَوَاهُ جَابِرٌ الْجُعْفِيُّ وَهُوَ ضَعِيفٌ عَنِ الشَّعْبِيِّ عَنْ شُرَيْحٍ أَنَّ عُمَرَ ؓ كَتَبَ إِلَيْهِ بِذَلِكَ ورَوَاهُ مُجَالِدٌ عَنِ الشَّعْبِيِّ قَالَ كَتَبَ عُمَرُ ؓ إِلَى شُرَيْحٍ وَهُوَ مُنْقَطِعٌ
24.6 [Machine] The tightening of land expropriation and its inclusion by force
٢٤۔٦ بَابُ التَّشْدِيدِ فِي غَصْبِ الْأَرَاضِي وَتَضْمِينِهَا بِالْغَصْبِ
Messenger of Allah ﷺ said, "Whoever usurps the land of somebody unjustly, his neck will be encircled with it down the seven earths (on the Day of Resurrection). " (Using translation from Bukhārī 2452)
سَمِعْتُ النَّبِيَّ ﷺ يَقُولُ مَنْ ظَلَمَ مِنَ الْأَرْضِ شَيْئًا فَإِنَّهُ يُطَوَّقُهُ مِنْ سَبْعِ أَرَضِينَ
He who wrongly took a span of land, Allah shall make him carry around his neck seven earths. (Using translation from Muslim 1610a)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنِ اقْتَطَعَ شِبْرًا مِنَ الْأَرْضِ ظُلْمًا طَوَّقَهُ اللهُ يَوْمَ الْقِيَامَةِ مِنْ سَبْعِ أَرَضِينَ
How could I take a part of her land, after what I heard from Messenger of Allah (may peace be upon'him)? He (Marwan) said: What did you hear from Messenger of Allah ﷺ? He said: I heard Messenger of Allah ﷺ say: He who wrongly took a span of land would be made to wear around his neck seven earths. Marwan said: I do not ask any evidence from you after this. He (Sa'id) said: O Allah, make her blind if she has told a lie and kill her in her own land. He (the narrator) said: She did not die until she had lost her eyesight, and (one day) as she was walking in her land, she fell down into a pit and died. (Using translation from Muslim 1610c)
سَعِيدٌ أَنَا كُنْتُ آخُذُ مِنْ أَرْضِهَا شَيْئًا بَعْدَ الَّذِي سَمِعْتُ مِنْ رَسُولِ اللهِ ﷺ فَقَالَ وَمَاذَا سَمِعْتَ مِنْ رَسُولِ اللهِ ﷺ؟ قَالَ سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ أَخَذَ شِبْرًا مِنَ الْأَرْضِ يَعْنِي ظُلْمًا طُوِّقَهُ إِلَى سَبْعِ أَرَضِينَ فَقَالَ لَهُ مَرْوَانُ لَا أَسْأَلُكَ بَيِّنَةً بَعْدَ هَذَا قَالَ اللهُمَّ إِنْ كَانَتْ كَاذِبَةً فَأَعْمِ بَصَرَهَا وَاقْتُلْهَا فِي أَرْضِهَا قَالَ فَمَا مَاتَتْ حَتَّى ذَهَبَ بَصَرُهَا فَبَيْنَا هِيَ تَمْشِي فِي أَرْضِهَا إِذْ وَقَعَتْ فِي حُفْرَةٍ فَمَاتَتْ
I heard Allah's Apostle ﷺ say: He who took a span of earth wrongly would be made to wear around his neck seven earths on the Day of Resurrection. (Using translation from Muslim 1610d)
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ ظَلَمَ قِيدَ شِبْرٍ مِنْ أَرْضٍ طُوِّقَهُ يَوْمَ الْقِيَامَةِ مِنْ سَبْعِ أَرَضِينَ
[Machine] The Messenger of Allah ﷺ said, "Whoever oppresses even to the extent of a hand span on the earth, his neck will be encircled by seven earths on the Day of Resurrection."
رَسُولَ اللهِ ﷺ قَالَ مَنْ ظَلَمَ قِيدَ شِبْرٍ مِنَ الْأَرْضِ طُوِّقَهُ مِنْ سَبْعِ أَرَضِينَ يَوْمَ الْقِيَامَةِ
[Machine] The Prophet ﷺ said: "Whoever takes a span of land unjustly will be surrounded by it from seven lands."
أَنَّ النَّبِيَّ ﷺ قَالَ مَنْ أَخَذَ شِبْرًا مِنَ الْأَرْضِ بِغَيْرِ حَقِّهِ طُوِّقَهُ مِنْ سَبْعِ أَرَضِينَ
I was in the company of 'Ali b. Abi Talib, when a person came to him, and said: What was it that Allah's Apostle ﷺ told you in secret? Thereupon he (liadrat 'All) was enraged and said: Allah's Apostle ﷺ did not tell me anything in secret that he hid from people, except that he told me four things. He said: Com- mader of Faithful, what are these? He said: Allah cursed him who cursed his father; Allah cursed him who sacrificed for anyone besides Allah; and Allah cursed him who accommodates an innovator (in religion) ; and Allah cursed him who changed the minarets (the boundary lines) of the land. مَا كَانَ النَّبِيُّ ﷺ يُسِرُّ إِلَيْكَ؟ قَالَ فَغَضِبَ وَقَالَ مَا كَانَ النَّبِيُّ ﷺ يُسِرُّ إِلِيَّ شَيْئًا كَتَمَهُ النَّاسَ غَيْرَ أَنَّهُ حَدَّثَنِي بِكَلِمَاتٍ أَرْبَعٍ قَالَ فَقُلْتُ مَا هُنَّ يَا أَمِيرَ الْمُؤْمِنِينَ؟ قَالَ قَالَ لَعَنَ اللهُ مَنْ لَعَنَ وَالِدَهُ لَعَنَ اللهُ مَنْ ذَبَحَ لِغَيْرِ اللهِ لَعَنَ اللهُ مَنْ آوَى مُحْدِثًا لَعَنَ اللهُ مَنْ غَيَّرَ مَنَارَ الْأَرْضِ لَفْظُ حَدِيثِ أَبِي الْحَسَنِ الْخُسْرَوْجِرْدِيِّ
24.7 [Machine] While no race is inherently oppressive, there are rights.
٢٤۔٧ بَابُ لَيْسَ لِعِرْقٍ ظَالِمٍ حَقٌّ
The Prophet ﷺ said: If anyone brings barren land into cultivation, it belongs to him, and the unjust vein has no right. (Using translation from Abū Dāʾūd 3073)
عَنِ النَّبِيِّ ﷺ قَالَ مَنْ أَحْيَا أَرْضًا مَيْتَةً فَهِيَ لَهُ وَلَيْسَ لِعِرْقٍ ظَالِمٍ حَقٌّ
[Machine] The Messenger of Allah ﷺ said, "Whoever revives a dead land, it belongs to him and the rightful owner has no right to it." Two men from Bani Zahir came to the Messenger of Allah ﷺ arguing about a date palm tree that one of them had planted in the other's land. The Messenger of Allah ﷺ ruled in favor of the owner of the land, ordering the owner of the date palm tree to remove it. Urwah said, "The one who informed me of this incident told me that he saw the date palm tree and it was beaten with shoes (in frustration). It was a fully grown date palm tree until it produced 11540 dates." Abu Sa'id narrated to us, Abu Al-Abbas narrated to us, Al-Hasan narrated to us, Yahya ibn Adam narrated to us, Abu Shihab narrated to us from Muhammad ibn Ishaq, mentioning it in a similar meaning, except that he said, "Indeed, the person who informed me of this incident said that he saw two men from Bani Zahir arguing, and he mentioned it (number 11541). Abu Ali Al-Roudhbari informed us, Muhammad ibn Bakr narrated to us, Abu Dawud narrated to us, Ahmad ibn Saeed Al-Darimi narrated to us, Wahb narrated to us from his father, from Ibn Ishaq with the same meaning, except that when he mentioned the person who informed him of this said, "A man from the companions of the Prophet ﷺ, and I presume it is Abu Sa'id Al-Khudri, for I saw the man hitting the base of the date palm tree."
قَالَ رَسُولُ اللهِ ﷺ مَنْ أَحْيَا أَرْضًا مَيْتَةً فَهِيَ لَهُ وَلَيْسَ لِعِرْقٍ ظَالِمٍ حَقٌّ قَالَ فَاخْتَصَمَ رَجُلَانِ مِنْ بَيَاضَةَ إِلَى رَسُولِ اللهِ ﷺ غَرَسَ أَحَدُهُمَا نَخْلًا فِي أَرْضِ الْآخَرِ فَقَضَى رَسُولُ اللهِ ﷺ لِصَاحِبِ الْأَرْضِ بِأَرْضِهِ وَأَمَرَ صَاحِبَ النَّخْلِ أَنْ يُخْرِجَ نَخْلَهُ مِنْهَا قَالَ قَالَ عُرْوَةُ فَلَقَدْ أَخْبَرَنِي الَّذِي حَدَّثَنِي قَالَ رَأَيْتُهَا وَإِنَّهُ لِيُضْرَبُ فِي أُصُولِهَا بِالْفُئُوسِ وَإِنَّهُ لَنَخْلٌ عُمٌّ حَتَّى أَخْرَجَتْ 11540 وَأَخْبَرَنَا أَبُو سَعِيدٍ ثنا أَبُو الْعَبَّاسِ ثنا الْحَسَنُ ثنا يَحْيَى بْنُ آدَمَ ثنا أَبُو شِهَابٍ عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ فَذَكَرَهُ بِمَعْنَاهُ إِلَّا أَنَّهُ قَالَ فَلَقَدْ حَدَّثَنِي صَاحِبُ هَذَا الْحَدِيثِ أَنَّهُ أَبْصَرَ رَجُلَيْنِ مِنْ بَيَاضَةَ يَخْتَصِمَانِ فَذَكَرَهُ 11541 وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ مُحَمَّدُ بْنُ بَكْرٍ ثنا أَبُو دَاوُدَ ثنا أَحْمَدُ بْنُ سَعِيدٍ الدَّارِمِيُّ ثنا وَهْبٌ عَنْ أَبِيهِ عَنِ ابْنِ إِسْحَاقَ بِإِسْنَادِهِ وَمَعْنَاهُ إِلَّا أَنَّهُ قَالَ عِنْدَ قَوْلِهِ مَكَانَ الَّذِي حَدَّثَنِي هَذَا فَقَالَ رَجُلٌ مِنْ أَصْحَابِ النَّبِيِّ ﷺ وَأَكْبَرُ ظَنِّي أَنَّهُ أَبُو سَعِيدٍ الْخُدْرِيُّ فَأَنَا رَأَيْتُ الرَّجُلَ يَضْرِبُ فِي أُصُولِ النَّخْلِ
24.8 [Machine] Whoever takes something forcefully and puts it in a ship or builds a wall upon it, the saying of Samurah bin Jundub about the Prophet ﷺ has passed: "Whatever is taken by force must be returned.
٢٤۔٨ بَابُ مَنْ غَصَبَ لَوْحًا فَأَدْخَلَهُ فِي سَفِينَةٍ أَوْ بَنَى عَلَيْهِ جِدَارًا قَدْ مَضَى حَدِيثُ سَمُرَةَ بْنِ جُنْدُبٍ عَنِ النَّبِيِّ ﷺ: " عَلَى الْيَدِ مَا أَخَذَتْ حَتَّى تُؤَدِّيَهُ "
[Machine] The Messenger of Allah ﷺ said: "It is not permissible for a person to take the stick of his brother except with his consent, and this is due to the severity of what Allah has forbidden. The property of a Muslim is forbidden to another Muslim. Abdul-Rahman ibn Sa'd ibn Malik is the servant of Sa'd ibn Malik, who is Abu Said Al-Khudri. Abu Bakr ibn Abi Uwais narrated it from Sulaiman, and Abdul-Rahman ibn Sa'id narrated it and Abdul-Malik ibn Al-Hasan narrated it from Abdul-Rahman ibn Abi Said, who narrated it from Umara ibn Harithah Al-Damri, who narrated it from Amr ibn Yathribi, with the same wording that was mentioned. In what we were informed, Abu Abdullah Al-Hafiz informed us that Al-Hasan ibn Muhammad ibn Ishaq narrated to us, and Muhammad ibn Ahmed ibn Al-Bara narrated to us, he said: Ali ibn Al-Madini said: I have the hadith of Suhail with me."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا يَحِلُّ لِامْرِئٍ أَنْ يَأْخُذَ عَصَا أَخِيهِ بِغَيْرِ طِيبِ نَفْسِهِ وَذَلِكَ لِشِدَّةِ مَا حَرَّمَ اللهُ ﷻ مَالَ الْمُسْلِمِ عَلَى الْمُسْلِمِ عَبْدُ الرَّحْمَنِ هُوَ ابْنُ سَعْدِ بْنِ مَالِكٍ وَسَعْدُ بْنُ مَالِكٍ هُوَ أَبُو سَعِيدٍ الْخُدْرِيُّ وَرَوَاهُ أَبُو بَكْرِ بْنُ أَبِي أُوَيْسٍ عَنْ سُلَيْمَانَ فَقَالَ عَبْدِ الرَّحْمَنِ بْنِ سَعِيدٍ وَرَوَاهُ عَبْدُ الْمَلِكِ بْنُ الْحَسَنِ عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبِي سَعِيدٍ عَنْ عُمَارَةَ بْنِ حَارِثَةَ الضَّمْرِيِّ عَنْ عَمْرِو بْنِ يَثْرِبِيٍّ عَلَى اللَّفْظِ الَّذِي مَضَى ذِكْرُهُ 11543 وَفِيمَا أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ الْحَسَنُ بْنُ مُحَمَّدِ بْنِ إِسْحَاقَ ثنا مُحَمَّدُ بْنُ أَحْمَدَ بْنِ الْبَرَاءِ قَالَ قَالَ عَلِيُّ بْنُ الْمَدِينِيِّ الْحَدِيثُ عِنْدِي حَدِيثُ سُهَيْلٍ
[Machine] He heard the Messenger of Allah say: "None of you should take his brother's belongings as a joke or in seriousness. If any of you takes his brother's stick, let him return it to him." This is the wording of the hadith in the narration of al-Hurfi, and in the narration of Ibn Bashran from Abdullah ibn al-Sa'ib ibn Yazid from his father from his grandfather from the Prophet. He said: "None of you should take his brother's belongings as a joke or in seriousness. If any of you takes his brother's stick, let him return it to him."
أَنَّهُ سَمِعَ رَسُولَ اللهِ ﷺ يَقُولُ لَا يَأْخُذْ أَحَدُكُمْ مَتَاعَ صَاحِبِهِ لَاعِبًا وَلَا جَادًّا فَإِذَا أَخَذَ أَحَدُكُمْ عَصَا أَخِيهِ فَلْيَرُدَّهَا إِلَيْهِ لَفْظُ حَدِيثِ الْحُرْفِيِّ وَفِي رِوَايَةِ ابْنِ بِشْرَانَ عَنْ عَبْدِ اللهِ بْنِ السَّائِبِ بْنِ يَزِيدَ عَنْ أَبِيهِ عَنْ جَدِّهِ عَنِ النَّبِيِّ ﷺ قَالَ لَا يَأْخُذْ أَحَدُكُمْ مَتَاعَ أَخِيهِ لَاعِبًا وَلَا جَادًّا فَإِذَا أَخَذَ أَحَدُكُمْ عَصَا أَخِيهِ فَلْيَرُدَّهَا إِلَيْهِ
[Machine] The Messenger of Allah ﷺ said, "The wealth of a Muslim is not permissible except with his consent."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا يَحِلُّ مَالُ امْرِئٍ مُسْلِمٍ إِلَّا بِطِيبِ نَفْسٍ مِنْهُ
24.9 [Machine] Whoever forcefully seized a slave girl, then sold her, and then came the owner of the slave girl
٢٤۔٩ بَابُ مَنْ غَصَبَ جَارِيَةً فَبَاعَهَا ثُمَّ جَاءَ رَبُّ الْجَارِيَةِ
The Prophet ﷺ said: If anyone finds his very property with a man, he is more entitled to it (than anyone else), and the buyer should pursue the one who sold it. (Using translation from Abū Dāʾūd 3531)
قَالَ رَسُولُ اللهِ ﷺ مَنْ وَجَدَ مَالَهُ عِنْدَ رَجُلٍ فَهُوَ أَحَقُّ بِهِ وَيَتَّبِعُ الْبَيِّعُ مَنْ بَاعَهُ
[Machine] A man sold a slave girl belonging to his father while his father was absent. When his father returned, he refused to approve the sale as the buyer had already given birth to a child from her. They disputed the matter to Umar ibn al-Khattab, who ruled in favor of the man regarding his slave girl and ordered the buyer to take his purchase in full settlement. The father of the seller requested Umar to show mercy and spare his son. Umar then said to him, "And you, spare his son."
أَنَّ رَجُلًا بَاعَ جَارِيَةً لِأَبِيهِ وَأَبُوهُ غَائِبٌ فَلَمَّا قَدِمَ أَبَى أَبُوهُ أَنْ يُجِيزَ بَيْعَهُ وَقَدْ وَلَدَتْ مِنَ الْمُشْتَرِي فَاخْتَصَمُوا إِلَى عُمَرَ بْنِ الْخَطَّابِ فَقَضَى لِلرَّجُلِ بِجَارِيَتِهِ وَأَمَرَ الْمُشْتَرِي أَنْ يَأْخُذَ بَيِّعَهُ بِالْخَلَاصِ فَلَزِمَهُ فَقَالَ أَبُو الْبَائِعِ مُرْهُ فَلْيُخَلِّ عَنِ ابْنِي فَقَالَ لَهُ عُمَرُ ؓ وَأَنْتَ فَخَلِّ عَنِ ابْنِهِ
[Machine] About 'Amir al-Sha'bi in a man who found his servant in the hands of a man who had given birth to her, so he established the evidence that she is his servant and he established the evidence that it was bought by the man who had her. So 'Ali said, the owner of the servant takes his servant and the seller is held accountable. And Wahb reported that Sa'id narrated that Hisham reported that Isma'il ibn Salim said, "I heard al-Sha'abi saying that the transfer of ownership does not occur for someone who sells something he does not own, so it remains with its owner, and the buyer follows the seller with what he has given, and it is not upon the seller to return what he has taken or to have anything else taken from him." And we were also narrated from another source from al-Sha'bi from Shurayh that he said, "Whoever stipulates the condition of ownership transfer is foolish. Accept what you have sold or return what you have taken. Ownership does not transfer." The sheikh said, and the saying of 'Ali that the seller is held accountable means that Allah knows the price and the value of the offspring, so it agrees with the statement of those who came after him. And what we have narrated in the hadith from Samurah from the Prophet, ﷺ .
عَنْ عَامِرٍ الشَّعْبِيِّ فِي رَجُلٍ وَجَدَ جَارِيَتَهُ فِي يَدِ رَجُلٍ قَدْ وَلَدَتْ مِنْهُ فَأَقَامَ الْبَيِّنَةَ أَنَّهَا جَارِيَتُهُ وَأَقَامَ الَّذِي فِي يَدِهِ الْجَارِيَةُ الْبَيِّنَةَ أَنَّهُ اشْتَرَاهَا فَقَالَ فَقَالَ عَلِيٌّ يَأْخُذُ صَاحِبُ الْجَارِيَةِ جَارِيَتَهُ وَيُؤْخَذُ الْبَائِعُ بِالْخَلَاصِ 11548 وَقَالَ وَحَدَّثَنَا سَعِيدٌ ثنا هُشَيْمٌ أنبأ إِسْمَاعِيلُ بْنُ سَالِمٍ قَالَ سَمِعْتُ الشَّعْبِيَّ يَقُولُ لَيْسَ الْخَلَاصُ بِشَيْءٍ مَنْ بَاعَ مَا لَا يَمْلِكُ فَهُوَ لِصَاحِبِهِ وَيَتَّبِعُ الْمُشْتَرِي الْبَائِعَ بِمَا أَعْطَاهُ وَلَيْسَ عَلَى الْبَائِعِ أَكْثَرُ مِنْ أَنْ يَرُدَّ مَا أَخَذَ وَلَا يُؤْخَذُ بِغَيْرِهِ وَرُوِّينَا مِنْ وَجْهٍ آخَرَ عَنِ الشَّعْبِيِّ عَنْ شُرَيْحٍ أَنَّهُ قَالَ مَنْ شَرَطَ الْخَلَاصَ فَهُوَ أَحْمَقُ سَلِّمْ مَا بِعْتَ أَوْ رُدَّ مَا أَخَذْتَ لَيْسَ الْخَلَاصُ بِشَيْءٍ قَالَ الشَّيْخُ وَقَوْلُ عَلِيٍّ وَيُؤْخَذُ الْبَائِعُ بِالْخَلَاصِ يُرِيدُ وَاللهُ أَعْلَمُ بِالثَّمَنِ وَقِيمَةُ الْوَلَدِ فَيَكُونُ مُوَافِقًا لِقَوْلِ مَنْ بَعْدَهُ وَمَا رُوِّينَا فِي الْحَدِيثِ عَنْ سَمُرَةَ عَنِ النَّبِيِّ ﷺ
24.10 [Machine] Who Killed a Pig, Broke a Cross, or Destroyed a Tambourine
٢٤۔١٠ بَابُ مَنْ قَتَلَ خِنْزِيرًا أَوْ كَسَرَ صَلِيبًا أَوْ طُنْبُورًا
[Machine] The Prophet ﷺ said, "Soon, the son of Mary will descend among you as a just ruler. He will kill the swine, break the cross, abolish the jizyah, and wealth will flow abundantly to the extent that no one will accept it except for the one named 'Abdul-A'la."
النَّبِيَّ ﷺ قَالَ يُوشِكُ أَنْ يَنْزِلَ فِيكُمُ ابْنُ مَرْيَمَ حَكَمًا مُقْسِطًا فَيَقْتُلُ الْخِنْزِيرَ وَيَكْسِرُ الصَّلِيبَ وَيَضَعُ الْجِزْيَةَ وَيَفِيضُ الْمَالُ حَتَّى لَا يَقْبَلَهُ أَحَدٌ لَفْظُ عَبْدِ الْأَعْلَى
