24. Chapter
٢٤۔ كِتَابُ الْغَصْبِ
[Machine] The Messenger of Allah ﷺ addressed the people during the Farewell Hajj and mentioned in his speech, "It is not lawful for a man to take the wealth of his brother except what he willingly gives him out of good will. Do not wrong one another and do not return to disbelief after me, striking each other's necks."
أَنَّ رَسُولَ اللهِ ﷺ خَطَبَ النَّاسَ فِي حِجَّةِ الْوَدَاعِ فَذَكَرَ الْحَدِيثَ وَفِيهِ لَا يَحِلُّ لِامْرِئٍ مِنْ مَالِ أَخِيهِ إِلَّا مَا أَعْطَاهُ مِنْ طِيبِ نَفْسٍ وَلَا تَظْلِمُوا وَلَا تَرْجِعُوا بَعْدِي كُفَّارًا يَضْرِبُ بَعْضُكُمْ رِقَابَ بَعْضٍ
[Machine] I attended the sermon of the Prophet ﷺ in Mina, and in his speech he said, "It is not permissible for anyone to take anything from his brother's wealth except what his brother willingly gives. When someone heard that, he asked, 'O Messenger of Allah, what if I come across my cousin's sheep and I take a sheep from him and then slaughter it? Would I be at fault?' The Prophet ﷺ replied, 'If you come across a female sheep carrying a knife and a pulley of a caravan, do not touch it.' It was said that it is a land between Mecca and the neighbor's land, a land without any inhabitants."
شَهِدْتُ خُطْبَةَ النَّبِيِّ ﷺ بِمِنًى فَكَانَ فِيمَا خَطَبَ بِهِ قَالَ وَلَا يَحِلُّ لِأَحَدٍ مِنْ مَالِ أَخِيهِ إِلَّا مَا طَابَتْ بِهِ نَفْسُهُ فَلَمَّا سَمِعَهُ قَالَ ذَلِكَ قَالَ يَا رَسُولَ اللهِ أَرَأَيْتَ لَوْ لَقِيتُ غَنَمَ ابْنِ عَمِّي فَأَخَذْتُ مِنْهُ شَاةً فَاجْتَزَرْتُهَا فَعَلَيَّ فِي ذَلِكَ شَيْءٌ؟ قَالَ إِنْ لَقِيتَهَا نَعْجَةً تَحْمِلُ شَفْرَةً وَزِنَادًا بِخَبْتِ الْجَمِيشِ فَلَا تَمَسَّهَا قِيلَ هِيَ أَرْضٌ بَيْنَ مَكَّةَ وَالْجَارِ أَرْضٌ لَيْسَ بِهَا أَنِيسٌ
[Machine] Narrated Ibn 'Umar: The Prophet ﷺ mentioned the sermon during the middle days of Tashriq in his Hajj and said, "O people! Whoever has entrusted something precious to him, he should return it to the one who entrusted him. O people! Verily, no one has the right to take anything from his brother's wealth except what is pleasing to himself."
عَنِ ابْنِ عُمَرَ فَذَكَرَ الْحَدِيثَ فِي خُطْبَةِ النَّبِيِّ ﷺ وَسَطَ أَيَّامِ التَّشْرِيقِ فِي حَجَّتِهِ وَقَالَ فِيهَا أَيُّهَا النَّاسُ مَنْ كَانَتْ عِنْدَهُ وَدِيعَةٌ فَلْيَرُدَّهَا إِلَى مَنِ ائْتَمَنَهُ عَلَيْهَا أَيُّهَا النَّاسُ إِنَّهُ لَا يَحِلُّ لِامْرِئٍ مِنْ مَالِ أَخِيهِ شَيْءٌ إِلَّا مَا طَابَتْ بِهِ نَفْسُهُ
Abu Bakr had a slave who used to give him some of his earnings. Abu Bakr used to eat from it. One day he brought something and Abu Bakr ate from it. The slave said to him, "Do you know what this is?" Abu Bakr then enquired, "What is it?" The slave said, "Once, in the pre-Islamic period of ignorance I foretold somebody's future though I did not know this knowledge of foretelling but I, cheated him, and when he met me, he gave me something for that service, and that is what you have eaten from." Then Abu Bakr put his hand in his mouth and vomited whatever was present in his stomach. (Using translation from Bukhārī 3842)
كَانَ لِأَبِي بَكْرٍ ؓ غُلَامٌ يُخْرِجُ لَهُ الْخَرَاجَ وَكَانَ أَبُو بَكْرٍ ؓ يَأْكُلُ مِنْ خَرَاجِهِ فَجَاءَ يَوْمًا بِشَيْءٍ فَأَكَلَ مِنْهُ أَبُو بَكْرٍ ؓ فَقَالَ لَهُ الْغُلَامُ أَتَدْرِي مَا هَذَا؟ فَقَالَ أَبُو بَكْرٍ ؓ وَمَا هُوَ؟ قَالَ كُنْتُ تَكَهَّنْتُ لِإِنْسَانٍ فِي الْجَاهِلِيَّةِ وَمَا أُحْسِنُ الْكِهَانَةَ إِلَّا أَنِّي خَدَعْتُهُ فَلَقِيَنِي فَأَعْطَانِي بِذَلِكَ فَهَذَا الَّذِي أَكَلْتَ مِنْهُ فَأَدْخَلَ أَبُو بَكْرٍ ؓ يَدَهُ فَقَاءَ كُلَّ شَيْءٍ فِي بَطْنِهِ لَفْظُ حَدِيثِهِمَا سَوَاءٌ وَإِنَّمَا الِاخْتِلَافُ فِي الْإِسْنَادِ
[Machine] A Muslim woman from the Quraysh made food for the Messenger of Allah and invited him and his companions. He said, "Then my father took me with him and we sat among the gatherings of the children of their fathers. They did not eat until they saw the Messenger of Allah eating. When the Messenger of Allah took a morsel, he threw it away and said, 'I find the taste of a slaughtered sheep without the permission of its owner in it.' She said, 'O Messenger of Allah, my brother and I are among the dearest people to him, and if there was something better than it, he would not have given me anything else. So, he refused to eat from it and ordered the food to be given to the prisoners.' The old man added, 'and this (means) because he feared corruption, and her companion was absent, so he thought it was beneficial to feed the prisoners.' And Allah knows best. Then he guaranteed (the punishment for) her companion."
صَنَعَتِ امْرَأَةٌ مِنَ الْمُسْلِمِينَ مِنْ قُرَيْشٍ لِرَسُولِ اللهِ ﷺ طَعَامًا فَدَعَتْهُ وَأَصْحَابَهُ قَالَ فَذَهَبَ بِي أَبِي مَعَهُ قَالَ فَجَلَسْنَا بَيْنَ يَدَيْ آبَائِنَا مَجَالِسَ الْأَبْنَاءِ مِنْ آبَائِهِمْ قَالَ فَلَمْ يَأْكُلُوا حَتَّى رَأَوْا رَسُولَ اللهِ ﷺ أَكَلَ فَلَمَّا أَخَذَ رَسُولُ اللهِ ﷺ لُقْمَةً رَمَى بِهَا ثُمَّ قَالَ إِنِّي لَأَجِدُ طَعْمَ لَحْمِ شَاةٍ ذُبِحَتْ بِغَيْرِ إِذْنِ صَاحِبِهَا فَقَالَتْ يَا رَسُولَ اللهِ أَخِي وَأَنَا مِنْ أَعَزِّ النَّاسِ عَلَيْهِ وَلَوْ كَانَ خَيْرًا مِنْهَا لَمْ يُغَيِّرْ عَلَيَّ وَعَلَيَّ أَنْ أُرْضِيَهُ بِأَفْضَلَ مِنْهَا فَأَبَى أَنْ يَأْكُلَ مِنْهَا وَأَمَرَ بِالطَّعَامِ لِلْأُسَارَى قَالَ الشَّيْخُ وَهَذَا؛ لِأَنَّهُ كَانَ يَخْشَى عَلَيْهِ الْفَسَادَ وَصَاحِبُهَا كَانَ غَائِبًا فَرَأَى مِنَ الْمَصْلَحَةِ أَنْ يُطْعِمَهَا الْأُسَارَى وَاللهُ أَعْلَمُ ثُمَّ يَضْمَنُ لِصَاحِبِهَا
[Machine] About the jurists from the people of Al-Madina, they used to consider in every Livestock, whether the value of the Livestock is intact or injured, and anything that the Livestock is inflicted with is treated accordingly. Isa ibn Minaa said, as for the wounds of a slave, they consider the wounds of a slave to be valued according to the value of the slave on the day he was injured, just as the wounds of a free person are valued according to his blood money.
عَنِ الْفُقَهَاءِ مِنْ أَهْلِ الْمَدِينَةِ أَنَّهُمْ كَانُوا يَجْعَلُونَ فِي كُلِّ بَهِيمَةٍ أُصِيبَتْ مَا بَيْنَ قِيمَةِ الْبَهِيمَةِ صَحِيحَةِ الْعَيْنِ وَمُصَابَةِ الْعَيْنِ وَكُلُّ مَا أُصِيبَ مِنَ الْبَهِيمَةِ فَعَلَى قَدْرِ ذَلِكَ قَالَ عِيسَى بْنُ مِينَاءٍ فَأَمَّا جِرَاحُ الْعَبْدِ فَإِنَّهُمْ يَجْعَلُونَ جِرَاحَ الْعَبْدِ تَجْرِي جِرَاحُهُ كُلُّهَا فِي قِيمَتِهِ يَوْمَ يُصَابُ كَمَا تَجْرِي جِرَاحُ الْحُرِّ فِي دِيَتِهِ
[Machine] "He (Umar) wrote to him (Shuraih) about it, and it was also narrated by Jabir Al-Ju'fi, who is weak, from Al-Shabi from Shuraih that Umar wrote to him about it. And Mujalid narrated it from Al-Shabi, he said Umar wrote to Shuraih and it was disconnected."
أَنَّهُ كَتَبَ بِهِ إِلَى شُرَيْحٍ وَهُوَ أَيْضًا مُنْقَطِعٌ وَرَوَاهُ جَابِرٌ الْجُعْفِيُّ وَهُوَ ضَعِيفٌ عَنِ الشَّعْبِيِّ عَنْ شُرَيْحٍ أَنَّ عُمَرَ ؓ كَتَبَ إِلَيْهِ بِذَلِكَ ورَوَاهُ مُجَالِدٌ عَنِ الشَّعْبِيِّ قَالَ كَتَبَ عُمَرُ ؓ إِلَى شُرَيْحٍ وَهُوَ مُنْقَطِعٌ
