24. Chapter
٢٤۔ كِتَابُ الْغَصْبِ
The Prophet ﷺ said: If anyone finds his very property with a man, he is more entitled to it (than anyone else), and the buyer should pursue the one who sold it. (Using translation from Abū Dāʾūd 3531)
قَالَ رَسُولُ اللهِ ﷺ مَنْ وَجَدَ مَالَهُ عِنْدَ رَجُلٍ فَهُوَ أَحَقُّ بِهِ وَيَتَّبِعُ الْبَيِّعُ مَنْ بَاعَهُ
[Machine] A man sold a slave girl belonging to his father while his father was absent. When his father returned, he refused to approve the sale as the buyer had already given birth to a child from her. They disputed the matter to Umar ibn al-Khattab, who ruled in favor of the man regarding his slave girl and ordered the buyer to take his purchase in full settlement. The father of the seller requested Umar to show mercy and spare his son. Umar then said to him, "And you, spare his son."
أَنَّ رَجُلًا بَاعَ جَارِيَةً لِأَبِيهِ وَأَبُوهُ غَائِبٌ فَلَمَّا قَدِمَ أَبَى أَبُوهُ أَنْ يُجِيزَ بَيْعَهُ وَقَدْ وَلَدَتْ مِنَ الْمُشْتَرِي فَاخْتَصَمُوا إِلَى عُمَرَ بْنِ الْخَطَّابِ فَقَضَى لِلرَّجُلِ بِجَارِيَتِهِ وَأَمَرَ الْمُشْتَرِي أَنْ يَأْخُذَ بَيِّعَهُ بِالْخَلَاصِ فَلَزِمَهُ فَقَالَ أَبُو الْبَائِعِ مُرْهُ فَلْيُخَلِّ عَنِ ابْنِي فَقَالَ لَهُ عُمَرُ ؓ وَأَنْتَ فَخَلِّ عَنِ ابْنِهِ
[Machine] About 'Amir al-Sha'bi in a man who found his servant in the hands of a man who had given birth to her, so he established the evidence that she is his servant and he established the evidence that it was bought by the man who had her. So 'Ali said, the owner of the servant takes his servant and the seller is held accountable. And Wahb reported that Sa'id narrated that Hisham reported that Isma'il ibn Salim said, "I heard al-Sha'abi saying that the transfer of ownership does not occur for someone who sells something he does not own, so it remains with its owner, and the buyer follows the seller with what he has given, and it is not upon the seller to return what he has taken or to have anything else taken from him." And we were also narrated from another source from al-Sha'bi from Shurayh that he said, "Whoever stipulates the condition of ownership transfer is foolish. Accept what you have sold or return what you have taken. Ownership does not transfer." The sheikh said, and the saying of 'Ali that the seller is held accountable means that Allah knows the price and the value of the offspring, so it agrees with the statement of those who came after him. And what we have narrated in the hadith from Samurah from the Prophet, ﷺ .
عَنْ عَامِرٍ الشَّعْبِيِّ فِي رَجُلٍ وَجَدَ جَارِيَتَهُ فِي يَدِ رَجُلٍ قَدْ وَلَدَتْ مِنْهُ فَأَقَامَ الْبَيِّنَةَ أَنَّهَا جَارِيَتُهُ وَأَقَامَ الَّذِي فِي يَدِهِ الْجَارِيَةُ الْبَيِّنَةَ أَنَّهُ اشْتَرَاهَا فَقَالَ فَقَالَ عَلِيٌّ يَأْخُذُ صَاحِبُ الْجَارِيَةِ جَارِيَتَهُ وَيُؤْخَذُ الْبَائِعُ بِالْخَلَاصِ 11548 وَقَالَ وَحَدَّثَنَا سَعِيدٌ ثنا هُشَيْمٌ أنبأ إِسْمَاعِيلُ بْنُ سَالِمٍ قَالَ سَمِعْتُ الشَّعْبِيَّ يَقُولُ لَيْسَ الْخَلَاصُ بِشَيْءٍ مَنْ بَاعَ مَا لَا يَمْلِكُ فَهُوَ لِصَاحِبِهِ وَيَتَّبِعُ الْمُشْتَرِي الْبَائِعَ بِمَا أَعْطَاهُ وَلَيْسَ عَلَى الْبَائِعِ أَكْثَرُ مِنْ أَنْ يَرُدَّ مَا أَخَذَ وَلَا يُؤْخَذُ بِغَيْرِهِ وَرُوِّينَا مِنْ وَجْهٍ آخَرَ عَنِ الشَّعْبِيِّ عَنْ شُرَيْحٍ أَنَّهُ قَالَ مَنْ شَرَطَ الْخَلَاصَ فَهُوَ أَحْمَقُ سَلِّمْ مَا بِعْتَ أَوْ رُدَّ مَا أَخَذْتَ لَيْسَ الْخَلَاصُ بِشَيْءٍ قَالَ الشَّيْخُ وَقَوْلُ عَلِيٍّ وَيُؤْخَذُ الْبَائِعُ بِالْخَلَاصِ يُرِيدُ وَاللهُ أَعْلَمُ بِالثَّمَنِ وَقِيمَةُ الْوَلَدِ فَيَكُونُ مُوَافِقًا لِقَوْلِ مَنْ بَعْدَهُ وَمَا رُوِّينَا فِي الْحَدِيثِ عَنْ سَمُرَةَ عَنِ النَّبِيِّ ﷺ
