23. Chapter
٢٣۔ كِتَابُ الْعَارِيَةِ
[Machine] Abdullah said, "Every good deed is a form of charity. We used to count the good deeds during the time of the Messenger of Allah ﷺ such as giving in measures and weights and similar acts. Abu Al-Hassan Ibn Abdan informed us that Ahmad Ibn Ubayd reported to us that Ismail Ibn Al-Fadl Al-Saffar told us that Qutaybah narrated to us that Abu Awanah mentioned it with the same wording except that he said, 'We used to count the acts of assistance during the time of the Messenger of Allah ﷺ such as giving in measures and weights and similar acts.'"
قَالَ عَبْدُ اللهِ كُلُّ مَعْرُوفٍ صَدَقَةٌ وَكُنَّا نَعُدُّ الْمَعْرُوفَ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ الْقِدْرَ وَالدَّلْوَ وَأَشْبَاهَ ذَلِكَ 11468 وَأَخْبَرَنَا أَبُو الْحَسَنِ بْنُ عَبْدَانَ أنبأ أَحْمَدُ بْنُ عُبَيْدٍ ثنا إِسْمَاعِيلُ بْنُ الْفَضْلِ الصَّفَّارُ ثنا قُتَيْبَةُ ثنا أَبُو عَوَانَةَ فَذَكَرَهُ بِمِثْلِهِ إِلَّا أَنَّهُ قَالَ وَكُنَّا نَعُدُّ الْمَاعُونَ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ الْقِدْرَ وَالدَّلْوَ وَكَذَلِكَ
[Machine] In his saying, "He is the one who withholds a helping hand" [Al-Ma'un 7], he said it means holding back an axe, a bucket, a pot, and the like.
فِي قَوْلِهِ {الْمَاعُونَ} [الماعون 7] قَالَ هُوَ مَنْعُ الْفَأْسِ وَالدَّلْوِ وَالْقِدْرِ وَنَحْوِهَا
عَارِيَةُ الْمَتَاعِ
[Machine] Al-Ma'oon is the axe, the pot, and the bucket. I said, "So who prevents this (charity)? For him is the woe." He said, "No, but woe to him who collects them (wealth) and turns away from them, and woe to him who prohibits this (charity)."
الْمَاعُونُ الْفَأْسُ وَالْقِدْرُ وَالدَّلْوُ قُلْتُ فَمَنْ مَنَعَ هَذَا فَلَهُ الْوَيْلُ؟ قَالَ لَا وَلَكِنْ مَنْ جَمَعَهُنَّ فَلَهُ الْوَيْلُ مَنْ رَايَا فِي صَلَاتِهِ وَسَهَا عَنْهَا وَمَنَعَ هَذَا فَلَهُ الْوَيْلُ
Once the people of Medina were frightened, so the Prophet ﷺ borrowed a horse from Abu Talha called Al-Mandub, and rode it. When he came back he said, "We have not seen anything (to be afraid of), but the horse was very fast (having an energy as inexhaustible as the water of the sea). (Using translation from Bukhārī 2627)
سَمِعْتُ أَنَسَ بْنَ مَالِكٍ يَقُولُ كَانَ فَزَعٌ بِالْمَدِينَةِ فَاسْتَعَارَ رَسُولُ اللهِ ﷺ فَرَسًا مِنْ أَبِي طَلْحَةَ يُقَالُ لَهُ الْمَنْدُوبُ فَرَكِبَهُ فَلَمَّا رَجَعَ قَالَ مَا رَأَيْنَا مِنْ شَيْءٍ وَإِنْ وَجَدْنَاهُ لَبَحْرًا
I went to ʿAisha and she was wearing a coarse dress costing five Dirhams. ʿAisha said, "Look up and see my slave-girl who refuses to wear it in the house though during the lifetime of Messenger of Allah ﷺ I had a similar dress which no woman desiring to appear elegant (before her husband) failed to borrow from me." دَخَلْتُ عَلَى عَائِشَةَ وَعِنْدَهَا جَارِيَةٌ لَهَا عَلَيْهَا دِرْعُ قُطْنٍ ثَمَنُهُ خَمْسَةُ دَرَاهِمَ قَالَتْ ارْفَعْ بَصَرَكَ إِلَى جَارِيَتِي انْظُرْ إِلَيْهَا؛ فَإِنَّهَا تُزْهَى عَلَى أَنْ تَلْبَسَهُ فِي الْبَيْتِ وَقَدْ كَانَ لِي مِنْهُنَّ دِرْعٌ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ مَا كَانَتِ امْرَأَةٌ تُقَيَّنُ بِالْمَدِينَةِ إِلَّا أَرْسَلَتْ إِلِيَّ تَسْتَعِيرُهُ
23.2 [Machine] The naked is simulated
٢٣۔٢ بَابُ الْعَارِيَةُ مُؤَدَّاةٌ
[Machine] The Messenger of Allah ﷺ said, "Debt must be fulfilled, shame must be returned, favor must be reciprocated, and leadership is a cause for deprivation."
قَالَ رَسُولُ اللهِ ﷺ الدَّيْنُ مَقْضِيٌّ وَالْعَارِيَةُ مُؤَدَّاةٌ وَالْمِنْحَةُ مَرْدُودَةٌ وَالزَّعِيمُ غَارِمٌ
[Machine] That the Messenger of Allah ﷺ borrowed armor and weapons from Safwan ibn Umayyah during the Battle of Hunayn. Safwan asked, "O Messenger of Allah, are you borrowing them as a loan?" He replied, "Yes, I am borrowing them as a loan."
أَنَّ رَسُولَ اللهِ ﷺ اسْتَعَارَ مِنْ صَفْوَانَ بْنِ أُمَيَّةَ أَدْرَاعًا وَسِلَاحًا فِي غَزْوَةِ حُنَيْنٍ فَقَالَ يَا رَسُولَ اللهِ أَعَارِيَةٌ مُؤَدَّاةٌ؟ قَالَ عَارِيَةٌ مُؤَدَّاةٌ
[Machine] A people embraced Islam, and they had in their hands spoils from the polytheists. They said, "Islam has made us secure from the spoils that were in the hands of the polytheists." The Messenger of Allah ﷺ was informed of this, so he said, "Indeed, Islam does not make lawful for you that which is not rightfully yours. The spoils must be returned." So, the people returned what they had from those spoils. Ali said, "This is a command (from Allah), do not argue against it."
أَسْلَمَ قَوْمٌ فِي أَيْدِيهِمْ عَوَارِي مِنَ الْمُشْرِكِينَ فَقَالُوا قَدْ أَحْرَزَ لَنَا الْإِسْلَامُ مَا بِأَيْدِينَا مِنْ عَوَارِي الْمُشْرِكِينَ فَبَلَغَ ذَلِكَ رَسُولَ اللهِ ﷺ فَقَالَ إِنَّ الْإِسْلَامَ لَا يُحْرِزُ لَكُمْ مَا لَيْسَ لَكُمْ الْعَارِيَةُ مُؤَدَّاةٌ فَأَدَّى الْقَوْمُ مَا بِأَيْدِيهِمْ مِنْ تِلْكَ الْعَوَارِي قَالَ عَلِيٌّ هَذَا مُرْسَلٌ وَلَا تَقُومُ بِهِ حُجَّةٌ
23.3 [Machine] The heading "الْعَارِيَةُ مَضْمُونَةٌ" translates to "Guaranteed Revelation" in English.
٢٣۔٣ بَابُ الْعَارِيَةُ مَضْمُونَةٌ
[Machine] The Messenger of Allah ﷺ traveled to Hunayn and mentioned the Hadith in it. Then the Messenger of Allah ﷺ sent to Safwan ibn Umayyah and asked him for a hundred shields and whatever can be repaired from their equipment. He said, "Do you want them by force, O Muhammad?" He replied, "No, they are loans that we will return to you." Then the Messenger of Allah ﷺ went out, continuing on his journey.
أَنَّ رَسُولَ اللهِ ﷺ سَارَ إِلَى حُنَيْنٍ فَذَكَرَ الْحَدِيثَ وَفِيهِ ثُمَّ بَعَثَ رَسُولُ اللهِ ﷺ إِلَى صَفْوَانَ بْنِ أُمَيَّةَ فَسَأَلَهُ أَدْرَاعًا عِنْدَهُ مِائَةَ دِرْعٍ وَمَا يُصْلِحُهَا مِنْ عُدَّتِهَا فَقَالَ أَغَصْبًا يَا مُحَمَّدُ؟ فَقَالَ بَلْ عَارِيَةٌ مَضْمُونَةٌ حَتَّى نُؤَدِّيَهَا عَلَيْكَ ثُمَّ خَرَجَ رَسُولُ اللهِ ﷺ سَائِرًا
[Machine] The Prophet ﷺ borrowed some armor from someone on the day of Hunayn, and the person asked, "Do you want to take it forcibly, O Muhammad?" The Prophet replied, "No, rather I want to use it carefully."
أَنَّ النَّبِيَّ ﷺ اسْتَعَارَ مِنْهُ أَدْرَاعًا يَوْمَ حُنَيْنٍ فَقَالَ أَغَصْبٌ يَا مُحَمَّدُ؟ فَقَالَ لَا بَلْ عَارِيَةٌ مَضْمُونَةٌ
[Machine] From some people of the family of Safwan bin Umayyah, they said: The Messenger of Allah ﷺ borrowed a weapon from Safwan bin Umayyah. Safwan said, "Is it borrowing or seizing?" The Messenger of Allah ﷺ replied, "It is borrowing." So he borrowed from him between thirty and forty armor. The Messenger of Allah ﷺ then participated in the Battle of Hunayn, and when Allah defeated the polytheists, the Messenger of Allah ﷺ said, "Gather the armor of Safwan." They found that some of the armor was missing. The Messenger of Allah ﷺ said to Safwan, "If you wish, we can pay for it." Safwan replied, "O Messenger of Allah, today there is in my heart a faith that was not there before." Abu Ali Ar-Ru'zbary narrated that Abu Bakr bin Dasa narrated from Abu Dawud, who narrated from Abu Bakr bin Abi Shaybah, who narrated from Jarir, who narrated from Abdul Aziz bin Rufa', who narrated from some people of the family of Abdullah bin Safwan, that the Messenger of Allah ﷺ said, "O Safwan, do you have any weapons with you?" He mentioned the significance.
عَنْ نَاسٍ مِنْ آلِ صَفْوَانَ بْنِ أُمَيَّةَ فَقَالُوا اسْتَعَارَ رَسُولُ اللهِ ﷺ مِنْ صَفْوَانَ بْنِ أُمَيَّةَ سِلَاحًا فَقَالَ صَفْوَانُ أَعَارِيَةٌ أَمْ غَصْبٌ؟ فَقَالَ بَلْ عَارِيَةٌ فَأَعَارَهُ مَا بَيْنَ الثَّلَاثِينَ إِلَى أَرْبَعِينَ دِرْعًا قَالَ فَغَزَا رَسُولُ اللهِ ﷺ حُنَيْنًا فَلَمَّا هَزَمَ اللهُ الْمُشْرِكِينَ قَالَ رَسُولُ اللهِ ﷺ اجْمَعُوا أَدْرَاعَ صَفْوَانَ فَفَقَدُوا مِنْ دُرُوعِهِ أَدْرَاعًا فَقَالَ رَسُولُ اللهِ ﷺ لِصَفْوَانَ إِنْ شِئْتَ غَرَمْنَاهَا لَكَ فَقَالَ يَا رَسُولَ اللهِ إِنَّ فِي قَلْبِي الْيَوْمَ مِنَ الْإِيمَانِ مَا لَمْ يَكُنْ يَوْمَئِذٍ 11480 وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ أَبُو بَكْرِ بْنُ دَاسَةَ ثنا أَبُو دَاوُدَ ثنا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ ثنا جَرِيرٌ عَنْ عَبْدِ الْعَزِيزِ بْنِ رُفَيْعٍ عَنْ أُنَاسٍ مِنْ آلِ عَبْدِ اللهِ بْنِ صَفْوَانَ أَنَّ رَسُولَ اللهِ ﷺ قَالَ يَا صَفْوَانُ هَلْ عِنْدَكَ سِلَاحٌ؟ فَذَكَرَ مَعْنَاهُ
[Machine] That Safwan ibn Umayyah lent the Messenger of Allah ﷺ eighty shields, and he asked him, "Are they loaned to me voluntarily or by force?" The Messenger of Allah ﷺ replied, "They are truly loaned voluntarily, and some of these reports, even if they are transmitted, they are strengthened by evidence, along with what has been previously established. And Allah knows best."
أَنَّ صَفْوَانَ بْنَ أُمَيَّةَ أَعَارَ رَسُولَ اللهِ ﷺ سِلَاحًا هِيَ ثَمَانُونَ دِرْعًا فَقَالَ لَهُ أَعَارِيَةٌ مَضْمُونَةٌ أَمْ غَصْبًا؟ فَقَالَ رَسُولُ اللهِ ﷺ بَلْ عَارِيَةٌ مَضْمُونَةٌ وَبَعْضُ هَذِهِ الْأَخْبَارِ وَإِنْ كَانَ مُرْسَلًا فَإِنَّهُ يَقْوَى بِشَوَاهِدِهِ مَعَ مَا تَقَدَّمَ مِنَ الْمَوْصُولِ وَاللهُ أَعْلَمُ
The Prophet ﷺ as saying: The hand which takes is responsible till it pays. Then al-Hasan forgot and said: (If you give something on loan to a man), he is your depositor ; there is no compensation (for it) on him. (Using translation from Abū Dāʾūd 3561)
عَنِ النَّبِيِّ ﷺ قَالَ عَلَى الْيَدِ مَا أَخَذَتْ حَتَّى تُؤَدِّيَهُ ثُمَّ إِنَّ الْحَسَنَ نَسِيَ حَدِيثَهُ فَقَالَ هُوَ أَمِينُكَ لَا ضَمَانَ عَلَيْهِ
[Machine] Ibn Abbas used to guarantee the Awrah (parts of the body that should be covered) and he wrote to me to guarantee it.
كَانَ ابْنُ عَبَّاسٍ يَضْمَنُ الْعَارِيَةَ وَكَتَبَ إِلِيَّ أَنْ ضَمِّنْهَا
[Machine] The translation of the passage "يَغْرَمُ" into English is "he is infatuated/loves".

23.4 [Machine] Who said: "He will not get rich"?
٢٣۔٤ بَابُ مَنْ قَالَ: لَا يَغْرَمُ
[Machine] There is no guarantee for the depositor except the bankrupt, and there is no guarantee for the borrower except the bankrupt. This is what was saved from Shurayh al-Qadi, from his saying 11487. And it was narrated by Amr ibn Abdul Jabbar, from Ubaydah ibn Hassan, from Amr ibn Shuayb, from his father, from his grandfather, from the Prophet Muhammad ﷺ . Abu Abdur Rahman as-Sulami and Abu Bakr ibn al-Harith said: Ali ibn Umar al-Hafith narrated to us, from Abu Ali al-Husayn ibn al-Qasim ibn Jafar al-Kawkabi, from Ali ibn Harb, from Amr ibn Abdul Jabbar, he mentioned it. Ali said: Amr and Ubaydah are weak, and this is only narrated from Shurayh al-Qadi, not marfoo'.
لَيْسَ عَلَى الْمُسْتَوْدَعِ غَيْرِ الْمُغِلِّ ضَمَانٌ وَلَا عَلَى الْمُسْتَعِيرِ غَيْرِ الْمُغِلِّ ضَمَانٌ هَذَا هُوَ الْمَحْفُوظُ عَنْ شُرَيْحٍ الْقَاضِي مِنْ قَوْلِهِ 11487 وَرَوَاهُ عَمْرُو بْنُ عَبْدِ الْجَبَّارِ عَنْ عُبَيْدَةَ بْنِ حَسَّانَ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ عَنِ النَّبِيِّ ﷺ أَخْبَرَنَاهُ أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ وَأَبُو بَكْرِ بْنُ الْحَارِثِ قَالَا ثنا عَلِيُّ بْنُ عُمَرَ الْحَافِظُ ثنا أَبُو عَلِيٍّ الْحُسَيْنُ بْنُ الْقَاسِمِ بْنِ جَعْفَرٍ الْكَوْكَبِيُّ ثنا عَلِيُّ بْنُ حَرْبٍ ثنا عَمْرُو بْنُ عَبْدِ الْجَبَّارِ فَذَكَرَهُ قَالَ عَلِيٌّ عَمْرٌو وَعُبَيْدَةُ ضَعِيفَانِ وَإِنَّمَا يُرْوَى عَنْ شُرَيْحٍ الْقَاضِي غَيْرَ مَرْفُوعٍ
23.5 [Machine] Who built or planted on someone else's land
٢٣۔٥ بَابُ مَنْ بَنَى أَوْ غَرَسَ فِي أَرْضِ غَيْرِهِ
[Machine] Whoever builds on the land of a people without their permission, then it is to be demolished. But if he builds with their permission, then he is entitled to its value. He (PBUH) said: "and its value on the day he removes it."
مَنْ بَنَى فِي أَرْضِ قَوْمٍ بِغَيْرِ إِذْنِهِمْ فَلَهُ نَقْضُهُ وَإِنْ بَنَى بِإِذْنِهِمْ فَلَهُ قِيمَتُهُ 11489 قَالَ وَحَدَّثَنَا شَرِيكٌ عَنْ جَابِرٍ عَنْ عَامِرٍ قَالَ قِيمَتُهُ يَوْمَ يُخْرِجُهُ
[Machine] From Shuraih, who built in the land of a people with their permission, his building is worth 11,491. He said, Qais narrated to us from Jabir, from Al-Qasim, from Shuraih, similar to the saying of Abdullah ibn Mas'ood, and a raised hadith is narrated in it, but it is not established.
عَنْ شُرَيْحٍ مَنْ بَنَى فِي أَرْضِ قَوْمٍ بِإِذْنِهِمْ فَلَهُ قِيمَةُ بِنَائِهِ 11491 قَالَ وَحَدَّثَنَا قَيْسٌ عَنْ جَابِرٍ عَنِ الْقَاسِمِ عَنْ شُرَيْحٍ مِثْلَ قَوْلِ عَبْدِ اللهِ بْنِ مَسْعُودٍ وَقَدْ رُوِيَ فِيهِ حَدِيثٌ مَرْفُوعٌ وَلَا يَثْبُتُ
[Machine] The Messenger of Allah ﷺ said: "Whoever builds upon the property of a people with their permission, then he is entitled to the value. And whoever builds without their permission, then he is entitled to demolition." Umar ibn Qays al-Makkī is weak and cannot be used as evidence, and those below him are also weak.
قَالَ رَسُولُ اللهِ ﷺ مَنْ بَنَى فِي رِبَاعِ قَوْمٍ بِإِذْنِهِمْ فَلَهُ الْقِيمَةُ وَمَنْ بَنَى بِغَيْرِ إِذْنِهِمْ فَلَهُ النَّقْضُ عُمَرُ بْنُ قَيْسٍ الْمَكِّيُّ ضَعِيفٌ لَا يُحْتَجُّ بِهِ وَمَنْ دُونَهُ أَيْضًا ضَعِيفٌ
