17. Book of Freeing Slaves
١٧۔ كِتَابُ الْعِتْقِ
ذِكْرُ الْبَيَانِ بِأَنَّ اللَّهَ جَلَّ وَعَلَا يُعْتِقُ مِنَ النَّارِ مَنْ أَعْتَقَ رَقَبَةً، كُلُّ عُضْوٍ مِنْهُ بِعُضْوٍ مِنْهَا
[Machine] This sheikh told me about it, meaning Wathila. I asked, "What did he tell you?" He said, "We were with the Prophet ﷺ in the Battle of Tabuk when some people from the Banu Sulaym tribe came to him and said, 'O Messenger of Allah, we have a companion who has incurred debt.' The Messenger of Allah ﷺ said, 'Free a slave for him, for Allah will free every limb of his from the Fire in return.'" He mentioned, "The name of my father is Abi Abilah Shimir ibn Yaqdhan ibn Amir ibn Abdullah."
حَدَّثَنِي بِهِ هَذَا الشَّيْخُ يَعْنِي وَاثِلَةَ قُلْتُ مَا حَدَّثَكَ؟ قَالَ كُنَّا مَعَ النَّبِيِّ ﷺ فِي غَزْوَةِ تَبُوكَ فَأَتَاهُ نَفَرٌ مِنْ بَنِي سُلَيْمٍ فَقَالُوا يَا رَسُولَ اللَّهِ إِنَّ صَاحِبًا لَنَا قَدْ أَوْجَبَ فَقَالَ رَسُولُ اللَّهِ ﷺ «أَعْتِقُوا عَنْهُ رَقَبَةً يُعْتِقُ اللَّهُ بِكُلِّ عُضْوٍ مِنْهَا عُضْوًا مِنْهُ مِنَ النَّارِ» «اسْمُ أَبِي عَبْلَةَ شِمْرُ بْنُ يَقْظَانَ بْنِ عَامِرِ بْنِ عَبْدِ اللَّهِ»
ذِكْرُ الْبَيَانِ بِأَنَّ هَذَا الْفَضْلُ إِنَّمَا يَكُونُ إِذَا كَانَتِ الرَّقَبَةُ مُؤْمِنَةً
[Machine] The Prophet (PBUH) said: "Whoever frees a believing slave, Allah will free from Hellfire every limb of theirs, freeing one limb per limb of the slave they have freed."
عَنِ النَّبِيِّ ﷺ قَالَ «مَنْ أَعْتَقَ رَقَبَةً مُؤْمِنَةً أَعْتَقَ اللَّهُ بِكُلِّ عُضْوٍ مِنْهَا عُضْوًا مِنْهُ مِنَ النَّارِ»
ذِكْرُ الْبَيَانِ بِأَنَّ هَذَا الْفَضْلَ إِنَّمَا يَكُونُ إِذَا كَانَ الْمُعْتَقُ وَالْمُعْتَقَةُ جَمِيعًا مُسْلِمَيْنِ
Along with the Messenger of Allah ﷺ we besieged the palace of at-Ta'if. The narrator, Mutadh, said: I heard my father (sometimes) say: "Palace of at-Ta'if," and (sometimes) "Fort of at-Ta'if," which are the same. I heard the Messenger of Allah ﷺ say: he who causes an arrow to hit its mark in Allah's cause will have it counted as a degree for him (in Paradise). He then transmitted the rest of the tradition. I heard the Messenger of Allah ﷺ say: If a Muslim man emancipates a Muslim man, Allah, the Exalted, will make every bone of his protection for every bone of his emancipator from Hell; and if a Muslim woman emancipates a Muslim woman, Allah will make every bone of hers protection for every bone of her emancipator from Hell on the Day of Resurrection. حَاصَرْنَا مَعَ رَسُولِ اللَّهِ ﷺ الطَّائِفَ وَسَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «أَيُّمَا رَجُلٍ مُسْلِمٍ أَعْتَقَ رَجُلًا مُسْلِمًا فَإِنَّ اللَّهَ جَلَّ وَعَلَا جَاعِلٌ وِقَاءَ كُلِّ عَظْمٍ مِنْ عِظَامِ مُحَرَّرِهِ عَظْمًا مِنْ عِظَامِهِ مِنَ النَّارِ وَأَيُّمَا امْرَأَةٍ مَسْلَمَةٍ أَعْتَقَتِ امْرَأَةً مَسْلَمَةً فَإِنَّ اللَّهَ جَلَّ وَعَلَا جَاعِلٌ وِقَاءَ كُلِّ عَظْمٍ مِنْ عِظَامِ مُحَرَّرِهَا عَظْمًا مِنْ عِظَامِهَا مِنَ النَّارِ»
ذِكْرُ الْبَيَانِ بِأَنَّ خَيْرَ الرِّقَابِ وَأَفْضَلَهَا مَا كَانَ ثَمَنُهَا أَعْلَا
I said: Messenger of Allah, which of the deeds is the best? He (the Holy Prophet) replied: Belief in Allah and Jihad in His cause. I again asked: Who is the slave whose emancipation is the best? He (the Holy Prophet) replied: One who is valuable for his master and whose price is high. I said: If I can't afford to do it? He (the Holy Prophet) replied: Help an artisan or make anything for the unskilled (labourer). I (Abu Dharr) said: Messenger of Allah, you see that I am helpless in doing some of these deeds. He (the Holy Prophet) replied: Desist from doing mischief to the people. That is the charity of your person on your behalf. (Using translation from Muslim 84a)
قُلْتُ يَا نَبِيَّ اللَّهِ أَيُّ الْعَمَلِ أَفْضَلُ؟ قَالَ «الْإِيمَانُ بِاللَّهِ وَالْجِهَادُ فِي سَبِيلِهِ» قَالَ قُلْتُ أَيُّ الرِّقَابِ أَفْضَلُ يَا نَبِيَّ اللَّهِ؟ قَالَ «أَنْفَسُهَا عِنْدَ أَهْلِهَا وَأَكْثَرُهَا ثَمَنًا» قَالَ قُلْتُ أَرَأَيْتَ إِنْ لَمْ أَفْعَلْ قَالَ «تُعِينُ ضَعِيفًا أَوْ تَصْنَعُ لِأَخْرَقَ» قَالَ قُلْتُ أَرَأَيْتَ إِنْ ضَعُفْتُ قَالَ «تَكُفُّ شَرَّكَ عَنِ النَّاسِ فَإِنَّهُ صَدَقَةٌ مِنْكَ عَلَى نَفْسِكَ»
17.2 [Machine] The emancipation of the married slave before his wife
١٧۔٢ عِتْقُ الْعَبْدِ الْمُتَزَوِّجِ قَبْلَ زَوْجَتِهِ
[Machine] "She had a boy and a girl as slaves, so she wanted to free them. The Messenger of Allah ﷺ said to her, 'If you want to free them, start with the boy before the girl.'"
أَنَّهُ كَانَ لَهَا غُلَامٌ وَجَارِيَةٌ زَوْجٌ فَأَرَادَتْ أَنْ تَعْتِقَهُمَا فَقَالَ لَهَا رَسُولُ اللَّهِ ﷺ «إِنْ أَعْتَقْتِيهِمَا فَابْدَئِي بِالْغُلَامِ قَبْلَ الْجَارِيَةِ»
17.3 [Machine] Suhbat al-mamalik
١٧۔٣ بَابُ صُحْبَةِ الْمَمَالِيكِ
That the Messenger of Allah ﷺ said, "I was shown the first of (every) three to enter Paradise: A martyr, an 'Atif, who is a Muta'affif, and a slave who perfected his worship of Allah, and was sincere to his masters." (Using translation from Tirmidhī 1642)
قَالَ رَسُولُ اللَّهِ ﷺ «عُرِضَ عَلَيَّ أَوَّلُ ثَلَاثَةٍ يَدْخُلُونَ الْجَنَّةَ الشَّهِيدُ وَعَبْدٌ مَمْلُوكٌ أَحْسَنَ عِبَادَةَ رَبِّهِ وَنَصَحَ لِسَيِّدِهِ وَعَفِيفٌ مُتَعَفِّفٌ ذُو عِيَالٍ»
[Machine] The Prophet ﷺ said, "For the rulers, their food and clothing is upon us and they should not be burdened with more than they can bear. If you assign them responsibilities, then assist them and do not punish the slaves of Allah who are like you."
أَنَّ النَّبِيَّ ﷺ قَالَ «لِلْمَمْلُوكِ طَعَامُهُ وَكِسْوَتُهُ وَلَا يُكَلَّفُ إِلَّا مَا يُطِيقُ فَإِنْ كَلَّفْتُمُوهُمْ فَأَعِينُوهُمْ وَلَا تُعَذِّبُوا عِبَادَ اللَّهِ خَلْقًا أَمْثَالَكُمْ»
ذِكْرُ كِتْبَةِ اللَّهِ جَلَّ وَعَلَا الْأَجْرَ لِلْمُسْلِمِ بِتَخْفِيفِهِ عَنِ الْخَادِمِ عَمَلَهُ
[Machine] That the Messenger of Allah ﷺ said, "Whatever you lighten from the work of your servant, there will be a reward for you in your scales."
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «مَا خَفَّفْتَ عَنْ خَادِمِكَ مِنْ عَمَلِهِ كَانَ لَكَ أَجْرًا فِي مَوَازِينِكَ»
17.4 [Machine] Liberation of the partner.
١٧۔٤ بَابُ إِعْتَاقِ الشَّرِيكِ
ذِكْرُ الْحُكْمِ فِيمَنْ أَعْتَقَ نَصِيبَهُ بَيْنَ شُرَكَاءَ فِي مَمْلُوكٍ لَهُمْ
[Machine] I heard the Messenger of Allah ﷺ say, "Whichever slave has partners, and one of them emancipates their share, it will be adjusted in the wealth of the one who emancipated. Its value will be assessed fairly, and if his wealth reaches that, then he will be emancipated."
سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «أَيُّمَا مَمْلُوكٍ كَانَ بَيْنَ شُرَكَاءَ فَأَعْتَقَ أَحَدُهُمْ نَصِيبَهُ فَإِنَّهُ يُقَوَّمُ فِي مَالِ الَّذِي أَعْتَقَ قِيمَةَ عَدْلٍ فَيُعْتَقُ إِنْ بَلَغَ ذَلِكَ مَالُهُ» *
ذِكْرُ الْبَيَانِ بِأَنَّ الْمُعْتِقَ نَصِيبَهُ مِنْ مَمْلُوكِهِ، إِذَا كَانَ مُعْدِمًا كَانَ نَصِيبُهُ الَّذِي أَعْتَقَ جَائِزًا عِتْقُهُ
Messenger of Allah ﷺ said, "Whoever frees his share of a common slave and he has sufficient money to free him completely, should let its price be estimated by a just man and give his partners the price of their shares and manumit the slave; otherwise (i.e. if he has not sufficient money) he manumits the slave partially." أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «مَنْ أَعْتَقَ شِرْكًا لَهُ فِي عَبْدٍ فَكَانَ لَهُ مَالٌ يَبْلُغُ ثَمَنَ الْعَبْدِ قُوِّمَ عَلَيْهِ قِيمَةَ الْعَدْلِ وَأَعْطَى شُرَكَاءَهُ حِصَصَهُمْ وَأَعْتَقَ عَلَيْهِ الْعَبْدُ وَإِلَّا فَقَدْ عَتَقَ مِنْهُ مَا عَتَقَ»
ذِكْرُ الْبَيَانِ بِأَنَّ الشَّرِيكِ إِذَا أَعْتَقَ نَصِيبَهُ، وَالْمُعْتِقٌ مُعْدِمٌ لَمْ يَكُنْ عَلَى الْعَبْدِ شَيْءٌ، وَقَدْ عَتَقَ مِنْهُ مَا عَتَقَ
[Machine] The Messenger of Allahﷺ said, "Whoever frees a slave, and he (the slave) has a partner and fulfills his (the partner's) obligations, then he (the slave) is considered free, and he guarantees the share of his partners with a fair and just value for what he shared in the ownership, and the slave has no liability." "Abu Mu'ayd, his name is Hafs bin Ghailan al-Ru'ayni, is a trustworthy person from the people of Sham and their scholars."
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «مَنْ أَعْتَقَ عَبْدًا وَلَهُ فِيهِ شَرِيكٌ وَلَهُ وَفَاءٌ فَهُوَ حُرٌّ وَيَضْمَنُ نَصِيبَ شُرَكَائِهِ بِقِيمَةِ عَدْلٍ لِمَا أَسَاءَ مُشَارَكَتَهُمْ وَلَيْسَ عَلَى الْعَبْدِ شَيْءٌ» «أَبُو مُعَيْدٍ هَذَا اسْمُهُ حَفْصُ بْنُ غَيْلَانَ الرُّعَيْنِيُّ مِنْ ثِقَاتِ أَهْلِ الشَّامِ وَفُقَهَائِهِمْ»
ذِكْرُ إِبَاحَةِ اسْتِسْعَاءِ الْعَبْدِ فِي نَصِيبِ الْمُعْتِقِ لِفَكِّ رَقَبَتِهِ
[Machine] "The Messenger of Allah ﷺ said, 'Whichever slave has two partners and he frees one of them, his share will be granted to him. If he is capable, he should fulfill the right of the other partner, and if he is unable, then the slave should be sold, and his share should not be cut.'"
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «أَيُّمَا عَبْدٌ كَانَ بَيْنَ اثْنَيْنِ فَأَعْتَقَ أَحَدُهُمَا نَصِيبَهُ فَإِنْ كَانَ مُوسِرًا قُوِّمَ عَلَيْهِ وَإِنْ كَانَ مُعْسِرًا اسْتُسْعِيَ الْعَبْدُ غَيْرَ مَشْقُوقٍ عَلَيْهِ»
ذِكْرُ الْبَيَانِ بِأَنَّ الْعَبْدَ إِنَّمَا يُسْتَسْعَى فِي نَصِيبِهِ الْمُعْتَقِ بَعْدَ أَنْ يُقَوَّمَ ثَمَنُهُ قِيمَةَ عَدْلٍ لَا وَكْسَ فِيهِ، وَلَا شَطَطَ
“Whoever frees his share of a slave or part of his share, must pay from his wealth if he has any wealth if he has any wealth (in order to buy the rest of the slave's freedom). If he does not have wealth, then the slave should be asked to work for the price (of his freedom), without that causing him too much hardship.” (Using translation from Ibn Mājah 2527)
عَنْ رَسُولِ اللَّهِ ﷺ قَالَ «مَنْ أَعْتَقَ شِقْصًا فِي مَمْلُوكٍ فَعَلَيْهِ خَلَاصُهُ فِي مَالِهِ إِنْ كَانَ لَهُ فَإِنْ لَمْ يَكُنْ لَهُ مَالٌ قُوِّمَ الْعَبْدُ قِيمَةَ عَدْلٍ ثُمَّ يُسْتَسْعَى فِي نَصِيبِ الَّذِي لَمْ يُعْتِقْ غَيْرَ مَشْقُوقٍ عَلَيْهِ»
17.5 [Machine] Translation: "Inheritance in cases of diseases, mentioning what is ruled for someone who freed slaves at his death, having no other property besides them
١٧۔٥ بَابُ الْعِتْقِ فِي الْمَرَضِ ذِكْرُ مَا يُحْكَمُ لِمَنْ أَعْتَقَ عَبِيدًا لَهُ عِنْدَ مَوْتِهِ لَا مَالَ لَهُ غَيْرُهُمْ
A man who had no other property emancipated six slaves of his at the time of the death. When the Prophet ﷺ was informed about it, he spoke severely of him. He then called them, divided them into three sections, cast lots among them, and emancipated two and kept four in slavery. (Using translation from Abū Dāʾūd 3958)
«أَنَّ رَجُلًا كَانَ لَهُ سِتَّةُ أَعْبُدٍ فَأَعْتَقَهُمْ عِنْدَ مَوْتِهِ وَلَمْ يَكُنْ لَهُ مَالٌ غَيْرُهُمْ فَرُفِعَ ذَلِكَ إِلَى النَّبِيِّ ﷺ فَكَرِهَهُ وَجَزَّأَهُمْ ثَلَاثَةَ أَجْزَاءٍ فَأَقْرَعَ بَيْنَهُمْ فَأَعْتَقَ اثْنَيْنِ وَأَرَقَّ أَرْبَعَةً»
17.6 [Machine] The Writing
١٧۔٦ بَابُ الْكِتَابَةِ
ذِكْرُ الْإِخْبَارِ عَنْ كَيْفِيَّةِ الْكِتَابَةِ لِلْمُكَاتَبِ
[Machine] He said, "O Messenger of Allah, we hear from you some narratives. Can we have permission to write them down?" He said, "Yes."
أَنَّهُ قَالَ يَا رَسُولَ اللَّهِ إِنَّا نَسْمَعُ مِنْكَ أَحَادِيثَ أَفَتَأْذَنُ لَنَا أَنْ نَكْتُبَهَا؟ قَالَ «نَعَمْ»
ذِكْرُ الْبَيَانِ بِأَنَّ الْمُكَاتِبَةَ عَلَيْهَا أَنْ تَحْتَجِبَ عَنْ مُكَاتِبِهَا، إِذَا عَلِمَتْ أَنَّ عِنْدَهُ الْوَفَاءُ لِمَا كُوتِبَ عَلَيْهِ
[Machine] "Um Salama had written it and there remained one thousand dirhams from his writing." Nabhān said, "I used to hold it so that it would not be concealed from me." Um Salama said, "So I reasoned and saw her in the desert and she asked me, 'Who is this?' I said, 'I am Abu Yahya.' She said to me, 'Which of my sons are you calling to me, the son of my brother Muhammad bin Abdullah bin Abu Umama, and you are fulfilling what is due upon you in his marriage, and I am reciting the blessings upon you.' I cried and woke up and said, 'By Allah, I will never give it to him.' She said, 'My son, indeed the Messenger of Allah ﷺ said, 'If one of you has something that needs to be fulfilled from her writing, then hide it. By Allah, you will not see me unless you see me in the Hereafter.'"
أَنَّ أُمَّ سَلَمَةَ كَاتَبَتْهُ فَبَقِيَ مِنْ كِتَابَتِهِ أَلْفَا دِرْهَمٍ قَالَ نَبْهَانُ كُنْتُ أَمْسِكُهَا لِكَيْ لَا تَحْتَجِبَ عَنِّي أُمُّ سَلَمَةَ قَالَ فَحَجَجْتُ فَرَأَيْتُهَا بِالْبَيْدَاءِ فَقَالَتْ لِي مَنْ ذَا؟ فَقُلْتُ أَنَا أَبُو يَحْيَى فَقَالَتْ لِي أَيْ بُنَيَّ تَدْعُو إِلَيَّ ابْنَ أَخِي مُحَمَّدَ بْنَ عَبْدِ اللَّهِ بْنِ أَبِي أُمَيَّةَ وَتُعْطِي فِي نِكَاحِهِ الَّذِي لِي عَلَيْكَ وَأَنَا أَقْرَأُ عَلَيْكَ السَّلَامَ قَالَ فَبَكَيْتُ وَصِحْتُ وَقُلْتُ وَاللَّهِ لَا أَدْفَعُهَا إِلَيْهِ أَبَدًا فَقَالَتْ أَيْ بُنَيَّ إِنَّ رَسُولَ اللَّهِ ﷺ قَالَ «إِذَا كَانَ عِنْدَ مُكَاتَبِ إِحْدَاكُنَّ مَا يَقْضِي عَنْهُ فَاحْتَجِبِي فَوَاللَّهِ لَا تَرَانِي إِلَّا أَنْ تَرَانِي فِي الْآخِرَةِ»
17.7 [Machine] Mother of the Child
١٧۔٧ بَابُ أُمِّ الْوَلَدِ
ذِكْرُ الْإِبَاحَةِ لِلْمَرْءِ فِي الضَّرُورَةِ بَيْعَ أُمِّ وَلَدِهِ
“We used to sell our slave women and the mothers of our children (Umahat Awaldina) when the Prophet ﷺ was still living among us, and we did not see anything wrong with that.” (Using translation from Ibn Mājah 2517)
أَنَّهُ سَمِعَ جَابِرَ بْنَ عَبْدِ اللَّهِ يَقُولُ «كُنَّا نَبِيعُ سَرَارِينَا أُمَّهَاتِ الْأَوْلَادِ وَالنَّبِيُّ ﷺ حَيٌّ فِينَا فَلَا يَرَى بِذَلِكَ بَأْسًا»
ذِكْرُ الْبَيَانِ بِأَنَّ عُمَرَ بْنَ الْخَطَّابِ هُوَ الَّذِي نَهَى عَنْ بَيْعِ أُمَّهَاتِ الْأَوْلَادِ
We sold slave-mothers during the time of the Messenger of Allah ﷺ and of AbuBakr. When Umar was in power, he forbade us and we stopped. (Using translation from Abū Dāʾūd 3954)
«كُنَّا نَبِيعُ أُمَّهَاتِ الْأَوْلَادِ عَلَى عَهْدِ رَسُولِ اللَّهِ ﷺ وَأَبِي بَكْرٍ فَلَمَّا كَانَ عُمَرُ نَهَى عَنْ بَيْعِهِنَّ»
17.8 [Machine] Al-Walaa
١٧۔٨ بَابُ الْوَلَاءِ
Aisha said, "Barira came to me and said, 'I have agreed with my masters to pay them nine Uqiyas (of gold) (in installments) one Uqiya per year; please help me.' I said, 'I am ready to pay the whole amount now provided your masters agree that your Wala' will be for me.' So, Barira went to her masters and told them about that offer but they refused to accept it. She returned, and at that time, Messenger of Allah ﷺ was sitting (present). Barira said, 'I told them of the offer but they did not accept it and insisted on having the Wala'.' The Prophet ﷺ heard that." ʿAisha narrated the whole story to the Prophet. He said to her, "Buy her and stipulate that her Wala' would be yours as the Wala' is for the manumitter." ʿAisha did so. Then Messenger of Allah ﷺ stood up in front of the people, and after glorifying Allah he said, "Amma Baʿdu (i.e. then after)! What about the people who impose conditions which are not in Allah's Book (Laws)? Any condition that is not in Allah's Book (Laws) is invalid even if they were one hundred conditions, for Allah's decisions are the right ones and His conditions are the strong ones (firmer) and the Wala' will be for the manumitter." إِنِّي كَاتَبْتُ أَهْلِي عَلَى تِسْعِ أَوَاقٍ فِي كُلِّ عَامٍ أُوقِيَّةٌ فَأَعِينِينِي فَقَالَتْ عَائِشَةُ إِنْ أَحَبَّ أَهْلُكِ أَنْ أَعُدَّهَا لَهُمْ عَدَدْتُهَا لَهُمْ وَيَكُونُ لِي وَلَاؤُكِ فَذَهَبَتْ بَرِيرَةُ إِلَى أَهْلِهَا فَقَالَتْ لَهُمْ ذَلِكَ فَأَبَوْا عَلَيْهَا فَجَاءَتْ مِنْ عِنْدِ أَهْلِهَا وَرَسُولُ اللَّهِ ﷺ جَالِسٌ فَقَالَتْ إِنِّي قَدْ عَرَضْتُ عَلَيْهِمْ ذَلِكَ فَأَبَوْا إِلَّا أَنْ يَكُونَ الْوَلَاءُ لَهُمْ فَسَمِعَ رَسُولَ اللَّهِ ﷺ فَسَأَلَهَا فَأَخْبَرْتُهُ عَائِشَةُ فَقَالَ رَسُولُ اللَّهِ ﷺ «خُذِيهَا وَاشْتَرِطِي لَهُمُ الْوَلَاءَ فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ» قَالَتْ عَائِشَةُ ثُمَّ قَامَ رَسُولُ اللَّهِ ﷺ فِي النَّاسِ فَحَمِدَ اللَّهَ وَأَثْنَى عَلَيْهِ ثُمَّ قَالَ «أَمَا بَعْدُ مَا بَالُ رِجَالٍ يَشْتَرِطُونَ شُرُوطًا لَيْسَتْ فِي كِتَابِ اللَّهِ مَا كَانَ مِنْ شَرْطٍ لَيْسَ فِي كِتَابِ اللَّهِ فَهُوَ بَاطِلٌ وَإِنْ كَانَ مِائَةُ شَرْطٍ قَضَاءُ اللَّهِ أَحَقُّ وَشَرْطُ اللَّهِ أَوْثَقُ وَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ»
ذِكْرُ الْخَبَرِ الْمُدْحِضِ قَوْلَ مَنْ زَعَمَ أَنَّ عَائِشَةَ أَعَانَتْ بَرِيرَةَ فِي كِتَابَتِهَا مِنْ غَيْرِ أَنْ تَكُونَ قَدِ اشْتَرَتْهَا أَوْ أَعْتَقَتْهَا
[Machine] "That I pour for them a drink from you, then I will free you." So, I did it and I said, "And may I have your loyalty in return?" Barirah mentioned that to her family and they said, "We will not accept the loyalty unless it is for us." Yahya said, "Ummrah claimed that Aishah mentioned that to the Messenger of Allah ﷺ and he said, 'That should not prevent you. Buy her and free her, for loyalty is only for the one who frees.'"
أَنْ أَصُبَّ لَهُمْ عَنْكِ صَبَّةً فَأُعْتِقَكِ فَعَلْتُ وَيَكُونُ لِي وَلَاؤُكِ فَذَكَرَتْ ذَلِكَ بَرِيرَةُ لِأَهْلِهَا فَقَالُوا لَا إِلَّا أَنْ يَكُونَ الْوَلَاءُ لَنَا قَالَ يَحْيَى فَزَعَمَتْ عَمْرَةُ أَنَّ عَائِشَةَ ذَكَرَتْ ذَلِكَ لِرَسُولِ اللَّهِ ﷺ فَقَالَ «» لَا يَمْنَعُكِ ذَلِكَ اشْتَرِيهَا وَأَعْتِقِيهَا فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ «»
ذِكْرُ إِيجَابِ دُخُولِ النَّارِ لِلْمُتَوَلِّي غَيْرَ مَوَالِيهِ فِي الدُّنْيَا
[Machine] The Messenger of Allah ﷺ said, "Whoever allies himself with someone other than his allies, he should take his place in the fire."
قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ تَوَلَّى إِلَى غَيْرِ مَوَالِيهِ فَلْيَتَبَوَّأْ مَقْعَدَهُ مِنَ النَّارِ»
