18. Book of Oaths
١٨۔ كِتَابُ الْأَيْمَانِ
ذِكْرُ الْإِخْبَارِ عَمَّا يَجِبُ عَلَى الْمَرْءِ مِنْ حَفْظِ نَفْسِهِ فِي الْأَيْمَانِ وَالشَّهَادَاتِ
“The Messenger of Allah ﷺ was asked, 'Which of the people are best?' He said: 'My generation, then those that follow them, then those that follow them. Then there will come people whose testimony precedes their oath and whose oath precedes their testimony.” (Using translation from Ibn Mājah 2362)
سُئِلَ رَسُولُ اللَّهِ ﷺ أَيُّ النَّاسِ خَيْرٌ؟ قَالَ «قَرْنِي ثُمَّ الَّذِينَ يَلُونَهُمْ ثُمَّ الَّذِينَ يَلُونَهُمْ ثُمَّ يَجِيءُ قَوْمٌ تَبْدُرُ شَهَادَةُ أَحَدِهِمْ يَمِينَهُ وَيَمِينُهُ شَهَادَتَهُ»
ذِكْرُ إِبَاحَةِ حَلْفِ الْإِنْسَانِ بِاللَّهِ جَلَّ وَعَلَا، وَإِنْ لَمْ يُحَلَّفْ إِذَا أَرَادَ بِذَلِكَ تَأْكِيدَ قَوْلِهِ
[Machine] The Messenger of Allah ﷺ once received some young boys, girls, and slaves from the Ansar, and he said, "By Allah, I love you all."
أَنَّ رَسُولَ اللَّهِ ﷺ اسْتَقْبَلَهُ ذَاتَ يَوْمٍ غِلْمَانٌ وَإِمَاءٌ وَعُبَيْدٌ مِنَ الْأَنْصَارِ فَقَالَ «وَاللَّهِ إِنِّي لَأُحِبُّكُمْ»
ذِكْرُ الْبَيَانِ بِأَنَّ الْمَرْءَ جَائِزٌ لَهُ أَنْ يَحْلِفَ فِي كَلَامِهِ إِذَا أَرَادَ التَّأَكِيدَ لِقَوْلِهِ الَّذِي يَقُولُهُ
“I heard the Messenger of Allah ﷺ say: ‘The likeness of this world in comparison to the Hereafter is that of anyone of you dipping his finger into the sea: let him see what he brings forth.’” (Using translation from Ibn Mājah 4108)
سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «وَاللَّهِ مَا الدُّنْيَا فِي الْآخِرَةِ إِلَّا كَمَا يَجْعَلُ أَحَدُكُمْ إِصْبَعَهُ فِي الْيَمِّ فَلْيَنْظُرْ بِمَ تَرْجِعُ»
ذِكْرُ الِاسْتِحْبَابِ لِلْمَرْءِ إِذَا حَلَفَ أَنْ يَحْلِفَ بِرَبِّ مُحَمَّدٍ ﷺ
[Machine] "There is no secret to me when you are angry, and when you are content, when you are angry, you say 'No, by the Lord of Ibrahim,' and when you are content, you say 'No, by the Lord of Muhammad.' So I said, 'You have spoken the truth, I only refrain from mentioning your name.' She said, 'So I said, 'O Messenger of Allah, what if you descended into a valley with many trees, some of which have been eaten from, and you found a tree that has not been eaten from, in which one would you let your camel graze?' He said, 'In the one that has not been grazed in.' Do you mean that the Messenger of Allah did not marry a virgin other than her?"
لِي رَسُولُ اللَّهِ ﷺ «مَا يَخْفَى عَلَيَّ حِينَ تَكُونِينَ غَضْبَى وَحِينَ تَكُونِينَ رَاضِيَةً إِذَا كُنْتِ غَضْبَى قُلْتِ لَا وَرَبِّ إِبْرَاهِيمَ وَإِذَا كُنْتِ رَاضِيَةً قُلْتُ لَا وَرَبِّ مُحَمَّدٍ» فَقُلْتُ صَدَقْتَ إِنَّمَا أَهْجُرُ اسْمَكَ قَالَتْ فَقُلْتُ يَا رَسُولَ اللَّهِ أَرَأَيْتَ لَوَ نَزَلْتَ وَادِيًا فِيهِ شَجَرٌ كَثِيرٌ قَدْ أُكِلَ مِنْهَا وَوَجَدْتَ شَجَرَةً لَمْ يُؤْكَلْ مِنْهَا فِي أَيِّهَا كُنْتَ تَرْتَعُ بَعِيرَكَ؟ قَالَ «فِي الَّذِي لَمْ يُرْتَعْ فِيهَا» تُرِيدُ أَنَّ رَسُولَ اللَّهِ ﷺ لَمْ يَتَزَوَّجْ بِكْرًا غَيْرَهَا
ذِكْرُ مَا كَانَ يَحْلِفُ بِهِ النَّبِيُّ ﷺ فِي بَعْضِ الْأَحْوَالِ
[Machine] The right hand of the Prophet ﷺ, which he swore by, saying, "No and the turner of hearts."
كَانَ يَمِينُ النَّبِيِّ ﷺ الَّتِي يَحْلِفُ عَلَيْهَا «لَا وَمُقَلِّبِ الْقُلُوبِ»
ذِكْرُ الْإِخْبَارِ عَنْ وَصْفِ اللَّغْوِ الَّذِي لَا يُؤَاخَذُ اللَّهُ الْعَبْدَ بِهِ فِي كَلَامِهِ
[Machine] Aisha said, "Verily the Messenger of Allah ﷺ said, 'It is the speech of a man - no and by Allah, yes and by Allah.'"
قَالَتْ عَائِشَةُ إِنَّ رَسُولَ اللَّهِ ﷺ قَالَ «هُوَ كَلَامُ الرَّجُلِ كَلَّا وَاللَّهِ وَبَلَى وَاللَّهِ»
ذِكْرُ الْإِخْبَارِ بِأَنَّ الْأَيْمَانَ وَالْعُقُودَ إِذَا اخْتَلَجَتْ بِبَالِ الْمَرْءِ لَا حَرَجَ عَلَيْهِ بِهَا، مَا لَمْ يُسَاعِدْهُ الْفِعْلُ، أَوِ النُّطْقُ
the Messenger of Allah ﷺ said: "Allah has forgiven my nation for what they think of to themselves, so long as they do not act upon it or speak of it." (Using translation from Ibn Mājah 2040)
قَالَ رَسُولُ اللَّهِ ﷺ «إِنَّ اللَّهَ تَجَاوَزَ لِأُمَّتِي عَنْ كُلِّ شَيْءٍ حَدَّثَتْ بِهِ أَنْفُسَهَا مَا لَمْ تَتَكَلَّمْ أَوْ تَعْمَلْ بِهِ»
ذِكْرُ الْخَبَرِ الْمُدْحِضِ قَوْلَ مَنْ زَعَمَ أَنَّ هَذَا الْخَبَرَ تَفَرَّدَ بِهِ قَتَادَةُ
the Messenger of Allah ﷺ said: "Allah has forgiven my nation for what they think of to themselves, so long as they do not act upon it or speak of it." (Using translation from Ibn Mājah 2040)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «إِنَّ اللَّهَ تَجَاوَزَ لِأُمَّتِي عَمَّا حَدَّثَتْ بِهِ أَنْفُسَهَا مَا لَمْ تَنْطِقْ أَوْ تَعْمَلْ بِهِ»
ذِكْرُ الْخَبَرِ الدَّالِّ عَلَى أَنَّ الْمَرْءَ إِذَا حَلَفَ لَهُ أَخُوهُ الْمُسْلِمُ يَنْبَغِي أَنْ يُصَدِّقَهُ عَلَى يَمِينِهِ، وَإِنْ عَلِمَ مِنْهُ ضِدَّهُ
"Eisa bin Maryam saw a man stealing and said: 'Did you steal?' He said: 'No, by the One besides Whom there is no other God.' 'Eisa said: 'I believe in Allah, and I do not believe what my eyes see.'" (Using translation from Ibn Mājah 2102)
وَقَالَ رَسُولُ اللَّهِ ﷺ «رَأَى عِيسَى ابْنُ مَرْيَمَ رَجُلًا سَرَقَ فَقَالَ عِيسَى أَسَرَقْتَ؟ قَالَ كَلَّا وَالَّذِي لَا إِلَهَ إِلَّا هُوَ فَقَالَ عِيسَى آمَنْتُ بِاللَّهِ وَكَذَّبْتُ عَيْنِي»
ذِكْرُ الْخَبَرِ الدَّالِّ عَلَى أَنَّ الْحَالِفَ إِذَا أَرَادَ أَنْ يَحْلِفَ عَلَى شَيْءٍ يَجِبُ أَنْ يُعَقِّبَ يَمِينَهُ الِاسْتِثْنَاءَ
[Machine] On the authority of the Prophetﷺ he said, "Solomon, the son of David, took an oath to visit one hundred women, with each woman carrying a boy who would strive in the cause of Allah. However, only one woman among them gave birth to a half-boy." So, the Messenger of Allahﷺ said, "If he had said, 'If Allah wills', then it would have been as he said."
عَنِ النَّبِيِّ ﷺ قَالَ «حَلَفَ سُلَيْمَانُ بْنُ دَاوُدَ لَيَطُوفَنَّ عَلَى مِائَةِ امْرَأَةٍ كُلُّ امْرَأَةٍ مِنْهُنَّ تَحْمِلُ غُلَامًا يُجَاهِدُ فِي سَبِيلِ اللَّهِ قَالَ فَلَمْ تَحْمِلْ مِنْهُنَّ إِلَّا امْرَأَةٌ وَاحِدَةٌ نِصْفَ غُلَامٍ» فَقَالَ رَسُولَ اللَّهِ ﷺ «لَوْ قَالَ إِنْ شَاءَ اللَّهُ كَانَ كَمَا قَالَ»
ذِكْرُ الْبَيَانِ بِأَنَّ الْمَلِكَ قَدْ لَقَّنَهُ الِاسْتِثْنَاءَ عِنْدَ يَمِينِهِ إِلَّا أَنَّهُ نَسِيَ
[Machine] "Indeed, the Prophet ﷺ said, 'Sulaiman, son of Dawud, took an oath that he would spend the night with ninety women, each of whom would give birth to a boy who would fight in the cause of Allah.' His companion or the angel said to him, 'Say, "If Allah wills."' But he forgot and spent that night with ninety women, and none of them gave birth except one with the partial birth of a boy.' The Prophet ﷺ said, 'If he had said "If Allah wills," he would not have violated his oath and he would have fulfilled his need.'"
أَنَّ النَّبِيَّ ﷺ قَالَ «حَلَفَ سُلَيْمَانُ بْنُ دَاوُدَ لَيَطُوفَنَّ اللَّيْلَةَ بِتِسْعِينَ امْرَأَةً تَلِدُ كُلُّ امْرَأَةٍ مِنْهُنَّ غُلَامًا يُقَاتِلُ فِي سَبِيلِ اللَّهِ فَقَالَ لَهُ صَاحِبُهُ أَوِ الْمَلِكُ قُلْ إِنْ شَاءَ اللَّهُ فَنَسِيَ وَأَطَافَ تِلْكَ اللَّيْلَةَ بِتِسْعِينَ امْرَأَةً فَمَا جَاءَتِ امْرَأَةٌ مِنْهُنَّ إِلَّا وَاحِدَةٌ بِشِقِّ غُلَامٍ» فَقَالَ النَّبِيُّ ﷺ «لَوْ قَالَ إِنْ شَاءَ اللَّهُ لَمْ يَحْنَثْ وَكَانَ أَدْرَكَ حَاجَتَهُ»
ذِكْرُ إِبَاحَةِ الِاسْتِثْنَاءِ لِلْحَالِفِ فِي يَمِينِهِ إِذَا أَعْقَبَهَا إِيَّاهُ
The Prophet ﷺ said: If anyone says when swearing an oath: "If Allah wills," he makes an exception. (Using translation from Abū Dāʾūd 3261)
عَنِ النَّبِيِّ ﷺ قَالَ «مَنْ حَلَفَ فَقَالَ إِنْ شَاءَ اللَّهُ فَقَدِ اسْتَثْنَى»
ذِكْرُ الْخَبَرِ الْمُدْحِضِ قَوْلَ مَنْ زَعَمَ أَنَّ هَذَا الْخَبَرَ تَفَرَّدَ بِهِ أَيُّوبُ السَّخْتِيَانِيُّ
'Whoever swears an oath and says In sha' Allah, he will have made an exception."(2) (Using translation from Ibn Mājah 2104)
قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ حَلَفَ فَقَالَ إِنْ شَاءَ اللَّهُ لَمْ يَحْنَثْ»
ذِكْرُ الْخَبَرِ الْمُدْحِضِ قَوْلَ مَنْ زَعَمَ أَنَّ هَذَا الْخَبَرَ مَا رَوَاهُ إِلَّا نَافِعٌ، عَنِ ابْنِ عُمَرَ
The Prophet ﷺ said: If anyone says when swearing an oath: "If Allah wills," he makes an exception. (Using translation from Abū Dāʾūd 3261)
أَنَّ النَّبِيَّ ﷺ قَالَ «مَنْ حَلَفَ فَقَالَ إِنْ شَاءَ اللَّهُ فَقَدِ اسْتَثْنَى»
ذِكْرُ الْبَيَانِ بِأَنَّ الْمَرْءَ مُخَيَّرٌ عِنْدَ اسْتِثْنَائِهِ فِي الْيَمِينِ بَيْنَ أَنْ يَتْرُكَ يَمِينَهُ، أَوْ يَمْضِيَ فِيهَا
The Prophet ﷺ said: If anyone swears an oath and makes an exception, he may fulfil it if he wishes and break it if he wishes without any accountability for breaking. (Using translation from Abū Dāʾūd 3262)
قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ حَلَفَ فَاسْتَثْنَى فَهُوَ بِالْخِيَارِ إِنْ شَاءَ مَضَى وَإِنْ شَاءَ تَرَكَ غَيْرَ حَنِثٍ»
ذِكْرُ نَفْيِ الْحِنْثِ عَنْ مَنِ اسْتَثْنَى فِي يَمِينِهِ بَعْدَ سَكْتَةٍ يَسِيرَةٍ
[Machine] The Messenger of Allah ﷺ said, "By Allah, I will certainly fight Quraysh. By Allah, I will certainly fight Quraysh. By Allah, I will certainly fight Quraysh." Then he remained silent and said, "If Allah wills."
قَالَ رَسُولُ اللَّهِ ﷺ «وَاللَّهِ لَأَغْزُوَنَّ قُرَيْشًا وَاللَّهِ لَأَغْزُوَنَّ قُرَيْشًا وَاللَّهِ لَأَغْزُوَنَّ قُرَيْشًا» ثُمَّ سَكَتَ فَقَالَ «إِنْ شَاءَ اللَّهُ»
ذِكْرُ كِتْبَةِ اللَّهِ جَلَّ وَعَلَا الْحَسَنَةَ لِلتَّارِكِ يَمِينَهُ بِأَخْذِ مَا هُوَ خَيْرٌ مِنْهُ
[Machine] The Prophet ﷺ said, "Whoever swears an oath to harm someone and wants to fulfill it, then his expiation is to leave it (not harm the person), and with the expiation there is goodness."
أَنَّ النَّبِيَّ ﷺ قَالَ «مَنْ حَلَفَ عَلَى مُلْكِ يَمِينِهِ أَنْ يَضْرِبَهُ فَكَفَّارَتُهُ تَرَكُهُ وَمَعَ الْكَفَّارَةِ حَسَنَةٌ»
ذِكْرُ الْأَمْرِ بِتَرْكِ الْيَمِينِ لِلْحَالِفِ إِذَا عَلِمَ تَرَكَهُ خَيْرٌ مِنَ الْمُضِيِّ فِي يَمِينِهِ
He who took an oath, but he found something else better than that, should do that which is better and break his oath. (Using translation from Muslim 1651b)
عَنِ النَّبِيِّ ﷺ قَالَ «مَنْ حَلَفَ عَلَى يَمِينٍ فَرَأَى غَيْرَهَا خَيْرًا مِنْهَا فَلْيَأْتِ الَّذِي هُوَ خَيْرٌ ثُمَّ لِيَتْرُكْ يَمِينَهُ»
ذِكْرُ خَبَرٍ ثَانٍ يُصَرِّحُ بِصِحَّةِ مَا ذَكَرْنَاهُ
[Machine] I have nothing to give you except my shield and my forgiveness, so write to my family to give it to you. But they were not satisfied, so they swore not to give you anything. Then the man agreed and said: "If it weren't for me hearing the Messenger of Allah ﷺ saying, 'Whoever takes an oath and then sees that there is something more righteous to do for the sake of Allah, then let him do what is more righteous,'" I would not have broken my promise.
مَا عِنْدِي شَيْءٌ أُعْطِيكَهُ إِلَّا دِرْعِي وَمِغْفَرِي فَأَكْتُبُ إِلَى أَهْلِي أَنْ تَعْطِيكَهَا فَلَمْ يَرْضَ فَحَلَفَ أَنْ لَا يُعْطِيَهُ شَيْئًا ثُمَّ رَضِيَ الرَّجُلُ فَقَالَ عَدِيٌّ لَوْلَا أَنِّي سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ « مَنْ حَلَفَ عَلَى يَمِينٍ ثُمَّ رَأَى مَا هُوَ أَتْقَى لِلَّهِ مِنْهَا فَلْيَأْتِ التَّقْوَى» مَا حَنَثْتُ
ذِكْرُ الْبَيَانِ بِأَنَّ الْحَالِفَ إِنَّمَا أُمِرَ بِتَرْكِ يَمِينِهِ إِذَا رَأَى ذَلِكَ خَيْرًا لَهُ مَعَ الْكَفَّارَةِ
the Messenger of Allah ﷺ, said: "Whoever swears an oath then sees that something else is better than it, let him do that which is better and offer expiation for what he swore about. " (Using translation from Ibn Mājah 2108)
قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ حَلَفَ عَلَى يَمِينٍ فَرَأَى غَيْرَهَا خَيْرًا مِنْهَا فَلْيَأْتِ الَّذِي هُوَ خَيْرٌ وَلْيُكَفِّرْ عَنْ يَمِينِهِ»
ذِكْرُ خَبَرٍ ثَانٍ يُصَرِّحُ بِأَنَّ الْحَالِفَ مَأْمُورٌ بِالْكَفَّارَةِ عِنْدَ تَرْكِهِ الْيَمِينَ إِذَا رَأَى ذَلِكَ خَيْرًا لَهُ مِنَ الْمُضِيِّ فِيهِ
[Machine] The Messenger of Allah ﷺ said, "O Abdur-Rahman, do not ask for leadership. If it is given to you without asking, you will be entrusted with it. But if you are given it after asking, you will be left to deal with it on your own. And if you swear an oath on something and then you see something better than it, then do what is better and make atonement for breaking your oath."
قَالَ رَسُولُ اللَّهِ ﷺ «يَا عَبْدَ الرَّحْمَنِ لَا تَسْأَلِ الْإِمَارَةَ فَإِنَّكَ إِنْ أَتَتْكَ عَنْ مَسْأَلَةٍ وُكِلْتَ إِلَيْهَا وَإِنْ أَتَتْكَ مِنْ غَيْرِ مَسْأَلَةٍ أُعِنْتَ عَلَيْهَا وَإِذَا حَلَفْتَ عَلَى يَمِينٍ وَرَأَيْتَ غَيْرَهَا خَيْرًا مِنْهَا فَأْتِ الَّذِي هُوَ خَيْرٌ وَكَفِّرْ عَنْ يَمِينِكِ»
ذِكْرُ الْخَبَرِ الدَّالِّ عَلَى أَنَّ الْمَرْءَ مُبَاحٌ لَهُ أَنْ يَبْدَأَ بِالْكَفَّارَةِ قَبْلَ الْحِنْثِ إِذَا رَأَى تَرَكَ الْيَمِينِ خَيْرًا مِنَ الْمُضِيِّ فِيهِ
"Whoever swears an oath, then sees something better than it, let him do that which is better." (Using translation from Nasāʾī 3781)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «مَنْ حَلَفَ عَلَى يَمِينٍ فَرَأَى غَيْرَهَا خَيْرًا مِنْهَا فَلْيُكَفِّرْ عَنْ يَمِينِهِ وَلْيَفْعَلِ الَّذِي هُوَ خَيْرٌ»
ذِكْرُ الْإِبَاحَةِ لِلْحَالِفِ أَنْ يَحْنَثَ يَمِينَهُ إِذَا رَأَى ذَلِكَ خَيْرًا مِنَ الْمُضِيِّ فِيهِ
There came to our house some guests. It was a common practice with my father to (go) and talk to Messenger of Allah ﷺ during the night. While going he said: 'Abd al-Rahman, entertain the guests. When it was evening we served the food to them, but they refused saying: So long as the owner of the house does not come and join us, we would not take the meal. I said to them: He ('Abd Bakr) is a stern person, and if you would not do that (if you do not take the food). I fear, I may be harmed by him, but they refused. As he (my father) came, the first thing he asked was: Have you served the guests? They (the peopleof the household) said: We have not served them sofar. He said: Did I not command 'Abd al-Rahman (to do this)? He ('Abd al-Rahman) said: I slunk away and kept myself away by that time. He again said: O stupid fellow, I ask you on oath that In case you hear my voice you come to me. I came and said: By Allah, there is no fault of mine. These are your guests; you may ask them. I provided them with food but they refused to eat until you came. He said to them: Why is it that you did not accept our food? By Allah, I shall not even take food tonight (as you have not taken). They said: By Allah, we would not take until you join us. Thereupon he Abu Bakr) said: I have never seen a more unfortunate night than this. Woe be to thee! that you do not accept from us food prepared for you. He again said: What I did first (that is the taking of vow for not eating the food) was prompted by the Satan. Bring the food. The food was brought, and he ate by reciting the name of Allah and they also ate, and when it was morning he came to Allah's Apostle ﷺ and said: Messenger of Allah, their oath (that of the guests) came to be true, but mine was not true, and after that he informed him of the whole incident. He said: Your oath came to be the most true and you are the best of them. He (the narrator) said. I do not know whether he made an atonement for it. (Using translation from Muslim 2057b)
نَزَلَ عَلَيْنَا أَضْيَافٌ لَنَا وَكَانَ أَبِي يَتَحَدَّثُ إِلَى رَسُولِ اللَّهِ ﷺ مِنَ اللَّيْلِ فَانْطَلَقَ وَقَالَ يَا عَبْدَ الرَّحْمَنِ افْرُغْ مِنْ أَضْيَافِكَ فَلَمَّا أَمْسَيْتُ جِئْنَا بِقِرَاهُمْ فَأَبَوْا وَقَالُوا حَتَّى يَجِيءَ أَبُوكَ مَنْزِلَهُ فَيَطْعَمُ مَعَنَا فَقُلْتُ إِنَّهُ رَجُلٌ حَدِيدٌ وَإِنَّكُمْ إِنْ لَمْ تَفْعَلُوا خِفْتُ أَنْ يُصِيبَنِي مِنْهُ أَذًى فَأَبَوْا عَلَيْنَا فَلَمَّا جَاءَ قَالَ قَدْ فَرَغْتُمْ مِنْ أَضْيَافِكُمْ فَقَالُوا لَا وَاللَّهِ فَقَالَ أَلَمْ آمُرُ عَبْدَ الرَّحْمَنِ وَتَنَحَّيْتُ قَالَ أَقْسَمْتُ عَلَيْكَ إِنْ كُنْتَ تَسْمَعُ صَوْتِي إِلَّا جِئْتَ فَجِئْتُ فَقُلْتُ وَاللَّهِ مَا لِي ذَنْبٌ هَؤُلَاءِ أَضْيَافُكَ فَسَلْهُمْ قَدْ أَتَيْتُهُمْ بِقِرَاهُمْ فَأَبَوْا أَنْ يَطْعَمُوا حَتَّى تَجِيءَ فَقَالَ مَا لَكُمْ لَا تَقْبَلُونَ عَنَّا قِرَاكُمْ؟ وَقَالَ أَبُو بَكْرٍ وَاللَّهِ لَا أَطْعَمُهُ اللَّيْلَةَ قَالُوا فَوَاللَّهِ لَا نَطْعَمُهُ حَتَّى تَطْعَمَهُ فَقَالَ لَمْ أَرْ كَالشَّرِّ مُنْذُ اللَّيْلَةِ ثُمَّ قَالَ أَمَّا الْأَوَّلُ فَمِنِ الشَّيْطَانِ فَهَلُمُّوا قِرَاكُمْ فَجِيءَ بِالطَّعَامِ فَسَمَّى اللَّهَ وَأَكَلَ وَأَكَلُوا فَلَمَّا أَصْبَحَ غَدَا عَلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ بَرُّوا وَحَنِثْتُ فَقَالَ «بَلْ أَنْتَ أَبَرُّهُمْ وَخَيْرُهُمْ»
ذِكْرُ مَا يُسْتَحَبُّ لِلْمَرْءِ إِذَا حَلَفَ عَلَى يَمِينٍ أَنْ يَأْتِيَ مَا هُوَ خَيْرٌ لَهُ مِنَ الْمُضِيِّ فِي يَمِينِهِ دُونَهُ
[Machine] Abu Musa al-Ash'ari came to the Messenger of Allah ﷺ being requested to accompany a group of his people. Abu Musa said, "By Allah, I will not carry them." So the Messenger of Allah ﷺ was presented with some plunder from camels and he distributed it, and only fifteen remained. He asked, "Where is Abdullah bin Qais?" They said, "Here he is." So he said, "Take this and carry it for your people." Abdullah said, "O Messenger of Allah, you had sworn." The Messenger of Allah ﷺ said, "And if I had made an oath, I would keep it."
أَتَى أَبُو مُوسَى الْأَشْعَرِيُّ رَسُولَ اللَّهِ ﷺ يَسْتَحْمِلُهُ لِنَفَرٍ مِنْ قَوْمِهِ فَقَالَ وَاللَّهِ لَا أَحْمِلُهُمْ فَأُتِيَ رَسُولَ اللَّهِ ﷺ بِنَهْبٍ مِنْ إِبِلٍ فَفَرَّقَهَا فَبَقِيَ مِنْهَا خَمْسُ عَشْرَةَ فَقَالَ «أَيْنَ عَبْدُ اللَّهِ بْنُ قَيْسٍ؟ » قَالَ هُوَ ذَا هُوَ فَقَالَ «خُذْ هَذِهِ فَاحْمِلْ عَلَيْهَا قَوْمَكَ» قَالَ يَا رَسُولَ اللَّهِ إِنَّكَ كُنْتَ قَدْ حَلَفْتَ قَالَ «وَإِنْ كُنْتُ حَلَفْتُ»
ذِكْرُ الْإِبَاحَةِ لِلْمَرْءِ الْمُضِيَّ فِي يَمِينِهِ إِذَا رَأَى ذَلِكَ خَيْرًا لَهُ
the Messenger of Allah ﷺ, said: "Whoever swears an oath then sees that something else is better than it, let him do that which is better and offer expiation for what he swore about. " (Using translation from Ibn Mājah 2108)
قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ حَلَفَ عَلَى يَمِينً فَرَأَى غَيْرَهَا خَيْرًا مِنْهَا فَلْيَأْتِ الَّذِي هُوَ خَيْرٌ وَلْيُكَفِّرْ عَنْ يَمِينِهِ»
ذِكْرُ مَا يُسْتَحَبُّ لِلْإِمَامِ عِنْدَمَا سَبَقَ مِنْهُ مِنْ يَمِينٍ إِمْضَاءُ مَا رَأَى خَيْرًا لَهُ دُونَ التَّعَرُّجِ عَلَى يَمِينِهِ الَّتِي مَضَتْ
[Machine] The Prophet ﷺ, when he used to swear by an oath, he would not break it until the expiation for the oath was revealed. Then he ﷺ would say, "I do not swear by an oath and then see something better than it except that I fulfill the better one and compensate for my oath."
كَانَ رَسُولُ اللَّهِ ﷺ إِذَا حَلَفَ عَلَى يَمِينٍ لَمْ يَحْنَثْ حَتَّى نَزَلَتْ كَفَّارَةُ الْيَمِينِ فَقَالَ ﷺ «لَا أَحْلِفُ عَلَى يَمِينٍ فَأَرَى غَيْرَهَا خَيْرًا مِنْهَا إِلَّا أَتَيْتُ الَّذِي هُوَ خَيْرٌ وَكَفَّرْتُ عَنْ يَمِينِي»
ذِكْرُ وَصْفِ بَعْضِ الْأَيْمَانِ الَّتِي كَانَ الْمُصْطَفَى ﷺ يُمْضِي ضِدَّهَا إِذَا سَبَقَتْ مِنْهُ
[Machine] "We were on foot, and we went to the Prophet of Allah ﷺ to carry him. He said, 'By Allah, I will not let you carry me today,' or he said, 'By Allah, I will not let you carry me.' When we returned to the residence or when we returned to the residence, a herd of camels came to him. He sent us three pieces of barley, some of us said to each other, 'Should we ride while the Messenger of Allah ﷺ has already ridden?' So we went to him and said, 'O Prophet of Allah, you have already ridden.' He said, 'By Allah, I do not let you carry me, Allah is the one who carries you, and whatever is on the earth from the right side, I take an oath on it, and then I see something better than it, I will go to it or I will go to it.'"
كُنَّا مُشَاةً فَأَتَيْنَا نَبِيَّ اللَّهِ ﷺ نَسْتَحْمِلُهُ فَقَالَ «وَاللَّهِ لَا أَحْمِلُكُمُ الْيَوْمَ» أَوْ قَالَ «وَاللَّهِ لَا أَحْمِلُكُمْ» قَالَ فَلَمَّا رَجَعْنَا إِلَى الْمَنْزِلِ أَوْ قَالَ حِينَ رَجَعْنَا إِلَى الْمَنْزِلِ أَتَاهُ قَطِيعٌ مِنْ إِبِلٍ فَإِذَا قَدْ بَعَثَ إِلَيْنَا بِثَلَاثٍ بُقْعِ الذُّرَى قَالَ بَعْضُنَا لِبَعْضٍ أَنَرْكَبُ وَقَدْ حَلَفَ رَسُولُ اللَّهِ ﷺ فَأَتَيْنَاهُ فَقُلْنَا يَا نَبِيَّ اللَّهِ إِنَّكَ قَدْ حَلَفْتَ قَالَ «إِنِّي وَاللَّهِ مَا أَحْمِلُكُمْ إِنَّمَا حَمَلَكُمُ اللَّهُ وَمَا عَلَى الْأَرْضِ مِنْ يَمِينٍ أَحْلِفُ عَلَيْهَا ثُمَّ أَرَى خَيْرًا مِنْهَا إِلَّا أَتَيْتُهَا أَوْ أَتَيْتُهُ»
ذِكْرُ نَفْيِ جَوَازِ مُضِيِّ الْمَرْءِ فِي أَيمَانِهِ وَنُذُوُرِهِ الَّتِي لَا يَمْلِكُهَا، أَوْ يَشُوبُهَا بِمَعْصِيَةِ اللَّهِ جَلَّ وَعَلَا
There were two brothers among the Ansar who shared an inheritance. When one of them asked the other for the portion due to him, he replied: If you ask me again for the portion due to you, all my property will be devoted to the decoration of the Ka'bah. Umar said to him: The Ka'bah does not need your property. Make atonement for your oath and speak to your brother. I heard the Messenger of Allah ﷺ say: An oath or vow to disobey the Lord, or to break ties of relationship or about something over which one has no control is not binding on you. أَنَّ أَخَوَيْنِ مِنَ الْأَنْصَارِ كَانَ بَيْنَهُمَا مِيرَاثٌ فَسَأَلَ أَحَدُهُمَا صَاحِبَهُ الْقِسْمَةَ فَقَالَ لَئِنْ عُدْتَ تَسْأَلُنِي الْقِسْمَةَ لَمْ أُكَلِّمْكَ أَبَدًا وَكُلُّ مَالٍ لِي فِي رِتَاجِ الْكَعْبَةِ فَقَالَ عُمَرُ بْنُ الْخَطَّابِ ؓ إِنَّ الْكَعْبَةَ لَغَنِيَّةٌ عَنْ مَالِكَ كَفِّرْ عَنْ يَمِينِكِ وَكَلِّمْ أَخَاكَ فَإِنِّي سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «لَا يَمِينَ عَلَيْكَ وَلَا نَذَرَ فِي مَعْصِيَةٍ وَلَا فِي قَطِيعَةِ رَحِمٍ وَلَا فِيمَا لَا تَمْلِكُ»
ذِكْرُ الزَّجْرِ عَنْ أَنْ يُكْثِرَ الْمَرْءُ مِنَ الْحَلِفِ فِي أَسْبَابِهِ
the Messenger of Allah ﷺ said: "An oath (leads to) either sin or regret. " (Using translation from Ibn Mājah 2103)
قَالَ رَسُولُ اللَّهِ ﷺ «إِنَّمَا الْحَلِفُ حَنِثٌ أَوْ نَدَمٌ»
ذِكْرُ الزَّجْرِ عَنْ أَنْ يَحْلِفَ الْمَرْءُ بِغَيْرِ اللَّهِ أَوْ يَكُونَ فِي يَمِينِهِ غَيْرَ بَارٍّ
The Prophet ﷺ said: Do not swear by your fathers, or by your mothers, or by rivals to Allah; and swear by Allah only, and swear by Allah only when you are speaking the truth. (Using translation from Abū Dāʾūd 3248)
قَالَ رَسُولُ اللَّهِ ﷺ «لَا تَحْلِفُوا بِآبَائِكُمْ وَلَا بِأُمَّهَاتِكُمْ وَلَا بِالْأَنْدَادِ وَلَا تَحْلِفُوا إِلَّا بِاللَّهِ وَلَا تَحْلِفُوا إِلَّا وَأَنْتُمْ صَادِقُونَ» *
ذِكْرُ الزَّجْرِ عَنْ أَنْ يَحْلِفَ الْمَرْءُ بِشَيْءٍ سِوَى اللَّهِ جَلَّ وَعَلَا
Ibn Umar heard a man swearing: No, I swear by the Ka'bah. Ibn Umar said to him: I heard the Messenger of Allah ﷺ say: He who swears by anyone but Allah is polytheist. (Using translation from Abū Dāʾūd 3251)
سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «مَنْ حَلَفَ بِغَيْرِ اللَّهِ فَقَدْ أَشْرَكَ»
ذِكْرُ الْبَيَانِ بِأَنَّ الْمَرْءَ مَنْهِيٌّ عَنْ أَنْ يَحْلِفَ بِشَيْءٍ غَيْرِ اللَّهِ تَعَالَى
The Messenger of Allah ﷺ found 'Umar al-Khattab in a caravan while he was swearing by his father. So he said: Allah forbids you to swear by forefathers. If anyone swears, he must swear by Allah or keep silence. (Using translation from Abū Dāʾūd 3249)
أَنَّ رَسُولَ اللَّهِ ﷺ أَدْرَكَ عُمَرَ بْنَ الْخَطَّابِ وَهُوَ يَحْلِفُ بِأَبِيهِ فَقَالَ «إِنَّ اللَّهَ يَنْهَاكُمْ أَنْ تَحْلِفُوا بِآبَائِكُمْ فَمَنْ كَانَ حَالِفًا فَلْيَحْلِفْ بِاللَّهِ أَوْ لِيَسْكُتْ»
ذِكْرُ الْإِخْبَارِ عَمَّا يَجِبُ عَلَى الْمَرْءِ مِنْ مُجَانَبَةِ الْحَلِفِ بِغَيْرِ اللَّهِ جَلَّ وَعَلَا
Messenger of Allah ﷺ met ʿUmar bin Al-Khattab while the latter was going with a group of camel-riders, and he was swearing by his father. The Prophet ﷺ said, "Lo! Allah forbids you to swear by your fathers, so whoever has to take an oath, he should swear by Allah or keep quiet." (Using translation from Bukhārī 6646)
أَنَّ رَسُولَ اللَّهِ ﷺ أَدْرَكَ عُمَرَ بْنَ الْخَطَّابِ وَهُوَ يَسِيرُ فِي رَكْبٍ وَهُوَ يَحْلِفُ بِأَبِيهِ فَقَالَ رَسُولُ اللَّهِ ﷺ «إِنَّ اللَّهَ يَنْهَاكُمْ أَنْ تَحْلِفُوا بِآبَائِكُمْ فَمَنْ كَانَ حَالِفًا فَلْيَحْلِفْ بِاللَّهِ أَوْ لِيَصْمُتْ»

أَدْرَكَ رَسُولُ اللَّهِ ﷺ عُمَرَ بْنَ الْخَطَّابِ وَهُوَ يَحْلِفُ بِأَبِيهِ فَقَالَ النَّبِيُّ ﷺ «إِنَّ اللَّهَ يَنْهَاكُمْ أَنْ تَحْلِفُوا بِآبَائِكُمْ فَلْيَحْلِفْ حَالَفٌ بِاللَّهِ أَوْ لِيَسْكُتْ»
ذِكْرُ الْعِلَّةِ الَّتِي مِنْ أَجْلِهَا زَجَرَ عَنِ الْحَلِفِ بِالْآبَاءِ
"The Messenger of Allah said: 'Whoever swears, let him not swear by anything other than Allah.'" The Quraish used to swear by their forefathers, and so he said: "Do not swear by your forefathers." (Using translation from Nasāʾī 3764)
قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ كَانَ حَالِفًا فَلَا يَحْلِفُ إِلَّا بِاللَّهِ» وَكَانَتْ قُرَيْشٌ تَحْلِفُ بِآبَائِهَا فَقَالَ «لَا تَحْلِفُوا بِآبَائِكُمْ»
ذِكْرُ الزَّجْرِ عَنْ حَلِفِ الْمَرْءِ بِالْأَمَانَةِ إِذَا أَرَادَ الْقَسَمَ
[Machine] The Messenger of Allah ﷺ said, "Whoever deceives the wife of a person or his slave, then he is not from us, and whoever swears an oath by the trust, then he is not from us." - Ibn Buraydah, Abdullah ibn Buraydah ibn Hushayb.
قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ خَبَّبَ زَوْجَةَ امْرِئٍ أَوْ مَمْلُوكَهُ فَلَيْسَ مِنَّا وَمَنْ حَلَفَ بِالْأَمَانَةِ فَلَيْسَ مِنَّا» « ابْنُ بُرَيْدَةَ عَبْدُ اللَّهِ بْنُ بُرَيْدَةَ بْنِ حُصَيْبٍ»
ذِكْرُ الْأَمْرِ بِالشَّهَادَةِ مَعَ التَّفْلِ عَنْ يَسَارِهِ، ثَلَاثًا لِمَنْ حَلَفَ بِاللَّاتِ وَالْعُزَّى
[Machine] "My companions, you said 'hujrah' (which refers to abstaining from something). So I came to the Prophet ﷺ and said, 'O Messenger of Allah, the covenant was near, and I swore by al-Lat and al-'Uzza (pre-Islamic deities).' The Messenger of Allah ﷺ said, 'Say: La ilaha illallah (There is no deity worthy of worship except Allah) three times, then spit on your left side three times, and seek refuge in Allah from the accursed Satan, and do not return to it.'"
أَصْحَابِي قُلْتَ هُجْرًا فَأَتَيْتُ النَّبِيَّ ﷺ فَقُلْتُ يَا رَسُولَ اللَّهِ إِنَّ الْعَهْدَ كَانَ قَرِيبًا وَحَلَفْتُ بِاللَّاتِ وَالْعُزَّى فَقَالَ رَسُولُ اللَّهِ ﷺ «قُلْ لَا إِلَهَ إِلَّا اللَّهُ وَحْدَهُ ثَلَاثًا ثُمَّ اتْفُلْ عَنْ يَسَارِكِ ثَلَاثًا وَتَعَوَّذْ بِاللَّهِ مِنَ الشَّيْطَانِ الرَّجِيمِ وَلَا تَعُدْ»
ذِكْرُ الْأَمْرِ بِالِاسْتِعَاذَةِ بِاللَّهِ جَلَّ وَعَلَا مِنَ الشَّيْطَانِ لِمَنْ حَلَفَ بِغَيْرِ اللَّهِ تَعَالَى
[Machine] "To my companions, you said goodbye, so I went to the Prophet ﷺ and said, 'Indeed, the oath was an ignorant act, and I swore by Al-Lat and Al-Uzza.' The Messenger of Allah ﷺ said to me, 'Say, "There is no deity except Allah, alone, three times, and blow to your left three times, and seek refuge with Allah from Satan, and do not swear again."'"
لِي أَصْحَابِي لَقَدْ قُلْتَ هُجْرًا فَأَتَيْتُ النَّبِيَّ ﷺ فَقُلْتُ إِنَّ الْعَهْدَ كَانَ حَدِيثًا وَإِنِّي حَلَفْتُ بِاللَّاتِ وَالْعُزَّى فَقَالَ لِي رَسُولُ اللَّهِ ﷺ «قُلْ لَا إِلَهَ إِلَّا اللَّهُ وَحْدَهُ ثَلَاثًا وَانْفُثْ عَنْ شِمَالِكَ ثَلَاثًا وَتَعَوَّذْ بِاللَّهِ مِنَ الشَّيْطَانِ وَلَا تَعُدْ»
ذِكْرُ الزَّجْرِ عَنْ أَنْ يَحْلِفَ الْمَرْءُ بِسَائِرِ الْمِلَلِ سِوَى الْإِسْلَامِ
Verily the Messenger of Allah ﷺ said: He who took an oath on a religion other than Islam as a liar would become so as he said, and he who slaughtered himself with a thing would be slaughtered with that on the Day of Resurrection. (Using translation from Muslim 110d)
عَنِ النَّبِيِّ ﷺ قَالَ «مَنْ حَلَفَ بِمِلَّةٍ سِوَى الْإِسْلَامِ كَاذِبًا مُتَعَمِّدًا فَهُوَ كَمَا قَالَ وَمَنْ قَتَلَ نَفْسَهُ بِشَيْءٍ عُذِّبَ بِهِ فِي نَارِ جَهَنَّمَ»
ذِكْرُ التَّغْلِيظِ عَلَى مَنْ حَلَفَ كَاذِبًا بِالْمِلَلِ الَّتِي هِيَ غَيْرُ الْإِسْلَامِ
"Whoever swears by a religion other than Islam, telling a lie, will be as he said, and whoever kills himself with something will be punished with it in the Hereafter." (Using translation from Nasāʾī 3771)
عَنْ رَسُولِ اللَّهِ ﷺ قَالَ «مَنْ حَلَفَ بِمِلَّةٍ سِوَى الْإِسْلَامِ كَاذِبًا فَهُوَ كَمَا قَالَ وَمَنْ قَتَلَ نَفْسَهُ بِشَيْءٍ فِي الدُّنْيَا عُذِّبَ بِهِ يَوْمَ الْقِيَامَةِ»
ذِكْرُ إِيجَابِ دُخُولِ النَّارِ لِلْحَالِفِ عَلَى مِنْبَرِ رَسُولِ اللَّهِ ﷺ كَذِبًا
[Machine] The Prophet ﷺ said, "Whoever takes an oath while standing on my pulpit with a false right hand, let him occupy his seat in Hellfire."
أَنَّ النَّبِيَّ ﷺ قَالَ «مَنْ حَلَفَ عَلَى مِنْبَرِي هَذَا بِيَمِينٍ آثِمَةٍ تَبَوَّأَ مَقْعَدَهُ مِنَ النَّارِ»
ذِكْرُ الزَّجْرِ عَنِ اسْتِعْمَالِ الْمُحَالَفَةِ الَّتِي كَانَ يَفْعَلُهَا أَهْلُ الْجَاهِلِيَّةِ
[Machine] Qais ibn Asim asked the Prophet ﷺ about swearing oaths, and he replied, "There is no swearing of oaths in Islam."
أَنَّ قَيْسَ بْنَ عَاصِمٍ سَأَلَ النَّبِيَّ ﷺ عَنِ الْحِلْفِ فَقَالَ «لَا حِلْفَ فِي الْإِسْلَامِ»
ذِكْرُ خَبَرٍ ثَانٍ يُصَرِّحُ بِصِحَّةِ مَا ذَكَرْنَاهُ
The Messenger of Allah ﷺ as saying: There is no alliance in Islam, and Islam strengthened the alliance made during pre-Islamic days. (Using translation from Abū Dāʾūd 2925)
قَالَ رَسُولُ اللَّهِ ﷺ «لَا حِلْفَ فِي الْإِسْلَامِ وَمَا كَانَ فِي الْجَاهِلِيَّةِ لَمْ يَزِدْهُ الْإِسْلَامُ إِلَّا شِدَّةً أَوْ حِدَّةً»

The Messenger of Allah ﷺ as saying: There is no alliance in Islam, and Islam strengthened the alliance made during pre-Islamic days. (Using translation from Abū Dāʾūd 2925)
أَنَّ النَّبِيَّ ﷺ قَالَ «لَا حِلْفَ فِي الْإِسْلَامِ وَأَيُّمَا حِلْفٍ كَانَ فِي الْجَاهِلِيَّةِ فَإِنَّ الْإِسْلَامَ لَمْ يَزِدْهُ إِلَّا شِدَّةً»
ذِكْرُ خَبَرٍ فِيهِ شُهُودِ الْمُصْطَفَى ﷺ حِلْفَ الْمُطَيَّبِينَ
[Machine] The Messenger of Allah ﷺ said, "I witnessed with my own eyes the oath of allegiance of the righteous people, and I do not wish to have red camels even if I were to break them."
قَالَ رَسُولُ اللَّهِ ﷺ «شَهِدْتُ مَعَ عُمُومَتِي حِلْفَ الْمُطَيَّبِينَ فَمَا أُحِبُّ أَنَّ لِي حُمْرَ النَّعَمِ وَإِنِّي أَنْكُثُهُ»
ذِكْرُ خَبَرٍ ثَانٍ يُصَرِّحُ بِصِحَّةِ مَا أَوْمَأْنَا إِلَيْهِ
[Machine] The Messenger of Allah ﷺ said, "I have not witnessed any oath of the Quraysh except for the oath of the Muttayyibin, and I do not like to have red camels even though I have found them. The Muttayyibin are Hashim, Umayyah, Zahrah, and Makhzum."
قَالَ رَسُولُ اللَّهِ ﷺ «مَا شَهِدْتُ مِنْ حِلْفِ قُرَيْشٍ إِلَّا حِلْفَ الْمُطَيَّبِينَ وَمَا أُحِبُّ أَنَّ لِي حُمْرَ النَّعَمِ وَإِنِّي كُنْتُ نَقَضَتْهُ» قَالَ وَالْمُطَيِّبُونَ هَاشِمٌ وَأُمَيَّةُ وَزَهْرَةُ وَمَخْزُومٌ
