19. Book of Vows
١٩۔ كِتَابُ النُّذُورِ
By Allah, I am certain that the Messenger of Allah ﷺ forbade that. (Using translation from Aḥmad 101)
«أَنَّ رَسُولَ اللَّهِ ﷺ نَهَى عَنِ النَّذْرِ»
ذِكْرُ الْعِلَّةِ الَّتِي مِنْ أَجْلِهَا زَجَرَ عَنِ النَّذْرِ
"Do not make vows, for a vow does not have any impact on the Qadar. Rather it is just a means of taking wealth from the miserly." (Using translation from Nasāʾī 3805)
قَالَ رَسُولُ اللَّهِ ﷺ «لَا تَنْذِرُوا فَإِنَّ النَّذْرَ لَا يَرُدُّ مِنَ الْقَدْرِ شَيْئًا وَإِنَّمَا يُسْتَخْرَجُ بِهِ مِنَ الْبَخِيلِ»
ذِكْرُ خَبَرٍ ثَانٍ يُصَرِّحُ بِذِكْرِ الْعِلَّةِ الَّتِي ذَكَرْنَاهَا قَبْلُ
[Machine] The Prophet Muhammad ﷺ said, "Indeed, a vow does not remove anything, but rather it is extracted from the stingy person."
قَالَ رَسُولُ اللَّهِ ﷺ «إِنَّ النَّذْرُ لَا يَرُدُّ شَيْئًا وَلَكِنْ يُسْتَخْرَجُ مِنَ الْبَخِيلِ»
ذِكْرُ الْإِخْبَارِ عَمَّا يَجِبُ عَلَى الْمَرْءِ مِنْ قِلَّةِ الِاشْتِغَالِ بِالنَّذْرِ فِي أَسْبَابِهِ
[Machine] "O Abu Abdur Rahman, indeed I had a son who was in the land of Persia, and the plague struck there. So I made a vow that if Allah saved my son, he would walk to the Kaaba. And indeed, my son arrived but then he died. Abdullah said to me, 'Fulfill your vow.' I replied, 'I vowed that my son would walk, but my son has died.' Abdullah became angry and said, 'Were you not forbidden to make vows? I heard the Prophet ﷺ say, "Indeed, vows do not bring anything forward or delay it, but Allah uses it to remove miserliness."' When I saw this, I said to the man, 'Go to Sa'id bin Musayyib and ask him.' So he went to him and asked him, and then returned to me. I asked him, 'What did he say to you?' He replied, 'Leave your son.' I asked, 'Does that absolve me?' Sa'id bin Musayyib said, 'What if your son had a debt and you paid it, would that absolve him?' I said, 'Yes.' He said, 'Then leave your son.'"
يَا أَبَا عَبْدِ الرَّحْمَنِ إِنَّ ابْنًا لِي كَانَ بِأَرْضِ فَارِسَ فَوَقَعَ بِهَا الطَّاعُونُ فَنَذَرْتُ إِنِ اللَّهُ نَجَّى لِي ابْنِي أَنْ يَمْشِيَ إِلَى الْكَعْبَةِ وَإِنَّ ابْنِي قَدِمَ فَمَاتَ فَقَالَ لَهُ عَبْدُ اللَّهِ أَوْفِ بِنَذْرِكَ فَقَالَ لَهُ الرَّجُلُ إِنَّمَا نَذَرْتُ أَنْ يَمْشِيَ ابْنِي وَإِنَّ ابْنِي قَدْ مَاتَ فَغَضِبَ عَبْدُ اللَّهِ وَقَالَ أَوَلَمْ تُنْهَوْا عَنِ النَّذْرِ سَمِعْتُ النَّبِيَّ ﷺ يَقُولُ «إِنَّ النَّذْرَ لَا يُقَدِّمُ شَيْئًا وَلَا يُؤَخِّرُهُ وَلَكِنَّ اللَّهَ يَنْزِعُ بِهِ مِنَ الْبَخِيلِ» فَلَمَّا رَأَيْتُ ذَلِكَ قُلْتُ لِلرَّجُلِ انْطَلِقْ إِلَى سَعِيدِ بْنِ الْمُسَيِّبِ فَسَلْهُ فَانْطَلَقَ إِلَيْهِ فَسَأَلَهُ ثُمَّ رَجَعَ فَقُلْتُ مَاذَا قَالَ لَكَ؟ قَالَ امْشِ عَنِ ابْنِكَ قَالَ أَيُجْزِئُ عَنِّي ذَلِكَ فَقَالَ سَعِيدُ بْنُ الْمُسَيِّبِ «أَرَأَيْتَ لَوَ كَانَ عَلَى ابْنِكَ دَيْنٌ فَقَضَيْتَهُ أَكَانَ يُجْزِئُ عَنْهُ» قُلْتُ بَلَى قَالَ فَامْشِ عَنِ ابْنِكَ
ذِكْرُ الْإِبَاحَةِ لِلْمَرْءِ الْوَفَاءَ بِنَذْرٍ تَقَدَّمَ مِنْهُ فِي الْجَاهِلِيَّةِ
O Messenger of Allah ﷺ, I vowed during the jahiliyyah to observe i’tikaf for one night in al-Masjid al-Haram. He said to him: “Fulfil your vow.” (Using translation from Aḥmad 255)
أَنْ يَعْتَكِفَ لَيْلَةً فِي الْمَسْجِدِ الْحَرَامِ فِي الْجَاهِلِيَّةِ فَقَالَ لَهُ رَسُولُ اللَّهِ ﷺ «أَوْفِ بِنَذْرِكَ»
ذِكْرُ خَبَرٍ ثَانٍ يُصَرِّحُ بِصِحَّةِ مَا ذَكَرْنَاهُ
O Messenger of Allah ﷺ, I vowed during the jahiliyyah to observe i’tikaf for one night in al-Masjid al-Haram. He said to him: “Fulfil your vow.” (Using translation from Aḥmad 255)
يَا رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْكَ إِنِّي نَذَرْتُ أَنْ أَعْتَكِفَ لَيْلَةً فِي الْمَسْجِدِ الْحَرَامِ فِي الْجَاهِلِيَّةِ فَقَالَ رَسُولُ اللَّهِ ﷺ «فَأَوْفِ بِنَذْرِكَ»
ذِكْرُ خَبَرٍ قَدْ يُوهِمُ غَيْرَ الْمُتَبَحِّرِ فِي صِنَاعَةِ الْعِلْمِ أَنَّهُ مُضَادُّ لِلْخَبَرَيْنِ اللَّذَيْنِ ذَكَرْنَاهُمَا
[Machine] When the Messenger of Allah ﷺ returned from Hunayn, Umar asked the Messenger of Allah ﷺ about a vow he made in the pre-Islamic era to observe a day of i'tikaf. The Messenger of Allah ﷺ ordered him to fulfill it. Umar proceeded while a captive girl from the spoils of Hunayn was with him. He said, "I left her in the homes of the Bedouins until I descended (from the mountain). Suddenly, I found myself amidst the spoils of Hunayn, and they were racing, saying, 'The Messenger of Allah ﷺ has freed us.' Umar said to Abdullah, 'Go and send her (the captive girl).' Abdullah went and sent her."
لَمَّا قَفَلَ رَسُولُ اللَّهِ ﷺ مِنْ حُنَيْنٍ سَأَلَ عُمَرُ رَسُولَ اللَّهِ ﷺ عَنْ نَذَرٍ كَانَ نَذَرَهُ فِي الْجَاهِلِيَّةِ اعْتِكَافِ يَوْمٍ «فَأَمَرَهُ بِهِ» قَالَ فَانْطَلَقَ بَيْنَ يَدَيْهِ قَالَ فَبَعَثَ مَعِي بِجَارِيَةٍ أَصَابَهَا مِنْ سَبْيِ حُنَيْنٍ قَالَ فَجَعَلْتُهَا فِي بُيُوتِ الْأَعْرَابِ حَتَّى نَزَلْتُ فَإِذَا أَنَا بِسَبْيِ حُنَيْنٍ فَخَرَجُوا يَسْعَوْنَ يَقُولُونَ قَدْ أَعْتَقَنَا رَسُولُ اللَّهِ ﷺ فَقَالَ عُمَرُ لِعَبْدِ اللَّهِ اذْهَبْ فَأَرْسِلْهَا قَالَ فَذَهَبْتُ فَأَرْسَلْتُهَا
ذِكْرُ الْإِبَاحَةِ لِلْمَرْءِ الرُّكُوبَ إِذَا نَذَرَ أَنْ يَمْشِيَ إِلَى الْبَيْتِ الْعَتِيقِ
[Machine] He informed him that he heard Anas ibn Malik saying that the Messenger of Allah ﷺ passed by a man who was being led between two people, so he asked about him and they said, "He vowed to walk to the Kaaba." So the Messenger of Allah ﷺ said, "Indeed, Allah is self-sufficient and has no need to punish himself." And he commanded him to ride.
أَخْبَرَهُ أَنَّهُ سَمِعَ أَنَسَ بْنَ مَالِكٍ يَقُولُ مَرَّ رَسُولُ اللَّهِ ﷺ بِرَجُلٍ يُهَادَى بَيْنَ اثْنَيْنِ فَسَأَلَ عَنْهُ فَقَالُوا نَذَرَ أَنْ يَمْشِيَ يَعْنِي إِلَى الْكَعْبَةِ فَقَالَ رَسُولُ اللَّهِ ﷺ «إِنَّ اللَّهَ لِغَنِيٌّ عَنْ تَعْذِيبِ هَذَا نَفْسَهُ» وَأَمَرَهُ أَنْ يَرْكَبَ
ذِكْرُ إِبَاحَةِ رُكُوبِ النَّاذِرِ الْمَشْيَ إِلَى بَيْتِ اللَّهِ الْحَرَامِ جَلَّ وَعَلَا
[Machine] The Prophet ﷺ saw a man being restricted by two people and said, "What is the matter with him?" They said, "He has vowed to perform Hajj on foot." The Messenger of Allah ﷺ said, "Indeed, Allah is not in need of his walking. He should ride instead."
رَأَى النَّبِيُّ ﷺ رَجُلًا يُهَادَى بَيْنَ اثْنَيْنِ فَقَالَ «مَا لَهُ؟ » قَالُوا نَذَرَ أَنْ يَحُجَّ مَاشِيًا فَقَالَ رَسُولُ اللَّهِ ﷺ «إِنَّ اللَّهَ غَنِيٌّ عَنْ مَشْيِ هَذَا فَلْيَرْكَبْ»
ذِكْرُ الْأَمْرِ لِلْنَاذِرِ الْحَجَّ مَاشِيًا بِالرُّكُوبِ مَعَ الْكَفَّارَةِ
[Machine] A man came to the Prophet ﷺ and said, "Indeed, my sister has made a vow to perform Hajj on foot." He said, "Tell her to ride and fulfill her vow."
جَاءَ رَجُلٌ إِلَى النَّبِيِّ ﷺ فَقَالَ إِنَّ أُخْتِي جَعَلَتْ عَلَى نَفْسِهَا أَنْ تَحُجَّ مَاشِيَةً قَالَ «فَمُرْهَا فَلْتَرْكَبْ وَلْتُكَفِّرْ»
ذِكْرُ الْأَمْرِ بِوَفَاءِ نَذَرِ النَّاذِرِ إِذَا نَذَرَ مَا لِلَّهِ فِيهِ طَاعَةٌ
While the Prophet ﷺ was preaching a man was standing in the sun. He asked about him. They said: He is Abu Isra'il who has taken a vow to stand and not to sit, or go into shade, or speak, but to fast. Thereupon he said: Command him to speak, to go into the shade, sit and complete his fast. (Using translation from Abū Dāʾūd 3300)
بَيْنَمَا النَّبِيُّ ﷺ يَخْطُبُ إِذْ رَأَى رَجُلًا قَائِمًا فِي الشَّمْسِ فَسَأَلَ عَنْهُ فَقَالُوا هَذَا أَبُو إِسْرَائِيلَ نَذَرَ أَنْ يَقُومَ فِي الشَّمْسِ فَلَا يَقْعُدَ وَلَا يَسْتَظِلُّ وَلَا يَتَكَلَّمُ وَلَا يُفْطِرُ فَقَالَ «مُرُوهُ فَلْيَقْعُدْ وَلْيَسْتَظِلَّ وَلْيَتَكَلَّمْ وَلْيَصُمْ وَلْيُفْطِرْ (*)»
ذِكْرُ الْخَبَرِ الدَّالِّ عَلَى إِبَاحَةِ قَضَاءِ النَّاذِرِ نَذَرَهُ إِذَا لَمْ يَكُنْ بِمُحَرَّمٍ عَلَيْهِ
[Machine] The Messenger of Allah ﷺ returned from one of his expeditions, and a black servant girl came to him and said, "O Messenger of Allah, I made a vow that if Allah returns you safely, I will hit you on the head with a tambourine." The Messenger of Allah ﷺ said, "If you have made a vow, then fulfill it. Otherwise, do not do it." She said, "I indeed made a vow." So the Messenger of Allah ﷺ sat down and she hit him on the head with the tambourine.
رَجَعَ رَسُولُ اللَّهِ ﷺ مِنْ بَعْضِ مَغَازِيهِ فَجَاءَتْ جَارِيَةٌ سَوْدَاءُ فَقَالَتْ يَا رَسُولَ اللَّهِ إِنِّي نَذَرْتُ إِنْ رَدَّكَ اللَّهُ سَالِمًا أَنْ أَضْرِبَ عَلَى رَأْسِكَ بِالدُّفِّ فَقَالَ رَسُولُ اللَّهِ ﷺ «إِنْ نَذَرْتِ فَافْعَلِي وَإِلَّا فَلَا» قَالَتْ إِنِّي كُنْتُ نَذَرْتُ فَقَعَدَ رَسُولُ اللَّهِ ﷺ فَضَرَبَتْ بِالدُّفِّ
ذِكْرُ الْبَيَانِ بِأَنَّ نَذْرِ الْمَرْءِ فِيمَا لَيْسَ لِلَّهِ فِيهِ رِضًا لَا يَحِلُّ لَهُ الْوَفَاءُ بِهِ
"Whoever vows to obey Allah, let him obey Him, and whoever vows to disobey Allah, let him not disobey Him." (Using translation from Nasāʾī 3806)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «مَنْ نَذَرَ أَنْ يُطِيعَ اللَّهَ فَلْيُطِعْهُ وَمَنْ نَذَرَ أَنْ يَعْصِيَ اللَّهَ فَلَا يَعْصِهِ»
ذِكْرُ الزَّجْرِ عَنْ وَفَاءِ النَّاذِرِ بِنَذْرِهِ إِذَا كَانَ لِلَّهِ فِيهِ مَعْصِيَةٌ
"Whoever vows to obey Allah, let him obey Him, and whoever vows to disobey Allah, let him not disobey Him." (Using translation from Nasāʾī 3806)
عَنْ رَسُولِ اللَّهِ ﷺ قَالَ «مَنْ نَذَرَ أَنْ يُطِيعَ اللَّهَ فَلْيُطِعْهُ وَمَنْ نَذَرَ أَنْ يَعْصِيَ اللَّهَ فَلَا يَعْصِهِ»
ذِكْرُ الْبَيَانِ بِأَنَّ النَّذْرَ إِذَا كَانَ لِلَّهِ فِيهِ مَعْصِيَةٌ لَيْسَ عَلَى النَّاذِرِ الْوَفَاءُ بِهِ

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «مَنْ نَذَرَ أَنْ يُطِيعَ اللَّهَ فَلْيُطِعْهُ وَمَنْ نَذَرَ أَنْ يَعْصِيَ اللَّهَ فَلَا يَعْصِهِ»
ذِكْرُ الْخَبَرِ الْمُدْحِضِ قَوْلَ مَنْ زَعَمَ أَنَّ هَذَا الْخَبَرَ تَفَرَّدَ بِهِ طَلْحَةُ بْنُ عَبْدِ الْمَلِكِ
"Whoever vows to obey Allah, let him obey Him, and whoever vows to disobey Allah, let him not disobey Him." (Using translation from Nasāʾī 3806)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «مَنْ نَذَرَ أَنْ يَعْصِيَ اللَّهَ فَلَا يَعْصِهِ»
ذِكْرُ الزَّجْرِ عَنْ أَنْ يَفِيَ الْمَرْءِ بِنَذْرِ الْمَعْصِيَةِ، وَمَا لَمْ يَكُنْ مَالِكًا لَهُ فِي وَقْتٍ نَذْرِهِ
[Machine] From the Prophet ﷺ who said, "There is no fulfillment of a vow made while engaging in disobedience, and there is no fulfillment of a vow in something that the servant or the son of Adam does not possess."
عَنِ النَّبِيِّ ﷺ قَالَ «لَا وَفَاءَ لِنَذْرٍ فِي مَعْصِيَةٍ وَلَا وَفَاءَ لِنَذْرٍ فِي مَا لَا يَمْلِكُ الْعَبْدُ أَوِ ابْنُ آدَمَ»
ذِكْرُ الْإِخْبَارِ عَنْ نَفْيِ جَوَازِ وَفَاءِ نَذْرِ النَّاذِرِ إِذَا نَذَرَ فِيمَا لَا يَمْلِكُ، أَوْ كَانَ لِلَّهِ فِيهِ مَعْصِيَةٌ
[Machine] "A woman from the Muslims was captured by the polytheists, who had previously captured a camel belonging to the Messenger of Allah ﷺ . She found the people in a state of negligence and vowed that if Allah saved her, she would sacrifice the camel. He granted her safety and she arrived in the city, intending to sacrifice the camel. However, the people forbade her and the matter was brought to the attention of the Messenger of Allah ﷺ . He said, 'How bad is the way she intends to fulfill her vow!' Then he said, 'There is no fulfilling of a vow made by the son of Adam in disobedience to Allah or in something he does not possess.'"
أَنَّ امْرَأَةً مِنَ الْمُسْلِمِينَ سَبَاهَا الْمُشْرِكُونَ وَكَانُوا أَصَابُوا نَاقَةً لِرَسُولِ اللَّهِ ﷺ قَبْلَ ذَلِكَ فَوَجَدَتْ مِنَ الْقَوْمِ غَفَلَةً فَنَذَرَتْ إِنِ اللَّهُ أَنْجَاهَا عَلَيْهَا أَنْ تَنْحَرَهَا قَالَ فَأَنْجَاهَا وَقَدِمَتِ الْمَدِينَةَ فَذَهَبَتْ لِتَنْحَرَهَا فَمَنَعَهَا النَّاسُ وَذُكِرَ لِرَسُولِ اللَّهِ ﷺ فَقَالَ رَسُولُ اللَّهِ ﷺ «بِئْسَمَا جَزَيْتِيهَا» ثُمَّ قَالَ «لَا وَفَاءَ لِنَذْرٍ لِابْنِ آدَمَ فِي مَعْصِيَةٍ وَلَا فِيمَا لَا يَمْلِكُ»
ذِكْرُ الْأَمْرِ بِقَضَاءِ نَذَرِ النَّاذِرِ إِذَا مَاتَ قَبْلَ أَنْ يَفِيَ بِنَذْرِهِ
Sa'd b. 'Ubadah asked the Messenger of Allah ﷺ: My Mother has died and she could not fulfill her vow which she had taken. The Messenger of Allah ﷺ said: Fulfill it on her behalf. (Using translation from Abū Dāʾūd 3307)
أَنَّ سَعْدَ بْنَ عُبَادَةَ اسْتَفْتَى رَسُولَ اللَّهِ ﷺ فَقَالَ إِنَّ أُمِّي مَاتَتْ وَعَلَيْهَا نَذَرٌ لَمْ تَقْضِهِ فَقَالَ رَسُولُ اللَّهِ ﷺ «اقْضِهِ عَنْهَا»
ذِكْرُ الْإِبَاحَةِ لِلْمَرْءِ أَنْ يَقْضِيَ نَذَرَ النَّاذِرَةِ إِذَا مَاتَتْ قَبْلَ قَضَاءِ نَذْرِهَا
"Fulfill it on her behalf." (Using translation from Nasāʾī 3817)
أَنَّ سَعْدَ بْنَ عُبَادَةَ اسْتَفْتَى رَسُولَ اللَّهِ ﷺ فِي نَذَرٍ نَذَرَتْهُ أُمُّهُ ثُمَّ مَاتَتْ قَبْلَ أَنْ تَقْضِيَهُ فَقَالَ «اقْضِهِ عَنْهَا»
ذِكْرُ الْإِبَاحَةِ لِلْمَرْءِ قَضَاءَ نَذَرِ النَّاذِرَةِ إِذَا مَاتَتْ قَبْلَ أَنْ تَفِيَ بِهِ
Sa'd bin 'Ubadah came to the Prophet and said: "My mother has died and she had a vow to fulfill but she did not do so." He said: "Fulfill it on her behalf." (Using translation from Nasāʾī 3663)
جَاءَ سَعْدُ بْنُ عُبَادَةَ إِلَى النَّبِيِّ ﷺ فَقَالَ إِنَّ أُمِّي مَاتَتْ وَعَلَيْهَا نَذَرٌ لَمْ تَقْضِهِ فَقَالَ لَهُ النَّبِيُّ ﷺ «اقْضِهِ عَنْهَا»
ذِكْرُ الْبَيَانِ بِأَنَّ نَذَرَ النَّاذِرَةِ إِذَا مَاتَتْ قَبْلَ أَنْ تَفِيَ بِنَذْرِهَا لِبَعْضِ قَرَابَتِهَا قَضَاءُ ذَلِكَ النَّذْرِ عَنْهَا، وَإِنْ كَانَ النَّذْرُ صَوْمًا
[Machine] A woman came to the Prophet ﷺ and said, "Indeed, my mother has passed away and she had a fast to fulfill from a vow." The Prophet ﷺ said to her, "Were you her executor of debts if she had any?" She replied, "Yes." He said, "Then fast on behalf of your mother."
أَنَّ امْرَأَةً جَاءَتْ إِلَى النَّبِيِّ ﷺ فَقَالَتْ إِنَّ أُمِّي مَاتَتْ وَعَلَيْهَا صَوْمٌ مِنْ نَذْرٍ فَقَالَ لَهَا النَّبِيُّ ﷺ «أَكُنْتِ قَاضِيَةً عَنْ أُمِّكِ دَيْنًا لَوْ كَانَ عَلَيْهَا؟ » قَالَتْ نَعَمْ قَالَ «فَصُومِي عَنْ أُمِّكِ»
