17. Book of Freeing Slaves

١٧۔ كِتَابُ الْعِتْقِ

17.5 [Machine] Translation: "Inheritance in cases of diseases, mentioning what is ruled for someone who freed slaves at his death, having no other property besides them

١٧۔٥ بَابُ الْعِتْقِ فِي الْمَرَضِ ذِكْرُ مَا يُحْكَمُ لِمَنْ أَعْتَقَ عَبِيدًا لَهُ عِنْدَ مَوْتِهِ لَا مَالَ لَهُ غَيْرُهُمْ

ibnhibban:4320Abū Khalīfah > Musaddad b. Musarhad > Yazīd b. Zurayʿ > Yūnus b. ʿUbayd > al-Ḥasan > ʿImrān b. Ḥuṣayn

A man who had no other property emancipated six slaves of his at the time of the death. When the Prophet ﷺ was informed about it, he spoke severely of him. He then called them, divided them into three sections, cast lots among them, and emancipated two and kept four in slavery. (Using translation from Abū Dāʾūd 3958)   

ابن حبّان:٤٣٢٠أَخْبَرَنَا أَبُو خَلِيفَةَ حَدَّثَنَا مُسَدَّدُ بْنُ مُسَرْهَدٍ عَنْ يَزِيدَ بْنَ زُرَيْعٍ عَنْ يُونُسَ بْنِ عُبَيْدٍ عَنِ الْحَسَنِ عَنْ عِمْرَانَ بْنِ حُصَيْنٍ

«أَنَّ رَجُلًا كَانَ لَهُ سِتَّةُ أَعْبُدٍ فَأَعْتَقَهُمْ عِنْدَ مَوْتِهِ وَلَمْ يَكُنْ لَهُ مَالٌ غَيْرُهُمْ فَرُفِعَ ذَلِكَ إِلَى النَّبِيِّ ﷺ فَكَرِهَهُ وَجَزَّأَهُمْ ثَلَاثَةَ أَجْزَاءٍ فَأَقْرَعَ بَيْنَهُمْ فَأَعْتَقَ اثْنَيْنِ وَأَرَقَّ أَرْبَعَةً»
