16. Book of Divorce
١٦۔ كِتَابُ الطَّلَاقِ
ذِكْرُ الْأَمْرِ لِمَنْ أَرَادَ أَنْ يُطَلِّقَ امْرَأَتَهُ أَنْ يُطَلِّقَهَا فِي طُهْرِهَا لَا فِي حَيْضِهَا
"Abdullah has divorced his wife while she was menstruating." He said: "Tell 'Abdullah to take her back, then leave her until she becomes pure from this menstrual period, then menstruates again, then when she becomes pure again, if he wishes he may separate from her before having intercourse with her, or if he wishes he may keep her. This is the time when Allah, the Mighty and Sublime, has stated that women may be divorced." (Using translation from Nasāʾī 3389)
أَنَّهُ طَلَّقَ امْرَأَتَهُ تَطْلِيقَةً وَهِيَ حَائِضٌ فَاسْتَفْتَى عُمَرُ رَسُولَ اللَّهِ ﷺ فَقَالَ إِنَّ عَبْدَ اللَّهِ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَقَالَ «مُرْ عَبْدَ اللَّهِ فَلْيُرَاجِعْهَا ثُمَّ لِيُمْسِكْهَا حَتَّى تَطْهُرَ مِنْ حَيْضَتِهَا هَذِهِ فَإِذَا حَاضَتْ حَيْضَةً أُخْرَى فَطَهُرَتْ فَإِنْ شَاءَ فَلْيُطَلِّقْهَا قَبْلَ أَنْ يُجَامِعَهَا وَإِنْ شَاءَ فَلْيُمْسِكْهَا»
ذِكْرُ الزَّجْرِ عَنْ أَنْ يُطَلِّقَ الْمَرْءُ امْرَأَتَهُ فِي حَيْضِهَا دُونَ طُهْرِهَا
[Machine] I divorced my wife while she was menstruating. The Messenger of Allah ﷺ responded to me, "This divorce still counts until you divorce her while she is in a state of purity."
طَلَّقْتُ امْرَأَتِي وَهِيَ حَائِضٌ «فَرَدَّ عَلَيَّ رَسُولُ اللَّهِ ﷺ ذَلِكَ حَتَّى طَلَّقْتُهَا وَهِيَ طَاهِرٌ»
ذِكْرُ الزَّجْرِ عَنْ أَنْ يُطَلِّقَ الْمَرْءُ النِّسَاءَ وَيَرْتَجِعْهُنَّ حَتَّى يَكْثُرَ ذَلِكَ مِنْهُ
the Messenger of Allah said: What is wrong with people who play with the limits imposed by Allah, and one of them says: "I divorce you, I take you back, I divorce you?" (Using translation from Ibn Mājah 2017)
قَالَ رَسُولُ اللَّهِ ﷺ «مَا بَالُ أَحَدِكُمْ يَلْعَبُ بِحُدُودِ اللَّهِ يَقُولُ قَدْ طَلَّقْتُ قَدْ رَاجَعْتُ؟! »
ذِكْرُ الْخَبَرِ الدَّالِّ عَلَى أَنَّ الْكِنَايَاتِ فِي الطَّلَاقِ إِنْ أُرِيدَ بِهَا الطَّلَاقَ كَانَ طَلَاقًا عَلَى حَسَبِ نِيَّةِ الْمَرْءِ فِيهِ
"I asked Zuhri: 'Which of the wives of the Prophet ﷺ sought refuge with Allah from him? He said : "Urwah told me, (narrating) from 'Aishah, that when the daughter of Jawn entered upon the Messenger of Allah ﷺ and he came close to her, she said: "I seek refuge with Allah from you." the Messenger of Allah ﷺ said : "You have sought refuge in the Almighty" go to your family." (Using translation from Ibn Mājah 2050)
سَأَلْتُ الزُّهْرِيَّ أَيُّ أَزْوَاجِ النَّبِيِّ ﷺ اسْتَعَاذَتْ مِنْهُ قَالَ أَخْبَرَنِي عُرْوَةُ بْنُ الزُّبَيْرِ عَنْ عَائِشَةَ أَنَّ بِنْتَ الْجَوْنِ لَمَّا دَخَلَتْ عَلَى رَسُولِ اللَّهِ ﷺ فَدَنَا مِنْهَا قَالَتْ أَعُوذُ بِاللَّهِ مِنْكَ فَقَالَ رَسُولُ اللَّهِ ﷺ «عُذْتِ بِعَظِيمٍ الْحَقِي بِأَهْلِكِ» قَالَ الزُّهْرِيُّ «الْحَقِي بِأَهْلِكِ تَطْلِيقَةٌ»
ذِكْرُ الْبَيَانِ بِأَنَّ تَخْيِيرَ الْمَرْءِ امْرَأَتَهُ بَيْنَ فِرَاقِهِ، أَوِ الْكَوْنِ مَعَهُ إِذَا اخْتَارَتْ نَفْسُهُ لَمْ يَكُنْ ذَلِكَ طَلَاقًا
"The Messenger of Allah gave us the choice and we chose him; was that a divorce?" (Using translation from Nasāʾī 3441)
«خَيَّرَنَا رَسُولُ اللَّهِ ﷺ فَاخْتَرْنَاهُ» فَهَلْ كَانَ ذَلِكَ طَلَاقًا؟
ذِكْرُ الْبَيَانِ بِأَنَّ الْأَمَةَ الْمُزَوَّجَةَ إِذَا أُعْتِقَتْ كَانَ لَهَا الْخِيَارُ فِي الْكَوْنِ تَحْتَ زَوْجِهَا الْعَبْدِ أَوْ فِرَاقِهِ
"Three judgments were established because of Barirah. Her masters wanted to sell her but they stipulated that Al-Wala should still be to them. I mentioned that to the Prophet and he said: 'Buy her and set her free, for Al-Wala, is to the one who sets the slave free.' She was set free and the Messenger of Allah gave her the choice, and she chose herself. And she used to be given charity and she would give some of it as a gift to us. I mentioned that to the Prophet and he said: 'Eat it for it is charity for her and a gift for us.'" (Using translation from Nasāʾī 3448)
كَانَ فِي بَرِيرَةَ ثَلَاثُ قَضِيَّاتٍ أَرَادَ أَهْلُهَا أَنْ يَبِيعُوهَا وَيَشْتَرِطُوا الْوَلَاءَ فَذَكَرْتُ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ «اشْتَرِيهَا وَأَعْتِقِيهَا فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ» وَعَتَقَتْ فَخَيَّرَهَا رَسُولُ اللَّهِ ﷺ فَاخْتَارَتْ نَفْسَهَا وَكَانَتْ يُتَصَدَّقُ عَلَيْهَا فَتُهْدِي لَنَا مِنْهُ فَذَكَرْتُ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ «كُلُوا فَإِنَّهُ عَلَيْهَا صَدَقَةٌ وَهُوَ لَكُمْ هَدِيَّةٌ»
ذِكْرُ مَا يَجِبُ لِلْجَارِيَةِ إِذَا أُعْتِقَتْ وَهِيَ تَحْتَ عَبْدٍ أَنْ تَخْتَارَ فِرَاقَهُ أَوِ الْكَوْنَ مَعَهُ
[Machine] The Messenger of Allah (Peace be upon him) offered Barirah a choice, and she chose for herself.
«خَيَّرَ رَسُولُ اللَّهِ ﷺ بَرِيرَةَ فَاخْتَارَتْ نَفْسَهَا»
ذِكْرُ الْبَيَانِ بِأَنَّ الْجَارِيَةَ إِذَا أُعْتِقَتْ وَهِيَ تَحْتَ عَبْدٍ لَهَا الْخِيَارُ فِي فِرَاقِهِ أَوِ الْكَوْنِ مَعَهُ
[Machine] "Free her, for indeed loyalty belongs to the one who bestows favors and grants blessings." She said, "So I freed her." The Messenger of Allah ﷺ then gave her the choice and she said, "If I am given this and this, I will not be with him." Al-Aswad said, "And her husband was a free man."
ﷺ «اعْتِقِيهَا فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْطَى الْوَرِقَ وَوَلِيَ النِّعْمَةَ» قَالَتْ فَأَعْتَقْتُهَا فَخَيَّرَهَا رَسُولُ اللَّهِ ﷺ فَقَالَتْ لَوْ أُعْطِيتُ كَذَا وَكَذَا مَا كُنْتُ مَعَهُ قَالَ الْأَسْوَدُ «وَكَانَ زَوْجُهَا حُرًّا»
ذِكْرُ الْبَيَانِ بِأَنَّ زَوْجَ بَرِيرَةَ كَانَ عَبْدًا لَا حُرًّا، وَأَنَّ الْأَسْوَدَ وَاهِمٌ فِي قَوْلِهِ: كَانَ حُرًّا
"Barirah made a contract that she would be freed in return for nine Awaq, one Uqiyyah to be paid each year." She came to 'Aishah asking for help and she said: "No, not unless they agree to accept the sum in one payment, and that the Wala' will go to me." Barirah went and spoke to her masters but they insisted that the Wala' should be for them. She came to 'Aishah and the Messenger of Allah came, and she told her what her masters had said. She said: "No, by Allah, not unless Wala' is to me." The Messenger of Allah said: "What is this?" She said: "O Messenger of Allah, Barirah came to me and asked me to help her with her contract of manumission, and I said no, not unless they agree to accept the sum in one payment, and that the Wala' will be for me. She mentioned that to her masters and they insisted that the Wala' should be for them." The Messenger of Allah said: "Buy her, and stipulate that the Wala' is for the one who sets the slave free." Then he stood up and addressed the people and said: "What is the matter with people who stipulate conditions that are not in the Book of Allah, the Mighty and Sublime? They say: 'I set so-and-so free but the Wala' will be to me.' Every condition that is not in the Book of Allah, the Mighty and Sublime, is a false condition, even if there are a hundred conditions." And the Messenger of Allah gave her the choice with regard to her husband who was still a slave, and she chose herself. 'Urwah said: "If he had been free the Messenger of Allah would not have given her the choice." (Using translation from Nasāʾī 3451)
كَاتَبَتْ بَرِيرَةَ عَلَى نَفْسِهَا بِتِسْعَةِ أَوَاقٍ فِي كُلِّ سَنَةٍ أُوقِيَّةً فَأَتَتْ عَائِشَةَ تَسْتَعِينُهَا فَقَالَتْ لَا إِلَّا أَنْ يَشَاؤُوا أَنْ أَعُدَّهَا لَهُمْ عَدَّةً وَاحِدَةً وَيَكُونَ الْوَلَاءُ لِي فَذَهَبَتْ بَرِيرَةُ فَكَلَّمَتْ بِذَلِكَ أَهْلَهَا فَأَبَوْا عَلَيْهَا إِلَّا أَنْ يَكُونَ الْوَلَاءُ لَهُمْ فَجَاءَتْ إِلَى عَائِشَةَ وَجَاءَ رَسُولُ اللَّهِ ﷺ عِنْدَ ذَلِكَ فَقَالَتْ لَهَا مَا قَالَ أَهْلُهَا فَقَالَتْ لَاهَا اللَّهِ إِذًا إِلَّا أَنْ يَكُونَ الْوَلَاءُ لِي فَقَالَ رَسُولُ اللَّهِ ﷺ «مَا هَذَا؟ » فَقُلْتُ يَا رَسُولَ اللَّهِ إِنَّ بَرِيرَةَ أَتَتْنِي تَسْتَعِينُنِي عَلَى كِتَابَتِهَا فَقُلْتُ لَا إِلَّا أَنْ يَشَاؤُوا أَنْ أَعُدَّهَا لَهُمْ عَدَّةً وَاحِدَةً وَيَكُونَ الْوَلَاءُ لِي فَذَكَرَتْ ذَلِكَ لِأَهْلِهَا فَأَبَوْا عَلَيْهَا إِلَّا أَنْ يَكُونَ الْوَلَاءُ لَهُمْ فَقَالَ رَسُولُ اللَّهِ ﷺ «ابْتَاعِيهَا وَاشْتَرِطِي لَهُمُ الْوَلَاءَ وَأَعْتِقِيهَا فَإِنَّ الْوَلَاءَ لِمَنْ أَعْتَقَ»
ذِكْرُ الْخَبَرِ الْمُصَرِّحِ بِأَنَّ زَوْجَ بَرِيرَةَ كَانَ عَبْدًا لَا حُرًّا
The husband of Barirah was a slave called Mughith. It is as if I can see him walking behind her weeping, with the tears running down onto his beard. The Prophet [SAW] said to Al-'Abbas: "O 'Abbas, are you not amazed by the love of Mughith for Barirah and the hatred of Barirah for Mughith?" The Messenger of Allah [SAW] said to her: "Why don't you take him back, for he is the father of your child?" She said: "O Messenger of Allah, are you commanding me (to do so)?" He said: "I am just interceding." She said: "I have no need of him." (Using translation from Nasāʾī 5417)
يُقَالُ لَهُ مُغِيثٌ كَأَنِّي أَنْظُرُ إِلَيْهِ يَطُوفُ خَلْفَهَا يَبْكِي وَدُمُوعُهُ تَسِيلُ عَلَى لِحْيَتِهِ فَقَالَ النَّبِيُّ ﷺ لِلْعَبَّاسِ «يَا عَبَّاسُ أَلَا تَعْجَبُ مِنْ شِدَّةِ حُبِّ مُغِيثٍ بَرِيرَةَ وَمِنْ شِدَّةِ بُغْضِ بَرِيرَةَ مُغِيثًا» فَقَالَ لَهَا ﷺ «لَوْ رَاجَعْتِيهِ فَإِنَّهُ أَبُو وَلَدِكِ» قَالَتْ يَا رَسُولَ اللَّهِ أَتَأْمُرُنِي بِهِ؟ قَالَ ﷺ «إِنَّمَا أَنَا شَافِعٌ» قَالَتْ فَلَا حَاجَةَ لِي فِيهِ
16.1.6 Subsection
١٦۔١۔٦ ذِكْرُ الْبَيَانِ بِأَنَّ عَائِشَةَ لَمَّا خَيَّرَهَا الْمُصْطَفَى ﷺ اخْتَارَتِ اللَّهَ جَلَّ وَعَلَا وَصَفِيَّهُ ﷺ
I was eager to ask 'Umar about the two wives of the Prophet ﷺ concerning whom Allah said, “If you two (wives of the Prophet ﷺ turn in repentance to Allah, (it will be better for you), your hearts are indeed so inclined (to oppose what the Prophet ﷺ likes)” [at-Tahreem 66:4], until 'Umar went for Hajj and I went with him. When we were partway there, 'Umar turned aside and I turned aside with him, bringing the jug. He relieved himself, then he came to me and I poured water onto his hands, and he did wudoo’. I said: “O Ameer al -Mu'mineen, who are the two wives of the Prophet ﷺ of whom Allah said: ‘If you two (wives of the Prophet ﷺ) turn in repentance to Allah, (it will be better for you), your hearts are indeed so inclined (to oppose what the Prophet ﷺ likes)’?” [at-Tahreem 66:4] 'Umar said, “How strange of you, O Ibn 'Abbas”, (az-Zuhri said: By Allah, he did not like the question, but he did not conceal anything.) He said, “They were Hafsah and 'A'ishah.” Then he started to narrate the hadeeth and said: We people of Quraish were a people who dominated women, but when we came to Madinah we found a people who were dominated by their women, and our women started to learn from their women. My house was among Banu Umayyah bin Zaid in al-'Awali. One day I got angry with my wife, and she argued with me. I did not like her to argue with me, but she said: Do you not like me to argue with you? By Allah, the wives of the Prophet ﷺ argue with him, and one of them will forsake him all day until night comes, I went and entered upon Hafsah, and I said: Do you argue with the Messenger of Allah ﷺ? She said: Yes. I said: Does one of you forsake him all day until night comes? She said: Yes. I said: Any one of you who does that is doomed and lost. Does any one of you feel assured that Allah will not be angry with her because of the anger of His Messenger ﷺ, for then she will be doomed? Do not argue with the Messenger of Allah ﷺ and do not ask him for anything. Ask me for whatever you want. And do not be misled by the fact that your neighbour is more beautiful than you and more beloved to the Messenger of Allah ﷺ than you – referring to 'A'ishah. And ‘Umar said: I had a neighbour among the Ansar. We used to take turns to go down to the Messenger of Allah ﷺ. He would go down one day and I would go down the next. He would bring me the news of the Revelation and other things, and I would do likewise. We were saying that Ghassan were shoeing their horses to attack us. My friend went down, then he came to me at night and knocked on my door, then he called out to me. I went out to him and he said: Something terrible has happened! I said: What? Have Ghassan come? He said: No, it is more terrible than that and worse. The Prophet ﷺ has divorced his wives! I said: Hafsah is doomed and lost! I thought that this would happen. Then when I had prayed Fajr, I got dressed, then I went down and entered upon Hafsah, who was weeping. I said: Has the Messenger of Allah ﷺdivorced you? She said: I do not know. He has secluded himself in this loft. I went to a black slave of his and said: Ask for permission for ‘Umar to enter. He went in, then he came out to me and said: I mentioned you to him but he did not say anything, I went away and came to the minbar, where I sat down. By it was a group of people, some of whom were weeping. I sat for a little while, then I could not bear it any longer, so I went to the slave and said: Ask for permission for ‘Umar to enter. He went in, then he came out to me and said: I mentioned you to him but he did not say anything. I turned to leave, then the slave called me and said: Go in, he has given you permission. So I went in and greeted the Messenger of Allah ﷺ with salam. He was resting on a reed mat that had left marks on his side. I said: O Messenger of Allah, have you divorced your wives? He looked up at me and said, “No.” I said: Allah Akbar! if you had seen us, O Messenger of Allah, we Quraish were a people who dominated women, but when we came to Madinah we found a people who were dominated by their women, and our women started to learn from their women. I got angry with my wife one day, and she started to argue with me. I did not like her to argue with me, but she said: Do you not like me to argue with you? By Allah, the wives of the Prophet ﷺ argue with him, and one of them will forsake him all day until night comes. I said: Any one of them who does that is doomed and lost. Does one of them feel assured that Allah will not be angry with her because of the anger of His Messenger ﷺ,then she will be doomed? The Messenger of Allah ﷺ smiled. I said: O Messenger of Allah, I entered upon Hafsah and I said: Do not be misled by the fact that your neighbour (i.e. ‘Aa'ishah) is more beautiful than you and more beloved to the Messenger of Allah ﷺ than you. The Messenger of Allah ﷺ smiled again. I said: O Messenger of Allah, may I speak to you freely? He said: “Yes.” So I sat down and looked around the room, and by Allah, I did not see anything in it to please the eye except three hides. I said: Pray to Allah, O Messenger of Allah, to make life prosperous for your ummah, for He has made life prosperous for the Persians and Romans, but they do not worship Allah, may He be glorified and exalted. He sat up straight and said: “Are you doubting. O son of al-Khattab? They are people whose good things have been hastened for them in this world.” I said: Pray for forgiveness for me, O Messenger of Allah. He had sworn that he would not enter upon them for a month, because he was so annoyed with them until Allah rebuked him. (Using translation from Aḥmad 222)
لَمْ أَزَلْ حَرِيصًا أَنْ أَسْأَلَ عُمَرَ بْنَ الْخَطَّابِ عَنِ الْمَرْأَتَيْنِ اللَّتَيْنِ مِنْ أَزْوَاجِ النَّبِيِّ ﷺ قَالَ اللَّهُ {إِنْ تَتُوبَا إِلَى اللَّهِ فَقَدْ صَغَتْ قُلُوبُكُمَا} حَتَّى حَجَّ عُمَرُ فَحَجَجْتُ مَعَهُ فَلَمَّا كَانَ فِي بَعْضِ الطَّرِيقِ عَدَلَ لِيَتَوَضَّأُ وَعَدَلْتُ مَعَهُ بِالْإِدَاوَةِ فَتَبَرَّزَ ثُمَّ أَتَانِي فَسَكَبْتُ عَلَى يَدَيْهِ فَتَوَضَّأَ فَقُلْتُ يَا أَمِيرَ الْمُؤْمِنِينَ مَنِ الْمَرْأَتَانِ مِنْ أَزْوَاجِ النَّبِيِّ ﷺ اللَّتَانِ قَالَ اللَّهُ {إِنْ تَتُوبَا إِلَى اللَّهِ فَقَدْ صَغَتْ قُلُوبُكُمَا} فَقَالَ عُمَرُ وَاعَجَبًا لَكَ يَا ابْنَ عَبَّاسٍ ثُمَّ قَالَ هِيَ عَائِشَةُ وَحَفْصَةُ ثُمَّ أَنْشَأَ يَسُوقُ الْحَدِيثَ فَقَالَ كُنَّا مَعْشَرُ قُرَيْشٍ قَوْمًا نَغْلِبُ النِّسَاءَ فَلَمَّا قَدِمْنَا الْمَدِينَةَ وَجَدْنَاهُمْ قَوْمًا تَغْلِبُهُمْ نِسَاؤُهُمْ فَطَفِقَ نِسَاؤُنَا يَتَعَلَّمْنَ مِنْ نِسَائِهِمْ وَكَانَ مَنْزِلِي فِي بَنِي أُمَيَّةَ بْنِ زَيْدٍ فِي الْعَوَالِي قَالَ فَتَغَضَّبْتُ يَوْمًا عَلَى امْرَأَتِي فَإِذَا هِيَ تُرَاجِعْنِي فَأَنْكَرْتُ أَنْ تُرَاجِعَنِي فَقَالَتْ مَا تُنْكِرُ أَنْ أُرَاجِعَكَ فَوَاللَّهِ إِنَّ أَزْوَاجَ النَّبِيِّ ﷺ لَتُرَاجِعْنَهُ وَتَهْجُرُهُ إِحْدَاهُنَّ الْيَوْمَ إِلَى اللَّيْلِ قَالَ فَانْطَلَقْتُ فَدَخَلْتُ عَلَى حَفْصَةَ فَقُلْتُ أَتُرَاجِعِينَ رَسُولَ اللَّهِ ﷺ قَالَتْ نَعَمْ وَتَهْجُرُهُ إِحْدَانَا الْيَوْمَ إِلَى اللَّيْلِ قَالَ قَدْ قُلْتِ قَدْ خَابَ مَنْ فَعَلَ ذَلِكَ مِنْكُنَّ وَخَسِرَ أَفَتَأْمَنُ إِحْدَاكُنَّ أَنْ يَغْضَبَ اللَّهُ عَلَيْهَا لِغَضَبِ رَسُولِهِ ﷺ فَإِذَا هِيَ قَدْ هَلَكَتْ لَا تُرَاجِعِي رَسُولَ اللَّهِ ﷺ وَلَا تَسْأَلِيهِ شَيْئًا وَسَلِينِي مَا بَدَا لَكِ وَلَا يَغُرَّنَّكِ إِنْ كَانَتْ جَارَتُكِ هِيَ أَوْسَمُ وَأَحَبُّ إِلَى رَسُولِ اللَّهِ ﷺ مِنْكِ يُرِيدُ عَائِشَةَ قَالَ وَكَانَ لِي جَارٌ مِنَ الْأَنْصَارِ وَكُنَّا نَتَنَاوَبُ النُّزُولَ إِلَى رَسُولِ اللَّهِ ﷺ فَيَنْزِلُ يَوْمًا وأَنْزِلُ يَوْمًا فَيَأْتِينِي بِخَبَرِ الْوَحْيِ وَغَيْرِهِ وَأَنْزِلُ فَآتِيهِ بِمِثْلِ ذَلِكَ وَكُنَّا نَتَحَدَّثُ أَنَّ غَسَّانَ تُنْعِلُ الْخَيْلَ لِتَغْزُوَنَا قَالَ فَنَزَلَ صَاحِبِي يَوْمًا ثُمَّ أَتَانِي فَضَرَبَ عَلَى بَابِي ثُمَّ نَادَانِي فَخَرَجْتُ إِلَيْهِ فَقَالَ حَدَثَ أَمْرٌ عَظِيمٌ فَقُلْتُ مَاذَا؟ أَجَاءَتْ غَسَّانُ؟ قَالَ بَلْ أَعْظَمُ مِنْ ذَلِكَ وَأَطْوَلُ طَلَّقَ رَسُولُ اللَّهِ نِسَاءَهُ فَقُلْتُ خَابَتْ حَفْصَةُ وَخَسِرَتْ قَدْ كُنْتُ أَظُنُّ هَذَا كَائِنًا فَلَمَّا صَلَّيْتُ الصُّبْحَ شَدَدْتُ عَلَيَّ ثِيَابِي ثُمَّ نَزَلْتُ فَدَخَلْتُ عَلَى حَفْصَةَ فَإِذَا هِيَ تَبْكِي فَقُلْتُ أَطَلَّقَكُنَّ رَسُولُ اللَّهِ ﷺ فَقَالَتْ لَا أَدْرِي هُوَ ذَا هُوَ مُعْتَزِلٌ فِي هَذِهِ الْمَشْرُبَةِ قَالَ فَأَتَيْتُ غُلَامًا لَهُ أَسْوَدَ فَقُلْتُ اسْتَأْذَنْ لِعُمَرَ فَدَخَلَ الْغُلَامُ ثُمَّ خَرَجَ إِلَيَّ وَقَالَ قَدْ ذَكَرْتُكَ لَهُ فَلَمْ يَقُلْ شَيْئًا فَانْطَلَقْتُ حَتَّى أَتَيْتُ الْمَسْجِدَ فَإِذَا قَوْمٌ حَوْلَ الْمِنْبَرِ جُلُوسٌ يَبْكِي بَعْضُهُمْ إِلَى بَعْضٍ قَالَ فَجَلَسْتُ قَلِيلًا ثُمَّ غَلَبَنِي مَا أَجِدُ فَأَتَيْتُ الْغُلَامَ فَقُلْتُ اسْتَأْذَنْ لِعُمَرَ فَدَخَلَ ثُمَّ خَرَجَ إِلَيَّ فَقَالَ قَدْ ذَكَرْتُكَ لَهُ فَصَمَتَ فَرَجَعْتُ فَجَلَسْتُ إِلَى الْمِنْبَرِ ثُمَّ غَلَبَنِي مَا أَجِدُ فَأَتَيْتُ الْغُلَامَ فَقُلْتُ اسْتَأْذَنْ لِعُمَرَ فَدَخَلَ ثُمَّ خَرَجَ إِلَيَّ فَقَالَ قَدْ ذَكَرْتُكَ لَهُ فَسَكَتَ فَوَلَّيْتُ مُدْبِرًا فَإِذَا الْغُلَامُ يَدْعُونِي وَيَقُولُ ادْخُلْ فَقَدْ أَذِنَ لَكَ فَدَخَلْتُ فَسَلَّمْتُ عَلَى رَسُولِ اللَّهِ ﷺ فَإِذَا هُوَ مُتَّكِئٌ عَلَى رَمْلِ حَصِيرٍ قَدْ أَثَّرَ بِجَنْبِهِ فَقُلْتُ أَطَلَّقْتَ يَا رَسُولَ اللَّهِ نِسَاءَكَ؟ قَالَ فَرَفَعَ رَأْسَهُ إِلَيَّ وَقَالَ «لَا» فَقُلْتُ اللَّهُ أَكْبَرُ لَوْ رَأَيْتَنَا يَا رَسُولَ اللَّهِ وَكُنَّا مَعْشَرُ قُرَيْشٍ قَوْمًا نَغْلِبُ النِّسَاءَ فَلَمَّا قَدِمْنَا الْمَدِينَةَ وَجَدْنَا قَوْمًا تَغْلِبُهُمْ نِسَاؤُهُمْ فَطَفِقَ نِسَاؤُنَا يَتَعَلَّمْنَ مِنْ نِسَائِهِمْ فَتَغَضَّبْتُ عَلَى امْرَأَتِي يَوْمًا فَإِذَا هِيَ تُرَاجِعَنِي فَأَنْكَرْتُ ذَلِكَ عَلَيْهَا فَقَالَتْ أَتُنْكِرُ أَنْ أُرَاجِعَكَ فَوَاللَّهِ إِنَّ أَزْوَاجَ النَّبِيِّ ﷺ لَيُرَاجِعْنَهُ وَتَهْجُرُهُ إِحْدَاهُنَّ الْيَوْمَ إِلَى اللَّيْلِ قَالَ فَقُلْتُ قَدْ خَابَ مَنْ فَعَلَ ذَلِكَ مِنْهُنَّ وَخَسِرَتْ أَتَأْمَنُ إِحْدَاهُنَّ أَنْ يَغْضَبَ اللَّهُ عَلَيْهَا لِغَضَبِ رَسُولِهِ ﷺ فَإِذَا هِيَ قَدْ هَلَكَتْ قَالَ فَتَبَسَّمَ رَسُولُ اللَّهِ ﷺ فَقُلْتُ يَا رَسُولَ اللَّهِ فَدَخَلْتُ عَلَى حَفْصَةَ فَقُلْتُ لَهَا لَا تُرَاجِعِي رَسُولَ اللَّهِ ﷺ وَلَا تَسْأَلِيهِ شَيْئًا وَسَلِينِي مَا بَدَا لَكَ وَلَا يَغُرَّنَّكِ أَنْ كَانَتْ جَارَتُكِ هِيَ أَوْسَمُ وَأَحَبُّ إِلَى رَسُولِ اللَّهِ ﷺ مِنْكِ قَالَ فَتَبَسَّمَ رَسُولُ اللَّهِ ﷺ أُخْرَى فَقُلْتُ أَسْتَأْنِسُ يَا رَسُولَ اللَّهِ؟ قَالَ «نَعَمْ» فَجَلَسْتُ فَرَفَعْتُ رَأْسِي فِي الْبَيْتِ فَوَاللَّهِ مَا رَأَيْتُ فِيهِ شَيْئًا يَرُدُّ الْبَصَرَ إِلَّا أُهُبًا ثَلَاثَةً فَقُلْتُ يَا رَسُولَ اللَّهِ ادْعُ اللَّهَ أَنْ يُوَسِّعَ عَلَى أُمَّتِكَ فَقَدْ وَسَّعَ اللَّهُ عَلَى فَارِسَ وَالرُّومِ وَهُمْ لَا يَعْبُدُونَهُ قَالَ فَاسْتَوَى جَالِسًا وَقَالَ «أَفِي شَكٍّ أَنْتَ يَا ابْنَ الْخَطَّابِ أُولَئِكَ قَوْمٌ عُجِّلَتْ لَهُمْ طَيِّبَاتُهُمْ فِي الْحَيَاةِ الدُّنْيَا» فَقُلْتُ اسْتَغْفِرْ لِي يَا رَسُولَ اللَّهِ وَكَانَ أَقْسَمَ لَا يَدْخُلُ عَلَيْهِنَّ شَهْرًا مِنْ شِدَّةِ مَوْجِدَتِهِ عَلَيْهِنَّ حَتَّى عَاتَبَهُ اللَّهُ
[Machine] "When twenty-nine days had passed, the Messenger of Allah entered upon me and started with me. I said, 'O Messenger of Allah! You took an oath not to enter upon us for a month, but you entered on the twenty-ninth day.' He replied, 'The month is twenty-nine days.' Then he said, 'O Aisha! I have something on my mind for you, but I do not want to rush you until you consult with your parents.' She said, 'Then he recited the verse to me, "O Prophet! Say to your wives, 'If you desire the life of this world and its adornment, then come, I will provide for you and give you a gracious release. But if you desire Allah and His Messenger and the home of the Hereafter, then indeed, Allah has prepared for the doers of good among you a great reward.'" Aisha said, 'By Allah, my parents never stopped me from obeying the Messenger of Allah, so I said, 'Shall I consult my parents regarding this matter? I only desire Allah, His Messenger, and the home of the Hereafter.'"
فَلَمَّا مَضَى تِسْعٌ وَعِشْرُونَ دَخَلَ عَلَيَّ رَسُولُ اللَّهِ ﷺ بَدَأَ بِي فَقُلْتُ يَا رَسُولَ اللَّهِ إِنَّكَ أَقْسَمْتَ أَنْ لَا تَدْخُلَ عَلَيْنَا شَهْرًا وَإِنَّكَ دَخَلْتَ تِسْعًا وَعِشْرِينَ أَعُدُّهُنَّ فَقَالَ ﷺ «إِنَّ الشَّهْرَ تِسْعٌ وَعِشْرُونَ» ثُمَّ قَالَ «يَا عَائِشَةُ إِنِّي ذَاكِرٌ لَكِ أَمْرًا فَلَا أُرِيدُ أَنْ تَعْجَلِي فِيهِ حَتَّى تَسْتَأْمِرِي أَبَوَيْكِ» قَالَتْ ثُمَّ قَرَأَ عَلَيَّ الْآيَةَ {يَا أَيُّهَا النَّبِيُّ قُلْ لِأَزْوَاجِكَ إِنْ كُنْتُنَّ تُرِدْنَ الْحَيَاةَ الدُّنْيَا وَزِينَتَهَا فَتَعَالَيْنَ أُمَتِّعْكُنَّ وَأُسَرِّحْكُنَّ سَرَاحًا جَمِيلًا وَإِنْ كُنْتُنَّ تُرِدْنَ اللَّهَ وَرَسُولَهُ وَالدَّارَ الْآخِرَةَ فَإِنَّ اللَّهَ أَعَدَّ لِلْمُحْسِنَاتِ مِنْكُنَّ أَجْرًا عَظِيمًا} قَالَتْ عَائِشَةُ قَدْ عَلِمَ وَاللَّهِ أَنَّ أَبَوَيَّ لَمْ يَكُونَا يَأْمُرَانِي بِفِرَاقِهِ فَقُلْتُ أَفِي هَذَا أَسْتَأْمِرُ أَبَوَيَّ؟ فَإِنِّي أُرِيدُ اللَّهَ وَرَسُولَهُ وَالدَّارَ الْآخِرَةَ

١٦۔٢ بَابُ الرَّجْعَةُ
ذِكْرُ الْخَبَرِ الدَّالِّ عَلَى أَنَّ طَلَاقَ الْمَرْءِ امْرَأَتَهُ مَا لَمْ يُصَرِّحْ بِالثَّلَاثِ فِي نِيَّتِهِ يُحْكَمُ لَهُ بِهَا
[Machine] He divorced his wife Batata, then went to the Prophet ﷺ who asked him, "What did you intend with her?" He replied, "One (divorce)." The Prophet ﷺ asked him, "Did you really intend one (divorce)?" He replied, "Yes, one (divorce)." The Prophet ﷺ said, "Then she is divorced according to what you intended."
أَنَّهُ طَلَّقَ امْرَأَتَهُ الْبَتَّةَ فَأَتَى النَّبِيَّ ﷺ فَقَالَ «مَا أَرَدْتَ بِهَا؟ » قَالَ وَاحِدَةً قَالَ «آللَّهِ؟ » قَالَ آللَّهِ قَالَ «هِيَ عَلَى مَا أَرَدْتَ»
ذِكْرُ الْإِبَاحَةِ لِلْمَرْءِ طَلَاقَ امْرَأَتِهِ وَرَجْعَتِهَا مَتَى مَا أَحَبَّ
The Prophet ﷺ divorced Hafsah, but he took her back in marriage. (Using translation from Abū Dāʾūd 2283)
«أَنُّ رَسُولَ اللَّهِ ﷺ طَلَّقَ حَفْصَةُ ثُمَّ رَاجَعَهَا»
ذِكْرُ الْبَيَانِ بِأَنَّ الْمُصْطَفَى ﷺ رَاجِعْ حَفْصَةَ مِنْ أَجْلِ أَبِيهَا عُمَرَ بْنِ الْخَطَّابِ
[Machine] Umar entered upon Hafsah while she was crying, so he said, "What makes you cry? Perhaps the Messenger of Allah ﷺ has divorced you, as he had divorced you before and then took you back because of me. By Allah, if he divorces you again, I will not speak to you ever."
دَخَلَ عُمَرُ عَلَى حَفْصَةَ وَهِيَ تَبْكِي فَقَالَ «مَا يُبْكِيكِ لَعَلَّ رَسُولَ اللَّهِ ﷺ طَلَّقَكِ إِنَّهُ قَدْ كَانَ طَلَّقَكِ ثُمَّ رَاجَعَكِ مِنْ أَجْلِي فَأَيْمُ اللَّهِ لَئِنْ كَانَ طَلَّقَكِ لَا كَلَّمْتُكِ كَلِمَةً أَبَدًا»

ذِكْرُ الْإِبَاحَةِ لِلْمَرْءِ أَنْ يُوَلِّيَ مِنِ امْرَأَتَهِ أَيَّامًا مَعْلُومَةً
"The Messenger of Allah vowed to stay away from his wives for a month, so he stayed in a loft for twenty-nine days. They said: 'O Messenger of Allah, your vow was for a month,' so he said: 'The month is twenty-nine (days).'" (Using translation from Tirmidhī 690)
أَنَّهُ قَالَ آلَى رَسُولُ اللَّهِ ﷺ مِنْ نِسَائِهِ وَكَانَتِ انْفَكَّتْ رِجْلُهُ فَأَقَامَ فِي مَشْرُبَةٍ تِسْعًا وَعِشْرِينَ ثُمَّ نَزَلَ قَالُوا يَا رَسُولَ اللَّهِ آلَيْتَ شَهْرًا قَالَ «الشَّهْرُ تِسْعٌ وَعِشْرُونَ»
ذِكْرُ مَا يَعْمَلُ الْمَرْءِ إِذَا آلَى مِنِ امْرَأَتِهِ بِالْيَمِينِ
"The Messenger of Allah swore to keep away from his wives and declared them as unlawful for him, so he made something permissible forbidden, and he offered expiation for having sworn to do so." (Using translation from Ibn Mājah 2072)
«آلَى رَسُولُ اللَّهِ ﷺ مِنْ نِسَائِهِ فَجَعَلَ الْحَرَامَ حَلَالًا وَجَعَلَ فِي الْيَمِينِ كَفَّارَةً»
16.4 [Machine] The Morning
١٦۔٤ بَابُ الظِّهَارِ
ذِكْرُ وَصْفِ الْحُكْمِ لِلْمُظَاهِرِ مِنِ امْرَأَتِهِ، وَمَا يَلْزَمُهُ عِنْدَ ذَلِكَ مِنَ الْكَفَّارَةِ
[Machine] I was with him, and he was an elderly Sheikh with a bad character and he annoyed me. She said, "He entered upon me one day, and I questioned him about something, and he became angry and said, 'You are like the back of my mother to me.' Then he left and sat with his people for an hour, then he entered upon me again, and it seemed like he wanted to harm me. I said, 'No, by the One in whose hand is the soul of Khawilah, I will not submit to you, and you have said what you have said until Allah and His Messenger judge between us with their judgment.' She said, "So he pushed me away, and I resisted him. I overpowered him the way a weak woman overpowers an elderly Sheikh. I threw him under me, and then I went out to some of my neighbors and borrowed some clothes from them. Then I went until I reached the Messenger of Allah ﷺ, and I sat in front of him and told him what I had encountered from him. I complained to him about the bad character he had. The Messenger of Allah ﷺ said, 'O Khawilah, your cousin is an elderly Sheikh, so fear Allah in dealing with him.' She said, 'I swear by Allah, I did not cease until the Quran was revealed to the Messenger of Allah ﷺ, and the Messenger of Allah ﷺ was covered with something that covered him. Then it was hidden from him, and he said, 'O Khawilah, Allah has mentioned you and your companion in the Quran.' He recited to me, 'Indeed, Allah has heard the statement of the woman who argued with you about her husband and directed her complaint to Allah...' until His saying, '...And for the disbelievers is a painful punishment.' So the Messenger of Allah ﷺ said, 'Tell him to free a slave.' She said, 'I said, O Messenger of Allah, he does not have anything to free.' He said, 'Then let him fast for two consecutive months.' She said, 'I said, By Allah, O Messenger of Allah, he is an elderly Sheikh, and he cannot fast.' He said, 'Then let him feed sixty poor people and give them dates for sadaqah.' I said, 'By Allah, O Messenger of Allah, he does not have that either.' The Messenger of Allah ﷺ said, 'Then we will assist him with the equivalent of a handful of dates.' She said, 'I said, O Messenger of Allah, I will assist him with another equivalent.' He said, 'You have done well. Go and give it in charity on his behalf, and then advise your cousin.'" She said, "So I did so."
كُنْتُ عِنْدَهُ وَكَانَ شَيْخًا كَبِيرًا قَدْ سَاءَ خُلُقُهُ وَضَجِرَ قَالَتْ فَدَخَلَ عَلَيَّ يَوْمًا فَرَاجَعْتُهُ فِي شَيْءٍ فَغَضِبَ وَقَالَ أَنْتِ عَلَيَّ كَظَهْرِ أُمِّي ثُمَّ خَرَجَ فَجَلَسَ فِي نَادِي قَوْمِهِ سَاعَةً ثُمَّ دَخَلَ عَلَيَّ فَإِذَا هُوَ يُرِيدُنِي عَلَى نَفْسِي قَالَتْ قُلْتُ كَلَّا وَالَّذِي نَفْسُ خُوَيْلَةَ بِيَدِهِ لَا تَخْلُصُ إِلَيَّ وَقَدْ قُلْتَ مَا قُلْتَ حَتَّى يَحْكُمَ اللَّهُ وَرَسُولُهُ فِينَا بِحُكْمِهِ قَالَتْ فَوَاثَبَنِي فَامْتَنَعْتُ مِنْهُ فَغَلَبَتْهُ بِمَا تَغْلِبُ بِهِ الْمَرْأَةُ الشَّيْخَ الضَّعِيفَ فَأَلْقَيْتُهُ تَحْتِي ثُمَّ خَرَجْتُ إِلَى بَعْضِ جَارَاتِي فَاسْتَعَرْتُ مِنْهَا ثِيَابًا ثُمَّ خَرَجْتُ حَتَّى جِئْتُ رَسُولَ اللَّهِ ﷺ فَجَلَسْتُ بَيْنَ يَدَيْهِ فَذَكَرْتُ لَهُ مَا لَقِيتُ مِنْهُ فَجَعَلْتُ أَشْكُو إِلَيْهِ مَا أَلْقَى مِنْ سُوءِ خُلُقِهِ قَالَتْ فَجَعَلَ رَسُولُ اللَّهِ ﷺ يَقُولُ «يَا خُوَيْلَةُ ابْنُ عَمِّكِ شَيْخٌ كَبِيرٌ فَاتَّقِي اللَّهَ فِيهِ» قَالَتْ فَوَاللَّهِ مَا بَرِحْتُ حَتَّى نَزَلَ الْقُرْآنُ فَتَغَشَّى رَسُولُ اللَّهِ ﷺ مَا كَانَ يَغْشَاهُ ثُمَّ سُرِّيَ عَنْهُ فَقَالَ «يَا خُوَيْلَةُ قَدْ أَنْزَلَ اللَّهُ جَلَّ وَعَلَا فِيكِ وَفِي صَاحِبِكِ» قَالَتْ ثُمَّ قَرَأَ عَلَيَّ {قَدْ سَمِعَ اللَّهُ قَوْلَ الَّتِي تُجَادِلُكَ فِي زَوْجِهَا وَتَشْتَكِي إِلَى اللَّهِ} إِلَى قَوْلِهِ {وَلِلْكَافِرِينَ عَذَابٌ أَلِيمٌ} فَقَالَ رَسُولُ اللَّهِ ﷺ «مُرِيهِ فَلْيُعْتِقْ رَقَبَةً» قَالَتْ وَقُلْتُ يَا رَسُولَ اللَّهِ مَا عِنْدَهُ مَا يَعْتِقُ قَالَ «فَلْيَصُمْ شَهْرَيْنِ مُتَتَابِعَيْنِ» قَالَتْ فَقُلْتُ وَاللَّهِ يَا رَسُولَ اللَّهِ إِنَّهُ شَيْخٌ كَبِيرٌ مَا بِهِ مِنْ صِيَامٍ قَالَ «فَلْيُطْعِمْ سِتِّينَ مِسْكِينًا وَسْقًا مِنْ تَمْرٍ» فَقُلْتُ وَاللَّهِ يَا رَسُولَ اللَّهِ مَا ذَلِكَ عِنْدَهُ قَالَتْ فَقَالَ رَسُولُ اللَّهِ ﷺ «فَإِنَّا سَنُعِينُهُ بِعَرَقٍ مِنْ تَمْرٍ» قَالَتْ فَقُلْتُ وَأَنَا يَا رَسُولَ اللَّهِ سَأُعِينُهُ بِعَرَقٍ آخَرَ فَقَالَ «أَصَبْتِ وَأَحْسَنْتِ فَاذْهَبِي فَتَصَدَّقِي بِهِ عَنْهُ ثُمَّ اسْتَوْصِي بِابْنِ عَمِّكِ خَيْرًا» قَالَتْ فَفَعَلْتُ
16.5 [Machine] Divorce
١٦۔٥ بَابُ الْخُلْعِ
ذِكْرُ الْأَمْرِ لِلْمَرْأَةِ بِإِعْطَاءِ مَا طَابَتْ نَفْسُهَا بِهِ عَلَى الْخُلْعِ
She (Habibah) was the wife of Thabit ibn Qays ibn Shimmas. The Messenger of Allah ﷺ came out one morning and found Habibah by his door. The Messenger of Allah ﷺ said: Who is this? She replied: I am Habibah, daughter of Sahl. He asked: What is your case? She replied: I and Thabit ibn Qays, referring to her husband, cannot live together. When Thabit ibn Qays came, the Messenger of Allah ﷺ said to him: This is Habibah, daughter of Sahl, and she has mentioned (about you) what Allah wished to mention. Habibah said: Messenger of Allah, all that he gave me is with me. The Messenger of Allah ﷺ said to Thabit ibn Qays: Take it from her. So he took it from her, and she lived among her people (relatives). (Using translation from Abū Dāʾūd 2227)
وَأَنَّ رَسُولَ اللَّهِ ﷺ خَرَجَ إِلَى صَلَاةِ الصُّبْحِ فَوَجَدَ حَبِيبَةَ بِنْتَ سَهْلٍ عَلَى بَابِهِ فِي الْغَلَسِ فَقَالَ رَسُولُ اللَّهِ ﷺ «مَا شَأْنُكِ؟ » فَقَالَتْ لَا أَنَا وَلَا ثَابِتُ بْنُ قَيْسٍ لِزَوْجِهَا فَلَمَّا جَاءَ ثَابِتٌ قَالَ رَسُولُ اللَّهِ ﷺ «هَذِهِ حَبِيبَةُ بِنْتُ سَهْلٍ قَدْ ذَكَرَتْ مَا شَاءَ اللَّهُ أَنْ تَذْكُرَ» قَالَتْ حَبِيبَةُ يَا رَسُولَ اللَّهِ كُلُّ مَا أَعْطَانِي عِنْدِي فَقَالَ رَسُولُ اللَّهِ ﷺ لِثَابِتِ بْنِ قَيْسٍ «خُذْ مِنْهَا» فَأَخَذَ مِنْهَا وَجَلَسَتْ فِي أَهْلِهَا

١٦۔٦ بَابُ اللِّعَانِ
ذِكْرُ اسْمِ هَذَا الْمُلَاعِنِ امْرَأَتَهُ اللَّذَيْنِ ذَكَرْنَاهُمَا
Sahl bin Sa’ad Al Sa’idi said that ‘Uwaimir bin Ashqar Al Ajilani came to ‘Asim bin Adl and said to him “Asim tell me about a man who finds a man along with his wife. Should he kill him and then be killed by you, or how should he act? Ask the Apostle of Allaah ﷺ ‘Asim, for me about it. ‘Asim then asked the Apostle of Allaah ﷺ about it. The Apostle of Allaah ﷺ disliked the question and denounced it. What ‘Asim heard from the Apostle of Allaah ﷺ fell heavy on him. When ‘Asim returned to his family ‘Uwaimr came to him and asked ‘Asim “What did the Apostle of Allaah ﷺ say to you”? Asim replied “You did not do good to me”. The Apostle of Allaah ﷺ disliked the question that I asked him. Thereupon ‘Uwaimir said “I swear by Allaah, I shall not leave until I ask him about it. So, ‘Uwaimir came to the Apostle of Allaah ﷺ while he was sitting in the midst of the people.” He said “Apostle of Allaah ﷺ tell me about a man who finds a man along with his wife. Should he kill him and then be killed by you, or how should he act?” The Apostle of Allaah ﷺ said “A revelation has been sent down about you and your wife so go away and bring her. Sahl said “So we cursed one another while I was along with the people who were with the Apostle of Allaah ﷺ. Then when they finished, ‘Umamir said “I shall have lied against her, Apostle of Allaah ﷺ if I keep her. He pronounced her divorce three times before the Apostle of Allaah ﷺcommanded him (to do so). Ibn Shihab said “Then this became the method of invoking curses.” (Using translation from Abū Dāʾūd 2245)
أَنَّ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ؟ سَلْ لِي يَا عَاصِمُ عَنْ ذَلِكَ رَسُولَ اللَّهِ ﷺ قَالَ فَسَأَلَ عَاصِمُ رَسُولَ اللَّهِ ﷺ عَنْ ذَلِكَ فَكَرِهَ رَسُولُ اللَّهِ ﷺ تِلْكَ الْمَسَائِلَ وَعَابَهَا حَتَّى كَبُرَ عَلَى عَاصِمٍ مَا سَمِعَ مِنْ رَسُولِ اللَّهِ ﷺ فَلَمَّا رَجَعَ عَاصِمٌ إِلَى أَهْلِهِ جَاءَهُ عُوَيْمِرٌ فَقَالَ يَا عَاصِمُ مَاذَا قَالَ لَكَ رَسُولُ اللَّهِ ﷺ؟ فَقَالَ عَاصِمٌ لِعُوَيْمِرٍ لَمْ تَأْتِنِي بِخَيْرٍ قَدْ كَرِهَ رَسُولُ اللَّهِ ﷺ الْمَسْأَلَةَ الَّتِي سَأَلْتُهُ عَنْهَا فَقَالَ عُوَيْمِرٌ وَاللَّهِ لَا أَنْتَهِي حَتَّى أَسْأَلُهُ عَنْهَا فَجَاءَ عُوَيْمِرٌ وَرَسُولُ اللَّهِ ﷺ وَسَطَ النَّاسِ فَقَالَ رَسُولُ اللَّهِ ﷺ «قَدْ أُنْزِلَ فِيكَ وَفِي صَاحِبَتِكَ فَاذْهَبْ فَأْتِ بِهَا» فَقَالَ سَهْلٌ فَتَلَاعَنَا وَأَنَا مَعَ النَّاسِ عِنْدَ رَسُولِ اللَّهِ ﷺ فَلَمَّا فَرَغَا مِنْ تَلَاعُنِهِمَا قَالَ عُوَيْمِرٌ كَذَبْتُ عَلَيْهَا يَا رَسُولَ اللَّهِ إِنْ أَمْسَكْتُهَا فَطَلَّقَهَا ثَلَاثًا قَبْلَ أَنْ يَأْمُرُهُ رَسُولُ اللَّهِ ﷺ
ذِكْرُ خَبَرٍ ثَانٍ يُصَرِّحُ بِصِحَّةِ مَا ذَكَرْنَاهُ
'Uwaimir came to ʿAsim bin ʿAdi who was the chief of Bani Ajlan and said, "What do you say about a man who has found another man with his wife? Should he kill him whereupon you would kill him (i.e. the husband), or what should he do? Please ask Messenger of Allah ﷺ about this matter on my behalf." ʿAsim then went to the Prophet ﷺ and said, "O Messenger of Allah ﷺ! (And asked him that question) but Messenger of Allah ﷺ disliked the question," When 'Uwaimir asked ʿAsim (about the Prophet's answer) ʿAsim replied that Messenger of Allah ﷺ disliked such questions and considered it shameful. "Uwaimir then said, "By Allah, I will not give up asking unless I ask Messenger of Allah ﷺ about it." Uwaimir came (to the Prophet ) and said, "O Messenger of Allah ﷺ! A man has found another man with his wife! Should he kill him whereupon you would kill him (the husband, in Qisas) or what should he do?" Messenger of Allah ﷺ said, "Allah has revealed regarding you and your wife's case in the Qur'an "So Messenger of Allah ﷺ ordered them to perform the measures of Mula'ana according to what Allah had mentioned in His Book. So 'Uwaimir did Mula'ana with her and said, "O Messenger of Allah ﷺ! If I kept her I would oppress her." So 'Uwaimir divorced her and so divorce became a tradition after them for those who happened to be involved in a case of Mula'ana. Messenger of Allah ﷺ then said, "Look! If she (Uwaimir's wife) delivers a black child with deep black large eyes, big hips and fat legs, then I will be of the opinion that 'Uwaimir has spoken the truth; but if she delivers a red child looking like a Wahra then we will consider that 'Uwaimir has told a lie against her." Later on she delivered a child carrying the qualities which Messenger of Allah ﷺ had mentioned as a proof for 'Uwaimir's claim; therefore the child was ascribed to its mother henceforth. كَيْفَ تَقُولُونَ فِي رَجُلٍ وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَصْنَعُ؟ فَقَالَ سَلْ لِي رَسُولَ اللَّهِ ﷺ عَنْ ذَلِكَ قَالَ فَأَتَى عَاصِمٌ رَسُولَ اللَّهِ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ رَجُلٌ وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَصْنَعُ؟ فَكَرِهَ رَسُولُ اللَّهِ ﷺ الْمَسَائِلَ وَعَابَهَا فَأَتَى عُوَيْمِرًا فَقَالَ لَهُ إِنَّ النَّبِيَّ ﷺ قَدْ كَرِهَ الْمَسَائِلَ وَعَابَهَا فَقَالَ عُوَيْمِرٌ وَاللَّهِ لَا أَنْتَهِي حَتَّى أَسْأَلَ رَسُولَ اللَّهِ ﷺ عَنْ ذَلِكَ فَأَتَى عُوَيْمِرٌ فَسَأَلَهُ فَقَالَ رَسُولُ اللَّهِ ﷺ «قَدْ أَنْزَلَ اللَّهُ جَلَّ وَعَلَا فِيكَ وَفِي صَاحِبَتِكَ» فَأَمَرَهُمَا رَسُولُ اللَّهِ ﷺ فَتَلَاعَنَا بِمَا سَمَّى اللَّهُ فِي كِتَابِهِ قَالَ فَلَاعَنَهَا ثُمَّ قَالَ يَا رَسُولَ اللَّهِ إِنْ حَبَسْتُهَا فَقَدْ ظَلَمْتُهَا قَالَ فَطَلَّقَهَا وَكَانَتْ سُنَّةٌ لِمَنْ بَعْدَهُمَا مِنَ الْمُتَلَاعِنِينَ قَالَ ثُمَّ قَالَ رَسُولُ اللَّهِ ﷺ «انْظُرُوا فَإِنْ جَاءَتْ بِهِ أَسْحَمَ أَدْعَجَ الْعَيْنَيْنِ عَظِيمَ الْأَلْيَتَيْنِ خَدَلَّجَ السَّاقَيْنِ فَلَا أَحْسِبُ عُوَيْمِرًا إِلَّا قَدْ صَدَقَ عَلَيْهَا وَإِنْ جَاءَتْ بِهِ أُحَيْمِرَ كَأَنَّهُ وَحْرَةٌ فَلَا أَحْسِبُ عُوَيْمِرًا إِلَّا وَقَدْ كَذَبَ عَلَيْهَا» قَالَ فَجَاءَتْ بِهِ عَلَى النَّعْتِ الَّذِي نَعَتَ رَسُولُ اللَّهِ ﷺ مِنْ تَصْدِيقِ عُوَيْمِرٍ قَالَ فَكَانَ يُنْسَبُ بَعْدُ إِلَى أُمِّهِ
ذِكْرُ وَصْفِ اللِّعَانِ الَّذِي يَجِبُ أَنْ يَكُونَ بَيْنَ مَنْ وَصَفْنَا نَعْتَهَمَا مِنَ الزَّوْجِ وَالْمَرْأَةِ
"I was asked about those who were involved in the case of Li'an and if they are to be separated, during the leadership of Mus'ab bin Az-Zubair. I did not know what to say. So I went to the house of Abdullah bin Umar and I sought permission to enter. I was told that he was taking a nap, but he heard me talking and he said: 'Is it Ibn Jubair? Enter. You would not have come except for a need.'"He said: "So I entered and found him lying on a saddlecloth from his mount. I said: 'O Abu Abdur-Rahman! Are those involved in Li'an separated?' He said: 'Glorious is Allah! Yes. The first who asked about that was so-and-so the son of so-and-so. He came to the Prophet and said: "O Messenger of Allah! If one of us saw his wife committing adultery what should he do? If he were to say anything, his statement would be a horrible matter, and if he were to remain silent, his silence about the matter would be horrible." "He said: 'So the Prophet remained silent and did not answer him. Afterwards he came to the Prophet and said: "The one who asked you about it has been tried by it." So Allah revealed these Ayat from Surat An-Nur. And those who accuse their wives and have no witnesses except themselves - until the end of those Ayat. So he called for the man and recited the Ayat to him and admonished him, reminded him, and he told him: "Indeed the punishment of the world is less than the punishment of the Hereafter." So he said: "Nay! By the One Who sent you with the truth! I did not lie about her." Then he did the same with the woman, admonished her and reminding her and he told her: "Indeed the punishment of the world is less than the punishment of the Hereafter." She said: "Nay! By the One Who sent you with the truth! He is not telling the truth.'" "He said: 'So he started with the man: He testified four times, by Allah that he is one of the truthful, and the fifth time that the curse of Allah be upon him if he was one of the liars. Then the same with the woman: She testified four times by Allah, that he was one of the liars, and the fifth time that the wrath of Allah be upon her if he was one of the truthful. الْغُلَامُ إِنَّهُ قَائِلٌ فَقُلْتُ مَا بُدَّ مِنْ أَنْ أَدْخُلَ عَلَيْهِ فَسَمِعَ صَوْتِي فَعَرَفَهُ وَقَالَ أَسَعِيدٌ؟ قُلْتُ نَعَمْ قَالَ ادْخُلْ مَا جِئْتَ هَذِهِ السَّاعَةَ إِلَّا لِحَاجَةٍ فَدَخَلْتُ وَهُوَ مُفْتَرِشٌ بَرْذَعَةَ رَحْلِهِ مُتَوَسِّدٌ وِسَادَةً حَشْوهَا لِيفٌ فَقُلْتُ يَا أَبَا عَبْدِ الرَّحْمَنِ الْمُتَلَاعِنَانِ أَيُفَرَّقُ بَيْنَهُمَا فَقَالَ سُبْحَانَ اللَّهِ نَعَمْ إِنَّ أَوَّلَ مَنْ سَأَلَ عَنْ ذَلِكَ فُلَانُ بْنُ فُلَانٍ أَتَى النَّبِيَّ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ أَرَأَيْتَ لَوْ أَنَّ أَحَدَنَا رَأَى امْرَأَتَهُ عَلَى فَاحِشَةٍ كَيْفَ يَصْنَعُ؟ إِنْ تَكَلَّمَ تَكَلَّمَ بِأَمْرٍ عَظِيمٍ وَإِنْ سَكَتَ سَكَتَ عَلَى مِثْلِ ذَلِكَ فَلَمْ يُجِبْهُ النَّبِيُّ ﷺ فَلَمَّا كَانَ بَعْدُ ذَلِكَ أَتَى النَّبِيَّ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ إِنَّ الَّذِي سَأَلْتُكَ عَنْهُ قَدِ ابْتُلِيتُ بِهِ «فَأَنْزَلَ اللَّهُ جَلَّ وَعَلَا هَؤُلَاءِ الْآيَاتِ فَدَعَا الرَّجُلَ فَتَلَاهُنَّ عَلَيْهِ وَوَعَظَهُ وَذَكَّرَهُ وَأَخْبَرَهُ أَنَّ عَذَابَ الدُّنْيَا أَهْوَنُ مِنْ عَذَابِ الْآخِرَةِ» فَقَالَ لَا وَالَّذِي بَعَثَكَ بِالْحَقِّ مَا كَذَبْتُ عَلَيْهَا «ثُمَّ دَعَا بِالْمَرْأَةِ فَوَعَظَهَا وَذَكَّرَهَا وَأَخْبَرَهَا أَنَّ عَذَابَ الدُّنْيَا أَهْوَنُ مِنْ عَذَابِ الْآخِرَةِ» فَقَالَتْ وَالَّذِي بَعَثَكَ بِالْحَقِّ إِنَّهُ لَكَاذِبٌ «فَبَدَأَ بِالرَّجُلِ فَشَهِدَ أَرْبَعَ شَهَادَاتٍ بِاللَّهِ إِنَّهُ لِمَنِ الصَّادِقِينَ وَالْخَامِسَةُ أَنَّ لَعْنَةَ اللَّهِ عَلَيْهِ إِنْ كَانَ مِنَ الْكَاذِبِينَ ثُمَّ ثَنَّى بِالْمَرْأَةِ فَشَهِدَتْ أَرْبَعَ شَهَادَاتٍ بِاللَّهِ إِنَّهُ لِمَنِ الْكَاذِبِينَ وَالْخَامِسَةُ أَنَّ غَضِبَ اللَّهِ عَلَيْهَا إِنْ كَانَ مِنَ الصَّادِقِينَ ثُمَّ فَرَّقَ بَيْنَهُمَا»
ذِكْرُ الْبَيَانَ بِأَنَّ الزَّوْجَيْنِ إِذَا تَلَاعَنَا عَلَى حَسَبِ مَا وَصَفْنَاهُ لَمْ يَكُنْ لَهُ السَّبِيلُ عَلَيْهَا فِيمَا بَعْدُ مِنْ أَيَّامِهِ
Ibn ‘Umar said “The Apostle of Allaah ﷺ said to the spouses who invoked curses on each other. Your reckoning is in Allaah’s hands for one of you is liar there is no way for you to (remarry) her. He then asked Apostle of Allaah ﷺ what about my property? He replied “There is no property for you. If you have spoken the truth, it is the price for your having had the right to intercourse with her and if you have lied against her it is still more remote for you. قَالَ رَسُولُ اللَّهِ ﷺ لِلْمُتَلَاعِنَيْنِ «حِسَابُكُمَا عَلَى اللَّهِ أَحَدَكُمَا كَاذِبٌ لَا سَبِيلَ لَكَ عَلَيْهَا» قَالَ يَا رَسُولَ اللَّهِ مَالِي؟ قَالَ «لَا مَالَ لَكَ إِنْ كُنْتَ صَدَقْتَ عَلَيْهَا فَهُوَ مَا اسْتَحْلَلْتَ مِنْ فَرْجِهَا وَإِنْ كُنْتَ كَذَبْتَ عَلَيْهَا فَذَاكَ أَبْعَدُ لَكَ»
ذِكْرُ الْبَيَانِ بِأَنَّ وَلَدَ الْمُتَلَاعِنَةِ يَلْحَقُ بِهَا بَعْدَ اللِّعَانِ الْوَاقِعِ بَيْنَهَا وَبَيْنَ زَوْجِهَا دُونَ أَنْ يَلْحَقَ بِزَوْجِهَا
A man and his wife had a case of Lian (or Mula'ana) during the lifetime of the Prophet ﷺ and the man denied the paternity of her child. The Prophet ﷺ gave his verdict for their separation (divorce) and then the child was regarded as belonging to the wife only. (Using translation from Bukhārī 6748)
لَاعَنَ امْرَأَتَهُ فِي زَمَانِ رَسُولِ اللَّهِ ﷺ وَانْتَفَى مِنْ وَلَدِهَا «فَفَرَّقَ رَسُولُ اللَّهِ ﷺ بَيْنَهُمَا وَأَلْحَقَ الْوَلَدَ بِالْمَرْأَةِ»
16.6.1 Subsection
١٦۔٦۔١ ذِكْرُ السَّبَبِ الَّذِي مِنْ أَجْلِهِ أَنْزَلَ اللَّهُ آيَةَ اللِّعَانِ
[Machine] We were with the Prophet ﷺ in the mosque of Al-Madinah on a certain night, when a man said, "What do you think if a man finds another man with his wife? If he kills him, will he be killed, or if he remains silent, will he bear the burden of anger?" By Allah, I will ask the Messenger of Allah ﷺ about this matter." The next morning, he went to the Messenger of Allah ﷺ and asked him the same question. The Prophet ﷺ replied, "If a man finds another man with his wife, and he kills him, then he will be killed. And if he speaks about it, he will be punished. And if he remains silent, he will bear the burden of anger." Then the verse was revealed, "And those who accuse their wives [of adultery] and have no witnesses except themselves - then the witness of one of them [shall be] four testimonies [swearing] by Allah that indeed, he is of the truthful. And the fifth [oath will be] that the curse of Allah be upon him if he should be among the liars" [Quran 24:6-7]. The man came to the Prophet ﷺ with his wife, and they both invoked curses on each other. The man confessed four times, "By Allah, he is one of the truthful." And on the fifth time, he said, "May the curse of Allah be upon me if I am lying." Then, when he turned away, the Prophet ﷺ said, "Wait, there is a possibility that she might bring forth a child who has curly hair." Eventually, she gave birth to a child with curly hair. Isaq said, Yahya Ibn Ma'een told me, "I asked Jarir, and he said, "No one else from Al-A'mash reported this hadith except you. But I heard it from him."
كُنَّا مَعَ النَّبِيِّ ﷺ فِي مَسْجِدِ الْمَدِينَةِ ذَاتَ لَيْلَةٍ فَقَالَ رَجُلٌ أَرَأَيْتُمْ لَوْ وَجَدَ رَجُلٌ مَعَ امْرَأَتِهِ رَجُلًا فَإِنْ قَتَلَهُ قَتَلْتُمُوهُ وَإِنْ سَكَتَ سَكَتَ عَلَى غَيْظٍ فَوَاللَّهِ لَأَسْأَلَنَّ عَنْهُ رَسُولَ اللَّهِ ﷺ فَلَمَّا أَصْبَحَ غَدَا عَلَيْهِ فَسَأَلَهُ فَقَالَ لَوْ وَجَدَ رَجُلٌ مَعَ امْرَأَتِهِ رَجُلًا فَإِنْ قَتَلَهُ قَتَلْتُمُوهُ وَإِنْ تَكَلَّمَ جَلَدْتُمُوهُ وَإِنْ سَكَتَ سَكَتَ عَلَى غَيْظٍ ثُمَّ قَالَ اللَّهُمَّ افْتَحْ فَنَزَلَتْ {وَالَّذِينَ يَرْمُونَ أَزْوَاجَهُمْ} هَؤُلَاءِ الْآيَاتُ فِي اللِّعَانِ فَجَاءَ إِلَى النَّبِيِّ ﷺ وَامْرَأَتُهُ فَتَلَاعَنَا فَشَهِدَ الرَّجُلُ أَرْبَعَ مَرَّاتٍ بِاللَّهِ إِنَّهُ لِمَنِ الصَّادِقِينَ وَالْخَامِسَةُ أَنَّ لَعْنَةَ اللَّهِ عَلَيْهِ إِنْ كَانَ مِنَ الْكَاذِبِينَ فَلَمَّا أَخَذَتِ امْرَأَتُهُ لِتَلْتَعِنَ قَالَ لَهَا النَّبِيُّ ﷺ «مَهْ» فَالْتَعَنَتْ فَلَمَّا أَدْبَرَتْ قَالَ النَّبِيُّ ﷺ « فَلَعَلَّهَا أَنْ تَجِيءَ بِهِ أَسْوَدَ جَعْدًا» فَجَاءَتْ بِهِ أَسْوَدَ جَعْدًا قَالَ إِسْحَاقُ قَالَ يَحْيَى بْنُ مَعِينٍ قُلْتُ لِجَرِيرٍ لَمْ يَرْوِ هَذَا عَنِ الْأَعْمَشِ أَحَدٌ غَيْرُكَ قَالَ «لَكِنِّي سَمِعْتُهُ مِنْهُ»
Messenger of Allah, if I were to find with my wife a man, should I wait until I bring four witnesses? He said: Yes. (Using translation from Muslim 1498b)
لِرَسُولِ اللَّهِ ﷺ يَا رَسُولَ اللَّهِ أَرَأَيْتَ إِنْ وَجَدْتُ مَعَ امْرَأَتِي رَجُلًا أُمْهِلُهُ حَتَّى آتِيَ بِأَرْبَعَةِ شُهَدَاءَ؟ قَالَ رَسُولُ اللَّهِ ﷺ «نَعَمْ»
[Machine] A man came to the Prophet ﷺ and said, "O Messenger of Allah, what do you think of a man who sees his wife with another man and he kills him, and then you also kill him? How would you deal with him?" So Allah, the Most High, revealed what is mentioned in the Quran about those who curse each other. Then the Messenger of Allah ﷺ said to him, "The matter concerning you and your wife has been settled." He said, "But we cursed each other and I was a witness before the Messenger of Allah ﷺ ." The man said, "O Messenger of Allah, if I had restrained myself from killing him, I would have lied about her, so I divorced her." Then she became pregnant and he denied the pregnancy. Her son was summoned to her, and then the ruling regarding inheritance was applied, that he would inherit from her and she would inherit from him as Allah had prescribed for her.
أَنَّ رَجُلًا أَتَى النَّبِيَّ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ أَرَأَيْتَ رَجُلًا رَأَى مَعَ امْرَأَتِهِ رَجُلًا يَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ بِهِ؟ فَأَنْزَلَ اللَّهُ جَلَّ وَعَلَا مَا ذِكْرُ فِي الْقُرْآنِ مِنَ الْمُتَلَاعِنِينَ فَقَالَ لَهُ رَسُولُ اللَّهِ ﷺ «قَدْ قُضِيَ فِيكَ وَفِي امْرَأَتِكَ» قَالَ فَتَلَاعَنَا وَأَنَا شَاهِدٌ عِنْدَ رَسُولِ اللَّهِ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ إِنْ أَمْسِكُهَا فَقَدْ كَذَبْتُ عَلَيْهَا فَفَارَقَهَا فَكَانَتْ سُنَّةٌ بَعْدُ أَنْ يُفَرَّقَ بَيْنَ الْمُتَلَاعِنِينَ فَكَانَتْ حَامِلًا فَأَنْكَرَ حَمْلَهَا وَكَانَ ابْنُهَا يُدْعَى إِلَيْهَا ثُمَّ جَرَتِ السُّنَّةُ فِي الْمِيرَاثِ أَنْ يَرِثَهَا وَتَرِثُ مِنْهُ مَا فَرَضَ اللَّهُ لَهَا

[Machine] She came to the Messenger of Allah and asked about leaving her house. He commanded her to go to Ibn Umm Maktum, the blind man.
أَنَّهَا جَاءَتْ رَسُولَ اللَّهِ ﷺ فَاسْتَفْتَتْ فِي خُرُوجِهَا مِنْ بَيْتِهَا فَأَمَرَهَا أَنْ تَنْتَقِلَ إِلَى ابْنِ أُمِّ مَكْتُومٍ الْأَعْمَى
ذِكْرُ الْعِلَّةَ الَّتِي مِنْ أَجْلِهَا أُمِرَتْ فَاطِمَةُ بِنْتُ قَيْسٍ بِالِانْتِقَالِ إِلَى بَيْتِ ابْنِ أُمِّ مَكْتُومٍ
Abu Salamah bin ‘Abd Al Rahman reported on the authority of Fatimah daughter of Qais Abu ‘Amr bin Hafs divorced her (Fatimah daughter of Qais) absolutely when he was away from home and his agent sent her home barley. She was displeased with it. He said “I swear by Allah, you have no claim on us. She then came to Apostle of Allah ﷺ and mentioned that to him. He said to her “No maintenance is due to you from him. He ordered her to spend the waiting period in the house of Umm Sharik but he said afterwards “that is a woman whom my Companions visit. Spend the waiting period in the house of Ibn Umm Maktum for he is blind and you can undress. Then when you are in a position of being remarried, tell me.” She said “When I was in a position to remarry, I mentioned to him that Mu’awiyah bin Abi Sufyan and Abu Jahm had asked me in marriage. The Apostle of Allah ﷺsaid “As for Abu Jahm, he does not put down his stick from his shoulder, and as for Mu’awiyah he is a poor man who has no property; marry Usamah bin Zaid. I disliked him but he said “Marry Usamah bin Zaid. So, I married him. And Allah prospered him very much and I was envied.” (Using translation from Abū Dāʾūd 2284)
وَاللَّهِ مَا لَكَ عَلَيْنَا مِنْ شَيْءٍ فَجَاءَتْ رَسُولَ اللَّهِ ﷺ فَذَكَرَتْ ذَلِكَ لَهُ فَقَالَ لَهَا «لَيْسَ لَكِ عَلَيْهِ نَفَقَةٌ» وَأَمَرَهَا أَنْ تَعْتَدَّ فِي بَيْتِ أُمِّ شَرِيكٍ ثُمَّ قَالَ «تِلْكَ امْرَأَةٌ يَغْشَاهَا أَصْحَابِي فَاعْتَدِّي عِنْدَ ابْنِ أُمِّ مَكْتُومٍ فَإِنَّهُ رَجُلٌ أَعْمَى تَضَعِينَ ثِيَابَكِ حَيْثُ شِئْتِ فَإِذَا حَلَلْتِ فَآذِنِينِي» قَالَتْ فَلَمَّا حَلَلْتُ ذَكَرْتُ لَهُ أَنَّ مُعَاوِيَةَ بْنَ أَبِي سُفْيَانَ وَأَبَا جَهْمٍ خَطَبَانِي فَقَالَ رَسُولُ اللَّهِ ﷺ «أَمَّا أَبُو جَهْمٍ فَلَا يَضَعُ عَصَاهُ عَنْ عَاتِقِهِ وَأَمَّا مُعَاوِيَةُ فَصُعْلُوكٌ لَا مَالَ لَهُ انْكِحِي أُسَامَةَ بْنَ زَيْدٍ» قَالَتْ فَكَرِهْتُ ثُمَّ قَالَ «انْكِحِي أُسَامَةَ» فَنَكَحْتُهُ فَجَعَلَ اللَّهُ فِيهِ خَيْرًا وَاغْتَبَطْتُ بِهِ
ذِكْرُ الْإِخْبَارِ عَنْ نَفْيِ إِثْبَاتِ السَّكَنِ لِلْمَبْتُوتَةِ
"The thrice-divorced woman is not entitled to provision and shelter." (Using translation from Nasāʾī 3404)
عَنِ النَّبِيِّ ﷺ قَالَ «الْمُطَلَّقَةُ ثَلَاثًا لَيْسَ لَهَا سُكْنَى وَلَا نَفَقَةٌ»
ذِكْرُ وَصْفِ عِدَّةِ الْمُتَوَفَّى عَنْهَا زَوْجُهَا
"Should I return to my people, for he did not leave any dwelling house of his own and maintenance for me? She said: The Messenger of Allah ﷺ replied: Yes. She said: I came out, and when I was in the apartment or in the mosque, he called for me, or he commanded (someone to call me) and, therefore, I was called. He said: what did you say? So I repeated my story which I had already mentioned about my husband. Thereupon he said: Stay in your house till the term lapses. She said: So I passed my waiting period in it (her house) for four months and ten days. When Uthman ibn Affan became caliph, he sent for me and asked me about that; so I informed him, and he followed it and decided cases accordingly. (Using translation from Abū Dāʾūd 2300)
أَنَّهَا جَاءَتْ إِلَى رَسُولِ اللَّهِ ﷺ تَسْأَلُهُ أَنْ تَرْجِعَ إِلَى أَهْلِهَا فِي بَنِي خُدْرَةَ فَإِنَّ زَوْجَهَا خَرَجَ فِي طَلَبِ أَعْبُدٍ لَهُ أَبَقُوا حَتَّى إِذَا كَانُوا بِطَرَفِ الْقَدُومِ لَحِقَهُمْ فَقَتَلُوهُ فَسَأَلْتُ رَسُولَ اللَّهِ ﷺ أَنْ أَرْجِعَ إِلَى أَهْلِي فَإِنَّ زَوْجِي لَمْ يَتْرُكْنِي فِي مَنْزِلٍ يَمْلِكُهُ وَلَا نَفَقَةَ فَقَالَتْ قَالَ رَسُولُ اللَّهِ ﷺ «نَعَمْ» فَانْصَرَفْتُ حَتَّى إِذَا كُنْتُ فِي الْحُجْرَةِ أَوْ فِي الْمَسْجِدِ دَعَانِي أَوْ أَمَرَنِي رَسُولُ اللَّهِ ﷺ فَدُعِيتُ لَهُ فَقَالَ رَسُولُ اللَّهِ ﷺ «كَيْفَ قُلْتِ؟ » قَالَتْ فَرَدَدْتُ عَلَيْهِ الْقِصَّةَ الَّتِي ذَكَرْتُ مِنْ شَأْنِ زَوْجِي فَقَالَ «امْكُثِي فِي بَيْتِكِ حَتَّى يَبْلُغَ الْكِتَابُ أَجَلَهُ» قَالَتْ فَاعْتَدَدْتُ فِيهِ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا قَالَتْ فَلَمَّا كَانَ عُثْمَانُ بْنُ عَفَّانَ أَرْسَلَ إِلَيَّ فَسَأَلَنِي عَنْ ذَلِكَ فَأَخْبَرْتُهُ فَاتَّبَعَهُ وَقَضَى بِهِ
ذِكْرُ الْأَمْرِ بِالِاعْتِدَادِ لِلْمُتَوَفَّى عَنْهَا زَوْجُهَا فِي الْبَيْتِ الَّذِي جَاءَ فِيهِ نَعْيُهُ
[Machine] Her husband was in a village from the cities of Medina, and that he was following a group (who practices sorcery) and they killed him. So she went to the Messenger of Allah ﷺ and mentioned her distress and informed him that she is staying in a house that does not belong to her. She sought permission from him to go to her brothers in Medina, and he granted her permission. Then he revoked his decision and said to her, "Stay in the house where the news of his death came until the appointed time for the punishment is due."
أَنَّ زَوْجَهَا كَانَ فِي قَرْيَةٍ مِنْ قُرَى الْمَدِينَةِ وَأَنَّهُ تَبَعَ أَعْلَاجًا فَقَتَلُوهُ فَأَتَتْ رَسُولَ اللَّهِ ﷺ فَذَكَرَتِ الْوَحْشَةِ وَذَكَرَتْ أَنَّهَا فِي مَنْزِلٍ لَيْسَ لَهَا وَأَنَّهَا اسْتَأْذَنْتُهُ أَنْ تَأْتِيَ إِخْوَتَهَا بِالْمَدِينَةِ فَأَذِنَ لَهَا ثُمَّ أَعَادَهَا ثُمَّ قَالَ لَهَا «امْكُثِي فِي بَيْتِكِ الَّذِي جَاءَ فِيهِ نَعْيُهُ حَتَّى يَبْلُغَ الْكِتَابُ أَجَلَهُ»
ذِكْرُ الْإِخْبَارِ بِأَنَّ انْقِضَاءَ عِدَّةِ الْحَامِلِ وَضْعُهَا حَمْلَهَا، وَإِنْ كَانَ ذَلِكَ فِي مُدَّةٍ يَسِيرَةٍ
"Go to Subai'ah bint Al-Harith Al-Aslamiyyah, and ask her about the ruling of the Messenger of Allah concerning her pregnancy." He said: "So 'Umar bin 'Abdullah went to her and asked her. She told him that she was married to Sa'd bin Khawlah, who was one of the Companions of the Messenger of Allah who had been present at Badr. He died during the Farewell Pilgrimage, and she gave birth before four months and ten days had passed since her husband's death. When her Nifas ended, Abu As-Sanabil -a man from Banu 'Abd Ad-Dar- went to her and saw that she had adorned herself. He said: 'Perhaps you want to get married before four months and ten days has passed?' She said: 'When I heard that from Abu As-Sanabil, I went to the Messenger of Allah and told him my story. The Messenger of Allah said: 'It is permissible for you to marry when you gave birth.''" (Using translation from Nasāʾī 3520)
أَنِ ادْخُلْ عَلَى سُبَيْعَةَ بِنْتِ الْحَارِثِ الْأَسْلَمِيَّةِ فَاسْأَلْهَا عَمَّا أَفْتَاهَا رَسُولُ اللَّهِ ﷺ فِي حَمْلِهَا قَالَ فَدَخَلَ عُمَرُ بْنُ عَبْدِ اللَّهِ فَسَأَلَهَا فَأَخْبَرْتُهُ أَنَّهَا كَانَتْ تَحْتَ سَعْدِ بْنِ خَوْلَةَ وَكَانَ مِنْ أَصْحَابِ رَسُولِ اللَّهِ ﷺ مِمَّنْ شَهِدَ بَدْرًا فَتُوُفِّيَ عَنْهَا فِي حَجَّةِ الْوَدَاعِ فَوَلَدَتْ قَبْلَ أَنْ يَمْضِيَ لَهَا أَرْبَعَةُ أَشْهُرٍ وَعَشْرٍ مِنْ وَفَاةِ بَعْلِهَا فَلَمَّا تَعَلَّتْ مِنْ نِفَاسِهَا دَخَلَ عَلَيْهَا أَبُو السَّنَابِلِ بْنُ بَعْكَكٍ رَجُلٌ مِنْ بَنِي عَبْدِ الدَّارِ فَرَآهَا مُتَجَمِّلَةً فَقَالَ لَهَا لَعَلَّكِ تُرِيدِينَ النِّكَاحَ قَبْلَ أَنْ يَمُرَّ عَلَيْكِ أَرْبَعَةُ أَشْهُرٍ وَعَشْرٍ قَالَتْ فَلَمَّا سَمِعْتُ ذَلِكَ مِنْ أَبِي السَّنَابِلِ جِئْتُ رَسُولَ اللَّهِ ﷺ فَحَدَّثْتُهُ وَاسْتَفْتَيْتُهُ فَقَالَ رَسُولُ اللَّهِ ﷺ «قَدْ حَلَلْتِ حِينَ وَضَعْتِ حَمْلَكِ»
ذِكْرُ وَصْفِ الْعِدَّةِ لِلْحَامِلِ الْمُتَوَفَّى عَنْهَا زَوْجُهَا
[Machine] About a woman who gave birth forty nights after the death of her husband, Ibn Abbas said, "It is the last of the two terms." Abu Salama said, "Did not Allah say, 'And the mothers may give suckling to their children for two whole years?'". Abu Hurayrah said, "I am with the son of my brother," meaning Abu Salama. So Ibn Abbas sent Kurayb to the wives of the Prophet ﷺ to ask them, "Have you heard from the Messenger of Allah ﷺ regarding this as a Sunnah?" So they sent to him that Suhayla bint Aslamia gave birth forty nights after the death of her husband, and the Messenger of Allah ﷺ married her.
عَنِ امْرَأَةٍ وَضَعَتْ بَعْدَ وَفَاةِ زَوْجِهَا بِأَرْبَعِينَ لَيْلَةً فَقَالَ ابْنُ عَبَّاسٍ «آخِرَ الْأَجَلَيْنِ» قَالَ أَبُو سَلَمَةَ فَقُلْتُ أَمَا قَالَ اللَّهُ {وَأُولَاتُ الْأَحْمَالِ أَجَلُهُنَّ أَنْ يَضَعْنَ حَمْلَهُنَّ} قَالَ أَبُو هُرَيْرَةَ «أَنَا مَعَ ابْنِ أَخِي» يَعْنِي أَبَا سَلَمَةَ فَأَرْسَلَ ابْنُ عَبَّاسٍ كُرَيْبًا إِلَى أَزْوَاجِ النَّبِيِّ ﷺ يَسْأَلَهُنَّ هَلْ سَمِعْتُنَّ مِنْ رَسُولِ اللَّهِ ﷺ فِي ذَلِكَ سُنَّةً؟ فَأَرْسَلْنَ إِلَيْهِ «أَنَّ سُبَيْعَةَ الْأَسْلَمِيَّةَ وَضَعَتْ بَعْدَ وَفَاةِ زَوْجِهَا بِأَرْبَعِينَ لَيْلَةً فَزَوَّجَهَا رَسُولُ اللَّهِ ﷺ»
ذِكْرُ وَصْفِ عِدَّةِ الْمُتَوَفَّى عَنْهَا زَوْجُهَا وَهِيَ حَامِلٌ
"(She should wait) for the longer of the two periods." Abu Salamah said: "When she has given birth, it becomes permissible for her to remarry." Abu Hurairah came and said: "I agree with my brother's son" -meaning Abu Salamah bin 'Abdur-Rahman. They sent Kuraib, the freed slave of Ibn 'Abbas, to Umm Salamah to ask her about that. He came back to them and told them that she said: "Subai'ah gave birth one day after her husband died;" she mentioned that to the Messenger of Allah and he said: "It has become permissible for you to marry." وَقَالَ أَبُو سَلَمَةَ إِذَا نُفِسَتْ فَقَدْ حَلَّتْ قَالَ فَجَاءَ أَبُو هُرَيْرَةَ فَقَالَ أَنَا مَعَ ابْنِ أَخِي يَعْنِي أَبَا سَلَمَةَ فَبَعَثُوا كُرَيْبًا مَوْلَى ابْنِ عَبَّاسٍ إِلَى أُمِّ سَلَمَةَ زَوْجِ النَّبِيِّ ﷺ فَسَأَلَهَا عَنْ ذَلِكَ فَجَاءَهُمْ فَأَخْبَرَهُمْ أَنَّهَا قَالَتْ وَلَدَتْ سُبَيْعَةُ الْأَسْلَمِيَّةُ بَعْدَ وَفَاةِ زَوْجِهَا بِلَيَالٍ فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللَّهِ ﷺ فَقَالَ لَهَا «قَدْ حَلَلْتِ فَانْكِحِي»
ذِكْرُ الْقَدْرِ الَّذِي وَضَعَتْ فِيهِ سُبَيْعَةُ حَمْلَهَا بَعْدَ وَفَاةِ زَوْجِهَا
"Ibn 'Abbas and Abu Hurairah were asked about the woman whose husband dies when she is pregnant. Ibn 'Abbas said: '(She should wait) for the longer of the two periods.' Abu Hurairah said: 'When she gives birth it becomes permissible for her to marry.' Abu Salamah went to Umm Salamah and asked her about that, and she said: 'Subai'ah Al-Aslamiyyah gave birth half a month after her husband died, and two men proposed to her. One was young and one was old, and she was inclined toward the young one. So the old one said: It is not permissible for you to marry. Her family was not there, and he hoped that if he went to her family they would marry her to him. She went to the Messenger of Allah and he said: It is permissible for you to marry, so marry whomever you want.'" (Using translation from Nasāʾī 3510)
وَقَالَ أَبُو هُرَيْرَةَ «إِذَا وَلَدَتْ فَقَدْ حَلَّتْ» فَدَخَلَ أَبُو سَلَمَةَ عَلَى أُمِّ سَلَمَةَ فَسَأَلَهَا عَنْ ذَلِكَ فَقَالَتْ وَلَدَتْ سُبَيْعَةُ الْأَسْلَمِيَّةُ بَعْدَ وَفَاةِ زَوْجِهَا بِنِصْفِ شَهْرٍ فَخَطَبَهَا رَجُلَانِ أَحَدُهُمَا شَابٌّ وَالْآخَرُ كَهْلٌ فَحَطَّتْ إِلَى الشَّابِّ فَقَالَ الْكَهْلُ لَمْ تَحْلُلْ وَكَانَ أَهْلُهَا غَيْبًا وَرَجَا إِذَا جَاءَ أَهْلُهَا أَنْ يُؤْثِرُوهُ بِهَا فَجَاءَتْ رَسُولَ اللَّهِ ﷺ فَقَالَ «قَدْ حَلَلْتِ فَانْكِحِي مَنْ شِئْتِ»
ذِكْرُ الْإِبَاحَةِ لِلْمَرْأَةِ الْحَامِلِ إِذَا مَاتَ عَنْهَا زَوْجُهَا أَنْ تَتَزَوَّجَ بَعْدَ وَضْعِهَا حَمْلَهَا، وَإِنْ كَانَ ذَلِكَ فِي مُدَّةٍ يَسِيرَةٍ

وَضَعَتْ سُبَيْعَةُ بَعْدَ وَفَاةِ زَوْجِهَا بِأَيَّامٍ قَلَائِلَ فَأَتَتْ رَسُولَ اللَّهِ ﷺ فَاسْتَأْذَنَتْهُ فِي النِّكَاحِ «فَأَذِنَ لَهَا»
ذِكْرُ الْإِخْبَارِ بِأَنَّ الْمُتَوَفَّى عَنْهَا زَوْجُهَا لَهَا أَنْ تَتَزَوَّجَ بَعْدَ وَضْعِهَا الْحَمْلَ، وَإِنْ كَانَ ذَلِكَ فِي مُدَّةٍ يَسِيرَةٍ
"Subai'ah gave birth twenty-three or twenty-five days after her husband died, and when her Nifas ended she expressed her wish to remarry and was criticized for that. Mention of that was made to the Messenger of Allah and he said: 'There is nothing to stop her; her term has ended.'" (Using translation from Nasāʾī 3508)
وَضَعَتْ سُبَيْعَةُ حَمْلَهَا بَعْدَ وَفَاةِ زَوْجِهَا بِثَلَاثَةٍ وَعِشْرِينَ أَوْ خَمْسَةٍ وَعِشْرِينَ لَيْلَةً فَلَمَّا وَضَعَتْ تَشَوَّفَتِ الْأَزْوَاجَ فَعِيبَ ذَلِكَ عَلَيْهَا فَذُكِرَ ذَلِكَ لِرَسُولِ اللَّهِ ﷺ فَقَالَ «وَمَا يَمْنَعُهَا وَقَدِ انْقَضَى أَجَلُهَا»
ذِكْرُ وَصْفِ عِدَّةِ أُمِّ الْوَلَدِ إِذَا تُوُفِّيَ عَنْهَا سَيِّدُهَا
[Machine] "Do not impose upon us the practice of our Prophet's Sunnah, 'iddah for the mother of the child, the 'iddah of the deceased from her husband."
لَا تُلْبِسُوا عَلَيْنَا سُنَّةَ نَبِيِّنَا ﷺ «عِدَّةُ أُمِّ الْوَلَدِ عِدَّةُ الْمُتَوَفَّى عَنْهَا زَوْجُهَا»
16.8 [Machine] A chapter on the oppression of the aggressors
١٦۔٨ فَصْلٌ فِي إِحْدَادِ الْمُعْتَدَّةِ
[Machine] The Messenger of Allah ﷺ said, "It is not permissible for a believing woman in Allah and the Last Day to mourn for more than three days except for her husband. In that case, she should mourn for four months and ten days."
قَالَ رَسُولُ اللَّهِ ﷺ «لَا يَحِلُّ لِامْرَأَةٍ تُؤْمِنُ بِاللَّهِ وَالْيَوْمِ الْآخِرِ أَنْ تَحُدَّ عَلَى هَالِكٍ أَكْثَرِ مِنْ ثَلَاثٍ إِلَّا عَلَى زَوْجٍ فَإِنَّهَا تَحُدُّ عَلَيْهِ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا»
ذِكْرُ الْأَمْرِ بِالْإِحْدَادِ لِلْمَرْأَةِ عَلَى زَوْجِهَا أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا
Zainab said: "So I entered upon Zainab bint Jahsh when her brother died. She called for some perfume and put it on, then said: 'By Allah! I have no need for perfume except that I heard the Messenger of Allah said: "It is not lawful for a woman who believes in Allah and the Last Day to mourn for the dead more than three nights, except for her husband (in which case it is) four months and ten days." (Using translation from Tirmidhī 1196)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «لَا يَحِلُّ لِامْرَأَةٍ تُؤْمِنُ بِاللَّهِ وَالْيَوْمَ الْآخِرِ أَنْ تَحُدَّ عَلَى مَيِّتٍ فَوْقَ ثَلَاثَ لَيَالٍ إِلَّا عَلَى زَوْجٍ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا»
ذِكْرُ الزَّجْرِ عَنْ أَنْ تَحُدَّ الْمَرْأَةُ فَوْقَ الثَّلَاثِ عَلَى أَحَدٍ مِنَ النَّاسِ خَلَا الزَّوْجِ
It is not permissible for a woman believing in Allah and the Hereafter to observe mourning on the dead for more than three (days), except in case of her husband. (Using translation from Muslim 1491)
عَنِ النَّبِيِّ ﷺ قَالَ «لَا يَحِلُّ لِامْرَأَةٍ تُؤْمِنُ بِاللَّهِ وَالْيَوْمِ الْآخِرِ أَنْ تَحُدَّ عَلَى مَيِّتٍ فَوْقَ ثَلَاثٍ إِلَّا عَلَى زَوْجٍ»
ذِكْرُ الْإِبَاحَةِ لِلْمَرْأَةِ فِي الْإِحْدَادِ أَنْ تَمَسَّ الطِّيبَ فِي بَعْضِ الْأَوْقَاتِ دُونَ بَعْضٍ
I had in fact no need of it, but I heard Messenger of Allah ﷺ as saying: It is not permissible for the women believing in Allah and the Hereafter to abstain from adornment beyond three days except (at the death of) husband (in which case she must abstain from adornment) for four months and ten days. قَالَ رَسُولُ اللَّهِ ﷺ «لَا يَحِلُّ لِامْرَأَةٍ تُؤْمِنُ بِاللَّهِ وَالْيَوْمِ الْآخِرِ أَنْ تَحُدَّ عَلَى مَيِّتٍ فَوْقَ ثَلَاثٍ إِلَّا عَلَى زَوْجٍ فَإِنَّهَا تَحُدُّ عَلَيْهِ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا لَا تَكْتَحِلُ وَلَا تَلْبَسُ ثَوْبًا مَصْبُوغًا إِلَّا ثَوْبَ عَصْبٍ وَلَا تَمَسُّ طِيبًا إِلَّا عِنْدَ أَدْنَى طُهْرِهَا إِذَا اغْتَسَلَتْ مِنْ مَحِيضِهَا نُبْذَةَ قُسْطٍ وَأَظْفَارٍ» *
ذِكْرُ الزَّجْرِ عَنْ أَنْ تَلْبَسَ الْمُعْتَدَّةُ الْحُلِيَّ، أَوْ تَخْتَضِبَ
The Prophet ﷺ said: A woman whose husband has died must not wear clothes dyed with safflower (usfur) or with red ochre (mishq) and ornaments. She must not apply henna and collyrium. (Using translation from Abū Dāʾūd 2304)
عَنِ النَّبِيِّ ﷺ قَالَ «الْمُتَوَفَّى عَنْهَا زَوْجُهَا لَا تَلْبَسُ الْمُعَصْفَرَ مِنَ الثِّيَابِ وَلَا الْمُمَشَّقَةَ وَلَا الْحُلِيَّ وَلَا تَخْتَضِبُ وَلَا تَكْتَحِلُ»
16.8.3 Subsection
١٦۔٨۔٣ ذِكْرُ وَصْفِ الْإِحْدَادِ الَّذِي تَسْتَعْمِلُ الْمَرْأَةُ عَلَى زَوْجِهَا
[Machine] I swear to Allah, I have no need for perfume other than that I heard the Messenger of Allah ﷺ say, "It is not permissible for a woman who believes in Allah and the Last Day to mourn for a dead person for more than three nights, except for her husband for four months and ten days." Zainab said, "I entered upon Zainab bint Jahsh when her brother Abdullah ibn Jahsh died, and she called for perfume and applied it. Then she said, "I swear to Allah, I have no need for perfume other than that I heard the Messenger of Allah ﷺ say on the pulpit, "It is not permissible for a woman who believes in Allah and the Last Day to mourn for a dead person for more than three nights, except for her husband for four months and ten days."
وَاللَّهِ مَا لِي بِالطِّيبِ مِنْ حَاجَةٍ غَيْرَ أَنِّي سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «لَا يَحِلُّ لِامْرَأَةٍ تُؤْمِنُ بِاللَّهِ وَالْيَوْمِ الْآخِرِ أَنْ تَحُدَّ عَلَى مَيِّتٍ فَوْقَ ثَلَاثِ لَيَالٍ إِلَّا عَلَى زَوْجٍ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا» وَقَالَتْ زَيْنَبُ دَخَلْتُ عَلَى زَيْنَبَ بِنْتِ جَحْشٍ حِينَ تُوُفِّيَ أَخُوهَا عَبْدُ اللَّهِ بْنُ جَحْشٍ فَدَعَتْ بِطِيبٍ فَمَسَّتْ مِنْهُ ثُمَّ قَالَتْ وَاللَّهِ مَا لِي بِالطِّيبِ مِنْ حَاجَةٍ غَيْرَ أَنِّي سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ عَلَى الْمِنْبَرِ «لَا يَحِلُّ لِامْرَأَةٍ تُؤْمِنُ بِاللَّهِ وَالْيَوْمِ الْآخِرِ أَنْ تَحُدَّ عَلَى مَيِّتٍ فَوْقَ ثَلَاثَ لَيَالٍ إِلَّا عَلَى زَوْجٍ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا»
"I heard my mother, Um Salama saying that a woman came to Messenger of Allah ﷺ and said, "O Messenger of Allah ﷺ! The husband of my daughter has died and she is suffering from an eye disease, can she apply kohl to her eye?" Messenger of Allah ﷺ replied, "No," twice or thrice. (Every time she repeated her question) he said, "No." Then Messenger of Allah ﷺ added, "It is just a matter of four months and ten days. In the Pre-Islamic Period of ignorance a widow among you should throw a globe of dung when one year has elapsed." (Using translation from Bukhārī 5336)
وَسَمِعْتُ أُمِّي أُمَّ سَلَمَةَ تَقُولُ جَاءَتِ امْرَأَةٌ إِلَى رَسُولِ اللَّهِ ﷺ فَقَالَتْ يَا رَسُولَ اللَّهِ إِنَّ ابْنَتِي تُوُفِّيَ عَنْهَا زَوْجُهَا وَقَدِ اشْتَكَتْ عَيْنَاهَا فَنُكَحِّلُهَا؟ فَقَالَ رَسُولُ اللَّهِ ﷺ «لَا» مَرَّتَيْنِ أَوْ ثَلَاثًا كُلُّ ذَلِكَ يَقُولُ «لَا إِنَّمَا هِيَ أَرْبَعَةُ أَشْهُرٍ وَعَشْرٌ وَقَدْ كَانَتْ إِحْدَاكُنَّ فِي الْجَاهِلِيَّةِ تَرْمِي بِالْبَعْرَةِ عَلَى رَأْسِ الْحَوْلِ
