ذِكْرُ الْقَدْرِ الَّذِي وَضَعَتْ فِيهِ سُبَيْعَةُ حَمْلَهَا بَعْدَ وَفَاةِ زَوْجِهَا

"Ibn 'Abbas and Abu Hurairah were asked about the woman whose husband dies when she is pregnant. Ibn 'Abbas said: '(She should wait) for the longer of the two periods.' Abu Hurairah said: 'When she gives birth it becomes permissible for her to marry.' Abu Salamah went to Umm Salamah and asked her about that, and she said: 'Subai'ah Al-Aslamiyyah gave birth half a month after her husband died, and two men proposed to her. One was young and one was old, and she was inclined toward the young one. So the old one said: It is not permissible for you to marry. Her family was not there, and he hoped that if he went to her family they would marry her to him. She went to the Messenger of Allah and he said: It is permissible for you to marry, so marry whomever you want.'" (Using translation from Nasāʾī 3510)

وَقَالَ أَبُو هُرَيْرَةَ «إِذَا وَلَدَتْ فَقَدْ حَلَّتْ» فَدَخَلَ أَبُو سَلَمَةَ عَلَى أُمِّ سَلَمَةَ فَسَأَلَهَا عَنْ ذَلِكَ فَقَالَتْ وَلَدَتْ سُبَيْعَةُ الْأَسْلَمِيَّةُ بَعْدَ وَفَاةِ زَوْجِهَا بِنِصْفِ شَهْرٍ فَخَطَبَهَا رَجُلَانِ أَحَدُهُمَا شَابٌّ وَالْآخَرُ كَهْلٌ فَحَطَّتْ إِلَى الشَّابِّ فَقَالَ الْكَهْلُ لَمْ تَحْلُلْ وَكَانَ أَهْلُهَا غَيْبًا وَرَجَا إِذَا جَاءَ أَهْلُهَا أَنْ يُؤْثِرُوهُ بِهَا فَجَاءَتْ رَسُولَ اللَّهِ ﷺ فَقَالَ «قَدْ حَلَلْتِ فَانْكِحِي مَنْ شِئْتِ»

malik:29-92

Yahya related to me from Malik from Abdu Rabbih ibn Said ibn Qays that Abu Salama ibn Abd ar-Rahman said that Abdullah ibn Abbas and Abu Hurayra were asked when a pregnant woman whose husband had died could remarry. Ibn Abbas said, "At the end of two periods." Abu Hurayra said, "When she gives birth, she is free to marry." Abu Salama ibn Abd ar-Rahman visited Umm Salama, the wife of the Prophet ﷺ and asked her about it Umm Salama said, ''Subaya al-Aslamiya gave birth half a month after the death of her husband, and two men asked to marry her. One was young and the other was old. She preferred the young man and so the older man said, 'You are not free to marry yet.' Her family were away and he hoped that when her family came, they would give her to him. She went to the Messenger of Allah ﷺ and he said, 'You are free to marry, so marry whomever you wish.' "  

مالك:٢٩-٩٢حَدَّثَنِي يَحْيَى عَنْ مَالِكٍ عَنْ عَبْدِ رَبِّهِ بْنِ سَعِيدِ بْنِ قَيْسٍ عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ

"(She should wait) for the longer of the two periods." Abu Salamah said: "When she has given birth, it becomes permissible for her to remarry." Abu Hurairah came and said: "I agree with my brother's son" -meaning Abu Salamah bin 'Abdur-Rahman. They sent Kuraib, the freed slave of Ibn 'Abbas, to Umm Salamah to ask her about that. He came back to them and told them that she said: "Subai'ah gave birth one day after her husband died;" she mentioned that to the Messenger of Allah and he said: "It has become permissible for you to marry." وَقَالَ أَبُو سَلَمَةَ إِذَا نُفِسَتْ فَقَدْ حَلَّتْ قَالَ فَجَاءَ أَبُو هُرَيْرَةَ فَقَالَ أَنَا مَعَ ابْنِ أَخِي يَعْنِي أَبَا سَلَمَةَ فَبَعَثُوا كُرَيْبًا مَوْلَى ابْنِ عَبَّاسٍ إِلَى أُمِّ سَلَمَةَ زَوْجِ النَّبِيِّ ﷺ فَسَأَلَهَا عَنْ ذَلِكَ فَجَاءَهُمْ فَأَخْبَرَهُمْ أَنَّهَا قَالَتْ وَلَدَتْ سُبَيْعَةُ الْأَسْلَمِيَّةُ بَعْدَ وَفَاةِ زَوْجِهَا بِلَيَالٍ فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللَّهِ ﷺ فَقَالَ لَهَا «قَدْ حَلَلْتِ فَانْكِحِي»

[Machine] Al-Qa'nabi narrated from Malik that Bakr ibn Sahl narrated from Abdullah ibn Yusuf that Malik said, narrating from Abd Rabeh ibn Sa'id, who narrated from Abu Salama, who narrated from Umm Salama: She said, "Subay'ah al-Aslamiyyah gave birth after the death of her husband by half a month. Then, two men proposed to her, one of them being a young man and the other being an older man. She agreed to marry the young man. The older man said, 'You are not permissible (to me).' Her family was absent at the time, and he requested that when her family returned, they give him priority concerning her. So she came to the Prophet ﷺ and he said, 'You are permissible (to marry) whoever you wish.'"
