64. Vows (1/2)
٦٤۔ كِتَابُ النُّذُورِ ص ١
[Machine] The Messenger of Allah ﷺ said, and in another narration from Sufyan, from the Prophet ﷺ , he said: "There are four traits; whoever possesses them is a complete hypocrite, and whoever possesses one of them has a trait of hypocrisy until he abandons it. When he speaks, he lies; when he makes a promise, he breaks it; when he is entrusted with something, he betrays it; and when he disputes, he becomes vulgar."
قَالَ رَسُولُ اللهِ ﷺ وَفِي رِوَايَةِ سُفْيَانَ عَنِ النَّبِيِّ ﷺ قَالَ أَرْبَعٌ مَنْ كُنَّ فِيهِ كَانَ مُنَافِقًا خَالِصًا وَمَنْ كَانَتْ فِيهِ خَصْلَةٌ مِنْهُنَّ كَانَتْ فِيهِ خَصْلَةٌ مِنْ نِفَاقٍ حَتَّى يَدَعَهَا إِذَا حَدَّثَ كَذَبَ وَإِذَا عَاهَدَ غَدَرَ وَإِذَا وَعَدَ أَخْلَفَ وَإِذَا خَاصَمَ فَجَرَ
[Machine] The Prophet ﷺ said, "The best of you are my generation, then those who follow them, then those who follow them. Then there will be a people after them who will betray and not be trustworthy, who will testify without being called to testify, who will make promises and not fulfill them, and who will have excess fat among them."
قَالَ النَّبِيُّ ﷺ خَيْرُكُمْ قَرْنِي ثُمَّ الَّذِينَ يَلُونَهُمْ ثُمَّ الَّذِينَ يَلُونَهُمْ ثُمَّ يَكُونُ قَوْمٌ بَعْدَهُمْ يَخُونُونَ وَلَا يُؤْتَمَنُونَ وَيَشْهَدُونَ وَلَا يُسْتَشْهَدُونَ وَيَنْذِرُونَ وَلَا يُوفُونَ وَيَظْهَرُ فِيهِمْ السِّمَنُ
64.2 [Machine] What is fulfilled from the vows and what is not fulfilled
٦٤۔٢ بَابُ مَا يُوَفَّى بِهِ مِنَ النُّذُورِ , وَمَا لَا يُوَفَّى
The Prophet ﷺ said, "Whoever vows that he will be obedient to Allah, should remain obedient to Him; and whoever made a vow that he will disobey Allah, should not disobey Him." (Using translation from Bukhārī 6696)
قَالَ رَسُولُ اللهِ ﷺ مَنْ نَذَرَ أَنْ يُطِيعَ اللهَ فَلْيُطِعْهُ وَمَنْ نَذَرَ أَنْ يَعْصِيَهُ فَلَا يَعْصِهِ
[Machine] Thaqeef was an ally of the Banu 'Uqayl, and they captured two men from the companions of the Prophet ﷺ, and the companions of the Messenger of Allah ﷺ captured a man, and they all had the smallpox. The narration mentioned it as follows: "And a woman from the Ansar was also captured, and she also had the smallpox. So, the woman was in captivity, and the people would relieve themselves of their blessings among their households. One night she escaped from her captors and came across some camels. She would untie them when they approached the basil, and she did not untie them. He said: "And there was a branded camel, and it sat in its place, then it was stirred, and it left. They made a vow about it, so they went to look for it, but it eluded them." He said: "And she vowed that if Allah saved her, she would sacrifice it." So, when she arrived in the city, the people saw her and said: "This is the camel of the Messenger of Allah ﷺ." So, they said: "Indeed, she vowed that if Allah saved her from them, she would sacrifice it for Him." They went to the Prophet ﷺ and mentioned that to him, and he said: "Glory be to Allah! How wretched is what she has done! If Allah saved her from them, it was upon her to fulfill her vow, there is no fulfillment for a vow in disobedience to Allah, and in something that the servant does not possess."
كَانَتْ ثَقِيفُ حُلَفَاءَ لِبَنِي عُقَيْلٍ فَأَسَرَتْ ثَقِيفُ رَجُلَيْنِ مِنْ أَصْحَابِ النَّبِيِّ ﷺ وَأَسَرَ أَصْحَابُ رَسُولِ اللهِ ﷺ رَجُلًا وَأَصَابُوا مَعَهُ الْعَضْبَاءَ فَذَكَرَ الْحَدِيثَ كَمَا مَضَى وَفِيهِ قَالَ وَأُسِرَتِ امْرَأَةٌ مِنَ الْأَنْصَارِ وَأُصِيبَتِ الْعَضْبَاءُ فَكَانَتِ الْمَرْأَةُ فِي الْوَثَاقِ وَكَانَ الْقَوْمُ يُرِيحُونَ نَعَمَهُمْ بَيْنَ أَيْدِي بُيُوتِهِمْ فَانْفَلَتَتْ ذَاتَ لَيْلَةٍ مِنَ الْوَثَاقِ فَأَتَتِ الْإِبِلَ فَجَعَلَتْ إِذَا دَنَتْ مِنَ الْبَعِيرِ رَغَا فَتَتْرُكُهُ حَتَّى تَنْتَهِيَ إِلَى الْعَضْبَاءِ فَلَمْ تَرْغُ قَالَ وَنَاقَةٌ مَنُوقَةٌ فَقَعَدَتْ فِي عَجُزِهَا ثُمَّ زَجَرَتْهَا فَانْطَلَقَتْ وَنَذَرُوا بِهَا فَطَلَبُوهَا فَأَعْجَزَتْهُمْ قَالَ وَنَذَرَتْ إِنِ اللهُ أَنْجَاهَا لَتَنْحَرَنَّهَا فَلَمَّا قَدِمَتِ الْمَدِينَةَ رَآهَا النَّاسُ فَقَالُوا الْعَضْبَاءُ نَاقَةُ رَسُولِ اللهِ ﷺ فَقَالَ إِنَّهَا قَدْ نَذَرَتْ إِنِ اللهُ أَنْجَاهَا عَلَيْهَا لَتَنْحَرَنَّهَا فَأَتَوَا النَّبِيَّ ﷺ فَذَكَرُوا ذَلِكَ لَهُ فَقَالَ سُبْحَانَ اللهِ بِئْسَ مَا جَزَتْهَا إِنِ اللهُ أَنْجَاهَا عَلَيْهَا لَتَنْحَرَنَّهَا لَا وَفَاءَ لِنَذْرٍ فِي مَعْصِيَةِ اللهِ وَلَا فِيمَا لَا يَمْلِكُ الْعَبْدُ
[Machine] A woman from the family of Abu Dharr came to the Prophet Muhammad ﷺ riding a camel until she stopped near the mosque. She said, "O Messenger of Allah, I have made a vow that if Allah saves me on this journey, I will not eat the liver and lungs of camels." He said, "This is not a vow. A vow is only made seeking the Face of Allah."
أَنَّ امْرَأَةَ أَبِي ذَرٍّ جَاءَتْ عَلَى الْقَصْوَاءِ رَاحِلَةِ رَسُولِ اللهِ ﷺ حَتَّى أَنَاخَتْ عِنْدَ الْمَسْجِدِ فَقَالَتْ يَا رَسُولَ اللهِ نَذَرْتُ لَئِنْ نَجَّانِي اللهُ عَلَيْهَا لَآكُلَنَّ مِنْ كَبِدِهَا وَسَنَامِهَا قَالَ بِئْسَمَا جَزَيْتِيهَا لَيْسَ هَذَا نَذْرًا إِنَّمَا النَّذْرُ مَا ابْتُغِيَ بِهِ وَجْهُ اللهِ
While the Prophet ﷺ was preaching a man was standing in the sun. He asked about him. They said: He is Abu Isra'il who has taken a vow to stand and not to sit, or go into shade, or speak, but to fast. Thereupon he said: Command him to speak, to go into the shade, sit and complete his fast. (Using translation from Abū Dāʾūd 3300)
بَيْنَمَا النَّبِيُّ ﷺ يَخْطُبُ إِذَا هُوَ بِرَجُلٍ قَائِمٍ فِي الشَّمْسِ فَسَأَلَ عَنْهُ فَقَالُوا هَذَا أَبُو إِسْرَائِيلَ نَذَرَ أَنْ يَقُومَ وَلَا يَقْعُدَ وَلَا يَسْتَظِلَّ وَلَا يَتَكَلَّمَ وَيَصُومَ وَلَا يُفْطِرَ فَقَالَ مُرْهُ فَلْيَتَكَلَّمْ وَلْيَسْتَظِلَّ وَلْيَقْعُدْ وَلْيُتِمَّ صَوْمَهُ
[Machine] Abu Israel passed by while he was standing in the sun, so he said, "What is wrong with him?" They said, "He made a vow not to seek shade, sit, speak to anyone, and fast." So the Prophet, ﷺ , ordered him to seek shade, sit, speak to people, and complete his fast, and he did not command him to offer expiation. This is a good and authentic hadith, and it indicates that he was not ordered to offer expiation. Al-Hassan bin Umara narrated it from Habib bin Abi Thabit from Sa'id bin Jubair from Ibn Abbas, with a similar wording. In the end, he was not commanded to offer expiation. It was also narrated from Muhammad bin Kuraib from his father from Ibn Abbas, and it includes the command to offer expiation, but Muhammad bin Kuraib is weak.
مَرَّ بِأَبِي إِسْرَائِيلَ وَهُوَ قَائِمٌ فِي الشَّمْسِ فَقَالَ مَا لَهُ؟ فَقَالُوا نَذَرَ أَنْ لَا يَسْتَظِلَّ وَلَا يَقْعُدَ وَلَا يُكَلِّمَ أَحَدًا وَيَصُومَ فَأَمَرَهُ النَّبِيُّ صَلَّى اللهَ عَلَيْهِ وَسَلَّمَ أَنْ يَسْتَظِلَّ وَأَنْ يَقْعُدَ وَأَنْ يُكَلِّمَ النَّاسَ وَيُتِمَّ صَوْمَهُ وَلَمْ يَأْمُرْهُ بِكَفَّارَةٍ هَذَا مُرْسَلٌ جَيِّدٌ وَفِيهِ وَفِيمَا قَبْلَهُ دَلَالَةٌ عَلَى أَنَّهُ لَمْ يَأْمُرْ بِكَفَّارَةٍ وَرَوَاهُ الْحَسَنُ بْنُ عُمَارَةَ عَنْ حَبِيبِ بْنِ أَبِي ثَابِتٍ عَنْ سَعِيدِ بْنِ جُبَيْرٍ عَنِ ابْنِ عَبَّاسٍ ؓ بِمِثْلِهِ وَفِي آخِرِهِ وَلَمْ يَأْمُرْهُ بِالْكَفَّارَةِ وَرُوِيَ عَنْ مُحَمَّدِ بْنِ كُرَيْبٍ عَنْ أَبِيهِ عَنِ ابْنِ عَبَّاسٍ ؓ وَفِيهِ الْأَمْرُ بِالْكَفَّارَةِ وَمُحَمَّدُ بْنُ كُرَيْبٍ ضَعِيفٌ
[Machine] He fasted, did not sit, did not seek shade, and did not speak. So the Prophet ﷺ was brought to him and the Messenger of Allah ﷺ said to him, "Sit down, seek shade, and speak, and disbelieve like this." I found him disbelieving, and he disbelieve and with me it is a distortion. It is only fasting as he is in the rest of the narrations. And Allah knows best.
يَصُومَ وَلَا يَقْعُدَ وَلَا يَسْتَظِلَّ وَلَا يَتَكَلَّمَ فَأُتِيَ بِهِ النَّبِيُّ ﷺ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ اقْعُدْ وَاسْتَظِلَّ وَتَكَلَّمْ وَكَفِّرْ كَذَا وَجَدْتُهُ وَكَفِّرْ وَعِنْدِي أَنَّ ذَلِكَ تَصْحِيفٌ إِنَّمَا هُوَ وَصُمْ كَمَا هُوَ فِي سَائِرِ الرِّوَايَاتِ وَاللهُ أَعْلَمُ
[Machine] Layla, the wife of Bashir ibn al-Khassasiyyah, told me that his name before that was Zahm. The Messenger of Allah ﷺ gave him the name Bashir. She said that Bashir told her that he asked the Messenger of Allah ﷺ about fasting on Fridays and not speaking to anyone on that day. The Messenger of Allah ﷺ said to him, "Do not fast on Fridays unless you used to fast on that day or in a month, and do not speak to anyone. By the oath of Allah, speaking and commanding good or forbidding evil is better than keeping silent."
حَدَّثَتْنِي لَيْلَى امْرَأَةُ بَشِيرِ بْنِ الْخَصَاصِيَةِ وَكَانَ اسْمُهُ قَبْلَ ذَلِكَ زَحْمًا فَسَمَّاهُ رَسُولُ اللهِ ﷺ بَشِيرًا قَالَتْ حَدَّثَنِي بَشِيرٌ أَنَّهُ سَأَلَ رَسُولُ اللهِ ﷺ عَنْ صَوْمِ يَوْمِ الْجُمُعَةِ وَأَنْ لَا يُكَلِّمَ ذَلِكَ الْيَوْمَ أَحَدًا؟ قَالَ فَقَالَ لَهُ لَا تَصُمْ يَوْمَ الْجُمُعَةِ إِلَّا فِي أَيَّامٍ كُنْتَ تَصُومُهَا أَوْ فِي شَهْرٍ وَأَنْ لَا تُكَلِّمَ أَحَدًا فَلَعَمْرِي لَأَنْ تَكَلَّمَ فَتَأْمُرَ بِمَعْرُوفٍ أَوْ تَنْهَى عَنْ مُنْكَرٍ خَيْرٌ مِنْ أَنْ تَسْكُتَ
Abu Bakr went to a lady from the Ahmas tribe called Zainab bint Al-Muhajir and found that she refused to speak. He asked, "Why does she not speak." The people said, "She has intended to perform Hajj without speaking." He said to her, "Speak, for it is illegal not to speak, as it is an action of the pre-islamic period of ignorance. So she spoke and said, "Who are you?" He said, "A man from the Emigrants." She asked, "Which Emigrants?" He replied, "From Quraish." She asked, "From what branch of Quraish are you?" He said, "You ask too many questions; I am Abu Bakr." She said, "How long shall we enjoy this good order (i.e. Islamic religion) which Allah has brought after the period of ignorance?" He said, "You will enjoy it as long as your Imams keep on abiding by its rules and regulations." She asked, "What are the Imams?" He said, "Were there not heads and chiefs of your nation who used to order the people and they used to obey them?" She said, "Yes." He said, "So they (i.e. the Imams) are those whom I meant." (Using translation from Bukhārī 3834)
دَخَلَ أَبُو بَكْرٍ الصِّدِّيقُ ؓ عَلَى امْرَأَةٍ مِنْ أَحْمَسَ يُقَالُ لَهَا زَيْنَبُ قَالَ فَرَآهَا لَا تَكَلَّمُ قَالَ مَا لِهَذِهِ لَا تَكَلَّمُ؟ قَالَ فَقَالُوا حَجَّتْ مُصْمِتَةً فَقَالَ تَكَلَّمِي فَإِنَّ هَذَا لَا يَحِلُّ هَذَا مِنْ عَمَلِ الْجَاهِلِيَّةِ فَتَكَلَّمَتْ فَقَالَتْ مَنْ أَنْتَ؟ قَالَ أَنَا مِنَ الْمُهَاجِرِينَ قَالَتْ مِنْ أِيِّ الْمُهَاجِرِينَ؟ قَالَ مِنْ قُرَيْشٍ قَالَتْ مِنْ أِيِّ قُرَيْشٍ؟ قَالَ إِنَّكِ لَسئُولٌ أَنَا أَبُو بَكْرٍ فَقَالَتْ مَا بَقَاؤُنَا عَلَى هَذَا الْأَمْرِ الصَّالِحِ الَّذِي جَاءَ اللهُ بِهِ بَعْدَ الْجَاهِلِيَّةِ بَعْدَ النَّبِيِّ ﷺ؟ قَالَ فَقَالَ بَقَاؤُكُمْ عَلَيْهِ مَا اسْتَقَامَتْ أَئِمَّتُكُمْ قَالَتْ وَمَا الْأَئِمَّةُ؟ قَالَ أَمَا كَانَ لِقَوْمِكِ رُءُوسٌ وَأَشْرَافٌ يَأْمُرُونَهُمْ وَيُطِيعُونَهُمْ؟ قَالَتْ بَلَى قَالَ فَهُمْ أَمْثَالُ أُولَئِكَ يَكُونُونَ عَلَى النَّاسِ
[Machine] He went to the dome of a woman and greeted her, but she did not speak to him. He did not leave her until she spoke to him. She said, "O Abdullah, who are you?" He said, "I am from the emigrants." She said, "The emigrants are many, so which group are you from?" He said, "I am from the Quraysh." She said, "The Quraysh are many, so which clan are you from?" He said, "I am Abu Bakr." She said, "You are my father and mother. There was something between us and a group of people in the pre-Islamic era, so I swore that I would not speak to anyone until I perform Hajj." He said, "Indeed, Islam has abolished that, so speak."
أَنَّهُ أَتَى قُبَّةَ امْرَأَةٍ فَسَلَّمَ فَلَمْ تُكَلِّمْهُ فَلَمْ يَتْرُكْهَا حَتَّى كَلَّمَتْهُ قَالَتْ يَا عَبْدَ اللهِ مَنْ أَنْتَ؟ قَالَ مِنَ الْمُهَاجِرِينَ قَالَتْ الْمُهَاجِرُونَ كَثِيرٌ فَمِنْ أَيِّهِمْ أَنْتَ؟ قَالَ فَقَالَ مِنْ قُرَيْشٍ قَالَتْ قُرَيْشٌ كَثِيرٌ فَمِنْ أَيِّهِمْ أَنْتَ؟ قَالَ أَنَا أَبُو بَكْرٍ قَالَتْ بِأَبِي أَنْتَ وَأُمِّي كَانَ بَيْنَنَا وَبَيْنَ قَوْمٍ فِي الْجَاهِلِيَّةِ شَيْءٌ فَحَلَفْتُ إِنِ اللهُ عَافَانَا أَنْ لَا أُكَلِّمَ أَحَدًا حَتَّى أَحُجَّ قَالَ إِنَّ الْإِسْلَامَ هَدَمَ ذَلِكَ فَتَكَلَّمِي
[Machine] Abdullah, what you said was awful. That was only a woman speaking to have an excuse, and they denied that there could be a child without a husband or outside of marriage. So submit, enjoin what is good, and turn away from the ignorant. That is better than that.
عَبْدُ اللهِ بِئْسَ مَا قُلْتَ إِنَّمَا كَانَتْ تِلْكَ امْرَأَةً قَالَتْ ذَلِكَ لِيَكُونَ لَهَا عُذْرٌ وَكَانُوا يُنْكِرُونَ أَنْ يَكُونَ وَلَدٌ مِنْ غَيْرِ زَوْجٍ وَلَا زِنًا أَوْ إِلَّا زِنًا فَسَلِّمْ وَمُرْ بِالْمَعْرُوفِ وَانْهَ عَنِ الْمُنْكَرِ خَيْرٌ مِنْ ذَلِكَ
64.3 [Machine] What is fulfilled of the pre-Islamic era vows
٦٤۔٣ بَابُ مَا يُوَفَّى بِهِ مِنْ نُذُورِ الْجَاهِلِيَّةِ
[Machine] I performed the 'Itikaf in the Masjid al-Haram, and when I embraced Islam, I asked the Prophet ﷺ about it, and he said: Fulfill your vow.
أَعْتَكِفَ فِي الْمَسْجِدِ الْحَرَامِ فَلَمَّا أَسْلَمْتُ سَأَلْتُ النَّبِيَّ ﷺ عَنْ ذَلِكَ فَقَالَ أَوْفِ بِنَذْرِكَ
[Machine] "I have fulfilled my vow to mention the words of Muhammad, and in the narration of Musaddad, I vowed to spend a night in the pre-Islamic era."
أَوْفِ بِنَذْرِكَ لَفْظُ حَدِيثِ مُحَمَّدٍ وَفِي رِوَايَةِ مُسَدَّدٍ إِنِّي نَذَرْتُ أَنْ أَعْتَكِفَ لَيْلَةً فِي الْجَاهِلِيَّةِ
64.4 [Machine] What is fulfilled from a vow that is permissible, even if it is not an act of obedience.
٦٤۔٤ بَابُ مَا يُوَفَّى بِهِ مِنْ نَذْرِ مَا يَكُونُ مُبَاحًا , وَإِنْ لَمْ يَكُنْ طَاعَةً
[Machine] The Prophet ﷺ returned from one of his battles, and then a young black girl approached him and said, "O Messenger of Allah, I had made a vow that if Allah returns you safely, I will play the tambourine in front of you." He replied, "If you had made a vow, then go ahead and play it." So she began to play, and then Abu Bakr entered while she was playing, and then Umar entered. The girl dropped the tambourine under her when she saw Umar and sat on it. The Messenger of Allah ﷺ said, "Indeed, Satan fears you, O Umar."
أَنَّ النَّبِيَّ ﷺ قَدِمَ مِنْ بَعْضِ مَغَازِيهِ فَأَتَتْهُ جَارِيَةٌ سَوْدَاءُ فَقَالَتْ يَا رَسُولَ اللهِ إِنِّي كُنْتُ نَذَرْتُ إِنْ رَدَّكَ اللهُ سَالِمًا أَنْ أَضْرِبَ بَيْنَ يَدَيْكَ بِالدُّفِّ فَقَالَ إِنْ كُنْتِ نَذَرْتِ فَاضْرِبِي قَالَ فَجَعَلَتْ تَضْرِبُ فَدَخَلَ أَبُو بَكْرٍ ؓ وَهِيَ تَضْرِبُ ثُمَّ دَخَلَ عُمَرُ ؓ فَأَلْقَتِ الدُّفَّ تَحْتَهَا وَقَعَدَتْ عَلَيْهِ فَقَالَ رَسُولُ اللهِ ﷺ إِنَّ الشَّيْطَانَ يَخَافُ مِنْكَ يَا عُمَرُ
[Machine] That a woman came to the Prophet ﷺ and said, "O Messenger of Allah, I have vowed to strike you on the head with a tambourine." He said, "Fulfill your vow." The scholar, may Allah have mercy on him, said, "It is similar to if it were that he ﷺ only allowed her to strike him because it is a permissible matter and it shows joy at the appearance of the Messenger of Allah ﷺ and his safe return. It is not obligatory to fulfill the vow and Allah knows best."
أَنَّ امْرَأَةً أَتَتِ النَّبِيَّ ﷺ فَقَالَتْ يَا رَسُولَ اللهِ إِنِّي نَذَرْتُ أَنْ أَضْرِبَ عَلَى رَأْسِكَ بِالدُّفِّ فَقَالَ أَوْفِي بِنَذْرِكَ قَالَ الشَّيْخُ رَحِمَهُ اللهُ يُشْبِهُ أَنْ يَكُونَ ﷺ إِنَّمَا أَذِنَ لَهَا فِي الضَّرْبِ لِأَنَّهُ أَمْرٌ مُبَاحٌ وَفِيهِ إِظْهَارُ الْفَرَحِ بِظُهُورِ رَسُولِ اللهِ ﷺ وَرُجُوعِهِ سَالِمًا لَا أَنَّهُ يَجِبُ بِالنَّذْرِ وَاللهُ أَعْلَمُ
64.5 [Machine] Dislike of vows
٦٤۔٥ بَابُ كَرَاهِيَةِ النَّذْرِ
[Machine] The Messenger of Allah ﷺ forbade making vows and said, "Indeed, it does not bring forth anything but extracts it from the miserly." And in another narration it is said, "but it is extracted from the miserly."
نَهَى رَسُولُ اللهِ ﷺ عَنِ النَّذْرِ وَقَالَ إِنَّهُ لَا يَرُدُّ شَيْئًا إِنَّمَا يُسْتَخْرَجُ بِهِ مِنَ الشَّحِيحِ وَفِي رِوَايَةِ خَلَّادٍ وَلَكِنْ يُسْتَخْرَجُ بِهِ مِنَ الشَّحِيحِ
The vow does not bring anything near to the son of Adam which Allah has not ordained for him, but (at times) the vow coincides with Destiny, and this is how something is extracted from the miserly person, which that miser was not willing to give. (Using translation from Muslim 1640c)
أَنَّ النَّبِيَّ ﷺ قَالَ إِنَّ النَّذْرَ لَا يُقَرِّبُ مِنَ ابْنِ آدَمَ شَيْئًا لَمْ يَكُنِ اللهُ قَدَّرَهُ لَهُ وَلَكِنَّ النَّذْرَ يُوَافِقُ الْقَدَرَ فَيُخْرَجُ بِذَلِكَ مِنَ الْبَخِيلِ مَا لَمْ يَكُنِ الْبَخِيلُ يُرِيدُ أَنْ يُخْرِجَهُ
64.6 [Machine] Whoever makes a vow to walk to the Kaaba Imam Al-Shafi'i (may Allah have mercy on him) said: It is necessary for him to walk if he is able to do so. Our companions said: Because walking to a virtuous location is a virtue. As evidence for this, Allah says: "They come to you on foot" (Surah Al-Hajj, 27)
٦٤۔٦ بَابُ مَنْ نَذَرَ تَبَرُّرًا أَنْ يَمْشِيَ إِلَى بَيْتِ اللهِ الْحَرَامِ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: لَزِمَهُ أَنْ يَمْشِيَ إِنْ قَدَرَ عَلَى الْمَشْيِ " قَالَ أَصْحَابُنَا: " لِأَنَّ الْمَشْيَ إِلَى مَوْضِعِ الْبِرِّ بِرٌّ " , اسْتِدْلَالًا بِقَوْلِهِ تَعَالَى {يَأْتُوكَ رِجَالًا} [الحج: 27]
[Machine] There was a man, I think he was the farthest in distance from the mosque among the people of the city who prayed towards the Qibla. He used to attend prayers with the Prophet ﷺ. So it was said to him, "If you bought a donkey and rode it during the day and night, what would you do?" He said, "By Allah, I do not like for my house to be attached to the mosque." So the Messenger of Allah ﷺ was informed and he asked him, "O Messenger of Allah, how should I write my deeds, both good and bad, my returning to my family, my approaching, and my leaving?" The Messenger of Allah ﷺ said, "Allah will give you what you have intended."
كَانَ رَجُلٌ مَا أَعْلَمُ أَحَدًا مِنْ أَهْلِ الْمَدِينَةِ مِمَّنْ يُصَلِّي بِالْقِبْلَةِ أَبْعَدَ مَنْزِلًا مِنَ الْمَسْجِدِ مِنْهُ وَكَانَ يَحْضُرُ الصَّلَوَاتِ مَعَ النَّبِيِّ ﷺ قَالَ فَقِيلَ لَهُ لَوِ اشْتَرَيْتَ حِمَارًا فَرَكِبْتَهُ فِي الرَّمْضَاءِ وَالظَّلْمَاءِ فَقَالَ وَاللهِ مَا أُحِبُّ أَنَّ مَنْزِلِي يَلْزَقُ الْمَسْجِدَ فَأُخْبِرَ رَسُولُ اللهِ ﷺ بِذَلِكَ فَسَأَلَهُ فَقَالَ يَا رَسُولَ اللهِ كَيْمَا يُكْتَبُ أَثَرِي وَخَطَئِي وَرُجُوعِي إِلَى أَهْلِي وَإِقْبَالِي وَإِدْبَارِي فَقَالَ رَسُولُ اللهِ ﷺ أَنْطَاكَ اللهُ مَا احْتَسَبْتَ أَجْمَعَ
[Machine] On the authority of the Prophet, may the peace and blessings of Allah be upon him, he said: "Verily, those who have the greatest reward in prayer are those who walk furthest to it. And the one who waits for the prayer until they can pray it in congregation with the Imam, they have an even greater reward than those who pray it individually and then go to sleep." This hadith is narrated by Abu Usamah in Sahih.
عَنِ النَّبِيِّ صَلَّى اللهَ عَلَيْهِ وَسَلَّمَ قَالَ إِنَّ أَعْظَمَ النَّاسِ أَجْرًا فِي الصَّلَاةِ أَبْعَدُهُمْ إِلَيْهَا مَشْيًا وَالَّذِي يَنْتَظِرُ الصَّلَاةَ حَتَّى يُصَلِّيَهَا مَعَ الْإِمَامِ فِي جَمَاعَةٍ أَعْظَمُ أَجْرًا مِمَّنْ يُصَلِّيهَا ثُمَّ يَنَامُ أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ أَبِي أُسَامَةَ
[Machine] "The Messenger of Allah ﷺ said: Whoever performs Hajj from Mecca on foot and returns to Mecca, Allah will write for him seven hundred good deeds for every step. Each good deed is equal to the good deeds of the Haram. It was asked: What are the good deeds of the Haram? He said: Each good deed is equal to one hundred thousand good deeds. And it is narrated in the Book of Hajj the virtue of walking to the Kaaba."
رَسُولَ اللهِ ﷺ يَقُولُ مَنْ حَجَّ مِنْ مَكَّةَ مَاشِيًا حَتَّى يَرْجِعَ إِلَى مَكَّةَ كَتَبَ اللهُ لَهُ بِكُلِّ خُطْوَةٍ سَبْعَمِائَةِ حَسَنَةٍ كُلُّ حَسَنَةٍ مِثْلُ حَسَنَاتِ الْحَرَمِ قِيلَ وَمَا حَسَنَاتُ الْحَرَمِ؟ قَالَ بِكُلِّ حَسَنَةٍ مِائَةُ أَلْفِ حَسَنَةٍ وَرَوَيْنَا فِي كِتَابِ الْحَجِّ فَضْلَ الْمَشْيِ إِلَى بَيْتِ اللهِ الْحَرَامِ
[Machine] If a person vows to walk to the Kaaba, then this is a vow, so they should walk to the Kaaba. Ibn Wahb said, "Al-Layth said the same thing."
إِذَا نَذَرَ الْإِنْسَانُ عَلَى مَشْيٍ إِلَى الْكَعْبَةِ فَهَذَا نَذْرٌ فَلْيَمْشِ إِلَى الْكَعْبَةِ قَالَ ابْنُ وَهْبٍ قَالَ اللَّيْثُ مِثْلَهُ
64.7 [Machine] Riding for those who can't walk.
٦٤۔٧ بَابُ رُكُوبِ مَنْ لَمْ يَقْدِرْ عَلَى الْمَشْيِ
The Prophet ﷺ saw an old man walking, supported by his two sons, and asked about him. The people informed him that he had vowed to go on foot (to the Kaʿba). He said, "Allah is not in need of this old man's torturing himself," and ordered him to ride. (Using translation from Bukhārī 1865)
ﷺ مَا بَالُ هَذَا؟ قَالُوا نَذَرَ يَا رَسُولَ اللهِ أَنْ يَمْشِيَ قَالَ إِنَّ اللهَ ﷻ عَنْ تَعْذِيبِ هَذَا نَفْسَهُ لِغَنِيٌّ وَأَمَرَهُ أَنْ يَرْكَبَ فَرَكِبَ
[Machine] That the Prophet ﷺ saw a man being whipped between two men, so he said, "What is wrong with him?" They said, "He made a vow to walk to the Ka'bah." He said, "Surely Allah is rich and does not need to punish himself, so tell him to ride."
أَنَّ النَّبِيَّ ﷺ رَأَى رَجُلًا يُهَادَى بَيْنَ رَجُلَيْنِ فَقَالَ مَا لَهُ؟ فَقَالُوا نَذَرَ أَنْ يَمْشِيَ إِلَى الْبَيْتِ قَالَ فَإِنَّ اللهَ ﷻ غَنِيٌّ عَنْ تَعْذِيبِ هَذَا نَفْسَهُ فَمُرُوهُ فَلْيَرْكَبْ
Allah's Apostle ﷺ found an old man walking between his two sons supported by them, whereupon Allah's Apostle ﷺ said: What is the matter with him? He (the narrator) said: Messenger of Allah, they are his sons and there is upon him the (fulfilment) of the vow, whereupon Allah's Apostle ﷺ said: Ride, old man, for Allah is not in need of you and your vow. (Using translation from Muslim 1643a)
أَنَّ رَسُولَ اللهِ ﷺ أَدْرَكَ شَيْخًا يَمْشِي بَيْنَ ابْنَيْهِ يَتَوَكَّأُ عَلَيْهِمَا فَقَالَ النَّبِيُّ ﷺ مَا شَأْنُ هَذَا الشَّيْخِ؟ قَالَ ابْنَاهُ كَانَ عَلَيْهِ نَذْرٌ فَقَالَ النَّبِيُّ ﷺ ارْكَبْ أَيُّهَا الشَّيْخُ فَإِنَّ اللهَ ﷻ غَنِيٌّ عَنْكَ وَعَنْ نَذْرِكَ لَفْظُهُمَا سَوَاءٌ
64.8 [Machine] Walking within one's capacity, and riding in what one is unable to.
٦٤۔٨ بَابُ الْمَشْيِ فِيمَا قَدَرَ عَلَيْهِ , وَالرُّكُوبِ فِيمَا عَجَزَ عَنْهُ
[Machine] "That I should ask the Prophet ﷺ on her behalf, so I asked the Prophet ﷺ and he said, 'Let her walk and let her ride.' He ﷺ said, 'And Abu Al-Khair never leaves Uqbah.'"
أَنْ أَسْتَفْتِيَ لَهَا النَّبِيَّ ﷺ فَاسْتَفْتَيْتُ النَّبِيَّ ﷺ فَقَالَ لِتَمْشِ وَلِتَرْكَبْ قَالَ وَكَانَ أَبُو الْخَيْرِ لَا يُفَارِقُ عُقْبَةَ
[Machine] "That I ask the Messenger of Allah ﷺ for her permission, so I asked him and he said, 'You may go on foot or ride.'"
أَنْ أَسْتَفْتِيَ لَهَا رَسُولَ اللهِ ﷺ فَاسْتَفْتَيْتُهُ فَقَالَ تَمْشِي وَتَرْكَبُ
64.9 [Machine] Guidance on what to ride, and the discrepancies in narrations about it
٦٤۔٩ بَابُ الْهَدْيِ فِيمَا رَكِبَ , وَاخْتِلَافُ الرِّوَايَاتِ فِيهِ
The sister of Uqbah ibn Amir took a vow that she would perform hajj on foot, and she was unable to do so. The Prophet ﷺ said: Allah is not in need of the walking of your sister. She must ride and offer a sacrificial camel. (Using translation from Abū Dāʾūd 3303)
رَسُولُ اللهِ ﷺ إِنَّ اللهَ لَغَنِيٌّ عَنْ مَشْيِ أُخْتِكَ فَلْتَرْكَبْ وَلْتُهْدِ بَدَنَةً
قَتَادَةَ دُونَ ذِكْرِ الْهَدْيِ فِيهِ
[Machine] The Prophet ﷺ was informed that the sister of Ukba bin Amir had vowed to perform Hajj on foot. So he said to her, "Indeed, Allah is wealthy and does not need her vow. So, command her to ride instead." This is also narrated from Khalid al-Hazza' from Ikrimah without mentioning the mention of the sacrifice in it. And it was narrated by Ibn Abi 'Arooba from Qatadah and he sent it and did not mention the sacrifice in it.
النَّبِيَّ ﷺ بَلَغَهُ أَنَّ أُخْتَ عُقْبَةَ بْنِ عَامِرٍ نَذَرَتْ أَنْ تَحُجَّ مَاشِيَةً فَقَالَ لَهُ النَّبِيُّ ﷺ إِنَّ اللهَ لَغَنِيٌّ عَنْ نَذْرِهَا فَمُرْهَا فَلْتَرْكَبْ وَكَذَلِكَ رُوِيَ عَنْ خَالِدٍ الْحَذَّاءِ عَنْ عِكْرِمَةَ دُونَ ذِكْرِ الْهَدْيِ فِيهِ وَرَوَاهُ ابْنُ أَبِي عَرُوبَةَ عَنْ قَتَادَةَ فَأَرْسَلَهُ وَلَمْ يَذْكُرِ الْهَدْيَ فِيهِ
[Machine] To perform the pilgrimage on foot, Uqbah asked the Messenger of Allah ﷺ, who replied, "It is better for you to ride, for Allah the Almighty is not in need of the vow of your sister or the walk of your sister." Sa'id reported from Qatadah, who reported from 'Ikrimah that the sister of Uqbah, in the sense of Hisham, did not mention the offering. She said, "Tell your sister to ride." Abu Dawud said that Khalid narrated it from 'Ikrimah in the same sense, and it was also said that 'Ikrimah narrated it from 'Uqbah bin 'Amir without mentioning the offering in it.
أَنْ تَحُجَّ مَاشِيَةً فَسَأَلَ عُقْبَةُ رَسُولَ اللهِ ﷺ فَقَالَ مُرْهَا أَنْ تَرْكَبَ فَإِنَّ اللهَ تَعَالَى غَنِيٌّ عَنْ نَذْرِ أُخْتِكَ أَوْ مَشْيِ أُخْتِكَ شَكَّ سَعِيدٌ 20118 وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ مُحَمَّدُ بْنُ بَكْرٍ ثنا أَبُو دَاوُدَ ثنا ابْنُ الْمُثَنَّى ثنا ابْنُ أَبِي عَدِيٍّ عَنْ سَعِيدٍ عَنْ قَتَادَةَ عَنْ عِكْرِمَةَ أَنَّ أُخْتَ عُقْبَةَ بِمَعْنَى هِشَامٍ لَمْ يَذْكُرِ الْهَدْيَ وَقَالَ فِيهِ مُرْ أُخْتَكَ فَلْتَرْكَبْ قَالَ أَبُو دَاوُدَ وَرَوَاهُ خَالِدٌ عَنْ عِكْرِمَةَ بِمَعْنَاهُ وَقِيلَ عَنْ عِكْرِمَةَ عَنْ عُقْبَةَ بْنِ عَامِرٍ دُونَ ذِكْرِ الْهَدْيِ فِيهِ
[Machine] Verily, Allah does not intervene in your sister's walk to the house in any way.
إِنَّ اللهَ لَا يَصْنَعُ بِمَشْيِ أُخْتِكَ إِلَى الْبَيْتِ شَيْئًا
A man came to Prophet ﷺ and said: Messenger of Allah, my sister has taken a vow to perform hajj on foot. The Prophet ﷺ said: Allah gets no good from the affliction your sister imposed on herself, so let her perform hajj riding and make atonement for her oath. (Using translation from Abū Dāʾūd 3295)
جَاءَ رَجُلَ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنَّ أُخْتِي نَذَرَتْ أَنْ تَحُجَّ مَاشِيَةً فَقَالَ إِنَّ اللهَ لَا يَصْنَعُ بِشَقَاءِ أُخْتِكَ شَيْئًا لِتَحُجَّ رَاكِبَةً ثُمَّ تُكَفِّرَ يَمِينَهَا تَفَرَّدَ بِهِ شَرِيكٌ الْقَاضِي
[Machine] He said, "My sister has vowed to perform Hajj for the sake of Allah, riding a non-mating (unfertile) she-camel." He further said, "I mentioned this to the Messenger of Allah ﷺ and he said, 'Tell your sister to mate it, ride it, and observe (optional) fasting for three days.'"
قَالَ نَذَرَتْ أُخْتِي أَنْ تَحُجَّ لِلَّهِ مَاشِيَةً غَيْرَ مُخْتَمِرَةٍ قَالَ فَذَكَرْتُ ذَلِكَ لِرَسُولِ اللهِ ﷺ فَقَالَ مُرْ أُخْتَكَ فَلْتَخْتَمِرْ وَلِتَرْكَبْ وَلْتَصُمْ ثَلَاثَةَ أَيَّامٍ وَكَذَلِكَ
[Machine] While the Messenger of Allah ﷺ was traveling in a caravan in the middle of the night, he noticed a group of people whose camels had wandered away from them. A man came down and saw a naked woman whose hair was untied. He asked her, "What is the matter with you?" She replied, "I have made a vow to perform the pilgrimage to the Kaaba while naked with my hair untied. I hide during the day and travel on the road at night." The Prophet ﷺ was informed of this and he said, "Tell her to put on her clothes and leave a trail of blood." This narration has a weak chain of narration and another chain that is disconnected without mentioning the animal sacrifice.
بَيْنَا رَسُولُ اللهِ ﷺ يَسِيرُ فِي رَكْبٍ فِي جَوْفِ اللَّيْلِ إِذَ بَصُرَ بِخَيَالٍ قَدْ نَفَرَتْ مِنْهُ إِبِلُهُمْ فَأَنْزَلَ رَجُلًا فَنَظَرَ فَإِذَا هُوَ بِامْرَأَةٍ عُرْيَانَةٍ نَاقِضَةٍ شَعْرَهَا فَقَالَ مَا لَكِ؟ قَالَتْ إِنِّي نَذَرْتُ أَنْ أَحُجَّ الْبَيْتَ مَاشِيَةً عُرْيَانَةً نَاقِضَةً شَعْرِي فَأَنَا أَتَكَمَّنُ بِالنَّهَارِ وَأَتَنَكَّبُ الطَّرِيقَ بِاللَّيْلِ فَأَتَى النَّبِيَّ ﷺ فَأَخْبَرَهُ فَقَالَ ارْجِعْ إِلَيْهَا فَمُرْهَا فَلْتَلْبَسْ ثِيَابَهَا وَلْتُهْرِقْ دَمًا هَذَا إِسْنَادٌ ضَعِيفٌ وَرُوِيَ مِنْ وَجْهٍ آخَرَ مُنْقَطِعٍ دُونَ ذِكْرِ الْهَدْيِ فِيهِ
[Machine] The Prophet of Allah, ﷺ , once saw a woman with her hair uncovered and asked, "What is this?" They replied, "O Messenger of Allah, she made a vow to perform Hajj with her hair uncovered." The Messenger of Allah, ﷺ , commanded them to tell her to cover her head and ride on a camel.
أَنَّ رَسُولَ اللهِ صَلَّى اللهَ عَلَيْهِ وَسَلَّمَ حَانَتْ مِنْهُ نَظْرَةٌ فَإِذَا هُوَ بِامْرَأَةٍ نَاشِرَةٍ شَعْرَهَا فَقَالَ مَا هَذِهِ؟ قَالُوا يَا رَسُولَ اللهِ نَذَرَتْ أَنْ تَحُجَّ مَاشِيَةً نَاشِرَةً شَعْرَهَا فَقَالَ رَسُولُ اللهِ ﷺ مُرُوهَا فَلْتُغَطِّي رَأْسَهَا وَلْتَرْكَبْ
[Machine] The Messenger of Allah ﷺ rarely stood among us without urging us to give in charity and forbidding us from gambling. He said, "Among the acts of gambling is to target someone's nose with an arrow, and among the acts of gambling is to target someone's pilgrimage while on foot. So if any of you pledges to perform a pilgrimage on foot, then let him offer a sacrifice and let him ride." This was narrated by Muhammad bin Abdillah Al-Ansari from Salih. He said in the narration, "Then let him offer a sacrifice and let him ride. The year was 201." Abu Abdullah Al-Hafiz informed us that Abdullah bin Ishaq Al-Baghawi in Baghdad narrated to us, and Abu Qilabah Abdul Malik bin Muhammad narrated to him, and Muhammad bin Abdullah Al-Ansari narrated to him, and Salih bin Rustum mentioned it in its meaning. He said, "Then let him offer a sacrifice and let him ride. It is not valid to hear the Hadith from Imran bin Hussein, for in it there is sending. And Allah knows best." And it was narrated in it from Ali.
قَلَّمَا قَامَ فِينَا رَسُولُ اللهِ ﷺ إِلَّا حَثَّنَا فِيهِ عَلَى الصَّدَقَةِ وَنَهَانَا عَنِ الْمُثْلَةِ وَقَالَ إِنَّ مِنَ الْمُثْلَةِ أَنْ تَنْذِرَ أَنْ تَخْرِمَ أَنْفَهُ وَمِنَ الْمُثْلَةِ أَنْ تَنْذِرَ أَنْ تَحُجَّ مَاشِيًا فَإِذَا نَذَرَ أَحَدُكُمْ أَنْ يَحُجَّ مَاشِيًا فَلْيُهْدِ هَدْيًا وَلْيَرْكَبْ وَرَوَاهُ مُحَمَّدُ بْنُ عَبْدِ اللهِ الْأَنْصَارِيُّ عَنْ صَالِحٍ وَقَالَ فِي الْحَدِيثِ فَلْيُهْدِ بَدَنَةً وَلْيَرْكَبْ 20126 أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ عَبْدُ اللهِ بْنُ إِسْحَاقَ الْبَغَوِيُّ بِبَغْدَادَ أنبأ أَبُو قِلَابَةَ عَبْدُ الْمَلِكِ بْنُ مُحَمَّدٍ ثنا مُحَمَّدُ بْنُ عَبْدِ اللهِ الْأَنْصَارِيُّ ثنا صَالِحُ بْنُ رُسْتُمَ فَذَكَرَهُ بِمَعْنَاه وَقَالَ فَلْيُهْدِ بَدَنَةً وَلْيَرْكَبْ وَلَا يَصِحُّ سَمَاعُ الْحَسَنِ مِنْ عِمْرَانَ فَفِيهِ إِرْسَالٌ وَاللهُ أَعْلَمُ وَرُوِيَ فِيهِ عَنْ عَلِيٍّ ؓ
[Machine] Ali said about a man who swears to walk, "Let him walk, but if he becomes unable, he can ride and offer a camel as compensation."
عَنْ عَلِيٍّ ؓ فِي الرَّجُلِ يَحْلِفُ عَلَيْهِ الْمَشْيُ فَقَالَ يَمْشِي فَإِنْ عَجَزَ رَكِبَ وَأَهْدَى بَدَنَةً
64.10 [Machine] The one who commanded the repetition, walking what he rode, and riding what he walked, until he fulfills it as he vowed.
٦٤۔١٠ بَابُ مَنْ أَمَرَ فِيهِ بِالْإِعَادَةِ وَالْمَشْيِ فِيمَا رَكِبَ , وَالرُّكُوبِ فِيمَا مَشَى , حَتَّى يَأْتِيَ بِهِ كَمَا نَذَرَهُ
عَبَّاسٍ ؓ وَتَنْحَرُ بَدَنَةً
[Machine] If Abbas is on a camel, when he encounters a pedestrian, he should get down and walk, and when he encounters a rider, he should mount and ride, and he should slaughter a camel as a sacrifice.
عَبَّاسٍ ؓ إِذَا كَانَ عَامُ قَابِلٍ فَلْيَرْكَبْ مَا مَشِيَ وَيَمْشِي مَا رَكِبَ وَيَنْحَرْ بَدَنَةً
[Machine] Al-Abbas is the deaf. An-Nab'a informed Ash-Shafi'i who informed Malik from Yahya ibn Sa'id who said: I had a limp and it affected me. So I rode until I reached Makkah, where I asked 'Ata ibn Abi Rabah and others, and they told me to perform the 'Umrah while being guided. When I arrived in Madinah, I asked, and they commanded me to walk from where I was unable to, so I walked again. By the one whom Ash-Shafi'i authorized, may Allah have mercy on him, in his book "An-Nudhur", from the obligation of walking within one's ability and abstaining from it when unable, it is most resembling to the narrations of Abu Hurayrah, Anas ibn Malik, and Abu Al-Khair, narrated from 'Uqbah ibn 'Amir, from the Prophet ﷺ. And with Allah is the ability to succeed.
الْعَبَّاسِ هُوَ الْأَصَمُّ أنبأ الرَّبِيعُ أنبأ الشَّافِعِيُّ أنبأ مَالِكٌ عَنْ يَحْيَى بْنِ سَعِيدٍ أَنَّهُ قَالَ كَانَ عَلَيَّ مَشْيٌ فَأَصَابَتْنِي خَاصِرَةٌ فَرَكِبْتُ حَتَّى أَتَيْتُ مَكَّةَ فَسَأَلْتُ عَطَاءَ بْنَ أَبِي رَبَاحٍ وَغَيْرَهُ فَقَالُوا عَلَيْكَ هَدْيٌ فَلَمَّا قَدِمْتُ الْمَدِينَةَ سَأَلْتُ فَأَمَرُونِي أَنْ أَمْشِيَ مِنْ حَيْثُ عَجَزْتُ فَمَشَيْتُ مَرَّةً أُخْرَى وَالَّذِي أَجَازَهُ الشَّافِعِيُّ رَحِمَهُ اللهُ فِي كِتَابِ النُّذُورِ مِنْ وُجُوبِ الْمَشْيِ فِيمَا قَدَرَ عَلَيْهِ وَسُقُوطِهِ فِيمَا عَجَزَ عَنْهُ أَشْبَهُ الْأَقَاوِيلِ بِحَدِيثِ أَبِي هُرَيْرَةَ وَأَنَسِ بْنِ مَالِكٍ ؓ وَأَبِي الْخَيْرِ عَنْ عُقْبَةَ بْنِ عَامِرٍ ؓ عَنِ النَّبِيِّ ﷺ فَهُوَ أَوْلَى بِهِ وَبِاللهِ التَّوْفِيقُ
64.11 [Machine] Who said: "He should not leave from his designated place unless he intends a position until that has been reported, by Ata bin Abu Rabah"?
٦٤۔١١ بَابُ مَنْ قَالَ: يَمْشِي مِنْ مِيقَاتِهِ إِلَّا أَنْ يَكُونَ نَوَى مَكَانًا حَتَّى يَصْدُرَ رُوِيَ ذَلِكَ , عَنْ عَطَاءِ بْنِ أَبِي رَبَاحٍ
[Machine] Abu 'Amr, meaning Al-Awza'i, was asked about the one who is unable to walk to the House of Allah: from where should he start his journey? He said, "If he intends a specific location, then he should start from where he intends. And if he does not intend a specific location, then he should start from his current location." Ata' narrated this from Ibn Abbas.
أَبَا عَمْرٍو يَعْنِي الْأَوْزَاعِيَّ عَمَّنْ جَعَلَ عَلَيْهِ الْمَشْيَ إِلَى بَيْتِ اللهِ مِنْ أَيْنَ يَمْشِي؟ قَالَ إِنْ كَانَ نَوَى مَكَانًا فَمِنْ حَيْثُ نَوَى وَإِنْ لَمْ يَكُنْ نَوَى مَكَانًا فَمِنْ مِيقَاتِهِ وَأَخْبَرَنِيهِ عَطَاءٌ عَنِ ابْنِ عَبَّاسٍ ؓ بِذَلِكَ
64.12 [Machine] Who vowed to walk to the Mosque of the City or the Mosque of Jerusalem?
٦٤۔١٢ بَابُ مَنْ نَذَرَ الْمَشْيَ إِلَى مَسْجِدِ الْمَدِينَةِ أَوْ مَسْجِدِ بَيْتِ الْمَقْدِسِ
[Machine] The Prophet said: "Do not travel except to three mosques: the Masjid al-Haram (the Sacred Mosque), the mosque of the Messenger of Allah ﷺ , and the Al-Aqsa Mosque." Ibn al-Madeeni said, "Sufyan informed us about this narration with this wording, and the majority of its wording states: 'Do not travel except to three mosques'."
عَنِ النَّبِيِّ ﷺ قَالَ لَا تُشَدُّ الرِّحَالُ إِلَّا إِلَى ثَلَاثَةِ مَسَاجِدَ الْمَسْجِدِ الْحَرَامِ وَمَسْجِدِ رَسُولِ اللهِ ﷺ وَالْمَسْجِدِ الْأَقْصَى قَالَ ابْنُ الْمَدِينِيِّ هَكَذَا حَدَّثَنَا بِهِ سُفْيَانُ هَذِهِ الْمَرَّةَ عَلَى هَذَا اللَّفْظِ وَأَكْثَرُ لَفْظِهِ تُشَدُّ الرِّحَالُ إِلَى ثَلَاثَةِ مَسَاجِدَ
[Machine] Narrated by the Prophet ﷺ , he said: There are four things that amaze me and dazzle my mind: a woman should not travel for more than three days except with a Mahram (a close male relative); fasting on the day of Al-Fitr and the day of Al-Adha is prohibited; the prayer is not allowed after the Adhan of Fajr until the sun rises and after the Adhan of Asr until the sun sets; and the journey should not be undertaken except to three mosques: my mosque (in Medina), the Sacred Mosque (in Mecca), and the Farthest Mosque (in Jerusalem) or he said, the Masjid Al-Aqsa.
عَنِ النَّبِيِّ ﷺ قَالَ أَرْبَعٌ أَعْجَبَتْنِي وَأَيْنَقَتْنِي قَالَ لَا تُسَافِرُ الْمَرْأَةُ فَوْقَ ثَلَاثَةِ أَيَّامٍ إِلَّا مَعَ ذِي مَحْرَمٍ وَلَا صِيَامَ فِي يَوْمَيْنِ يَوْمِ الْفِطْرِ وَيَوْمِ الْأَضْحَى وَلَا صَلَاةَ يَعْنِي بَعْدَ صَلَاتَيْنِ بَعْدَ الصُّبْحِ حَتَّى تَطْلُعَ الشَّمْسُ وَبَعْدَ الْعَصْرِ حَتَّى تَغْرُبَ الشَّمْسُ وَلَا تُشَدُّ الرِّحَالُ إِلَّا إِلَى ثَلَاثَةِ مَسَاجِدَ مَسْجِدِي وَالْمَسْجِدِ الْحَرَامِ وَالْمَسْجِدِ الْأَقْصَى أَوْ قَالَ بَيْتِ الْمَقْدِسِ
64.13 [Machine] Whoever does not consider his vow obligatory, or establishes a place better than these three mosques, has achieved no less.
٦٤۔١٣ بَابُ مَنْ لَمْ يَرَ وُجُوبَهُ بِالنَّذْرِ , أَوْ أَقَامَ الْأَفْضَلَ مِنْ هَذِهِ الْمَسَاجِدِ الثَّلَاثَةِ مَقَامَ مَا هُوَ أَدْنَى مِنْهُ
[Machine] "O Messenger of Allah, indeed I made a vow during the time of conquest that if Allah grants you victory, then I will pray in Al-Masjid Al-Aqsa (the Noble Sanctuary). He (the Messenger of Allah) said: 'Pray here.' So he repeated it two or three times. The Messenger of Allah ﷺ then said: 'What is your matter then?' And this was narrated by Hammad bin Salamah from Habib Al-Muallim from Ataa.'"
يَا رَسُولَ اللهِ إِنِّي نَذَرْتُ زَمَنَ الْفَتْحِ إِنْ فَتْحَ اللهُ عَلَيْكَ أَنْ أُصَلِّيَ فِي بَيْتِ الْمَقْدِسِ فَقَالَ صَلِّ هَهُنَا فَأَعَادَهَا عَلَيْهِ مَرَّتَيْنِ أَوْ ثَلَاثًا فَقَالَ رَسُولُ اللهِ ﷺ فَشَأْنَكَ إِذًا وَرَوَاهُ حَمَّادُ بْنُ سَلَمَةَ عَنْ حَبِيبٍ الْمُعَلِّمِ عَنْ عَطَاءٍ
In case Allah cures me I will certainly go and observe prayer in Bait al-Maqdis. She recovered and so she made preparations to go out (to that place). She came to Maimuna. the wife of Allah's Apostle ﷺ. and after greeting her she informed her about it, whereupon she said: Stay here. and eat the provision (which you had made) and observe prayer In the mosque of the Messenger ﷺ. for I heard Messenger of Allah ﷺ say: Prayer In it is better than a thousand prayers observed in other mosques except the mosque of the Ka'ba. لَئِنْ شَفَانِي اللهُ لَأَخْرُجَنَّ فَلَأُصَلِّيَنَّ فِي بَيْتِ الْمَقْدِسِ فَبَرَأَتْ ثُمَّ تَجَهَّزَتْ تُرِيدُ الْخُرُوجَ فَجَاءَتْ مَيْمُونَةَ زَوْجَ النَّبِيِّ ﷺ تُسَلِّمُ عَلَيْهَا فَأَخْبَرَتْهَا ذَلِكَ فَقَالَتِ اجْلِسِي فَكُلِي مِمَّا صَنَعْتِ وَصَلِّي فِي مَسْجِدِ الرَّسُولِ ﷺ فَإِنِّي سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ صَلَاةٌ فِيهِ أَفْضَلُ مِنْ أَلْفِ صَلَاةٍ فِيمَا سِوَاهُ مِنَ الْمَسَاجِدِ إِلَّا مَسْجِدَ الْكَعْبَةِ
[Machine] He said that the Messenger of Allah ﷺ said: "A prayer in my mosque is better than a thousand prayers in any other mosque except for the Sacred Mosque."
أَنَّهُ قَالَ قَالَ رَسُولُ اللهِ ﷺ صَلَاةٌ فِي مَسْجِدِي هَذَا خَيْرٌ مِنْ أَلْفِ صَلَاةٍ فِيمَا سِوَاهُ إِلَّا الْمَسْجِدَ الْحَرَامَ
64.14 [Machine] Who vowed to sacrifice in Makkah?
٦٤۔١٤ بَابُ مَنْ نَذَرَ أَنْ يَنْحَرَ بِمَكَّةَ
[Machine] That the Messenger of Allah ﷺ said, "I have offered the sacrifice at this place and all of Mina is a place for sacrifice."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ نَحَرْتُ هَهُنَا وَمِنًى كُلُّهَا مَنْحَرٌ
64.15 [Machine] Who vowed to sacrifice without it in order to give charity
٦٤۔١٥ بَابُ مَنْ نَذَرَ أَنْ يَنْحَرَ بِغَيْرِهَا لِيَتَصَدَّقَ
[Machine] A man made a vow during the time of the Messenger of Allah ﷺ to slaughter a sheep in a place called Buwānah. The Messenger of Allah ﷺ asked, "Was there in it a statue of the idols of the pre-Islamic era that was worshipped?" They replied, "No." He then asked, "Was there in it a festival of their festivals?" They replied, "No." The Messenger of Allah ﷺ said, "Fulfill your vow, for there is no fulfilling of a vow in disobedience to Allah or in acquiring what the son of Adam does not possess." Abu Al-Husayn ibn Bishr narrated to us from Abu Al-Hasan Ali ibn Muhammad Al-Misri, who narrated to us from Malik ibn Yahya, who narrated to us from Yazid ibn Harun, who narrated to us from Abdullah ibn Yazid ibn Miqsam, who narrated to me from my aunt Sarah bint Miqsam, who narrated to me from Maymunah bint Kardam: She said, "I saw the Messenger of Allah ﷺ in Makkah while he was riding on a camel, and I was with my father. I mentioned the subject of my vow to him. My father said to him, 'I have made a vow to slaughter a certain number of sheep.' The Messenger of Allah ﷺ replied, 'I do not know except that it is fifty sheep on top of Buwānah.' The Messenger of Allah ﷺ then asked, 'Was there anything from these idols on it?' He replied, 'No.' The Messenger of Allah ﷺ then said, 'Fulfill what you have vowed to Allah.'" She said, "My father gathered the sheep and began to slaughter them, but one of them ran away. He sought it while saying, 'O Allah, fulfill my vow for me.' Then he got hold of it and slaughtered it."
نَذَرَ رَجُلٌ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ أَنْ يَنْحَرَ بِبُوَانَةَ فَقَالَ رَسُولُ اللهِ ﷺ هَلْ كَانَ فِيهَا وَثَنٌ مِنْ أَوْثَانِ الْجَاهِلِيَّةِ يُعْبَدُ؟ قَالُوا لَا قَالَ فَهَلْ كَانَ فِيهَا عِيدٌ مِنْ أَعْيَادِهِمْ؟ قَالُوا لَا فَقَالَ رَسُولُ اللهِ ﷺ أَوْفِ بِنَذْرِكَ فَإِنَّهُ لَا وَفَاءَ لِنَذْرٍ فِي مَعْصِيَةِ اللهِ وَلَا فِيمَا لَا يَمْلِكُ ابْنُ آدَمَ 20140 أَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ بِشْرَانَ بِبَغْدَادَ أنبأ أَبُو الْحَسَنِ عَلِيُّ بْنُ مُحَمَّدٍ الْمِصْرِيُّ ثنا مَالِكُ بْنُ يَحْيَى ثنا يَزِيدُ بْنُ هَارُونَ أنبأ عَبْدُ اللهِ بْنُ يَزِيدَ بْنِ مِقْسَمٍ وَهُوَ ابْنُ ضَبَّةَ حَدَّثَتْنِي عَمَّتِي سَارَةُ بِنْتُ مِقْسَمٍ عَنْ مَيْمُونَةَ بِنْتِ كَرْدَمٍ قَالَتْ رَأَيْتُ رَسُولَ اللهِ ﷺ بِمَكَّةَ وَهُوَ عَلَى نَاقَةٍ لَهُ وَأَنَا مَعَ أَبِي فَذَكَرَتِ الْحَدِيثَ قَالَتْ فَقَالَ لَهُ أَبِي فِي ذَلِكَ الْمَقَامِ إِنِّي نَذَرْتُ أَنْ أَذْبَحَ عِدَّةً مِنَ الْغَنَمِ قَالَ لَا أَعْلَمُ إِلَّا قَالَ خَمْسِينَ شَاةً عَلَى رَأْسِ بُوَانَةَ فَقَالَ رَسُولُ اللهِ ﷺ هَلْ عَلَيْهَا مِنْ هَذِهِ الْأَوْثَانِ شَيْءٌ؟ قَالَ لَا قَالَ فَأَوْفِ لِلَّهِ مَا نَذَرْتَ لَهُ قَالَتْ فَجَمَعَهَا أَبِي فَجَعَلَ يَذْبَحُهَا فَانْفَلَتَتْ مِنْهُ شَاةٌ فَطَلَبَهَا وَهُوَ يَقُولُ اللهُمَّ أَوْفِ عَنِّي نَذْرِي حَتَّى أَخَذَهَا فَذَبَحَهَا
[Machine] A man came to the Prophet ﷺ and said, "Indeed, I have made a vow to slaughter a camel in Buwana." The Prophet ﷺ said, "Is there anything in your heart from the period of ignorance?" He said, "No." The Prophet ﷺ said, "Then fulfill your vow."
أَتَى رَجُلٌ النَّبِيَّ ﷺ فَقَالَ إِنِّي نَذَرْتُ أَنْ أَذْبَحَ بِبُوَانَةَ فَقَالَ فِي قَلْبِكَ مِنَ الْجَاهِلِيَّةِ شَيْءٌ؟ قَالَ لَا قَالَ أَوْفِ بِنَذْرِكَ
