55. Prescribed Punishments (1/5)
٥٥۔ كِتَابُ الْحُدُودِ ص ١
[Machine] The Messenger of Allah ﷺ said, "When you see the adulterer, thief, and alcohol drinker, what do you say?" They said, "Allah and His Messenger know best." He said, "They are committing major sins, and there is punishment for them." This narration was mentioned only by Umar ibn Sa'id al-Dimashqi, who is considered untrustworthy in narrations. Rather, it is known from the narration of Nu'man ibn Murrah as mutawatir (reported by a large number of narrators) and mursal (where the chain of narrators does not reach the Prophet).
قَالَ رَسُولُ اللهِ ﷺ إِذَا رَأَيْتُمُ الزَّانِيَ وَالسَّارِقَ وَشَارِبَ الْخَمْرِ مَا تَقُولُونَ؟ قَالُوا اللهُ وَرَسُولُهُ أَعْلَمُ قَالَ هُنَّ فَوَاحِشُ وَفِيهِنَّ عُقُوبَةٌ وَذَكَرَ الْحَدِيثَ تَفَرَّدَ بِهِ عُمَرُ بْنُ سَعِيدٍ الدِّمَشْقِيُّ وَهُوَ مُنْكَرُ الْحَدِيثِ وَإِنَّمَا يُعْرَفُ مِنْ حَدِيثِ النُّعْمَانِ بْنِ مُرَّةَ مُرْسَلًا
[Machine] The Messenger of Allah ﷺ asked, "What do you say about drinkers, adulterers, and thieves?" This was before the penalties were revealed, so they said, "Allah and His Messenger know best." The Messenger of Allah ﷺ said, "These are major sins, and there are prescribed punishments for them. The worst theft is stealing one's own prayer." Ibn Bukayr said in his narration that they asked, "How can one steal their own prayer, O Messenger of Allah?" He replied, "By not completing its bowing or prostration." Ash-Shafi'i said a similar meaning is found in the Quran, where Allah says, "And those who commit unlawful sexual intercourse of your women - bring against them four witnesses from among you. And if they testify, confine the guilty women to houses until death takes them or Allah ordains for them another way. And the two who commit it among you - dishonor them both. But if they repent and correct themselves, leave them alone. Indeed, Allah is ever accepting of repentance and merciful." [Surah An-Nisa, 16]. Ash-Shafi'i said that this was the initial punishment for adultery in this world - imprisonment and harm. Then Allah abrogated imprisonment and harm in His book and said, "The [unmarried] woman or [unmarried] man found guilty of sexual intercourse - lash each one of them with a hundred lashes."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَا تَقُولُونَ فِي الشَّارِبِ وَالزَّانِي وَالسَّارِقِ؟ وَذَلِكَ قَبْلَ أَنْ تَنْزِلَ الْحُدُودُ فَقَالُوا اللهُ وَرَسُولُهُ أَعْلَمُ فَقَالَ رَسُولُ اللهِ ﷺ هُنَّ فَوَاحِشُ وَفِيهِنَّ عُقُوبَةٌ وَأَسْوَأُ السَّرِقَةِ الَّذِي يَسْرِقُ صَلَاتَهُ قَالَ ابْنُ بُكَيْرٍ فِي رِوَايَتِهِ قَالُوا وَكَيْفَ يَسْرِقُ صَلَاتَهُ يَا رَسُولَ اللهِ؟ فَقَالَ لَا يُتِمُّ رُكُوعَهَا وَلَا سُجُودَهَا قَالَ الشَّافِعِيُّ وَمَثَلُ مَعْنَى هَذَا فِي كِتَابِ اللهِ ﷻ قَالَ اللهُ ﷻ {وَاللَّاتِي يَأْتِينَ الْفَاحِشَةَ مِنْ نِسَائِكُمْ فَاسْتَشْهِدُوا عَلَيْهِنَّ أَرْبَعَةً مِنْكُمْ فَإِنْ شَهِدُوا فَأَمْسِكُوهُنَّ فِي الْبُيُوتِ حَتَّى يَتَوَفَّاهُنَّ الْمَوْتُ أَوْ يَجْعَلَ اللهُ لَهُنَّ سَبِيلًا وَاللَّذَانِ يَأْتِيَانِهَا مِنْكُمْ فَآذُوهُمَا فَإِنْ تَابَا وَأَصْلَحَا فَأَعْرِضُوا عَنْهُمَا إِنَّ اللهَ كَانَ تَوَّابًا رَحِيمًا} [النساء 16] قَالَ الشَّافِعِيُّ فَكَانَ هَذَا أَوَّلَ عُقُوبَةِ الزَّانِيَيْنِ فِي الدُّنْيَا الْحَبْسُ وَالْأَذَى ثُمَّ نَسَخَ اللهُ الْحَبْسَ وَالْأَذَى فِي كِتَابِهِ فَقَالَ {الزَّانِيَةُ وَالزَّانِي فَاجْلِدُوا كُلَّ وَاحِدٍ مِنْهُمَا مِائَةَ جَلْدَةٍ}
[Machine] "And those two who commit it (i.e. illegal sexual intercourse) among you, dishonor them both." [Al-Nisa' 16]. The verse was abrogated by the verse of flogging, so He said, "The [unmarried] woman or [unmarried] man found guilty of sexual intercourse - lash each one of them with a hundred lashes" (Al-Nur 2:3). And Abu 'Abdullah Al-Haafiz informed us that Ahmad ibn Kaamil Al-Qaadi informed us that Abu Ja'far Muhammad ibn Sa'd ibn Muhammad ibn Al-Hasan ibn 'Attiyah narrated to us that my father told me that my grandfather told me from Ibn 'Abbas with a similar statement.
{وَاللَّذَانِ يَأْتِيَانِهَا مِنْكُمْ فَآذُوهُمَا} [النساء 16] الْآيَةَ فَنَسَخَ ذَلِكَ بِآيَةِ الْجَلْدِ فَقَالَ {الزَّانِيَةُ وَالزَّانِي فَاجْلِدُوا كُلَّ وَاحِدٍ مِنْهُمَا مِائَةَ جَلْدَةٍ} 16904 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ أَحْمَدُ بْنُ كَامِلٍ الْقَاضِي أنبأ أَبُو جَعْفَرٍ مُحَمَّدُ بْنُ سَعْدِ بْنِ مُحَمَّدِ بْنِ الْحَسَنِ بْنِ عَطِيَّةَ ثنا أَبِي حَدَّثَنِي عَمِّي حَدَّثَنِي أَبِي عَنْ أَبِيهِ عَنِ ابْنِ عَبَّاسٍ بِمِثْلِهِ
[Machine] On the authority of Mujahid, in his saying, "And those among your women who commit illegal sexual intercourse" [Quran 4:15], it means (committing) adultery. And in his saying, "Then punish them both" [Quran 4:16], it means (punish them) with flogging. Then it was abrogated by the verse, "The fornicatress and the fornicator, flog each of them with a hundred stripes" [Quran 24:2]. And in His saying, "Or Allah may make for them a way out" [Quran 4:15], the meaning of "a way out" is the punishment.
عَنْ مُجَاهِدٍ فِي قَوْلِهِ {وَاللَّاتِي يَأْتِينَ الْفَاحِشَةَ مِنْ نِسَائِكُمْ} [النساء 15] يَعْنِي الزِّنَا وَفِي قَوْلِهِ {فَآذُوهُمَا} [النساء 16] يَعْنِي سَبًّا ثُمَّ نَسَخَهَا {الزَّانِيَةُ وَالزَّانِي فَاجْلِدُوا كُلَّ وَاحِدٍ مِنْهُمَا مِائَةَ جَلْدَةٍ} وَفِي قَوْلِهِ {أَوْ يَجْعَلَ اللهُ لَهُنَّ سَبِيلًا} [النساء 15] قَالَ السَّبِيلُ الْحَدُّ
[Machine] About Mujahid's saying, "And those of your women who commit illegal sexual intercourse..." [An-Nisa 15], he said that the punishment for adultery was that they be confined until four witnesses testified against them, "Until death takes them or Allah provides for them a way." [An-Nisa 15] The prescribed punishment is...
عَنْ مُجَاهِدٍ فِي قَوْلِهِ {وَاللَّاتِي يَأْتِينَ الْفَاحِشَةَ مِنْ نِسَائِكُمْ} [النساء 15] قَالَ الزِّنَا قَالَ كَانَ أَمَرَ أَنْ يُحْبَسْنَ يَعْنِي حَتَّى يَشْهَدَ عَلَيْهِنَّ أَرْبَعَةٌ {حَتَّى يَتَوَفَّاهُنَّ الْمَوْتُ أَوْ يَجْعَلَ اللهُ لَهُنَّ سَبِيلًا} [النساء 15] الْحُدُودُ
55.2 [Machine] What can be inferred from the fact that the punishment is flogging for fornicators and stoning for adulterers
٥٥۔٢ بَابُ مَا يُسْتَدَلُّ بِهِ عَلَى أَنَّ السَّبِيلَ هُوَ جَلْدُ الزَّانِيَيْنِ وَرَجْمُ الثَّيِّبِ
Take from me. Verily Allah has ordained a way for them (the women who commit fornication),: (When) a married man (commits adultery) with a married woman, and an unmarried male with an unmarried woman, then in case of married (persons) there is (a punishment) of one hundred lashes and then stoning (to death). And in case of unmarried persons, (the punishment) is one hundred lashes and exile for one year. (Using translation from Muslim 1690c)
أَنَّ رَسُولَ اللهِ ﷺ كَانَ إِذَا نَزَلَ عَلَيْهِ الْوَحْيُ كُرِبَ لِذَلِكَ وَتَرَبَّدَ لَهُ وَجْهُهُ فَأَنْزَلَ اللهُ عَلَيْهِ ذَاتَ يَوْمٍ فَلَقِيَ ذَلِكَ فَلَمَّا سُرِّيَ عَنْهُ قَالَ خُذُوا عَنِّي قَدْ جَعَلَ اللهُ لَهُنَّ سَبِيلًا الثَّيِّبُ بِالثَّيِّبِ وَالْبِكْرُ بِالْبِكْرِ الثَّيِّبُ جَلْدُ مِائَةٍ ثُمَّ رَجْمٌ بِالْحِجَارَةِ وَالْبِكْرُ جَلْدُ مِائَةٍ وَنَفْيُ سَنَةٍ
[Machine] About the verse {And those who commit unlawful sexual intercourse of your women - bring against them four witnesses from among you.} [An-Nisa 15] until His saying {Or would Allah make for them a way out.} [An-Nisa 15], Al-Hasan said: "The first limits for women were that they were confined to their houses until the verse in An-Nur was revealed: {The [unmarried] woman or [unmarried] man found guilty of sexual intercourse - lash each one of them with a hundred lashes.} 'Ubada bin As-Samit said: "We were with the Prophet ﷺ and he said: 'Take it, take it. Allah has made a way out for them. The virgin with the virgin is lashing of a hundred, exile for a year, and the non-virgin with the non-virgin is lashing of a hundred, and stoning with stones."
عَنِ الْحَسَنِ فِي هَذِهِ الْآيَةِ {وَاللَّاتِي يَأْتِينَ الْفَاحِشَةَ مِنْ نِسَائِكُمْ} [النساء 15] إِلَى قَوْلِهِ {أَوْ يَجْعَلَ اللهُ لَهُنَّ سَبِيلًا} [النساء 15] قَالَ كَانَ أَوَّلُ حُدُودِ النِّسَاءِ كُنَّ يُحْبَسْنَ فِي بُيُوتٍ لَهُنَّ حَتَّى نَزَلَتِ الْآيَةُ الَّتِي فِي النُّورِ {الزَّانِيَةُ وَالزَّانِي فَاجْلِدُوا كُلَّ وَاحِدٍ مِنْهُمَا مِائَةَ جَلْدَةٍ} قَالَ عُبَادَةُ بْنُ الصَّامِتِ كُنَّا عِنْدَ النَّبِيِّ ﷺ فَقَالَ خُذُوا خُذُوا قَدْ جَعَلَ اللهُ لَهُنَّ سَبِيلًا الْبِكْرُ بِالْبِكْرِ جَلْدُ مِائَةٍ وَنَفْيُ سَنَةٍ وَالثَّيِّبُ بِالثَّيِّبِ جَلْدُ مِائَةٍ وَالرَّجْمُ بِالْحِجَارَةِ
[Machine] Umar ibn Al-Khattab, while sitting on the pulpit of the Messenger of Allah ﷺ, said, "Indeed, Allah sent Muhammad ﷺ with the truth and revealed the Book to him. Among what Allah revealed upon him was the verse of stoning, which we recited, understood, and the Messenger of Allah ﷺ implemented it, and we implemented it after him. I fear that if time prolongs, some people may say, 'We do not find the punishment of stoning in the Book of Allah,' thus leading astray by neglecting a duty that Allah has revealed. Indeed, the punishment of stoning is an obligation upon anyone who commits adultery when married, whether male or female, when there is clear evidence, or through pregnancy or confession." Ibn Shihab said, "So we see chastity when a woman marries and then the punishment of stoning is imposed upon her if she commits adultery. He said, 'And if he commits adultery and has not touched his wife, he should not be stoned, but he is to be whipped a hundred times if he is free and to be exiled for a year."
عُمَرُ بْنُ الْخَطَّابِ ؓ وَهُوَ جَالِسٌ عَلَى مِنْبَرِ رَسُولِ اللهِ ﷺ إِنَّ اللهَ بَعَثَ مُحَمَّدًا ﷺ بِالْحَقِّ وَأَنْزَلَ عَلَيْهِ الْكِتَابَ فَكَانَ فِيمَا أَنْزَلَ اللهُ عَلَيْهِ آيَةُ الرَّجْمِ قَرَأْنَاهَا وَوَعَيْنَاهَا وَرَجَمَ رَسُولُ اللهِ ﷺ وَرَجَمْنَا بَعْدَهُ فَأَخْشَى إِنْ طَالَ بِالنَّاسِ زَمَانٌ أَنْ يَقُولَ قَائِلٌ مَا نَجِدُ الرَّجْمَ فِي كِتَابِ اللهِ فَيَضِلُّونَ بِتَرْكِ فَرِيضَةٍ أَنْزَلَهَا اللهُ وَإِنَّ الرَّجْمَ فِي كِتَابِ اللهِ حَقٌّ عَلَى كُلِّ مَنْ زَنَى إِذَا أُحْصِنَ مِنَ الرِّجَالِ أَوِ النِّسَاءِ إِذَا قَامَتِ الْبَيِّنَةُ أَوْ كَانَ الْحَبَلُ أَوِ الِاعْتِرَافُ قَالَ ابْنُ شِهَابٍ فَنَرَى الْإِحْصَانَ إِذَا تَزَوَّجَ الْمَرْأَةَ ثُمَّ مَسَّهَا عَلَيْهِ الرَّجْمُ إِنْ زَنَى قَالَ وَإِنْ زَنَى وَلَمْ يَمَسَّ امْرَأَتَهُ فَلَا يُرْجَمُ وَلَكِنْ يُجْلَدُ مِائَةً إِذَا كَانَ حُرًّا وَيُغَرَّبُ عَامًا
[Machine] That people continue for a long time until someone says, "We cannot find stoning in the book of Allah," and they went astray by neglecting a duty that Allah has revealed. Surely, stoning is a punishment if a man is married, and evidence is established, or if pregnancy or confession exists. We have read it from the Sheikh and the Sheikha when they committed adultery, so stone them firmly. The Messenger of Allah ﷺ stoned and we stoned after him.
أَنْ يَطُولَ بِالنَّاسِ زَمَانٌ حَتَّى يَقُولَ الْقَائِلُ مَا نَجِدُ الرَّجْمَ فِي كِتَابِ اللهِ ﷻ فَيَضِلُّوا بِتَرْكِ فَرِيضَةٍ أَنْزَلَهَا اللهُ ﷻ أَلَا وَإِنَّ الرَّجْمَ حَقٌّ إِذَا أُحْصِنَ الرَّجُلُ وَقَامَتِ الْبَيِّنَةُ أَوْ كَانَ الْحَمْلُ أَوِ الِاعْتِرَافُ فَقَدْ قَرَأْنَاهَا الشَّيْخُ وَالشَّيْخَةُ إِذَا زَنَيَا فَارْجُمُوهُمَا الْبَتَّةَ وَقَدْ رَجَمَ رَسُولُ اللهِ ﷺ وَرَجَمْنَا بَعْدَهُ
[Machine] Indeed, I have seen her and she is as beautiful as Surah Al-Baqarah. And surely, in her is the sheikh and the sheikha, if they commit adultery, then stone them immediately, as a punishment from Allah. And Allah is Mighty and Wise.
أَقَطُّ لَقَدْ رَأَيْتُهَا وَإِنَّهَا لَتَعْدِلُ سُورَةَ الْبَقَرَةِ وَإِنَّ فِيهَا الشَّيْخُ وَالشَّيْخَةُ إِذَا زَنَيَا فَارْجُمُوهُمَا الْبَتَّةَ نَكَالًا مِنَ اللهِ وَاللهُ عَزِيزٌ حَكِيمٌ
I heard the Messenger of Allah ﷺ say, "The ˹married˺ man and a woman, if they commit adultery, then absolutely stone them." (Using translation from Ḥākim 8072)
سَمِعْتُ النَّبِيَّ ﷺ يَقُولُ الشَّيْخُ وَالشَّيْخَةُ إِذَا زَنَيَا فَارْجُمُوهُمَا الْبَتَّةَ نَكَالًا مِنَ اللهِ وَرَسُولِهِ
[Machine] Zaid, we used to read that if the Sheikh and the Sheikha commit adultery, then stone them immediately. Marwan said, "Should we not mention it in the Quran?" He replied, "Don't you see the two young, unmarried individuals being stoned?" Marwan said, "And they mentioned that in front of Umar ibn Al-Khattab." Umar said, "I can cure you of that." We asked, "How?" He said, "I will go to the Prophet, ﷺ , and mention such and such, and when I mention stoning, I will say, 'O Messenger of Allah, write for me the verse of stoning.'" He said, "So I went to him and reminded him, and he mentioned the verse of stoning." He said, "And he said, 'O Messenger of Allah, write for me the verse of stoning.'" He said, "I cannot do that in this and the previous conditions. This indicates that the ruling of the verse of stoning is established, while its recitation has been abrogated. And this is something I do not know about a difference of opinion."
زَيْدٌ كُنَّا نَقْرَأُ الشَّيْخُ وَالشَّيْخَةُ إِذَا زَنَيَا فَارْجُمُوهُمَا الْبَتَّةَ قَالَ فَقَالَ مَرْوَانُ أَفَلَا نَجْعَلُهُ فِي الْمُصْحَفِ؟ قَالَ لَا أَلَا تَرَى الشَّابَّيْنِ الثَّيِّبَيْنِ يُرْجَمَانِ؟ قَالَ وَقَالَ ذَكَرُوا ذَلِكَ وَفِينَا عُمَرُ بْنُ الْخَطَّابِ ؓ قَالَ أَنَا أَشْفِيكُمْ مِنْ ذَاكَ قَالَ قُلْنَا كَيْفَ؟ قَالَ آتِي النَّبِيَّ ﷺ فَأَذْكُرُ كَذَا وَكَذَا فَإِذَا ذَكَرَ الرَّجْمَ أَقُولُ يَا رَسُولَ اللهِ أَكْتِبْنِي آيَةَ الرَّجْمِ قَالَ فَأتَيْتُهُ فَذَكَّرْتُهُ قَالَ فَذَكَرَ آيَةَ الرَّجْمِ قَالَ فَقَالَ يَا رَسُولَ اللهِ أَكْتِبْنِي آيَةَ الرَّجْمِ قَالَ لَا أَسْتَطِيعُ ذَاكَ فِي هَذَا وَمَا قَبْلَهُ دَلَالَةٌ عَلَى أَنَّ آيَةَ الرَّجْمِ حُكْمُهَا ثَابِتٌ وَتِلَاوَتُهَا مَنْسُوخَةٌ وَهَذَا مِمَّا لَا أَعْلَمُ فِيهِ خِلَافًا
[Machine] In his statement "{And those who commit immorality from your women}" [Surah An-Nisa 15], he said that when a woman committed adultery, she would be confined to the house until her death. And in his statement "{And the two who commit it [i.e., unlawful sexual intercourse] among you}" [Surah An-Nisa 16], he said that when a man committed adultery, he would be dishonored and struck with sandals. Then Allah revealed after this "{The [unmarried] woman or [unmarried] man found guilty of sexual intercourse – lash each one of them with a hundred lashes}" So if they were previously married, they would be stoned according to the Sunnah of the Messenger of Allah ﷺ. And this is their prescribed punishment set by Allah for them.
فِي قَوْلِهِ {وَاللَّاتِي يَأْتِينَ الْفَاحِشَةَ مِنْ نِسَائِكُمْ} [النساء 15] الْآيَةَ قَالَ كَانَتِ الْمَرْأَةُ إِذَا زَنَتْ حُبِسَتْ فِي الْبَيْتِ حَتَّى تَمُوتَ وَفِي قَوْلِهِ {وَاللَّذَانِ يَأْتِيَانِهَا مِنْكُمْ فَآذُوهُمَا} [النساء 16] قَالَ كَانَ الرَّجُلُ إِذَا زَنَى أُوذِيَ بِالتَّعْيِيرِ وَضَرْبِ النِّعَالِ فَأَنْزَلَ اللهُ ﷻ بَعْدَ هَذَا {الزَّانِيَةُ وَالزَّانِي فَاجْلِدُوا كُلَّ وَاحِدٍ مِنْهُمَا مِائَةَ جَلْدَةٍ} فَإِنْ كَانَا مُحْصِنَيْنِ رُجِمَا فِي سُنَّةِ رَسُولِ اللهِ ﷺ وَهَذَا سَبِيلُهُمَا الَّذِي جَعَلَ اللهُ لَهُمَا
55.3 [Machine] What can be deduced that the punishment of one hundred lashes is applicable to unmarried adulterers and is abrogated from married adulterers, and that stoning is applicable to married adulterers. Al-Shafi'i, may Allah have mercy on him, said: Because the saying of the Messenger of Allah, ﷺ , "Take from me, Allah has made a way for them" was the first thing revealed, and by it, hadd (punishment) and harm fornicators were abrogated. So when the Prophet, ﷺ , stoned Ma'iz and did not lash him, and he ordered Unays to go to the wife of another man, and if she confesses, to stone her, it indicates the abrogation of lashing for unmarried adulterers and the establishment of stoning for married adulterers.
٥٥۔٣ بَابُ مَا يُسْتَدَلُّ بِهِ عَلَى أَنَّ جَلْدَ الْمِائَةِ ثَابِتٌ عَلَى الْبِكْرَيْنِ الْحُرَّيْنِ وَمَنْسُوخٌ عَنِ الثَّيِّبَيْنِ، وَأَنَّ الرَّجْمَ ثَابِتٌ عَلَى الثَّيِّبَيْنِ الْحُرَّيْنِ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: لِأَنَّ قَوْلَ رَسُولِ اللهِ ﷺ: " خُذُوا عَنِّي قَدْ جَعَلَ اللهُ لَهُنَّ سَبِيلًا " أَوَّلُ مَا أُنْزِلَ فَنُسِخَ بِهِ الْحَبْسُ وَالْأَذَى عَنِ الزَّانِيَيْنِ، فَلَمَّا رَجَمَ النَّبِيُّ ﷺ مَاعِزًا وَلَمْ يَجْلِدْهُ، وَأَمَرَ أُنَيْسًا أَنْ يَغْدُوَ عَلَى امْرَأَةِ الْآخَرِ، فَإِنِ اعْتَرَفَتْ رَجَمَهَا، دَلَّ عَلَى نَسْخِ الْجَلْدِ عَنِ الزَّانِيَيْنِ الْحُرَّيْنِ الثَّيِّبَيْنِ، وَثَبَّتَ الرَّجْمُ عَلَيْهِمَا
[Machine] The Messenger of Allah ﷺ called for Ma'iz ibn Malik, a man who was rahter short, with strong muscles, and confessed to him about committing adultery. The Messenger turned away from him, but he came to him from another angle, and again the Messenger turned away from him. He said, "I don't know if it happened twice or thrice." Then, he ordered for him to be stoned. The Messenger ﷺ said, "Whenever we go out for battle, one of them will follow behind someone, his neck like that of a goat, and he would grant one of them permission to have intercourse. Indeed, Allah (SWT) would not allow me to spare anyone of them without making him an example for them or punishing him on their behalf." Saeed ibn Jubair mentioned this to me and said, "Reject it four times."
أَنَّ رَسُولَ اللهِ ﷺ أُتِيَ بِمَاعِزِ بْنِ مَالِكٍ رَجُلٍ أَشْعَرَ قَصِيرٍ ذِي عَضَلَاتٍ فَأَقَرَّ لَهُ بِالزِّنَا فَأَعْرَضَ عَنْهُ فَأَتَاهُ مِنْ وَجْهِهِ الْآخَرِ فَأَعْرَضَ عَنْهُ قَالَ لَا أَدْرِي مَرَّتَيْنِ أَوْ ثَلَاثًا فَأَمَرَ بِهِ فَرُجِمَ وَقَالَ كُلَّمَا نَفَرْنَا غَازِينَ خَلَفَ أَحَدُهُمْ يَنِبُّ نَبِيبَ التَّيْسِ يَمْنَحُ إِحْدَاهُنَّ الْكُثْبَةَ إِنَّ اللهَ ﷻ لَا يُمَكِّنُنِي مِنْ أَحَدٍ مِنْهُمْ إِلَّا جَعَلْتُهُ نَكَالًا عَنْهُنَّ أَوْ نَكَّلْتُهُ عَنْهُنَّ قَالَ فَذَكَرْتُهُ لِسَعِيدِ بْنِ جُبَيْرٍ فَقَالَ رَدَّهُ أَرْبَعَ مَرَّاتٍ
[Machine] The Prophet ﷺ stoned a she-goat and did not mention the hide.
أَنَّ النَّبِيَّ ﷺ رَجَمَ مَاعِزًا وَلَمْ يَذْكُرْ جَلْدًا
Two men brought a dispute before the Messenger of Allah ﷺ. One of them said: Pronounce judgement between us in accordance with Allah’s Book, Messenger of Allah! The other who had more understanding said: Yes, Messenger of Allah! Pronounce judgement between us in accordance with Allah’s Book, and allow me to speak. He (the Prophet) said: Speak, He then said: My son who was a hired servant with this(man) committed fornication with his wife, and when I was told that my son must be stoned to death, I ransomed him with a hundred sheep and a slave girl of mine; but when I asked the learned, they told me that my son should receive a hundred lashes and be banished for a year, and that stoning to death applied only to man’s wife. The apostle of Allah ﷺ replied: By him in whose hand my soul is, I shall certainly pronounce judgment between you in accordance with Allah’s Book. Your sheep and your slave girl must be returned to you, and your son shall receive a hundred lashes and be banished for a year. And he commanded Unias al-Aslami go to that man’s wife, and if she confessed, he should stone her to death. She confessed and he stoned her. (Using translation from Abū Dāʾūd 4445)
أَنَّ رَجُلَيْنِ اخْتَصَمَا إِلَى رَسُولِ اللهِ ﷺ فَقَالَ أَحَدُهُمَا يَا رَسُولَ اللهِ اقْضِ بَيْنَنَا بِكِتَابِ اللهِ وَقَالَ الْآخَرُ وَكَانَ أَفْقَهَهُمَا أَجَلْ يَا رَسُولَ اللهِ اقْضِ بَيْنَنَا بِكِتَابِ اللهِ وَأْذَنْ لِي فِي أَنْ أَتَكَلَّمَ قَالَ تَكَلَّمْ قَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا فَزَنَى بِامْرَأَتِهِ فَأَخْبَرُونِي أَنَّ عَلَى ابْنِي الرَّجْمَ فَافْتَدَيْتُ مِنْهُ بِمِائَةِ شَاةٍ وَجَارِيَةٍ لِي ثُمَّ إِنِّي سَأَلْتُ أَهْلَ الْعِلْمِ فأَخْبَرُونِي أَنَّ عَلَى ابْنِي جَلْدَ مِائَةٍ وَتَغْرِيبَ عَامٍ إِنَّمَا الرَّجْمُ عَلَى امْرَأَتِهِ فَقَالَ رَسُولُ اللهِ ﷺ أَمَا وَالَّذِي نَفْسِي بِيَدِهِ لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللهِ أَمَّا غَنَمُكَ وَجَارِيَتُكَ فَرَدٌّ إِلَيْكَ وَجَلَدَ ابْنَهُ مِائَةً وَغَرَّبَهُ عَامًا وَأَمَرَ أُنَيْسًا الْأَسْلَمِيَّ أَنْ يَأْتِيَ امْرَأَةَ الْآخَرِ فَإِنِ اعْتَرَفَتْ رَجَمَهَا فَاعْتَرَفَتْ فَرَجَمَهَا لَفْظُ حَدِيثِ الْقَعْنَبِيِّ وَزَادَ فِي حَدِيثِهِ وَالْعَسِيفُ الْأَجِيرُ 16918 وَأَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ الْفَضْلِ الْقَطَّانُ أنبأ عَبْدُ اللهِ بْنُ جَعْفَرٍ ثنا يَعْقُوبُ بْنُ سُفْيَانَ ثنا ابْنُ قَعْنَبٍ وَابْنُ بُكَيْرٍ عَنْ مَالِكٍ فَذَكَرَهُ بِإِسْنَادِهِ نَحْوَهُ قَالَ وَالْعَسِيفُ الْأَجِيرُ
[Machine] He said, "I heard Umar ibn Al-Khattab say: Stoning (to death) is a punishment prescribed in the book of Allah for those who commit adultery, when they are married and when proof is established against them, whether it be through witness testimony, pregnancy, or confession."
أَنَّهُ قَالَ سَمِعْتُ عُمَرَ بْنَ الْخَطَّابِ ؓ يَقُولُ الرَّجْمُ فِي كِتَابِ اللهِ ﷻ حَقٌّ عَلَى مَنْ زَنَى إِذَا أُحْصِنَ مِنَ الرِّجَالِ وَالنِّسَاءِ إِذَا قَامَتْ عَلَيْهِ الْبَيِّنَةُ أَوْ كَانَ الْحَبَلُ أَوِ الِاعْتِرَافُ
[Machine] "That a person say, 'We do not find two limits in the Book of Allah, so the Messenger of Allah ﷺ has stoned and we have stoned. By the One in whose hand is my soul, if people were not to say that Umar has added to the Book of Allah in the case of the Sheikh and Sheikha when they committed adultery, I would have written it.' Shaykh and Sheikha mean an older man and an older woman from the men and women."
أَنْ يَقُولَ قَائِلٌ لَا نَجِدُ حَدَّيْنِ فِي كِتَابِ اللهِ ﷻ فَقَدْ رَجَمَ رَسُولُ اللهِ ﷺ وَرَجَمْنَا فَوَالَّذِي نَفْسِي بِيَدِهِ لَوْلَا أَنْ يَقُولَ النَّاسُ زَادَ عُمَرُ فِي كِتَابِ اللهِ لَكَتَبْتُهَا الشَّيْخُ وَالشَّيْخَةُ إِذَا زَنَيَا فَارْجُمُوهُمَا الْبَتَّةَ فَإِنَّا قَدْ قَرَأْنَاهَا 16921 وَأَخْبَرَنَا أَبُو أَحْمَدَ الْمِهْرَجَانِيُّ أنبأ أَبُو بَكْرِ بْنُ جَعْفَرٍ الْمُزَكِّي ثنا مُحَمَّدُ بْنُ إِبْرَاهِيمَ ثنا ابْنُ بُكَيْرٍ ثنا مَالِكٌ فَذَكَرَهُ بِنَحْوِهِ زَادَ قَالَ مَالِكٌ يُرِيدُ عُمَرُ بْنُ الْخَطَّابِ بِالشَّيْخِ وَالشَّيْخَةِ الثَّيِّبَ مِنَ الرِّجَالِ وَالثَّيِّبَةَ مِنَ النِّسَاءِ
[Machine] Umar said, "The Messenger of Allah ﷺ stoned, Abu Bakr stoned, and I stoned. But I do not want to increase anything in the Book of Allah. If it were not for the fact that I fear that people will come and not find it, so they will not believe it."
قَالَ عُمَرُ ؓ رَجَمَ رَسُولُ اللهِ ﷺ وَرَجَمَ أَبُو بَكْرٍ وَرَجَمْتُ وَلَوْلَا أَنِّي أَكْرَهُ أَنْ أَزِيدَ فِي كِتَابِ اللهِ لَكَتَبْتُهُ فِي الْمُصْحَفِ فَإِنِّي أَخَافُ أَنْ يَأْتِيَ أَقْوَامٌ فَلَا يَجِدُونَهُ فَلَا يُؤْمِنُونَ بِهِ
55.4 [Machine] What can be inferred about the conditions of chastity from it?
٥٥۔٤ بَابُ مَا يُسْتَدَلُّ بِهِ عَلَى شَرَائِطِ الْإِحْصَانِ
[Machine] The Messenger of Allah ﷺ said: "The blood of a Muslim who bears witness that there is no god but Allah and that I am the Messenger of Allah shall not be permissible except in one of three cases: a married adulterer, a life for a life, and one who abandons his religion and separates from the community - and in another narration, the blood of a man is mentioned."
قَالَ رَسُولُ اللهِ ﷺ لَا يَحِلُّ دَمُ امْرِئٍ مُسْلِمٍ يَشْهَدُ أَنْ لَا إِلَهَ إِلَّا اللهُ وَأَنِّي رَسُولُ اللهِ إِلَّا بِإِحْدَى ثَلَاثٍ الثَّيِّبُ الزَّانِي وَالنَّفْسُ بِالنَّفْسِ وَالتَّارِكُ لِدِينِهِ الْمُفَارِقُ لِلْجَمَاعَةِ وَفِي رِوَايَةِ يَعْلَى دَمُ رَجُلٍ
[Machine] Abu Huraira and Zaid ibn Khalid narrated that a man from the Bedouins came to the Messenger of Allah ﷺ and said, "O Messenger of Allah, I swear by Allah, except if Allah decides otherwise, then I will definitely be judged according to the Book of Allah." Another man, who was more knowledgeable than him, said, "Yes, judge between us according to the Book of Allah and give me permission." The Messenger of Allah ﷺ said, "Say what you have to say." He said, "My son was a shepherd and he committed adultery with his wife. I was informed that stoning was required for my son, so I ransomed him with one hundred sheep and a slave-girl. I asked the people of knowledge and they informed me that my son should be lashed one hundred times and exiled for one year, and that his wife should be stoned." The Messenger of Allah ﷺ said, "By the One in Whose Hand is my soul, I will judge between you according to the Book of Allah. The slave-girl and the sheep shall be returned to you, and your son shall be lashed one hundred times and exiled for one year. Go, O Unais, and deal with the matter of this woman, and if she confesses, then stone her." So, the next day she confessed and the Messenger of Allah ﷺ ordered that she be stoned.
عَنْ أَبِي هُرَيْرَةَ وَزَيْدِ بْنِ خَالِدٍ أَنَّهُمَا قَالَا إِنَّ رَجُلًا مِنَ الْأَعْرَابِ أَتَى رَسُولَ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ أَنْشُدُكَ اللهَ إِلَّا قَضَيْتَ فِيَّ بكِتَابِ اللهِ فَقَالَ الْآخَرُ وَهُوَ أَفْقَهُ مِنْهُ نَعَمْ فَاقْضِ بَيْنَنَا بِكِتَابِ اللهِ وَأْذَنْ لِي فَقَالَ رَسُولُ اللهِ ﷺ قُلْ قَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا فَزَنَى بِامْرَأَتِهِ وَإِنِّي أُخْبِرْتُ أَنَّ عَلَى ابْنِي الرَّجْمَ فَافْتَدَيْتُ مِنْهُ بِمِائَةِ شَاةٍ وَوَلِيدَةٍ وَسَأَلْتُ أَهْلَ الْعِلْمِ فَأَخْبَرُونِي أَنَّ عَلَى ابْنِي جَلْدَ مِائَةٍ وَتَغْرِيبَ عَامٍ وَأَنَّ عَلَى امْرَأَتِهِ الرَّجْمَ فَقَالَ رَسُولُ اللهِ ﷺ وَالَّذِي نَفْسِي بِيَدِهِ لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللهِ الْوَلِيدَةُ وَالْغَنَمُ رَدٌّ عَلَيْكَ وَعَلَى ابْنِكَ جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ اغْدُ يَا أُنَيْسُ عَلَى امْرَأَةِ هَذَا فَإِنِ اعْتَرَفَتْ فَارْجُمْهَا قَالَ فَغَدَا عَلَيْهَا فَاعْتَرَفَتْ فَأَمَرَ بِهَا رَسُولُ اللهِ ﷺ فَرُجِمَتْ
[Machine] He said, "A man from the Muslims came to the Messenger of Allah ﷺ while he was in the mosque and called out to him, saying, 'O Messenger of Allah, I have committed adultery.' So, the Messenger turned away from him, moving his face to the other side. The man repeated his statement four times, but each time the Messenger turned away from him until he testified against himself four times. Then, the Messenger of Allah ﷺ called him and asked, 'Are you insane?' The man replied, 'No.' The Messenger asked, 'Have you been married?' The man answered, 'Yes.' The Messenger of Allah ﷺ then ordered him to be stoned. Ibn Shihab narrated, 'Jabir ibn Abdullah said to me, 'I was among those who stoned him in the mosque. After being hit by stones, he tried to escape, but we caught up with him in the Harra (a place), and stoned him again.''"
أَنَّهُ قَالَ أَتَى رَجُلٌ مِنَ الْمُسْلِمِينَ رَسُولَ اللهِ ﷺ وَهُوَ فِي الْمَسْجِدِ فَنَادَاهُ فَقَالَ يَا رَسُولَ اللهِ إِنِّي زَنَيْتُ فَأَعْرَضَ عَنْهُ فَتَنَحَّى لِقَاءَ وَجْهِهِ فَقَالَ يَا رَسُولَ اللهِ إِنِّي زَنَيْتُ فَأَعْرَضَ عَنْهُ حَتَّى ثَنَّى ذَلِكَ أَرْبَعَ مَرَّاتٍ فَلَمَّا شَهِدَ عَلَى نَفْسِهِ أَرْبَعَ شَهَادَاتٍ دَعَاهُ رَسُولُ اللهِ ﷺ فَقَالَ أَبِكَ جُنُونٌ؟ فَقَالَ لَا فَقَالَ هَلْ أَحْصَنْتَ؟ قَالَ نَعَمْ قَالَ رَسُولُ اللهِ ﷺ اذْهَبُوا بِهِ فَارْجُمُوهُ قَالَ ابْنُ شِهَابٍ وَأَخْبَرَنِي مَنْ سَمِعَ جَابِرَ بْنَ عَبْدِ اللهِ يَقُولُ كُنْتُ فِيمَنْ رَجَمَهُ فَرَجَمْنَاهُ بِالْمُصَلَّى فَلَمَّا أَذْلَقَتْهُ الْحِجَارَةُ هَرَبَ فَأَدْرَكْنَاهُ فِي الْحَرَّةِ فَرَجَمْنَاهُ 16927 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أَخْبَرَنِي بِشْرُ بْنُ أَحْمَدَ بْنِ مُحَمَّدٍ ثنا دَاوُدُ بْنُ الْحُسَيْنِ بْنِ عَقِيلٍ ثنا عَبْدُ الْمَلِكِ بْنُ شُعَيْبِ بْنِ اللَّيْثِ حَدَّثَنِي أَبِي عَنْ جَدِّي قَالَ حَدَّثَنِي عَقِيلٌ فَذَكَرَ الْحَدِيثَ بِمِثْلِهِ
Messenger of Allah, purify me, whereupon he said: Woe be upon you, go back, ask forgiveness of Allah and turn to Him in repentance. He (the narrator) said that he went back not far, then came and said: Messenger of Allah, purify me. whereupon Messenger of Allah ﷺ said: Woe be upon you, go back and ask forgiveness of Allah and turn to Him in repentance. He (the narrator) said that he went back not far, when he came and said: Messenger of Allah, purify me. Allah's Apostle ﷺ said as he had said before. When it was the fourth time, Messenger of Allah (may, peace be upon him) said: From what am I to purify you? He said: From adultery, Messenger of Allah ﷺ asked if he had been mad. He was informed that he was not mad. He said: Has he drunk wine? A person stood up and smelt his breath but noticed no smell of wine. Thereupon Messenger of Allah ﷺ said: Have you committed adultery? He said: Yes. He made pronouncement about him and he was stoned to death. The people had been (divided) into two groups about him (Ma'iz). One of them said: He has been undone for his sins had encompassed him, whereas another said: There is no repentance more excellent than the repentance of Ma'iz, for he came to Allah's Apostle ﷺ and placing his hand in his (in the Holy Prophet's) hand said: Kill me with stones. (This controversy about Ma'iz) remained for two or three days. Then came Messenger of Allah ﷺ to them (his Companions) as they were sitting. He greeted them with salutation and then sat down and said: Ask forgiveness for Ma'iz b. Malik. They said: May Allah forgive Ma'iz b. Malik. Thereupon Messenger of Allah ﷺ said: He (Ma'iz) has made such a repentance that if that were to be divided among a people, it would have been enough for all of them. He (the narrator) said: Then a woman of Ghamid, a branch of Azd, came to him and said: Messenger of of Allah, purify me, whereupon he said: Woe be upon you; go back and beg forgiveness from Allah and turn to Him in repentance. She said: I find that you intend to send me back as you sent back Ma'iz. b. Malik. He (the Holy, Prophet) said: What has happened to you? She said that she had become pregnant as a result of fornication. He (the Holy Prophet) said: Is it you (who has done that)? She said: Yes. He (the Holy Prophet) said to her: (You will not be punished) until you deliver what is there in your womb. One of the Ansar became responsible for her until she was delivered (of the child). He (that Ansari) came to Allah's Apostle ﷺ and said the woman of Ghamid has given birth to a child. He (the Holy Prophet) said: In that case we shall not stone her and so leave her infant with none to suckle him. One of the Ansar got up and said: Allah's Apostle, let the responsibility of his suckling be upon me. She was then stoned to death. (Using translation from Muslim 1695a)
جَاءَ مَاعِزُ بْنُ مَالِكٍ إِلَى النَّبِيِّ ﷺ وَقَالَ يَا رَسُولَ اللهِ طَهِّرْنِي فَقَالَ وَيْحَكَ ارْجِعْ فَاسْتَغْفِرِ اللهَ وَتُبْ إِلَيْهِ قَالَ فَرَجَعَ غَيْرَ بَعِيدٍ ثُمَّ جَاءَ فَقَالَ يَا رَسُولَ اللهِ طَهِّرْنِي فَقَالَ النَّبِيُّ ﷺ وَيْحَكَ ارْجِعْ فَاسْتَغْفِرِ اللهَ وَتُبْ إِلَيْهِ قَالَ فَرَجَعَ غَيْرَ بَعِيدٍ ثُمَّ جَاءَ فَقَالَ يَا رَسُولَ اللهِ طَهِّرْنِي فَقَالَ النَّبِيُّ ﷺ مِثْلَ ذَلِكَ حَتَّى إِذَا كَانَتِ الرَّابِعَةُ قَالَ لَهُ النَّبِيُّ ﷺ مِمَّ أُطَهِّرُكَ؟ فَقَالَ مِنَ الزِّنَا فَسَأَلَ النَّبِيُّ ﷺ أَبِهِ جُنُونٌ؟ فَأُخْبِرَ أَنَّهُ لَيْسَ بِمَجْنُونٍ فَقَالَ أَشَرِبَ خَمْرًا؟ فَقَامَ رَجُلٌ فَاسْتَنْكَهَهُ فَلَمْ يَجِدْ مِنْهُ رِيحَ خَمْرٍ فَقَالَ النَّبِيُّ ﷺ أَثَيِّبٌ أَنْتَ؟ قَالَ نَعَمْ فَأَمَرَ بِهِ فَرُجِمَ فَكَانَ النَّاسُ فِيهِ فَرِيقَيْنِ تَقُولُ فِرْقَةٌ لَقَدْ هَلَكَ مَاعِزٌ عَلَى أَسْوَأِ عَمَلِهِ لَقَدْ أَحَاطَتْ بِهِ خَطِيئَتُهُ وَقَائِلٌ يَقُولُ أَتَوْبَةٌ أَفْضَلُ مِنْ تَوْبَةِ مَاعِزٍ أَنْ جَاءَ إِلَى رَسُولِ اللهِ ﷺ فَوَضَعَ يَدَهُ فِي يَدِهِ فَقَالَ اقْتُلْنِي بِالْحِجَارَةِ قَالَ فَلَبِثُوا بِذَلِكَ يَوْمَيْنِ أَوْ ثَلَاثَةً ثُمَّ جَاءَ النَّبِيُّ ﷺ وَهُمْ جُلُوسٌ فَسَلَّمَ ثُمَّ قَالَ اسْتَغْفِرُوا لِمَاعِزِ بْنِ مَالِكٍ قَالَ فَقَالُوا يَغْفِرُ اللهُ لِمَاعِزِ بْنِ مَالِكٍ؟ قَالَ فَقَالَ النَّبِيُّ ﷺ لَقَدْ تَابَ تَوْبَةً لَوْ قُسِمَتْ بَيْنَ أُمَّةٍ لَوَسِعَتْهَا قَالَ ثُمَّ جَاءَتْهُ امْرَأَةٌ مِنْ غَامِدٍ مِنَ الْأَزْدِ قَالَتْ يَا رَسُولَ اللهِ طَهِّرْنِي قَالَ وَيْحَكِ ارْجِعِي فَاسْتَغْفِرِي اللهَ وَتُوبِي إِلَيْهِ قَالَتْ لَعَلَّكَ تُرِيدُ أَنْ تَرْدُدَنِي كَمَا رَدَدْتَ مَاعِزَ بْنَ مَالِكٍ؟ قَالَ وَمَا ذَاكَ؟ قَالَتْ إِنَّهَا حُبْلَى مِنَ الزِّنَا فَقَالَ أَثَيِّبٌ أَنْتِ؟ قَالَتْ نَعَمْ قَالَ إِذًا لَا نَرْجُمُكِ حَتَّى تَضَعِي مَا فِي بَطْنِكِ قَالَ فَكَفَلَهَا رَجُلٌ مِنَ الْأَنْصَارِ حَتَّى وَضَعَتْ فَأَتَى النَّبِيَّ ﷺ فَقَالَ قَدْ وَضَعَتِ الْغَامِدِيَّةُ فَقَالَ إِذًا لَا نَرْجُمُهَا وَنَدَعُ وَلَدَهَا صَغِيرًا لَيْسَ لَهُ مَنْ يُرْضِعُهُ فَقَامَ رَجُلٌ مِنَ الْأَنْصَارِ فَقَالَ إِلِيَّ رَضَاعُهُ يَا نَبِيَّ اللهِ فَرَجَمَهَا
some jews came to the Messenger of Allah ﷺ and mentioned to him that a man and a women of their number had committed fornication. The Messenger of Allah ﷺ asked them: What do you find in the Torah about stoning? They replied: We disgrace them and they should be flogged. ‘Abd Allah b. Salam said: You lie; it contains (instruction for) stoning. So they brought the Torah and spread it out, and one of them put his hand over the verse of stoning and read what preceded it and what followed it. ‘Abd Allah b. Salam said to him: Lift your hand. When he did so, the verse of stoning was seen to be in it. They then said: He has spoken the truth, Muhammad, the verse of stoning is in it. The Messenger of Allah ﷺ then gave command regarding them, and they were stoned to death. ‘Abd Allah b. ‘Umar said: I saw the man leaning on the woman protecting her from the stones. أَنَّهُ قَالَ إِنَّ الْيَهُودَ جَاءُوا إِلَى النَّبِيِّ ﷺ فَذَكَرُوا لَهُ أَنَّ رَجُلًا مِنْهُمْ وَامْرَأَةً زَنَيَا فَقَالَ لَهُمْ رَسُولُ اللهِ ﷺ مَا تَجِدُونَ فِي التَّوْرَاةِ مِنْ شَأْنِ الزِّنَا؟ قَالُوا نَفْضَحُهُمْ وَيُجْلَدُونَ قَالَ عَبْدُ اللهِ بْنُ سَلَامٍ كَذَبْتُمْ إِنَّ فِيهَا الرَّجْمَ فَأَتَوْا بِالتَّوْرَاةِ فَنَشَرُوهَا فَجَعَلَ أَحَدُهُمْ يَدَهُ عَلَى آيَةِ الرَّجْمِ وَجَعَلَ يَقْرَأُ مَا قَبْلَهَا وَمَا بَعْدَهَا فَقَالَ لَهُ عَبْدُ اللهِ بْنُ سَلَامٍ ارْفَعْ يَدَكَ فَرَفَعَهَا فَإِذَا فِيهَا آيَةُ الرَّجْمِ فَقَالُوا صَدَقَ يَا مُحَمَّدُ فِيهَا آيَةُ الرَّجْمِ فَأَمَرَ بِهِمَا رَسُولُ اللهِ ﷺ فَرُجِمَا قَالَ عَبْدُ اللهِ فَرَأَيْتُ الرَّجُلَ يَحْنِي عَلَى الْمَرْأَةِ يَقِيهَا الْحِجَارَةَ
[Machine] They passed by the Messenger of Allah, ﷺ , a Jew who had been whipped and his face was swollen. The Jews asked him, "Who is your most knowledgeable person?" They said, "Fulān." He sent for him and he came. He asked him, "What do you find to be the punishment for adultery in your book?" They said, "We find stoning, but adultery has spread among our nobles. So, when a noble commits adultery he is not stoned, but when a commoner commits adultery, he is stoned. As a result, we have agreed upon flogging and public shaming (for punishment)." The Prophet, ﷺ , ordered that he be stoned. Then he said, "O Allah, I bear witness that I am the first to revive a sunnah that they have let die."
مَرُّوا عَلَى رَسُولِ اللهِ ﷺ بِيَهُودِيٍّ قَدْ جُلِدَ وَحُمِمَ وَجْهُهُ فَسَأَلَ الْيَهُودَ مَنْ عَالِمُكُمْ؟ فَقَالُوا فُلَانٌ فَأَرْسَلَ إِلَيْهِ فَجَاءَ فَقَالَ مَا تَجِدُونَ حَدَّ الزِّنَا فِي كِتَابِكُمْ؟ فَقَالُوا نَجِدُهُ الرَّجْمَ وَلَكِنْ فَشَا الزِّنَا فِي أَشْرَافِنَا فَكَانَ الشَّرِيفُ إِذَا زَنَى لَمْ يُرْجَمْ وَإِذَا زَنَى السَّفِيهُ رُجِمَ فَاصْطَلَحْنَا عَلَى الْجَلْدِ وَالتَّحْمِيمِ فَأَمَرَ النَّبِيُّ ﷺ بِهِ فَرُجِمَ ثُمَّ قَالَ اللهُمَّ إِنِّي أُشْهِدُكَ أَنِّي أَوَّلُ مَنْ أَحْيَا سُنَّةً أَمَاتُوهَا
[Machine] He heard Jabir ibn Abdullah saying, "The Prophet ﷺ stoned a man who was a Muslim, and a man who was from the Jews, and his wife." The scholar (may Allah have mercy on him) said, "By woman from the Jews, he means a woman from the Jews."
أَنَّهُ سَمِعَ جَابِرَ بْنَ عَبْدِ اللهِ يَقُولُ رَجَمَ النَّبِيُّ ﷺ رَجُلًا مِنْ أَسْلَمَ وَرَجُلًا مِنَ الْيَهُودِ وَامْرَأَتَهُ قَالَ الشَّيْخُ رَحِمَهُ اللهُ يَعْنِي امْرَأَةً مِنَ الْيَهُودِ
[Machine] That the Jews brought a Jewish man and a Jewish woman who had committed adultery to the Messenger of Allah ﷺ , and they had already been married. So the Messenger of Allah ﷺ ordered that they be stoned to death. Abdullah Ibn Al-Harith said, "I was among those who stoned them."
أَنَّ الْيَهُودَ أَتَوْا رَسُولَ اللهِ ﷺ بِيَهُودِيٍّ وَيَهُودِيَّةٍ زَنَيَا وَقَدْ أُحْصِنَا فَأَمَرَ بِهِمَا رَسُولُ اللهِ ﷺ فَرُجِمَا قَالَ عَبْدُ اللهِ بْنُ الْحَارِثِ فَكُنْتُ أَنَا فِيمَنْ رَجَمَهُمَا
[Machine] The Messenger of Allah ﷺ was presented with a Jewish man and a Jewish woman who were both married. They asked him to judge between them, so he ruled that they should be stoned to death. This information was relayed to me by Abu Abdullah with permission from Abu al-Walid, who narrated it from Muhammad ibn Ishaq, who narrated it from Yusuf ibn Musa, who heard it from Jarir, who heard it from Muhammad ibn Ishaq. Additionally, in a separate hadith, Zahiri heard a man from Muzaynah narrating from Ibn Mas'ud that Abu Hurairah informed them that Jewish rabbis met in the school when the Messenger of Allah arrived in Medina. One of them committed adultery with a Jewish woman after she had been legally married to him. This hadith is mentioned in the chapter about the punishment of non-Muslims.
أُتِيَ رَسُولُ اللهِ ﷺ بِيَهُودِيٍّ وَيَهُودِيَّةٍ وَقَدْ أُحْصِنَا فَسَأَلُوهُ أَنْ يَحْكُمَ فِيمَا بَيْنَهُمْ فَحَكَمَ فِيهِمَا بِالرَّجْمِ 16933 وَهَذَا فِيمَا أَنْبَأَنِيهِ أَبُو عَبْدِ اللهِ إِجَازَةً أنبأ أَبُو الْوَلِيدِ ثنا مُحَمَّدُ بْنُ إِسْحَاقَ ثنا يُوسُفُ بْنُ مُوسَى أنبأ جَرِيرٌ عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ فَذَكَرَهُ وَفِي حَدِيثِ الزُّهْرِيِّ سَمِعَ رَجُلًا مِنْ مُزَيْنَةَ يُحَدِّثُ ابْنَ الْمُسَيِّبِ أَنَّ أَبَا هُرَيْرَةَ حَدَّثَهُمْ أَنَّ أَحْبَارَ يَهُودَ اجْتَمَعُوا فِي بَيْتِ الْمِدْرَاسِ حِينَ قَدِمَ رَسُولُ اللهِ ﷺ الْمَدِينَةَ وَقَدْ زَنَى مِنْهُمْ رَجُلٌ بَعْدَ إِحْصَانِهِ بِامْرَأَةٍ مِنَ الْيَهُودِ قَدْ أَحْصَنَتْ فَذَكَرَ الْحَدِيثَ وَهُوَ مَذْكُورٌ فِي بَابِ حَدِّ الذِّمِّيِّينَ
[Machine] Abu Waqid al-Laythi, who was one of the Companions of the Prophet Muhammad ﷺ , narrated that while he was with Umar ibn al-Khattab at al-Jabiya, a man came to him and said, "O Amir al-Mu'minin (Commander of the Faithful), my wife has committed adultery with my slave and she has confessed to it." Abu Waqid said, "So Umar called me and another nine people, and we were sent to his wife, and Umar ordered us to ask her about what he said. So we went to her and found her to be a young girl. When I saw her, I said, 'You can escape punishment today if you want.' Then I spoke to her and said, 'Your husband came to Amir al-Mu'minin and informed him that you committed adultery with his slave, so he sent us to you as witnesses to what you say.' She said, 'He speaks the truth.' So Umar ordered us and we stoned her with stones."
أَنَّ أَبَا وَاقِدٍ اللَّيْثِيَّ وَكَانَ مِنْ أَصْحَابِ النَّبِيِّ ﷺ أَخْبَرَهُ أَنَّهُ بَيْنَا هُوَ عِنْدَ عُمَرَ بْنِ الْخَطَّابِ ؓ بِالْجَابِيَةِ جَاءَهُ رَجُلٌ فَقَالَ يَا أَمِيرَ الْمُؤْمِنِينَ إِنَّ امْرَأَتِي زَنَتْ بِعَبْدِي مُعْتَرِفَةً بِذَلِكَ قَالَ أَبُو وَاقِدٍ فَدَعَانِي عُمَرُ بْنُ الْخَطَّابِ ؓ عَاشِرَ عَشَرَةِ رَهْطٍ فَأَرْسَلَنَا إِلَى امْرَأَتِهِ وَأَمَرَنَا أَنْ نَسْأَلَهَا عَمَّا قَالَ فَجِئْنَاهَا فَإِذَا هِيَ جَارِيَةٌ حَدِيثَةُ السِّنِّ فَقُلْتُ حِينَ رَأَيْتُهَا تَكْفِتُهَا عَمَّا شِئْتُ الْيَوْمَ ثُمَّ كَلَّمْتُهَا فَقُلْتُ إِنَّ زَوْجَكِ أَتَى أَمِيرَ الْمُؤْمِنِينَ فَأَخْبَرَهُ أَنَّكِ زَنَيْتِ بِعَبْدِهِ فَأَرْسَلَنَا إِلَيْكِ لِنَشْهَدَ عَلَى مَا تَقُولِينَ قَالَتْ صَدَقَ فَأَمَرَنَا عُمَرُ ؓ فَرَجَمْنَاهَا بِالْحِجَارَةِ
“A Woman was coerced (i.e., raped) during the time of Messenger of Allah ﷺ He waived the legal punishment for her and carried it out on the one who had attacked her, but he (the narrator) did not say that he rules that she should be given a bridal-money.” (Using translation from Ibn Mājah 2598)
اسْتُكْرِهَتِ امْرَأَةٌ عَلَى عَهْدِ النَّبِيِّ ﷺ فَدَرَأَ عَنْهَا الْحَدَّ وَأَقَامَهُ عَلَى الَّذِي أَصَابَهَا
55.5 [Machine] Who said: Whoever associates partners with Allah is not chaste
٥٥۔٥ بَابُ مَنْ قَالَ: مَنْ أَشْرَكَ بِاللهِ فَلَيْسَ بِمُحْصَنٍ
This hadith has been reported on the authority of Ibn 'Umar through another chain of transmitters. (Using translation from Muslim 1501b)
عَنْ نَافِعٍ
[Machine] The Messenger of Allah ﷺ said: "Whoever associates partners with Allah is not considered chaste." Abu 'Abd al-Rahman al-Sulami and Abu Bakr ibn al-Harith al-Faqih reported to us that 'Ali ibn 'Umar, the father of al-Hasan, the Darquti, the Hafiz, said: "(This hadith) was not narrated by anyone other than Ishaq, and it is said that he later retracted from it, and the correct opinion is that it is mawquf."
قَالَ رَسُولُ اللهِ ﷺ مَنْ أَشْرَكَ بِاللهِ فَلَيْسَ بِمُحْصَنٍ 16938 فَأَخْبَرَنَا أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ وَأَبُو بَكْرِ بْنُ الْحَارِثِ الْفَقِيهُ قَالَا أَنْبَأَ عَلِيُّ بْنُ عُمَرَ أَبُو الْحَسَنِ الدَّارَقُطْنِيُّ الْحَافِظُ قَالَ لَمْ يَرْفَعْهُ غَيْرُ إِسْحَاقَ وَيُقَالُ إِنَّهُ رَجَعَ عَنْهُ وَالصَّوَابُ مَوْقُوفٌ
[Machine] The Messenger of Allah, ﷺ , said, "Those who associate partners with Allah have no protection." Abu Ahmad narrated from Ahmad ibn Abi Nafi' from Mu'afa ibn Imran from Thawri, who considered it a rejected hadith from Thawri from Musa ibn 'Uqbah with this chain of narration. Abu Abdur Rahman as-Sulami and Abu Bakr ibn al-Harith informed us that Ali ibn Umar al-Hafiz said, "He is doubtful about its authenticity, and the correct version is that it is attributed to Ibn Umar."
قَالَ رَسُولُ اللهِ ﷺ لَا يُحْصِنُ أَهْلُ الشِّرْكِ بِاللهِ شَيْئًا قَالَ أبو أَحْمَدَ وَرَوَى عَنْ أَحْمَدَ بْنِ أَبِي نَافِعٍ عَنْ مُعَافَى بْنِ عِمْرَانَ عَنِ الثَّوْرِيِّ وَهُوَ مُنْكَرٌ مِنْ حَدِيثِ الثَّوْرِيِّ عَنْ مُوسَى بْنِ عُقْبَةَ بِهَذَا الْإِسْنَادِ وَأَخْبَرَنَا أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ وَأَبُو بَكْرِ بْنُ الْحَارِثِ قَالَا أَنْبَأَ عَلِيُّ بْنُ عُمَرَ الْحَافِظُ قَالَ وَهِمَ عَفِيفٌ فِي رَفْعِهِ وَالصَّوَابُ مَوْقُوفٌ مِنْ قَوْلِ ابْنِ عُمَرَ
[Machine] Whoever associates partners with Allah is not a believer.
مَنْ أَشْرَكَ بِاللهِ فَلَيْسَ بِمُحْصَنٍ
[Machine] That he should marry a Jewess or a Christian woman, so the Messenger of Allah ﷺ prohibited him from doing so and said to him that it would not protect him. 16942. Abdur-Rahman Al-Sulami and Abu Bakr Ibn Al-Harith Al-Faqih informed us, they said: Abu Al-Hasan Ad-Daraqutni, Al-Hafiz, said: Abu Bakr Ibn Abi Maryam is weak and Ali Ibn Abi Talhah did not meet Ka'b. The Sheikh, may Allah have mercy on him, said: It was also narrated by Baqiyyah Ibn Al-Walid from Abu Saba Utbah Ibn Tamim from Ali Ibn Abi Talhah from Ka'b, and this narration is disconnected.
أَنْ يَتَزَوَّجَ يَهُودِيَّةً أَوْ نَصْرَانِيَّةً فَسَأَلَ رَسُولَ اللهِ ﷺ فَنَهَاهُ عَنْهَا وَقَالَ إِنَّهَا لَا تُحْصِنُكَ 16942 أَخْبَرَنَا عَبْدُ الرَّحْمَنِ السُّلَمِيُّ وَأَبُو بَكْرِ بْنُ الْحَارِثِ الْفَقِيهُ قَالَا قَالَ أَبُو الْحَسَنِ الدَّارَقُطْنِيُّ الْحَافِظُ أَبُو بَكْرِ بْنُ أَبِي مَرْيَمَ ضَعِيفٌ وَعَلِيُّ بْنُ أَبِي طَلْحَةَ لَمْ يُدْرِكْ كَعْبًا قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَرَوَاهُ أَيْضًا بَقِيَّةُ بْنُ الْوَلِيدِ عَنْ أَبِي سَبَأٍ عُتْبَةَ بْنِ تَمِيمٍ عَنْ عَلِيِّ بْنِ أَبِي طَلْحَةَ عَنْ كَعْبٍ وَهُوَ مُنْقَطِعٌ
55.6 [Machine] What came in the nation that protects freedom?
٥٥۔٦ بَابُ مَا جَاءَ فِي الْأَمَةِ تُحْصِنُ الْحُرَّ
[Machine] We heard the companions of the Messenger of Allah ﷺ saying that.
أَدْرَكْنَا أَصْحَابَ رَسُولِ اللهِ ﷺ يَقُولُونَ ذَلِكَ
[Machine] We encountered the companions of the Messenger of Allah ﷺ saying that. Imam Ahmad said that it was narrated to me by Muhammad ibn Yahya that he said, "I found Al-Awza'i following Yunus, so they are more deserving (of trust)." And it was narrated by Amr ibn Abi Salamah from Al-Awza'i.
أَدْرَكْنَا أَصْحَابَ رَسُولِ اللهِ ﷺ يَقُولُونَ ذَلِكَ قَالَ الْإِمَامُ أَحْمَدُ بَلَغَنِي عَنْ مُحَمَّدِ بْنِ يَحْيَى أَنَّهُ قَالَ وَجَدْتُ الْأَوْزَاعِيَّ قَدْ تَابَعَ يُونُسَ فَهُمَا إِذًا أَوْلَى وَرَوَاهُ عَنْ عَمْرِو بْنِ أَبِي سَلَمَةَ عَنِ الْأَوْزَاعِيِّ
55.7 [Machine] What is the ruling regarding someone who married a woman but did not have sexual intercourse with her, then committed adultery?
٥٥۔٧ بَابُ مَا جَاءَ فِيمَنْ تَزَوَّجَ امْرَأَةً وَلَمْ يَمَسَّهَا ثُمَّ زَنَى
أَنْ يُجْلَدَ وَلَا يُرْجَمَ
[Machine] I came with Ali to Siffin, and there was a man in the field crying out, "I have committed fornication, so apply the punishment on me." I brought him to Ali, and Ali asked him, "Did you get married?" He replied, "Yes." Ali asked, "Did you consummate the marriage?" He replied, "No." Ali then flogged him a hundred times, fined him half of the marriage gift, and separated them.
جِئْتُ مَعَ عَلِيٍّ ؓ بِصِفِّينَ فَإِذَا رَجُلٌ فِي زَرْعٍ يُنَادِي إِنِّي قَدْ أَصَبْتُ فَاحِشَةً فَأَقِيمُوا عَلَيَّ الْحَدَّ فَرَفَعْتُهُ إِلَى عَلِيٍّ ؓ فَقَالَ لَهُ عَلِيٌّ ؓ هَلْ تَزَوَّجْتَ؟ قَالَ نَعَمْ قَالَ فَدَخَلْتَ بِهَا؟ قَالَ لَا قَالَ فَجَلَدَهُ مِائَةً وَأَغْرَمَهُ نِصْفَ الصَّدَاقِ وَفَرَّقَ بَيْنَهُمَا
[Machine] That Ali entered by force, and then stayed with her against her will, so he separated them. The Sheikh said, "As for the separation between them by adultery, we do not say that because of what we mentioned in the book of marriage from the evidences, and it is possible that Ali separated them with his consent by way of separation, and Allah knows best."
أَنْ يَدْخُلَ بِهَا فَأَقَامَ عَلِيٌّ ؓ عَلَيْهِ الْحَدَّ فَقَالَ إِنَّ الْمَرْأَةَ لَا تَرْضَى أَنْ تَكُونَ عِنْدَهُ فَفَرَّقَ بَيْنَهُمَا عَلِيٌّ ؓ قَالَ الشَّيْخُ رَحِمَهُ اللهُ أَمَّا التَّفْرِيقُ بَيْنَهُمَا بِالزِّنَا حُكْمًا فَلَا نَقُولُ بِهِ لِمَا ذَكَرْنَا فِي كِتَابِ النِّكَاحِ مِنَ الْحُجَجِ وَيُحْتَمَلُ أَنْ يَكُونَ عَلِيٌّ ؓ فَرَّقَ بَيْنَهُمَا بِرِضَاهُ بِالتَّفْرِيقِ وَاللهُ أَعْلَمُ
[Machine] Regarding the scholars of the people of Madinah, they used to say: Whoever marries someone who was not chaste before that, and commits adultery before consummating the marriage, there shall be no stoning upon him. Likewise, the woman is also not subject to stoning. However, if he enters upon his wife for an hour of the day or night, or more than that, and then commits adultery after that, then stoning shall be obligatory upon him. Similarly, the woman is also subject to stoning. The slave women who are mothers of children do not incur stoning.
عَنِ الْفُقَهَاءِ مِنْ أَهْلِ الْمَدِينَةِ كَانُوا يَقُولُونَ مَنْ تَزَوَّجَ مِمَّنْ لَمْ يَكُنْ أُحْصِنَ قَبْلَ ذَلِكَ فَزَنَى قَبْلَ أَنْ يَدْخُلَ بِامْرَأَتِهِ فَلَا رَجْمَ عَلَيْهِ وَالْمَرْأَةُ مِثْلُ ذَلِكَ فَإِنْ دَخَلَ بِامْرَأَتِهِ سَاعَةً مِنْ لَيْلٍ أَوْ نَهَارٍ أَوْ أَكْثَرَ فَزَنَى بَعْدَ ذَلِكَ فَعَلَيْهِ الرَّجْمُ وَالْمَرْأَةُ مِثْلُ ذَلِكَ وَالْإِمَاءُ أُمَّهَاتُ الْأَوْلَادِ لَا يُوجِبْنَ الرَّجْمَ
55.8 [Machine] Translation: "Who is to be punished in adultery and then is known to be chaste.
٥٥۔٨ بَابُ مَنْ جُلِدَ فِي الزِّنَا ثُمَّ عُلِمَ بِإِحْصَانِهِ
[Machine] The Messenger of Allah ﷺ flogged a man for adultery one hundred times, and it was reported that he was married. So, he commanded that he be stoned.
أَنَّ رَسُولَ اللهِ ﷺ جَلَدَ رَجُلًا فِي الزِّنَا مِائَةً فَأُخْبِرَ أَنَّهُ كَانَ أُحْصِنَ فَأَمَرَ بِهِ فَرُجِمَ
[Machine] That a man committed adultery with a woman and his chastity was not known, so he was punished with whipping. Then it was revealed that he had been chaste, so he was stoned. This is the wording of the hadith of Al-Bazzaaz, and in another narration of Abu Muslim, it is reported from Jabir that a man committed adultery and was then punished with whipping, and then it was revealed that he had been chaste. Jabir said, "He should be stoned."
أَنَّ رَجُلًا زَنَى بِامْرَأَةٍ فَلَمْ يُعْلَمْ بِإِحْصَانِهِ فَجُلِدَ ثُمَّ عُلِمَ بِإِحْصَانِهِ فَرُجِمَ هَذَا لَفْظُ حَدِيثِ الْبَزَّازِ وَفِي رِوَايَةِ أَبِي مُسْلِمٍ قَالَ عَنْ جَابِرٍ فِي رَجُلٍ زَنَى ثُمَّ جُلِدَ ثُمَّ عُلِمَ بِإِحْصَانِهِ قَالَ يُرْجَمُ
55.9 [Machine] The stoned one is washed, prayed upon, and then buried.
٥٥۔٩ بَابُ الْمَرْجُومِ يُغَسَّلُ وَيُصَلَّى عَلَيْهِ ثُمَّ يُدْفَنُ
[Machine] A woman from Juhaynah came to the Prophet ﷺ while she was pregnant from an illicit affair. The Messenger of Allah ﷺ commanded her guardian to treat her well. When she gave birth, bring the baby to me." He did so, and the Prophet ﷺ ordered her to be covered with her clothes. Then he ordered her to be stoned. After that, he prayed for her and said to Umar, "O Messenger of Allah, do you pray for her while she committed adultery?" He replied, "She has sincerely repented to a degree that if it was distributed amongst the people of Madinah, it would suffice them. Have you seen anything better than a person who has gone so far in improving herself?" 16952 And Abu Abdullah al-Hafiz informed us, and Muhammad ibn Salih ibn Hane narrated to me from Abu Ali al-Qabbani, who narrated from Ubaydullah ibn Sa'id, who narrated from Mu'adh ibn Hisham, who narrated from my father, who mentioned it with its chain of narration and its meaning except that he said, "if it was distributed amongst seventy of the people of Madinah, it would suffice them. Have you found anything better than a person who has gone so far in sacrificing herself for Allah?"
أَنَّ امْرَأَةً مِنْ جُهَيْنَةَ أَتَتِ النَّبِيَّ ﷺ وَهِيَ حُبْلَى مِنَ الزِّنَا فَأَمَرَ رَسُولُ اللهِ ﷺ وَلِيَّهَا أَنْ يُحْسِنَ إِلَيْهَا فَإِذَا وَضَعَتْ حَمْلَهَا فَائْتِنِي بِهَا فَفَعَلَ فَأَمَرَ بِهَا فَشُكَّتْ عَلَيْهَا ثِيَابُهَا ثُمَّ أَمَرَ بِهَا فَرُجِمَتْ ثُمَّ صَلَّى عَلَيْهَا فَقَالَ لَهُ عُمَرُ ؓ يَا رَسُولَ اللهِ أَتُصَلِّي عَلَيْهَا وَقَدْ زَنَتْ؟ فَقَالَ لَقَدْ تَابَتْ تَوْبَةً لَوْ قُسِمَتْ بَيْنَ أَهْلِ الْمَدِينَةِ لَوَسِعَتْهُمْ وَهَلْ وَجَدْتَ شَيْئًا أَفْضَلَ مِنْ أَنْ جَادَتْ بِنَفْسِهَا 16952 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أَخْبَرَنِي مُحَمَّدُ بْنُ صَالِحِ بْنِ هَانِئٍ ثنا أَبُو عَلِيٍّ الْقَبَّانِيُّ ثنا عُبَيْدُ اللهِ بْنُ سَعِيدٍ ثنا مُعَاذُ بْنُ هِشَامٍ حَدَّثَنِي أَبِي فَذَكَرَهُ بِإِسْنَادِهِ وَمَعْنَاهُ إِلَّا أَنَّهُ قَالَ لَوْ قُسِمَتْ بَيْنَ سَبْعِينَ مِنْ أَهْلِ الْمَدِينَةِ لَوَسِعَتْهُمْ وَهَلْ وَجَدْتَ أَفْضَلَ مِنْ أَنْ جَادَتْ بِنَفْسِهَا لِلَّهِ ﷻ
[Machine] Take it easy, Khalid ibn Al-Walid, don't insult her. By the One in whose hand is my soul, she has repented with a repentance that, if the owner of the Makhs (i.e. a person of questionable character) were to repent like it, he would be forgiven. So he commanded for her to be prayed upon and she was buried.
مَهْلًا يَا خَالِدَ بْنَ الْوَلِيدِ لَا تَسُبَّهَا فَوَالَّذِي نَفْسِي بِيَدِهِ لَقَدْ تَابَتْ تَوْبَةً لَوْ تَابَهَا صَاحِبُ مَكْسٍ لَغُفِرَ لَهُ فَأَمَرَ بِهَا فَصَلَّى عَلَيْهَا وَدُفِنَتْ
I was working in the market. A woman passed carrying a child. The people rushed towards her, and I also rushed along with them. I then went to the Prophet ﷺ while he was asking: Who is the father of this (child) who is with you? She remained silent. A young man by her side said: I am his father, Messenger of Allah! He then turned towards her and asked: Who is the father of this child with you? The young man said: I am his father, Messenger of Allah! The Messenger of Allah ﷺ then looked at some of those who were around him and asked them about him. They said: We only know good (about him). The Prophet ﷺ said to him: Are you married? He said: Yes. So he gave orders regarding him and he was stoned to death. He (the narrator) said: We took him out, dug a pit for him and put him in it. We then threw stones at him until he died. A man then came asking about the man who was stoned. We brought him to the Prophet ﷺ and said: This man has come asking about the wicked man. The Messenger of Allah ﷺ said: He is more agreeable than the fragrance of musk in the eyes of Allah. The man was his father. We then helped him in washing, shrouding and burying him. (The narrator said:) I do not know whether he said or did not say "in praying over him." This is the tradition of Abdah, and it is more accurate. (Using translation from Abū Dāʾūd 4435)
أَخْبَرَهُ أَنَّهُ كَانَ قَاعِدًا يَعْمَلُ فِي السُّوقِ فَمَرَّتِ امْرَأَةٌ تَحْمِلُ صَبِيًّا فَثَارَ النَّاسُ وَثُرْتُ فِيمَنْ ثَارَ فَانْتَهَيْتُ إِلَى النَّبِيِّ ﷺ أَظُنُّهُ قَالَ فَقَالَ مَنْ أَبُو هَذَا مَعَكِ؟ قَالَ فَسَكَتَتْ قَالَ فَقَالَ شَابٌّ حِذَاءَهَا أَنَا أَبُوهُ يَا رَسُولَ اللهِ قَالَ فَأَقْبَلَ عَلَيْهَا فَقَالَ مَنْ أَبُو هَذَا مَعَكِ؟ قَالَ فَسَكَتَتْ قَالَ فَقَالَ الْفَتَى يَا رَسُولَ اللهِ إِنَّهَا حَدِيثَةُ السِّنِّ حَدِيثَةُ عَهْدٍ بِخِزْيَةٍ وَلَيْسَتْ مُكَلِّمَتَكَ فَأَنَا أَبُوهُ يَا رَسُولَ اللهِ قَالَ فَنَظَرَ إِلَى بَعْضِ مَنْ حَوْلَهُ كَأَنَّهُ يَسْأَلُهُمْ عَنْهُ فَقَالُوا مَا عَلِمْنَا إِلَّا خَيْرًا أَوْ نَحْوَ ذَا فَقَالَ أَحْصَنْتَ؟ قَالَ نَعَمْ قَالَ فَأَمَرَ بِهِ فَرُجِمَ قَالَ فَخَرَجْنَا بِهِ فَحَفَرْنَا لَهُ حَتَّى أَمْكَنَّا ثُمَّ رَمَيْنَاهُ بِالْحِجَارَةِ حَتَّى هَدَأَ ثُمَّ انْصَرَفْنَا إِلَى مَجَالِسِنَا قَالَ فَبَيْنَا نَحْنُ كَذَلِكَ إِذْ جَاءَ شَيْخٌ يَسْأَلُ عَنِ الْمَرْجُومِ فَقُمْنَا إِلَيْهِ فَأَخَذْنَا بِتَلَابِيبِهِ فَانْطَلَقْنَا بِهِ إِلَى النَّبِيِّ ﷺ فَقُلْنَا إِنَّ هَذَا جَاءَ يَسْأَلُ عَنِ الْخَبِيثِ فَقَالَ رَسُولُ اللهِ ﷺ مَهْ لَهُوَ أَطْيَبُ عِنْدَ اللهِ مِنْ رِيحِ الْمِسْكِ قَالَ فَانْصَرَفْنَا مَعَ الشَّيْخِ فَإِذَا هُوَ أَبُوهُ فَأَتَيْنَا إِلَيْهِ فَأَعَنَّاهُ عَلَى غُسْلِهِ وَتَكْفِينِهِ وَدَفْنِهِ قَالَ وَلَا أَدْرِي قَالَ وَالصَّلَاةِ عَلَيْهِ أَمْ لَا وَرُوِّينَا عَنْ أَبِي بَكْرٍ أَنَّ النَّبِيَّ ﷺ رَجَمَ امْرَأَةً فَلَمَّا طُفِئَتْ أَخْرَجَهَا فَصَلَّى عَلَيْهَا
[Machine] A man who had embraced Islam came to the Prophet and confessed to committing adultery. The Prophet turned away from him, then he confessed again and the Prophet turned away from him again. This happened four times until he testified against himself four times. The Prophet asked him, "Are you crazy?" He replied, "No." The Prophet then asked him, "Have you protected yourself?" He replied, "Yes." So the Prophet ordered that he be stoned at the mosque. When the stones caused him pain, he ran away but was caught and stoned until he died. The Prophet then said to him, "May Allah grant you goodness. He did not offer funeral prayer for him."
أَنَّ رَجُلًا مِنْ أَسْلَمَ جَاءَ إِلَى النَّبِيِّ ﷺ فَاعْتَرَفَ بِالزِّنَا فَأَعْرَضَ عَنْهُ ثُمَّ اعْتَرَفَ فَأَعْرَضَ عَنْهُ حَتَّى شَهِدَ عَلَى نَفْسِهِ أَرْبَعَ مَرَّاتٍ فَقَالَ لَهُ النَّبِيُّ ﷺ أَبِكَ جُنُونٌ؟ قَالَ لَا قَالَ أَحْصَنْتَ؟ قَالَ نَعَمْ فَأَمَرَ بِهِ النَّبِيُّ ﷺ فَرُجِمَ بِالْمُصَلَّى فَلَمَّا أَذْلَقَتْهُ الْحِجَارَةُ فَرَّ فَأُدْرِكَ فَرُجِمَ حَتَّى مَاتَ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ خَيْرًا وَلَمْ يُصَلِّ عَلَيْهِ
[Machine] Ma'iz ibn Malik came and confessed to the Prophet ﷺ about adultery three times. The Prophet ﷺ asked about him, then ordered that he should be stoned. So we stoned him with stones, pottery, and bones. We did not dig a pit nor fasten him. He then went towards a wall and we followed him. He stood up and we stoned him until he became still. The Prophet ﷺ did not seek forgiveness for him nor curse him.
جَاءَ مَاعِزُ بْنُ مَالِكٍ فَاعْتَرَفَ عِنْدَ النَّبِيِّ ﷺ بِالزِّنَا ثَلَاثَ مَرَّاتٍ فَسَأَلَ عَنْهُ النَّبِيُّ ﷺ ثُمَّ أَمَرَ بِهِ فَرُجِمَ فَرَمَيْنَاهُ بِالْخَزَفِ وَالْجَنْدَلِ وَالْعِظَامِ وَمَا حَفَرْنَا لَهُ وَلَا أَوْثَقْنَاهُ فَمَضَى يَشْتَدُّ إِلَى الْحَرَّةِ وَاتَّبَعْنَاهُ فَقَامَ لَنَا فَرَمَيْنَاهُ حَتَّى سَكَنَ فَمَا اسْتَغْفَرَ لَهُ النَّبِيُّ ﷺ وَلَا سَبَّهُ
55.10 [Machine] Who allowed the absence of the condemned and the witnesses? Al-Shafi'i, may Allah have mercy on him, said: The Messenger of Allah, ﷺ , ordered the stoning of a she-goat, but he did not attend it, and he ordered Unays to bring a woman and if she confessed, stone her, and he did not say, "Inform me so that I attend her.
٥٥۔١٠ بَابُ مَنْ أَجَازَ أَنْ لَا يَحْضُرَ الْإِمَامُ الْمَرْجُومِينَ وَلَا الشُّهُودُ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: أَمَرَ رَسُولُ اللهِ ﷺ بِرَجْمِ مَاعِزٍ، وَلَمْ يَحْضُرْهُ، وَأَمَرَ أُنَيْسًا أَنْ يَأْتِيَ امْرَأَةً فَإِنِ اعْتَرَفَتْ رَجَمَهَا، وَلَمْ يَقُلْ أَعْلِمْنِي لِأَحْضُرَهَا
A man from Bani Aslam came to Messenger of Allah ﷺ while he was in the mosque and called (the Prophet ﷺ ) saying, "O Messenger of Allah ﷺ! I have committed illegal sexual intercourse." On that the Prophet ﷺ turned his face from him to the other side, whereupon the man moved to the side towards which the Prophet ﷺ had turned his face, and said, "O Messenger of Allah ﷺ! I have committed illegal sexual intercourse." The Prophet turned his face (from him) to the other side whereupon the man moved to the side towards which the Prophet ﷺ had turned his face, and repeated his statement. The Prophet ﷺ turned his face (from him) to the other side again. The man moved again (and repeated his statement) for the fourth time. So when the man had given witness four times against himself, the Prophet ﷺ called him and said, "Are you insane?" He replied, "No." The Prophet ﷺ then said (to his companions), "Go and stone him to death." The man was a married one. Jabir bin ʿAbdullah Al-Ansari said: I was one of those who stoned him. We stoned him at the Musalla (ʿId praying place) in Medina. When the stones hit him with their sharp edges, he fled, but we caught him at Al-Harra and stoned him till he died. أَتَى رَجُلٌ مِنْ أَسْلَمَ رَسُولَ اللهِ ﷺ وَهُوَ فِي الْمَسْجِدِ فَنَادَاهُ فَقَالَ يَا رَسُولَ اللهِ إِنَّ الْآخَرَ زَنَى يَعْنِي نَفْسَهُ فَأَعْرَضَ عَنْهُ رَسُولُ اللهِ ﷺ فَتَنَحَّى لِشِقِّ وَجْهِهِ الَّذِي أَعْرَضَ قِبَلَهُ فَقَالَ يَا رَسُولَ اللهِ إِنَّ الْآخَرَ زَنَى فَأَعْرَضَ عَنْهُ رَسُولُ اللهِ ﷺ فَتَنَحَّى لِشِقِّ وَجْهِهِ الَّذِي أَعْرَضَ قِبَلَهُ فَقَالَ يَا رَسُولَ اللهِ إِنَّ الْآخَرَ زَنَى فَأَعْرَضَ عَنْهُ رَسُولُ اللهِ ﷺ فَتَنَحَّى الرَّابِعَةَ فَلَمَّا شَهِدَ عَلَى نَفْسِهِ أَرْبَعَ شَهَادَاتٍ دَعَاهُ رَسُولُ اللهِ ﷺ فَقَالَ هَلْ بِكَ جُنُونٌ؟ فَقَالَ لَا فَقَالَ رَسُولُ اللهِ ﷺ اذْهَبُوا بِهِ فَارْجُمُوهُ وَكَانَ قَدْ أُحْصِنَ قَالَ الزُّهْرِيُّ فَأَخْبَرَنِي مَنْ سَمِعَ جَابِرَ بْنَ عَبْدِ اللهِ الْأَنْصَارِيَّ قَالَ كُنْتُ فِيمَنْ رَجَمَهُ فَرَجَمْنَاهُ بِالْمُصَلَّى بِالْمَدِينَةِ فَلَمَّا أَذْلَقَتْهُ الْحِجَارَةُ جَمَزَ حَتَّى أَدْرَكْنَاهُ بِالْحَرَّةِ فَرَجَمْنَاهُ حَتَّى مَاتَ
[Machine] A goat came to the Prophet ﷺ and said, "O Messenger of Allah, I have committed adultery. So, establish the punishment upon me according to the Book of Allah." The Prophet turned away from it. The goat repeated its statement four times, but the Prophet turned away from it each time. Then he said, "Take it and stone it." When the stones touched it, it became agitated and struggled. Abdullah ibn Unais came from his village and threw a piece of brick at it, causing its death. The people stoned it until it was killed. It was then mentioned to the Prophet ﷺ that it had run away. He said, "Why did you not leave it alone? Perhaps it would have repented, and Allah would have accepted its repentance." O Hazal, if only you had covered it with your garment, that would have been better for you than what you have done. Some narrations mention that Yazid ibn Nuaim threw a piece of camel dung, and others mention a piece of camel's beard.
جَاءَ مَاعِزٌ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنِّي زَنَيْتُ فَأَقِمْ فِيَّ كِتَابَ اللهِ فَأَعْرَضَ عَنْهُ ثُمَّ قَالَ إِنِّي زَنَيْتُ فَأَقِمْ فِيَّ كِتَابَ اللهِ فَأَعْرَضَ عَنْهُ حَتَّى ذَكَرَ أَرْبَعَ مَرَّاتٍ فَقَالَ اذْهَبُوا بِهِ فَارْجُمُوهُ فَلَمَّا مَسَّتْهُ الْحِجَارَةُ جَزِعَ فَاشْتَدَّ فَخَرَجَ عَبْدُ اللهِ بْنُ أُنَيْسٍ مِنْ بَادِيَتِهِ فَرَمَاهُ بِوَظِيفِ حِمَارٍ فَصَرَعَهُ وَرَمَاهُ النَّاسُ حَتَّى قَتَلُوهُ فَذُكِرَ لِلنَّبِيِّ ﷺ فِرَارَهُ فَقَالَ هَلَّا تَرَكْتُمُوهُ فَلَعَلَّهُ يَتُوبُ فَيَتُوبَ اللهُ عَلَيْهِ يَا هَزَّالُ لَوْ سَتَرْتَهُ بِثَوْبِكَ كَانَ خَيْرًا لَكَ مِمَّا صَنَعْتَ وَقَالَ غَيْرُهُ فِي هَذَا الْحَدِيثِ عَنْ يَزِيدَ بْنِ نُعَيْمٍ بِوَظِيفِ بَعِيرٍ وَقَالَ بَعْضُهُمْ بِلَحْيِ بَعِيرٍ
