55. Prescribed Punishments (2/5)
٥٥۔ كِتَابُ الْحُدُودِ ص ٢
A bedouin came to Messenger of Allah ﷺ and said, "O Allah's apostle! I ask you by Allah to judge My case according to Allah's Laws." His opponent, who was more learned than he, said, "Yes, judge between us according to Allah's Laws, and allow me to speak." Messenger of Allah ﷺ said, "Speak." He (i .e. the bedouin or the other man) said, "My son was working as a laborer for this (man) and he committed illegal sexual intercourse with his wife. The people told me that it was obligatory that my son should be stoned to death, so in lieu of that I ransomed my son by paying one hundred sheep and a slave girl. Then I asked the religious scholars about it, and they informed me that my son must be lashed one hundred lashes, and be exiled for one year, and the wife of this (man) must be stoned to death." Messenger of Allah ﷺ said, "By Him in Whose Hands my soul is, I will judge between you according to Allah's Laws. The slave-girl and the sheep are to be returned to you, your son is to receive a hundred lashes and be exiled for one year. You, Unais, go to the wife of this (man) and if she confesses her guilt, stone her to death." Unais went to that woman next morning and she confessed. Messenger of Allah ﷺ ordered that she be stoned to death. (Using translation from Bukhārī 2724)
عَنْ زَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ وَأَبِي هُرَيْرَةَ وَشِبْلٍ قَالُوا كُنَّا عِنْدَ النَّبِيِّ ﷺ فَقَامَ إِلَيْهِ رَجُلٌ فَقَالَ يَا رَسُولَ اللهِ أَنْشُدُكَ اللهَ إِلَّا قَضَيْتَ بَيْنَنَا بِكِتَابِ اللهِ فَقَامَ خَصْمُهُ وَكَانَ أَفْقَهَ مِنْهُ فَقَالَ أَجَلْ يَا رَسُولَ اللهِ اقْضِ بَيْنَنَا بِكِتَابِ اللهِ وَأْذَنْ فَلْأَقُلْ قَالَ قُلْ قَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا وَإِنَّهُ زَنَى بِامْرَأَتِهِ فَأُخْبِرْتُ أَنَّ عَلَى ابْنِي الرَّجْمَ فَافْتَدَيْتُ مِنْهُ بِمِائَةِ شَاةٍ وَخَادِمٍ ثُمَّ سَأَلْتُ رِجَالًا مِنْ أَهْلِ الْعِلْمِ فَأَخْبَرَنِي أَنَّ عَلَى ابْنِي جَلْدَ مِائَةٍ وَتَغْرِيبَ عَامٍ وَأَنَّ عَلَى امْرَأَةِ هَذَا الرَّجْمَ فَقَالَ النَّبِيُّ ﷺ وَالَّذِي نَفْسِي بِيَدِهِ لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللهِ الْمِائَةُ شَاةٍ وَالْخَادِمُ رَدٌّ عَلَيْكَ وَعَلَى ابْنِكَ جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ وَاغْدُ يَا أُنَيْسُ عَلَى امْرَأَةِ هَذَا فَإِنِ اعْتَرَفَتْ فَارْجُمْهَا قَالَ فَغَدَا عَلَيْهَا فَاعْتَرَفَتْ فَرَجَمَهَا قَالَ الْحُمَيْدِيُّ قَالَ سُفْيَانُ وَأُنَيْسٌ رَجُلٌ مِنْ أَسْلَمَ هَذَا لَفْظُ حَدِيثِ الْحُمَيْدِيِّ
[Machine] It is not accepted by his words, and he made her repeat it several times in order to withdraw from it, but she refused to withdraw and remained steadfast in her confession. Umar ibn al-Khattab commanded her, so she was stoned to death. Al-Shafi'i said in the book that he did not say, "Inform me, bring her." Indeed, Uthman ibn Affan commanded the stoning of a woman, and she was stoned to death, although she did not testify against herself. Abu Ahmad al-Miharjani informed us, Abu Bakr ibn Ja'far informed us, Muhammad ibn Ibrahim informed us, Ibn Bukayr informed us, Malik informed us that it reached him that Uthman ibn Affan was brought a woman, and he mentioned the hadith regarding his ordering her stoning, and it was found that she had already been stoned.
أَنَّهَا لَا تُؤْخَذُ بِقَوْلِهِ وَجَعَلَ يُلَقِّنُهَا أَشْبَاهَ ذَلِكَ لِتَنْزِعَ فَأَبَتْ أَنْ تَنْزِعَ وَثَبَتَتْ عَلَى الِاعْتِرَافِ فَأَمَرَ بِهَا عُمَرُ بْنُ الْخَطَّابِ ؓ فَرُجِمَتْ قَالَ الشَّافِعِيُّ فِي الْكِتَابِ وَلَمْ يَقُلْ أَعْلِمْنِي أَحْضِرْهَا وَلَقَدْ أَمَرَ عُثْمَانُ بْنُ عَفَّانَ ؓ بِرَجْمِ امْرَأَةٍ فَرُجِمَتْ وَمَا حَضَرَهَا 16961 أَخْبَرَنَاهُ أَبُو أَحْمَدَ الْمِهْرَجَانِيُّ أَنْبَأَ أَبُو بَكْرِ بْنُ جَعْفَرٍ ثنا مُحَمَّدُ بْنُ إِبْرَاهِيمَ ثنا ابْنُ بُكَيْرٍ ثنا مَالِكٌ أَنَّهُ بَلَغَهُ أَنَّ عُثْمَانَ بْنَ عَفَّانَ ؓ أُتِيَ بِامْرَأَةٍ فَذَكَرَ الْحَدِيثَ فِي أَمْرِهِ بِرَجْمِهَا وَأَنَّهُ أَمَرَ بِرَدِّهَا فَوُجِدَتْ قَدْ رُجِمَتْ
55.11 [Machine] Who considers the presence of the imam and the witnesses, and the beginning of the imam with stoning when adultery is established by the confession of the stoned, and the beginning of the witnesses with their testimony when it is established by their testimony.
٥٥۔١١ بَابُ مَنِ اعْتَبَرَ حُضُورَ الْإِمَامِ وَالشُّهُودِ، وَبِدَايَةَ الْإِمَامِ بِالرَّجْمِ إِذَا ثَبَتَ الزِّنَا بِاعْتِرَافِ الْمَرْجُومِ، وَبِدَايَةَ الشُّهُودِ بِهِ إِذَا ثَبَتَ بِشَهَادَتِهِمْ
[Machine] Ali came with a woman from Bishara in al-Hamdaniyah, and he had intercourse with her until she gave birth. When she gave birth, he said, "Bring me the closest women to her." So he gave her child to her and then he beat and stoned her. He said, "I beat her according to the Book of Allah and stoned her according to the Sunnah." Then he said, "Whichever woman has her child blamed on her or if there is an accusation, the Imam is the first to stone, then the people. But if the witnesses testify against her, then the witnesses are the first to stone, then the Imam, then the people."
أُتِيَ عَلِيٌّ ؓ بِشَرَاحَةَ الْهَمْدَانِيَّةِ قَدْ فَجَرَتْ فَرَدَّهَا حَتَّى وَلَدَتْ فَلَمَّا وَلَدَتْ قَالَ ائْتُونِي بِأَقْرَبِ النِّسَاءِ مِنْهَا فَأَعْطَاهَا وَلَدَهَا ثُمَّ جَلَدَهَا وَرَجَمَهَا ثُمَّ قَالَ جَلَدْتُهَا بِكِتَابِ اللهِ وَرَجَمْتُهَا بِالسُّنَّةِ ثُمَّ قَالَ أَيُّمَا امْرَأَةٍ نَعَى عَلَيْهَا وَلَدُهَا أَوْ كَانَ اعْتِرَافٌ فَالْإِمَامُ أَوَّلُ مَنْ يَرْجُمُ ثُمَّ النَّاسُ فَإِنْ نَعَاهَا الشُّهُودُ فَالشُّهُودُ أَوَّلُ مَنْ يَرْجُمُ ثُمَّ الْإِمَامُ ثُمَّ النَّاسُ
[Machine] "So, he commanded that she be confined, and when she gave birth to what was in her womb, he brought her out on Thursday and he struck her a hundred times. Then on Friday, he dug a pit in the open field for her and the people surrounded her, taking stones. He said, 'This is not how stoning is done. If this were the case, you would harm each other. Line up like the lines of prayer, one row behind another.' Then he said, 'O people, if a woman is brought forth with her child and there is a rope with her, meaning that she confessed, then the Imam is the first one to stone, followed by the people. And if a woman is brought forth or a man who committed adultery, and four witnesses testify against him, then the witnesses stone first, followed by the Imam, then the people, and then he ordered them and they stoned her. They formed a row, then another row, and he said, 'Treat her as you would treat your dead.' The scholar may Allah have mercy on him said, 'We mentioned that the punishment of flogging for the married adulterer has been abrogated, and the ruling has been changed to stoning.'"
فَأَمَرَ بِهَا فَحُبِسَتْ فَلَمَّا وَضَعَتْ مَا فِي بَطْنِهَا أَخْرَجَهَا يَوْمَ الْخَمِيسِ فَضَرَبَهَا مِائَةً وَحَفَرَ لَهَا يَوْمَ الْجُمُعَةِ فِي الرَّحَبَةِ وَأَحَاطَ النَّاسُ بِهَا وَأَخَذُوا الْحِجَارَةَ فَقَالَ لَيْسَ هَكَذَا الرَّجْمُ إِذًا يُصِيبُ بَعْضُكُمْ بَعْضًا صُفُّوا كَصَفِّ الصَّلَاةِ صَفًّا خَلْفَ صَفٍّ ثُمَّ قَالَ أَيُّهَا النَّاسُ أَيُّمَا امْرَأَةٍ جِيءَ بِهَا وَبِهَا حَبَلٌ يَعْنِي أَوِ اعْتَرَفَتْ فَالْإِمَامُ أَوَّلُ مَنْ يَرْجُمُ ثُمَّ النَّاسُ وَأَيُّمَا امْرَأَةٍ جِيءَ بِهَا أَوْ رَجُلٍ زَانٍ فَشَهِدَ عَلَيْهِ أَرْبَعَةٌ بِالزِّنَا فَالشُّهُودُ أَوَّلُ مَنْ يَرْجُمُ ثُمَّ الْإِمَامُ ثُمَّ النَّاسُ ثُمَّ رَجَمَهَا ثُمَّ أَمَرَهُمْ فَرَجَمَ صَفٌّ ثُمَّ صَفٌّ ثُمَّ قَالَ افْعَلُوا بِهَا مَا تَفْعَلُونَ بِمَوْتَاكُمْ قَالَ الشَّيْخُ رَحِمَهُ اللهُ قَدْ ذَكَرْنَا أَنَّ جَلْدَ الثَّيِّبِ صَارَ مَنْسُوخًا وَأَنَّ الْأَمْرَ صَارَ إِلَى الرَّجْمِ فَقَطْ
55.12 [Machine] What was mentioned in the Hadith of Al-Murjom and Al-Murjumah?
٥٥۔١٢ بَابُ مَا جَاءَ فِي حَفْرِ الْمَرْجُومِ وَالْمَرْجُومَةِ
[Machine] When the Prophet ﷺ commanded us to stone Ma'iz ibn Malik, we took him to Al-Baqi'. By Allah, we did not dig a pit for him or tie him up. Rather, he stood up for us and we threw stones at him with bones and pottery. He complained, and he came out limping until he stood in the middle of the open area. We continued to stone him with pebbles until the saying of Ahmad ibn Hanbal stopped.
لَمَّا أَمَرَنَا النَّبِيُّ ﷺ أَنْ نَرْجُمَ مَاعِزَ بْنَ مَالِكٍ خَرَجْنَا بِهِ إِلَى الْبَقِيعِ فَوَاللهِ مَا حَفَرْنَا لَهُ وَلَا أَوْثَقْنَاهُ وَلَكِنَّهُ قَامَ لَنَا فَرَمَيْنَاهُ بِالْعِظَامِ وَالْخَزَفِ فَاشْتَكَى فَخَرَجَ يَشْتَدُّ حَتَّى انْتَصَبَ لَنَا فِي عُرْضِ الْحَرَّةِ فَرَمَيْنَاهُ بِجَلَامِيدِ الْجَنْدَلِ حَتَّى سَكَتَ لَفْظُ حَدِيثِ أَحْمَدَ بْنِ حَنْبَلٍ
[Machine] He was a prophet of Allah ﷺ. He went back and when it was the next day, he came to him again and confessed to him about adultery. The Prophet of Allah ﷺ said to him, "O Prophet of Allah, purify me." The Prophet of Allah ﷺ told him to go back and then sent to his people and asked them about him. He said, "Do you know Ma'iz ibn Malik? Do you see any harm from him or do you see anything wrong with his mind?" They said, "O Prophet of Allah, we do not see any harm from him and we do not see anything wrong with his mind." So he came to him again on the third day and said, "O Prophet of Allah, purify me, for I have committed adultery." The Prophet of Allah ﷺ then sent to his people and asked them about him as he had asked them before. They said, "O Messenger of Allah, we do not see anything wrong with his mind and we do not see any harm from him." So the Prophet of Allah ﷺ commanded that a pit be dug for him and he was buried in it up to his chest. Then the people were commanded to stone him.
لَهُ نَبِيُّ اللهِ ﷺ ارْجِعْ فَلَمَّا كَانَ مِنَ الْغَدِ أَتَاهُ أَيْضًا فَاعْتَرَفَ عِنْدَهُ بِالزِّنَا فَقَالَ يَا نَبِيَّ اللهِ طَهِّرْنِي فَقَالَ لَهُ نَبِيُّ اللهِ ﷺ ارْجِعْ ثُمَّ أَرْسَلَ إِلَى قَوْمِهِ فَسَأَلَهُمْ عَنْهُ فَقَالَ هَلْ تَعْلَمُونَ مَاعِزَ بْنَ مَالِكٍ هَلْ تَرَوْنَ بِهِ بَأْسًا أَوْ تُنْكِرُونَ مِنْ عَقْلِهِ شَيْئًا؟ قَالُوا يَا نَبِيَّ اللهِ مَا نَرَى بِهِ بَأْسًا وَلَا نُنْكِرُ مِنْ عَقْلِهِ شَيْئًا فَأَتَاهُ مِنَ الْغَدِ الثَّالِثَةَ فَقَالَ يَا نَبِيَّ اللهِ طَهِّرْنِي فَإِنِّي قَدْ زَنَيْتُ قَالَ فَأَرْسَلَ نَبِيُّ اللهِ ﷺ إِلَى قَوْمِهِ فَسَأَلَهُمْ عَنْهُ كَمَا سَأَلَهُمْ فِي الْمَرَّةِ الْأُولَى فَقَالُوا يَا رَسُولَ اللهِ مَا نُنْكِرُ مِنْ عَقْلِهِ شَيْئًا وَلَا نَرَى بِهِ بَأْسًا فَأَمَرَ نَبِيُّ اللهِ ﷺ فَحُفِرَ لَهُ حُفْرَةٌ فَجُعِلَ فِيهَا إِلَى صَدْرِهِ ثُمَّ أَمَرَ النَّاسَ أَنْ يَرْجُمُوهُ
[Machine] I was sitting with the Prophet of Allah ﷺ when a woman from the tribe of Ghamed came to him and said, "O Prophet of Allah, purify me, for I have committed adultery." The Prophet of Allah ﷺ told her to go back. The next day, she came to him and confessed her sin again, saying, "O Messenger of Allah, purify me, for perhaps you will turn me away as you turned away Ibn Malik Al-Aslami." She was pregnant at the time. The Prophet of Allah ﷺ told her to go back until she gives birth. When she gave birth, she came to him, carrying the baby wrapped in a cloth and said, "O Messenger of Allah, I have given birth." He told her to go and breastfeed the baby until he is weaned. After she weaned the baby, she came to him holding a piece of bread in his hand and said, "O Messenger of Allah, he has been weaned, this is what he eats." The Prophet of Allah ﷺ ordered that the baby be given to a Muslim man, then he ordered a hole to be dug for her, and she was put in it up to her chest. Then he commanded the people to stone her. Khaled bin Al-Walid came forward with a stone and struck her on the head. She bled on Khalid's face, and he cursed her. The Prophet of Allah ﷺ heard him cursing her and said, "Hold on, O Khaled bin Al-Walid, do not curse her. By the One in Whose hand is my soul, she has repented with a repentance that if the sin of Ma'iz bin Malik had repented with, he would have been forgiven." Then he ordered for her to be prayed upon and buried.
كُنْتُ جَالِسًا عِنْدَ نَبِيِّ اللهِ ﷺ فَجَاءَتْهُ امْرَأَةٌ مِنْ غَامِدٍ فَقَالَتْ يَا نَبِيَّ اللهِ طَهِّرْنِي فَإِنِّي قَدْ زَنَيْتُ فَقَالَ لَهَا نَبِيُّ اللهِ ﷺ ارْجِعِي فَلَمَّا كَانَ مِنَ الْغَدِ أَيْضًا اعْتَرَفَتْ عِنْدَهُ بِالزِّنَا فَقَالَتْ يَا رَسُولَ اللهِ طَهِّرْنِي فَلَعَلَّكَ أَنْ تَرْدُدَنِي كَمَا رَدَدْتَ ابْنَ مَالِكٍ الْأَسْلَمِيَّ فَوَاللهِ إِنِّي لَحُبْلَى فَقَالَ لَهَا رَسُولُ اللهِ ﷺ ارْجِعِي حَتَّى تَلِدِي فَلَمَّا وَلَدَتْهُ جَاءَتْهُ بِالصَّبِيِّ تَحْمِلُهُ فِي خِرْقَةٍ قَالَتْ يَا نَبِيَّ اللهِ هَذَا قَدْ وَلَدْتُ فَقَالَ لَهَا نَبِيُّ اللهِ ﷺ اذْهَبِي فَأَرْضِعِيهِ حَتَّى تَفْطِمِيهِ فَلَمَّا فَطَمَتْهُ جَاءَتْ بِالصَّبِيِّ فِي يَدِهِ كِسْرَةُ خُبْزٍ فَقَالَتْ يَا نَبِيَّ اللهِ هَذَا قَدْ فَطَمْتُهُ هَذَا هُوَ يَأْكُلُ فَأَمَرَ نَبِيُّ اللهِ ﷺ بِدَفْعِهِ إِلَى رَجُلٍ مِنَ الْمُسْلِمِينَ ثُمَّ أَمَرَ بِهَا فَحُفِرَ لَهَا حُفْرَةٌ فَجُعِلَتْ فِيهَا إِلَى صَدْرِهَا ثُمَّ أَمَرَ النَّاسَ أَنْ يَرْجُمُوهَا فَأَقْبَلَ خَالِدُ بْنُ الْوَلِيدِ يَعْنِي بِحَجَرٍ فَرَمَى رَأْسَهَا فَتَنَضَّخَ عَلَى وَجْنَةِ خَالِدٍ فَسَبَّهَا فَسَمِعَ نَبِيُّ اللهِ ﷺ سَبَّهُ إِيَّاهَا فَقَالَ مَهْلًا يَا خَالِدُ بْنَ الْوَلِيدِ لَا تَسُبَّهَا فَوَالَّذِي نَفْسِي بِيَدِهِ لَقَدْ تَابَتْ تَوْبَةً لَوْ تَابَهَا صَاحِبُ مَكْسٍ لَغُفِرَ لَهُ فَأَمَرَ بِهَا فَصَلَّى عَلَيْهَا وَدُفِنَتْ
[Machine] "That the Prophet ﷺ stoned a woman and a grave was dug for her up to her chest. Abu Dawud said: I was informed by Abdus Samad ibn Abdil Warith, narrating from Zakariya bin Sulaiman through his chain of narration similar to it. He continues: Then he (the Prophet ﷺ) threw stones at her with stones similar to chickpeas. Then he said: Stone her and be cautious about hitting her face. When her punishment was completed, he took her out and prayed for her. And he said regarding repentance similar to the hadith of Buraydah."
أَنَّ النَّبِيَّ ﷺ رَجَمَ امْرَأَةً فَحُفِرَ لَهَا إِلَى الثَّنْدُوَةِ قَالَ أَبُو دَاوُدَ حُدِّثْتُ عَنْ عَبْدِ الصَّمَدِ بْنِ عَبْدِ الْوَارِثِ ثنا زَكَرِيَّا بْنُ سُلَيْمَانَ بِإِسْنَادِهِ نَحْوَهُ زَادَ ثُمَّ رَمَاهَا بِحَصَاةٍ مِثْلَ الْحِمِّصَةِ ثُمَّ قَالَ ارْمُوا وَاتَّقُوا الْوَجْهَ فَلَمَّا طُفِئَتْ أَخْرَجَهَا فَصَلَّى عَلَيْهَا وَقَالَ فِي التَّوْبَةِ نَحْوَ حَدِيثِ بُرَيْدَةَ
55.13 [Machine] What is mentioned in the denial of the virgin?
٥٥۔١٣ بَابُ مَا جَاءَ فِي نَفْيِ الْبِكْرِ
[Machine] The Messenger of Allah ﷺ said, "Take from me: Allah has prescribed a way for them. For the virgin, the punishment is one hundred lashes and one year of exile. And for the married adulterer, the punishment is one hundred lashes. This stoning punishment is the narration of Yahya and in the narration of Amr and Tughriq."
قَالَ رَسُولُ اللهِ ﷺ خُذُوا عَنِّي قَدْ جَعَلَ اللهُ لَهُنَّ سَبِيلًا الْبِكْرُ بِالْبِكْرِ جَلْدُ مِائَةٍ وَنَفْيُ سَنَةٍ وَالثَّيِّبُ بِالثَّيِّبِ جَلْدُ مِائَةٍ وَالرَّجْمُ هَذَا حَدِيثُ يَحْيَى وَفِي رِوَايَةِ عَمْرٍو وَتَغْرِيبُ عَامٍ
[Machine] Abu Huraira, Zaid bin Khalid al-Juhani, and Shibl said, "We were with the Prophet ﷺ when a man came to him and said, 'I adjure you by Allah, do not judge between us except according to the Book of Allah and allow me to speak first.' The Prophet ﷺ said, 'Say your statement.' The man said, 'My son was a shepherd for this man's wife and he committed adultery with her. I redeemed myself from him by giving him a hundred sheep and a servant. Then I asked some knowledgeable people who informed me that he should be punished with a hundred lashes and one year of exile, and that his wife should be stoned to death.' The Messenger of Allah ﷺ said, 'By the One in Whose hand is my soul, I will judge between you according to the Book of Allah. The hundred sheep and the servant are to be returned to you, and your son is to be punished with a hundred lashes and one year of exile. And you, O Unays, go and announce that if the wife of this man admits (to the adultery), then stone her.' So Unays went and announced this, and the wife admitted (to the adultery), so he stoned her.' Sufyan and Unays both said, 'Unays was a man who had embraced Islam.'
عَنْ أَبِي هُرَيْرَةَ وَزَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ وَشِبْلٍ قَالُوا كُنَّا عِنْدَ النَّبِيِّ ﷺ فَقَامَ إِلَيْهِ رَجُلٌ فَقَالَ أَنْشُدُكَ اللهَ إِلَّا قَضَيْتَ بَيْنَنَا بِكِتَابِ اللهِ وَأْذَنْ لِي قَالَ قُلْ قَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا فَزَنَى بِامْرَأَتِهِ فَافْتَدَيْتُ مِنْهُ بِمِائَةِ شَاةٍ وَخَادِمٍ ثُمَّ سَأَلْتُ رِجَالًا مِنْ أَهْلِ الْعِلْمِ فَأَخْبَرُونِي أَنَّ عَلَيْهِ جَلْدَ مِائَةٍ وَتَغْرِيبَ عَامٍ وَأَنَّ عَلَى امْرَأَةِ هَذَا الرَّجْمَ فَقَالَ رَسُولُ اللهِ ﷺ وَالَّذِي نَفْسِي بِيَدِهِ لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللهِ ﷻ الْمِائَةُ شَاةٍ وَالْخَادِمُ رَدٌّ عَلَيْكَ وَعَلَى ابْنِكَ جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ وَاحِدٍ وَاغْدُ يَا أُنَيْسُ عَلَى امْرَأَةِ هَذَا فَإِنِ اعْتَرَفَتْ فَارْجُمْهَا فَغَدَا عَلَيْهَا فَاعْتَرَفَتْ فَرَجَمَهَا قَالَ سُفْيَانُ وَأُنَيْسٌ رَجُلٌ مِنْ أَسْلَمَ
[Machine] I heard the Messenger of Allah ﷺ ordering the punishment of one who commits adultery and is not married, which is one hundred lashes and one year of banishment. This is the narration of Abdullah, and in the narration of At-Tayalisi, I witnessed it being decreed for one who commits adultery.
سَمِعْتُ رَسُولَ اللهِ ﷺ يَأْمُرُ فِيمَنْ زَنَى وَلَمْ يُحْصِنْ بِجَلْدِ مِائَةٍ وَتَغْرِيبِ عَامٍ لَفْظُ حَدِيثِ عَبْدِ الرَّحْمَنِ وَفِي رِوَايَةِ الطَّيَالِسِيِّ شَهِدْتُهُ قَضَى فِيمَنْ زَنَى
[Machine] The Messenger of Allah ﷺ said regarding a person who commits adultery without being married, they are to be exiled from Medina for one year, with the punishment imposed upon them. Ibn Shihab stated that Umar used to exile them from Medina to Basra and Khaybar.
عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ قَالَ فِيمَنْ زَنَى وَلَمْ يُحْصِنْ يُنْفَى عَامًا مِنَ الْمَدِينَةِ مَعَ إِقَامَةِ الْحَدِّ عَلَيْهِ قَالَ ابْنُ شِهَابٍ وَكَانَ عُمَرُ ؓ يَنْفِي مِنَ الْمَدِينَةِ إِلَى الْبَصْرَةِ وَإِلَى خَيْبَرَ
[Machine] While Abu Bakr was in the mosque, a man approached him and spoke to him in an offensive manner, which surprised him. Abu Bakr said to Umar, "Go to him and see what his matter is, for he seems to have some issue." Umar went to him and found out that he had lost his way and ended up at Abu Bakr's daughter's house. Umar got angry and hit him in the chest, saying, "May Allah disgrace you! Didn't you have any shame in looking at Abu Bakr's daughter?" Abu Bakr ordered them both to be punished, and they were both given the prescribed punishment. Then, one of them got married to the other, and Abu Bakr ordered them to be exiled for a year or so. Ali said, "This is how it happened."
بَيْنَمَا أَبُو بَكْرٍ ؓ فِي الْمَسْجِدِ جَاءَهُ رَجُلٌ فَلَاثَ عَلَيْهِ بِلَوْثٍ مِنْ كَلَامٍ وَهُوَ دَهِشٌ فَقَالَ أَبُو بَكْرٍ لِعُمَرَ ؓ قُمْ إِلَيْهِ فَانْظُرْ فِي شَأْنِهِ فَإِنَّ لَهُ شَأْنًا فَقَامَ إِلَيْهِ عُمَرُ ؓ قَالَ إِنَّهُ ضَافَهُ ضَيْفٌ فَوَقَعَ بِابْنَتِهِ فَصَكَّ عُمَرُ ؓ فِي صَدْرِهِ وَقَالَ قَبَّحَكَ اللهُ أَلَا سَتَرْتَ عَلَى ابْنَتِكَ قَالَ فَأَمَرَ بِهِمَا أَبُو بَكْرٍ ؓ فَضُرِبَا الْحَدَّ ثُمَّ تَزَوَّجَ أَحَدُهُمَا مِنَ الْآخَرِ وَأَمَرَ بِهِمَا فَغُرِّبَا عَامًا أَوْ حَوْلًا قَالَ عَلِيٌّ هَكَذَا
[Machine] A man added another man, so he married his sister. Her brother went to Abu Bakr as-Siddiq and mentioned the matter to him, so he sent for him and he confessed to it. Abu Bakr said: Is it Abkar or Thayyib? He said: Abkar. So he lashed him a hundred times and banished him to Fadak. He said: Then, the man married the woman afterwards. He said: Then, the man was killed on the day of Yamamah. Ahmad said: and it means...
أَنَّ رَجُلًا أَضَافَ رَجُلًا فَافْتَضَّ أُخْتَهُ فَجَاءَ أَخُوهَا إِلَى أَبِي بَكْرٍ الصِّدِّيقِ ؓ فَذَكَرَ ذَلِكَ لَهُ فَأَرْسَلَ إِلَيْهِ فَأَقَرَّ بِهِ فَقَالَ أَبِكْرٌ أَمْ ثَيِّبٌ؟ قَالَ بِكْرٌ فَجَلَدَهُ مِائَةً وَنَفَاهُ إِلَى فَدَكَ قَالَ ثُمَّ إِنَّ الرَّجُلَ تَزَوَّجَ الْمَرْأَةَ بَعْدُ قَالَ ثُمَّ قُتِلَ الرَّجُلُ يَوْمَ الْيَمَامَةِ قَالَ أَحْمَدُ وَبِمَعْنَاهُ
[Machine] Abu Bakr Al-Siddiq was informed that a man had committed adultery with a virgin girl and made her pregnant. The man confessed to his wrongdoing, admitting that he was not married. Abu Bakr ordered that he be punished with the prescribed punishment (lashings) and then exiled to Fadak (a place in Arabia). This incident was narrated by Shu'ayb ibn Abi Hamzah from Nafi', who said that Safiyyah bint Abi 'Ubaid informed me about Abu Bakr Al-Siddiq that he had flogged and exiled him for a year. Abu Al-Husayn bin Bishran narrated it to us, who was informed by Ismail Al-Saffar, who narrated it from Abd Al-Karim bin Al-Haytham, who narrated it from Abu Al-Yaman, who narrated it from Shu'ayb, who said: Nafi' mentioned this incident. Abdullah bin Idris also narrated it from Ubaidullah bin Umar.
أَنَّ أَبَا بَكْرٍ الصِّدِّيقَ ؓ أُتِيَ بِرَجُلٍ وَقَعَ عَلَى جَارِيَةٍ بِكْرٍ فَأَحْبَلَهَا ثُمَّ اعْتَرَفَ عَلَى نَفْسِهِ أَنَّهُ زَنَى وَلَمْ يَكُنْ أُحْصِنَ فَأَمَرَ بِهِ أَبُو بَكْرٍ ؓ فَجُلِدَ الْحَدَّ ثُمَّ نُفِيَ إِلَى فَدَكَ 16976 وَرَوَاهُ شُعَيْبُ بْنُ أَبِي حَمْزَةَ عَنْ نَافِعٍ قَالَ أَخْبَرَتْنِي صَفِيَّةُ بِنْتُ أَبِي عُبَيْدٍ عَنْ أَبِي بَكْرٍ الصِّدِّيقِ ؓ أَنَّهُ جَلَدَهُ وَنَفَاهُ عَامًا أَخْبَرَنَاهُ أَبُو الْحُسَيْنِ بْنُ بِشْرَانَ أنبأ إِسْمَاعِيلُ الصَّفَّارُ ثنا عَبْدُ الْكَرِيمِ بْنُ الْهَيْثَمِ ثنا أَبُو الْيَمَانِ ثنا شُعَيْبٌ قَالَ قَالَ نَافِعٌ فَذَكَرَهُ وَرَوَاهُ عَبْدُ اللهِ بْنُ إِدْرِيسَ عَنْ عُبَيْدِ اللهِ بْنِ عُمَرَ
[Machine] That the Prophet ﷺ traveled and emigrated, and that Abu Bakr traveled and emigrated, and that Umar traveled and emigrated.
أَنَّ النَّبِيَّ ﷺ ضَرَبَ وَغَرَّبَ وَأَنَّ أَبَا بَكْرٍ ؓ ضَرَبَ وَغَرَّبَ وَأَنَّ عُمَرَ ؓ ضَرَبَ وَغَرَّبَ
وَأَنَّ عُمَرَ ؓ ضَرَبَ وَغَرَّبَ
[Machine] Ali was whipped and exiled from Basra to Kufa, or it is said from Kufa to Basra.
أَنَّ عَلِيًّا ؓ جَلَدَ وَنَفَى مِنَ الْبَصْرَةِ إِلَى الْكُوفَةِ أَوْ قَالَ مِنَ الْكُوفَةِ إِلَى الْبَصْرَةِ
[Machine] The two unmarried individuals shall be lashed and exiled, while the two married individuals shall be stoned.
الْبِكْرَانِ يُجْلَدَانِ وَيُنْفَيَانِ وَالثَّيِّبَانِ يُرْجَمَانِ
55.14 [Machine] What is mentioned in the denial of effeminate men?
٥٥۔١٤ بَابُ مَا جَاءَ فِي نَفْيِ الْمُخَنَّثِينَ
[Machine] To Abdullah, my brother: If Allah grants you victory over Ta'if tomorrow, then I will guide you to the daughter of Ghaylan, for she accepts with four and considers with eight. The Messenger of Allah ﷺ heard his statement and said, "These people should not enter upon you."
لِعَبْدِ اللهِ أَخِي إِنْ فَتَحَ اللهُ عَلَيْكُمْ غَدًا الطَّائِفَ فَإِنِّي أَدُلُّكَ عَلَى ابْنَةِ غَيْلَانَ فَإِنَّهَا تُقْبِلُ بِأَرْبَعٍ وَتُدْبِرُ بِثَمَانٍ فَسَمِعَ رَسُولُ اللهِ ﷺ قَوْلَهُ فَقَالَ لَا يَدْخُلَنَّ هَؤُلَاءِ عَلَيْكُمْ
[Machine] The Prophet Muhammad entered upon me and I had a eunuch with me. He heard him say to Abdullah ibn Abi Umayyah, "O Abdullah, what if Allah grants victory over Ta'if tomorrow? Then you should take the daughter of Ghaylan, as she accepts with four and conceives with eight." The Prophet ﷺ said, "These [eunuchs] should not enter upon you." Sufyan said, "Ibn Abi Najeeh said, and his name is Hiyat."
دَخَلَ عَلَيَّ رَسُولُ اللهِ ﷺ وَعِنْدِي مُخَنَّثٌ فَسَمِعَهُ يَقُولُ لِعَبْدِ اللهِ بْنِ أَبِي أُمَيَّةَ يَا عَبْدَ اللهِ أَرَأَيْتَ إِنْ فَتَحَ اللهُ عَلَيْكُمُ الطَّائِفَ غَدًا فَعَلَيْكَ بِابْنَةِ غَيْلَانَ فَإِنَّهَا تُقْبِلُ بِأَرْبَعٍ وَتُدْبِرُ بِثَمَانٍ قَالَتْ فَقَالَ النَّبِيُّ ﷺ لَا يَدْخُلَنَّ هَؤُلَاءِ عَلَيْكُمْ قَالَ سُفْيَانُ قَالَ ابْنُ أَبِي نَجِيحٍ وَاسْمُهُ هِيتٌ
[Machine] The mukhannathun (effeminate males) during the time of the Messenger of Allah ﷺ were of three types: those who possessed desirable qualities, those who were demolished (their houses) and those who were confined. The one who possessed desirable qualities was Khawlah bint 'Amr ibn 'A'idh, the paternal aunt of the Messenger of Allah ﷺ . She used to enter the homes of the Prophet ﷺ and visit the women until the battle of Ta'if took place. The Messenger of Allah ﷺ heard of her and said to Khalid ibn Walid: "If Ta'if is conquered tomorrow, do not let Badi'ah bint Ghailan escape from you, as she accepts four and rejects eight." The Messenger of Allah ﷺ said: "I do not see this wickedness being prudent concerning this matter. After this, he should not enter upon his wives." Then the Messenger of Allah ﷺ set off, continuing his journey until he reached Dhul-Hulayfah, where he said: "They (mukhannathun) are not to enter Al-Madinah." The Messenger of Allah ﷺ entered Al-Madinah and stayed there, and it was said to him that there was a poor man who needed something. The Messenger of Allah ﷺ would go to him every Saturday and ask him (about his needs), then he would return to his home. This was the practice during the time of the Messenger of Allah ﷺ , Abu Bakr, and the time of 'Umar. The Messenger of Allah ﷺ banished both his companions (mukhannathun) along with him, and one was demolished while the other was confined.
الْمُخَنَّثُونَ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ ثَلَاثَةً مَاتِعٌ وَهَدْمٌ وَهِيتٌ وَكَانَ مَاتِعٌ لِفَاخِتَةَ بِنْتِ عَمْرِو بْنِ عَائِذٍ خَالَةِ رَسُولِ اللهِ ﷺ وَكَانَ يَغْشَى بُيُوتَ النَّبِيِّ ﷺ وَيَدْخُلُ عَلَيْهِنَّ حَتَّى إِذَا حَاصَرَ الطَّائِفَ سَمِعَهُ رَسُولُ اللهِ ﷺ وَهُوَ يَقُولُ لِخَالِدِ بْنِ الْوَلِيدِ إِنِ افْتُتِحَتِ الطَّائِفُ غَدًا فَلَا تَنْفَلِتَنَّ مِنْكَ بَادِيَةُ بِنْتُ غَيْلَانَ فَإِنَّهَا تُقْبِلُ بِأَرْبَعٍ وَتُدْبِرُ بِثَمَانٍ فَقَالَ رَسُولُ اللهِ ﷺ لَا أَرَى هَذَا الْخَبِيثَ يَفْطِنُ لِهَذَا لَا يَدْخُلُ عَلَيْكُنَّ بَعْدَ هَذَا لِنِسَائِهِ قَالَ ثُمَّ أَقْبَلَ رَسُولُ اللهِ ﷺ قَافِلًا حَتَّى إِذَا كَانَ بِذِي الْحُلَيْفَةِ قَالَ لَا يَدْخُلَنَّ الْمَدِينَةَ وَدَخَلَ رَسُولُ اللهِ ﷺ الْمَدِينَةَ فَكُلِّمَ فِيهِ وَقِيلَ لَهُ إِنَّهُ مِسْكِينٌ وَلَا بُدَّ لَهُ مِنْ شَيْءٍ فَجَعَلَ لَهُ رَسُولُ اللهِ ﷺ يَوْمًا فِي كُلِّ سَبْتٍ يَدْخُلُ فَيَسْأَلُ ثُمَّ يَرْجِعُ إِلَى مَنْزِلِهِ فَلَمْ يَزَلْ كَذَلِكَ عَهْدَ رَسُولِ اللهِ ﷺ وَأَبِي بَكْرٍ وَعَلَى عَهْدِ عُمَرَ ؓ وَنَفَى رَسُولُ اللهِ ﷺ صَاحِبَيْهِ مَعَهُ هَدْمٌ وَالْآخَرُ هِيتٌ
The Prophet (May peace be upon him) cursed effeminate men (mukhannathan) and women who imitated men, saying: Put them out of your houses, and put so-and-so out. (that is to say, the effeminate men) (Using translation from Abū Dāʾūd 4930)
أَنَّ النَّبِيَّ ﷺ لَعَنَ الْمُخَنَّثِينَ مِنَ الرِّجَالِ وَالْمُتَرَجِّلَاتِ مِنَ النِّسَاءِ وَقَالَ أَخْرِجُوهُمْ مِنْ بُيُوتِكُمْ وَأَخْرِجُوا فُلَانًا وَفُلَانًا يَعْنِي الْمُخَنَّثِينَ
[Machine] "That the Prophet ﷺ said, 'Expel the eunuchs (effeminate men) from your homes.' So the Messenger of Allah ﷺ expelled a eunuch, and Umar expelled a eunuch.'"
أَنَّ النَّبِيَّ ﷺ قَالَ أَخْرِجُوا الْمُخَنَّثِينَ مِنْ بُيُوتِكُمْ فَأَخْرَجَ رَسُولُ اللهِ ﷺ مُخَنَّثًا وَأَخْرَجَ عُمَرُ ؓ مُخَنَّثًا
[Machine] The Messenger of Allah commanded that a man from the mukhannatheen be expelled from the city, and Abu Bakr was also commanded to expel a man from among them.
أَمَرَ رَسُولُ اللهِ ﷺ بِرَجُلٍ مِنَ الْمُخَنَّثِينَ فَأُخْرِجَ عَنِ الْمَدِينَةِ وَأَمَرَ أَبُو بَكْرٍ ؓ بِرَجُلٍ مِنْهُمْ فَأُخْرِجَ أَيْضًا
Am effeminate man (mukhannath) who had dyed his hands and feet with henna was brought to the Prophet ﷺ. He asked: What is the matter with this man? He was told: "Messenger of Allah! He imitates the look of women." So he issued an order regarding him and he was banished to an-Naqi'. The people said: Messenger of Allah! Should we not kill him? He said: I have been prohibited from killing people who pray. AbuUsamah said: Naqi' is a region near Medina and not a Baqi'. (Using translation from Abū Dāʾūd 4928)
أَنَّ النَّبِيَّ ﷺ أُتِيَ بِمُخَنَّثٍ قَدْ خَضَبَ يَدَيْهِ وَرِجْلَيْهِ بِالْحِنَّاءِ فَقَالَ النَّبِيُّ ﷺ مَا بَالُ هَذَا؟ فَقِيلَ يَا رَسُولَ اللهِ يَتَشَبَّهُ بِالنِّسَاءِ فَأَمَرَ بِهِ فَنُفِيَ إِلَى النَّقِيعِ قَالُوا يَا رَسُولَ اللهِ أَلَا نَقْتُلُهُ؟ قَالَ إِنِّي نُهِيتُ عَنْ قَتْلِ الْمُصَلِّينَ قَالَ أَبُو أُسَامَةَ وَالنَّقِيعُ نَاحِيَةٌ عَنِ الْمَدِينَةِ وَلَيْسَ بِالْبَقِيعِ
55.15 [Machine] Setting the limit for someone who confesses to adultery once and it is proven.
٥٥۔١٥ بَابُ إِقَامَةِ الْحَدِّ عَلَى مَنِ اعْتَرَفَ بِالزِّنَا مَرَّةً وَثَبَتَ عَلَيْهَا
A bedouin came to Messenger of Allah ﷺ and said, "O Allah's apostle! I ask you by Allah to judge My case according to Allah's Laws." His opponent, who was more learned than he, said, "Yes, judge between us according to Allah's Laws, and allow me to speak." Messenger of Allah ﷺ said, "Speak." He (i .e. the bedouin or the other man) said, "My son was working as a laborer for this (man) and he committed illegal sexual intercourse with his wife. The people told me that it was obligatory that my son should be stoned to death, so in lieu of that I ransomed my son by paying one hundred sheep and a slave girl. Then I asked the religious scholars about it, and they informed me that my son must be lashed one hundred lashes, and be exiled for one year, and the wife of this (man) must be stoned to death." Messenger of Allah ﷺ said, "By Him in Whose Hands my soul is, I will judge between you according to Allah's Laws. The slave-girl and the sheep are to be returned to you, your son is to receive a hundred lashes and be exiled for one year. You, Unais, go to the wife of this (man) and if she confesses her guilt, stone her to death." Unais went to that woman next morning and she confessed. Messenger of Allah ﷺ ordered that she be stoned to death. (Using translation from Bukhārī 2724)
بَيْنَا نَحْنُ عِنْدَ رَسُولِ اللهِ ﷺ قَامَ إِلَيْهِ رَجُلٌ مِنَ الْأَعْرَابِ فَقَالَ يَا رَسُولَ اللهِ اقْضِ لِي بِكِتَابِ اللهِ فَقَامَ خَصْمُهُ فَقَالَ صَدَقَ يَا رَسُولَ اللهِ اقْضِ لَهُ بِكِتَابِ اللهِ وَأْذَنْ لِي فَقَالَ لَهُ رَسُولُ اللهِ ﷺ قُلْ فَقَالَ إن ابْنِي كَانَ عَسِيفًا عَلَى هَذَا وَالْعَسِيفُ الْأَجِيرُ فَزَنَى بِامْرَأَتِهِ فَأَخْبَرَونِي أَنَّ عَلَى ابْنِي الرَّجْمَ فَافْتَدَيْتُ مِنْهُ بِمِائَةٍ مِنَ الْغَنَمِ وَوَلِيدَةٍ ثُمَّ سَأَلْتُ أَهْلَ الْعِلْمِ فَأَخْبَرُونِي أَنَّ عَلَى امْرَأَتِهِ الرَّجْمَ وَإِنَّمَا عَلَى ابْنِي جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ فَقَالَ رَسُولُ اللهِ ﷺ وَالَّذِي نَفْسِي بِيَدِهِ لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللهِ أَمَّا الْوَلِيدَةُ وَالْغَنَمُ فَرُدُّوهَا وَأَمَّا ابْنُكَ فَعَلَيْهِ جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ وَأَمَّا أَنْتَ يَا أُنَيْسُ لِرَجُلٍ مِنْ أَسْلَمَ فَاغْدُ عَلَى امْرَأَةِ هَذَا فَإِنِ اعْتَرَفَتْ فَارْجُمْهَا فَغَدَا عَلَيْهَا أُنَيْسٌ فَاعْتَرَفَتْ فَرَجَمَهَا
A woman belonging to the tribe of Juhaynah (according to the version of Aban) came to the Prophet ﷺ and said that she had committed fornication and that she was pregnant. The Messenger of Allah ﷺ called her guardian. Then the Messenger of Allah ﷺ said to him: Be good to her, and when she bears a child, bring her (to me). When she gave birth to the child, he brought her (to him). The Prophet ﷺ gave orders regarding her, and her clothes were tied to her. He then commanded regarding her and she was stoned to death. He commanded the people (to pray) and they prayed over her. Thereupon Umar said: Are you praying over her, Messenger of Allah, when she has committed fornication? He said: By Him in Whose hand my soul is, she has repented to such an extent that if it were divided among the seventy people of Medina, it would have been enough for them all. And what do you find better than the fact that she gave her life. Aban did not say in his version: Then her clothes were tied to her. (Using translation from Abū Dāʾūd 4440)
أَنَّ امْرَأَةً أَتَتِ النَّبِيَّ ﷺ فَقَالَتْ إِنَّهَا زَنَتْ وَهِيَ حُبْلَى فَدَعَا النَّبِيُّ ﷺ وَلِيَّهَا فَقَالَ أَحْسِنْ إِلَيْهَا فَإِذَا وَضَعَتْ فَجِئْ بِهَا فَلَمَّا أَنْ وَضَعَتْ جَاءَتْ فَأَمَرَ بِهَا النَّبِيُّ ﷺ فَشُدَّتْ عَلَيْهَا ثِيَابُهَا ثُمَّ أَمَرَ بِهَا فَرُجِمَتْ ثُمَّ أَمَرَهُمْ فَصَلَّوْا عَلَيْهَا ثُمَّ دَفَنُوهَا فَقَالَ عُمَرُ بْنُ الْخَطَّابِ ؓ يَا رَسُولَ اللهِ تُصَلِّي عَلَيْهَا وَقَدْ زَنَتْ؟ فَقَالَ وَالَّذِي نَفْسِي بِيَدِهِ لَقَدْ تَابَتْ تَوْبَةً لَوْ قُسِمَتْ بَيْنَ سَبْعِينَ مِنْ أَهْلِ الْمَدِينَةِ لَوَسِعَتْهُمْ وَهَلْ وَجَدْتَ أَفْضَلَ مِنْ أَنْ جَادَتْ بِنَفْسِهَا
55.16 [Machine] Who said: He is not subjected to punishment until he confesses four times.
٥٥۔١٦ بَابُ مَنْ قَالَ: لَا يُقَامُ عَلَيْهِ الْحَدُّ حَتَّى يَعْتَرِفَ أَرْبَعَ مَرَّاتٍ
A man from Bani Aslam came to Messenger of Allah ﷺ while he was in the mosque and called (the Prophet ﷺ ) saying, "O Messenger of Allah ﷺ! I have committed illegal sexual intercourse." On that the Prophet ﷺ turned his face from him to the other side, whereupon the man moved to the side towards which the Prophet ﷺ had turned his face, and said, "O Messenger of Allah ﷺ! I have committed illegal sexual intercourse." The Prophet turned his face (from him) to the other side whereupon the man moved to the side towards which the Prophet ﷺ had turned his face, and repeated his statement. The Prophet ﷺ turned his face (from him) to the other side again. The man moved again (and repeated his statement) for the fourth time. So when the man had given witness four times against himself, the Prophet ﷺ called him and said, "Are you insane?" He replied, "No." The Prophet ﷺ then said (to his companions), "Go and stone him to death." The man was a married one. Jabir bin ʿAbdullah Al-Ansari said: I was one of those who stoned him. We stoned him at the Musalla (ʿId praying place) in Medina. When the stones hit him with their sharp edges, he fled, but we caught him at Al-Harra and stoned him till he died. أَتَى رَسُولُ اللهِ ﷺ رَجُلٌ مِنَ النَّاسِ وَهُوَ فِي الْمَسْجِدِ فَنَادَاهُ يَا رَسُولَ اللهِ إِنِّي زَنَيْتُ يُرِيدُ نَفْسَهُ فَأَعْرَضَ عَنْهُ النَّبِيُّ ﷺ فَتَنَحَّى لِشِقِّ وَجْهِهِ الَّذِي أَعْرَضَ قِبَلَهُ فَقَالَ يَا رَسُولَ اللهِ إِنِّي زَنَيْتُ فَأَعْرَضَ عَنْهُ فَجَاءَ لِشِقِّ وَجْهِ النَّبِيِّ ﷺ الَّذِي أَعْرَضَ عَنْهُ فَلَمَّا شَهِدَ عَلَى نَفْسِهِ أَرْبَعَ شَهَادَاتٍ دَعَاهُ النَّبِيُّ ﷺ فَقَالَ أَبِكَ جُنُونٌ؟ فَقَالَ لَا يَا رَسُولَ اللهِ فَقَالَ أَحْصَنْتَ؟ قَالَ نَعَمْ يَا رَسُولَ اللهِ قَالَ اذْهَبُوا فَارْجُمُوهُ قَالَ ابْنُ شِهَابٍ أَخْبَرَنِي مَنْ سَمِعَ جَابِرًا قَالَ فَكُنْتُ فِيمَنْ رَجَمَهُ فَرَجَمْنَاهُ بِالْمُصَلَّى فَلَمَّا أَذْلَقَتْهُ الْحِجَارَةُ جَمَزَ حَتَّى أَدْرَكْنَاهُ بِالْحَرَّةِ فَرَجَمْنَاهُ
A man from the tribe of Bani Aslam came to Messenger of Allah ﷺ and Informed him that he had committed illegal sexual intercourse and bore witness four times against himself. Messenger of Allah ﷺ ordered him to be stoned to death as he was a married Person. (Using translation from Bukhārī 6814)
أَنَّ رَجُلًا مِنْ أَسْلَمَ أَتَى النَّبِيَّ ﷺ فَحَدَّثَهُ أَنَّهُ قَدْ زَنَى وَشَهِدَ عَلَى نَفْسِهِ أَرْبَعَ شَهَادَاتٍ فَأَمَرَ بِهِ رَسُولُ اللهِ ﷺ فَرُجِمَ وَكَانَ قَدْ أُحْصِنَ
[Machine] On the authority of the Messenger of Allah ﷺ, a man who had embraced Islam confessed to committing adultery four times in front of him. The Prophet commanded that he be stoned to death. However, the man, who was married, had been granted protection by his tribe. Some people claimed that he was innocent.
عَنْ رَسُولِ اللهِ ﷺ أَنَّ رَجُلًا مِنْ أَسْلَمَ شَهِدَ عِنْدَهُ بِالزِّنَا عَلَى نَفْسِهِ أَرْبَعَ مَرَّاتٍ فَأَمَرَ بِهِ فَرُجِمَ وَكَانَ قَدْ أُحْصِنَ قَالَ زَعَمُوا أَنَّهُ مَاعِزٌ
[Machine] Ma'iz ibn Malik came to the Prophet ﷺ and said, "O Messenger of Allah, purify me." The Prophet ﷺ exclaimed, "Woe to you, go back and seek forgiveness from Allah and repent to Him." Ma'iz returned after a short while and said, "O Messenger of Allah, purify me." The Prophet ﷺ responded once again, "Woe to you, go back and seek forgiveness from Allah and repent to Him." Ma'iz returned again shortly and repeated his request, saying, "O Messenger of Allah, purify me." The Prophet ﷺ finally replied, "Likewise, I have given you the same answer until now. But what is it that you want to be purified from?" Ma'iz answered, "From committing adultery." The Prophet ﷺ asked, "Are you insane?" Ma'iz's sanity was confirmed, and the Prophet ﷺ inquired if he had consumed any alcohol. A man stood up to condemn him, but could not smell alcohol on him. The Prophet ﷺ asked Ma'iz, "Are you sure you are telling the truth?" Ma'iz affirmed, so the Prophet ﷺ ordered that he be stoned to death. The Prophet ﷺ then mentioned the incident in the context of repentance, as he had done before. Afterwards, a woman from the tribe of Ghamid, from the Azd clan, came to him and requested, "O Messenger of Allah, purify me." He once again expressed, "Woe to you, go back and seek forgiveness from Allah and repent to Him." She responded, saying, "Perhaps you want to turn me away just as you turned away Ma'iz ibn Malik?" The Prophet ﷺ asked, "What are you talking about?" She explained, "I am pregnant from committing adultery." The Prophet ﷺ inquired, "Are you sure you are telling the truth?" She confirmed. He then said, "In that case, we will not stone you until you give birth." The Prophet ﷺ also mentioned this incident.
جَاءَ مَاعِزُ بْنُ مَالِكٍ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللهِ طَهِّرْنِي فَقَالَ وَيْحَكَ ارْجِعْ فَاسْتَغْفِرِ اللهَ وَتُبْ إِلَيْهِ قَالَ فَرَجَعَ غَيْرَ بَعِيدٍ ثُمَّ جَاءَ فَقَالَ يَا رَسُولَ اللهِ طَهِّرْنِي فَقَالَ النَّبِيُّ ﷺ وَيْحَكَ ارْجِعْ فَاسْتَغْفِرِ اللهَ وَتُبْ إِلَيْهِ فَقَالَ فَرَجَعَ غَيْرَ بَعِيدٍ ثُمَّ جَاءَ فَقَالَ يَا رَسُولَ اللهِ طَهِّرْنِي فَقَالَ رَسُولُ اللهِ ﷺ مِثْلَ ذَلِكَ حَتَّى إِذَا كَانَتِ الرَّابِعَةُ قَالَ رَسُولُ اللهِ ﷺ مِمَّ أُطَهِّرُكَ؟ فَقَالَ مِنَ الزِّنَا فَسَأَلَ النَّبِيُّ ﷺ أَبِهِ جُنُونٌ؟ فَأُخْبِرَ أَنَّهُ لَيْسَ بِمَجْنُونٍ فَقَالَ أَشَرِبْتَ خَمْرًا؟ فَقَامَ رَجُلٌ فَاسْتَنْكَهَهُ فَلَمْ يَجِدْ مِنْهُ رِيحَ خَمْرٍ فَقَالَ النَّبِيُّ ﷺ أَثَيِّبٌ أَنْتَ؟ قَالَ نَعَمْ فَأَمَرَ بِهِ فَرُجِمَ ثُمَّ ذَكَرَ الْحَدِيثَ فِي التَّوْبَةِ كَمَا مَضَى قَالَ ثُمَّ جَاءَتْهُ امْرَأَةٌ مِنْ غَامِدٍ مِنَ الْأَزْدِ فَقَالَتْ يَا رَسُولَ اللهِ طَهِّرْنِي فَقَالَ وَيْحَكِ ارْجِعِي فَاسْتَغْفِرِي اللهَ وَتُوبِي إِلَيْهِ فَقَالَتْ لَعَلَّكَ تُرِيدُ أَنْ تَرْدُدَنِي كَمَا رَدَدْتَ مَاعِزَ بْنَ مَالِكٍ؟ قَالَ وَمَا ذَلِكَ؟ قَالَتْ إِنَّهَا حُبْلَى مِنَ الزِّنَا فَقَالَ أَثَيِّبٌ أَنْتِ؟ قَالَتْ نَعَمْ قَالَ إِذًا لَا نَرْجُمُكِ حَتَّى تَضَعِي مَا فِي بَطْنِكِ وَذَكَرَ الْحَدِيثَ
[Machine] "When a goat came to the Prophet ﷺ , he said to him, 'Woe to you! Perhaps you kissed or winked or looked?' He replied, 'No.' The Prophet ﷺ said, 'But you did this and that to me. Did it not annoy me?' He said, 'Yes.' At that point, he ordered his stoning to death and Abu Amr Al-Adib informed us that Abu Bakr Al-Isma'ili told me that Al-Hasan ibn Sufyan informed us that Ibrahim ibn Ya'qub narrated to me from Wahb ibn Jarir, who narrated from his father that he said, 'Did you enjoy it?' He said, 'Yes.'
أَنَّ مَاعِزًا لَمَّا أَتَى النَّبِيَّ ﷺ قَالَ لَهُ وَيْحَكَ لَعَلَّكَ قَبَّلْتَ أَوْ غَمَزْتَ أَوْ نَظَرْتَ؟ فَقَالَ لَا فَقَالَ لَهُ النَّبِيُّ ﷺ فَعَلْتَ كَذَا وَكَذَا لَا يُكَنِّي؟ قَالَ نَعَمْ قَالَ فَعِنْدَ ذَلِكَ أَمَرَ بِرَجْمِهِ 16995 وَأَخْبَرَنَا أَبُو عَمْرٍو الْأَدِيبُ أنبأ أَبُو بَكْرٍ الْإِسْمَاعِيلِيُّ أَخْبَرَنِي الْحَسَنُ بْنُ سُفْيَانَ ثنا إِبْرَاهِيمُ بْنُ يَعْقُوبَ ثنا وَهْبُ بْنُ جَرِيرٍ ثنا أَبِي بِهَذَا غَيْرَ أَنَّهُ قَالَ أَفَنِكْتَهَا؟ قَالَ نَعَمْ
[Machine] I saw Ma'iz bin Malik brought to the Prophet when a man, who was short and crippled, brought him. The man had no cloak on him, so he testified against himself four times that he had committed adultery. The Messenger of Allah ﷺ said to him: “Perhaps you just saw (what was done)?” He said: “No, by Allah, I have committed adultery.” So he ordered him to be stoned to death, and he (the Prophet) recited the verses of stoning.
رَأَيْتُ مَاعِزَ بْنَ مَالِكٍ حِينَ جِيءَ بِهِ إِلَى النَّبِيِّ ﷺ رَجُلٌ قَصِيرٌ أَعْضَلُ لَيْسَ عَلَيْهِ رِدَاءٌ فَشَهِدَ عَلَى نَفْسِهِ أَرْبَعَ شَهَادَاتٍ أَنَّهُ قَدْ زَنَى فَقَالَ رَسُولُ اللهِ ﷺ فَلَعَلَّكَ؟ قَالَ لَا وَاللهِ قَدْ زَنَى الْأَخِرُ فَرُجِمَ ثُمَّ خَطَبَ فَقَالَ أَلَا كُلَّمَا نَفَرْنَا فِي سَبِيلِ اللهِ خَلَفَ أَحَدُهُمْ لَهُ نَبِيبٌ كَنَبِيبِ التَّيْسِ أَلَا وَإِنِّي لَا أُوتَى بِأَحَدِهِمْ إِلَّا جَعَلْتُهُ نَكَالًا
I have committed immorality (adultery), so inflict punishment upon me. Allah's Apostle ﷺ turned him away again and again. He then asked his people (about the state of his mind). They said: We do not know of any ailment of his except that he has committed something about which he thinks that he would not be able to relieve himself of its burden but with the Hadd being imposed upon him. He (Ma'iz) came back to Allah's Apostle ﷺ and he commanded us to stone him. We took him to the Baqi' al-Gharqad (the graveyard of Medina). We neither tied him nor dug any ditch for him. We attacked him with bones, with clods and pebbles. He ran away and we ran after him until he came upon the ston ground (al-Harra) and stopped there and we stoned him with heavy stones of the Harra until he became motionless (lie died). He (the Holy Prophet) then addressed (us) in the evening saying Whenever we set forth on an expedition in the cause of Allah, some one of those connected with us shrieked (under the pressure of sexual lust) as the bleating of a male goat. It is essential that if a person having committed such a deed is brought to me, I should punish him. He neither begged forgiveness for him nor cursed him. (Using translation from Muslim 1694a)
يُقَالُ لَهُ مَاعِزُ بْنُ مَالِكٍ أَتَى رَسُولَ اللهِ ﷺ فَقَالَ إِنِّي أَصَبْتُ فَاحِشَةً فَأَقِمْهُ عَلَيَّ فَرَدَّهُ رَسُولُ اللهِ ﷺ مِرَارًا ثُمَّ سَأَلَ قَوْمَهُ فَقَالُوا مَا نَعْلَمُ بِهِ بَأْسًا إِلَّا أَنَّهُ أَصَابَ شَيْئًا يَرَى أَنْ لَا يُخْرِجَهُ مِنْهُ إِلَّا أَنْ يُقَامَ فِيهِ الْحَدُّ قَالَ فَرَجَعَ إِلَى رَسُولِ اللهِ ﷺ فَأَمَرَنَا أَنْ نَرْجُمَهُ قَالَ فَانْطَلَقْنَا إِلَى بَقِيعِ الْغَرْقَدِ قَالَ فَمَا أَوْثَقْنَاهُ وَلَا حَفَرْنَا لَهُ قَالَ فَرَمَيْنَاهُ بِالْعِظَامِ وَالْمَدَرِ وَالْخَزَفِ قَالَ فَاشْتَدَّ وَاشْتَدَدْنَا خَلْفَهُ حَتَّى أَتَى عُرْضَ الْحَرَّةِ فَانْتَصَبَ لَنَا فَرَمَيْنَاهُ بِجَلَامِيدِ الْحَرَّةِ يَعْنِي الْحِجَارَةَ حَتَّى سَكَتَ قَالَ ثُمَّ قَامَ رَسُولُ اللهِ ﷺ خَطِيبًا مِنَ الْعِشَاءِ قَالَ أَكُلَّمَا انْطَلَقْنَا غُزَاةً فِي سَبِيلِ اللهِ تَخَلَّفَ رَجُلٌ فِي عِيَالِنَا لَهُ نَبِيبٌ كَنَبِيبِ التَّيْسِ عَلَى أَنْ لَا أُوتَى بِرَجُلٍ فَعَلَ ذَلِكَ إِلَّا نَكَّلْتُ بِهِ قَالَ فَمَا اسْتَغْفَرَ لَهُ وَلَا سَبَّهُ لَفْظُ حَدِيثِ ابْنِ الْمُثَنَّى
A man of the tribe of Aslam came to the Prophet ﷺ and testified four times against himself that he had had illicit intercourse with a woman, while all the time the Prophet ﷺ was turning away from him. Then when he confessed a fifth time, he turned round and asked: Did you have intercourse with her? He replied: Yes. He asked: Have you done it so that your sexual organ penetrated hers? He replied: Yes. He asked: Have you done it like a collyrium stick when enclosed in its case and a rope in a well? He replied: Yes. He asked: Do you know what fornication is? He replied: Yes. I have done with her unlawfully what a man may lawfully do with his wife. He then asked: What do you want from what you have said? He said: I want you to purify me. So he gave orders regarding him and he was stoned to death. Then the Prophet ﷺ heard one of his companions saying to another: Look at this man whose fault was concealed by Allah but who would not leave the matter alone, so that he was stoned like a dog. He said nothing to them but walked on for a time till he came to the corpse of an ass with its legs in the air. He asked: Where are so and so? They said: Here we are, Messenger of Allah ﷺ! He said: Go down and eat some of this ass's corpse. They replied: Messenger of Allah! Who can eat any of this? He said: The dishonour you have just shown to your brother is more serious than eating some of it. By Him in Whose hand my soul is, he is now among the rivers of Paradise and plunging into them. أَنَّ مَاعِزًا جَاءَ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنِّي قَدْ زَنَيْتُ فَأَعْرَضَ عَنْهُ حَتَّى قَالَهَا أَرْبَعًا فَلَمَّا كَانَ فِي الْخَامِسَةِ قَالَ زَنَيْتَ؟ قَالَ نَعَمْ قَالَ وَتَدْرِي مَا الزِّنَا؟ قَالَ نَعَمْ أَتَيْتُ مِنْهَا حَرَامًا مَا يَأْتِي الرَّجُلُ مِنَ امْرَأَتِهِ حَلَالًا قَالَ مَا تُرِيدُ إِلَى هَذَا الْقَوْلِ؟ قَالَ أُرِيدُ أَنْ تُطَهِّرَنِي فَقَالَ رَسُولُ اللهِ ﷺ أَدْخَلْتَ ذَلِكَ مِنْهُ فِي ذَلِكَ مِنْهَا كَمَا يَغِيبُ الْمِيلُ فِي الْمُكْحُلَةِ وَالْعَصَا فِي الشَّيْءِ؟ أَوْ قَالَ الرِّشَاءُ فِي الْبِئْرِ؟ قَالَ نَعَمْ يَا رَسُولَ اللهِ فَأَمَرَ بِرَجْمِهِ فَرُجِمَ فَسَمِعَ النَّبِيُّ ﷺ رَجُلَيْنِ يَقُولُ أَحَدُهُمَا لِصَاحِبِهِ أَلَمْ تَرَ إِلَى هَذَا الَّذِي سَتَرَ اللهُ عَلَيْهِ فَلَمْ تَدَعْهُ نَفْسُهُ حَتَّى رُجِمَ رَجْمَ الْكَلْبِ فَسَارَ رَسُولُ اللهِ ﷺ شَيْئًا ثُمَّ مَرَّ بِجِيفَةِ حِمَارٍ فَقَالَ أَيْنَ فُلَانٌ وَفُلَانٌ؟ قُومَا فَانْزِلَا فَكُلَا مِنْ جِيفَةِ هَذَا الْحِمَارِ فَقَالَا غَفَرَ اللهُ لَكَ يَا رَسُولَ اللهِ وَهَلْ يُؤْكَلُ مِثْلُ هَذَا؟ قَالَ فَمَا نِلْتُمَا مِنْ أَخِيكُمَا آنِفًا شَرٌّ مِنْ هَذَا وَالَّذِي نَفْسِي بِيَدِهِ إِنَّهُ الْآنَ لَفِي أَنْهَارِ الْجَنَّةِ يَتَقَمَّسُ فِيهَا
[Machine] A man who had converted to Islam came to Abu Bakr Al-Siddiq and said, "Indeed, the brother has committed adultery." Abu Bakr asked him, "Did you mention this to anyone other than me?" He replied, "No." Abu Bakr said to him, "Repent to Allah and seek the cover of Allah's concealment, for Allah accepts the repentance of His servants." However, he (the man) did not feel at ease until he approached Umar ibn Al-Khattab and said the same thing he had said to Abu Bakr. Umar responded to him as Abu Bakr did, and he still did not feel at ease until he went to the Messenger of Allah, ﷺ , and said, "Indeed, the brother has committed adultery." Sa'id turned away from him repeatedly until, when he persisted, he sent for his family and said to them, "Does he have any signs of madness?" They replied, "By Allah, he is sane." The Messenger of Allah, ﷺ , asked, "Is he Abu Bakr or Thayyib?" They replied, "Rather, he is Thayyib." So, the Messenger of Allah, ﷺ , ordered that he be stoned to death.
رَجُلًا مِنْ أَسْلَمَ جَاءَ إِلَى أَبِي بَكْرٍ الصِّدِّيقِ ؓ فَقَالَ إِنَّ الْأَخِرَ زَنَى فَقَالَ لَهُ أَبُو بَكْرٍ هَلْ ذَكَرْتَ هَذَا لِأَحَدٍ غَيْرِي؟ فَقَالَ لَا قَالَ أَبُو بَكْرٍ فَتُبْ إِلَى اللهِ وَاسْتَتِرْ بِسِتْرِ اللهِ فَإِنَّ اللهَ يَقْبَلُ التَّوْبَةَ عَنْ عِبَادِهِ فَلَمْ تُقِرَّهُ نَفْسُهُ حَتَّى أَتَى عُمَرَ بْنَ الْخَطَّابِ ؓ فَقَالَ لَهُ كَمَا قَالَ لِأَبِي بَكْرٍ ؓ فَقَالَ لَهُ عُمَرُ كَمَا قَالَ لَهُ أَبُو بَكْرٍ ؓ فَلَمْ تُقِرَّهُ نَفْسُهُ حَتَّى أَتَى رَسُولَ اللهِ ﷺ فَقَالَ إِنَّ الْأَخِرَ زَنَى قَالَ سَعِيدٌ فَأَعْرَضَ عَنْهُ رَسُولُ اللهِ ﷺ مِرَارًا كُلُّ ذَلِكَ يَعْرِضُ عَنْهُ حَتَّى إِذَا أَكْثَرَ عَلَيْهِ بَعَثَ إِلَى أَهْلِهِ فَقَالَ أَيَشْتَكِي بِهِ جِنَّةً؟ فَقَالُوا وَاللهِ إِنَّهُ لَصَحِيحٌ فَقَالَ رَسُولُ اللهِ ﷺ أَبِكْرٌ أَمْ ثَيِّبٌ؟ فَقَالُوا بَلْ ثَيِّبٌ فَأَمَرَ بِهِ رَسُولُ اللهِ ﷺ فَرُجِمَ
55.17 [Machine] Recognition of adultery is retracted by confession, so it is left.
٥٥۔١٧ بَابُ الْمُعْتَرِفِ بِالزِّنَا يَرْجِعُ عَنْ إِقْرَارِهِ فَيُتْرَكَ
[Machine] A goat from Aslam came to the Messenger of Allah ﷺ and said, "I have committed adultery." The Messenger turned away from it and mentioned the matter. He said, "Take it and stone it." So when it felt the stones, it ran away vigorously. Then a man with a beard of a camel came and struck it and killed it. The Prophet ﷺ mentioned its escape, saying, "Why did you not leave it alone?"
جَاءَ مَاعِزٌ الْأَسْلَمِيُّ إِلَى رَسُولِ اللهِ ﷺ فَقَالَ إِنِّي زَنَيْتُ فَأَعْرَضَ عَنْهُ وَذَكَرَ الْحَدِيثَ قَالَ اذْهَبُوا بِهِ فَارْجُمُوهُ فَلَمَّا وَجَدَ مَسَّ الْحِجَارَةِ فَرَّ يَشْتَدُّ فَمَرَّ رَجُلٌ مَعَهُ لَحْيُ بَعِيرٍ فَضَرَبَهُ فَقَتَلَهُ فَذُكِرَ فِرَارُهُ لِلنَّبِيِّ ﷺ فَقَالَ أَفَلَا تَرَكْتُمُوهُ
[Machine] "The Messenger of Allah, ﷺ , said regarding a goat, when it went away: 'Why didn't you leave it? Perhaps it would repent, and Allah would accept its repentance.' And the Messenger of Allah, ﷺ , said: 'O Hazal, if you had covered it with your garment, it would have been better for you than what you have done.'"
أَنَّ رَسُولَ اللهِ ﷺ قَالَ فِي مَاعِزٍ لَمَّا ذَهَبَ هَلَّا تَرَكْتُمُوهُ فَلَعَلَّهُ يَتُوبُ فَيَتُوبَ اللهُ عَلَيْهِ وَقَالَ رَسُولُ اللهِ ﷺ يَا هَزَّالُ لَوْ كُنْتَ سَتَرْتَ عَلَيْهِ بِثَوْبِكَ لَكَانَ خَيْرًا لَكَ مِمَّا صَنَعْتَ
55.18 [Machine] A man admits to adultery without the woman
٥٥۔١٨ بَابُ الرَّجُلِ يُقِرُّ بِالزِّنَا دُونَ الْمَرْأَةِ
A man came to the Prophet ﷺ and confessed before him that he had committed fornication with a woman whom he named. The Messenger of Allah ﷺ sent for the woman and asked her about it. But she denied that she had committed fornication. So he inflicted the prescribed punishment of flogging on him, and let her go. (Using translation from Abū Dāʾūd 4437)
عَنِ النَّبِيِّ ﷺ أَنَّ رَجُلًا أَتَاهُ فَأَقَرَّ عِنْدَهُ أَنَّهُ زَنَى بِامْرَأَةٍ فَسَمَّاهَا لَهُ فَبَعَثَ رَسُولُ اللهِ ﷺ إِلَى الْمَرْأَةِ فَسَأَلَهَا عَنْ ذَلِكَ فَأَنْكَرَتْ أَنْ تَكُونَ زَنَتْ فَجَلَدَهُ الْحَدَّ وَتَرَكَهَا
[Machine] He heard Ibn Abbas saying that the Prophet ﷺ was delivering a sermon to the people on Friday when a man from the Banu Layth bin Bakr bin Abd Manat approached him, pushing through the people until he came close to him. He said, "O Messenger of Allah, carry out the prescribed punishment upon me." The Prophet ﷺ told him to sit down and admonished him. Then he stood for the second time and said the same thing. The Prophet ﷺ told him to sit down again. Then he stood for the third time and said the same thing. The Prophet ﷺ asked him, "What is the prescribed punishment for you?" He replied, "I have committed adultery." The Prophet ﷺ asked some of his companions, including Ali bin Abi Talib, Abbas, Zaid bin Harithah, and Uthman bin Affan, to take him and give him one hundred lashes. It was mentioned that the man [from Banu Layth bin Bakr bin Abd Manat] had not been married. So it was said, "O Messenger of Allah, shall we not flog the woman who engaged in illicit relations with him?" The Prophet ﷺ said, "Bring me someone who is a witness." When that person was brought, the Prophet ﷺ asked him, "Who is your companion [in this act]?" The man replied, "She is so-and-so, a woman from the Banu Bakr." The Prophet ﷺ called for her and asked her about the matter. She denied it, saying, "By Allah, I do not know anything about it, and I am one of those who, regarding what I say, rely upon Allah's Innocence. Then the Prophet ﷺ said, "Who will testify that you have committed adultery, since she denies it? If you have witnesses, then whip her; otherwise, whip him for his confession of adultery." The man said, "By Allah, O Messenger of Allah, I have no witnesses." So the Prophet ﷺ commanded that he be given the punishment for adultery, which is eighty lashes.
أَنَّهُ سَمِعَ ابْنَ عَبَّاسٍ يَقُولُ بَيْنَا رَسُولُ اللهِ ﷺ يَخْطُبُ النَّاسَ يَوْمَ الْجُمُعَةِ أَتَاهُ رَجُلٌ مِنْ بَنِي لَيْثِ بْنِ بَكْرِ بْنِ عَبْدِ مَنَاةَ فَتَخَطَّى النَّاسَ حَتَّى اقْتَرَبَ إِلَيْهِ فَقَالَ يَا رَسُولَ اللهِ أَقِمْ عَلَيَّ الْحَدَّ فَقَالَ النَّبِيُّ ﷺ اجْلِسْ فَانْتَهَرَهُ فَجَلَسَ ثُمَّ قَامَ الثَّانِيَةَ فَقَالَ مِثْلَ ذَلِكَ فَقَالَ اجْلِسْ ثُمَّ قَامَ الثَّالِثَةَ فَقَالَ مِثْلَ ذَلِكَ فَقَالَ مَا حَدُّكَ؟ قَالَ أَتَيْتُ امْرَأَةً حَرَامًا فَقَالَ النَّبِيُّ ﷺ لِرِجَالٍ مِنْ أَصْحَابِهِ فِيهِمْ عَلِيُّ بْنُ أَبِي طَالِبٍ وَعَبَّاسٌ وَزَيْدُ بْنُ حَارِثَةَ وَعُثْمَانُ بْنُ عَفَّانَ ُؓ انْطَلِقُوا بِهِ فَاجْلِدُوهُ مِائَةَ جَلْدَةٍ وَلَمْ يَكُنِ اللَّيْثِيُّ تَزَوَّجَ فَقِيلَ يَا رَسُولَ اللهِ أَلَا نَجْلِدُ الَّتِي خَبَثَ بِهَا؟ فَقَالَ النَّبِيُّ ﷺ ائْتُونِي بِهِ مَجْلُودًا فَلَمَّا أُتِيَ بِهِ قَالَ لَهُ مَنْ صَاحِبَتُكَ؟ قَالَ فُلَانَةٌ لِامْرَأَةٍ مِنْ بَنِي بَكْرٍ فَدَعَاهَا فَسَأَلَهَا عَنْ ذَلِكَ فَقَالَتْ كَذَبَ وَاللهِ مَا أَعْرِفُهُ وَإِنِّي مِمَّا قَالَ لَبَرِئيَةٌ اللهُ عَلَى مَا أَقُولُ مِنَ الشَّاهِدِينَ فَقَالَ النَّبِيُّ ﷺ مَنْ شُهُودُكَ أَنَّكَ خَبَثْتَ بِهَا فَإِنَّهَا تُنْكِرُ؟ فَإِنْ كَانَ لَكَ شُهَدَاءُ جَلَدْتُهَا وَإِلَّا جَلَدْتُكَ حَدَّ الْفِرْيَةِ فَقَالَ يَا رَسُولَ اللهِ وَاللهِ مَا لِي شُهَدَاءُ فَأَمَرَ بِهِ فَجُلِدَ حَدَّ الْفِرْيَةِ ثَمَانِينَ
55.19 [Machine] The flogging punishment is not inflicted on a pregnant woman, a sick person, during extreme heat or severe cold, or in cases of destruction.
٥٥۔١٩ بَابُ لَا يُقَامُ حَدُّ الْجَلْدِ عَلَى الْحُبْلَى وَلَا عَلَى مَرِيضٍ دَنَفَ، وَلَا فِي يَوْمٍ حَرُّهُ شَدِيدٌ أَوْ بَرْدُهُ مُفْرِطٌ، وَلَا فِي أَسْبَابِ التَّلَفِ
[Machine] I heard Ali, while he was giving a sermon on the pulpit, praising and glorifying God. Then he said, "O people, if any male or female servant commits adultery, then establish the punishment upon them. And if they were previously married, then flog them. Indeed, a servant of the Messenger of Allah ﷺ committed adultery, so he sent me to strike her. But I found her recently postpartum and I feared that if I were to strike her, I would kill her. Therefore, I refrained from hitting her until she recovered and regained her strength." He (the narrator) said, "You have done well."
سَمِعْتُ عَلِيًّا ؓ وَهُوَ يَخْطُبُ عَلَى الْمِنْبَرِ فَحَمِدَ اللهَ وَأَثْنَى عَلَيْهِ ثُمَّ قَالَ أَيُّهَا النَّاسُ أَيُّمَا عَبْدٍ أَوْ أَمَةٍ زَنَى فَأَقِيمُوا عَلَيْهِ الْحَدَّ وَإِنْ كَانَ قَدْ أُحْصِنَ فَاجْلِدُوهُ فَإِنَّ خَادِمًا لِرَسُولِ اللهِ ﷺ زَنَتْ فَأَرْسَلَنِي إِلَيْهَا لِأَضْرِبَهَا فَوَجَدْتُهَا حَدِيثَةَ عَهْدٍ بِنِفَاسِهَا وَخَشِيتُ إِنْ أَنَا ضَرَبْتُهَا أَنْ أَقْتُلَهَا فَرَدَدْتُ عَنْهَا حَتَّى تُمَاثِلَ وَتَشْتَدَّ قَالَ أَحْسَنْتَ
“When her postpartum bleeding stops, give her the hadd punishment of flogging.” Then he said: “Carry out the hadd punishment on those whom your right hands possess.” (Using translation from Aḥmad 1231)
أَنَّ جَارِيَةً لِلنَّبِيِّ ﷺ نُفِسَتْ مِنَ الزِّنَا فَأَرْسَلَنِي النَّبِيُّ ﷺ أَنْ أُقِيمَ عَلَيْهَا الْحَدَّ فَوَجَدْتُهَا فِي الدِّمَاءِ لَمْ تَجِفَّ عَنْهَا فَرَجَعْتُ إِلَى النَبِيِّ ﷺ فَأَخْبَرْتُهُ فَقَالَ إِذَا جَفَّ الدَّمُ عَنْهَا فَاجْلِدْهَا الْحَدَّ وَقَالَ أَقِيمُوا الْحُدُودَ عَلَى مَا مَلَكَتْ أَيْمَانُكُمْ
55.20 [Machine] Al-Hubla is not translated until she puts and secures her offspring
٥٥۔٢٠ بَابُ الْحُبْلَى لَا تُرْجَمُ حَتَّى تَضَعَ وَيُكْفَلُ وَلَدُهَا
[Machine] The Prophet ﷺ asked, "Are you a married woman?" She replied, "Yes." He said, "Then we will not stone you until you give birth to what is in your womb." A man from the Ansar took responsibility for her until she gave birth. He then went to the Prophet ﷺ and informed him, "The woman from the tribe of Ghamid has given birth." The Prophet ﷺ said, "Stone her, but spare her child who is still breastfeeding." A man from the Ansar stood up and said, "I will breastfeed him, O Messenger of Allah." So they stoned her.
قَالَ النَّبِيُّ ﷺ أَثَيِّبٌ أَنْتِ؟ قَالَتْ نَعَمْ قَالَ إِذًا لَا نَرْجُمُكِ حَتَّى تَضَعِي مَا فِي بَطْنِكِ قَالَ فَكَفَلَهَا رَجُلٌ مِنَ الْأَنْصَارِ حَتَّى وَضَعَتْ فَأَتَى النَّبِيَّ ﷺ فَقَالَ قَدْ وَضَعَتِ الْغَامِدِيَّةُ فَقَالَ نَرْجُمُهَا وَنَدَعُ وَلَدَهَا صَغِيرَ السِّنِّ لَيْسَ لَهُ مَنْ يُرْضِعُهُ فَقَامَ رَجُلٌ مِنَ الْأَنْصَارِ فَقَالَ إِلِيَّ رَضَاعُهُ يَا رَسُولَ اللهِ فَرَجَمَهَا
[Machine] I was sitting with the Prophet ﷺ when a woman from the tribe of Ghamid came to him and said, "I have committed adultery and I want to be purified." He mentioned the Hadd (prescribed punishment) concerning her until he said, "By Allah, I am pregnant." The Prophet ﷺ said to her, "Go back until you give birth." When she gave birth and came with the child (wrapped in a cloth), she said, "O Messenger of Allah, I have given birth." He said, "Go and breastfeed him." When she had breastfed him, she came to him with the child (holding a piece of bread) and said, "O Messenger of Allah, I have breastfed him." The Prophet ﷺ ordered that the child be given to a Muslim man, then he commanded that a pit be dug for her and she was placed in it up to her chest. Then he ordered the people to stone her, and he mentioned the Hadd.
كُنْتُ جَالِسًا عِنْدَ النَّبِيِّ ﷺ فَجَاءَتْهُ امْرَأَةٌ مِنْ غَامِدٍ فَقَالَتْ إِنِّي قَدْ زَنَيْتُ وَإِنِّي أُرِيدُ أَنْ تُطَهِّرَنِي فَذَكَرَ الْحَدِيثَ إِلَى أَنْ قَالَتْ فَوَاللهِ إِنِّي لَحُبْلَى فَقَالَ لَهَا النَّبِيُّ ﷺ ارْجِعِي حَتَّى تَلِدِي فَلَمَّا وَلَدَتْ جَاءَتْ بِالصَّبِيِّ فِي خِرْقَةٍ فَقَالَتْ يَا رَسُولَ اللهِ إِنِّي قَدْ وَلَدْتُ فَقَالَ اذْهَبِي حَتَّى تَفْطِمِيهِ فَلَمَّا فَطَمَتْهُ جَاءَتْهُ بِالصَّبِيِّ فِي يَدِهِ كِسْرَةٌ فَقَالَتْ يَا رَسُولَ اللهِ هَذَا قَدْ فَطَمْتُهُ فَأَمَرَ النَّبِيُّ ﷺ بِالصَّبِيِّ فَدُفِعَ إِلَى رَجُلٍ مِنَ الْمُسْلِمِينَ ثُمَّ أَمَرَ بِهَا فَحُفِرَتْ لَهَا حَفِيرَةٌ فَجُعِلَتْ فِيهَا إِلَى صَدْرِهَا ثُمَّ أَمَرَ النَّاسَ أَنْ يَرْجُمُوهَا وَذَكَرَ الْحَدِيثَ
55.21 [Machine] The blind person in his creation is not from a disease that affects the limit.
٥٥۔٢١ بَابُ الضَّرِيرِ فِي خِلْقَتِهِ لَا مِنْ مَرَضٍ يُصِيبُ الْحَدَّ
[Machine] "And the other one said, 'It was a seat that was beside Sa'd, and a woman was hit by a rope, so she threw it at him.' Then he was questioned and he admitted. So the Prophet ﷺ ordered that he be punished. One of them said, 'He should be whipped with the branches of the palm tree.' And the other one said, 'He should be whipped with the fibers of the palm tree.' This is what is preserved from Sufyan, conveyed from Abu Sa'id, and it is also narrated from Abu Al-Zinad from Abu Umamah from his father, and it is said that it is narrated from Abu Umamah from Sa'id ibn Sa'd ibn 'Ubadah."
وَقَالَ الْآخَرُ مُقْعَدٌ كَانَ عِنْدَ جِوَارِ سَعْدٍ فَأَصَابَ امْرَأَةً حَبَلٌ فَرَمَتْهُ بِهِ فَسُئِلَ فَاعْتَرَفَ فَأَمَرَ النَّبِيُّ ﷺ بِهِ قَالَ أَحَدُهُمَا فَجُلِدَ بِإِثْكَالِ النَّخْلِ وَقَالَ الْآخَرُ بِأُثْكُولِ النَّخْلِ هَذَا هُوَ الْمَحْفُوظُ عَنْ سُفْيَانَ مُرْسَلًا وَرُوِي عَنْهُ مَوْصُولًا بِذِكْرِ أَبِي سَعِيدٍ فِيهِ وَقِيلَ عَنْ أَبِي الزِّنَادِ عَنْ أَبِي أُمَامَةَ عَنْ أَبِيهِ وَقِيلَ عَنْ أَبِي أُمَامَةَ عَنْ سَعِيدِ بْنِ سَعْدِ بْنِ عُبَادَةَ
[Machine] Between us, there was a weak and crippled man that we never saw except that he was with a group of servant women from the household, whom he would deceive. Sa'd bin 'Ubadah raised his matter to the Messenger of Allah ﷺ , so he said, "Flog him with one hundred lashes." They said, "O Messenger of Allah, he is weaker than that. If we were to flog him with one hundred lashes, he would die." He said, "Then take him and flog him with one hundred branches."
كَانَ بَيْنَ أَبْيَاتِنَا رَجُلٌ مُخْدَجٌ ضَعِيفٌ فَلَمْ نُرَعْ إِلَّا وَهُوَ عَلَى أَمَةٍ مِنْ إِمَاءِ الدَّارِ يَخْبُثُ بِهَا فَرَفَعَ شَأْنَهُ سَعْدُ بْنُ عُبَادَةَ إِلَى رَسُولِ اللهِ ﷺ فَقَالَ اجْلِدُوهُ مِائَةَ سَوْطٍ فَقَالُوا يَا نَبِيَّ اللهِ هُوَ أَضْعَفُ مِنْ ذَاكَ لَوْ ضَرَبْنَاهُ مِائَةَ سَوْطٍ مَاتَ قَالَ فَخُذُوا لَهُ عِثْكَالًا فِيهِ مِائَةُ شِمْرَاخٍ فَاضْرِبُوهُ وَاحِدَةً
[Machine] During the time of the Prophet ﷺ, a woman got pregnant from adultery. She was asked, "Who made you pregnant?" She replied, "A paralyzed man made me pregnant." When asked about it, he confessed, so the Prophet ﷺ said that he was physically weak. He ordered for him to be beaten with one hundred lashes. Ali said, "This is what the Prophet ﷺ said," and the correct narration is from Abu Hazim, from Abu Umamah ibn Sahl ibn Hunayf, from the Prophet ﷺ.
أَنَّ وَلِيدَةً فِي عَهْدِ النَّبِيِّ ﷺ حَمَلَتْ مِنَ الزِّنَا فَسُئِلَتْ مَنْ أَحْبَلَكِ؟ قَالَتْ أَحْبَلَنِي الْمُقْعَدُ فَسُئِلَ عَنْ ذَلِكَ فَاعْتَرَفَ فَقَالَ النَّبِيُّ ﷺ إِنَّهُ لَضَعِيفٌ عَنِ الْجَلْدِ فَأَمَرَ بِمِائَةِ عُثْكُولٍ فَضَرَبَهُ بِهَا وَاحِدَةً قَالَ عَلِيٌّ كَذَا قَالَ وَالصَّوَابُ عَنْ أَبِي حَازِمٍ عَنْ أَبِي أُمَامَةَ بْنِ سَهْلِ بْنِ حُنَيْفٍ عَنِ النَّبِيِّ ﷺ
55.22 [Machine] Witnesses in Adultery: Allah ﷻ said: "And bring to witness four witnesses from among you" [Quran 4:15], and He said: "And if they do not produce four witnesses
٥٥۔٢٢ بَابُ الشُّهُودِ فِي الزِّنَا قَالَ اللهُ ﷻ: {فَاسْتَشْهِدُوا عَلَيْهِنَّ أَرْبَعَةً مِنْكُمْ} [النساء: 15]، وَقَالَ: {لَوْلَا جَاءُوا عَلَيْهِ بِأَرْبَعَةِ شُهَدَاءَ}
[Machine] "O Messenger of Allah, if I find my wife with another man, should I give him respite until I bring forth four witnesses?" He replied, "Yes."
يَا رَسُولَ اللهِ إِنْ وَجَدْتُ مَعَ امْرَأَتِي رَجُلًا أُمْهِلْهُ حَتَّى آتِيَ بِأَرْبَعَةِ شُهَدَاءَ؟ قَالَ نَعَمْ
أَنَّ رَجُلًا بِالشَّامِ وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا فَقَتَلَهُ أَوْ قَتَلَهَا فَكَتَبَ مُعَاوِيَةُ إِلَى أَبِي مُوسَى الْأَشْعَرِيِّ بِأَنْ يَسْأَلَ لَهُ عَنْ ذَلِكَ عَلِيًّا فَسَأَلَهُ فَقَالَ عَلِيٌّ ؓ إِنَّ هَذَا الشَّيْءَ مَا هُوَ بِأَرْضِ الْعِرَاقِ عَزَمْتُ عَلَيْكَ لَتُخْبِرَنِّي فَأَخْبَرَهُ فَقَالَ عَلِيٌّ ؓ أَنَا أَبُو حَسَنٍ إِنْ لَمْ يَأْتِ بِأَرْبَعَةِ شُهَدَاءَ فَلْيُعْطَ بِرُمَّتِهِ
