55. Prescribed Punishments
٥٥۔ كِتَابُ الْحُدُودِ
[Machine] The Messenger of Allah ﷺ said, "Take from me: Allah has prescribed a way for them. For the virgin, the punishment is one hundred lashes and one year of exile. And for the married adulterer, the punishment is one hundred lashes. This stoning punishment is the narration of Yahya and in the narration of Amr and Tughriq."
قَالَ رَسُولُ اللهِ ﷺ خُذُوا عَنِّي قَدْ جَعَلَ اللهُ لَهُنَّ سَبِيلًا الْبِكْرُ بِالْبِكْرِ جَلْدُ مِائَةٍ وَنَفْيُ سَنَةٍ وَالثَّيِّبُ بِالثَّيِّبِ جَلْدُ مِائَةٍ وَالرَّجْمُ هَذَا حَدِيثُ يَحْيَى وَفِي رِوَايَةِ عَمْرٍو وَتَغْرِيبُ عَامٍ
[Machine] Abu Huraira, Zaid bin Khalid al-Juhani, and Shibl said, "We were with the Prophet ﷺ when a man came to him and said, 'I adjure you by Allah, do not judge between us except according to the Book of Allah and allow me to speak first.' The Prophet ﷺ said, 'Say your statement.' The man said, 'My son was a shepherd for this man's wife and he committed adultery with her. I redeemed myself from him by giving him a hundred sheep and a servant. Then I asked some knowledgeable people who informed me that he should be punished with a hundred lashes and one year of exile, and that his wife should be stoned to death.' The Messenger of Allah ﷺ said, 'By the One in Whose hand is my soul, I will judge between you according to the Book of Allah. The hundred sheep and the servant are to be returned to you, and your son is to be punished with a hundred lashes and one year of exile. And you, O Unays, go and announce that if the wife of this man admits (to the adultery), then stone her.' So Unays went and announced this, and the wife admitted (to the adultery), so he stoned her.' Sufyan and Unays both said, 'Unays was a man who had embraced Islam.'
عَنْ أَبِي هُرَيْرَةَ وَزَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ وَشِبْلٍ قَالُوا كُنَّا عِنْدَ النَّبِيِّ ﷺ فَقَامَ إِلَيْهِ رَجُلٌ فَقَالَ أَنْشُدُكَ اللهَ إِلَّا قَضَيْتَ بَيْنَنَا بِكِتَابِ اللهِ وَأْذَنْ لِي قَالَ قُلْ قَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا فَزَنَى بِامْرَأَتِهِ فَافْتَدَيْتُ مِنْهُ بِمِائَةِ شَاةٍ وَخَادِمٍ ثُمَّ سَأَلْتُ رِجَالًا مِنْ أَهْلِ الْعِلْمِ فَأَخْبَرُونِي أَنَّ عَلَيْهِ جَلْدَ مِائَةٍ وَتَغْرِيبَ عَامٍ وَأَنَّ عَلَى امْرَأَةِ هَذَا الرَّجْمَ فَقَالَ رَسُولُ اللهِ ﷺ وَالَّذِي نَفْسِي بِيَدِهِ لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللهِ ﷻ الْمِائَةُ شَاةٍ وَالْخَادِمُ رَدٌّ عَلَيْكَ وَعَلَى ابْنِكَ جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ وَاحِدٍ وَاغْدُ يَا أُنَيْسُ عَلَى امْرَأَةِ هَذَا فَإِنِ اعْتَرَفَتْ فَارْجُمْهَا فَغَدَا عَلَيْهَا فَاعْتَرَفَتْ فَرَجَمَهَا قَالَ سُفْيَانُ وَأُنَيْسٌ رَجُلٌ مِنْ أَسْلَمَ
[Machine] I heard the Messenger of Allah ﷺ ordering the punishment of one who commits adultery and is not married, which is one hundred lashes and one year of banishment. This is the narration of Abdullah, and in the narration of At-Tayalisi, I witnessed it being decreed for one who commits adultery.
سَمِعْتُ رَسُولَ اللهِ ﷺ يَأْمُرُ فِيمَنْ زَنَى وَلَمْ يُحْصِنْ بِجَلْدِ مِائَةٍ وَتَغْرِيبِ عَامٍ لَفْظُ حَدِيثِ عَبْدِ الرَّحْمَنِ وَفِي رِوَايَةِ الطَّيَالِسِيِّ شَهِدْتُهُ قَضَى فِيمَنْ زَنَى
[Machine] The Messenger of Allah ﷺ said regarding a person who commits adultery without being married, they are to be exiled from Medina for one year, with the punishment imposed upon them. Ibn Shihab stated that Umar used to exile them from Medina to Basra and Khaybar.
عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ قَالَ فِيمَنْ زَنَى وَلَمْ يُحْصِنْ يُنْفَى عَامًا مِنَ الْمَدِينَةِ مَعَ إِقَامَةِ الْحَدِّ عَلَيْهِ قَالَ ابْنُ شِهَابٍ وَكَانَ عُمَرُ ؓ يَنْفِي مِنَ الْمَدِينَةِ إِلَى الْبَصْرَةِ وَإِلَى خَيْبَرَ
[Machine] While Abu Bakr was in the mosque, a man approached him and spoke to him in an offensive manner, which surprised him. Abu Bakr said to Umar, "Go to him and see what his matter is, for he seems to have some issue." Umar went to him and found out that he had lost his way and ended up at Abu Bakr's daughter's house. Umar got angry and hit him in the chest, saying, "May Allah disgrace you! Didn't you have any shame in looking at Abu Bakr's daughter?" Abu Bakr ordered them both to be punished, and they were both given the prescribed punishment. Then, one of them got married to the other, and Abu Bakr ordered them to be exiled for a year or so. Ali said, "This is how it happened."
بَيْنَمَا أَبُو بَكْرٍ ؓ فِي الْمَسْجِدِ جَاءَهُ رَجُلٌ فَلَاثَ عَلَيْهِ بِلَوْثٍ مِنْ كَلَامٍ وَهُوَ دَهِشٌ فَقَالَ أَبُو بَكْرٍ لِعُمَرَ ؓ قُمْ إِلَيْهِ فَانْظُرْ فِي شَأْنِهِ فَإِنَّ لَهُ شَأْنًا فَقَامَ إِلَيْهِ عُمَرُ ؓ قَالَ إِنَّهُ ضَافَهُ ضَيْفٌ فَوَقَعَ بِابْنَتِهِ فَصَكَّ عُمَرُ ؓ فِي صَدْرِهِ وَقَالَ قَبَّحَكَ اللهُ أَلَا سَتَرْتَ عَلَى ابْنَتِكَ قَالَ فَأَمَرَ بِهِمَا أَبُو بَكْرٍ ؓ فَضُرِبَا الْحَدَّ ثُمَّ تَزَوَّجَ أَحَدُهُمَا مِنَ الْآخَرِ وَأَمَرَ بِهِمَا فَغُرِّبَا عَامًا أَوْ حَوْلًا قَالَ عَلِيٌّ هَكَذَا
[Machine] A man added another man, so he married his sister. Her brother went to Abu Bakr as-Siddiq and mentioned the matter to him, so he sent for him and he confessed to it. Abu Bakr said: Is it Abkar or Thayyib? He said: Abkar. So he lashed him a hundred times and banished him to Fadak. He said: Then, the man married the woman afterwards. He said: Then, the man was killed on the day of Yamamah. Ahmad said: and it means...
أَنَّ رَجُلًا أَضَافَ رَجُلًا فَافْتَضَّ أُخْتَهُ فَجَاءَ أَخُوهَا إِلَى أَبِي بَكْرٍ الصِّدِّيقِ ؓ فَذَكَرَ ذَلِكَ لَهُ فَأَرْسَلَ إِلَيْهِ فَأَقَرَّ بِهِ فَقَالَ أَبِكْرٌ أَمْ ثَيِّبٌ؟ قَالَ بِكْرٌ فَجَلَدَهُ مِائَةً وَنَفَاهُ إِلَى فَدَكَ قَالَ ثُمَّ إِنَّ الرَّجُلَ تَزَوَّجَ الْمَرْأَةَ بَعْدُ قَالَ ثُمَّ قُتِلَ الرَّجُلُ يَوْمَ الْيَمَامَةِ قَالَ أَحْمَدُ وَبِمَعْنَاهُ
[Machine] Abu Bakr Al-Siddiq was informed that a man had committed adultery with a virgin girl and made her pregnant. The man confessed to his wrongdoing, admitting that he was not married. Abu Bakr ordered that he be punished with the prescribed punishment (lashings) and then exiled to Fadak (a place in Arabia). This incident was narrated by Shu'ayb ibn Abi Hamzah from Nafi', who said that Safiyyah bint Abi 'Ubaid informed me about Abu Bakr Al-Siddiq that he had flogged and exiled him for a year. Abu Al-Husayn bin Bishran narrated it to us, who was informed by Ismail Al-Saffar, who narrated it from Abd Al-Karim bin Al-Haytham, who narrated it from Abu Al-Yaman, who narrated it from Shu'ayb, who said: Nafi' mentioned this incident. Abdullah bin Idris also narrated it from Ubaidullah bin Umar.
أَنَّ أَبَا بَكْرٍ الصِّدِّيقَ ؓ أُتِيَ بِرَجُلٍ وَقَعَ عَلَى جَارِيَةٍ بِكْرٍ فَأَحْبَلَهَا ثُمَّ اعْتَرَفَ عَلَى نَفْسِهِ أَنَّهُ زَنَى وَلَمْ يَكُنْ أُحْصِنَ فَأَمَرَ بِهِ أَبُو بَكْرٍ ؓ فَجُلِدَ الْحَدَّ ثُمَّ نُفِيَ إِلَى فَدَكَ 16976 وَرَوَاهُ شُعَيْبُ بْنُ أَبِي حَمْزَةَ عَنْ نَافِعٍ قَالَ أَخْبَرَتْنِي صَفِيَّةُ بِنْتُ أَبِي عُبَيْدٍ عَنْ أَبِي بَكْرٍ الصِّدِّيقِ ؓ أَنَّهُ جَلَدَهُ وَنَفَاهُ عَامًا أَخْبَرَنَاهُ أَبُو الْحُسَيْنِ بْنُ بِشْرَانَ أنبأ إِسْمَاعِيلُ الصَّفَّارُ ثنا عَبْدُ الْكَرِيمِ بْنُ الْهَيْثَمِ ثنا أَبُو الْيَمَانِ ثنا شُعَيْبٌ قَالَ قَالَ نَافِعٌ فَذَكَرَهُ وَرَوَاهُ عَبْدُ اللهِ بْنُ إِدْرِيسَ عَنْ عُبَيْدِ اللهِ بْنِ عُمَرَ
[Machine] That the Prophet ﷺ traveled and emigrated, and that Abu Bakr traveled and emigrated, and that Umar traveled and emigrated.
أَنَّ النَّبِيَّ ﷺ ضَرَبَ وَغَرَّبَ وَأَنَّ أَبَا بَكْرٍ ؓ ضَرَبَ وَغَرَّبَ وَأَنَّ عُمَرَ ؓ ضَرَبَ وَغَرَّبَ
وَأَنَّ عُمَرَ ؓ ضَرَبَ وَغَرَّبَ
[Machine] Ali was whipped and exiled from Basra to Kufa, or it is said from Kufa to Basra.
أَنَّ عَلِيًّا ؓ جَلَدَ وَنَفَى مِنَ الْبَصْرَةِ إِلَى الْكُوفَةِ أَوْ قَالَ مِنَ الْكُوفَةِ إِلَى الْبَصْرَةِ
[Machine] The two unmarried individuals shall be lashed and exiled, while the two married individuals shall be stoned.
الْبِكْرَانِ يُجْلَدَانِ وَيُنْفَيَانِ وَالثَّيِّبَانِ يُرْجَمَانِ
