55. Prescribed Punishments
٥٥۔ كِتَابُ الْحُدُودِ
أَنْ يُجْلَدَ وَلَا يُرْجَمَ
[Machine] I came with Ali to Siffin, and there was a man in the field crying out, "I have committed fornication, so apply the punishment on me." I brought him to Ali, and Ali asked him, "Did you get married?" He replied, "Yes." Ali asked, "Did you consummate the marriage?" He replied, "No." Ali then flogged him a hundred times, fined him half of the marriage gift, and separated them.
جِئْتُ مَعَ عَلِيٍّ ؓ بِصِفِّينَ فَإِذَا رَجُلٌ فِي زَرْعٍ يُنَادِي إِنِّي قَدْ أَصَبْتُ فَاحِشَةً فَأَقِيمُوا عَلَيَّ الْحَدَّ فَرَفَعْتُهُ إِلَى عَلِيٍّ ؓ فَقَالَ لَهُ عَلِيٌّ ؓ هَلْ تَزَوَّجْتَ؟ قَالَ نَعَمْ قَالَ فَدَخَلْتَ بِهَا؟ قَالَ لَا قَالَ فَجَلَدَهُ مِائَةً وَأَغْرَمَهُ نِصْفَ الصَّدَاقِ وَفَرَّقَ بَيْنَهُمَا
[Machine] That Ali entered by force, and then stayed with her against her will, so he separated them. The Sheikh said, "As for the separation between them by adultery, we do not say that because of what we mentioned in the book of marriage from the evidences, and it is possible that Ali separated them with his consent by way of separation, and Allah knows best."
أَنْ يَدْخُلَ بِهَا فَأَقَامَ عَلِيٌّ ؓ عَلَيْهِ الْحَدَّ فَقَالَ إِنَّ الْمَرْأَةَ لَا تَرْضَى أَنْ تَكُونَ عِنْدَهُ فَفَرَّقَ بَيْنَهُمَا عَلِيٌّ ؓ قَالَ الشَّيْخُ رَحِمَهُ اللهُ أَمَّا التَّفْرِيقُ بَيْنَهُمَا بِالزِّنَا حُكْمًا فَلَا نَقُولُ بِهِ لِمَا ذَكَرْنَا فِي كِتَابِ النِّكَاحِ مِنَ الْحُجَجِ وَيُحْتَمَلُ أَنْ يَكُونَ عَلِيٌّ ؓ فَرَّقَ بَيْنَهُمَا بِرِضَاهُ بِالتَّفْرِيقِ وَاللهُ أَعْلَمُ
[Machine] Regarding the scholars of the people of Madinah, they used to say: Whoever marries someone who was not chaste before that, and commits adultery before consummating the marriage, there shall be no stoning upon him. Likewise, the woman is also not subject to stoning. However, if he enters upon his wife for an hour of the day or night, or more than that, and then commits adultery after that, then stoning shall be obligatory upon him. Similarly, the woman is also subject to stoning. The slave women who are mothers of children do not incur stoning.
عَنِ الْفُقَهَاءِ مِنْ أَهْلِ الْمَدِينَةِ كَانُوا يَقُولُونَ مَنْ تَزَوَّجَ مِمَّنْ لَمْ يَكُنْ أُحْصِنَ قَبْلَ ذَلِكَ فَزَنَى قَبْلَ أَنْ يَدْخُلَ بِامْرَأَتِهِ فَلَا رَجْمَ عَلَيْهِ وَالْمَرْأَةُ مِثْلُ ذَلِكَ فَإِنْ دَخَلَ بِامْرَأَتِهِ سَاعَةً مِنْ لَيْلٍ أَوْ نَهَارٍ أَوْ أَكْثَرَ فَزَنَى بَعْدَ ذَلِكَ فَعَلَيْهِ الرَّجْمُ وَالْمَرْأَةُ مِثْلُ ذَلِكَ وَالْإِمَاءُ أُمَّهَاتُ الْأَوْلَادِ لَا يُوجِبْنَ الرَّجْمَ
