55.28 [Machine] The Witnesses of Adultery When They Do Not Agree on One Act, There is no Punishment for the One Witnessed.

٥٥۔٢٨ بَابُ شُهُودِ الزِّنَا إِذَا لَمْ يَجْتَمِعُوا عَلَى فِعْلٍ وَاحِدٍ فَلَا حَدَّ عَلَى الْمَشْهُودِ

[Machine] Daniel ﷺ was the first to question the witnesses. He said to one of them, "What did you see and what did you witness?" He replied, "I bear witness that I saw a lily committing adultery in the garden with a young man." Daniel asked, "In which place?" He answered, "Under the apricot tree." Then, he called upon the other witness and asked, "What do you testify?" He said, "I bear witness that I saw a lily committing adultery in the garden under the apple tree." Then, Daniel invoked God against both of them and a fire came from the sky and burned them, and God cleared the innocence of the lily.  

البيهقي:١٧٠٤٥أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ أَبُو الْوَلِيدِ ثنا مُحَمَّدُ بْنُ هَارُونَ ثنا عُثْمَانُ بْنُ سَعِيدٍ عَنْ مُوسَى بْنِ إِسْمَاعِيلَ عَنْ أَبِي عَوَانَةَ عَنْ إِسْمَاعِيلَ بْنِ سَالِمٍ عَنْ أَبِي إِدْرِيسَ فِي قِصَّةِ سَوْسَنَ قَالَ

كَانَ دَانْيَالُ عَلَيْهِ السَّلَامُ أَوَّلَ مَنْ فَرَّقَ بَيْنَ الشُّهُودِ فَقَالَ لِأَحَدِهِمَا مَا الَّذِي رَأَيْتَ وَمَا الَّذِي شَهِدْتَهُ؟ قَالَ أَشْهَدُ أَنِّي رَأَيْتُ سَوْسَنَ تَزْنِي فِي الْبُسْتَانِ بِرَجُلٍ شَابٍّ قَالَ فِي أِيِّ مَكَانٍ؟ قَالَ تَحْتَ شَجَرَةِ الْكُمَّثْرَى ثُمَّ دَعَا بِالْآخَرِ فَقَالَ مَا تَشْهَدُ؟ قَالَ أَشْهَدُ أَنِّي أَبْصَرْتُ سَوْسَنَ تَزْنِي فِي الْبُسْتَانِ تَحْتَ شَجَرَةِ التُّفَّاحِ قَالَ فَدَعَا اللهَ عَلَيْهِمَا فَجَاءَتْ مِنَ السَّمَاءِ نَارٌ فَأََحْرَقَتْهُمَا وَأَبْرَأَ اللهُ سَوْسَنَ
