55. Prescribed Punishments
٥٥۔ كِتَابُ الْحُدُودِ
[Machine] The Messenger of Allah ﷺ said, "Keep the limits away from the Muslims as much as you can. If you find a way out for the Muslim, then let him go. Indeed, it is better for the leader to make a mistake in forgiveness than to make a mistake in punishment." This was narrated by Wakee' from Yazid bin Ziyad, who reported it from Aisha. Abu Abdullah Al-Hafiz informed us that Abu Al-Walid Al-Faqih narrated to him from Muhammad bin Ahmad bin Zuheir, who reported it from Abdullah bin Hashim, who reported it from Wakee', who mentioned it from Yazid, and he narrated it in a way that was attributed to Yazid bin Ziyad Al-Shami, from Al-Zuhri. This narration has a weakness. The narration of Wakee' is closer to correctness, and Allah knows best. Rashdeen bin Saad narrated it from Aqeel, from Al-Zuhri, in a marfu' (elevated) form. Rashdeen is weak.
قَالَ رَسُولُ اللهِ ﷺ ادْرءُوا الْحُدُودَ عَنِ الْمُسْلِمِينَ مَا اسْتَطَعْتُمْ فَإِنْ وَجَدْتُمْ لِلْمُسْلِمِ مَخْرَجًا فَخَلُّوا سَبِيلَهُ فَإِنَّ الْإِمَامَ أَنْ يُخْطِئَ فِي الْعَفْوِ خَيْرٌ لَهُ مِنْ أَنْ يُخْطِيءَ فِي الْعُقُوبَةِ 17058 وَرَوَاهُ وَكِيعٌ عَنْ يَزِيدَ بْنِ زِيَادٍ مَوْقُوفًا عَلَى عَائِشَةَ أَخْبَرَنَاهُ أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ أَبُو الْوَلِيدِ الْفَقِيهُ ثنا مُحَمَّدُ بْنُ أَحْمَدَ بْنِ زُهَيْرٍ ثنا عَبْدُ اللهِ بْنُ هَاشِمٍ ثنا وَكِيعٌ عَنْ يَزِيدَ فَذَكَرَهُ مَوْقُوفًا تَفَرَّدَ بِهِ يَزِيدُ بْنُ زِيَادٍ الشَّامِيُّ عَنِ الزُّهْرِيِّ وَفِيهِ ضَعْفٌ وَرِوَايَةُ وَكِيعٍ أَقْرَبُ إِلَى الصَّوَابِ وَاللهُ أَعْلَمُ وَرَوَاهُ رِشْدِينُ بْنُ سَعْدٍ عَنْ عَقِيلٍ عَنِ الزُّهْرِيِّ مَرْفُوعًا وَرِشْدِينُ ضَعِيفٌ
[Machine] I heard the Messenger of Allah ﷺ saying, "Keep the boundaries in this chain weak."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ ادْرَءُوا الْحُدُودَ فِي هَذَا الْإِسْنَادِ ضَعْفٌ
[Machine] The Messenger of Allah ﷺ said "Prevent the violation of boundaries, and it is not appropriate for the leader to disregard the boundaries." Al-Bukhari said that Al-Mukhtar ibn Nafi' said "It is an invalid hadith."
قَالَ رَسُولُ اللهِ ﷺ ادْرَءُوا الْحُدُودَ وَلَا يَنْبَغِي لِلْإِمَامِ أَنْ يُعَطِّلَ الْحُدُودَ قَالَ الْبُخَارِيُّ الْمُخْتَارُ بْنُ نَافِعٍ مُنْكَرُ الْحَدِيثِ
[Machine] If you come to us, ask about your efforts in the covenant, for if I make a mistake in forgiveness, it is more beloved to me than making a mistake in punishment that is permanent and suspended.
إِذَا حَضَرْتُمُونَا فَاسْأَلُوا فِي الْعَهْدِ جَهْدَكُمْ فَإِنِّي إِنْ أُخْطِئْ فِي الْعَفْوِ أَحَبُّ إِلِيَّ مِنْ أَنْ أُخْطِئَ فِي الْعُقُوبَةِ مُنْقَطِعٌ وَمَوْقُوفٌ
[Machine] To make a mistake in punishment and when you find a way out for a Muslim, repel from him the severed and suspended punishment.
أَنْ تُخْطِئُوا فِي الْعُقُوبَةِ وَإِذَا وَجَدْتُمْ لِمُسْلِمٍ مَخْرَجًا فَادْرَءُوا عَنْهُ الْحَدَّ مُنْقَطِعٌ وَمَوْقُوفٌ
[Machine] "And Abdullah ibn Mas'ood and Uqbah ibn Aamir said, 'When there is doubt in the ruling, then ward it off with certainty.'"
وَعَبْدَ اللهِ بْنَ مَسْعُودٍ وَعُقْبَةَ بْنَ عَامِرٍ ؓ قَالُوا إِذَا اشْتُبِهَ الْحَدُّ فَادْرَءُوهُ مُنْقَطِعٌ
عَنِ الْمُسْلِمِينَ مَا اسْتَطَعْتُمْ هَذَا مَوْصُولٌ
[Machine] A man who used to gather firewood was freed by Omar bin Al-Khattab if he prayed, fasted, and owned a Nubian slave who also prayed and fasted but did not understand Arabic. She would only understand him through gestures. The man went to Omar and informed him of the situation, to which Omar replied, "You are not bringing any good to us." This scared the man, so Omar sent for the slave and asked her if she was pregnant. She confirmed and mentioned that it was from a man who paid her two silver coins. Upon hearing this, Omar called upon Ali, Uthman, and Abdur Rahman bin Awf and asked them to give their opinion. They were not present, so the slave asked them to make hand gestures. Ali and Abdur Rahman said that the punishment had already fallen upon her, and Uthman, who was sitting, agreed. She asked them to point towards her. Uthman replied, "Your brothers have already pointed at you," to which she requested Uthman to point at her. He responded by saying that he believed she acted as if she did not know. He also added that punishment is only applicable to those who are aware of the law. Omar agreed with this and thus, he flogged her a hundred times and then banished her for a year. The scholar (may Allah have mercy on him) commented that her punishment was stoning, but it was removed due to the suspicion of ignorance. Omar flogged and banished her as a form of punishment. And Allah knows best.
حَاطِبٌ فَأُعْتِقَ مَنْ صَلَّى مِنْ رَقِيقِهِ وَصَامَ وَكَانَتْ لَهُ أَمَةٌ نُوبِيَّةٌ قَدْ صَلَّتْ وَصَامَتْ وَهِيَ أَعْجَمِيَّةٌ لَمْ تَفْقَهْ فَلَمْ تَرُعْهُ إِلَّا بِحَبَلِهَا وَكَانَتْ ثَيِّبًا فَذَهَبَ إِلَى عُمَرَ ؓ فَحَدَّثَهُ فَقَالَ لَأَنْتَ الرَّجُلُ لَا تَأْتِي بِخَيْرٍ فَأَفْزَعَهُ ذَلِكَ فَأَرْسَلَ إِلَيْهَا عُمَرُ ؓ فَقَالَ أَحَبَلْتِ؟ فَقَالَتْ نَعَمْ مِنْ مَرْغُوشٍ بِدِرْهَمَيْنِ فَإِذَا هِيَ تَسْتَهِلُّ بِذَلِكَ لَا تَكْتُمُهُ قَالَ وَصَادَفَ عَلِيًّا وَعُثْمَانَ وَعَبْدَ الرَّحْمَنِ بْنَ عَوْفٍ ؓ فَقَالَتْ أَشِيرُوا عَلَيَّ وَكَانَ عُثْمَانُ ؓ جَالِسًا فَاضْطَجَعَ فَقَالَ عَلِيٌّ وَعَبْدُ الرَّحْمَنِ قَدْ وَقَعَ عَلَيْهَا الْحَدُّ فَقَالَ أَشِرْ عَلَيَّ يَا عُثْمَانُ فَقَالَ قَدْ أَشَارَ عَلَيْكَ أَخَوَاكَ قَالَ أَشِرْ عَلَيَّ أَنْتَ قَالَ أُرَاهَا تَسْتَهِلُّ بِهِ كَأَنَّهَا لَا تَعْلَمُهُ وَلَيْسَ الْحَدُّ إِلَّا عَلَى مَنْ عَلِمَهُ فَقَالَ صَدَقْتَ وَالَّذِي نَفْسِي بِيَدِهِ مَا الْحَدُّ إِلَّا عَلَى مَنْ عَلِمَهُ فَجَلَدَهَا عُمَرُ ؓ مِائَةً وَغَرَّبَهَا عَامًا قَالَ الشَّيْخُ رَحِمَهُ اللهُ كَانَ حَدُّهَا الرَّجْمَ فَكَأَنَّهُ ؓ دَرَأَ عَنْهَا حَدَّهَا لِلشُّبْهَةِ بِالْجَهَالَةِ وَجَلَدَهَا وَغَرَّبَهَا تَعْزِيرًا وَاللهُ أَعْلَمُ
[Machine] It was written to him about a man who was asked, "When did you start dealing with women?" He said, "Yesterday." They asked, "With whom?" He said, "My mother." He was told, "You are already dead." He said, "I did not know that Allah had forbidden adultery." So Umar ibn al-Khattab wrote that he should be sworn to not pursue what he did not know Allah had forbidden, and then he should be freed.
أَنَّهُ كُتِبَ إِلَيْهِ فِي رَجُلٍ قِيلَ لَهُ مَتَى عَهْدُكَ بِالنِّسَاءِ؟ فَقَالَ الْبَارِحَةَ قِيلَ بِمَنْ؟ قَالَ أُمِّ مَثْوَايَ فَقِيلَ لَهُ قَدْ هَلَكْتَ قَالَ مَا عَلِمْتُ أَنَّ اللهَ حَرَّمَ الزِّنَا فَكَتَبَ عُمَرُ ؓ أَنْ يُسْتَحْلَفَ مَا عَلِمَ أَنَّ اللهَ حَرَّمَ الزِّنَا ثُمَّ يُخَلَّى سَبِيلُهُ
