[Machine] A man who used to gather firewood was freed by Omar bin Al-Khattab if he prayed, fasted, and owned a Nubian slave who also prayed and fasted but did not understand Arabic. She would only understand him through gestures. The man went to Omar and informed him of the situation, to which Omar replied, "You are not bringing any good to us." This scared the man, so Omar sent for the slave and asked her if she was pregnant. She confirmed and mentioned that it was from a man who paid her two silver coins. Upon hearing this, Omar called upon Ali, Uthman, and Abdur Rahman bin Awf and asked them to give their opinion. They were not present, so the slave asked them to make hand gestures. Ali and Abdur Rahman said that the punishment had already fallen upon her, and Uthman, who was sitting, agreed. She asked them to point towards her. Uthman replied, "Your brothers have already pointed at you," to which she requested Uthman to point at her. He responded by saying that he believed she acted as if she did not know. He also added that punishment is only applicable to those who are aware of the law. Omar agreed with this and thus, he flogged her a hundred times and then banished her for a year. The scholar (may Allah have mercy on him) commented that her punishment was stoning, but it was removed due to the suspicion of ignorance. Omar flogged and banished her as a form of punishment. And Allah knows best.  

البيهقي:١٧٠٦٥أَخْبَرَنَا أَبُو بَكْرٍ أَحْمَدُ بْنُ الْحَسَنِ الْقَاضِي ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ أنبأ الرَّبِيعُ بْنُ سُلَيْمَانَ أنبأ الشَّافِعِيُّ أنبأ مُسْلِمُ بْنُ خَالِدٍ عَنِ ابْنِ جُرَيْجٍ عَنْ هِشَامِ بْنِ عُرْوَةَ عَنْ أَبِيهِ أَنَّ يَحْيَى بْنَ حَاطِبٍ حَدَّثَهُ قَالَ تُوُفِّيَ

حَاطِبٌ فَأُعْتِقَ مَنْ صَلَّى مِنْ رَقِيقِهِ وَصَامَ وَكَانَتْ لَهُ أَمَةٌ نُوبِيَّةٌ قَدْ صَلَّتْ وَصَامَتْ وَهِيَ أَعْجَمِيَّةٌ لَمْ تَفْقَهْ فَلَمْ تَرُعْهُ إِلَّا بِحَبَلِهَا وَكَانَتْ ثَيِّبًا فَذَهَبَ إِلَى عُمَرَ ؓ فَحَدَّثَهُ فَقَالَ لَأَنْتَ الرَّجُلُ لَا تَأْتِي بِخَيْرٍ فَأَفْزَعَهُ ذَلِكَ فَأَرْسَلَ إِلَيْهَا عُمَرُ ؓ فَقَالَ أَحَبَلْتِ؟ فَقَالَتْ نَعَمْ مِنْ مَرْغُوشٍ بِدِرْهَمَيْنِ فَإِذَا هِيَ تَسْتَهِلُّ بِذَلِكَ لَا تَكْتُمُهُ قَالَ وَصَادَفَ عَلِيًّا وَعُثْمَانَ وَعَبْدَ الرَّحْمَنِ بْنَ عَوْفٍ ؓ فَقَالَتْ أَشِيرُوا عَلَيَّ وَكَانَ عُثْمَانُ ؓ جَالِسًا فَاضْطَجَعَ فَقَالَ عَلِيٌّ وَعَبْدُ الرَّحْمَنِ قَدْ وَقَعَ عَلَيْهَا الْحَدُّ فَقَالَ أَشِرْ عَلَيَّ يَا عُثْمَانُ فَقَالَ قَدْ أَشَارَ عَلَيْكَ أَخَوَاكَ قَالَ أَشِرْ عَلَيَّ أَنْتَ قَالَ أُرَاهَا تَسْتَهِلُّ بِهِ كَأَنَّهَا لَا تَعْلَمُهُ وَلَيْسَ الْحَدُّ إِلَّا عَلَى مَنْ عَلِمَهُ فَقَالَ صَدَقْتَ وَالَّذِي نَفْسِي بِيَدِهِ مَا الْحَدُّ إِلَّا عَلَى مَنْ عَلِمَهُ فَجَلَدَهَا عُمَرُ ؓ مِائَةً وَغَرَّبَهَا عَامًا قَالَ الشَّيْخُ رَحِمَهُ اللهُ كَانَ حَدُّهَا الرَّجْمَ فَكَأَنَّهُ ؓ دَرَأَ عَنْهَا حَدَّهَا لِلشُّبْهَةِ بِالْجَهَالَةِ وَجَلَدَهَا وَغَرَّبَهَا تَعْزِيرًا وَاللهُ أَعْلَمُ

"عن يَحيى بنِ عبدِ الرَّحمن بنِ حَاطِبِ قَالَ: تُوُفِّى عَبدُ الرَّحمنِ ابنُ حَاطبٍ وَأعْتَقَ مَنْ صَلَّى مِن رَقِيقِهِ وصَامَ، وكَانتْ لَه نُوبِيَّةٌ قدْ صلَّتْ وصَامَتْ وهى أَعْجميَّةٌ لمَ تَفْقَه فَلَم يَرُعْهُ إلا حَبَلُها، وَكانَت ثَيِّبًا، فَذَهَب إلى عمرَ فَزِعًا، فَحدَّثه، فَقَالَ لَه عُمرُ. لأَنْتَ الرَّجُلُ لا تأتى بِخيرٍ، فأَفْزَعهُ ذَلك، فَأَرْسل إليهَا عمرُ فَسألَها فقَالَ: حَبِلْتِ؟ قَالتْ: نَعم، مِنْ مَرْعوشٍ بِدِرهَمَين، وإِذَا هِى تَسْتَهِلُّ بِذَلك لَا تَكْتمه، فَصَادَف عِندَه عَلِيًّا وَعثمَان وَعبدَ الرَّحمنِ بنَ عَوف فَقالَ، أَشيرُوا عَلَىَّ؛ فَقَالَ عَلى وعبد الرحمن: قَدْ وَقَعَ علَيها الحدُّ، فَقَالَ: أشِرْ عَلىَّ يَا عثمانُ. فَقَالَ: قَدْ أَشَارَ عَلَيْكَ أَخَواكَ، قالَ: أَشِرْ عَلَىَّ أَنْتَ. قال عُثمانُ: أَرَاها تَسْتَهِلُّ به كَأنَّها لَا تَعْلَمهُ ولَا تَرى بهِ بَأسًا، وَلَيس الْحدُّ إلَّا عَلَى مَنْ عَلِمَه، قَال: صَدقْتَ والذى نَفسِى بيدِه ما الحدُّ إلَّا عَلَى مَنْ علمَه".
