55. Prescribed Punishments
٥٥۔ كِتَابُ الْحُدُودِ
[Machine] A woman was forced during the time of the Prophet Muhammad ﷺ , and the punishment prescribed for her was waived. The Prophet Muhammad ﷺ upheld the decision that was in her favor and did not mention that he would give her a dowry. In this chain of narration, there is weakness from two aspects: one is that Al-Hajjaj did not hear from Abdul Jabbar, and the other is that Abdul Jabbar did not hear from his father. Al-Bukhari and others have reported this.
اسْتُكْرِهَتِ امْرَأَةٌ عَلَى عَهْدِ النَّبِيِّ ﷺ فَدَرَأَ عَنْهَا الْحَدَّ زَادَ غَيْرُهُ فِيهِ وَأَقَامَهُ عَلَى الَّذِي أَصَابَهَا وَلَمْ يَذْكُرْ أَنَّهُ جَعَلَ لَهُ مَهْرًا وَفِي هَذَا الْإِسْنَادِ ضَعْفٌ مِنْ وَجْهَيْنِ أَحَدُهُمَا أَنَّ الْحَجَّاجَ لَمْ يَسْمَعْ مِنْ عَبْدِ الْجَبَّارِ وَالْآخَرُ أَنَّ عَبْدَ الْجَبَّارِ لَمْ يَسْمَعْ مِنْ أَبِيهِ قَالَهُ الْبُخَارِيُّ وَغَيْرُهُ
[Machine] I was sleeping and didn't wake up until a man threw himself at me like a shooting star. 'Umar said, "She is a Yemeni woman who is young and beautiful, so leave her and make her happy."
إِنِّي كُنْتُ نَائِمَةً فَلَمْ أَسْتَيْقِظْ إِلَّا بِرَجُلٍ رَمَى فِيَّ مِثْلَ الشِّهَابِ فَقَالَ عُمَرُ ؓ يَمَانِيَةٌ نَؤُومَةٌ شَابَّةٌ فَخَلَّى عَنْهَا وَمَتَّعَهَا
[Machine] We were in Mecca when people gathered around a woman, nearly killing her, while saying that she had committed adultery. Umar ibn al-Khattab came with his people, and they praised her. Umar asked her to tell him about her situation. She said, "O leader of the believers, I was a woman who was attacked last night. I performed the night prayer, then I slept. When I woke up, a man was between my legs and he threw something on me like a shooting star, then he left." Umar said, "If anyone had killed this man who was between the two mountains or between the two trees, Abu Khalid would have doubted and Allah would have punished them. He left her alone and wrote to all regions, 'Do not kill anyone except with my permission.'"
إِنَّا لَبِمَكَّةَ إِذْ نَحْنُ بِامْرَأَةٍ اجْتَمَعَ عَلَيْهَا النَّاسُ حَتَّى كَادَ أَنْ يَقْتُلُوهَا وَهُمْ يَقُولُونَ زَنَتْ زَنَتْ فَأَتَى بِهَا عُمَرُ بْنُ الْخَطَّابِ ؓ وَهِيَ حُبْلَى وَجَاءَ مَعَهَا قَوْمُهَا فَأَثْنَوْا عَلَيْهَا بِخَيْرٍ فَقَالَ عُمَرُ أَخْبِرِينِي عَنْ أَمْرِكِ قَالَتْ يَا أَمِيرَ الْمُؤْمِنِينَ كُنْتُ امْرَأَةً أُصِيبُ مِنْ هَذَا اللَّيْلِ فَصَلَّيْتُ ذَاتَ لَيْلَةٍ ثُمَّ نِمْتُ وَقُمْتُ وَرَجُلٌ بَيْنَ رِجْلِيَّ فَقَذَفَ فِيَّ مِثْلَ الشِّهَابِ ثُمَّ ذَهَبَ فَقَالَ عُمَرُ ؓ لَوْ قَتَلَ هَذِهِ مَنْ بَيْنَ الْجَبَلَيْنِ أَوْ قَالَ الْأَخْشَبَيْنِ شَكَّ أَبُو خَالِدٍ لَعَذَّبَهُمُ اللهُ فَخَلَّى سَبِيلَهَا وَكَتَبَ إِلَى الْآفَاقِ أَنْ لَا تَقْتُلُوا أَحَدًا إِلَّا بِإِذْنِي
عَنْ صَفِيَّةَ بِنْتِ أَبِي عُبَيْدٍ
أَنْ نُخْلِيَ سَبِيلَهَا فَفَعَلَ
[Machine] And on the authority of Az-Zuhri, may Allah be pleased with him, the truthfulness and accuracy (of a narration) is (also) required.
وَعَنِ الزُّهْرِيِّ عَلَيْهِ الصَّدَاقُ وَالْحَدُّ
