55. Prescribed Punishments
٥٥۔ كِتَابُ الْحُدُودِ
[Machine] The Messenger of Allah, ﷺ , said: When a man says to another man, "O effeminate one," then lash him twenty times. And when a man says to another man, "O Jew," then lash him twenty times. Ibrahim al-Ash'hali singularly narrated this but he is not strong in his narration, and even if it is authentic, it is not applicable to punishment.
قَالَ رَسُولُ اللهِ ﷺ إِذَا قَالَ الرَّجُلُ لِلرَّجُلِ يَا مُخَنَّثُ فَاجْلِدُوهُ عِشْرِينَ وَإِذَا قَالَ الرَّجُلُ لِلرَّجُلِ يَا يَهُودِيُّ فَاجْلِدُوهُ عِشْرِينَ تَفَرَّدَ بِهِ إِبْرَاهِيمُ الْأَشْهَلِيُّ وَلَيْسَ بِالْقَوِيِّ وَهُوَ إِنْ صَحَّ مَحْمُولٌ عَلَى التَّعْزِيرِ
[Machine] Ali said about a man who says to another man, "O wicked one, O evildoer," he replied, "There is no set limit for him to be punished by the judge for what he has seen."
عَنْ عَلِيٍّ ؓ فِي الرَّجُلِ يَقُولُ لِلرَّجُلِ يَا خَبِيثُ يَا فَاسِقٌ قَالَ لَيْسَ عَلَيْهِ حَدٌّ مَعْلُومٌ يُعَزِّرُ الْوَالِي بِمَا رَأَى
[Machine] "And Abu Amr al-Adhib informed us that Abu Ahmad al-Ghitrifi informed us that Abu Ya'la narrated to us that Ubaydullah al-Qawariyyi narrated to us that Abu Awanah narrated from Abdul Malik bin Umayr from a sheikh from the people of Kufa who said, 'I heard Ali (may Allah be pleased with him) saying, "You asked me about a man who called another man a disbeliever, a wicked sinner, and a donkey, while there is no prescribed punishment for such words. However, there is a punishment from the authorities, so do not repeat it."'"

وَأَخْبَرَنَا أَبُو عَمْرٍو الْأَدِيبُ أنبأ أَبُو أَحْمَدَ الْغِطْرِيفُ أنبأ أَبُو يَعْلَى ثنا عُبَيْدُ اللهِ الْقَوَارِيرِيُّ ثنا أَبُو عَوَانَةَ عَنْ عَبْدِ الْمَلِكِ بْنِ عُمَيْرٍ عَنْ شَيْخٍ مِنْ أَهْلِ الْكُوفَةِ قَالَ سَمِعْتُ عَلِيًّا ؓ يَقُولُ إِنَّكُمْ سَأَلْتُمُونِي عَنِ الرَّجُلِ يَقُولُ لِلرَّجُلِ يَا كَافِرُ يَا فَاسِقُ يَا حِمَارُ وَلَيْسَ فِيهِ حَدٌّ وَإِنَّمَا فِيهِ عُقُوبَةٌ مِنَ السُّلْطَانِ فَلَا تَعُودُوا فَتَقُولُوا
[Machine] Umar and Uthman were being punished for insulting.
عُمَرُ وَعُثْمَانُ ؓ يُعَاقِبَانِ عَلَى الْهِجَاءِ
[Machine] "Umar ibn al-Khattab used to whip those who slandered the women of the Muslim community, and this punishment is confirmed and applicable if proven in court, and Allah knows best."
أَنَّ عُمَرَ بْنَ الْخَطَّابِ ؓ كَانَ يَجْلِدُ مَنْ يَفْتَرِي عَلَى نِسَاءِ أَهْلِ الْمِلَّةِ وَهَذَا مُنْقَطِعٌ وَهُوَ مَحْمُولٌ إِنْ ثَبَتَ عَلَى التَّعْزِيرِ وَاللهُ أَعْلَمُ
