[Machine] Abu Huraira, Zaid bin Khalid al-Juhani, and Shibl said, "We were with the Prophet ﷺ when a man came to him and said, 'I adjure you by Allah, do not judge between us except according to the Book of Allah and allow me to speak first.' The Prophet ﷺ said, 'Say your statement.' The man said, 'My son was a shepherd for this man's wife and he committed adultery with her. I redeemed myself from him by giving him a hundred sheep and a servant. Then I asked some knowledgeable people who informed me that he should be punished with a hundred lashes and one year of exile, and that his wife should be stoned to death.' The Messenger of Allah ﷺ said, 'By the One in Whose hand is my soul, I will judge between you according to the Book of Allah. The hundred sheep and the servant are to be returned to you, and your son is to be punished with a hundred lashes and one year of exile. And you, O Unays, go and announce that if the wife of this man admits (to the adultery), then stone her.' So Unays went and announced this, and the wife admitted (to the adultery), so he stoned her.' Sufyan and Unays both said, 'Unays was a man who had embraced Islam.'

عَنْ أَبِي هُرَيْرَةَ وَزَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ وَشِبْلٍ قَالُوا كُنَّا عِنْدَ النَّبِيِّ ﷺ فَقَامَ إِلَيْهِ رَجُلٌ فَقَالَ أَنْشُدُكَ اللهَ إِلَّا قَضَيْتَ بَيْنَنَا بِكِتَابِ اللهِ وَأْذَنْ لِي قَالَ قُلْ قَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا فَزَنَى بِامْرَأَتِهِ فَافْتَدَيْتُ مِنْهُ بِمِائَةِ شَاةٍ وَخَادِمٍ ثُمَّ سَأَلْتُ رِجَالًا مِنْ أَهْلِ الْعِلْمِ فَأَخْبَرُونِي أَنَّ عَلَيْهِ جَلْدَ مِائَةٍ وَتَغْرِيبَ عَامٍ وَأَنَّ عَلَى امْرَأَةِ هَذَا الرَّجْمَ فَقَالَ رَسُولُ اللهِ ﷺ وَالَّذِي نَفْسِي بِيَدِهِ لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللهِ ﷻ الْمِائَةُ شَاةٍ وَالْخَادِمُ رَدٌّ عَلَيْكَ وَعَلَى ابْنِكَ جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ وَاحِدٍ وَاغْدُ يَا أُنَيْسُ عَلَى امْرَأَةِ هَذَا فَإِنِ اعْتَرَفَتْ فَارْجُمْهَا فَغَدَا عَلَيْهَا فَاعْتَرَفَتْ فَرَجَمَهَا قَالَ سُفْيَانُ وَأُنَيْسٌ رَجُلٌ مِنْ أَسْلَمَ  

رَوَاهُ الْبُخَارِيُّ فِي الصَّحِيحِ عَنْ عَلِيِّ بْنِ عَبْدِ اللهِ وَغَيْرِهِ عَنْ سُفْيَانَ دُونَ ذِكْرِ شِبْلٍ وَالْحَافِظِ يَرَوْنَهُ خَطَأً فِي هَذَا الْحَدِيثِ 16970 وَقَدْ أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أَخْبَرَنِي أَبُو الْحَسَنِ أَحْمَدُ بْنُ مُحَمَّدِ بْنُ عُبْدُوسٍ قَالَ سَمِعْتُ عُثْمَانَ بْنَ سَعِيدٍ الدَّارِمِيَّ يَقُولُ سَمِعْتُ عَلِيَّ بْنَ عَبْدِ اللهِ بْنِ الْمَدِينِيِّ يَقُولُ فِي هَذَا الْحَدِيثِ قُلْتُ لِسُفْيَانَ إِنَّ بَعْضَهُمْ يَجْعَلُهُ عَنْ وَاحِدٍ قَالَ لَكِنِّي أُحَدِّثُكَ عَنِ الزُّهْرِيِّ قَالَ ثنا عُبَيْدُ اللهِ عَنْ أَبِي هُرَيْرَةَ وَزَيْدِ بْنِ خَالِدٍ وَشِبْلٍ كُنَّا عِنْدَ النَّبِيِّ ﷺ قَالَ عَلِيٌّ قَالَ سُفْيَانُ هَذَا حَفِظْنَاهُ مِنْ فِي الزُّهْرِيِّ وَلَعَمْرِي لَقَدْ أَتْقَنَّاهُ إِتْقَانًا حَسَنًا قَالَ الشَّيْخُ رَحِمَهُ اللهُ كَذَا قَالَ ابْنُ عُيَيْنَةَ وَأَمَّا الْبَاقُونَ مِنْ أَصْحَابِ الزُّهْرِيِّ نَحْوِ مَالِكِ بْنِ أَنَسٍ وَصَالِحِ بْنِ كَيْسَانَ وَعُقَيْلِ بْنِ خَالِدٍ وَشُعَيْبِ بْنِ أَبِي حَمْزَةَ وَمَعْمَرِ بْنِ رَاشِدٍ وَيُونُسَ بْنِ يَزِيدَ وَاللَّيْثِ بْنِ سَعْدٍ وَغَيْرِهِمْ فَلَمْ يَذْكُرُوا فِيهِ شِبْلًا فَاللهُ أَعْلَمُ

While we were with the Prophet ﷺ , a man stood up and said (to the Prophet ﷺ ), "I beseech you by Allah, that you should judge us according to Allah's Laws." Then the man's opponent who was wiser than him, got up saying (to Messenger of Allah ﷺ) "Judge us according to Allah's Law and kindly allow me (to speak)." The Prophet ﷺ said, "'Speak." He said, "My son was a laborer working for this man and he committed an illegal sexual intercourse with his wife, and I gave one-hundred sheep and a slave as a ransom for my son's sin. Then I asked a learned man about this case and he informed me that my son should receive one hundred lashes and be exiled for one year, and the man's wife should be stoned to death." The Prophet ﷺ said, "By Him in Whose Hand my soul is, I will judge you according to the Laws of Allah. Your one-hundred sheep and the slave are to be returned to you, and your son has to receive one-hundred lashes and be exiled for one year. O Unais! Go to the wife of this man, and if she confesses, then stone her to death." Unais went to her and she confessed. He then stoned her to death.

tirmidhi:1433Naṣr b. ʿAlī And Ghayr Wāḥid > Sufyān b. ʿUyaynah > al-Zuhrī

That he heard from Abu Hurairah, Zaid bin Khalid, and Shibl, that they were with the Prophet ﷺ and two men came to him disputing. So one of them stood before him and said: "I ask you by Allah, O Messenger of Allah! Only that you would judge between us by the book of Allah." So his disputant said - and he was more eloquent that him: "I agree of O Messenger of Allah! Judge between us by the Book of Allah, and allow me to speak. My son was a servant for this man and he committed adultery with his wife. So they told me that my son was to be stoned. I paid him one hundred female sheep and a female slave. Then I met some people from the people of knowledge and they said that my son was to be lashed one hundred times, and to be banished for a year and that stoning is only for this man's wife." So the Prophet ﷺ said: "By the One in Whose Hand is my soul! I will judge between you two by the Book of Allah. The one hundred female sheep and the female slave should be returned to you. For your son is one hundred lashes and banishment for a year. O Unais! Go to this Man's wife, and if she confesses then stone her." He went to her and she confessed, so he stoned her.  

الترمذي:١٤٣٣حَدَّثَنَا نَصْرُ بْنُ عَلِيٍّ وَغَيْرُ وَاحِدٍ حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ عَنِ الزُّهْرِيِّ

عَنْ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ بْنِ عُتْبَةَ سَمِعَهُ مِنْ أَبِي هُرَيْرَةَ وَزَيْدِ بْنِ خَالِدٍ وَشِبْلٍ أَنَّهُمْ كَانُوا عِنْدَ النَّبِيِّ ﷺ فَأَتَاهُ رَجُلاَنِ يَخْتَصِمَانِ فَقَامَ إِلَيْهِ أَحَدُهُمَا وَقَالَ أَنْشُدُكَ اللَّهَ يَا رَسُولَ اللَّهِ لَمَّا قَضَيْتَ بَيْنَنَا بِكِتَابِ اللَّهِ فَقَالَ خَصْمُهُ وَكَانَ أَفْقَهَ مِنْهُ أَجَلْ يَا رَسُولَ اللَّهِ اقْضِ بَيْنَنَا بِكِتَابِ اللَّهِ وَائْذَنْ لِي فَأَتَكَلَّمَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا فَزَنَا بِامْرَأَتِهِ فَأَخْبَرُونِي أَنَّ عَلَى ابْنِي الرَّجْمَ فَفَدَيْتُ مِنْهُ بِمِائَةِ شَاةٍ وَخَادِمٍ ثُمَّ لَقِيتُ نَاسًا مِنْ أَهْلِ الْعِلْمِ فَزَعَمُوا أَنَّ عَلَى ابْنِي جَلْدَ مِائَةٍ وَتَغْرِيبَ عَامٍ وَإِنَّمَا الرَّجْمُ عَلَى امْرَأَةِ هَذَا فَقَالَ النَّبِيُّ ﷺ وَالَّذِي نَفْسِي بِيَدِهِ لأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللَّهِ الْمِائَةُ شَاةٍ وَالْخَادِمُ رَدٌّ عَلَيْكَ وَعَلَى ابْنِكَ جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ وَاغْدُ يَا أُنَيْسُ عَلَى امْرَأَةِ هَذَا فَإِنِ اعْتَرَفَتْ فَارْجُمْهَا فَغَدَا عَلَيْهَا فَاعْتَرَفَتْ فَرَجَمَهَا  

malik:41-6

Malik related to me from Ibn Shihab from Ubaydullah ibn Abdullah ibn Utba ibn Masud that Abu Hurayra and Zayd ibn Khalid al-Juhani informed him that two men brought a dispute to the Messenger of Allah ﷺ. One of them said, "Messenger of Allah! Judge between us by the Book of Allah!" The other said, and he was the wiser of the two, "Yes, Messenger of Allah. Judge between us by the Book of Allah and give me permission to speak." He said, "Speak." He said, "My son was hired by this person and he committed fornication with his wife. He told me that my son deserved stoning, and I ransomed him for one hundred sheep and a slave-girl. Then I asked the people of knowledge and they told me that my son deserved to be flogged with one hundred lashes and exiled for a year, and they informed me that the woman deserved to be stoned." The Messenger of Allah ﷺ said, "By him in whose Hand myself is, I will judge between you by the Book of Allah. As for your sheep and slave girl, they should be returned to you. Your son should have one hundred lashes and be exiled for a year." He ordered Unays al-Aslami to go to the wife of the other man and to stone her if she confessed . She confessed and he stoned her.  

مالك:٤١-٦حَدَّثَنِي مَالِكٌ عَنِ ابْنِ شِهَابٍ عَنْ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ بْنِ عُتْبَةَ بْنِ مَسْعُودٍ عَنْ أَبِي هُرَيْرَةَ وَزَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ أَنَّهُمَا أَخْبَرَاهُ

أَنَّ رَجُلَيْنِ اخْتَصَمَا إِلَى رَسُولِ اللَّهِ ﷺ فَقَالَ أَحَدُهُمَا يَا رَسُولَ اللَّهِ اقْضِ بَيْنَنَا بِكِتَابِ اللَّهِ وَقَالَ الآخَرُ وَهُوَ أَفْقَهُهُمَا أَجَلْ يَا رَسُولَ اللَّهِ فَاقْضِ بَيْنَنَا بِكِتَابِ اللَّهِ وَائْذَنْ لِي أَنْ أَتَكَلَّمَ قَالَ تَكَلَّمْ فَقَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا فَزَنَا بِامْرَأَتِهِ فَأَخْبَرَنِي أَنَّ عَلَى ابْنِي الرَّجْمَ فَافْتَدَيْتُ مِنْهُ بِمِائَةِ شَاةٍ وَبِجَارِيَةٍ لِي ثُمَّ إِنِّي سَأَلْتُ أَهْلَ الْعِلْمِ فَأَخْبَرُونِي أَنَّ مَا عَلَى ابْنِي جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ وَأَخْبَرُونِي أَنَّمَا الرَّجْمُ عَلَى امْرَأَتِهِ فَقَالَ رَسُولُ اللَّهِ أَمَا وَالَّذِي نَفْسِي بِيَدِهِ لأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللَّهِ أَمَّا غَنَمُكَ وَجَارِيَتُكَ فَرَدٌّ عَلَيْكَ وَجَلَدَ ابْنَهُ مِائَةً وَغَرَّبَهُ عَامًا وَأَمَرَ أُنَيْسًا الأَسْلَمِيَّ أَنْ يَأْتِيَ امْرَأَةَ الآخَرِ فَإِنِ اعْتَرَفَتْ رَجَمَهَا فَاعْتَرَفَتْ فَرَجَمَهَا

[Machine] "Indeed, the Prophet ﷺ said, 'Any woman who is married without the permission of her guardian, her marriage is invalid, and she is entitled to her dowry as long as she has received any part of it. If they dispute, the ruler is the guardian of one who has no guardian.' This has been confirmed through narrations from reliable sources, as the narrators have been documented to have heard each other's narrations. These narrations cannot be criticized based on the narration of Ibn 'Ulayyah and his questioning by Ibn Jurayj, as a trustworthy narrator may forget a hadith after narrating it, and this has been done by more than one memorizer of hadith. Al-Husayn ibn al-Hasan ibn Ayyub informed us, Abu Hatim Muhammad ibn Idris al-Razi said, "I heard Ahmad ibn Hanbal say, and it was mentioned in his presence that Ibn 'Ulayyah mentions a hadith from Ibn Jurayj regarding 'There is no marriage except with a guardian.' Ibn Jurayj said, 'I met al-Zuhri and asked him about it, but he did not know it well, and he praised Sulayman ibn Musa.' Ahmad ibn Hanbal said, 'Indeed, Ibn Jurayj has written books, and this is not mentioned in his books, meaning the narration of Ibn 'Ulayyah from Ibn Jurayj.' I heard Abu al-Abbas Muhammad ibn Ya'qub say, 'I heard al-Abbas ibn Muhammad al-Duri say, 'I heard Yahya ibn Ma'in say about the hadith 'There is no marriage except with a guardian,' which Ibn Jurayj narrates, so I said to him, 'Indeed, Ibn 'Ulayyah says this.' Ibn Jurayj said, 'I asked al-Zuhri about it, and he said, 'I do not remember it well.' Yahya ibn Ma'in said, 'No one says this except Ibn 'Ulayyah, and Ibn 'Ulayyah only presented the books of Ibn Jurayj to 'Abd al-Majid ibn 'Abd al-Aziz ibn Abi Rawwad, who corrected them for him, but he did not exert himself to preserve the hadith.'"

أَنَّ النَّبِيَّ ﷺ قَالَ «أَيُّمَا امْرَأَةٍ نُكِحَتْ بِغَيْرِ إِذْنِ وَلِيِّهَا فَنِكَاحُهَا بَاطِلٌ وَلَهَا مَهْرُهَا بِمَا أَصَابَ مِنْهَا فَإِنِ اشْتَجَرُوا فَالسُّلْطَانُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ» فَقَدْ صَحَّ وَثَبَتَ بِرِوَايَاتِ الْأَئِمَّةِ الْأَثْبَاتِ سَمَاعُ الرُّوَاةِ بَعْضُهُمْ مِنْ بَعْضٍ فَلَا تُعَلَّلُ هَذِهِ الرِّوَايَاتُ بِحَدِيثِ ابْنِ عُلَيَّةَ وَسُؤَالِهِ ابْنَ جُرَيْجٍ عَنْهُ وَقَوْلِهِ إِنِّي سَأَلْتُ الزُّهْرِيَّ عَنْهُ فَلَمْ يَعْرِفْهُ فَقَدْ يَنْسَى الثِّقَةُ الْحَافِظُ الْحَدِيثَ بَعْدَ أَنْ حَدَّثَ بِهِ وَقَدْ فَعَلَهُ غَيْرُ وَاحِدٍ مِنْ حُفَّاظِ الْحَدِيثِ أَخْبَرَنَا الْحُسَيْنُ بْنُ الْحَسَنِ بْنِ أَيُّوبَ ثنا أَبُو حَاتِمٍ مُحَمَّدُ بْنُ إِدْرِيسَ الرَّازِيُّ قَالَ سَمِعْتُ أَحْمَدَ بْنَ حَنْبَلٍ يَقُولُ وَذُكِرَ عِنْدَهُ أَنَّ ابْنَ عُلَيَّةَ يَذْكُرُ حَدِيثَ ابْنِ جُرَيْجٍ فِي «لَا نِكَاحَ إِلَّا بِوَلِيٍّ» قَالَ ابْنُ جُرَيْجٍ فَلَقِيتُ الزُّهْرِيَّ فَسَأَلْتُهُ عَنْهُ فَلَمْ يَعْرِفْهُ وَأَثْنَى عَلَى سُلَيْمَانَ بْنِ مُوسَى قَالَ أَحْمَدُ بْنُ حَنْبَلٍ إِنَّ ابْنَ جُرَيْجٍ لَهُ كُتُبْ مُدَوَّنَةٌ وَلَيْسَ هَذَا فِي كُتُبِهِ يَعْنِي حِكَايَةَ ابْنِ عُلَيَّةَ عَنِ ابْنِ جُرَيْجٍ سَمِعْتُ أَبَا الْعَبَّاسِ مُحَمَّدَ بْنَ يَعْقُوبَ يَقُولُ سَمِعْتُ الْعَبَّاسَ بْنَ مُحَمَّدٍ الدُّورِيَّ يَقُولُ سَمِعْتُ يَحْيَىَ بْنَ مَعِينٍ يَقُولُ فِي حَدِيثِ «لَا نِكَاحَ إِلَّا بِوَلِيٍّ» الَّذِي يَرْوِيهِ ابْنُ جُرَيْجٍ فَقُلْتُ لَهُ إِنَّ ابْنَ عُلَيَّةَ يَقُولُ قَالَ ابْنُ جُرَيْجٍ فَسَأَلْتُ عَنْهُ الزُّهْرِيَّ فَقَالَ لَسْتُ أَحْفَظُهُ فَقَالَ يَحْيَى بْنُ مَعِينٍ لَيْسَ يَقُولُ هَذَا إِلَّا ابْنُ عُلَيَّةَ وَإِنَّمَا عَرَضَ ابْنُ عُلَيَّةَ كُتُبَ ابْنِ جُرَيْجٍ عَلَى عَبْدِ الْمَجِيدِ بْنِ عَبْدِ الْعَزِيزِ بْنِ أَبِي رَوَّادٍ فَأَصْلَحَهَا لَهُ وَلَكِنْ لَمْ يَبْذُلْ نَفْسَهُ لِلْحَدِيثِ حَدَّثَنَا أَبُو عَبْدِ اللَّهِ مُحَمَّدُ بْنُ عَبْدِ اللَّهِ ثنا أَبُو بَكْرِ بْنُ رَجَاءٍ ثنا مُحَمَّدُ بْنُ الْمُصَفَّى ثنا بَقِيَّةُ ثنا شُعَيْبُ بْنُ أَبِي حَمْزَةَ قَالَ قَالَ لِيَ الزُّهْرِيُّ إِنَّ مَكْحُولًا يَأْتِينَا وَسُلَيْمَانُ بْنُ مُوسَى وَلَعَمْرُ اللَّهِ إِنَّ سُلَيْمَانَ بْنَ مُوسَى لَأَحْفَظُ الرَّجُلَيْنِ  

قَالَ الْحَاكِمُ «رَجَعْنَا إِلَى الْأَصْلِ الَّذِي لَمْ يَسَعِ الشَّيْخَيْنِ إِخْلَاءُ الصَّحِيحَيْنِ عَنْهُ وَهُوَ حَدِيثُ أَبِي إِسْحَاقَ عَنْ أَبِي بُرْدَةِ عَنْ أَبِي مُوسَى»

[Machine] Narrated Abu Hurayrah, Zayd ibn Khalid, and Shibl: We were with the Prophet ﷺ when a man came to him and said: "I adjure you by Allah, except what you have decreed among us with the Book of Allah." The Prophet ﷺ said: "Say." He said: "Indeed, my son was a shepherd for this man, and he committed adultery with his wife. So I ransomed myself from him with a hundred sheep and a servant, and they both informed me about stoning his son. So I ransomed him, and then I asked the knowledgeable men, and they informed me that there should be a hundred lashes and banishment for a year on my son." The Prophet ﷺ said to him: "By the One in whose hand is my soul, I will judge between you with the Book of Allah. The hundred sheep and the servant shall be returned to you, and your son shall be lashed a hundred times and banished for a year. Go, O Unais, and announce about this woman, for if she confesses, then stone her." So he went to her and she confessed, so he stoned her. Abu 'Abdur-Rahman said: We do not know anyone who narrated it from Sufyan on the authority of Shibil, except Malik, from Az-Zuhri, from 'Ubaidullah, from Abu Hurayrah and Zayd ibn Khalid. Bukayr ibn al-Ashajj narrated it from 'Amr ibn Shu'aib, from Az-Zuhri, from 'Ubaidullah ibn 'Abdullah, from Abu Hurayrah. And the hadith of Malik and 'Amr ibn Shu'aib is more correct than the narration of Ibn 'Uyaynah and Shibl. Yunus ibn 'Abd al-A'la said: Ibn Wahb informed us, saying: I heard Malik ibn Anas say...

[Machine] Shuayb informed me and Abu Abdullah Al-Hafidh and Abu Bakr Al-Qadi said: Abu Al-Abbas Muhammad bin Ya'qub narrated to me, who narrated to me Muhammad bin Khalid, who narrated to me Bishr bin Shuayb, from his father, from Al-Zuhri, who informed me that Ubaidullah bin Abdullah bin Utbah said: Abdullah bin Abbas arrived where Ibn Aqil bin Qais bin Hisn was staying, and he was one of the chosen ones who Umar bin Khattab respected. The reciters were companions of Umar's meetings and consultations, whether they were elders or young men. Uyaina said to his nephew, "O my nephew, do you have any influence with this leader, so that you can seek permission for me to meet him?" He replied, "I will seek permission for you to meet him." Ibn Abbas said, "Al-Hurr sought permission for Uyaina, and Umar gave him permission. When Uyaina entered, Umar said to him, "O son of Al-Khattab, you do not give us what is due and you do not judge among us with justice." Umar became so angry that he intended to harm him. Al-Hurr said to him, "O Commander of the Believers, Allah, the Exalted, said to His Prophet ﷺ , 'Take to forgiveness and enjoin what is good and turn away from the ignorant.' (Quran 7:199). And this behavior is from the ignorant." Uyaina said, "By Allah, Umar did not exceed those limits when he recited it on him (i.e., Uyaina). He was always strict in adhering to the words of Allah, while the decision is for the ruler, Abu Abdullah."

رَوَاهُ الْبُخَارِيُّ فِي الصَّحِيحِ عَنْ أَبِي الْيَمَانِ وَرَوَيْنَا فِي كِتَابِ الزَّكَاةِ عَنْ أَبِي هُرَيْرَةَ أَنَّ النَّبِيَّ ﷺ قَالَ مَا نَقَصَتْ صَدَقَةٌ مِنْ مَالٍ وَمَا زَادَ اللهُ بِعَفْوٍ إِلَّا عِزًّا وَمَا تَوَاضَعَ أَحَدٌ لِلَّهِ إِلَّا رَفَعَهُ وَقَدْ رَوَيْنَا عَنْ عَائِشَةَ أَنَّ النَّبِيَّ ﷺ قَالَ أَقِيلُوا ذَوِي الْهَيْئَاتِ عَثَرَاتِهِمْ مَا لَمْ يَكُنْ حَدًّا وَهُوَ فِي كِتَابِ الْحُدُودِ

[Machine] The Prophet ﷺ once stoned a person who had committed adultery and then said, "Stay away from this filth that Allah has forbidden. Whoever has sinned, let them conceal it with the concealment of Allah." 17602 Abu Al-Hasan bin Abdan informed us that Ahmad bin Ubaid narrated to him from Umar bin Ahmad bin Bishr from Harun bin Musa Al-Farwi from Abu Damrah from Yahya bin Said from Abdullah bin Dinar who mentioned it with similar words: "Increase in repentance to Allah, for whoever shows us his sins, we will enforce the punishment of Allah's Book upon him." Ash-Shafi'i may Allah have mercy on him stated that it has been narrated that during the time of the Prophet ﷺ , Abu Bakr (may Allah be pleased with him) instructed a man who had been punished with stoning to hide himself, and Umar (may Allah be pleased with him) also instructed the same. The Sheikh, may Allah have mercy on him, said, "The chain of narration for this hadith in the chapter of confessing adultery has already passed." 17603 Abu Zakariya bin Abi Ishaq informed us that Abu Abdullah Muhammad bin Ya'qub narrated to him from Muhammad bin Abdul Wahhab, who narrated from Jafar bin Awn, who narrated from Abdul Rahman bin Abdullah, who narrated from Wasil, who said, "Umar (may Allah be pleased with him) entered upon a woman who had committed adultery and mentioned the hadith." He said, "Then Umar (may Allah be pleased with him) said, 'Indeed, Allah has made four witnesses a concealment for you from your indecencies, so do not infringe upon the concealment of Allah. Verily, if Allah willed, He could have made it one true witness or one false witness." Ash-Shafi'i (may Allah have mercy on him) said, "We prefer for the one who has been punished to hide himself and fear Allah, and not to return to the disobedience of Allah. Verily, Allah accepts repentance from His servants."

أَنَّ رَسُولَ اللهِ ﷺ بَعْدَ أَنْ رَجَمَ الْأَسْلَمِيَّ قَالَ اجْتَنِبُوا هَذِهِ الْقَاذُورَةَ الَّتِي نَهَى الله عَنْهَا فَمَنْ أَلَمَّ فَلْيَسْتَتِرْ بِسِتْرِ اللهِ ﷻ 17602 وَأَخْبَرَنَا أَبُو الْحَسَنِ بْنُ عَبْدَانَ أنبأ أَحْمَدُ بْنُ عُبَيْدٍ ثنا عُمَرُ بْنُ أَحْمَدَ بْنِ بِشْرٍ ثنا هَارُونُ بْنُ مُوسَى الْفَرْوِيُّ ثنا أَبُو ضَمْرَةَ عَنْ يَحْيَى بْنِ سَعِيدٍ عَنْ عَبْدِ اللهِ بْنِ دِينَارٍ فَذَكَرَهُ بِمِثْلِهِ زَادَ وَلْيَتُبْ إِلَى اللهِ فَإِنَّهُ مَنْ يُبْدِ لَنَا صَفْحَتَهُ نُقِمْ كِتَابَ اللهِ عَلَيْهِ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ وَرُوِيَ أَنَّ أَبَا بَكْرٍ ؓ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ أَمَرَ رَجُلًا أَصَابَ حَدًّا بِالِاسْتِتَارِ وَأَنَّ عُمَرَ ؓ أَمَرَهُ بِهِ قَالَ الشَّيْخُ رَحِمَهُ اللهُ قَدْ مَضَى إِسْنَادُ هَذَا الْحَدِيثِ فِي بَابِ الِاعْتِرَافِ بِالزِّنَا 17603 وَأَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ أنبأ أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ عَبْدِ الْوَهَّابِ أنبأ جَعْفَرُ بْنُ عَوْنٍ أنبأ عَبْدُ الرَّحْمَنِ بْنُ عَبْدِ اللهِ عَنْ وَاصِلٍ عَنِ الْمَعْرُورِ قَالَ أُتِيَ عُمَرُ ؓ بِامْرَأَةٍ قَدْ زَنَتْ فَذَكَرَ الْحَدِيثَ قَالَ ثُمَّ قَالَ عُمَرُ ؓ إِنَّمَا جَعَلَ اللهُ أَرْبَعَةَ شُهَدَاءَ سِتْرًا يَسْتُرُكُمْ دُونَ فَوَاحِشِكُمْ فَلَا يَتَطَلَّعَنَّ سِتْرَ اللهِ أَحَدٌ أَلَا وَإِنَّ اللهَ لَوْ شَاءَ لَجَعَلَهُ وَاحِدًا صَادِقًا أَوْ كَاذِبًا قَالَ الشَّافِعِيُّ وَنَحْنُ نُحِبُّ لِمَنْ أَصَابَ الْحَدَّ أَنْ يَسْتَتِرَ وَأَنْ يَتَّقِيَ اللهَ وَلَا يَعُودَ لِمَعْصِيَةِ اللهِ فَإِنَّ اللهَ يَقْبَلُ التَّوْبَةَ عَنْ عِبَادِهِ

Two men brought a dispute before the Messenger of Allah ﷺ. One of them said: Pronounce judgement between us in accordance with Allah’s Book, Messenger of Allah! The other who had more understanding said: Yes, Messenger of Allah! Pronounce judgement between us in accordance with Allah’s Book, and allow me to speak. He (the Prophet) said: Speak, He then said: My son who was a hired servant with this(man) committed fornication with his wife, and when I was told that my son must be stoned to death, I ransomed him with a hundred sheep and a slave girl of mine; but when I asked the learned, they told me that my son should receive a hundred lashes and be banished for a year, and that stoning to death applied only to man’s wife. The apostle of Allah ﷺ replied: By him in whose hand my soul is, I shall certainly pronounce judgment between you in accordance with Allah’s Book. Your sheep and your slave girl must be returned to you, and your son shall receive a hundred lashes and be banished for a year. And he commanded Unias al-Aslami go to that man’s wife, and if she confessed, he should stone her to death. She confessed and he stoned her. (Using translation from Abū Dāʾūd 4445)

أَنَّ رَجُلَيْنِ اخْتَصَمَا إِلَى رَسُولِ اللهِ ﷺ فَقَالَ أَحَدُهُمَا يَا رَسُولَ اللهِ اقْضِ بَيْنَنَا بِكِتَابِ اللهِ وَقَالَ الْآخَرُ وَكَانَ أَفْقَهَهُمَا أَجَلْ يَا رَسُولَ اللهِ اقْضِ بَيْنَنَا بِكِتَابِ اللهِ وَأْذَنْ لِي فِي أَنْ أَتَكَلَّمَ قَالَ تَكَلَّمْ قَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا فَزَنَى بِامْرَأَتِهِ فَأَخْبَرُونِي أَنَّ عَلَى ابْنِي الرَّجْمَ فَافْتَدَيْتُ مِنْهُ بِمِائَةِ شَاةٍ وَجَارِيَةٍ لِي ثُمَّ إِنِّي سَأَلْتُ أَهْلَ الْعِلْمِ فأَخْبَرُونِي أَنَّ عَلَى ابْنِي جَلْدَ مِائَةٍ وَتَغْرِيبَ عَامٍ إِنَّمَا الرَّجْمُ عَلَى امْرَأَتِهِ فَقَالَ رَسُولُ اللهِ ﷺ أَمَا وَالَّذِي نَفْسِي بِيَدِهِ لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللهِ أَمَّا غَنَمُكَ وَجَارِيَتُكَ فَرَدٌّ إِلَيْكَ وَجَلَدَ ابْنَهُ مِائَةً وَغَرَّبَهُ عَامًا وَأَمَرَ أُنَيْسًا الْأَسْلَمِيَّ أَنْ يَأْتِيَ امْرَأَةَ الْآخَرِ فَإِنِ اعْتَرَفَتْ رَجَمَهَا فَاعْتَرَفَتْ فَرَجَمَهَا لَفْظُ حَدِيثِ الْقَعْنَبِيِّ وَزَادَ فِي حَدِيثِهِ وَالْعَسِيفُ الْأَجِيرُ 16918 وَأَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ الْفَضْلِ الْقَطَّانُ أنبأ عَبْدُ اللهِ بْنُ جَعْفَرٍ ثنا يَعْقُوبُ بْنُ سُفْيَانَ ثنا ابْنُ قَعْنَبٍ وَابْنُ بُكَيْرٍ عَنْ مَالِكٍ فَذَكَرَهُ بِإِسْنَادِهِ نَحْوَهُ قَالَ وَالْعَسِيفُ الْأَجِيرُ  

أَخْرَجَهُ الْبُخَارِيُّ فِي الصَّحِيحِ عَنِ ابْنِ يُوسُفَ وَابْنِ أَبِي أُوَيْسٍ عَنْ مَالِكٍ وَأَخْرَجَاهُ مِنْ أَوْجُهٍ أُخَرَ عَنِ الزُّهْرِيِّ وَحَدِيثُ الْغَامِدِيَّةِ وَالْجُهُنَيَّةِ دَلِيلٌ فِيهِ وَذَلِكَ يَرِدُ إِنْ شَاءَ اللهُ تَعَالَى

[Machine] Abu Huraira and Zaid ibn Khalid narrated that a man from the Bedouins came to the Messenger of Allah ﷺ and said, "O Messenger of Allah, I swear by Allah, except if Allah decides otherwise, then I will definitely be judged according to the Book of Allah." Another man, who was more knowledgeable than him, said, "Yes, judge between us according to the Book of Allah and give me permission." The Messenger of Allah ﷺ said, "Say what you have to say." He said, "My son was a shepherd and he committed adultery with his wife. I was informed that stoning was required for my son, so I ransomed him with one hundred sheep and a slave-girl. I asked the people of knowledge and they informed me that my son should be lashed one hundred times and exiled for one year, and that his wife should be stoned." The Messenger of Allah ﷺ said, "By the One in Whose Hand is my soul, I will judge between you according to the Book of Allah. The slave-girl and the sheep shall be returned to you, and your son shall be lashed one hundred times and exiled for one year. Go, O Unais, and deal with the matter of this woman, and if she confesses, then stone her." So, the next day she confessed and the Messenger of Allah ﷺ ordered that she be stoned.

[Machine] He was asked while on the pulpit about a man who divorced his wife three times, then someone else married her, closed the door, removed the veil, and revealed her face, then divorced her. He said, "She is not permissible for the first man until the other man tastes her honey." This is the wording of the Hadith of Al-'Abdiyy. Al-'Abdiyy also said it in his narration, as did Abu Ahmad Al-Zubayri. The authentic narration is from 'Abd Al-Rahman bin Mahdi, and it was narrated by Waki' once from Sufyan, who narrated from 'Alqamah, from Razeen bin Sulaiman Al-Ahmarri. He was contradicted by Shu'bah in his chain of narrators, so he narrated it from 'Alqamah bin Marthad, from Salim bin Razeen, from Salim bin 'Abdullah, from Sa'id bin Al-Musayyib, from Ibn 'Umar. The Prophet informed us of this and it was narrated by Abu 'Abdullah Al-Hafiz and Abu Bakr Ahmad bin Al-Hasan. They said, "Abu Al-Abbas Muhammad bin Ya'qub informed us, Muhammad bin Ishaq informed me, and I am the successor of Yahya bin Ma'in." They said, "Ghandar informed us, Shu'bah mentioned it to us, and I received it from Muhammad bin Isma'il Al-Bukhari that he weakened the Hadith of Shu'bah and Sufyan together. And Abi Zar'ah said that the Hadith of Sufyan is the most authentic."

رَوَاهُ قَيْس بْنِ الرَّبِيعِ فَقَالَ حَدَّثَنَا عَلْقَمَةٌ بْنِ مَرْثَد عَنْ رَزِينٍ الأَحْمَرِي قَالَ سَمِعْتُ عَبْدُ الله بْنَ عُمَرَ ؓ يقول سُئِلَ رَسُولَ اللهِ ﷺ وَهُوَ عَلَى الْمِنْبَرِ عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ فَبَانَتْ مِنْهُ فَذَكَرَهُ أَخْبَرَنَاه أَبُو مُحَمَّدٍ جَنَاحُ بْنُ نُذَيْرٍ الْمُحَارِبِيُّ بِالْكُوفَةِ أنا أَبُو جَعْفَرِ بْنُ دُحَيْمٍ نا أَحْمَدُ بْنُ حَازِمٍ نا مَالِكُ بْنُ إِسْمَاعِيلَ نا قَيْسٌ فَذَكَرَهُ وَكَانَ شُعْبَةُ يَقُولُ سُفْيَانُ أَحْفَظُ مِنِّي وَقَالَ يَحْيَى الْقَطَّانُ إِذَا اخْتَلَفَا أَخَذْتُ بِقَوْلِ سُفْيَانَ وَرُوِيَ فِي ذَلِكَ أَيْضًا عَنْ أَنَسِ بْنِ مَالِكٍ عَنِ النَّبِيِّ ﷺ

[Machine] "A Bedouin man from the tribe of Banu Fazara came to the Prophet ﷺ and said, 'Indeed, my wife has given birth to a dark-skinned boy.' The Prophet ﷺ said to him, 'Do you have any camels?' He replied, 'Yes.' The Prophet ﷺ asked, 'What are their colors?' He answered, 'Red.' The Prophet ﷺ then asked, 'Do any of them have white markings?' He replied, 'Yes, some of them have white markings.' The Prophet ﷺ said, 'Perhaps it is from the genes of one of them that the child inherited this.' The phrase 'perhaps it is from the genes of one of them' is a narration from Imam Shafi'i, and in the narration of Qutaiba, it mentions that a man from the tribe of Banu Fazara came to the Prophet ﷺ and said, 'Perhaps it is from the genes of one of them.'"  

البيهقي:١٥٣٦٣أَخْبَرَنَا أَبُو نَصْرٍ مُحَمَّدُ بْنُ عَلِيِّ بْنِ مُحَمَّدٍ الْفَقِيهُ الشِّيرَازِيُّ قَالَ ثنا أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ يَعْقُوبَ نا مُحَمَّدُ بْنُ شَاذَانَ نا قُتَيْبَةُ بْنُ سَعِيدٍ نا سُفْيَانُ ح وَأنا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ وَأَبُو بَكْرِ بْنُ الْحَسَنِ الْقَاضِي قَالَا نا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ أنا الرَّبِيعُ بْنُ سُلَيْمَانَ أنا الشَّافِعِيُّ أنا سُفْيَانُ عَنِ ابْنِ شِهَابٍ عَنِ ابْنِ الْمُسَيِّبِ عَنْ أَبِي هُرَيْرَةَ ؓ

أَنَّ أَعْرَابِيًّا مِنْ بَنِي فَزَارَةَ أَتَى النَّبِيَّ ﷺ فَقَالَ إِنَّ امْرَأَتِي وَلَدَتْ غُلَامًا أَسْوَدَ فَقَالَ لَهُ النَّبِيُّ ﷺ هَلْ لَكَ مِنْ إِبِلٍ؟ قَالَ نَعَمْ قَالَ فَمَا أَلْوَانُهَا؟ قَالَ حُمْرٌ قَالَ هَلْ فِيهَا مِنْ أَوْرَقَ؟ قَالَ إِنَّ فِيهَا لَوُرْقًا قَالَ فَأَنَّى أَصَابَهَا ذَلِكَ؟ قَالَ لَعَلَّهُ عِرْقٌ نَزَعَهُ فَقَالَ النَّبِيُّ ﷺ وَهَذَا لَعَلَّهُ نَزَعَهُ عِرْقٌ لَفْظُ حَدِيثِ الشَّافِعِيِّ وَفِي رِوَايَةِ قُتَيْبَةَ جَاءَ رَجُلٌ مِنْ بَنِي فَزَارَةَ إِلَى النَّبِيِّ ﷺ وَقَالَ عَسَى أَنْ يَكُونَ نَزَعَهُ عِرْقٌ  

رَوَاهُ مُسْلِمٌ فِي الصَّحِيحِ عَنْ قُتَيْبَةَ وَجَمَاعَةٍ 15364 وَرَوَاهُ مَعْمَرٌ عَنِ الزُّهْرِيِّ فَقَالَ فِي الْحَدِيثِ إِنَّ رَجُلًا قَالَ يَا رَسُولَ اللهِ إِنَّ امْرَأَتِي وَلَدَتْ غُلَامًا أَسْوَدَ وَهُوَ حِينَئِذٍ يُعَرِّضُ بِأَنْ يَنْفِيَهُ ثُمَّ ذَكَرَهُ بِمَعْنَاهُ أَخْبَرَنَاهُ أَبُو عَبْدِ اللهِ الْحَافِظُ أنا أَبُو الْفَضْلِ بْنُ إِبْرَاهِيمَ نا أَحْمَدُ بْنُ سَلَمَةَ نا إِسْحَاقُ بْنُ إِبْرَاهِيمَ أنا عَبْدُ الرَّزَّاقِ أنا مَعْمَرٌ فَذَكَرَهُ رَوَاهُ مُسْلِمٌ فِي الصَّحِيحِ عَنْ إِسْحَاقَ بْنِ إِبْرَاهِيمَ 15365 وَرَوَاهُ ابْنُ أَبِي ذِئْبٍ عَنِ الزُّهْرِيِّ بِمَعْنَى حَدِيثِ ابْنِ عُيَيْنَةَ وَزَادَ فِي آخِرِ الْحَدِيثِ فَلَمْ يُرَخِّصْ لَهُ رَسُولُ اللهِ ﷺ أَنْ يَنْتَفِيَ مِنْهُ أَخْبَرَنَا أَبُو بَكْرِ بْنُ فُورَكٍ أنا عَبْدُ اللهِ بْنُ جَعْفَرٍ نا يُونُسُ بْنُ حَبِيبٍ نا أَبُو دَاوُدَ نا ابْنُ أَبِي ذِئْبٍ عَنِ الزُّهْرِيِّ فَذَكَرَهُ 15366 وَرَوَاهُ يُونُسُ بْنُ يَزِيدَ عَنِ ابْنِ شِهَابٍ عَنْ أَبِي سَلَمَةَ عَنْ أَبِي هُرَيْرَةَ ؓ أَنَّ أَعْرَابِيًّا أَتَى النَّبِيَّ ﷺ فَقَالَ إِنَّ امْرَأَتِي وَلَدَتْ غُلَامًا أَسْوَدَ وَإِنِّي أَنْكَرْتُهُ ثُمَّ ذَكَرَ مَعْنَى حَدِيثِ سُفْيَانَ أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ نا إِسْمَاعِيلُ بْنُ أَحْمَدَ الْجُرْجَانِيُّ نا مُحَمَّدُ بْنُ الْحَسَنِ بْنِ قُتَيْبَةَ نا حَرْمَلَةُ نا ابْنُ وَهْبٍ أَخْبَرَنِي يُونُسُ بْنُ يَزِيدَ فَذَكَرَهُ رَوَاهُ مُسْلِمٌ فِي الصَّحِيحِ عَنْ حَرْمَلَةَ رَحِمَهُ اللهُ

A bedouin came to Messenger of Allah ﷺ and said, "O Allah's apostle! I ask you by Allah to judge My case according to Allah's Laws." His opponent, who was more learned than he, said, "Yes, judge between us according to Allah's Laws, and allow me to speak." Messenger of Allah ﷺ said, "Speak." He (i .e. the bedouin or the other man) said, "My son was working as a laborer for this (man) and he committed illegal sexual intercourse with his wife. The people told me that it was obligatory that my son should be stoned to death, so in lieu of that I ransomed my son by paying one hundred sheep and a slave girl. Then I asked the religious scholars about it, and they informed me that my son must be lashed one hundred lashes, and be exiled for one year, and the wife of this (man) must be stoned to death." Messenger of Allah ﷺ said, "By Him in Whose Hands my soul is, I will judge between you according to Allah's Laws. The slave-girl and the sheep are to be returned to you, your son is to receive a hundred lashes and be exiled for one year. You, Unais, go to the wife of this (man) and if she confesses her guilt, stone her to death." Unais went to that woman next morning and she confessed. عَنْ زَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ وَأَبِي هُرَيْرَةَ وَشِبْلٍ قَالُوا كُنَّا عِنْدَ النَّبِيِّ ﷺ فَقَامَ إِلَيْهِ رَجُلٌ فَقَالَ يَا رَسُولَ اللهِ أَنْشُدُكَ اللهَ إِلَّا قَضَيْتَ بَيْنَنَا بِكِتَابِ اللهِ فَقَامَ خَصْمُهُ وَكَانَ أَفْقَهَ مِنْهُ فَقَالَ أَجَلْ يَا رَسُولَ اللهِ اقْضِ بَيْنَنَا بِكِتَابِ اللهِ وَأْذَنْ فَلْأَقُلْ قَالَ قُلْ قَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا وَإِنَّهُ زَنَى بِامْرَأَتِهِ فَأُخْبِرْتُ أَنَّ عَلَى ابْنِي الرَّجْمَ فَافْتَدَيْتُ مِنْهُ بِمِائَةِ شَاةٍ وَخَادِمٍ ثُمَّ سَأَلْتُ رِجَالًا مِنْ أَهْلِ الْعِلْمِ فَأَخْبَرَنِي أَنَّ عَلَى ابْنِي جَلْدَ مِائَةٍ وَتَغْرِيبَ عَامٍ وَأَنَّ عَلَى امْرَأَةِ هَذَا الرَّجْمَ فَقَالَ النَّبِيُّ ﷺ وَالَّذِي نَفْسِي بِيَدِهِ لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللهِ الْمِائَةُ شَاةٍ وَالْخَادِمُ رَدٌّ عَلَيْكَ وَعَلَى ابْنِكَ جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ وَاغْدُ يَا أُنَيْسُ عَلَى امْرَأَةِ هَذَا فَإِنِ اعْتَرَفَتْ فَارْجُمْهَا قَالَ فَغَدَا عَلَيْهَا فَاعْتَرَفَتْ فَرَجَمَهَا قَالَ الْحُمَيْدِيُّ قَالَ سُفْيَانُ وَأُنَيْسٌ رَجُلٌ مِنْ أَسْلَمَ هَذَا لَفْظُ حَدِيثِ الْحُمَيْدِيِّ

[Machine] A man asked the Prophet ﷺ about having intercourse with women from behind or a man having intercourse with his wife from behind. The Prophet ﷺ said, "It is permissible." When the man left, he called him back or ordered someone to call him back, and he said, "How did you say it? In which of the two habitations? Or in which of the two cave-like structures? Or in which of the two orifices?" Meaning, from behind in the front orifice is fine, but from behind in the back orifice is not permissible. Indeed, Allah is not too shy to tell the truth. Do not have intercourse with women from behind." Al-Shafi'i said, "May Allah have mercy on my blind uncle, Thiqah, and 'Abdullah Ibn 'Ali, who is trustworthy. Muhammad informed me about it from Al-Ansari Al-Muaddith, who praised Khuzaymah, who is known to be a knowledgeable person. I don't dismiss it, rather I prohibit it." 14113 Al-Hafiz Abu Abdullah Abu Abdullah Ibn Muhammad Al-Saffar narrated to us that Hamad Ibn Muhammad Al-Shafi'i narrated to us that my blind uncle, Ibrahim Ibn Muhammad Ibn Al-Abbas, narrated to us that my grandfather, Muhammad Ibn 'Ali, said, "I was with Muhammad Ibn Ka'b Al-Quradhi when a man came to him and said, 'O Abu 'Amr, what do you say about having intercourse with a woman from behind?' He said, 'This is a Sheikh from the Quraysh, ask him.' He meant 'Abdullah Ibn 'Ali Ibn Al-Sahib. He said, 'I have never heard anything about it.' The man said, "O Allah, it is disgusting even if it is permissible." Then 'Abdullah Ibn 'Ali Ibn Al-Sahib met 'Amr Ibn Uhayhah Ibn Al-Julah and said to him, 'Have you heard anything about having intercourse with a woman from behind?' He said, 'I bear witness that I heard Khuzaymah Ibn Thabit Al-Ansari, whose testimony the Messenger of Allah valued as equivalent to the testimony of two men, say that a man came to the Prophet ﷺ and mentioned the rest of the Hadith similarly.' As for the chain of narrators of Abdullah Ibn 'Ali Ibn Al-Sahib, there is another chain of narrators."

أَنَّ رَجُلًا سَأَلَ النَّبِيَّ ﷺ عَنْ إِتْيَانِ النِّسَاءِ فِي أَدْبَارِهِنَّ أَوْ إِتْيَانِ الرَّجُلِ امْرَأَتَهُ فِي دُبُرِهَا فَقَالَ النَّبِيُّ ﷺ حَلَالٌ فَلَمَّا وَلَّى الرَّجُلُ دَعَاهُ أَوْ أَمَرَ بِهِ فَدُعِيَ فَقَالَ كَيْفَ قُلْتَ فِي أِيِّ الْخَرِبَتَيْنِ أَوْ فِي أِيِّ الْخَرَزَتَيْنِ أَوْ فِي أِيِّ الْخَصَفَتَيْنِ؟ أَمِنْ دُبُرِهَا فِي قُبُلِهَا فَنَعَمْ أَمَّا مِنْ دُبُرِهَا فِي دُبُرِهَا فَلَا إِنَّ اللهَ لَا يَسْتَحْيِي مِنَ الْحَقِّ لَا تَأْتُوا النِّسَاءَ فِي أَدْبَارِهِنَّ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ عَمِّي ثِقَةٌ وَعَبْدُ اللهِ بْنُ عَلِيٍّ ثِقَةٌ وَقَدْ أَخْبَرَنِي مُحَمَّدٌ عَنِ الْأَنْصَارِيِّ الْمُحَدِّثِ بِهَا أَنَّهُ أَثْنَى عَلَيْهِ خَيْرًا وَخُزَيْمَةُ مِمَّنْ لَا يَشُكُّ عَالِمٌ فِي ثِقَتِهِ فَلَسْتُ أُرَخِّصُ فِيهِ بَلْ أَنْهَى عَنْهُ 14113 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ عَبْدِ اللهِ الصَّفَّارُ ثنا أَبُو مُحَمَّدٍ حَمَدُ بْنُ مُحَمَّدٍ الشَّافِعِيُّ ثنا عَمِّي يَعْنِي إِبْرَاهِيمَ بْنَ مُحَمَّدِ بْنِ الْعَبَّاسِ ثنا جَدِّي مُحَمَّدُ بْنُ عَلِيٍّ قَالَ كُنْتُ عِنْدَ مُحَمَّدِ بْنِ كَعْبٍ الْقُرَظِيِّ فَجَاءَهُ رَجُلٌ فَقَالَ يَا أَبَا عَمْرٍو مَا تَقُولُ فِي إِتْيَانِ الْمَرْأَةِ فِي دُبُرِهَا؟ فَقَالَ هَذَا شَيْخٌ مِنْ قُرَيْشٍ فَسَلْهُ يَعْنِي عَبْدَ اللهِ بْنَ عَلِيِّ بْنِ السَّائِبِ قَالَ وَكَانَ عَبْدُ اللهِ لَمْ يَسْمَعْ فِي ذَلِكَ شَيْئًا قَالَ اللهُمَّ قَذَرٌ وَلَوْ كَانَ حَلَالًا ثُمَّ إِنَّ عَبْدَ اللهِ بْنَ عَلِيٍّ لَقِيَ عَمْرَو بْنَ أُحَيْحَةَ بْنِ الْجُلَاحِ فَقَالَ هَلْ سَمِعْتَ فِي إِتْيَانِ الْمَرْأَةِ فِي دُبُرِهَا شَيْئًا؟ فَقَالَ أَشْهَدُ لَسَمِعْتُ خُزَيْمَةَ بْنَ ثَابِتٍ الْأَنْصَارِيَّ الَّذِي جَعَلَ رَسُولُ اللهِ ﷺ شَهَادَتَهُ بِشَهَادَةِ رَجُلَيْنِ يَقُولُ جَاءَ رَجُلٌ إِلَى النَّبِيِّ ﷺ وَذَكَرَ بَاقِيَ الْحَدِيثِ بِنَحْوِهِ وَلِعَبْدِ اللهِ بْنِ عَلِيِّ بْنِ السَّائِبِ فِيهِ إِسْنَادٌ آخَرُ

Allah has made blind the hearts of some people as He has deprived them of eyesight that they give religious verdict in favour of temporary marriage, while he was alluding to a person (Ibn 'Abbas). Ibn Abbas called him and said: You are an uncouth person, devoid of sense. By my life, Mut'a was practised during the lifetime of the leader of the pious (he meant Messenger of Allah, may peace be upon him), and Ibn Zubair said to him: just do it yourselves, and by Allah, if you do that I will stone you with your stones. Ibn Shihab said. Khalid b. Muhajir b. Saifullah informed me: While I was sitting in the company of a person, a person came to him and he asked for a religious verdict about Mut'a and he permitted him to do it. Ibn Abu 'Amrah al-Ansari (Allah be pleased with him) said to him: Be gentle. It was permitted in- the early days of Islam, (for one) who was driven to it under the stress of necessity just as (the eating of) carrion and the blood and flesh of swine and then Allah intensified (the commands of) His religion and prohibited it (altogether). Ibn Shihab reported: Rabi' b. Sabra told me that his father (Sabra) said: I contracted temporary marriage with a woman of Banu 'Amir for two cloaks during the lifetime of Messenger of Allah ﷺ ; then he forbade us to do Mut'a. Ibn Shihab said: I heard Rabi' b. Sabra narrating it to Umar b. 'Abd al-'Aziz and I was sitting there. (Using translation from Muslim 1406k)

إِنَّ نَاسًا أَعْمَى اللهُ قُلُوبَهُمْ كَمَا أَعْمَى أَبْصَارَهُمْ يُفْتُونَ بِالْمُتْعَةِ وَيُعَرِّضُ بِالرَّجُلِ فَنَادَاهُ فَقَالَ إنك جِلْفٌ جَافٍ فَلَعَمْرِي لَقَدْ كَانَتِ الْمُتْعَةُ تُفْعَلُ فِي عَهْدِ إِمَامِ الْمُتَّقِينَ يُرِيدُ رَسُولَ اللهِ ﷺ فَقَالَ ابْنُ الزُّبَيْرِ فَجَرِّبْ بِنَفْسِكَ فَوَاللهِ لَئِنْ فَعَلْتَهَا لَأَرْجُمَنَّكَ بِأَحْجَارِكَ قَالَ ابْنُ شِهَابٍ فَأَخْبَرَنِي خَالِدُ بْنُ الْمُهَاجِرِ بْنِ سَيْفِ اللهِ أَنَّهُ بَيْنَمَا هُوَ جَالِسٌ عِنْدَ رَجُلٍ جَاءَهُ رَجُلٌ فَاسْتَفْتَاهُ فِي الْمُتْعَةِ فَقَالَ لَهُ ابْنُ أَبِي عَمْرَةَ الْأَنْصَارِيُّ مَهْلًا مَا هِيَ وَاللهِ لَقَدْ فُعِلَتْ فِي عَهْدِ إِمَامِ الْمُتَّقِينَ قَالَ ابْنُ أَبِي عَمْرَةَ إِنَّهَا كَانَتْ رُخْصَةً فِي أَوَّلِ الْإِسْلَامِ لِمَنْ يُضْطَرُّ إِلَيْهَا كَالْمَيْتَةِ وَالدَّمِ وَلَحْمِ الْخِنْزِيرِ ثُمَّ أَحْكَمَ اللهُ الدِّينَ وَنَهَى عَنْهَا قَالَ ابْنُ شِهَابٍ وَأَخْبَرَنِي الرَّبِيعُ بْنُ سَبْرَةَ الْجُهَنِيُّ أَنَّ أَبَاهُ قَالَ قَدْ كُنْتُ اسْتَمْتَعْتُ فِي عَهْدِ رَسُولِ اللهِ ﷺ مِنِ امْرَأَةٍ مِنْ بَنِي عَامِرٍ بِبُرْدَيْنِ أَحْمَرَيْنِ ثُمَّ نَهَانَا رَسُولُ اللهِ ﷺ عَنِ الْمُتْعَةِ قَالَ ابْنُ شِهَابٍ وَسَمِعْتُ الرَّبِيعَ بْنَ سَبْرَةَ يُحَدِّثُ ذَلِكَ عُمَرَ بْنَ عَبْدِ الْعَزِيزِ وَأَنَا جَالِسٌ  

رَوَاهُ مُسْلِمٌ فِي الصَّحِيحِ عَنْ حَرْمَلَةَ بْنِ يَحْيَى 14165 وَأَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ الْفَقِيهُ أنبأ أَبُو مُحَمَّدِ بْنُ حَيَّانَ أَبُو الشَّيْخِ ثنا إِبْرَاهِيمُ بْنُ مُحَمَّدِ بْنِ الْحَسَنِ ثنا أَحْمَدُ بْنُ سَعِيدٍ ثنا ابْنُ وَهْبٍ فَذَكَرَهُ بِنَحْوِهِ إِلَّا أَنَّهُ قَالَ يُعَرِّضُ بِابْنِ عَبَّاسٍ وَزَادَ فِي آخِرِهِ قَالَ ابْنُ شِهَابٍ وَأَخْبَرَنِي عُبَيْدُ اللهِ أَنَّ ابْنَ عَبَّاسٍ كَانَ يُفْتِي بِالْمُتْعَةِ وَيَغْمِصُ ذَلِكَ عَلَيْهِ أَهْلُ الْعِلْمِ فَأَبَى ابْنُ عَبَّاسٍ أَنْ يَنْتَكِلَ عَنْ ذَلِكَ حَتَّى طَفِقَ بَعْضُ الشُّعَرَاءِ يَقُولُ [البحر البسيط] يَا صَاحِ هَلْ لَكَ فِي فُتْيَا ابْنِ عَبَّاسِ هَلْ لَكَ فِي نَاعِمٍ خُودٍ مُبْتَلَّةٍ تَكُونُ مَثْوَاكَ حَتَّى مَصْدَرِ النَّاسِ؟ قَالَ فَازْدَادَ أَهْلُ الْعِلْمِ بِهَا قَذَرًا وَلَهَا بُغْضًا حِينَ قِيلَ فِيهَا الْأَشْعَارُ

[Machine] I was sitting with the Prophet ﷺ when a man from the people of Yemen came to him and said, "Indeed, three people from the people of Yemen have come to Ali and they are disputing with him over a child. They have agreed upon a woman in her state of purity." He (Ali) said to both of them, "You both claim the child is yours so each of you can have the child for six months." Then he said to both of them again, "You both claim the child is yours so each of you can have the child for six months." He (the man) said, "You are partners who dispute. I will be the arbitrator between you. Whoever I decide in favor of will have the child, and the other will have to pay two-thirds of the blood money." So, he (the arbitrator) made a decision in favor of the one he decided for, and the Messenger of Allah ﷺ laughed until his molars or canine teeth were visible  

البيهقي:٢١٢٨٢وَالْمَشْهُورُ فِي هَذَا الْبَابِ مَا أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو بَكْرٍ أَحْمَدُ بْنُ إِسْحَاقَ الْفَقِيهُ أنبأ أَبُو الْمُثَنَّى ثنا مُسَدَّدٌ ثنا يَحْيَى عَنِ الْأَجْلَحِ عَنِ الشَّعْبِيِّ عَنْ عَبْدِ اللهِ بْنِ الْخَلِيلِ عَنْ زَيْدِ بْنِ أَرْقَمَ قَالَ

كُنْتُ جَالِسًا عِنْدَ النَّبِيِّ ﷺ إِذْ جَاءَهُ رَجُلٌ مِنْ أَهْلِ الْيَمَنِ فَقَالَ إِنَّ ثَلَاثَةَ نَفَرٍ مِنْ أَهْلِ الْيَمَنِ أَتَوْا عَلِيًّا ؓ يَخْتَصِمُونَ إِلَيْهِ فِي وَلَدٍ وَقَدْ وَقَعُوا عَلَى امْرَأَةٍ فِي طُهْرٍ وَاحِدٍ فَقَالَ لِلِاثْنَيْنِ مِنْهُمَا طَيِّبَا بِالْوَلَدِ لِهَذَا فَغَلَبَا ثُمَّ قَالَ لِلِاثْنَيْنِ طَيِّبَا بِالْوَلَدِ لِهَذَا فَغَلَبَا فَقَالَ أَنْتُمْ شُرَكَاءُ مُتَشَاكِسُونَ إِنِّي مُقْرِعٌ بَيْنَكُمْ فَمَنْ قَرَعَ فَلَهُ الْوَلَدُ وَعَلَيْهِ لِصَاحِبَيْهِ ثُلُثَا الدِّيَةِ فَأَقْرَعَ بَيْنَهُمْ فَجَعَلَهُ لِمَنْ قَرَعَ فَضَحِكَ رَسُولُ اللهِ ﷺ حَتَّى بَدَتْ أَضْرَاسُهُ أَوْ قَالَ نَوَاجِذُهُ  

أَخْرَجَهُ أَبُو دَاوُدَ فِي كِتَابِ السُّنَنِ عَنْ مُسَدَّدٍ وَكَذَلِكَ

"عَن الزُّهْرِىِّ، عَنْ عُبَيْد الله، عَنْ أبى هُرَيْرَةَ وَزَيْدِ بْنِ خَالِدٍ، وَشِبْلٍ أَنَّهُمْ كَانُوا عِنْدَ النَّبِى ﷺ فَقَامَ رَجُلٌ مِنَ الأَعْرَابِ فَقَالَ: أَنْشُدُكَ الله إِلَّا قَضَيْتَ بَيْنَنَا بِكِتَابِ الله، فَقَالَ الخَصْمُ الآخَرُ وهُوَ أَفْقَهُ مِنهُ: نَعَمْ، فَاقْضِ بَيْنَنَا بِكِتَابِ الله وَائْذَنْ لِى حَتَّى أَقُولَ، قَالَ: قُلْ، قَالَ: إِنَّ ابْنِى كَانَ عَسِيفًا (*) عَلَى هَذَا، وَأَنَّهُ زَنَى بِامْرَأَتِهِ، فَأَخْبَرُونِى أَنَّ عَلَى ابْنِى الرَّجْمَ، فَافْتَدَيْتُ مِنْهُ بِمِائَةِ شَاةٍ وَخَادِمٍ، فَسَأَلْتُ رِجَالًا مِنْ أَهْلِ العِلْمِ فَأَخْبَرُونِى أن على ابْنى جَلْدَ مائة وتغريب عامٍ وأَنَّ عَلَى امْرَأَةِ هَذَا الرَّجْمَ، فَقَالَ النَبِىُّ ﷺ : والَّذِى نَفْسِى بِيَدِهِ لأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ الله، الْمِائَةُ شَاةٍ والْخَادِمُ رَدٌّ عَلَيْكَ، وعَلَى ابْنِكَ جَلْدُ مِائَةٍ وتَغْرِيبُ عَامٍ، وعَلَى امْرَأَةِ هَذَا الرَّجُلِ الرَّجْمُ، واغْدُ يَا أُنَيْسُ عَلَى امْرَأَةِ هَذَا فَإِنِ اعْتَرَفَتْ فَارْجُمْهَا، فَغَدَا عَلَيْهَا فَاعْتَرَفَتْ فَأَمَرَ بِهَا فَرُجِمَتْ".
