٢٩۔ كِتَابُ الْقَضَاءِ ص ١
The Prophet [SAW] said: "Those who are just and fair will be with Allah, Most High, on thrones of light, at the right hand of the Most Merciful, those who are just in their rulings and in their dealings with their families and those of whom they are in charge." Muhammad (one of the narrators) said in his Hadith: "And both of His hands are right hands." (Using translation from Nasāʾī 5379)
عَنِ النَّبِيِّ ﷺ قَالَ «إِنَّ الْمُقْسِطِينَ عِنْدَ اللهِ تَعَالَى عَلَى مَنَابِرَ مِنْ نُورٍ عَنْ يَمِينِ الرَّحْمَنِ الَّذِينَ يَعْدِلُونَ فِي حُكْمِهِمْ وَأَهْلِيهِمْ وَمَا وُلُّوا»
29.2 [Machine] Discussion of the differences regarding Al-Zuhri in this Hadith
٢٩۔٢ بَابُ ذِكْرِ الِاخْتِلَافِ عَلَى الزُّهْرِيِّ فِي هَذَا الْحَدِيثِ
[Machine] The Messenger of Allah ﷺ said, "Verily, those who are just and fair in the sight of Allah will be on pulpits of light on the Day of Resurrection, by the side of the Most Merciful, according to their justice and fairness in the world." Abu 'Abd al-Rahman said, "Shu'ayb ibn Abi Hamzah halted him there."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «إِنَّ الْمُقْسِطِينَ فِي اللهِ عَلَى مَنَابِرَ مِنْ نُورٍ يَوْمَ الْقِيَامَةِ بَيْنَ يَدَيِ الرَّحْمَنِ بِمَا أَقْسَطُوا فِي الدُّنْيَا» قَالَ أَبُو عَبْدِ الرَّحْمَنِ وَقَّفَهُ شُعَيْبُ بْنُ أَبِي حَمْزَةَ
29.3 [Machine] The Reward of Reaching a Verdict After Striving for Those Who are Able to Strive
٢٩۔٣ ثَوَابُ الْإِصَابَةِ فِي الْحُكْمِ بَعْدَ الِاجْتِهَادِ لِمَنْ لَهُ أَنْ يَجْتَهِدَ
[Machine] On the authority of the Messenger of Allah ﷺ , he said, "When a judge makes a ruling and strives to reach the correct decision, then if he is successful, he will receive two rewards. But if he strives and makes a mistake, he will receive one reward." Ibn al-Hadd reported to me that he narrated from Abu Bakr ibn Amr ibn Hazm, who said, "This is what Abu Salamah narrated to me from Abu Hurayrah." Isaac said, "I did not understand 'Amr ibn al-'Asi, who is 'Abd al-Aziz 5888." Ishaaq ibn Ibrahim reported to us that al-Muqri' said, "Haywah ibn Shurayh narrated to us from Yazid ibn al-Hadd." Both narrations are of equal strength in their chains of narration.
عَنْ رَسُولِ اللهِ ﷺ قَالَ «إِذَا حَكَمَ الْحَاكِمُ فَاجْتَهَدَ فَأَصَابَ فَلَهُ أَجْرَانِ وَإِذَا حَكَمَ فَاجْتَهَدَ فَأَخْطَأَ فَلَهُ أَجْرٌ وَاحِدٌ» قَالَ ابْنُ الْهَادِ فَحَدَّثْتُ أَبَا بَكْرِ بْنَ عَمْرِو بْنِ حَزْمٍ فَقَالَ هَكَذَا حَدَّثَنِي أَبُو سَلَمَةَ عَنْ أَبِي هُرَيْرَةَ قَالَ إِسْحَاقُ لَمْ أَفْهَمْ عَمْرَو بْنَ الْعَاصِي مَنْ عَبْدُ الْعَزِيزِ 5888 أَخْبَرَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ قَالَ أَخْبَرَنَا الْمُقْرِئُ قَالَ حَدَّثَنَا حَيْوَةُ بْنُ شُرَيْحٍ عَنْ يَزِيدَ بْنِ الْهَادِ كِلَا الْحَدِيثَيْنِ بِإِسْنَادِهِمَا سَوَاءٌ مِثْلَهُ
"The Messenger of Allah [SAW] said: 'If a judge passes judgment and strives to reach the right conclusion and gets it right, he will have two rewards; if he strives to reach the right conclusion but gets it wrong, he will still have one reward." (Using translation from Nasāʾī 5381)
قَالَ رَسُولُ اللهِ ﷺ «إِذَا حَكَمَ الْحَاكِمُ فَاجْتَهَدَ فَأَصَابَ فَلَهُ أَجْرَانِ وَإِذَا اجْتَهَدَ فَأَخْطَأَ فَلَهُ أَجْرٌ»
The Prophet ﷺ said, "Seven (people) will be shaded by Allah by His Shade on the Day of Resurrection when there will be no shade except His Shade. (They will be), a just ruler, a young man who has been brought up in the worship of Allah, a man who remembers Allah in seclusion and his eyes are then flooded with tears, a man whose heart is attached to mosques (offers his compulsory congregational prayers in the mosque), two men who love each other for Allah's Sake, a man who is called by a charming lady of noble birth to commit illegal sexual intercourse with her, and he says, 'I am afraid of Allah,' and (finally), a man who gives in charity so secretly that his left hand does not know what his right hand has given." أَنَّ رَسُولَ اللهِ ﷺ قَالَ سَبْعَةٌ يُظِلُّهُمُ اللهُ يَوْمَ الْقِيَامَةِ بِظِلِّهِ يَوْمَ لَا ظِلَّ إِلَّا ظِلُّهُ إِمَامٌ عَادِلٌ وَشَابٌّ نَشَأَ فِي عِبَادَةِ اللهِ وَرَجُلٌ ذَكَرَ اللهَ فِي خَلَاءٍ فَفَاضَتْ عَيْنَاهُ وَرَجُلٌ قَلْبُهُ مُعَلَّقٌ بِالْمَسْجِدِ وَرَجُلَانِ تَحَابَّا فِي اللهِ وَرَجُلٌ دَعَتْهُ امْرَأَةٌ ذَاتُ مَنْصِبٍ وَجَمَالٍ إِلَى نَفْسِهَا فَقَالَ إِنِّي أَخَافُ اللهَ وَرَجُلٌ تَصَدَّقَ بِصَدَقَةٍ فَأَخْفَاهَا حَتَّى لَا تَعْلَمَ شِمَالُهُ مَا صَنَعَتْ يَمِينُهُ
29.4 [Machine] The Mention of What Allah has Prepared for the Ignorant Ruler
٢٩۔٤ ذِكْرُ مَا أَعَدَّ اللهُ تَعَالَى لِلْحَاكِمِ الْجَاهِلِ
“Were it not for the Hadith of Ibn Buraidah from his father, from the Prophet ﷺ who said: 'Judges are of three types, two of whom will be in Hell and one will be in Paradise. The man who knows the truth and rules in accordance with it, will be in Paradise. The man who passes judgment on the people in ignorance will be in Hell' - we would have said that if the judge does his best he will be in Paradise.” (Using translation from Ibn Mājah 2315)
عَنْ رَسُولِ اللهِ ﷺ لَقُلْتُ إِنَّ الْقَاضِيَ إِذَا اجْتَهَدَ فَلَيْسَ عَلَيْهِ شَيْءٌ وَلَكِنْ قَالَ رَسُولُ اللهِ ﷺ «الْقُضَاةُ ثَلَاثَةٌ اثْنَانِ فِي النَّارِ وَوَاحِدٌ فِي الْجَنَّةِ رَجُلٌ عَرَفَ الْحَقَّ فَقَضَى بِهِ فَهُوَ فِي الْجَنَّةِ وَرَجُلٌ عَرَفَ الْحَقَّ فَلَمْ يَقْضِ بِهِ وَجَارَ فِي الْحُكْمِ فَهُوَ فِي النَّارِ وَرَجُلٌ لَمْ يَعْرِفِ الْحَقَّ فَقَضَى لِلنَّاسِ عَنْ جَهْلٍ فَهُوَ فِي النَّارِ»
29.5 [Machine] Intensification in Government
٢٩۔٥ التَّغْلِيظُ فِي الْحُكْمِ
The Prophet ﷺ said: He who has been appointed a judge has been killed without a knife. (Using translation from Abū Dāʾūd 3571)
عَنِ النَّبِيِّ ﷺ قَالَ «مَنْ جُعِلَ قَاضِيًا فَقَدْ ذُبِحَ بِغَيْرِ سِكِّينٍ»
[Machine] The Messenger of Allah ﷺ said, "Whoever is appointed to make a judgment, it is as if he was slaughtered with a knife." Abu Abdur Rahman Uthman ibn Muhammad al-Akhnasi said, "He is not strong in that sense, but we mentioned it so that Uthman does not leave the group and makes ibn Abi Dhi'b replace Sa'id."
قَالَ رَسُولُ اللهِ ﷺ «مَنِ اسْتُعْمِلَ عَلَى الْقَضَاءِ فَكَأَنَّمَا ذُبِحَ بِالسِّكِّينِ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ عُثْمَانُ بْنُ مُحَمَّدٍ الْأَخْنَسِيُّ لَيْسَ بِذَاكَ الْقَوِيِّ وَإِنَّمَا ذَكَرْنَا لِئَلَّا يَخْرُجَ عُثْمَانُ مِنَ الْوَسَطِ وَيَجْعَلَ ابْنُ أَبِي ذِئْبٍ عَنْ سَعِيدٍ
The Prophet ﷺ said: He who has been appointed a judge among the people has been killed without a knife. (Using translation from Abū Dāʾūd 3572)
عَنِ النَّبِيِّ ﷺ «مَنْ جُعِلَ قَاضِيًا بَيْنَ النَّاسِ فَقَدْ ذُبِحَ بِغَيْرِ سِكِّينٍ»
[Machine] The Prophet ﷺ said, "Whosoever is made a judge among the people, he is being slaughtered without a knife." Abu Salama said, "He mentioned this once or twice from Al-A'raj and Al-Maqburi."
عَنِ النَّبِيِّ ﷺ «مَنْ جُعِلَ قَاضِيًا بَيْنَ النَّاسِ فَقَدْ ذُبِحَ بِغَيْرِ سِكِّينٍ» قَالَ أَبُو سَلَمَةَ وَقَدْ ذَكَرَهُ مَرَّةً أَوْ مَرَّتَيْنِ عَنِ الْأَعْرَجِ وَالْمَقْبُرِيِّ
29.6 [Machine] The eagerness for the Emirate
٢٩۔٦ الْحِرْصُ عَلَى الْإِمَارَةِ
"You will become keen for positions of authority, but that will become a regret and loss. What a good life they will live, but how hard it will be for them when they die." (Using translation from Nasāʾī 4211)
عَنِ النَّبِيِّ ﷺ قَالَ «إِنَّكُمْ سَتَحْرِصُونَ عَلَى الْإِمَارَةِ وَإِنَّهَا سَتَكُونُ نَدَامَةً وَحَسْرَةً يَوْمَ الْقِيَامَةِ فَنِعْمَتِ الْمُرْضِعَةُ وَبِئْسَتِ الْفَاطِمَةُ»
The Prophet [SAW] said: "You will be keen for governorship but it will be regret and loss on the Day of Resurrection. What a good position it is when they are alive, but how miserable their state when they die (and leave it behind)." (Using translation from Nasāʾī 5385)
أَنَّهُ كَانَ يَقُولُ «إِنَّكُمْ سَتَحْرِصُونَ عَلَى الْإِمَارَةِ وَإِنَّهَا سَتَكُونُ حَسْرَةً وَنَدَامَةً يَوْمَ الْقِيَامَةِ فَنِعْمَتِ الْمُرْضِعَةُ وَبِئْسَتِ الْفَاطِمَةُ»
29.7 [Machine] Abandoning the Use of Those Who are Concerned About the Judiciary
٢٩۔٧ تَرْكُ اسْتِعْمَالِ مَنْ يَحْرِصُ عَلَى الْقَضَاءِ
[Machine] Two men from the Ash'ariyyin came to the Prophet ﷺ and they presented their actions. The Messenger of Allah ﷺ said, "Indeed, your brothers whom you seek are with me." But they did not find any support from them for anything. Abu Abdur-Rahman said, "Abbad ibn Al-Awwam caused a rift between his brother and Abu Burdah Qurrah ibn Bashir."
جَاءَ رَجُلَانِ مِنَ الْأَشْعَرِيِّينَ إِلَى النَّبِيِّ ﷺ فَجَعَلَا يُعَرِّضَانِ بِالْعَمَلِ فَقَالَ رَسُولُ اللهِ ﷺ «إِنَّ أَخْوَنَكُمْ عِنْدِي مَنْ طَلَبَهُ» فَمَا اسْتَعَانَ بِهِمَا عَلَى شَيْءٍ قَالَ أَبُو عَبْدِ الرَّحْمَنِ أَدْخَلَ عَبَّادُ بْنُ الْعَوَّامِ بَيْنَ أَخِيهِ وَبَيْنَ أَبِي بُرْدَةَ قُرَّةَ بْنَ بِشْرٍ
[Machine] I came to the Messenger of Allah ﷺ along with two men. One of them testified the Shahada (faith declaration) and said, "O Messenger of Allah, we have come to assist you in some of your work." Then, the other man testified the Shahada as well. The Messenger of Allah ﷺ said the same words as the first man. He ﷺ said, "Indeed, your brothers whom you seek are present with me." However, he did not seek their assistance in anything until he passed away.
أَتَيْتُ رَسُولَ اللهِ ﷺ أَنَا وَرَجُلَانِ فَتَشَهَّدَ أَحَدُهُمَا وَقَالَ يَا رَسُولَ اللهِ جِئْنَا تَسْتَعِينُ بِنَا عَلَى بَعْضِ عَمَلِكَ وَتَشَهَّدَ الْآخَرُ فَقَالَ مِثْلَ مَقَالَتِهِ فَقَالَ رَسُولُ اللهِ ﷺ «إِنَّ أَخْوَنَكُمْ عِنْدِي مَنْ يَطْلُبُهُ» فَلَمْ يَسْتَعِنْ بِهِمَا فِي شَيْءٍ حَتَّى قُبِضَ
"I came to the Prophet ﷺ when he was using the Siwak and with me were two men of the Ash'aris - one on my right and the other on my left - who were seeking to be appointed as officials. I said: 'By the One Who sent you as a Prophet with the truth, they did not tell me why they wanted to come with me and I did not realize that they were seeking to be appointed as officials.' And I could see his Siwak beneath his lip, then it slipped and he said: 'We do not' - or; 'We will never appoint as an official anyone who seeks that. Rather you should go.'" So he sent his (Abu Musa) to Yemen, then he sent Mu'adh bin Jabal to go after him - may Allah be pleased with them. (Using translation from Nasāʾī 4)
أَقْبَلْتُ عَلَى النَّبِيِّ ﷺ وَمَعِي رَجُلَانِ مِنَ الْأَشْعَرِيِّيِّنَ أَحَدُهُمَا عَنْ يَمِينِي وَالْآخَرُ عَنْ يَسَارِي ورَسُولُ اللهِ ﷺ يَسْتَاكُ فَكِلَاهُمَا سَأَلَ الْعَمَلَ قُلْتُ وَالَّذِي بَعَثَكَ بِالْحَقِّ مَا أَطْلَعَانِي عَلَى مَا فِي أَنْفُسِهِمَا وَمَا شَعَرْتُ أَنَّهُمَا يَطْلُبَانِ الْعَمَلَ فَكَأَنِّي أَنْظُرُ إِلَى سِوَاكِهِ تَحْتَ شَفَتِهِ قَلُصَتْ قَالَ «إِنَّا لَا أَوْ لَنْ نَسْتَعْمِلَ عَلَى عَمَلِنَا مَنْ أَرَادَهُ وَلَكِنْ اذْهَبْ أَنْتَ» فَبَعَثَهُ عَلَى الْيَمَنِ ثُمَّ أَتْبَعَهُ مُعَاذَ بْنَ جَبَلٍ
Will you not appoint me governor as you have appointed so and so? He (the Messenger of Allah) said: You will surely come across preferential treatment after me, so you should be patient until you meet me at the Cistern (Haud-i-Kauthar). (Using translation from Muslim 1845a)
أَنَّ رَجُلًا مِنَ الْأَنْصَارِ جَاءَ رَسُولَ اللهِ ﷺ فَقَالَ أَلَا تَسْتَعْمِلُنِي كَمَا اسْتَعْمَلْتَ فُلَانًا؟ قَالَ «إِنَّكُمْ سَتَلْقَوْنَ بَعْدِي أَثَرَةً فَاصْبِرُوا حَتَّى تَلْقَوْنِي عَلَى الْحَوْضِ»
The Messenger of Allah ﷺ said to me: 'Abd al-Rahman, do not ask for a position of authority, for if you are granted this position as a result of your asking for it, you will be left alone (without God's help to discharge the responsibilities attendant thereon), and it you are granted it without making any request for it, you will be helped (by God in the discharge of your duties). قَالَ كَأَنَّهُ يَعْنِي النَّبِيَّ ﷺ «لَا تَسْأَلِ الْإِمَارَةَ فَإِنَّكَ إِنْ أُعْطِيتَهَا عَنْ مَسْأَلَةٍ أُكِلْتَ إِلَيْهَا وَإِنْ أُعْطِيتَهَا عَلَى غَيْرِ مَسْأَلَةٍ أُعِنْتَ عَلَيْهَا»
29.8 [Machine] The Use of Trusted Poets in Governance
٢٩۔٨ اسْتِعْمَالُ الشُّعَرَاءِ الْمَأْمُونِينَ عَلَى الْحُكْمِ
A group from Banu Tamim came to the Prophet [SAW]. Abu Bakr said: "Appoint Al-Qa'qa' bin Ma'bad (as commander or governor)," and 'Umar said: "No, (appoint) Al-Aqra' bin Habis." They argued until they began to raise their voices, then the words were revealed: "O you who believe! Make not (a decision) in advance before Allah and His Messenger..." until the end of the Verse: "And if they had patience till you could come out to them, it would have been better for them." (Using translation from Nasāʾī 5386)
أَخْبَرَهُ أَنَّهُ قَدِمَ الرَّكْبُ مِنْ بَنِي تَمِيمٍ عَلَى النَّبِيِّ ﷺ قَالَ أَبُو بَكْرٍ أَمِّرِ الْقَعْقَاعَ بْنَ مَعْبَدٍ وَقَالَ عُمَرُ بَلْ أَمِّرِ الْأَقْرَعَ بْنَ حَابِسٍ فَتَمَارَيَا حَتَّى ارْتَفَعَتْ أَصْوَاتُهُمَا فَنَزَلَتْ فِي ذَلِكَ {يَا أَيُّهَا الَّذِينَ آمَنُوا لَا تُقَدِّمُوا بَيْنَ يَدَيِ اللهِ وَرَسُولِهِ} [الحجرات 1] حَتَّى انْقَضَتِ الْآيَةُ {وَلَوْ أَنَّهُمْ صَبَرُوا حَتَّى تَخْرُجَ إِلَيْهِمْ لَكَانَ خَيْرًا لَهُمْ} [الحجرات 5]
29.9 [Machine] Abandoning the use of women in the governance.
٢٩۔٩ تَرْكُ اسْتِعْمَالِ النِّسَاءِ عَلَى الْحُكْمِ
"Allah protected me with something that I heard from the Messenger of Allah [SAW]. When Chosroes died, he said: 'Whom have they appointed as his successor?' They said: 'His daughter.' He said: 'No people will ever prosper who entrust their leadership to a woman.'" (Using translation from Nasāʾī 5388)
عَصَمَنِي اللهُ ﷻ بِشَيْءٍ سَمِعْتُهُ مِنْ رَسُولِ اللهِ ﷺ لَمَّا هَلَكَ كِسْرَى قَالَ «مَنِ اسْتَخْلَفُوا؟» قَالُوا ابْنَتَهُ قَالَ «لَنْ يُفْلِحَ قَوْمٌ وَلَّوْا أَمْرَهُمُ امْرَأَةً»
29.10 [Machine] If a people accept the rule of a man and he rules over them and their descendants
٢٩۔١٠ إِذَا نَزَلَ قَوْمٌ عَلَى حُكْمِ رَجُلٍ فَحَكَمَ فِيهِمْ وَفِي ذَرَارِيِّهِمْ
[Machine] He heard him saying, "When the people of Qurayzah were given the judgment of Sa'd, the Prophet ﷺ came to them riding a donkey and said, 'Indeed, these [people] have come down on your judgment.'" He said, "So surely, I judge that their fighters be killed and their children be taken as captives." He said, "You have judged them with the judgment of a king." Abu Abdullah Al-Rahman said, "Muhammad bin Salih disagreed with him."
أَنَّهَ سَمِعَهُ يَقُولُ لَمَّا نَزَلَ أَهْلُ قُرَيْظَةَ عَلَى حُكْمِ سَعْدٍ أَتَى النَّبِيُّ ﷺ عَلَى حِمَارٍ فَقَالَ «إِنَّ هَؤُلَاءِ نَزَلُوا عَلَى حُكْمِكَ» قَالَ فَإِنِّي أَحْكُمُ أَنْ تُقْتَلَ مُقَاتِلَتُهُمْ وَتُسْبَى ذَرَارِيُّهُمْ قَالَ «حَكَمْتَ فِيهِمْ بِحُكْمِ الْمَلِكِ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ خَالَفَهُ مُحَمَّدُ بْنُ صَالِحٍ
[Machine] "And their wealth is distributed, so it was mentioned to the Prophet ﷺ and he said, 'You have ruled among them with the judgment of Allah, who has ruled with it above the seven heavens.'"
وَأَنْ تُقْسَمَ أَمْوَالُهُمْ فَذُكِرَ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ «حَكَمْتَ فِيهِمْ بِحُكْمِ اللهِ الَّذِي حَكَمَ بِهِ فَوْقَ سَبْعِ سَمَوَاتٍ»
29.11 [Machine] If they choose a man and are pleased with him, then he judges between them.
٢٩۔١١ إِذَا حَكَّمُوا رَجُلًا وَرَضُوا بِهِ فَحَكَمَ بَيْنَهُمْ
When he came to the Messenger of Allah [SAW] and he heard them calling Hani' by the nickname of Abu Al-Hakam, the Messenger of Allah [SAW] called him and said to him: "Allah is Al-Hakam (the Judge) and judgment is His. Why are you known as Abu Al-Hakam?" He said: "If my people differ concerning something, they come to me, and I pass judgment among them, and both sides accept it." He said: "How good this is. Do you have any children?" He said: "I have Shuraih, and 'Abdullah, and Muslim." He said: "Who is the eldest of them?" He said: "Shuraih." He said: "Then you are Abu Shuraih," and he supplicated for him and his son. (Using translation from Nasāʾī 5387)
أَنَّهُ لَمَّا وَفَدَ إِلَى رَسُولِ اللهِ ﷺ مَعَ قَوْمِهِ سَمِعَهُ وَهُمْ يُكَنُّونَ هَانِئًا أَبَا الْحَكَمِ فَدَعَاهُ رَسُولُ اللهِ ﷺ فَقَالَ لَهُ «إِنَّ اللهَ هُوَ الْحَكَمُ وَإِلَيْهِ الْحُكْمُ فَلِمَ تُكَنَّى أَبَا الْحَكَمِ؟» قَالَ إِنَّ قَوْمِي إِذَا اخْتَلَفُوا فِي شَيْءٍ أَتَوْنِي فَحَكَمْتُ بَيْنَهُمْ فَرَضِيَ كِلَا الْفَرِيقَيْنِ فَقَالَ «مَا أَحْسَنَ مِنْ هَذَا فَمَا لَكَ مِنَ الْوَلَدِ؟» قَالَ لِي شُرَيْحٌ وَعَبْدَ اللهِ وَمُسْلِمٌ قَالَ «مَنْ أَكْبَرُهُمْ؟» قَالَ شُرَيْحٌ قَالَ فَأَنْتَ أَبُو شُرَيْحٍ وَدَعَا لَهُ وَلِوَلَدِهِ
29.12 [Machine] Interpretation of the saying of Allah, Glorious is His Praise: "And whoever does not judge by what Allah has revealed - then it is those who are the disbelievers." [Al-Ma'idah: 44]
٢٩۔١٢ تَأْوِيلُ قَوْلِ اللهِ جَلَّ ثَنَاؤُهُ {وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْزَلَ اللهُ فَأُولَئِكَ هُمُ الْكَافِرُونَ} [المائدة: 44]
"There were kings after 'Isa bin Mariam who altered the Tawrah and the Injil, but there were among them believers who read the Tawrah. It was said to their kings: 'We have never heard of any slander worse than that of those (believers) who slander us and recite: "And whosoever does not judge by what Allah has revealed, such are the disbelievers." In these Verses, they are criticizing us for our deeds when they recite them.' So he called them together and gave them the choice between being put to death, or giving up reading the Tawrah and Injil, except for what had been altered. They said: 'Why do you want us to change? Leave us alone.' Some of them said: 'Build us a tower and let us go up there, and give us something to lift up our food and drink so we do not have to mix with you.' Others said: 'Let us go and wander throughout the land, and we will drink as the wild animals drink, and if you capture us in your land, you may kill us.' Others said: 'Build houses for us in the wilderness, and we will dig wells and grow vegetables, and we will not mix with you or pass by you, for there is no one of the tribes among whom we do not have close relatives.' So they did that, and Allah revealed the words: 'But the monasticism which they invented for themselves, We did not prescribe for them, but (they sought it) only to please Allah therewith, but that they did not observe it with the right observance.' Then others said: 'We will worship as so-and-so worshipped, and we will wander as so-and-so wandered, and we will adopt houses (in the wilderness) as so-and-so did.' But they were still following their Shirk with no knowledge of the faith of those whom they claimed to be following. When Allah sent the Prophet [SAW], and they were only a few of them left, a man came down from his cell, and a wanderer came from his travels, and a monk came from his monastery, and they believed in him. And Allah said: 'O you who believe! Fear Allah, and believe in His Messenger (Muhammad), He will give you a double portion of His mercy - meaning, two rewards, because of their having believed in 'Isa and in the Tawrah and Injil, and for having believing in Muhammad [SAW]; and He will give you a light by which you shall walk (straight), - meaning, the Qur'an, and their following the Prophet [SAW]; and He said: 'So that the people of the Scripture (Jews and Christians) may know that they have no power whatsoever over the Grace of Allah.'" كَانَتْ مُلُوكٌ بَعْدَ عِيسَى بَدَّلُوا التَّوْرَاةَ وَالْإِنْجِيلَ فَكَانَ فِيهِمْ مُؤْمِنُونَ يَقْرَءُونَ التَّوْرَاةَ فَقِيلَ لِمُلُوكِهِمْ مَا نَجْدُ شَتْمًا أَشَدَّ مِنْ شَتْمٍ يَشْتِمُونَنَا هَؤُلَاءِ أَنَّهُمْ يَقْرَءُونَ {وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْزَلَ اللهُ فَأُولَئِكَ هُمُ الْكَافِرُونَ} [المائدة 44] هَؤُلَاءِ الْآيَاتُ مَعَ مَا يَعِيبُونَنَا بِهِ فِي أَعْمَالِنَا فِي قِرَاءَتِهِمْ فَادْعُهُمْ فَلْيَقْرَءُوا كَمَا نَقْرَأُ وَلْيُؤْمِنُوا كَمَا آمَنَّا فَدَعَاهُمْ فَجَمَعَهُمْ وَعَرَضَ عَلَيْهِمُ الْقَتْلَ أَوْ يَتْرُكُوا قِرَاءَةَ التَّوْرَاةِ وَالْإِنْجِيلِ إِلَّا مَا بَدَّلُوا مِنْهَا فَقَالُوا مَا تُرِيدُونَ إِلَى ذَلِكَ؟ دَعُونَا فَقَالَتْ طَائِفَةٌ مِنْهُمْ ابْنُوا لَنَا أُسْطُوَانَةً ثُمَّ ارْفَعُونَا إِلَيْهَا ثُمَّ أَعْطُونَا شَيْئًا نَرْفَعُ بِهِ طَعَامَنَا وَشَرَابَنَا فَلَا نَرُدُّ عَلَيْكُمْ وَقَالَتْ طَائِفَةٌ دَعُونَا نَسِيحُ فِي الْأَرْضِ وَنَهِيمُ وَنَشْرَبُ كَمَا يَشْرَبُ الْوَحْشُ فَإِنْ قَدَرْتُمْ عَلَيْنَا فِي أَرْضِكُمْ فَاقْتُلُونَا وَقَالَتْ طَائِفَةٌ ابْنُوا لَنَا دُورًا فِي الْفَيَافِي وَنَحْتَفِرُ الْآبَارَ وَنَحْتَرِثُ الْبُقُولَ فَلَا نَرِدُ عَلَيْكُمْ وَلَا نَقْرَبُكُمْ وَلَيْسَ أَحَدٌ مِنَ الْقَبَائِلِ إِلَّا ولَهُ حَمِيمٌ فِيهِمْ قَالَ فَفَعَلُوا ذَلِكَ فَأَنْزَلَ اللهُ تَعَالَى {وَرَهْبَانِيَّةً ابْتَدَعُوهَا مَا كَتَبْنَاهَا عَلَيْهِمْ إِلَّا ابْتِغَاءَ رِضْوَانِ اللهِ فَمَا رَعَوْهَا حَقَّ رِعَايَتِهَا} [الحديد 27] وَالْآخَرُونَ قَالُوا نَتَعَبَّدُ كَمَا تَعَبَّدَ فُلَانٌ وَنَسِيحُ كَمَا سَاحَ فُلَانٌ وَنَتَّخِذُ دُورًا كَمَا اتَّخَذَ فُلَانٌ عَلَى شِرْكِهِمْ لَا عِلْمَ لَهُمْ بِإِيمَانِ الَّذِينَ اقْتَدُوا بِهِ فَلَمَّا بَعَثَ اللهُ النَّبِيَّ ﷺ وَلَمْ يَبْقَ مِنْهُمْ إِلَّا قَلِيلٌ انْحَطَّ رَجُلٌ مِنْ صَوْمَعَتِهِ وَجَاءَ سَائِحٌ مِنْ سِيَاحَتِهِ وَصَاحِبُ الدَّيْرِ مِنْ دَيْرِهِ فَآمَنُوا بِهِ وَصَدَّقُوهُ فَقَالَ اللهُ تَعَالَى {يَا أَيُّهَا الَّذِينَ آمَنُوا اتَّقُوا اللهَ وَآمِنُوا بِرَسُولِهِ يُؤْتِكُمْ كِفْلَيْنِ مِنْ رَحْمَتِهِ} [الحديد 28] أَجْرَيْنِ بِإِيمَانِهِمْ بِعِيسَى عَلَيْهِ السَّلَامُ وَبِالتَّوْرَاةِ وَالْإِنْجِيلِ وَبِإِيمَانِهِمْ بِمُحَمَّدٍ ﷺ وَتَصْدِيقِهِمْ قَالَ {يَجْعَلْ لَكُمْ نُورًا تَمْشُونَ بِهِ} [الحديد 28] الْقُرْآنَ وَاتِّبَاعَهُمُ النَّبِيَّ ﷺ قَالَ {لِئَلَّا يَعْلَمَ أَهْلُ الْكِتَابِ} [الحديد 29] الَّذِينَ يَتَشَبَّهُونَ بِكُمْ {أَلَّا يَقْدِرُونَ عَلَى شَيْءٍ مِنْ فَضْلِ اللهِ وَأَنَّ الْفَضْلَ بِيَدِ اللهِ يُؤْتِيهِ مَنْ يَشَاءُ وَاللهُ ذُو الْفَضْلِ الْعَظِيمِ} [الحديد 29] الْآيَةَ
29.13 Section
٢٩۔١٣ بَابٌ
[Machine] I speak of it every Sunday that the Messenger of Allah ﷺ stood at a door while we were inside, and he said, "The leaders from Quraysh, they have rights over you, and you have rights over them. As long as they are kind to you, show mercy. If they make a covenant and fulfill it, then fulfill it as well. And if they judge with justice, then accept their judgment. But whoever does not do that from among them, then the curse of Allah, the angels, and all people be upon them."
أُحَدِّثُهُ كُلَّ أَحَدٍ إِنَّ رَسُولَ اللهِ ﷺ قَامَ عَلَى بَابٍ وَنَحْنُ فِيهِ فَقَالَ «الْأَئِمَّةُ مِنْ قُرَيْشٍ إِنَّ لَهُمْ عَلَيْكُمْ حَقًّا وَلَكُمْ عَلَيْهِمْ مِثْلُ ذَلِكَ مَا إِنِ اسْتُرْحِمُوا رَحِمُوا وَإِنْ عَاهَدُوا وَفَوْا وَإِنْ حَكَمُوا عَدَلُوا فَمَنْ لَمْ يَفْعَلْ ذَلِكَ مِنْهُمْ فَعَلَيْهِ لَعْنَةُ اللهِ وَالْمَلَائِكَةِ وَالنَّاسِ أَجْمَعِينَ»
29.14 [Machine] The evidence that the ruling of the judge neither permits nor prohibits anything.
٢٩۔١٤ الِاسْتِدْلَالُ بِأَنَّ حُكْمَ الْحَاكِمِ لَا يُحِلُّ شَيْئًا وَلَا يُحَرِّمُهُ
"I am only a human being, and you bring your disputes to me, some perhaps being more eloquent in their plea than others, so that I give judgement on their behalf according to what I hear from them. Therefore, whatever I decide for anyone which by right belongs to his brother, he must not take anything, for I am granting him only a portion of Hell. (Using translation from Abū Dāʾūd 3583)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «إِنَّمَا أَنَا بَشَرٌ وَإِنَّكُمْ تَخْتَصِمُونَ إِلَيَّ وَلَعَلَّ بَعْضُكُمْ أَنْ يَكُونَ أَلْحَنَ بِحُجَّتِهِ مِنْ بَعْضٍ فَأَقْضِي لَهُ عَلَى نَحْوِ مَا أَسْمَعُ مِنْهُ فَمَنْ قَضَيْتُ لَهُ بِشَيْءٍ مِنْ حَقِّ أَخِيهِ فَلَا يَأْخُذْ مِنْهُ شَيْئًا فَإِنَّمَا أَقْطَعُ لَهُ قِطْعَةً مِنَ النَّارِ»
29.15 [Machine] The ruling on what the people of knowledge have agreed upon.
٢٩۔١٥ الْحُكْمُ بِمَا اتَّفَقَ عَلَيْهِ أَهْلُ الْعِلْمِ
He wrote to 'Umar, to ask him (a question), and 'Umar wrote back to him telling him: "Judge according to what is in the Book of Allah. If it is not (mentioned) in the Book of Allah, then (judge) according to the Sunnah of the Messenger of Allah [SAW]. If it is not (mentioned) in the Book of Allah or the Sunnah of the Messenger of Allah [SAW], then pass judgment according to the way the righteous passed judgment. If it is not (mentioned) in the Book of Allah, or the Sunnah of the Messenger of Allah [SAW], and the righteous did not pass judgment concerning it, then if you wish, go ahead (and try to work it out by yourself) or if you wish, leave it. And I think that leaving it is better for you. And peace be upon you." (Using translation from Nasāʾī 5399)
«أَنِ اقْضِ بِمَا فِي كِتَابِ اللهِ فَإِنْ لَمْ يَكُنْ فِي كِتَابِ اللهِ فَبِسُنَّةِ رَسُولِ اللهِ ﷺ فَإِنْ لَمْ يَكُنْ فِي كِتَابِ اللهِ وَلَا سُنَّةِ رَسُولِ اللهِ ﷺ فَاقْضِ بِمَا قَضَى بِهِ الصَّالِحُونَ فَإِنْ لَمْ يَكُنْ فِي كِتَابِ اللهِ وَلَا فِي سُنَّةِ رَسُولِ اللهِ ﷺ وَلَمْ يَقْضِ بِهِ الصَّالِحُونَ فَإِنْ شِئْتَ فَتَقَدَّمْ وَإِنْ شِئْتَ فَتَأَخَّرْ وَلَا أَرَى التَّأَخُّرَ إِلَّا خَيْرًا لَكَ وَالسَّلَامُ عَلَيْكُمْ»
29.16 [Machine] Tashbih, tamsil, and mentioning the differences between Muhammad and Hushaym regarding Yahya ibn Abi Ishaq.
٢٩۔١٦ التَّشْبِيهُ، وَالتَّمْثِيلِ وَذِكْرُ اخْتِلَافِ مُحَمَّدٍ، وَهُشَيْمٍ عَلَى يَحْيَى بْنِ أَبِي إِسْحَاقَ
a man asked the Prophet "The command of ) Hajj has come while my father is an old man and cannot sit firmly in his saddle; if I tie him (to the saddle) I fear that he will die. Can I perform Hajj on his behalf?" He said: "don't you think that if your father owed a debt and you paid it off, that would be good enough?" He said: "Yes." He said: "Then perform Hajj on behalf of your father. " (Using translation from Nasāʾī 2640)
أَنَّ رَجُلًا سَأَلَ النَّبِيَّ ﷺ أَنَّ أَبِي أَدْرَكَهُ الْحَجُّ وَهُوَ شَيْخٌ كَبِيرٌ لَا يَثْبُتُ عَلَى رَاحِلَتِهِ فَإِنْ شَدَدْتُهُ خَشِيتُ أَنْ يَمُوتَ أَفَأَحُجُّ عَنْهُ؟ قَالَ «أَرَأَيْتَ لَوْ كَانَ عَلَيْهِ دَيْنٌ فَقَضَيْتَهُ أَكَانَ مُجْزِئًا؟» قَالَ نَعَمْ قَالَ «فَحُجَّ عَنْ أَبِيكَ»
[Machine] I was a companion of the Prophet Muhammad ﷺ. A man came to him and said, "Indeed, my father is an elderly man and unable to perform Hajj. And when I mount him on a camel, he cannot stay on it. And if I tie him tightly on it, he cannot hold on. " The Prophet asked him, "Have you ever owed anyone?" The man replied, "Yes." The Prophet said, "Perform Hajj on behalf of your father." Abu Abdur-Rahman disagreed with him, saying it was narrated from Al-Fadl ibn Abbas.
كُنْتُ رَدِيفَ النَّبِيِّ ﷺ فَأَتَاهُ رَجُلٌ فَقَالَ إِنَّ أَبِي كَبِيرٌ وَلَمْ يَحُجَّ وَإِنْ حَمَلْتُهُ عَلَى بَعِيرٍ لَمْ يَثْبُتْ عَلَيْهِ وَإِنْ شَدَدْتُهُ عَلَيْهِ لَمْ آمَنْ عَلَيْهِ قَالَ «كُنْتَ قَاضِيًا دَيْنًا لَوْ كَانَ عَلَيْهِ؟» قَالَ نَعَمْ قَالَ «حُجَّ عَنْ أَبِيكَ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ خَالَفَهُ مُحَمَّدُ بْنُ سِيرِينَ فَقَالَ عَنِ الْفَضْلِ بْنِ عَبَّاسٍ
he was riding behind the Messenger of Allah and a man came and said: "O Messenger of Allah! My mother is an old woman and she cannot sit firmly in the saddle. If I tie her I fear that I may kill her." The Messenger of Allah said: "Don't you think that if your mother owed a debt you would pay it off?" He said: "Yes." Her said: "Then perform Hajj on behalf of your mother."(Shih) (Using translation from Nasāʾī 2643)
أَنَّهُ كَانَ رَدِيفَ النَّبِيِّ ﷺ فَجَاءَهُ رَجُلٌ فَقَالَ يَا رَسُولَ اللهِ إِنَّ أُمِّي عَجُوزٌ كَبِيرَةٌ إِنْ حَمَلْتُهَا لَمْ تَسْتَمْسِكْ وَإِنْ رَبَطْتُهَا خَشِيتُ أَنْ أَقْتُلَهَا فَقَالَ رَسُولُ اللهِ ﷺ «أَرَأَيْتَ لَوْ كَانَ عَلَى أُمِّكَ دَيْنٌ أَكُنْتَ قَاضِيَهُ؟» قَالَ نَعَمْ قَالَ «فَحُجَّ عَنْ أُمِّكَ»
He was riding behind the Messenger of Allah [SAW] on the morning of the Day of Sacrifice, when a woman from Khath'am came to him and said: "O Messenger of Allah, the command of Allah, the Mighty and Sublime, to His slaves to perform Hajj has come while my father is an old man and cannot ride unless he is tied crossways on a mount; can I perform Hajj on his behalf?" He said: "Yes, perform Hajj on his behalf, for if he owed a debt you would pay it off for him." (Using translation from Nasāʾī 5389)
أَنَّهُ كَانَ رَدِيفَ رَسُولِ اللهِ ﷺ غَدَاةَ النَّحْرِ فَأَتَتْهُ امْرَأَةٌ مِنْ خَثْعَمٍ فَقَالَتْ يَا رَسُولَ اللهِ إِنَّ فَرِيضَةَ اللهِ فِي الْحَجِّ عَلَى عِبَادِهِ أَدْرَكَتْ أَبِي شَيْخًا كَبِيرًا لَا يَسْتَطِيعُ أَنْ يَرْكَبَ إِلَّا مُعْتَرِضًا أَفَأَحُجُّ عَنْهُ؟ قَالَ «نَعَمْ حُجِّي عَنْهُ» قَالَ لَوْ كَانَ عَلَيْهِ دَيْنٌ قَضَيْتِيهِ
a woman from Khath'am asked the Messenger of Allah a question during the Farewell Pilgrimage, when Al-Fadl bin 'Abbas was riding behing the Messenger of Allah She said: "O Messenger of Allah! The command of Allah has come for His slaves to perform Hajj, but my father is an old man and cannot sit upright in the saddle. Will it be paid off on his behalf if I perform Hajj on his behalf?" The Messenger of Allah said to her: "Yes." And Al-Fadl started to turn toward her, as she was a beautiful woman, but the Messenger of Allah took hold of Al-Fadl's face and turned it to the other side. (Using translation from Nasāʾī 2642)
أَخْبَرَهُ أَنَّ امْرَأَةً مِنْ خَثْعَمٍ اسْتَفْتَتْ رَسُولَ اللهِ ﷺ فِي حَجَّةِ الْوَدَاعِ وَالْفَضْلُ بْنُ عَبَّاسٍ رَدِيفُ رَسُولِ اللهِ ﷺ فقَالَتْ يَا رَسُولَ اللهِ إِنَّ فَرِيضَةَ اللهِ فِي الْحَجِّ عَلَى عِبَادِهِ أَدْرَكَتْ أَبِي شَيْخًا كَبِيرًا لَا يَسْتَوِي عَلَى الرَّاحِلَةِ فَهَلْ يَقْضِي عَنْهُ أَنْ أَحُجَّ عَنْهُ؟ فَقَالَ لَهَا رَسُولُ اللهِ ﷺ «نَعَمْ» فَأَخَذَ الْفَضْلُ بْنُ عَبَّاسٍ يَلْتَفِتُ إِلَيْهَا وَكَانَتِ امْرَأَةً حَسْنَاءَ وَأَخَذَ رَسُولُ اللهِ ﷺ الْفَضْلَ فَيُحَوِّلُ وَجْهَهُ مِنَ الشِّقِّ الْآخَرَ
29.17 [Machine] Judging by appearances
٢٩۔١٧ الْحُكْمِ بِالظَّاهِرِ
The Messenger of Allah [SAW] said: "You refer your disputes to me, but I am only human, and some of you may be more eloquent in arguing their case than others. If I pass judgment in favor of one of you, against his brother's rights, let him not take it, for it is a piece of fire that I am giving him." (Using translation from Nasāʾī 5401)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «إِنَّكُمْ تَخْتَصِمُونَ إِلَيَّ وَإِنَّمَا أَنَا بَشَرٌ وَلَعَلَّ بَعْضَكُمْ أَلْحَنُ بِحُجَّتِهِ مِنْ بَعْضٍ فَمَنْ قَضَيْتُ لَهُ مِنْ حَقِّ أَخِيهِ شَيْئًا فَلَا يَأْخُذْهُ فَإِنَّمَا أَقْطَعُهُ بِهِ قِطْعَةً مِنَ النَّارِ»
29.18 [Machine] Understanding, Judgment, Planning in it, and Ruling by Evidence.
٢٩۔١٨ الْفَهْمُ وَالْقَضَاءُ وَالتَّدْبِيرُ فِيهِ وَالْحُكْمُ بِالِاسْتِدْلَالِ
[Machine] Narrated by the prophet ﷺ: Two women came to Solomon, son of David, peace be upon them, arguing over a child each claiming to be its mother. Prophet of Allah ﷺ then said, "Bring me a knife so that I may cut it (the baby) in half and give each of them a half." One of them said, "No, let the child live." The other agreed. So he decided in favor of the one who had agreed to let the child live.
عَنِ النَّبِيِّ ﷺ قَالَ اخْتَصَمَتِ امْرَأَتَانِ إِلَى سُلَيْمَانَ بْنِ دَاوُدَ عَلَيْهِمَا السَّلَامُ فِي وَلَدٍ كُلُّ وَاحِدَةٍ مِنْهُمَا تَزْعُمُ أَنَّهَا وَلَدَتْهُ فَقَالَ نَبِيُّ اللهِ ﷺ هَاتُوا السِّكِّينَ حَتَّى نَقْطَعَهُ بَيْنَهُمَا قَالَتْ إِحْدَاهُمَا بَلْ أَدَعُهُ لَهَا قَالَ وَكَانَتِ الْأُخْرَى رَضِيَتْ فَقَالَ لَوْ كَانَ ابْنَكِ لَمْ تَرْضَيْ أَنْ يُقْطَعَ فَقَضَى بِهِ لِلْأُخْرَى
29.19 [Machine] The expansion of the ruler to say to a thing that he does not do: "I am doing it to clarify the truth.
٢٩۔١٩ التَّوْسِعَةُ لِلْحَاكِمِ فِي أَنْ يَقُولَ لِلشَّيْءِ الَّذِي لَا يَفْعَلُهُ أَفْعَلُ لِيَسْتَبِينَ بِهِ الْحَقُّ
The Messenger of Allah [SAW] said: "Two women went out with two children of theirs, and the wolf attacked one of them and took her child. The next day they referred their dispute over the remaining child to Dawud, peace be upon him, and he ruled that (the child) belonged to the older woman. Then they passed by Sulaiman and he said: 'What is your story?' So they told him. He said: 'Bring me a knife and I will cut him in half (to be shared) between you.' The younger one said: 'Will you cut him in half?' He said: 'Yes.' She said: 'Do not do that; I will give my share of him to her.' He said: 'He is your child' and he ruled that he belonged to her." (Using translation from Nasāʾī 5403)
عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ قَالَ خَرَجَتِ امْرَأَتَانِ وَمَعَهُمَا صَبِيَّانِ لَهُمَا فَعَدَا الذِّئْبُ عَلَى إِحْدَاهُمَا فَأَخَذَ وَلَدَهَا فَأَصْبَحَتَا تَخْتَصِمَانِ فِي الصَّبِيِّ الْبَاقِي اخْتَصَمَتَا إِلَى دَاوُدَ النَّبِيِّ عَلَيْهِ السَّلَامُ فَقَضَى بِهِ لِلْكُبْرَى مِنْهُمَا فَمَرَّتَا عَلَى سُلَيْمَانَ عَلَيْهِ السَّلَامُ فَقَالَ كَيْفَ أَمْرُكُمَا؟ فَقَصَّتَا عَلَيْهِ فَقَالَ ائْتُونِي بِالسِّكِّينِ أَشُقُّ الْغُلَامَ بَيْنَهُمَا فَقَالَتِ الصُّغْرَى أَتَشُقُّهُ؟ قَالَ نَعَمْ فَقَالَتْ لَا تَفْعَلْ حَظِّي مِنْهُ لَهَا فَقَالَ هُوَ ابْنُكِ فَقَضَى بِهِ لَهَا
29.20 [Machine] The Judgement Contrary to What the Ruled Recognizes When the Judge Realizes That the Truth is Different from What is Recognized.
٢٩۔٢٠ الْحُكْمُ بِخِلَافِ مَا يَعْتَرِفُ بِهِ الْمَحْكُومُ لَهُ إِذَا تَبَيَّنَ لِلْحَاكِمِ أَنَّ الْحَقَّ غَيْرُ مَا اعْتَرَفَ بِهِ
The Prophet [SAW] said: "Two women went out with their two children, and the wolf took one of the children from them. They referred their dispute to Prophet Dawud, peace be upon him, and he ruled that (the remaining child) belonged to the older woman. Then they passed by Sulaiman, peace be upon him, and he said: 'How did he judge between you?' She said: 'He ruled that (the child) belongs to the older woman.' Sulaiman said: 'Cut him in half, and give half to one and half to the other.' The older woman said: 'Yes, cut him in half.' The younger woman said: 'Do not cut him, he is her child.' So he ruled that the child belonged to the woman who refused to let him be cut." (Using translation from Nasāʾī 5404)
عَنِ النَّبِيِّ ﷺ قَالَ خَرَجَتِ امْرَأَتَانِ مَعَهُمَا وَلَدَاهُمَا فَأَخَذَ الذِّئْبُ أَحَدَهُمَا فَاخْتَصَمَتَا فِي الْوَلَدِ إِلَى دَاوُدَ عَلَيْهِ السَّلَامُ فَقَضَى بِهِ لِلْكُبْرَى مِنْهُمَا فَمَرَّتَا عَلَى سُلَيْمَانَ فَقَالَ كَيْفَ قَضَى بَيْنَكُمَا؟ قَالَ قَضَى بِهِ لِلْكُبْرَى قَالَ سُلَيْمَانُ اقْطَعُوهُ نِصْفَيْنِ لِهَذِهِ نِصْفٌ وَلِهَذِهِ نِصْفٌ فَقَالَتِ الْكُبْرَى نَعَمِ اقْطَعُوهُ وَقَالَتِ الصُّغْرَى لَا تَقْطَعُهُ هُوَ وَلَدُهَا فَقَضَى بِهِ لِلَّتِي أَبَتْ أَنْ تَقْطَعَهُ
29.21 [Machine] The revocation of the ruling of a judge by someone who is like him or superior to him.
٢٩۔٢١ نَقْضُ الْحَاكِمِ مَا حَكَمَ بِهِ غَيْرُهُ مِمَّنْ هُوَ مِثْلُهُ أَوْ أَجَلُّ مِنْهُ
Messenger of Allah ﷺ said, "There were two women with whom there were their two sons. A wolf came and took away the son of one of them. That lady said to her companion, 'The wolf has taken your son.' The other said, 'But it has taken your son.' So both of them sought the judgment of (the Prophet) David who judged that the boy should be given to the older lady. Then both of them went to (the Prophet) Solomon, son of David and informed him of the case. Solomon said, 'Give me a knife so that I may cut the child into two portions and give one half to each of you.' The younger lady said, 'Do not do so; may Allah bless you ! He is her child.' On that, he gave the child to the younger lady." Abu Huraira added: By Allah! I had never heard the word 'Sakkin' as meaning knife, except on that day, for we used to call it "Mudya". يُحَدِّثُهُ عَنْ رَسُولِ اللهِ ﷺ قَالَ وَقَالَ بَيْنَمَا امْرَأَتَانِ مَعَهُمَا ابْنَاهُمَا جَاءَ الذِّئْبُ فَذَهَبَ بِابْنِ إِحْدَاهُمَا فَقَالَتْ هَذِهِ لِصَاحِبَتِهَا إِنَّمَا ذَهَبَ بِابْنِكِ وَقَالَتِ الْأُخْرَى إِنَّمَا ذَهَبَ بِابْنِكِ فَتَحَاكَمَتَا إِلَى دَاوُدَ عَلَيْهِ السَّلَامُ فَقَضَى لِلْكُبْرَى فَخَرَجَتَا عَلَى سُلَيْمَانَ بْنِ دَاوُدَ عَلَيْهِمَا السَّلَامُ فَأَخْبَرَتَاهُ فَقَالَ ائْتُونِي بِالسِّكِّينِ أَشُقُّهُ بَيْنَهُمَا فَقَالَتِ الصُّغْرَى لَا تَفْعَلْ يَرْحَمُكَ اللهُ هُوَ ابْنُهَا فَقَضَى بِهِ لِلصُّغْرَى قَالَ أَبُو هُرَيْرَةَ وَاللهِ إِنْ سَمِعْتُ بِالسِّكِّينِ قَطُّ إِلَّا يَوْمَئِذٍ وَمَا كُنَّا نَقُولُ إِلَّا الْمُدْيَةَ
29.22 [Machine] If the judge ruled unjustly, should his ruling be rejected?
٢٩۔٢٢ إِذَا قَضَى الْحَاكِمُ بِجَوْرٍ هَلْ يُرَدُّ حُكْمُهُ؟
The Prophet ﷺ sent Khalid bin Al-Walid to the tribe of Jadhima and Khalid invited them to Islam but they could not express themselves by saying, "Aslamna (i.e. we have embraced Islam)," but they started saying "Saba'na! Saba'na (i.e. we have come out of one religion to another)." Khalid kept on killing (some of) them and taking (some of) them as captives and gave every one of us his Captive. When there came the day then Khalid ordered that each man (i.e. Muslim soldier) should kill his captive, I said, "By Allah, I will not kill my captive, and none of my companions will kill his captive." When we reached the Prophet, we mentioned to him the whole story. On that, the Prophet ﷺ raised both his hands and said twice, "O Allah! I am free from what Khalid has done." بَعَثَ النَّبِيُّ ﷺ خَالِدَ بْنَ الْوَلِيدِ إِلَى بَنِي جَذِيمَةَ فَدَعَاهُمْ إِلَى الْإِسْلَامِ فَلَمْ يُحْسِنُوا أَنْ يَقُولُوا أَسْلَمْنَا فَجَعَلُوا يَقُولُونَ صَبَأْنَا صَبَأْنَا وَجَعَلَ خَالِدٌ بِهِمْ أَسْرًا وَقَتْلًا قَالَ وَدَفَعَ إِلَى كُلِّ رَجُلٍ مِنَّا أَسِيرًا حَتَّى إِذَا أَصْبَحَ يَوْمًا أَمَرَنَا خَالِدُ بْنُ الْوَلِيدِ أَنْ يَقْتُلَ كُلُّ رَجُلٍ مِنَّا أَسِيرَهُ قَالَ ابْنُ عُمَرَ فَقُلْتُ وَاللهِ لَا أُقْتُلُ أَسِيرِي وَلَا يَقْتُلُ أَحَدٌ مِنْ أَصْحَابِي أَسِيرَهُ قَالَ فَقَدِمْنَا عَلَى رَسُولِ اللهِ ﷺ فَذُكِرَ لَهُ صَنِيعُ خَالِدٍ فَقَالَ النَّبِيُّ ﷺ وَرَفَعَ يَدَيْهِ «اللهُمَّ إِنِّي أَبْرَأُ إِلَيْكَ مِمَّا صَنَعَ خَالِدٌ» اللهُمَّ إِنِّي أَبْرَأُ إِلَيْكَ مِمَّا صَنَعَ خَالِدٌ
29.23 [Machine] The Situation in Which the Ruler Should Avoid Making Decisions
٢٩۔٢٣ الْحَالُ الَّذِي يَنْبَغِي لِلْحَاكِمِ اجْتِنَابُ الْقَضَاءَ فِيهَا
[Machine] The Prophet ﷺ said, "A judge should not make a decision between two parties while he is angry."
قَالَ النَّبِيُّ ﷺ «لَا يَقْضِي الْقَاضِي بَيْنَ اثْنَيْنِ وَهُوَ غَضْبَانُ»
29.24 [Machine] Facilitating the ruling for the secure ruler to rule while angry
٢٩۔٢٤ التَّسْهِيلُ لِلْحَاكِمِ الْمَأْمُونِ أَنْ يَحْكُمَ وَهُوَ غَضْبَانُ
He disputed with a man among Ansar who had been present at Badr with the Messenger of Allah [SAW], concerning a stream in Al-Harrah from which they both used to water their date palm trees. The Ansari said: "Let the water flow." But he (Az-Zubair) refused. The Messenger of Allah [SAW] said: "Irrigate (your land), O Zubair! Then let the water flow to your neighbor." The Ansari became angry and said, "O Messenger of Allah, is it because he is your cousin?" The face of the Messenger of Allah [SAW] changed color (because of anger) and he said: "O Zubair! Irrigate (your land) then block the water, until it flows back to the walls." So the Messenger of Allah [SAW] allowed Az-Zubair to take his rights in full, although before that he had suggested to Az-Zubair a middle way that benefited both him and the Ansari. But when the Ansari made the Messenger of Allah [SAW] angry, he gave Az-Zubair his rights in full, as stated clearly in his ruling. Az-Zubair said: "I think that this Verse was revealed concerning this matter: 'But no, by your Lord, they can have no faith, until they make you (O Muhammad) judge in all disputes between them.'" أَنَّهُ خَاصَمَ رَجُلًا مِنَ الْأَنْصَارِ قَدْ شَهِدَ بَدْرًا مَعَ رَسُولِ اللهِ ﷺ فِي شِرَاجِ الْحَرَّةِ كَانَا يَسْقِيَانِ بِهِ كِلَاهُمَا النَّخْلَ فَقَالَ الْأَنْصَارِيُّ سَرِّحِ الْمَاءَ يَمُرُّ عَلَيْهِ فَأَبَى عَلَيْهِ فَقَالَ رَسُولُ اللهِ ﷺ «اسْقِ يَا زُبَيْرُ ثُمَّ أَرْسِلِ الْمَاءَ إِلَى جَارِكَ» فَغَضِبَ الْأَنْصَارِيُّ فََقَالَ يَا رَسُولَ اللهِ أَنْ كَانَ ابْنَ عَمَّتِكَ فَتَلَوَّنَ وَجْهُ رَسُولِ اللهِ ﷺ ثُمَّ قَالَ يَا زُبَيْرُ اسْقِ ثُمَّ احْبِسِ الْمَاءَ حَتَّى يَرْجِعَ إِلَى الْجَدْرِ وَاسْتَوْعَى رَسُولُ اللهِ ﷺ لِلزُّبَيْرِ حَقَّهُ وَكَانَ رَسُولُ اللهِ ﷺ قَبْلَ ذَلِكَ أَشَارَ عَلَى الزُّبَيْرِ بِرَأْيٍ أَرَادَ فِيهِ السَّعَةَ لَهُ وَلِلْأَنْصَارِيِّ فَلَمَّا أَحْفَظَ رَسُولَ اللهِ ﷺ الْأَنْصَارِيُّ اسْتَوْعَى لِلزُّبَيْرِ حَقَّهُ فِي صَرِيحِ الْحُكْمِ قَالَ الزُّبَيْرُ لَا أَحْسِبُ هَذِهِ الْآيَةَ أُنْزِلَتْ إِلَّا فِي ذَلِكَ فَلَا وَرَبِّكَ لَا يُؤْمِنُونَ حَتَّى يُحَكِّمُوكَ فِيمَا شَجَرَ بَيْنَهُمْ وَأَحَدُهُمَا يَزِيدُ عَلَى صَاحِبِهِ فِي الْقَصَّةِ قَالَ أَبُو عَبْدِ الرَّحْمَنِ خَالَفَهُ قُتَيْبَةُ بْنُ سَعِيدٍ
An Ansari man quarreled with Az-Zubair in the presence of the Prophet ﷺ about the Harra Canals which were used for irrigating the date-palms. The Ansari man said to Az-Zubair, "Let the water pass' but Az-Zubair refused to do so. So, the case was brought before the Prophet ﷺ who said to Az-Zubair, "O Zubair! Irrigate (your land) and then let the water pass to your neighbor." On that the Ansari got angry and said to the Prophet, "Is it because he (i.e. Zubair) is your aunt's son?" On that the color of the face of Messenger of Allah ﷺ changed (because of anger) and he said, "O Zubair! Irrigate (your land) and then withhold the water till it reaches the walls between the pits round the trees." Zubair said, "By Allah, I think that the following verse was revealed on this occasion": "But no, by your Lord They can have No faith Until they make you judge In all disputes between them." أَنَّ رَجُلًا مِنَ الْأَنْصَارِ خَاصَمَ الزُّبَيْرَ إِلَى رَسُولِ اللهِ ﷺ فِي شِرَاجِ الْحَرَّةِ الَّتِي يَسْقُونَ بِهَا النَّخْلَ فَقَالَ لِلْأَنْصَارِيِّ سَرِّحِ الْمَاءَ يَمُرُّ فَأَبَى عَلَيْهِ فَاخْتَصَمُوا عِنْدَ رَسُولِ اللهِ ﷺ فَقَالَ رَسُولُ اللهِ ﷺ لِلزُّبَيْرِ «أَسْقِ يَا زُبَيْرُ ثُمَّ أَرْسِلْ إِلَى جَارِكَ» فَغَضِبَ الْأَنْصَارِيُّ فَقَالَ يَا رَسُولَ اللهِ أَنْ كَانَ ابْنَ عَمَّتِكَ فَتَلَوَّنَ وَجْهُ نَبِيِّ اللهِ ﷺ ثُمَّ قَالَ «يَا زُبَيْرُ أَسْقِ ثُمَّ احْبِسِ الْمَاءَ حَتَّى يَرْجِعَ إِلَى الْجَدْرِ» فَقَالَ الزُّبَيْرُ وَاللهِ إِنِّي لَأَحْسِبُ هَذِهِ الْآيَةَ نَزَلَتْ فِي ذَلِكَ {فَلَا وَرَبِّكَ لَا يُؤْمِنُونَ حَتَّى يُحَكِّمُوكَ فِيمَا شَجَرَ بَيْنَهُمْ} [النساء 65]
29.25 [Machine] The ruling of the judge in his home.
٢٩۔٢٥ حُكْمُ الْحَاكِمِ فِي دَارِهِ
[Machine] That he demanded a debt from the son of Abi Hadrad that he owed him in the mosque, and their voices were raised until the Messenger of Allah ﷺ heard them while he was in his house, so he came out to them and revealed the curtain of his room and called out, "O Ka'b!" He said, "Here I am, O Messenger of Allah." He said, "Reduce the debt for him from your debt." And he pointed to the half. He said, "I have done that." He said, "Get up and settle it." Abu Abdullah Al-Rahman said, "Mammar sent him." Muhammad bin Rafi 'narrated to us, he said: 'Abdul Razzaq told us, he said: Mammar told us, from Az-Zuhri, that Ka'b bin Malik was sent.
أَنَّهُ تَقَاضَى ابْنَ أَبِي حَدْرَدٍ دَيْنًا كَانَ لَهُ عَلَيْهِ فِي الْمَسْجِدِ فَارْتَفَعَتْ أَصْوَاتُهُمَا حَتَّى سَمِعَهُمَا رَسُولُ اللهِ ﷺ وَهُوَ فِي بَيْتِهِ فَخَرَجَ إِلَيْهِمَا فَكَشَفَ سِتْرَ حُجْرَتِهِ فَنَادَى «يَا كَعْبُ» قَالَ لَبَّيْكَ يَا رَسُولَ اللهِ قَالَ «ضَعْ مِنْ دَيْنِكَ هَذَا» وَأَوْمَأَ إِلَى الشَّطْرِ قَالَ قَدْ فَعَلْتُ قَالَ «قُمْ فَاقْضِهِ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ أَرْسَلَهُ مَعْمَرٌ [414] 5927 أَخْبَرَنَا مُحَمَّدُ بْنُ رَافِعٍ قَالَ حَدَّثَنَا عَبْدُ الرَّزَّاقِ قَالَ حَدَّثَنَا مَعْمَرٌ عَنِ الزُّهْرِيِّ أَنَّ كَعْبَ بْنَ مَالِكٍ مُرْسَلٌ
[Machine] He heard the Messenger of Allah, ﷺ , saying: "You will not be true believers unless you love one another. Shall I not guide you to something which, if you do, will create mutual love among you?" They said: "Yes, O Messenger of Allah." He said: "Spread peace among yourselves, for, by the One in Whose Hand is my soul, you will not enter Paradise until you believe, and you will not believe until you love one another. Shall I inform you of something that, if you practice it, you will love one another? Promote greetings of peace among yourselves." They said: "O Messenger of Allah, all of us are inclined to love." He said: "No, I am not referring to that love. What I intended is universal love."
أَنَّهُ سَمِعض رَسُولَ اللهِ ﷺ يَقُولُ «لَنْ تُؤْمِنُوا حَتَّى تَحَابُّوا أَفَلَّا أَدُلُّكُمْ عَلَى مَا تَحَابُّونَ عَلَيْهِ؟» قَالُوا بَلَى يَا رَسُولَ اللهِ قَالَ «أَفْشُوا السَّلَامَ بَيْنَكُمْ فَوَالَّذِي نَفْسِي بِيَدِهِ لَا تَدْخُلُوا الْجَنَّةَ حَتَّى تَرَاحَمُوا» قَالُوا يَا رَسُولَ اللهِ كُلُّنَا رَحِمٌ قَالَ «إِنَّهُ لَيْسَ بِرَحْمَةِ أَحَدِكُمْ خَاصَّتَهَ وَلَكِنْ رَحْمَةُ الْعَامَّةِ»
[Machine] From the Messenger of Allah ﷺ , he said, "Spread peace, feed the food, and be brothers as Allah commanded you."
عَنْ رَسُولِ اللهِ ﷺ قَالَ «أَفْشُوا السَّلَامَ وَأَطْعِمُوا الطَّعَامَ وَكُونُوا إِخْوَانًا كَمَا أَمَرَكُمُ اللهُ»
29.26 [Machine] The journey of the ruler to his subjects to reconcile between them
٢٩۔٢٦ مَسِيرُ الْحَاكِمِ إِلَى رَعِيَّتِهِ لِيُصْلِحَ بَيْنَهُمْ
[Machine] I heard Sahl ibn Saad say that a dispute occurred between two groups of the Ansar until they started throwing stones at each other. So the Messenger of Allah ﷺ went to reconcile between them, and when the prayer time came, Bilal called the Adhan, and the Messenger of Allah ﷺ waited. Then he performed the prayer, and Abu Bakr stepped forward to lead the people.
سَمِعْتُ سَهْلَ بْنَ سَعْدٍ يَقُولُ وَقَعَ بَيْنَ حَيَّيْنِ مِنَ الْأَنْصَارِ كَلَامٌ حَتَّى تَرَامَوْا بِالْحِجَارَةِ فَذَهَبَ رَسُولُ اللهِ ﷺ لِيُصْلِحَ بَيْنَهُمْ فَحَضَرَتِ الصَّلَاةُ فَأَذَّنَ بِلَالٌ وَانْتَظَرَ رَسُولَ اللهِ ﷺ فَاحْتَبَسَ فَأَقَامَ الصَّلَاةَ وَتَقَدَّمَ أَبُو بَكْرٍ يَؤُمُّ النَّاسَ
29.27 [Machine] Directing the governor to consider and enforce the verdict.
٢٩۔٢٧ تَوْجِيهُ الْحَاكِمِ رَجُلًا وَحْدَهُ لِلنَّظَرِ فِي الْحُكْمِ وَإِنْفَاذِهِ
[Machine] Narrated Abu Hurayrah, Zayd ibn Khalid, and Shibl: We were with the Prophet ﷺ when a man came to him and said: "I adjure you by Allah, except what you have decreed among us with the Book of Allah." The Prophet ﷺ said: "Say." He said: "Indeed, my son was a shepherd for this man, and he committed adultery with his wife. So I ransomed myself from him with a hundred sheep and a servant, and they both informed me about stoning his son. So I ransomed him, and then I asked the knowledgeable men, and they informed me that there should be a hundred lashes and banishment for a year on my son." The Prophet ﷺ said to him: "By the One in whose hand is my soul, I will judge between you with the Book of Allah. The hundred sheep and the servant shall be returned to you, and your son shall be lashed a hundred times and banished for a year. Go, O Unais, and announce about this woman, for if she confesses, then stone her." So he went to her and she confessed, so he stoned her. Abu 'Abdur-Rahman said: We do not know anyone who narrated it from Sufyan on the authority of Shibil, except Malik, from Az-Zuhri, from 'Ubaidullah, from Abu Hurayrah and Zayd ibn Khalid. Bukayr ibn al-Ashajj narrated it from 'Amr ibn Shu'aib, from Az-Zuhri, from 'Ubaidullah ibn 'Abdullah, from Abu Hurayrah. And the hadith of Malik and 'Amr ibn Shu'aib is more correct than the narration of Ibn 'Uyaynah and Shibl. Yunus ibn 'Abd al-A'la said: Ibn Wahb informed us, saying: I heard Malik ibn Anas say...
عَنْ أَبِي هُرَيْرَةَ وَزِيدِ بْنِ خَالِدٍ وَشِبْلٍ قَالُوا كُنَّا عِنْدَ النَّبِيِّ ﷺ فَقَامَ إِلَيْهِ رَجُلٌ فَقَالَ أَنْشُدُكَ بِاللهِ إِلَّا مَا قَضَيْتَ بَيْنَنَا بِكِتَابِ اللهِ قَالَ قُلْ قَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا فَزَنَا بِامْرَأَتِهِ فَافْتَدَيْتُ مِنْهُ بِمِائَةِ شَاةٍ وَخَادِمٍ كَانَا أَخْبَرَانِي عَلَى ابْنِهِ الرَّجْمَ فَافْتَدَى مِنْهُ ثُمَّ سَأَلْتُ رِجَالًا مِنْ أَهْلِ الْعِلْمِ فَأَخْبَرُونِي أَنَّ عَلَى ابْنِي جَلْدَ مِائَةٍ وَتَغْرِيبَ عَامٍ فَقَالَ لَهُ النَّبِيُّ ﷺ «وَالَّذِي نَفْسِي بِيَدِهِ لَأَقْضِيَنَّ بَيْنَكُمْ بِكِتَابِ اللهِ الْمِائَةُ شَاةٍ وَالْخَادِمُ تُرَدُّ عَلَيْكَ وَعَلَى ابْنِكَ جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ اغْدُ يَا أُنَيْسُ عَلَى امْرَأَةِ هَذَا فَإِنِ اعْتَرَفَتْ فَارْجُمْهَا» فَغَدَا عَلَيْهَا فَاعْتَرَفَتْ فَرَجَمَهَا قَالَ أَبُو عَبْدِ الرَّحْمَنِ لَا نَعْلَمُ أَحَدًا تَابَعَ سُفْيَانَ عَلَى قَوْلِهِ وَشِبْلٍ رَوَاهُ مَالِكٌ عَنِ الزُّهْرِيِّ عَنْ عُبَيْدِ اللهِ عَنْ أَبِي هُرَيْرَةَ وَزِيدِ بْنِ خَالِدٍ وَرَوَاهُ بُكَيْرُ بْنُ الْأَشَجِّ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنِ الزُّهْرِيِّ عَنْ عُبَيْدِ اللهِ بْنِ عَبْدِ اللهِ عَنْ أَبِي هُرَيْرَةَ فَقَطْ وَحَدِيثُ مَالِكٍ وَعَمْرِو بْنِ شُعَيْبٍ أَوْلَى بِالصَّوَابِ مِنْ قَوْلِ ابْنِ عُيَيْنَةَ وَشِبْلٍ أَخْبَرَنَا يُونُسُ بْنُ عَبْدِ الْأَعْلَى قَالَ حَدَّثَنَا ابْنُ وَهْبٍ قَالَ سَمِعْتُ مَالِكَ بْنَ أَنَسٍ
Two men brought a dispute before the Messenger of Allah ﷺ. One of them said: Pronounce judgement between us in accordance with Allah’s Book, Messenger of Allah! The other who had more understanding said: Yes, Messenger of Allah! Pronounce judgement between us in accordance with Allah’s Book, and allow me to speak. He (the Prophet) said: Speak, He then said: My son who was a hired servant with this(man) committed fornication with his wife, and when I was told that my son must be stoned to death, I ransomed him with a hundred sheep and a slave girl of mine; but when I asked the learned, they told me that my son should receive a hundred lashes and be banished for a year, and that stoning to death applied only to man’s wife. The apostle of Allah ﷺ replied: By him in whose hand my soul is, I shall certainly pronounce judgment between you in accordance with Allah’s Book. Your sheep and your slave girl must be returned to you, and your son shall receive a hundred lashes and be banished for a year. And he commanded Unias al-Aslami go to that man’s wife, and if she confessed, he should stone her to death. She confessed and he stoned her. (Using translation from Abū Dāʾūd 4445)
أَنَّ رَجُلَيْنِ أَتَيَا رَسُولَ اللهِ ﷺ يَخْتَصِمَانِ إِلَيْهِ فَقَالَ أَحَدُهُمَا اقْضِ بَيْنَنَا بِكِتَابِ اللهِ وَقَالَ الْآخَرُ وَكَانَ أَفْقَهَهُمَا أَجَلْ فَاقْضِ بَيْنَنَا بِكِتَابِ اللهِ وَائْذَنْ لِي فِي أَنْ أَتَكَلَّمَ قَالَ تَكَلَّمَ قَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا وَإِنَّهُ زَنَا بِامْرَأَتِهِ فَأَخْبَرَنِي أَنَّ عَلَى ابْنِي الرَّجْمَ فَافْتَدَيْتُ مِنْهُ بِمِائَةِ شَاةٍ وَجَارِيَةٍ ثُمَّ إِنِّي سَأَلْتُ أَهْلَ الْعِلْمِ فَأَخْبَرُونِي أَنَّمَا عَلَى ابْنِي جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ وَإِنَّمَا الرَّجْمُ عَلَى امْرَأَتِهِ قَالَ رَسُولُ اللهِ ﷺ «وَالَّذِي نَفْسِي بِيَدِهِ لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللهِ أَمَّا غَنَمُكَ وَجَارِيَتُكَ فَرُدَّ إِلَيْكَ وَجَلَدَ ابْنَهُ مِائَةً وَغَرَّبَهُ عَامًا وَأَمَرَ أُنَيْسًا أَنْ يَرْجُمَ امْرَأَةَ الْآخَرِ إِنِ اعْتَرَفَتْ فَاعْتَرَفَتْ فَرَجَمَهَا»
29.28 [Machine] The judge's signal to the opponent for reconciliation.
٢٩۔٢٨ إِشَارَةُ الْحَاكِمِ عَلَى الْخَصْمِ بِالصُّلْحِ
That ʿAbdullah bin Abi Hadrad Al-Aslami owed him some debt. Kaʿb met him and caught hold of him and they started talking and their voices grew loudest. The Prophet ﷺ passed by them and addressed Kaʿb, pointing out to him to reduce the debt to one half. So, Kaʿb got one half of the debt and exempted the debtor from the other half. أَنَّهُ كَانَ لَهُ عَلَى عَبْدِ اللهِ بْنِ أَبِي حَدْرَدٍ الْأَسْلَمِيِّ دَيْنٌ فَلَقِيَهُ فَلَزِمَهُ فَتَكَلَّمَا حَتَّى ارْتَفَعَتِ الْأَصْوَاتُ فَمَرَّ بِهِمَا رَسُولُ اللهِ ﷺ فَقَالَ «يَا كَعْبُ» فَأَشَارَ بِيَدِهِ كَأَنَّهُ يَقُولُ النِّصْفُ فَأَخَذَ نِصْفًا مِمَّا عَلَيْهِ وَتَرَكَ نِصْفًا
29.29 [Machine] The judge's indication towards the opponent with forgiveness
٢٩۔٢٩ إِشَارَةُ الْحَاكِمِ عَلَى الْخَصْمِ بِالْعَفْوِ
"I saw the Messenger of Allah when the heir of a victim brought the killer, leading him by a string. The Messenger of Allah said to the heir of the victim: Will you forgive him?' He said: 'No., He said: 'Will you accept Diyah?' He said: 'No.' He said: 'Will you kill him?' He said: 'Yes.' He said" 'Take him away (to kill him).' When he took him and turned away, he turned to those who were with him, and called him back, and said to him: 'Will you forgive him?' He said: No.' He said: 'Will you accept Diyah?' He said: No.' He said: 'Will you kill him?' He said: 'Yes.' He said: 'Take him away.' Then the Messenger of Allah said: 'If you forgive him, he will carry your sin and the sin of your companion (the victim).' So he forgave him and left him, and I was him dragging his string." شَهِدْتُ رَسُولَ اللهِ ﷺ حِينَ جِيءَ بِالْقَاتِلِ يَقُودُهُ وَلِيُّ الْمَقْتُولِ فِي نِسْعَةٍ فَقَالَ رَسُولُ اللهِ ﷺ لِوَلِيِّ الْمَقْتُولِ «أَتَعْفُو؟» قَالَ لَا قَالَ «تَأْخُذُ الدِّيَةَ؟» قَالَ لَا قَالَ «فَتَقْتُلُهُ» قَالَ نَعَمْ قَالَ «اذْهَبْ» فَلَمَّا ذَهَبَ فَوَلَّى مِنْ عِنْدِهِ دَعَاهُ فَقَالَ «أَتَعْفُو؟» قَالَ لَا قَالَ «أَتَأْخُذُ الدِّيَةَ؟» قَالَ لَا قَالَ «فَتَقْتُلُهُ؟» قَالَ نَعَمْ قَالَ «اذْهَبْ بِهِ» فَقَالَ رَسُولُ اللهِ ﷺ عِنْدَ ذَلِكَ «أَمَا إِنَّكَ إِنْ عَفَوْتَ عَنْهُ يَبُوءُ بِإِثْمِهِ وَإِثْمِ صَاحِبِكَ» فَعَفَا عَنْهُ وَتَرَكَهُ فَأَنَا رَأَيْتُهُ يَجُرُّ نِسْعَتَهُ [418] 5935 أَخْبَرَنَا مُحَمَّدُ بْنُ بَشَّارٍ قَالَ حَدَّثَنَا يَحْيَى قَالَ حَدَّثَنَا جَامِعُ بْنُ مَطَرٍ الْحَبَطِيُّ عَنْ عَلْقَمَةَ بْنِ وَائِلٍ عَنْ أَبِيهِ عَنِ النَّبِيِّ ﷺ مِثْلَهُ قَالَ يَحْيَى وَهَذَا أَحْسَنُ مِنْهُ
29.30 [Machine] The Judge's signal to the opponent with gentleness.
٢٩۔٣٠ إِشَارَةُ الْحَاكِمِ عَلَى الْخَصْمِ بِالرِّفْقِ
An Ansari man quarreled with Az-Zubair in the presence of the Prophet ﷺ about the Harra Canals which were used for irrigating the date-palms. The Ansari man said to Az-Zubair, "Let the water pass' but Az-Zubair refused to do so. So, the case was brought before the Prophet ﷺ who said to Az-Zubair, "O Zubair! Irrigate (your land) and then let the water pass to your neighbor." On that the Ansari got angry and said to the Prophet, "Is it because he (i.e. Zubair) is your aunt's son?" On that the color of the face of Messenger of Allah ﷺ changed (because of anger) and he said, "O Zubair! Irrigate (your land) and then withhold the water till it reaches the walls between the pits round the trees." Zubair said, "By Allah, I think that the following verse was revealed on this occasion": "But no, by your Lord They can have No faith Until they make you judge In all disputes between them." أَنَّ رَجُلًا مِنَ الْأَنْصَارِ خَاصَمَ الزُّبَيْرَ إِلَى رَسُولِ اللهِ ﷺ فِي شِرَاجِ الْحَرَّةِ الَّتِي يَسْقُونَ بِهَا النَّخْلَ فَقَالَ الْأَنْصَارِيُّ سَرِّحِ الْمَاءَ يَمُرُّ فَأَبَى عَلَيْهِ فَاخْتَصَمُوا عِنْدَ رَسُولِ اللهِ ﷺ فَقَالَ رَسُولُ اللهِ ﷺ لِلزُّبَيْرِ «اسْقِ يَا زُبَيْرُ ثُمَّ أَرْسِلْ إِلَى جَارِكَ» فَغَضِبَ الْأَنْصَارِيُّ فَقَالَ يَا رَسُولَ اللهِ أَنْ كَانَ ابْنَ عَمَّتِكَ فَتَلَوَّنَ وَجْهُ رَسُولِ اللهِ ﷺ ثُمَّ قَالَ «يَا زُبَيْرُ اسْقِ ثُمَّ احْبِسِ الْمَاءَ حَتَّى يَرْجِعَ إِلَى الْجَدْرِ» فَقَالَ الزُّبَيْرُ وَاللهِ إِنِّي لَأَحْسِبُ هَذِهِ الْآيَةَ أُنْزِلَتْ فِي ذَلِكَ {فَلَا وَرَبِّكَ لَا يُؤْمِنُونَ} [النساء 65]
29.31 [Machine] Does the judge intervene on behalf of the opponents before the judgment?
٢٩۔٣١ هَلْ يَشْفَعُ الْحَاكِمُ لِلْخُصُومِ قَبْلَ فَصْلِ الْحُكْمِ؟
The husband of Barirah was a slave called Mughith. It is as if I can see him walking behind her weeping, with the tears running down onto his beard. The Prophet [SAW] said to Al-'Abbas: "O 'Abbas, are you not amazed by the love of Mughith for Barirah and the hatred of Barirah for Mughith?" The Messenger of Allah [SAW] said to her: "Why don't you take him back, for he is the father of your child?" She said: "O Messenger of Allah, are you commanding me (to do so)?" He said: "I am just interceding." She said: "I have no need of him." (Using translation from Nasāʾī 5417)
يُقَالُ لَهُ مُغِيثٌ كَأَنِّي أَنْظُرُ إِلَيْهِ يَطُوفُ خَلْفَهَا يَبْكِي وَدُمُوعُهُ تَسِيلُ عَلَى لِحْيَتِهِ فَقَالَ النَّبِيُّ ﷺ لِلْعَبَّاسِ «يَا عَبَّاسُ أَلَا تَعْجَبُ مِنْ حُبِّ مُغِيثٍ بَرِيرَةَ وَمِنْ بُغْضِ بَرِيرَةَ مُغِيثًا؟» فَقَالَ لَهَا النَّبِيُّ ﷺ «لَوْ رَاجَعْتِيهِ فَإِنَّهُ أَبُو وَلَدِكِ» فَقَالَتْ يَا رَسُولَ اللهِ أَتَأْمُرُنِي؟ قَالَ «إِنَّمَا أَنَا شَفِيعٌ» قَالَتْ فَلَا حَاجَةَ لِي فِيهِ قَالَ أَبُو عَبْدِ الرَّحْمَنِ هَذَا حَدِيثٌ صَالِحٌ
